We hope that all prisoners will be fully integrated into society when they come to be released from prison and will lead a law-abiding life of constructive citizenship. As I said a few moments ago, the Government will make clear their approach at the forthcoming Committee of Ministers meeting and in an announcement to Parliament in the usual fashion.

T7. Some 54,000 women lose their jobs each year due to pregnancy and maternity discrimination. The Secretary of State may remember the chaos of the early weeks of caring for a newborn, but the time limit for bringing an employment tribunal claim is just three months, so will he look again at this issue, as recommended by the Women and Equalities Committee, the Justice Committee and the Equality and Human Rights Commission, and extend the time limit for claims related to pregnancy and maternity discrimination?

As part of the consultations on introducing shared parental leave, I have had a number of discussions with employer representative groups and employers, as well as family representative groups, about the issues surrounding women returning to work after maternity leave. Those groups have included the British Chambers of Commerce, the CBI, the Federation of Small Businesses, the TUC and Working Families, as well as employers such as BT and Lloyds.

As someone who has three daughters, all of whom have children and have had maternity leave, and who have demanding jobs, may I tell the Minister that the Government’s record since 2010 is not good? Recent independent reports show that family incomes and women’s incomes have declined, and we still have not addressed the thing that prevents the most talented people in our country from getting back to work—the cost of child care. When will the Government tackle that?

The hon. Gentleman is right to mention the cost of child care, and the Government are well aware of the challenge that it poses for working mums and dads. That is exactly why we have announced a new tax break of £1,200 per child per year for child care costs. Just this week, we have extended the free early education entitlement to two-year-olds, and it will double next year to include the most disadvantaged 40% of two-year-olds. There is also an additional £200 million in universal credit. We recognise the important point he raises and are acting on it.

Will the Minister do everything she can to encourage employers to keep in touch with their employees during maternity leave? That would improve many of the challenges that exist.

My hon. Friend makes a very valid point. Ensuring that employers and employees stay in touch during the period of maternity leave can ease the return to work and make the process work better for everybody involved. The “keeping in touch days” that were introduced fairly recently—within the last few years—as part of maternity leave have helped in that. We are of course considering how that successful initiative can be extended further through the shared parental leave that we are introducing.

I know that the Minister will have every reason to agree with me about the importance of supporting maternity leave for working women. We wish her well. However, she will also be appalled by the figures that one in seven women on maternity leave lose their job and half return to jobs that are worse than those they left. Discrimination against someone just because they are on maternity leave is obviously illegal, but the Government have now decided that new mothers who want to take their case to an employment tribunal will have to pay £1,200 to do so. That is the equivalent of nine weeks’ maternity pay. Does she think that will make it easier or harder for new mothers budgeting for a young family to challenge maternity discrimination?

The right hon. Lady raises a variety of important points, and I thank her very much for her kind words. I agree that maternity discrimination is unacceptable—of course, it is also illegal. Any employer worth their salt would not dream of doing it, but some will. It is important that we proceed on the basis of evidence. I would be happy to look at the analysis I have requested from Slater and Gordon, which I understand did some of that research, because it does not necessarily tally with the figures that also exist which say that 84% of women return from maternity leave to the same job they had before. It is important we get to the bottom of that.

I understand the right hon. Lady’s concern on employment tribunal fees, but it is important to see the whole picture. It is not the case that most women who want to take up a case of maternity discrimination will be forced to pay such a fee. The vast majority of cases can be dealt with well outside the tribunal system. The Government’s employment law reforms have encouraged more cases to be conciliated at an early stage through ACAS. Only a tiny number of cases ultimately get to tribunal—300 went to a hearing last year. Anyone who wins their case has a good chance of having their fees paid by the employer if ordered by the tribunal. In addition, a remissions regime is in place for those who are unable to afford the fees.

2. What plans the Government have to bring forward legislative proposals for equal pay.

From October 2014, employment tribunals will be required to order an equal pay audit where an employer has broken the law on equal pay. The Government’s “Think, Act, Report” initiative promotes greater transparency on gender employment issues. More than 125 companies are now supporting the initiative, representing nearly 2 million employees.

Given that most part-time workers are women, that most low-paid jobs are part-time jobs, and that the average hourly wage for a woman doing part-time work is less than three quarters of the hourly wage of a full-time employee, will my hon. Friend the Minister use her energy and effectiveness with her team to ensure that women in part-time work get a fair deal and equal pay as soon as possible?

My right hon. Friend is right to raise the issues of part-time and full-time employment. One problem identified by, among others, the Women’s Business Council, is that there is often a shortage of senior roles available on a part-time or job-share basis. The Government are taking steps to help to improve the situation by extending the right to request flexible working to everyone, which should help to ensure that it becomes more of a cultural norm rather than an anomaly purely for parents. I take his point and we will continue to work on that.

I entirely agree with the right hon. Member for Bermondsey and Old Southwark (Simon Hughes) on part-time working, which makes things particularly difficult for women, but will the Minister also look at the problem of zero-hours contracts, which have a desperately difficult impact on women?

The hon. Lady will be glad to know that the Government are looking at zero-hours contracts. The Department for Business, Innovation and Skills, in which I am also a Minister, undertook an information-gathering exercise over the summer. We are looking closely at what can be done to prevent the abuse of zero-hours contracts where it exists.

1. What assessment she has made of the most recent statistics on differential earnings for women and men in the (a) public and (b) private sector.

