Commons ChamberThe Department of Health and Social Care has assessed and contacted 448 suppliers of medicine and has regular and detailed conversations with the industry.
I would say that we should not be scaring people unnecessarily. The Government have put in place a framework to ensure supply. We have also put in place an express freight service, which will give even more capacity on a 24-hour basis and between two to four days for larger pallets. There is additional capacity, and a huge amount of work has been done on storage, but this is an issue of mutual interest for the UK and the Commission, and we are working on it jointly.
Anyone who is facing cancer treatment wants to know that they can get the medicine and the medical devices they need as quickly as possible and with certainty. Dr Buscombe from the British Nuclear Medicine Society says that the system for delivering radioactive isotopes in the event of a no-deal Brexit is “fragile”. What does the Secretary of State say to patients who are concerned to hear that?
I was a Health Minister, and as part of business as usual there are always issues of supply, usually with around up to 50 lines. We have had it in the last few weeks with HRT, which is totally unconnected to Brexit. These are issues that the Department is well used to preparing for. It is in the interest of both sides to get this right. Two thirds of Ireland’s medicine comes through the land bridge in Great Britain. This is something that both sides are working to deliver because it is of interest to both of us.

Commons ChamberI have regular conversations with Cabinet colleagues on all aspects of our EU exit. The Chancellor has provided £4.2 billion to prepare for all areas of our exit.
The clue is in the hon. Gentleman’s own question. He talks about “unilaterally”. Clearly, GATT 24 would need to be agreed. I think all the leadership contenders recognise that.
Beckie Hart, the director of Yorkshire and the Humber CBI, said recently that many firms are unaware that it is not just their relationship with EU customers that is at risk from a no-deal Brexit, but relationships across the globe. Tonight, Hull MPs and the shadow Brexit Secretary are meeting the Hull and Humber chamber of commerce to discuss our region’s economic prospects under Brexit. What reassurances can the Secretary of State give to Humber businesses on what is being done to avoid a no-deal Brexit, and what is being done to prepare for it to minimise the damage to the northern powerhouse from years of underfunding and austerity from his Government?
The hon. Lady raises a number of issues within the question of how we are preparing for no deal. It is essential, which is why the Government are investing in that preparation. I am keen to see to us do so at pace. In terms of the wider economy, it is about looking at, if we were in a no-deal situation, what flexibilities we could exploit, what issues of mutual benefit to the EU and the UK we can agree on, and where the flexibilities are that we can work on with the industry in that particular region. Those are the discussions we are having with applicable sectors. We are looking at key sectors to the region, such as offshore wind, and seeing what support the Government could provide in that situation.
My hon. Friend has made an astute observation. He will be aware that 40% of Irish exports go through the short straits between Dover and Calais. We hear forecasts of delays at Calais from Labour Members, but it is not simply UK goods that will be delayed there; it will obviously be Irish exports too, as well as the many Irish imports.
There are a number of areas in which it is in Ireland’s interests to avoid the disruption of no deal. There has been very little debate in the UK about the impact on Ireland, and my hon. Friend is right to highlight it.
The hon. Lady will know that this is not Department for Transport questions; this is questions to the Department for Exiting the European Union, and she will know from the written ministerial statement we published yesterday that we have set out a framework. But in respect of Seaborne Freight it is worth reminding the House that it was a contract in which payments were linked to performance, and as the performance did not flow the payment did not go with it.

Commons ChamberI admire the hon. Gentleman’s honesty in setting out that his position is clearly to revoke article 50. These are arguments that were made before the referendum. We had a negotiation with the European Union, and we put that approach to the people in the referendum and said that they should decide. I think we should listen to their decision and follow it through.
In November 2018, the Government published an assessment of the future security partnership as set out in the political declaration. The political declaration itself recognises the shared threats faced by the UK and the European Union and provides a framework to safeguard our security. That framework, as the hon. Lady will know, covers law enforcement, judicial co-operation in criminal matters, foreign policy, and security and defence co-operation in areas where we hope to have mutual co-operation.
Protecting our national security from organised crime and terrorism is of course the first duty of any Government. My constituents want to know that we will still be able to participate in the European arrest warrant and share criminal record checks if or when we leave the EU, so what further progress has been made on what was put into the political declaration so many months ago?
The hon. Lady will appreciate that those matters are for the second phase of the discussions between us and the EU. To get to that second stage, I sincerely recommend that she support the withdrawal agreement. That is the only mechanism by which we will get to phase 2 of the negotiations, where we can discuss some of these matters, which are critically important to her constituents and to the country.

