I am pleased to have secured this debate along with the hon. Member for Liverpool, West Derby (Stephen Twigg), and I thank the Backbench Business Committee for granting us this opportunity.

The conflict in Yemen between the Saudi-led coalition and the Houthi rebels has created grave instability and danger. Amnesty International has stated that the conflict has seen

“violations of international humanitarian law committed by both sides with impunity.”

UN reports suggest that around 60% of airstrikes during the war have been conducted by Saudi-led forces.

The Committees on Arms Export Controls had an inquiry last year into the sale of UK arms to Saudi Arabia. It is clear to me that there is an urgent need for the Government to suspend such licences, pending the results of an independent UN-led investigation into potential breaches of international humanitarian law. That was the position taken by the Business, Innovation and Skills Committee and the International Development Committee in the conclusion of their inquiry.

Meanwhile, the Government have repeated their view that the Saudis should be allowed to conduct their own investigations. Almost two years into the conflict, the Saudi-led joint incidents and assessment team has initiated only around 15 investigations. Saferworld estimates that the number of credible allegations to be “well over 100”. Furthermore, feedback by that team is limited to press releases and press conferences, rather than comprehensive reports.

During the Defence Secretary’s statement on 19 December, I asked my right hon. Friend to outline the circumstances under which the Government would pause arms sales to Saudi Arabia, to which the response was:

“If we have evidence that international humanitarian law had been breached”.—[Official Report, 19 December 2016; Vol. 618, c. 1224.]

I point to the devastating twin attack on a funeral hall in Sana’a in October, killing 140 people and injuring as many as 500. According to UN reports, the attacks were minutes apart, targeting a location where it was known that senior Houthi officials were assembling among families and children.

The US has since launched a review of that attack and cancelled a sale of precision-guided munitions worth around $350 million to Saudi Arabia, citing “systemic” and “endemic” problems with Saudi targeting in Yemen. For an attack to fail to distinguish between those fighting in a conflict and civilians gives serious weight to the argument that international humanitarian law has been broken.

The UK should be an example to the world in terms of our licensing regime, our commitment to the rule of law and our responsiveness to challenges. Criterion 2(c) of our arms export licensing regime forbids the authorisation of arms sales if there is a “clear risk” of a violation of international humanitarian law. In his response today, will the Minister outline at what point that threshold is met? The evidence that the Committees of Arms Export Controls heard last year was compelling in suggesting that there is very much a “clear risk”.

I have heard arguments that if we do not supply arms, a nation with a weaker licensing regime will do so instead. I pre-empt any such point today and suggest that that is no way to approach any situation, not least the sale of weapons. We must be accountable for our own actions, particularly if we are to be an example in cementing the rule of law into our practices. Such a position does not fulfil our obligations under the criteria and the law. Unless we wish to become one of these other weaker countries, we should maintain that position.

A legal opinion in December 2015 by Matrix Chambers argues that the sale of UK arms constitutes a violation of our obligations under national, EU and international law. I also pre-empt the widely recognised point that our strategic relationship with Saudi Arabia is one that must be maintained. I absolutely agree with that position, but that does not extend to our acting as its proxy defence. We pride ourselves on our relationship with Saudi Arabia, but it must not be a mechanism to deflect criticism, and our close ties should not be used to support otherwise.

I am grateful to the hon. Gentleman for giving way. The primary subject of the debate is the people of Yemen who are suffering. That reflects my personal feelings. The objective is clear: a ceasefire, which is the only way to relieve the situation in Yemen. Stopping arms sales to Saudi is a bogus argument.

I put this to the hon. Gentleman: you have seen the arms sales from Putin and Moscow to Assad, and you have seen the devastation in Aleppo, so I find it incredible that you can make the argument about ethical arms sales and our ethical arms sales, and then allow Saudi Arabia, using our petrol pounds, to buy arms from whoever it wants. You see from Aleppo the devastation that could be caused if they bought Russian arms. That is a ridiculous argument.

