An interesting point. I will certainly take that back to BDUK, Openreach and others. We need to ensure that the legal framework underpinning our digital infrastructure encourages and enables the deployment of the latest networks. In 2017, we made changes to that legal framework. Implementing reforms to the electronic communications code—this goes to the point made by the hon. Member for Ceredigion (Ben Lake)—requires installation agreements between landowners and telecom operators. The aim was to make it easier for digital networks to be installed, maintained and upgraded, and now we will go even further. The Bill will update the electronic communications code to deliver on the Government’s ambitions for digital connectivity and levelling up. Specifically, it will do three things: make the most of existing infrastructure; encourage stronger and more collaborative relationships between telecom operators and site providers; and build on previous measures to tackle the issue of non-responsive landowners.

In my constituency of St Albans there is the Highfield Park Trust, run by a group of volunteers. Since the 2017 reforms, it has lost 98% of its income from hosting a mast because of the telecoms company using its new powers to renegotiate the lease. Does the Secretary of State agree that that poses a real risk to the roll-out of 5G, because in some instances small site owners might decide that it is not worth their while anymore and just evict the telecoms companies? Is she willing to look at the issue again, and at the power imbalance that has arisen from the 2017 reforms?

In 2017, the prices were too high and they affected the overall roll-out. The new pricing regime is more closely aligned to those of utilities such as water, electricity and gas, which are fair. In order for us to roll out 5G to future-proof our digital economy and our telecoms, and to reach the targets of ensuring that we have 4G/5G coverage and 100% gigabit roll-out as soon as possible, we need to ensure that telecom providers can access land to establish both masts and the facilities that we need to make it happen. It has to be fair. We are not revisiting the code of 2017; the Bill does not do that. It will stay as it was, and there will not be a revision to the pricing regime. It is important that I make that clear straightaway.

Businesses across the UK are having to tighten their belts. Households across the UK are facing inflationary pressures and having to tighten their belts. The two-year freeze on the licence fee means the BBC will be doing the same. I could not agree more with my hon. Friend.

Last Wednesday, at Prime Minister’s questions, the Prime Minister was challenged about the future of the licence fee. He seemed to caution against this by referring to the BBC as a “great national institution”, yet by the weekend the Secretary of State was tweeting that this would be the last licence fee agreement. Will she explain to the House what on earth has been going on in No. 10 since Wednesday that has led to what appears to be a screeching U-turn?

Of course we continue to engage with the EU. As I say, I deeply regret that it rejected our offer. It is worth noting that what we put forward was what the music industry had asked for. We will continue to engage with the music industry, and there are opportunities both with individual member states and with the Commission directly.

One of my constituents is the orchestral leader of two major British orchestras. More than 50% of her work with British orchestras is touring abroad in the EU, but she is a self-employed musician, so she does not have anybody to wade through all this new red tape for her. Putting covid to one side, by what specific date does the Secretary of State hope to fix this absurd, bureaucratic, self-defeating situation, so that self-employed musicians can enjoy visa-free travel in the EU?

I agree with the hon. Lady: it is absurd and self-defeating. It could have been solved, and it could still be solved today by the EU matching the offer that we have unilaterally made to EU nationals. She talks about support. I know her constituency well; it neighbours mine. For example, The Horn music venue in her constituency, which is a home to emergent artists, has received a quarter of a million pounds under the culture recovery fund. The Goblin theatre has received £51,000. Wind and Foster has received £63,000. We are demonstrating as a Government through our actions that we are standing behind culture in this country.

First, I congratulate the hon. Member for St Albans (Daisy Cooper) on obtaining this urgent question and demonstrating that persistence pays off.

The BBC has for decades played a vital role in this country’s cultural and civic life, and that has never been more true than during the last few months. During an unprecedented global crisis, it has helped to counter disinformation and share factual information about the coronavirus pandemic, while reinforcing important public health messaging. It has been a constant source of entertainment. It has helped to fundraise for charities through “The Big Night In”, which the Government match funded pound for pound, and it has helped countless families across the UK to educate their children from home through services such as BBC Bitesize.

The BBC has also been a source of comfort to many during this pandemic, and none more so, perhaps, than those elderly citizens who have been forced to shield and stay at home and who are sadly most at risk of experiencing loneliness and isolation as they do so. That is why we welcomed the BBC’s initial decision at the beginning of the lockdown to continue to grant the licence fee concession to the over-75s, and it is why we were deeply disappointed when the BBC board announced earlier this month that it would be ending that concession from 1 August. As a result, four out of five of those previously eligible for a free TV licence will now need to pay. That is a decision for the BBC, but the Government regret the approach that it has taken.

In the 2015 funding settlement—a settlement that was widely considered to be a generous one and which the director-general said was a strong deal for the BBC—we agreed with the BBC that responsibility for the over-75s concession would transfer to it in June 2020. The BBC agreed to have both the policy decision and the funding responsibility. That reform was subject to public discussion and debated extensively during the passage of the Digital Economy Act 2017. During those discussions and the passage of that legislation, Parliament agreed that the future of the over-75 concession and how and when it would be implemented was entirely a matter for the BBC.

