Yes. I thank the hon. Lady for her intervention. That is absolutely why this debate is so important—because we cannot deny the genocide any longer. It has to be recognised by this Government, because we will be—we are—an outlier.
Stalin set out to destroy the Ukrainians. The Ukrainians were not in the grasp of famine. He deported the cultural elite and suppressed Ukrainian culture, and there was the breaking of the rural communities. Stalin’s closure of the borders and refusal to send aid, despite selling millions of tonnes of grain to the west, are yet further proof. His desire to end Ukrainian identity is absolutely clear, and Soviet actions in the aftermath of the Holodomor—decimated villages were resettled with ethnically Russian communities—are conclusive.
Raphael Lemkin put the matter very clearly in a speech at the 20th commemoration of the Holodomor in New York City in 1953. He described the Holodomor as
“perhaps the classic example of Soviet genocide, its longest and broadest experiment in Russification—the destruction of the Ukrainian nation.”
He recognised that there were no attempts at “complete annihilation”, as had taken place in the holocaust. However, his most powerful quote is as follows:
“And yet, if the Soviet program succeeds completely, if the intelligentsia, the priests and the peasants can be eliminated, Ukraine will be as dead as if every Ukrainian were killed, for it will have lost that part of it which has kept and developed its culture, its beliefs, its common ideas, which have guided it and given it a soul, which, in short, made it a nation rather than a mass of people.”
The Lemkin quote sets out very clearly why the Holodomor amounts to a genocide. It also leads me on perfectly to another reason why today’s debate is so important. Those words, delivered by him 70 years ago, resonate with us today. Ukraine is once again threatened by Russian expansionism. Thankfully, Stalin failed, and the culture, beliefs and common ideas, the very soul of Ukraine, survived. On countless occasions in the last year, we have paid tribute in this House to the spirit and soul of the Ukrainian people in their battle against Putin.
The UK Government should always recognise crimes against humanity, including genocide, wherever they happen. In my last debate on this subject, it was suggested to me that official international recognition is less important than the memory of these events in defeating genocide. I do not agree. In my experience of serving on the Select Committee on International Development, I have visited both Rwanda and Bosnia, and have seen the peace processes that followed the Rwanda genocide and the Srebrenica massacre. Those have both been recognised as genocides by the UK Government, and that matters to the people. In any case, the Holodomor is now 90 years ago. Although my local Ukrainian community is brilliant at arranging annual commemorations and campaigning on this issue, the Holodomor is now almost out of human living memory. International recognition is absolutely crucial for local communities, and it is no surprise that the Ukrainian Government have welcomed a host of countries’ recognising the Holodomor as a genocide.
Recognition matters to the other side, too. In October 2022, when Russian forces took Mariupol, they tore down the Holodomor memorial, saying that it represented disinformation at the state level. It is clearly important to both the victims and the perpetrators when such an event is formally recognised.
That brings me on to my second point about recognition. I said that the Government should always recognise genocide when it occurs, and that is true, but in this case there is an even more obvious reason to do so. Ukraine is threatened again, and its strongest allies around the world are standing up and supporting it. That is why the delegation went a couple of weeks ago to stand in solidarity with the Ukrainian nation and say, “We support you.”
As the hon. Member for Putney (Fleur Anderson) said, Canada, Ireland, Australia and many other countries have long recognised the Holodomor as a genocide. In May 2022, the US Congress passed a resolution recognising the Holodomor as a genocide and condemning Soviet policies that prevented the delivery of humanitarian aid and people from escaping. There are clear overtones of what is happening in current times. Germany, Romania and Moldova recognised the Holodomor as recently as November 2022, so we are fast becoming an international outlier by refusing to acknowledge the suffering of the Ukrainian people at the hands of the Soviets in the 1930s, while at the same time supporting them in their fight today.
In the war on Ukraine, as I heard during my visit, Russians have been accused of crimes against humanity. We saw evidence of that. We saw the piled-up, burned-out, shot-at cars of people who were trying to escape the Russians. Civilians were slaughtered as part of what Russia is doing to Ukraine. We must give confidence to the Ukrainian Government and the international legal order that the UK Government and Parliament will not stand for abuses of human rights and war crimes. We can do that by recognising where genocide took place. Indeed, that may be important in the future. I raised this matter with the Foreign Secretary in the House in February, and he noted that Putin has himself said
“that his intention is to eradicate the whole concept of Ukraine.”—[Official Report, 20 February 2023; Vol. 728, c. 60.]
If that is not genocide, I do not know what is.
A final reason why it is important officially to recognise the Holodomor as a genocide is because of our Ukrainian communities in the UK. Since February 2022, thanks to the generosity of the British people, those communities have increased exponentially in size. I know from my experience in Derbyshire that it would mean a huge amount to Ukrainians in the UK if we were able to recognise the Holodomor as a genocide. I met a family on Friday who said, “Please, get the Government to recognise it. It would mean so much to the people of Ukraine.”
I therefore have two asks of the Minister. First and most importantly, will he please reconsider the official Government position that a genocide will be recognised only after a court has adjudicated on it, given the evidence that I set out, and the unique circumstances? In the light of the war in Ukraine, we need to show our support for our allies; we need to show Putin that attempts to eradicate the Ukrainian people will not be tolerated. If the US, Germany, Canada, Australia and Ukraine can recognise the genocide, we can and should, too, particularly if it can have an impact on the war.
Secondly, if His Majesty’s Government are unable to break their policy and recognise the Holodomor—I hope I am wrong about that—would the Minister be willing to arrange a debate on the issue, and a meaningful vote on it on the Floor of the House, so that the UK Parliament can at least can show its support for Ukraine, and designate the Holodomor a genocide?