Thank you for the final point, but I suggest that where the hon. Gentleman talks about ethics he is missing my point entirely. This is not necessarily about ethics; it is about the rule of law and the criteria for our arms export licensing.

My hon. Friend is being generous in giving way. I would echo the comments made by my Lancashire neighbour, the hon. Member for Hyndburn (Graham Jones). On the relationship with Saudi, does my hon. Friend not recognise that, through the good offices of Ministers such as the Minister who is in his place the behaviour of Saudi has changed? For example, it now accepts that it will no longer use cluster bombs.

I will answer briefly by saying that the Government had already been in discussions with Saudi Arabia regarding cluster munitions—in 2010—but I do not think that the Saudi Arabian Government took a terribly large amount of notice of our Government’s persuasion until after the events when those munitions were identified.

The hon. Gentleman, the Chair of the Committee, is making a strong speech. Members on both sides of the House and Governments of both parties led the world in arguing for the arms trade treaty, including the previous Labour Government, who put the process in place, and indeed the other arms export control criteria, so that we have a rules-based system for our defence industry to operate within and one that adheres to humanitarian principles. Does he agree that that wider principle will be at stake if we do not adhere to it?

I am sorry, but I am probably getting well past the Deputy Speaker’s patience.

To return to the statement made by the Secretary of State for Defence on 19 December and to the specific question raised by the hon. Member for Hyndburn, we learned the Government’s finding that British made cluster munitions had been used by the Saudi-led coalition in May 2016. That has a number of implications and is a cause for concern, and I challenge the Minister on the responsiveness of our arms exports licensing regime. It is unacceptable that an international ally used a weapon manufactured in Britain with complete disregard for the 2008 convention on cluster munitions, of which the UK is a signatory.

We are duty bound by the 2008 convention to prevent the use of cluster munitions, so what steps were taken to convince the Saudis of our opposition to the use of such munitions and to convince them to decommission those weapons? I recognise that the Government have not sold cluster munitions to Saudi Arabia since 1989, but it is important to consider the durability of our munitions.

We know that the UK Government stopped supplying cluster munitions to Saudi Arabia in 1989. However, we also know that the UK Government continued to maintain those horrific weapons until 2010. No doubt, the Minister will tell us why that contract was in place for 21 years, but does the hon. Gentleman not agree that the crucial point is that accountability should extend beyond simply sales to maintenance contracts?

I agree with the hon. Gentleman that it will be interesting to hear the Minister’s response to that intervention.

The humanitarian crisis requires an urgent and comprehensive response from the international community. Everyone in the Chamber agrees with that. As each month goes by and casualties grow, the case for an independent, UN-led investigation of potential breaches becomes all the more compelling. From a UK perspective, and to protect our reputation as an example to the world in arms export licensing, it is right that we suspend our sale of arms to Saudi Arabia until such an investigation is completed.

As mentioned in the debate, the Committees on Arms Export Controls has in recent months conducted an inquiry into the conflict in Yemen and the use of UK-manufactured arms in it. In a joint report of the then Business, Innovation and Skills Committee and the International Development Committee, following the inquiry that I chaired, the conclusion from the widespread evidence that we heard was that there have been violations of international humanitarian law, as reported by organisations such as the UN, Human Rights Watch and Amnesty International. As a result, the joint Committee report has called on the Government to push for a UN-led investigation into the conduct of the Saudi-led coalition, and for the suspension of arms sales to the country while this investigation takes place.

Since the report was published on 15 September, we have seen further civilian casualties—not least on 8 October, which saw the most severe attack of the conflict yet, as mentioned by a number of colleagues.

I would like to ask my hon. Friend the same question as I put to the shadow Foreign Secretary. When he talks about suspending arms sales, what does that mean? Does it mean that he and his Committee believe that the United Kingdom should withhold the supply of spare parts and withdraw our advisers to the Royal Saudi Air Force, or does it relate just to future sales down the track?