Commons ChamberThere has been a huge amount of engagement with the Scottish and Welsh Governments through the Joint Ministerial Committee and the Ministerial Forum, which I co-chair. A number of issues have been raised about Scotland’s place in Europe and our shared policy is to pursue, for instance, co-operation with Europe on universities. However, the hon. Gentleman will recognise that Scotland’s share of UK immigration is very low, and it is, as the Migration Advisory Committee has made clear, only really possible to have an immigration policy for the whole UK.
The Government have undertaken extensive work to identify the legislation essential to deliver our exit from the EU. In fact, as I speak, almost all the statutory instruments—93% of them—required for a functioning statute book on exit day have been laid before Parliament.
The Government have failed to pass the Trade Bill, the Agriculture Bill, the Fisheries Bill, the financial services Bill and the environment Bill, and they have even failed to introduce the EU withdrawal Bill. Does that not show those who think we are ready to leave in a no-deal situation on 12 April that the Government are not prepared for that at all?
I reject the assumption behind the question. As I stated, almost all the SIs required—93% of something like 600—have been passed. The hon. Lady is quite right that there are Bills currently in Parliament that are being discussed and that are going through both Houses. All those Bills provide for a range of negotiation outcomes, as she knows, including a no-deal scenario.
The hon. Member for Redditch (Rachel Maclean) appears to be on the receiving end of mentoring from her right hon. Friend the Member for New Forest West (Sir Desmond Swayne). It will probably be extremely helpful to her—it would be to any Member—and it is a great tribute to the right hon. Gentleman.
Can the Secretary of State just enlighten the House as to what he thinks has actually gone well during this first phase?
I think what has gone well in this first phase is that we have an agreement with the EU that gives certainty to EU citizens, that respects our legal obligations and that will ensure that there is no hard border on the border of Northern Ireland. In part, one of the achievements of both parties, but particularly of the Labour party, was the Good Friday agreement. It is why those Members in Northern Ireland get so agitated with Members on the hon. Lady’s Benches over their failure on the withdrawal process. We have a deal; it is on the table; and it is the only deal that the EU is willing to offer.

No, I do not believe that it would be best. We have to remember that we were all elected on manifestos that respected the referendum result, and we have to deliver on that. I do pay heed to Sir John Major, when he makes the point about how important it is that we protect the peace process and the Good Friday agreement. That is exactly what we seek to do through the negotiations with the EU.
The Government’s handling of this whole thing has been woeful. After yesterday’s shambles, I met staff of Reckitt Benckiser this morning, who told me that they are having to step up the preparations for a no-deal scenario, having received a letter from the Health Secretary saying that there could be problems at the ports for up to six months, which would mean major problems for pharmaceuticals and getting raw materials into the country. Is it not time that we now actually get on and have the vote? The Prime Minister will not bring back any major change to the withdrawal agreement and the political declaration; let us have the vote before Christmas, and then we can see what we need to do next in the new year.
I regularly meet pharmaceutical businesses to talk to them about the Government’s plan for a deal, and also no-deal contingency planning such as that which the hon. Lady talks about. I recognise that the industry strongly supports securing a deal that provides an implementation period that provides a clear pathway ahead for trade. We want to see that delivered. I think it is right that the Prime Minister should seek to put the best possible deal before this House.