My hon. Friend is absolutely right to ask for a parliamentary debate, which would show that there is a lot of sympathy for officially designating the Holodomor a genocide. She may be aware that the European Parliament voted to do so by 507 votes; only 12 voted against. That sent a powerful signal to Ukraine that the European Parliament was behind it.

Commons ChamberI thank the hon. Gentleman for the point he made about the speed of our technical response. The urban search and rescue team that we have dispatched are world-class, and they have world-class equipment. With regard to the humanitarian access routes, I will be speaking to Martin Griffiths at the UN later this afternoon. I know that at both ministerial and official level we will be liaising with our international partners to ensure that we co-ordinate on what Turkey needs for the response. I have already authorised the deployment of a medical assessment team. We will work closely with our international partners to make sure we address the further stages of requirement, and the requirement will evolve over time.
In Syria, we will deploy support by working through organisations such as the Red Crescent and the UN. On what more we can do for those dislocated people, we will co-ordinate with the Turkish authorities and those active in Syria as best we can, and we will make any decisions in due course.
Yesterday I was able to contact my opposite number in the Turkish delegation to the Council of Europe. He described the situation in Turkey as “overwhelming”. He has written to us to thank us for all that we have done. Does my right hon. Friend agree that we should do as much as possible to help the Turks in this terrible situation?
My hon. Friend makes an incredibly important point. The scale of this catastrophe is one that we are unused to. Sadly, this situation is almost unprecedented for the very reasons mentioned: the fact that this part of Turkey and Syria—particularly Syria—has been on the receiving end of a huge amount of violence already; the time of year; and because we are seeing multiple shocks and it is entirely feasible that there may be more. We will, of course, work very closely with our Turkish friends and allies and our international partners in the ongoing assessment of need and our response to that.

Is the Minister aware that last week at the Council of Europe we held a debate on this very subject? The benefit of that debate was that both the Azeris and the Armenians were present and participating. It was a tense diplomatic stand-off, because there are other, bigger powers involved in the situation. Does he agree that the situation must be approached very carefully?

Commons ChamberI entirely agree with that, but in more direct response to my right hon. Friend the Member for Rayleigh and Wickford (Mr Francois), the timidity of the Germans not just to release their own tanks, but to allow the tanks of other nations, such as Poland, to be sent into the conflict to support the Ukrainians sends more than a signal of timidity—it is appeasement. I am sorry to use that word, which I know has a loaded connotation, but it is appeasement. However, we must congratulate Germany on having come a very long way from the days of Gazprom being chaired by a former Chancellor of Germany and Angela Merkel making Germany dependent on Russian gas as a matter of policy. We have come a long way, and we should welcome the fact that Germany has committed to spend €100 billion more on defence, but we are still yet to see what that really means, and it means nothing if Germany is not prepared to help send heavy armour into this conflict.
If I may say so, we have committed to send 12 tanks, but why not 120 tanks? What are our tanks for? Are they there to sit around on Salisbury plain and in Germany to decorate the British Army’s capability, or should we tool them up and get them into this conflict so that the taxpayer can actually get value for money out of this investment? If necessary, we can launch an urgent operational requirement to acquire some more tanks to replace those that we will probably not ever see again in our own country.
I will, but I do want to press on, and I will probably be overrunning my time very shortly.
I will try not to interrupt my hon. Friend for too long. Does he agree with me that the timidity on the part of the UK is exampled by the fact that when I asked Zelensky how many air defence missile systems he had, he said 10%—that is all? When I got back to the UK, there was an email from a well-known Cabinet Minister saying, “Be very quiet about this, because we do not want to stress the fact that we are giving him so few.” Does my hon. Friend agree that that is a prime example of such timidity?
We should not trash what the Government have done, which is considerable, but we should point out that the failure to do much more—much more—is going to cost us in the short term, the medium term and the long term. We must also dispense with the false hopes that some kind of regime change would be likely to reverse the Russian urge to control its near abroad, or to use its army as a tool for suppressing dissent and keeping the country together.
My conclusion is that if the UK is going to help lead the NATO alliance, which protects Europe against Russia, we need meaningful land power to make an effective contribution, supported by mobile air cover and a Navy to deliver the Army to where the action is. For that, we need a new mobilisation system to come out of the integrated review refresh, and a procurement system to back it up that looks much more like a system of urgent operational requirements, as my right hon. Friend the Member for Rayleigh and Wickford suggested during the statement earlier this week, than the absurdly slow and costly peacetime procurement process that we somehow insist we have to maintain, despite its delivering—or not delivering at all—equipment, at vast expense, with limited capability.
This demands a drastic—even revolutionary—change of UK grand strategy, which I suppose is why we seem to avoid having one and, I suspect, why the IRR is stuck where it is. In the long term, how do we find a way to stop burgeoning state-backed health and welfare systems crowding out defence and security spending? In the short term, Whitehall in general and the Ministry of Defence in particular must accept that, if we continue to spend defence money as we have done over the last 20 years, we really are lost. We need a complete revolution in defence acquisition and procurement, making it look and feel much more like a continuing series of urgent operational requirements—a system based on wartime emergency procedures that, historically, delivered much cheaper and more timely equipment. We need to regain the ability to adapt our force structure, kit and tactics to outmatch an active enemy, just as the Ukrainians have done and the Poles are doing.