I am sorry, Madam Deputy Speaker, but I thought I should grant my hon. Friend the Member for Aldershot (Sir Gerald Howarth) the chance to ask that question. We have a very short amount of time for this debate, but we deserve the opportunity to have a proper discussion of what a pause in arms sales would be. I would ask a more open question in response to those who have spoken on the same side as my hon. Friend: we were looking for a UN-led independent investigation, so what is preventing that investigation?

Saudi Arabia has described the airstrikes on the funeral as a mistake, while the Government continue to depend on Saudi assurances in relation to the conflict. The number of civilian casualties prompts me to ask whether every act that results in such loss can be considered a mistake. As Philippe Sands QC told the Committees on Arms Export Controls, the question of whether or not a state “intends” to commit a violation does not detract from the fact that a violation is committed by that state.

The United Kingdom’s legal obligations stipulate that the Government must suspend arms sales if there is a clear risk that there might be a violation of international humanitarian law. I suggest that that criterion has been met, and that arms sales to Saudi Arabia should therefore be suspended. I repeat our report’s recommendation that while such doubt and uncertainty about compliance with international humanitarian law in Yemen exists, the default position of the UK Government should be not to continue to sell weapons, but to pause until they are satisfied that allegations have been investigated properly.

I recently spoke in the debate on the Queen’s Speech and called for an industrial strategy, not least because the manufacturing sector needs long-term assurance if it is to succeed. Irrespective of whether the shadow Chancellor agrees on the need for an industrial strategy, does he agree that a vote to leave would create unwelcome uncertainty at a time when our vital manufacturing sector needs stability?

There is a desperate need for long-term, patient investment in our manufacturing base in order to develop an industrial strategy. The threat of Brexit is undermining those who make the decisions about that long-term, patient investment, and Brexit would be a disaster for recreating our manufacturing base in this country.

Is the hon. Lady aware of the inquiry into the Yemen conflict by the Committees on Arms Export Controls, which have heard evidence from non-governmental organisations, the defence industry and Government? The report will be published before the summer recess. As she clearly states, there are serious concerns about violations of international humanitarian and human rights law. Does she agree that the UK has international and domestic obligations on arms export controls and that we have to hold ourselves to the highest standards?

We need to be careful. There is no evidence yet that Saudi Arabia has used cluster munitions. The right hon. Gentleman is right that Saudi Arabia is not a signatory to the convention banning cluster munitions, but nor is the United States. We have always made it clear to the Saudi Arabians that we cannot support the use of cluster munitions in any circumstances, as to do so would be unlawful for Ministers and officials in this country. We believe we have an assurance from Saudi Arabia that cluster munitions have not been used in the conflict, but as I said earlier, the MOD is urgently investigating the allegations. I am sure that my ministerial colleague will have more to say in response to the UQ.

Through the conflict, stability and security fund, we are seeking to reduce the impunity and address the causes of conflict. We are working with the Burundians in general and with the international community, the country’s human rights commission, the truth and reconciliation commission and the court system. I met human rights organisations in private in Bujumbura in December to hear their detailed concerns, and I addressed the UN Security Council in March. I am pleased to report that the Arusha talks have now started under the chairmanship of former Tanzanian President Mkapa. I look forward to hearing reports about how they are going.

I beg to move,

That this House has considered the persecution of Ahmadiyya Muslims and other religious minorities in Pakistan.

The cornerstone of the Ahmadiyya Muslim faith is its belief in peace and religious tolerance for everyone. Its motto is:

“Love for all, hatred for none.”

However, as we speak, that very same peaceful community continues to be persecuted on a daily basis in Pakistan and elsewhere. It is the only religious community to be targeted by the state on the grounds of faith. In Pakistan, Ahmadis cannot call themselves Muslims and are prohibited by law from voting as Muslims. That state-sponsored persecution has been enshrined in the country’s constitution since 1974. On top of that, Ahmadis are openly declared as “deserving to be killed”, with neither the state nor civic society willing to stand up for them against extremists. Perpetrators are given free rein to attack Ahmadis, safe in the knowledge that they will not be prosecuted for their actions.