The Government’s view is that the BBC should be doing more, given the generous settlement that it received. During the 2015 settlement, we gave the BBC a number of things in return for taking on this responsibility. We closed the iPlayer loophole. We committed to increasing the licence fee in line with inflation, and we reduced a number of other BBC spending commitments. To help with financial planning, we agreed to provide phased transitional funding over two years to gradually introduce the cost to the BBC.

It is now essential that the BBC, having taken the decision to end the concession, gets the implementation of the change right and is not heavy-handed in its approach. While lockdown may be easing, older people across the country still face many challenges and still rely on their TV as much as they did a few weeks ago. The BBC can and should therefore do more to support older people, and it should look urgently at how it can use its substantial licence fee income to support older people and deliver for UK audiences of all ages.

As the national broadcaster, the BBC has a duty to represent all of the nation—both its youngest and oldest citizens, no matter where they live—and I am aware that many people have expressed concerns about cuts to regional programming as well as the BBC’s recent announcement of staffing reductions. Let me be clear that both operational and editorial decisions are a matter for the BBC. It is an independent body and the Government rightly have no say over the day-to-day decisions that it makes on programming, staffing or the administration of the licence fee, but as I have said, including during a recent Adjournment debate, the Government believe that the BBC must represent all of Britain. We set clear targets for news and current affairs and the need to represent all parts of the UK and the charter as part of the BBC’s mission and public purposes. It is for the BBC to meet these and Ofcom to hold it to account on doing so. That means engaging and reporting on local issues across our diverse communities, not just reflecting the views of the metropolitan bubbles of London and Manchester.

While the BBC remains operationally and editorially independent from the Government, we will continue to push it on these issues so that we can ensure that the BBC remains closer to the communities that it serves.

The BBC licence fee exists to give the BBC protection from political interference. The BBC should not be making decisions on welfare. That is the role of the Government. Last year, the BBC chairman said that

“the licence fee is at the heart of what we do. It establishes a direct relationship between us and the public and makes absolutely clear that our job is to serve them”—

and yet here we are.

From 1 August, the BBC will fund free licences only for people over 75 who receive pension credit, but two-fifths of people who are entitled to the benefit—about 1.2 million pensioners—are not receiving it. Some do not know how to claim, many struggle to apply and others feel embarrassed about requiring help. Is the BBC really to become a de facto arm of the Department for Work and Pensions?

Let us be absolutely clear about how we have ended up here. It was the Conservative Government who took the decision in 2015 to stop funding for free licences, and it was the Conservative Government who forced responsibility on to the BBC board to make the decision on the future of the concession. The Government should never have asked the BBC to take that on, and the BBC should never have accepted it. Continuing with the licence fee scheme for the over-75s would have cost £745 million—a fifth of the BBC’s budget. To meet that cost without Government funding, the BBC would have had to close all of the following: BBC 2, BBC 4, the BBC News channel, BBC Scotland, Radio 5 live and local radio stations, as well as many other cuts and reductions. As it happens, the means-tested scheme will still cost the BBC about £250 million, and to help meet that cost it has recently announced hundreds of job losses and programming cuts.

The BBC has proved invaluable to the British public during the covid lockdown through its trusted news, entertainment and home schooling resources. Does the Minister agree? Age UK says that it firmly believes it is the Government’s responsibility to look after vulnerable older people, not the BBC’s. Age UK also thinks the Government should take back responsibility for a benefit that was introduced to tackle pensioner poverty. Will he do that? The Conservative Government have been responsible for these secret deals with the BBC that have significantly diminished its ability to serve the British public, so when the licence fee negotiations start in earnest next year, will he commit to a wholly transparent process involving Ofcom?

The decisions taken at the time of the licence fee settlement in 2015 were the result of lengthy negotiations with the BBC, in which it received a number of concessions that it strongly asked for. In return for those, it agreed that it would take on responsibility for the maintenance of the over-75s free TV licence concession. It was up to the BBC how it decided to take that forward. A number of options were suggested and consulted on by the BBC. The Government were disappointed, as I say, that it decided to remove the concession completely. There were a number of other ways it could have addressed it that would have saved the BBC money but would have at least maintained some help for those aged over 75. But, as I said, that was a matter for the BBC. Obviously, we will continue to discuss it with the BBC. In particular, we will be having discussions over the next licence fee settlement in 2022. We will ensure that there is an opportunity for Ofcom, and others, to have an input into that, but that is still some way off. In the meantime, as somebody who was responsible for those negotiations, I believed the licence fee settlement was a good outcome. The BBC made public the fact that it thought it was a good outcome, too.

I thank my hon. Friend for his support, but I think there are slightly separate questions about the timings and the issue of human rights abuses. He is absolutely right to raise the issue of human rights abuses, and that is something we are addressing through the modern slavery Bill. We should not be having any companies operating in the United Kingdom relying on slavery, so we have introduced the modern slavery Bill. Indeed, there is an amendment that will be considered in the Lords very shortly which deals precisely with that issue, and we are working with peers to address that.