Madam Deputy Speaker, I am drawing to a close. There are growing pockets of awareness and belief in the value of strategy in the civil service, the diplomatic service, the security services, the National Security Council, the MOD, the Foreign Office and No. 10, but Whitehall as a whole is still miles away from the kind of capability and capacity for constant strategic analysis and assessment that would provide Ministers with the right questions and might lead them to the right answer. Why do we not have a Minister in the Cabinet Office for national security who is responsible for answering on grand strategy? Without the right apparatus and the right culture in government, we will always be behind the curve of events, as we seem to be now, and mis-appreciating what is really happening. We need to find the right answers to the new and evolving threats the UK and the whole of the free world must confront before it is too late.
When I started the process in the Council of Europe that had Russia expelled, I was unsure where it would end up. One of the things I have done since then is to introduce what I hope will turn into a new convention or treaty that will hold Russia to account for its aggression against the environment. Human lives and human aggravation are already accounted for, but there is nothing to be able to hold it to account for aggression against the environment.
Secondly, I have asked for a current affairs debate on two countries: Serbia and Kosovo. Why have I asked for a debate on Serbia and Kosovo? Because it is clear to me that Putin is making a big effort to make Serbia a second front to take our attention away from Ukraine. I think he is also doing it as a result of wanting to expand Russia. It is a pretty good example of that.
In 2015, the Russian state media, Sputnik, began broadcasting anti-EU and anti-NATO disinformation. It began broadcasting it not from Russia, but in the western Balkans from its regional base in Belgrade. Only at the end of last year, on 13 December, a rally was held in Belgrade to demand the intervention of the Serbian Government in Kosovo. Members may think there is nothing to be said about that, but many of the people attending that rally were waving Russian flags and chanting hateful and racist comments.
In fact, it is even worse than that. The state-controlled media in Serbia simply broadcasts Russian propaganda and has recently accused Ukraine of killing its own civilians, when in fact those civilians were being killed by Russian missile attacks.
I am glad my hon. Friend has taken away a large part of what I was going to say, which has made it much easier to concentrate.
Russia and Belarus have provided Serbia with 14 MiG-29 fighter jets. Eight are donations from Belarus and six are from Russia, and Serbia has bought the rest. Russia has also beefed up Serbia with 30 T-72 tanks and 30 other armoured vehicles. The Pantsir-S1 air defence system has reportedly also been sold to Serbia, along with the longer-range Buk air defence system. A shipment of Kornet anti-tank missiles has also arrived from Russia. The co-operation in military activities has gone from 50 in 2016 to over 100 joint military exercises in 2021. It is no wonder that, according to the US Department of Defense, Serbia provides the “most permissive environment” for Russian influence in the Balkans. When Kosovo took reciprocity measures regarding the temporary licence plate issues in 2021, Serbia escalated the military provocation, flying Russia-donated MiG-29 fighter jets and continuing to make available Russian helicopters on the border with Kosovo.
We know the short-term reasons why Russia is doing this: to stop Kosovo having a role to play in the EU and in the Council of Europe. We have defied Russia in the Council of Europe and given Kosovo seats so it is able to participate in debates, even though, for the moment, it cannot vote; that is because of the opposition of Serbia and that will be dealt with.
This is a serious situation because it affects not just Kosovo. We must not forget that Serbia is also influential in Bosnia and Herzegovina. Hon. Members may have seen that, only last week, in the Republika Srpska, the Muslim part of Bosnia and Herzegovina, Milorad Dodik, the Bosnian Serb leader, with great pride said that he was giving Putin the highest medal of honour for his
“patriotic concern and love for Republika Srpska.”
I ask you. Members can judge for themselves what that concerned.
We are dealing with some very unpleasant people. The Republika Srpska has the site of the genocide of Srebrenica. We are not allowed to call it a genocide because the Serbians do not like that term being used for it, yet it was a genocide of almost 8,000 Muslim people killed in that area.
Our inability to call a genocide is not just limited to Serbia. Our biggest problem is that we simply will not and cannot call any action a genocide, even when it demonstrable, until it goes through the United Nations, yet other countries such as America have declared genocides in China; we sit silent.
It does not have to go to the UN; it could go to a reasonable court. In two recent cases in Germany—I have forgotten what the particular issue was—a genocide was declared and that has allowed us to pursue that. That is the position taken by a number of charities that take the lead in this area.
In order to keep an eye on what Russia is doing, we need to have our eyes open, we need to have eyes in the back of our head and we need to be aware of all of the incidents that are occurring around Europe. It is a great shame that the effect of Russia is creeping out of places such as Serbia and is affecting attitudes in the west to places such as Kosovo. I very much regret that and I hope that we can take that issue forward in supporting Kosovo against Serbia.

That this House has considered the West Balkans and the Council of Europe.
It is a pleasure to serve under your chairmanship, Ms Nokes, and a great pleasure to move the motion. I want to begin by saying that I have recently returned from a visit to Bosnia-Herzegovina, where I observed the presidential and parliamentary elections on behalf of the Council of Europe. It left me with a deep impression of a troubled state where nothing gets done. I will come back to that in due course.
First, I wish to thank three people: George Papandreou, the former Prime Minister of Greece, who has produced a solid paper on the Europeanisation of the western Balkans. I am grateful for his sharing of the information that he collected, even though his paper remains too European Union-centric in its overall thrust. The second person I want to thank is Sandy Moss, our permanent representative in Strasbourg. Thirdly, I thank the Parliamentary Assembly of the Council of Europe secretariat in London, which does so much for us, and particularly the work of Nick Wright, its leader who is with us today.
The western Balkans covers a number of countries, including Albania, Bosnia- Herzegovina, North Macedonia, Serbia and Kosovo. Most of those countries are members of the Council of Europe and have also applied to join the EU.
I know the hon. Gentleman is a member of PACE and I thank him for the updates on his work there. Does he agree that the Council of Europe has a key role to play in normalising bilateral relations in dispute resolution in the region?