I congratulate the hon. Lady on securing this important debate. I take this opportunity to praise Mohammed Salim and other members of the Ahmadiyya Muslim Association who do so much for our community in Warwick and Leamington.

Does the hon. Lady agree that if Pakistan expects to grow its economy exponentially, it needs to address these serious humanitarian concerns and, in particular, the Pakistani Government’s failure to legally recognise the Ahmadiyya Muslim community?

Absolutely not. I am clearly talking to very different young people in south Devon. I agree that young people—indeed, people of every age—are crying out for clear information. Perhaps, instead of the Government churning out information that is not widely trusted, we could consider some way in which we could grade the quality of information, as we do for scientific papers, which are graded according to the quality of the evidence. Perhaps we could ask academic bodies, or the Library, to grade the information to which people have access, so that they can judge whether it comes from one perspective or another. People want clear information.

Does my hon. Friend agree in principle that votes at 16 is an idea whose time has come, but that it should not be introduced by means of an amendment on a matter of this significance? Does she agree that lowering the voting age to 16 is inevitable and would she welcome, as I would, the Government taking the initiative on that sensible and timely reform of our franchise?

I absolutely agree with my hon. Friend that the time has come. The time came in Scotland, and we saw very clearly how important that was for young people. More than 90% of young people in Scotland registered to vote. They now permanently have a voice and a vote, and I do not think they will accept its being taken away from them now. That would be infantilising. We should accept that they have the capacity to make these decisions, and the House should embrace that.

I believe this should be a decision for Parliament, not a party political decision through the Whips. I would like the whole House to have the opportunity to decide on this in a free vote. Furthermore, on my hon. Friend’s point about whether we should take this as a stand-alone issue or debate the wider franchise, I will be making the same point and voting in the same way when this comes back and we have a wider discussion about the franchise in other elections. Let us not be dragged into this kicking and screaming; let us make a positive decision that we trust our young people and want to give them a voice.

As the hon. Gentleman says, the Prime Minister did the right thing in making that statement on other tragic events near Amritsar decades before and in expressing this country’s regret for that. That was absolutely the right thing and I think across the whole House we support that. He did that because of Britain’s responsibility for those events. Apologies go with responsibility and imply a responsibility. As I said earlier, if any of us thought that any British assistance had contributed to unnecessary loss of life and to suffering in this case, or in any other case, we would all want to say that that was a mistake and for the country to make an apology. But that is not what is established by the Cabinet Secretary’s report. The picture is very different from that, and we all have to base our opinions, in the end, on the facts.

My constituency is also home to a large Sikh community, and I would like to take this opportunity to pay tribute to the huge contribution they make to local and national life. I am pleased that the Government have investigated these issues so promptly. However, may I ask the Foreign Secretary what further steps he will take to reassure our Sikh community that this investigation has indeed been fully transparent and comprehensive?

It is important to explain the investigation, and that is what I am doing today. I am sure that my hon. Friend will encourage his constituents to read the report. It is not a report just for Parliament to read; it is a report for the public to read. It is published on the Government’s website and it is easy for Members of Parliament to make copies available. People will be able to make judgments for themselves on its transparency and on how much reassurance to take from it. I hope they will be reassured that in this country we do look into such documents and respond to demands for investigations. We asked the highest ranking civil servant in the country to lead those investigations. We ensured that officials from 30 years ago were interviewed and that tens of thousands of documents were examined. There are not many countries in the world that have that level of transparency relating to events in the past, let alone in the present. We should say that those are good attributes of our country, and that they are good examples of how we face up to issues from the past.

I congratulate my hon. Friend the Member for Enfield North (Nick de Bois) on not only securing the debate, but his comprehensive remarks.