The gender pay gap is falling and currently stands at 19% in the public sector and 26% in the private sector. The causes of the gender pay gap are varied: roughly a third can be attributed to education and the types of jobs women do; about a third can be attributed to work patterns and the need to take time out of the labour market, for example for caring; and the remaining third is unexplained, which could include discrimination. The Government are committed to tackling the gender pay gap and believe that we absolutely need to get it down.

I am grateful to my hon. Friend for her commitment on this issue. More than one in five of the lowest paid full-time women workers earn under £80 a week, and it is much worse for women in low pay than it is for men. Will she indicate that the Government have that in their sights and have a strategy for dealing with inequality across the wage range, particularly for those struggling at the very bottom end of the income scale?

My right hon. Friend is right to raise that issue. Figures from the Office for National Statistics show that the gender pay gap is lowest for those at the lowest end, with a 7% gap in the bottom 10%, compared with a 23% gap in the top 10%, but there is absolutely no room for complacency. This week, as he will know, we announced a 1.9% increase in the national minimum wage, which is set against a 0.8% increase in wages, according to the most recent ONS statistics. Of course, two thirds of the beneficiaries of that rise in the national minimum wage will be women.

The Government’s report, “Think, Act, Report: one year on”, states that 54 organisations have signed up to the Government’s voluntary equality pay scheme. Given that there are 6,000 businesses in the UK that employ more than 250 people, does the Minister think that a 0.9% sign-up rate demonstrates sufficient voluntary progress on equal pay?

Clearly, we want to increase the number of organisations signed up to “Think, Act, Report”, but we have also been focusing on those that employ the largest number of workers. The current figures show that more than 80 organisations and large-scale employers have signed up, which represents 1.3 million employees. I think that is a key figure, because 1.3 million employees are now protected by companies that are ensuring that they not only consider what they need to do to tackle the pay gap, but act on it and, importantly, through transparency, report on what they have been doing.

Section 78 of the Equality Act 2010 requires businesses that employ more than 250 people to measure and publish their gender pay gap figures. Will the Government implement that and, if not, what is the problem with doing so?

When the Government launched the “Think, Act, Report” initiative, we set out the fact that we believed it would be helpful if companies took a voluntary approach in pursuing this matter. Of course, we have not ruled out commencing that part of the 2010 Act at some future point, and we have also brought forward legislation—this measure is set out in the Enterprise and Regulatory Reform Bill—that will force organisations found guilty of breaching equal pay laws to conduct equal pay audits. I think that there is a clear message to be sent to employers: they should get their house in order on equal pay, or the equal pay audits will be coming down the track.

The Government are committed to reducing the pay gap and guaranteeing equal pay for women. The latest figure, based on median earnings, shows that the pay gap continues to narrow and currently stands at 19.7% for all employees, but there is, of course, much more to be done, because the existence of a pay gap is unacceptable.

We are making good progress with “Think, Act, Report”, which promotes gender equality and transparency. More than 60 major companies have signed up to it, representing more than 1.2 million people and more than 11% of the target work force.

What assessment has the Minister made of the impact on the retirement incomes of low-paid women of excluding all those who earn less than £9,440 a year from the new workplace pensions? Does she realise that 1 million people who could be saving for the future are being left out in the cold, and that 77% of them are women?

Saving for pensions is very important. That is why the Minister of State, Department for Work and Pensions, my hon. Friend the Member for Thornbury and Yate (Steve Webb), has been promoting workplace pensions. We are introducing the system gradually, because suddenly having to pay money into their pensions that they have not previously had to pay could have a real impact on people’s current incomes, but our plan is, over time, to ensure that everyone saves for a pension.

Does my hon. Friend agree that the introduction of shared parental leave will lead to more equality in the workplace, including equality in incomes? Men will be encouraged to take a greater share of child care, which will allow women to return to work earlier if they wish to do so.

I wholeheartedly agree with my hon. Friend. Shared parental leave is crucial in not just enabling families to share the care of their children in a way that works for them, but dealing with some of the inequalities which, sadly, persist in the workplace. We know, for example, that maternity discrimination still goes on. One of the positive side-effects of shared parental leave will be the reduction of incentives for employers who have been tempted to break the law, and who may now decide that that is not a sensible thing to do.

I can assure the hon. Gentleman that I will do that. We have made great progress in this country in recent years, including under the previous Government, on giving proper support to witnesses who have to appear in court. Obviously, it is most important to look after the most vulnerable witnesses, including children, who can be intimidated by the experience. We are looking at what we have in place now, and we hope to strengthen the arrangements.

Drug misuse in prisons has declined by 71% since the introduction of mandatory drug testing in 1996. The latest results from the surveying prisoner crime reduction study suggest that 7% to 8% of prisoners had their fist use of heroin in custody, while 81% had used drugs in the year before custody. The steps to tackle drug use include drug-free wings and drug-recovery wings; procuring a networked intelligence system; a comprehensive corruption-prevention strategy; new technology to tackle the availability of drugs and phones in prisons; and building on existing prison security measures.

I thank the Minister for that answer, but the fact that any prisoners first try heroin while in prison is shocking. The very concept of “drug-free wings” shows just how bad the situation has become. Will he undertake a thorough review of the supply routes by which drugs are getting into prisons—via visitors, staff or the mail system—and act to cut them off, so that all our prisons can be drug-free?

The hon. Lady is right, although the position has been historically improving over the past 16 years or so, and one should remember that prisons are mini-communities, with a high volume of legitimate communication with, and access to, the outside world. Prisons cannot be hermetically sealed, and she drew attention to the many different routes through which drugs are smuggled. However, we of course examine all the routes into prison, and act to interdict and address them with the resources available to us, including new technology.