I thank the hon. Lady very much for her question. That is a large part of what my speech is about. The Council of Europe has a pivotal role in the area in being able to take forward the sort of agenda that she has outlined. I am grateful to her for raising that.
The granting of candidate status to Moldova and Ukraine has not gone down well with the western Balkans states. We can all understand why. It has been seen for what it is: a political act that has left the western Balkans high and dry. It is seen as being driven by political expediency in view of the dreadful war in Ukraine. It has left a growing disenchantment with membership of the EU and with the EU itself, which will do nothing to increase peace in the region or provide stability, despite the agreed commitment to the shared values of human rights, democracy and the rule of law—the three principal values of the Council of Europe. That should have given the Council of Europe the inside track in working with the western Balkans to establish those values as the norm.
Despite calls over the years for the Council to take the initiative in the region, very little has been done. I will return to that. A catalysing activity for the region is the war in Ukraine. The influence of Russia in the region is enormous. As a starter, it has big strategic influence in energy, banking and real estate. Some of the countries support the sanctions that have been imposed on Russia. Albania, Kosovo, Montenegro and North Macedonia have done so. Bosnia-Herzegovina and Serbia have not. Serbia has signed a new three-year gas contract with Russia. We should note, too, that Russia is Serbia’s biggest supplier of arms—all sobering thoughts in a European context. The influence of Russia can therefore be seen to be felt very widely across the whole region.
In addition, two other players have a key role. Turkey’s activities have by and large been benign and focused on enhancing co-operation.
The hon. Gentleman is making an excellent and timely speech, and I praise his stewardship in leading parliamentarians on the Council of Europe. His mention of Turkey reminded me that there are elections in that country next year. Does he agree that the Organisation for Security and Co-operation in Europe also does sterling democracy-extending work in the Balkans and more widely in election monitoring? He mentioned Bosnia—he and I were observing the elections in Sarajevo last month—but such work extends to America, where I was election observing. The organisation also had border scrutineers in Ukraine during the lead-up to war. Does he further agree that its work has been vital?
I thank the hon. Lady for her comments, and it was a great pleasure to see her in Bosnia-Herzegovina where she was representing the OSCE. That was very much a joint mission to observe the elections, and I agree that the OSCE has a lot to offer, but today I shall concentrate on the relationship with the Council of Europe and what the Council can do, which perhaps has a longer-lasting effect in the region.
Turkey can play a role for good in the region and it has done much good work, but the second country that has a role to play there is Iran, whose activities cannot be described as beneficial. Iran, for example, is widely believed to be behind the attempted vote rigging that occurred in Bosnia-Herzegovina when the hon. Lady and I were there observing the recent elections. That vote rigging attempt was stopped, but it showed what Iran can do.
What can the Council of Europe do in the western Balkans? One of the key elements on which the Council should be concentrating is the rule of law, which is a principle that embeds all others. Furthermore, there are two broad areas where the Council has the edge over the EU, the first of which is developing and enhancing civil society across the region.
Without civil society, there can be no enduring and fundamental championing of the rule of law. We need a civil society that can be taken seriously and not just be one of those complainers. It needs to be active in promoting aspects of society such as good human rights. That is just the sort of area that the Council is trying to establish in Russia, although it faces great difficulties, but it should be much easier to achieve that in the western Balkans. That means programmes providing assistance and watertight governance, and ensuring that the systems—the Governments—accept the role that civil society can play.
Secondly, there is the broad area of concentrating on bringing the systems used by Governments more in line with the rule of law across Europe. Where are the extensive training programmes for the judiciary and its independence? I am aware of the Regional Rule of Law Forum for South East Europe, hosted by the AIRE—Advice on Individual Rights in Europe—Centre and Civil Rights Defenders, which has brought together some of the judges of the Court of Human Rights and the Venice Commission to establish best practice, but we need much more of that.
Where is the work with the Administrations to enable them to be willing to invite civil society into the reform process? Where is the work to increase the political will to do something about these issues, which will either increase democracy or provide a conflict with it that needs to be resolved? Where, too, is the ancillary but essential work of ensuring that the media are free?
Those are activities in which the EU is not, I am afraid, 100% active, but where the Council of Europe should be and could be. That requires a Council of Europe secretary-general who is prepared to roll up her sleeves and get out into the countries to sort out those programmes. Sadly, that is one component of the Council that is currently lacking. Instead, it has put three countries —Albania, Bosnia-Herzegovina, and Serbia—under monitoring procedures by the Parliamentary Assembly of the Council of Europe, while Montenegro and Macedonia have just come out of monitoring.
The hon. Gentleman mentioned that he recently observed elections in Bosnia and spoke at the Council of Europe about the aftermath of the Dayton agreement. Does he feel that the worsening situation in Bosnia-Herzegovina can be remedied?
The hon. Lady seems to have read my speech, because she is anticipating some of the points that I will make later. I made that point at the Council of Europe and I am happy to make it later if she does not mind waiting a few more minutes until I get to that part of my speech.
Kosovo has been caught up in internal Council of Europe committee meetings and wrangling for a long time. Monitoring can play a great part in helping countries move forward with their reforms, including established countries such as France, the Netherlands and even the UK—I am the monitoring rapporteur for Turkey—but the amount that can be done through monitoring, as opposed to active programmes, is limited. It is not a big stick to tell the countries what they have done wrong; it is much more about bringing PACE’s substantial resources to bear to help the country put right weaknesses that might have occurred in its human rights, rule of law or democracy.
How, for example, does PACE monitoring deal with political instability? If anyone thinks that political instability does not arise in that region, they should just look at two countries. We as a delegation are actively helping Kosovo to overcome the difficulties that it faces and become a full member of the Council of Europe, against Serbia’s objections which, of course, are backed by Russia.