I, too, welcome this screeching U-turn. It is ultimately the right decision on the grounds of national security, human rights and British industrial strategy. Does the Secretary of State agree that the best way to mitigate the risks of relying on just two vendors is for the Government to invest in the development of the open radio access network and to open the market to newer smaller entrants. If he does, when will he publish a strategy to achieve that?

My hon. Friend is right to champion Theatr Clwyd in Mold and to say that this is a significant sum of money for Wales. I spoke to the Welsh Deputy Minister for Culture, Sport and Tourism at the weekend, and he was delighted with this sum of money. Because of the way that the Barnett formula works, we cannot guarantee that the money will be spent on arts and culture, but he is keen to ensure that when the Welsh Government get hold of it, it goes to the right places.

From Edinburgh to Aldeburgh, the UK’s thriving festival sector reaches almost 5 million people a year. Will the Minister clarify whether festivals will be eligible to get some of the money from this rescue package? If not, does she agree with me and with the British Arts Festivals Association, which is calling for the £120 million that has been allocated for a festival of Britain in 2022 to be reallocated to all the festivals of Britain that need help this year?

At the moment, festivals often attract funding through some of the Arts Council funds. It is possible that live events will attract such funding, but that will be set out in the guidance when we release it. Our performing arts and cultural sectors want more than anything to get back up to speed, and get up and running, and Festival 2022 presents a remarkable opportunity for all four nations of the United Kingdom to commission work and get people out there doing what they do—performing, creating and entertaining our country.

Yes, I absolutely do agree. Ofcom is perfectly placed to balance our absolutely unequivocal commitment to free speech with the need to regulate an industry that is, as I said, ripe for regulation.

Could the Minister share some more details about the scope of this announcement? Specifically, does it cover threats to democracy and abuses of the electoral system that have been examined in the Lords by Lord Puttnam’s Committee, and will Ofcom be given future-proofing powers to adjust regulations not only to take account of technological changes but to protect against future threats that do not yet exist?

The work that the Cabinet Office is doing on protecting democracy is a hugely important, albeit complementary, part of the process, rather than something that is covered by online harms. Our intention is that the regulations and the codes of practice that Ofcom will draw up will be as future-proofed as possible, because we do not want to be coming back time and again having this debate in a whole series of forums. We need to get on with this.

There are a number of questions there. My hon. Friend is right to allude to the fact that there are alternatives to Huawei, and we would of course seek to use them as much as possible. He is right to say that we have to consider the unique nature of a 5G network, and that is precisely what our agencies will do when they offer advice to Government. He is also right to say that we have to look at this decision in the round, and that is what we will do.

In addition to legitimate security concerns, the human rights implications of granting access must not be ignored. Huawei has been implicated in mass oppression in China, selling infrastructure that has allowed it to build a surveillance state and disseminate disinformation and racially charged propaganda. To ensure that we continue to defend human rights here and abroad, what steps will the Government take to ensure that all foreign firms wanting to bid for public contracts in the UK or run critical infrastructure are subject to the most stringent human rights impact assessments and also that those assessments consider information provided by our key allies, including the Five Eyes alliance?

York is an exemplar for these sorts of projects. It demonstrates why investment is the right thing to do for the commercial sector, and why it is right for the state to support it. I look forward to the other place seeing the Bill in much more detail. That will happen imminently, I am sure—or maybe not; we will see.

As I say, superfast broadband facilitated the original internet that we are so familiar with, and gigabit will do so much more. It will support older people in staying independent for longer, will allow people to work how and where they choose to a much greater extent, and will make sure that commuters can join up their life in a much more effective way. However, the benefits for businesses and consumers can be realised only if digital infrastructure providers such as Openreach, Virgin Media, CityFibre and many others—increasingly more—can access homes, workplaces and public buildings such as hospitals and train stations. It is for that reason that this Government have made the deployment of gigabit broadband one of our key priorities.

With this Bill, we are taking the first hammer blow to the barriers preventing the deployment of gigabit connectivity. We will similarly take aim at new-build homes that are being built without access to futureproof connections, and we are exploring how we can make it easier for digital infrastructure providers to share the infrastructure of others, and how we can promote 5G mobile services by simplifying the planning regime.

The Minister mentioned delays. I welcome the Bill, although it is overdue, and its objectives. One of our challenges, however, is that up to 3,000 applications a year could be going to the tribunal from suppliers wanting to secure access. The Minister said that he would be taking a hammer to the delays and barriers; what will he do to ensure that the tribunal has the capacity and resources to process those applications and ensure that they go through?

The hon. Lady is absolutely right that the system is only as good as the resourcing behind it. We will explore every option to ensure that the tribunal gets those resources. We are confident that what we are proposing will work—we will make sure that it does—but of course we are open to considering what we can do to make it better as soon as we might need to.