The UK remains the ninth largest manufacturer in the world, but over the past few years, our export performance has been poor. In 2000, our share of world goods exports was 4.4% but, unfortunately, that had fallen to 2.8% by 2009, which is quite shocking. Perhaps that is why so few Labour Members are in the Chamber.

Unfortunately, I cannot, given the time available.

There are, however, now positive signs of improvement. In contrast to financial services, exports in manufactured goods have risen since the financial crisis. Fortunately, in the period between 2008 and 2011, exports of finished manufactured goods grew by more than 16%.

Ultimately, exports depend on good products and pioneering companies, such as DCA Design International. I will not go through a list, as my hon. Friend the Member for Witham (Priti Patel) did of all the jam makers and so on in her constituency, but my constituency has similar manufacturers.

The Government have a role in supporting businesses to export, and I hope that they will use the upcoming Budget to provide additional resources to UKTI so that it can reach out to even more businesses. The Prime Minister has announced a national challenge for the UK to encourage more small and medium-sized businesses to export, which is essential. As has been mentioned, if the UK exported at the EU average of about 25%, rather than 20%, about £36 billion would be added to the UK economy.

Businesses need support if they are to export, particularly smaller businesses that do not have large teams and resources to enable them to get into such markets. Our competitors in Europe and America see potential growth in the BRIC countries, as has been mentioned, and their Governments seek to provide their companies with every single advantage. That is why collaboration between the Foreign Office and UKTI is so important. The Foreign Secretary has made it clear that he wants British embassies to roll up their sleeves and support British business. We must also ensure that officials have their ear to the ground for new trade opportunities and then feed such information back to UKTI. We need to create a dual hub-and-spoke system, with the UK’s vast diplomatic opportunities feeding back information to UKTI and trade bodies in the UK, while they in turn have their own systems to feed back local information to chambers of commerce and business networks.

The Foreign Secretary has tried to reverse the decline in trade offices in consulates throughout the world, but we need to do more than merely reverse the decline—we need to expand, particularly in the emerging markets I mentioned earlier. Information is crucial in an age in which companies can communicate in minutes and deals can be won or lost through the smallest of delays. In the longer term, we also need to encourage businesses to make personal connections with emerging markets.

As a British Chambers of Commerce survey in 2011 pointed out, contacts are often key for businesses exporting into new markets. Businesses that had employees or directors who had lived abroad were even more successful. However, the most direct way in which we can support British businesses to export is by ensuring that our export products and guarantees are as competitive as possible. The Government should therefore commission a report into the comparative competitiveness of the UK’s export guarantees and credits, and the effectiveness of our institutions such as UKTI, so that we can learn from the success of others, and accordingly improve our own standards and the way in which we work.

Is my hon. Friend aware that the video games industry added £1.4 billion to exports in 2010? Would he support UKTI giving appropriate resource to the creative industries?

I concur with my hon. Friend. We should support overseas all the industries that we are good at.

UK export finance is available, but many of the small and medium-sized companies I speak to in my constituency of Shrewsbury are not aware of the export finance support they can get from UKTI.

I asked a very good friend of mine who works in the private sector what he would do if he were promoting business in a country such as the United Arab Emirates, where 130,000 British citizens reside. He said he would put just four people in an office in the UAE and give them the sole task of constantly updating a database of all the public and private sector procurement opportunities in the country. The database would have to be updated daily and constantly reviewed to include not just the large, multi-million pound opportunities, but smaller ones.

The database could be relayed daily to the regional directors of UKTI in the UK. I recently met Paul Noon, the UKTI regional director for the west midlands. The regional directors should in turn create databases of all the companies in their regions, so they understand every company in, for example, the west midlands, and what they can do. Like a telephone switchboard operator, they could then marry up each company in the west midlands to each opportunity identified in the UAE. I know from the discussions I have had with Shrewsbury businesses that they are simply not being told of the opportunities that exist in the UAE. That is just one case in point.