Bosnia-Herzegovina contains Srebrenica—the site of a massacre of more than 8,000 Bosniak Muslim men and boys, which has been classed in the international courts as genocide. It might be thought that there is little to argue about, but Serbs do not accept that it was genocide, and Bosnia-Herzegovina has a mixed population.
Reconciliation, which is crucial for peace and security, requires an end to conflicting narratives about the past and a more vigorous prosecution of war crimes. That too is where civil society and the Council of Europe can play a key role. The council must not allow such disputes to fester while we put programmes in place, and we need good conflict resolution activity. If I were secretary-general of PACE—this is not a bid for election, although I am happy to entertain offers—I would seek to develop that area. It requires people with special skill and faith that the countries can come right.
The hon. Member for Ealing Central and Acton (Dr Huq) will agree that the general elections we observed in Bosnia and Herzegovina were generally well run and free. The polling booths, although sometimes a little eccentric—one was in someone’s front room—were generally well run. The only incident, to which I have already referred, occurred when those running a polling station turned up to open it with bags of polling forms that had already been completed.
A major problem, however, was that only three or four people were allowed in the polling booths at any one time. The queues stretched right out into the open air at times, because it took an average of 30 minutes for someone to vote because there were four very large, folded voting papers to read before they could identify their preferred candidates. It took that time to manage the paperwork. That is largely a result of the solution produced by the Dayton accord, which created an unsustainable constitutional system for the country. Sure, people were no longer voting with a gun pointed at them, but that cannot be the answer for the future. It cannot go on like that. Having three Presidents means that nothing ever gets decided. With a strong Muslim community, the country is divided into separate constitutional entities, all of which are threatening—at one time or another—to resign the country, such as the Republika Srpska. The high representative has already said that the country is
“facing the greatest existential threat of the post-war period”,
and its links with Russia are strong. It is a crazy and unsustainable situation. I congratulate Bosnia-Herzegovina on setting up such a large election-monitoring activity with both the OSCE and the Council of Europe, and other western organisations.
I have mentioned Kosovo. We as a delegation are actively supporting Kosovo, and have already offered to help it to become a full member of the Council of Europe. It can take its seats, but not vote, thanks to the work that we as a delegation did to encourage that as the first step for membership. I understand that our enthusiasm for Kosovo is the position of the UK Government as well.
It is difficult to comment on Albania without a comment on its Prime Minister. I have met Edi Rama, and did not find him to be the most conducive man for accepting the activities of the Council of Europe. We are aware of the number of Albanians, certainly the number of Albanian single men, who are coming across the channel, but Albania needs to make lots of progress on reforms to the judiciary and against corruption.
The big problem with Serbia is normalising its relationship with Kosovo and aligning its foreign policy away from Russia to a western, normal perspective. These both mean a lot of work, and a great deal of rethinking. It is interesting that the EU sees the help of the Council of Europe as crucial for enlarging the EU to include the western Balkans. It is essential for the UK too, but we should not try to do it alone at this stage. The UK should use my delegation to put pressure on the Council of Europe to take a more active role in the region and step up to the plate. It is not a question of money either; the Council of Europe Development Bank is able to help with the investment. We need a strategic approach, looking at the region as a whole. The question of migrants is a big factor in this, but we must move away from the narrow confines of nationalism and xenophobia, and the Council of Europe can play a major role in that.
I thank everyone who has participated in this debate. They have made it a very cross-party debate, as is typical of the Council of Europe, and as is typical of how I try to run the delegation. There are two things that I will recall from this debate. The first is the overall impression that the western Balkans matter to us, and that we need to spend a lot of time looking at them. The second is that when I first became the leader of the delegation, nobody in these sorts of debates had heard of the Council of Europe, or at least nobody quoted it, but today many people have quoted from the reports of the Council of Europe and many have referred to it. That is a fitting tribute both to me and to the delegation for the enormous work we have done to ensure that we continue to play a vital role in the Council of Europe. That is vital for Europe more widely and for making sure that we are well known and active across the region.

Will my right hon. Friend join me in congratulating President Zelensky on engaging directly with parliamentarians such as myself at the Council of Europe, where he spoke openly about his needs? It was in answer to a question of mine that he said he had only 10% of what he needed for missile defence systems.
I congratulate President Zelensky on his engagement with partners, both bilaterally and multilaterally, and I would like to put on record my thanks for the work that my hon. Friend the Member for Henley (John Howell) does to ensure that these issues are brought to people’s attention and for the huge amount of effort he puts into the UK’s position on the Council of Europe.

Commons ChamberI know the hon. Gentleman’s constituency well. I have had the opportunity of standing in some of the beautiful parts of it and seeing overhead some of the actions of our own forces, and I understand how close his constituents sometimes feel to our allies just the other side of the North sea, as well as their concerns. I welcome the fact that he and his party stand with us on supporting the succession process. We have been working very closely with many international partners on support for Ukraine and standing up against Russian aggression. Indeed, only yesterday I was in the European Parliament meeting some of my former colleagues from many countries, many of whom praised our Prime Minister for the leadership he has taken globally on the issue of Russia and Ukraine. We must prioritise NATO as an important contributor to our defence and our strategic defence, and that is the topic that we are discussing today—but yes, we talk to other organisations as well.
Will the Minister recognise with me the work of the UK delegation to the Council of Europe for the lobbying that we have undertaken of the Turkish delegation to get Turkey to change its mind over the admission of Sweden and Finland to NATO?