Commons ChamberI simply reject the premise of the hon. Lady’s question. It is clear, and is stated clearly in the political declaration, that we will embark on negotiations with the EU and we will conclude them. That is our principal objective—to conclude a free trade agreement with the EU before the end of the implementation period.
I have regular discussions with my right hon. Friend the Home Secretary and, as he has said, the Government will shortly publish an immigration White Paper setting out the details of our future immigration system.
As immigration was one of the key issues of the 2016 referendum, is it not a complete failure of Government that we will not have that White Paper before we vote next Tuesday? Can the Secretary of State say what he believes will happen with the crisis in our social care workforce once Brexit happens?
The hon. Lady is correct that it was a key area of debate during the referendum, and that is why it is also one of the key wins that the Prime Minister has secured in the withdrawal agreement. She has made it clear that freedom of movement is coming to an end and that we will put in place a skills-based system, so that we can recruit on the basis of what our economy needs, whether that is in social care, health or other sectors such as fintech. We can recruit on the basis of skills, rather than nationality. It is one of the key wins secured by the Prime Minister, and that is why this is a good deal.

Commons ChamberI accept that Jaguar Land Rover does not sell as many cars as I should like it to. I consider it this Government’s duty to enter into trading arrangements with the whole world that facilitate the company’s complete success. I look forward to working to do just that with all the strength we can muster.
If work has been done on the regional impact of different Brexit scenarios, is not it in the national interest for regional devolved bodies and local councils to have this information, so that they can make appropriate plans for the future?
We will continue our programme of engagements with the devolved Administrations and the English regions. What we will not do is publish or reveal information we consider to be prejudicial to their interests and the national interest or that would harm our negotiations.

Commons ChamberMy hon. Friend is absolutely right. We are a country that has been a world leader on the environment. We must ensure that we take all the opportunities offered by this process, as I believe the Secretary of State for Environment, Food and Rural Affairs is already doing, to strengthen our environmental protections.
The UK will continue to play an active role internationally, as demonstrated by our ratification of the Paris agreement on climate change. We will continue to uphold our obligations under international environmental treaties such as the Montreal and Gothenburg protocols, the Stockholm convention, the convention on biological diversity and the convention on international trade in endangered species. The new clause itself we will return to in debate.

Commons ChamberNo, I do not think my hon. Friend is right. It is a 96-page judgment, so we have to go through the detail, but the major part of the case was confined to two aspects—the implications specifically for the European Communities Act and for those treaties that have an effect on the domestic legal rights of citizens—and I do not think that the decision to go to war falls within either. He raises more broadly, however, an important point. We are in an era when the exact reach of the royal prerogative has to be established and understood. Once we are in complete command of our own future, we will have to know what the Government can and cannot do, what we have to do in conjunction with Parliament and where we have to go back for authorisation. That is one reason we are taking our time to read the judgment.
The Secretary of State has mentioned a few times that this is a massive exercise in democracy. I put it to him that a useful tool in a participatory democracy is issuing White Papers. I do not understand why he has set his face against doing that, given that we are about to make the most important decision for many generations and trigger article 50.
The Chairman of the Select Committee, who is not here, said his Committee wanted a plan as quickly as possible—before the middle of February; I said it would be difficult to turn out a full White Paper before then. One of the virtues of delivering the plan via a prime ministerial speech of some length was that we could do it quickly, we could make it very clear and everybody could understand it. It also got coverage around the world in a way that no other medium could have. People remind me—and sometimes tease me, of course—of my history as an activist for parliamentary rights. The important point is that we are here only because we represent our constituents’ interests.
I have tried—I keep reiterating this phrase—to provide as much information as possible. Let us take the plan with respect to what was asked for by Labour Front-Bench Members and the Select Committee. They asked, “What are we going to do about the single market?” and hopefully that is now plain. They asked, “What are we going to do about the customs union?”, and hopefully that is now plain. They asked, “What are we going to do about justice and home affairs?”, and hopefully that is now plain. They asked, “What role is seen for Britain in the world?”, and hopefully that is now plain, too. Of course, what we cannot do is say what the outcome of the negotiation will be. We cannot give that level of certainty, but we can certainly give a level of certainty, as we have and as we will, as to what the aims and strategic objectives are. We have done that.