I thank my hon. Friend for his work leading Parliament’s delegation to the Council of Europe, which I heard being praised yesterday when I was in Strasbourg. We welcome the fact that agreement was reached by all members of NATO. The alliance’s strength is that it requires consensus. The end result—Finland and Sweden joining the alliance—is something to celebrate, and we encourage all members to ratify as quickly as possible.

I am the leader of the British delegation to the Council of Europe, which I declare as an interest, and it is a pleasure to serve under your chairmanship, Dame Maria.
It pains me to start on a slightly sour note, but we are having the debate here in Westminster Hall because successive Leaders of the House have said no to us being allowed Government time for a debate in the main Chamber. I believe that the number of Members who have put in to speak, and the many more who have shown interest in the debate, is an expression of the greatest interest in the subject. It is a shame that we will be unable to hear the full richness of contributions from members of the delegation and others due to time constraints. That is no criticism of Westminster Hall as a setting for the debate, but it is a request to the Minister to provide us with assistance in trying to raise the visibility and importance of the Council of Europe.
More people now understand what the Council of Europe is and what it does. As a delegation, we work hard to make our contribution in the plenary sessions of the Parliamentary Assembly, the committee meetings that take place between plenary sessions and more generally. After each plenary session, we publish, for example, a summary of what we have discussed and the character of the meeting. I brief lobby journalists before we go to the Council. We issue press releases on key subjects, such as the position of Russia and the fate of the British individuals sentenced to death. We have held seminars—well attended—with, for example, Vladimir Kara-Murza, a Russian dissident now imprisoned, and with Ahmet Yildiz on Turkey. Finally, after each meeting, I raise questions on the subjects of the debate we have had. This has dramatically increased the profile of the Council of Europe among parliamentarians, and perhaps more generally among members of the public. However, I appreciate that there is still a lot more to do to ensure that people do not confuse us with the European Union, an organisation with about half the number of member countries as the Council of Europe.
Given that the Council of Europe represents 47 countries and that its mission is to empower and promote our fundamental values of democracy, human rights and the rule of law, and given that we are seeing those values breached both by Vladimir Putin with his invasion of Ukraine and in China and elsewhere, does the hon. Gentleman agree that this place should put paramount importance on those fundamental values and the Council of Europe, and on debate such as this?
The Council of Europe is not responsible for China. It is responsible for what happens in Europe, and the three pillars of the Council of Europe—human rights, the rule of law and democracy—are crucial to its future. That is what we need to hold countries to.
The reason for making the remarks I made before taking an intervention is that the role of the Council of Europe has never been more important. For me, one of the proudest moments was when we expelled Russia from the Council. I am told that I was the first politician to ask for that to happen, in a letter to the Secretary-General, and I was pleased to see the support from the delegation for that action.
Thank heavens that the covid crisis has diminished substantially. The sort of diplomacy required simply cannot be carried out by Zoom or remotely. It is great for our effectiveness to be back in person, and I am pleased that newer members of the delegation can now see that what I said all along about understanding what the Council stood for being best achieved by their personal attendance was absolutely true. I am sure that other Members will want to comment on Russia during further consideration.
I am proud to be part of the UK delegation to the Council of Europe and to sit on committees and give speeches to raise important topical issues such as the war in Ukraine. I thank my hon. Friend for recently arranging for us to meet the Ukrainian delegation in Strasbourg to demonstrate the UK’s support. Does he agree with me on how essential it is that the UK continues to work in the Council of Europe? It is a vital part of our global Britain agenda and we must continue to lead on important international matters.
I completely agree with that intervention. I will come on to say something about that at the end of my speech; it is crucial to what we are about.
The Russian expulsion has, however, left the Council with a deficit, which this time we are keen to see professionally filled. I appreciate the need for reform of the Council, and we look forward to participating in that. It is bizarre that meetings have taken place at a ministerial level in which there has been little contact with the delegation, which has tremendous experience of the Council and its work, but I am grateful that the UK Government have agreed to provide an additional £2.8 million this year to help the Council out of the hole left by Russia’s expulsion. That gives us an opportunity to take advantage of the current situation to push the UK position forward in the full knowledge that we are participating fully in the future of the Council.
It is important to understand how the Council works. It works on the basis of putting forward conventions—international treaties—for countries to agree. Those set standards across a wider Europe in key areas. I will give the example of the Istanbul convention, which goes a long way to answering the question: what does the Council do for us? The Government have set 31 July as the date by which they expect to ratify the Istanbul convention on preventing and combating violence against women and domestic violence. Many of us regard it as a flagship convention of the Council of Europe and as the gold standard for the protection of women and girls in Europe. Dame Maria, you and I spoke at a debate on this subject that I organised in the covid period.
The Government signed the convention in 2012 and have been working since that date to strengthen UK laws to better protect women and girls—we like to change the law in this country before we finally ratify a treaty. The necessary Command Paper was laid in both Houses on 17 May. I hope that there will be no objections in the following 21 sitting days and that the convention will be ratified.
There are two reservations in the convention that the UK is allowed to make. The first concerns crimes in UK law that are not crimes in other territories, and the second relates to migrant victims. Members are free to ask Ministers questions about those caveats. That illustrates only too well how the Council works: a treaty that it is not compulsory to sign, where the arguments for or against are set out and fully debated, and where the successful signing of the treaty involves us as members of the delegation in pursuing the diplomacy involved through, for example, Westminster Hall debates; by encouraging meetings between Ministers and the President of the Parliamentary Assembly of the Council of Europe; and by our membership of the parliamentary network “Women Free from Violence”.
The Council is also active in the field of human rights, and never has there been a greater need to be on top of this issue internationally. I have already held a debate in the main Chamber on the future of the European Court of Human Rights because it does need reform. Non-governmental organisations have too much influence. Some of the judges could be more suitably qualified. Not only were Russia’s judges sent back for examination; the same has also happened with Iceland. But one of the biggest tests for the court is occurring in Turkey, where the Committee of Ministers—the second chamber of the Council—has begun infringement proceedings. The key question here is: are we to allow Turkey to infringe the court, or are we to take action? And what should that action consist of? Does it mean the expulsion of Turkey from the Council, or are there other routes to follow since we cannot do nothing? As one of the rapporteurs for the Council on Turkey, let me explain the situation in relation to Osman Kavala.
Kavala is a leading businessman and campaigner who has been sentenced to aggravated life imprisonment after a period of pre-trial detention. The Turkish authorities argue that the original court case has been complied with in relation to the European Court of Human Rights in that Kavala was released to be rearrested the following day. The court argues that its judgment applies to the whole of the evidence base for all charges brought against Kavala, which are lacking in any evidence. That is the source of the current impasse with the Turkish Government. Turkey faces many attempts at terrorism, for which I have great sympathy, but the question must be asked whether these anti-terrorism laws are too restrictive and contravene human rights. There are, of course, other examples besides the Kavala case.
That example illustrates the important work of the Council in monitoring countries to ensure they are complying with the three pillars of the Council: human rights, the rule of law and democracy. That work and election monitoring are important functions. While I can see there is room for joint monitoring exercises with the Committee of Ministers, this is an important element of what the Council does. I would not like to see it given away to another organisation, and the Council not to have a role.
There is plenty of opportunity for the Council to work with other organisations, such as the Organisation for Security and Co-operation in Europe. I have already had discussions with the head of the UK delegation to the OSCE, and we are looking at ways to work together more closely, but it would wrong to see the OSCE having more experience of election monitoring or in monitoring more generally.
A key question remains about the future role of the Council of Europe. I welcome the UK Government’s support for Kosovo to join the Council, which the delegation also supports. Many discussions on this have already started, in which we can, should and do participate. The recent Turin ministerial meeting is one such example. I am grateful for the attendance of my right hon. Friend the Foreign Secretary at that meeting. Another is the debate that took place at the standing committee in Dublin on the future discussions that will take place.
There is so much more that the Council could do in the area of the rule of law and in promoting democracy more widely across Europe. There are gaps in both those areas in many countries, and knowledge is needed to help them get the right answer. We stand ready to work in promoting that area. The delegation would value the chance to have more extensive discussions with the Foreign Office, and with other Ministers. We do have the experience of putting together programmes in this area.
Does the hon. Gentleman agree that one of the problems with the Council of Europe is that its work, importance and role are not fully understood, even by Members of this House, never mind the general public? I know he has worked hard on that. We need to have a much more active public relations initiative, explaining the value of the Council of Europe, its powers and the changes it can, and does, bring about among members states.
I agree fully with right hon. Gentleman. I try my hardest to push that as leader of the delegation. It is essential to get across what the Council is about, how it can help, and the role it now plays in—I have to use this expression—a post-Brexit Britain. It plays a vital role in ensuring that we have good relations with parliamentarians in other parts of Europe.
I will conclude by saying that putting down written questions after each debate at the Council of Europe brings home how wide those debates are, and how they affect policy across Government. Debates that relate to the Foreign Office account for about 30%. The rest cover a range of Ministries, from the Department for Work and Pensions to the Department for Digital, Culture, Media and Sport. I ask those questions I put to them to show the range of debates that we conduct, partly to ensure there is a written answer on record for the issues that have been discussed, and so that we understand what Government are doing. That is welcome, at least by members of the delegation, but we would welcome the Minister’s help in ensuring that the Government’s position can be put across when rapporteurs visit the country on behalf of the Council and need to see a Minister. I know that that is a pain, but without it the result does not look good and can leave us in an embarrassing position.
I am extremely grateful not just for the work of all members of the delegation—we try to operate on a genuinely cross-party basis wherever possible, and the number of Members here for the debate illustrates that—but for our utterly brilliant secretariat led by Nick Wright, to whom we would all like to pay our thanks.
I will come to the other people. Finally, on behalf of the delegation, I would like to pay thanks to three people in Strasbourg: Alan Mitchell, the president of the committee for the prevention of torture; Tim Eicke, our judge at the Court, to whom we are grateful for getting to know us and for sharing with us his expertise and experience; and our permanent representative Sandy Moss, whose assistance and co-operation is second to none and has been particularly helpful for the delegation.
The Council of Europe is crucial for our relationship with wider Europe, particularly after Brexit. It sets out a method of co-operation that can alienate no one. It is a major part of our international diplomacy, and Russia’s departure offers us an opportunity to make real change. I look forward to what the Minister has to say.
I am similarly grateful to the hon. Gentleman for that intervention. I am really concerned about the public discourse in these islands. If we believe in the rule of law, that means that we also believe in it when it is difficult or inconvenient for the Government of the day. The Scottish Government have been before the European Court of Human Rights as well on the issue of prisoners slopping out. It has been difficult for us, too, but if we sign up to a set of rules and to extrajudicial scrutiny, we need to allow that to run its course. Undermining the independence of the judiciary is a really, really dangerous place for us to go, so I urge everyone, from all points of the compass, to stop it.
Is the hon. Gentleman aware that we are arranging a tour around the European Court of Human Rights for members of the delegation, hopefully in the next session, so that they can see for themselves how it works and talk to some of the judges there?
That is a very interesting and helpful point. I hope that the hon. Gentleman is inviting the Home Secretary along as well. Perhaps we can arrange that, because my concern is that most ignorance is wilful. We saw an awful lot of wilful ignorance in the European Union debate, and we are seeing some in the Council of Europe debate as well.
I believe, with every fibre of my being, that we are an internationalist nation in Scotland, but the UK is as well, and signing up to these international structures allows decency to be promoted on a wider canvas—the European continent. We have heard how wide a range of organisations is covered within the Council of Europe. We can and should be an enthusiastic part of that, not an example of how to undermine it.
This has been a good debate, and I have been glad to take part in it. However, the SNP will always be an internationalist, outward-looking party, and I would happily work with anybody across this House to those ends.
I agree with the principles of what my hon. Friend is saying, and that applies to judgments of other international courts, including the International Court Of Justice, which the Government have also been taken to task over on a number of issues. I mentioned Ukraine, which is crucial in our focus, but the situation in the western Balkans is also very serious at the moment—the Minister is nodding her head. The Council of Europe has been playing a critical role there in strengthening judicial processes and promoting peace and democracy.
The case of Turkey has been mentioned. The Committee of Ministers’ decision to launch infringement proceedings against Ankara over the Osman Kavala case demonstrates its commitment to the Council’s central values without fear or favour. The hon. Member for Henley rightly referenced wider concerns about Turkey and its infringement of civil and political rights.
Will the hon. Member join us in supporting Kosovo’s membership of the Council of Europe, which will be coming forward later in the year?
I certainly would. I plan to visit Kosovo in the near future, and I am sure that that will be an issue on the agenda during my visit there and to the western Balkans. That is something I certainly support.
I want to end by asking the Minister a few questions. Can she give us some reassurances about the Government’s wider commitments to the Council of Europe and the ECHR? The Prime Minister has refused to rule out leaving the ECHR. We have seen the many trailed proposals about a so-called Bill of rights, which could diminish the role of the ECHR and undermine its positions. There is a serious risk of undermining some crucial human rights that we all enjoy. Also, it is worth mentioning the crucial role that the ECHR played in the Good Friday agreement. I would like to see the Minister give some reassurance on that point.
Secondly, can the Minister explain the reasoning behind the Government’s reservation of article 59 of the Istanbul convention, which protects migrant and refugee women from domestic abuse and violence? Finally, given the point I made about working together with allies, and given the scale of the challenges we face across Europe and the world, will she assure us that the Government will stop the unilateral approach that they seem to have drifted towards in recent weeks and months and, instead, work together?
It has already been stated that I try to run the delegation as a cross-party group, but it is important to bear in mind that it is also a cross-Houses group that includes Members of the House of Lords. I am grateful to Lord Foulkes for attending most of the debate. I thank everyone who has participated. It has been heartwarming to see such enthusiasm and agreement on the important things that the Council of Europe does. I hope that we can look forward to a much longer debate in the main Chamber.
I associate the Opposition parties with the hon. Member’s ambitions. He is assiduous in looking for ministerial responses, but the Minister did not answer my question, nor that of my hon. Friend the Member for Cardiff South and Penarth (Stephen Doughty). Will he join me in asking for responses from Ministers?

I am afraid I do not share the view of the hon. Member for Central Ayrshire (Dr Whitford) that the immediate recognition of a Palestinian state would advance the cause of peace. The Palestinian Authority’s unilateral efforts to achieve statehood outside the agreed framework of negotiations directly contravenes the 1993 Oslo accords and undermines the peace process. Those who support such attempts are regrettably sending the Palestinian leadership the message that it does not need to make the necessary compromises for a lasting peace or to establish stability.
Promoting peaceful coexistence in the region should not be looked at as a one-sided effort. In the Palestinian Authority, removing hate-filled material inciting violence against Israel and Jews in official PA school textbooks would be a welcome start. Young, impressionable Palestinian children are being indoctrinated to hate their neighbours and told that killing Israelis is an honourable act. And that is only the hatred espoused by the Palestinian Authority. In Gaza, the Hamas terror group recruits child soldiers who are taught to practice sniper shooting and how to launch anti-tank missiles. Video footage of children expressing their hope to die as martyrs, marching with weapons and burning Israeli flags, has been widely published online. Both sides will need to make the necessary compromises, but let us not forget that Israel has a track record of removing settlements and making land swaps in the interests of peace. Land borders can be negotiated, but hatred cannot be unlearned. Until the Palestinian leadership shares a message of peace and reconciliation, including acknowledging the Jewish connection to the land of Israel, peace remains unlikely.
Mahmoud Abbas is now in the 18th year of a four-year term as Palestinian Authority president, so I ask the Minister what more can be done to encourage the Palestinian Authority to reschedule last year’s postponed election. Just as our friends in the UAE, Bahrain and elsewhere have understood that peace with Israel will lead to shared prosperity and security, so too should we help the Palestinian leadership to boldly follow suit. It is deeply regrettable that the Palestinian Authority has opposed these landmark peace agreements, and I hope the opportunity presented by these accords will be seized to advance Israeli-Palestinian peace. Instead of supporting efforts to bypass direct peace talks, I urge the Government to work with international partners to address the issues that I have raised and support the Palestinian Authority to take a more constructive and a more democratic approach to the region and to these issues.

Commons ChamberAs I have said, we have a very tough anti-corruption regime, and we have used it. As a result of the work that we are doing with our allies, we have been clear that Russia would face massive consequences if there were to be an incursion into Ukraine.
As my right hon. Friend knows, I lead the UK delegation to the Council of Europe, of which Russia is a member, and where we have to deal with Russia on an almost daily basis. Will she join me in getting the Council of Europe, which is responsible for democracy and the rule of law across Europe, to take a firm stand against Russia?
I certainly agree with my hon. Friend. It is important that the Council of Europe takes a strong stand on this issue.
