Public Bill CommitteesI am grateful to the hon. Gentleman for his comments because he raises an important point, which is: how will we interpret the legislation? Clause 3, which my hon. Friend the Member for Peterborough has outlined, provides that additional guidance will need to be put in place to give greater clarity for those who are running individual polling booths. That might not be their day job, and they might come from another part of a local authority and might be taking part in only that one electoral event, so it is right that there will be interpretation and guidance with respect to the Bill. It will be for the Electoral Commission and others to provide that as part of the overall process. Hence, clause 3 outlines the approach we suggest.
Before I come to clause 3, let me refer to clause 2.
When the Government produce that guidance, would it not make sense for it to say that when two adults were going to a polling booth together, they would need to be doing so in circumstances whereby they were, for example, giving assistance to a disabled person? Therefore, the presumption would be that everyone should go separately, rather than there being a need to prove intent, because it is always difficult to know what is going on in someone else’s mind.
I am grateful to my hon. Friend for her suggestion. This exchange is highlighting some of the challenges around the level of prescription that needs to be in the process versus the level of discretion. That is one reason that we legislate in this place and a separate body provides interpretation.
The ultimate decision about whether things are appropriate or not appropriate in individual polling booths is down to the presiding officer in that polling booth. Presiding officers will take decisions based on the law and the guidance around the law, and the situation on the ground. I have been the elections Minister for only a few months, but I can see that there is an incredible amount of legislation and guidance in this area. That legislation and guidance provide significant prescription—it is important that there is consistency and clarity across the country when electoral events happen—but equally, guidance can never provide every piece of information for every scenario.
I take the point made by my hon. Friend the Member for Sleaford and North Hykeham and will feed it into our consideration, but it will be for the Electoral Commission to provide guidance and further information.

Commons ChamberThis Government are making sure that hard-working families and first-time buyers have affordable, quality homes to call their own. Last month, we confirmed over £12 billion of investment to build more affordable homes—the most significant of its kind in living memory. This includes our new affordable homes programme, which will deliver up to 180,000 homes from next year.
I thank the Secretary of State for his answer. My constituents are keen to see villages grow gently, sympathetically and with a range of larger and more affordable homes, and I am pleased to hear him focus on quality. How will my right hon. Friend’s planning reforms focus on quality and ensure that no new three-storey, densely packed, large developments of identikit houses are allowed to ruin the edges of small villages?
Like my hon. Friend, this Government believe that beautiful high-quality homes should be the norm in every area of this country. Our reformed planning system will place a much higher regard on quality, design and local character, such as that in Lincolnshire, than ever before. Local planning authorities already have the power to set high standards for housing, including setting parameters for density, open space and private gardens. However, to go further, I have announced that we will create a new national design code, and I have asked Nicholas Boys Smith, the founder of Create Streets, to establish a new body to help every local community to create their own design code and deliver locally popular architecture for everyone.

Commons ChamberThe hon. Gentleman is talking about reoffending rates. May I remind him that the reoffending rate for young males under the last Labour Government was 70%?
I am grateful to the hon. Lady for her intervention, but the fact of the matter is that in the last 10 years, this Government have enacted policies that at best ignore the impact on public safety, and at worst actively undermine it. Cuts to the police service have led to frontline police officer numbers being slashed and to forces being under-resourced elsewhere. My police force in West Yorkshire has had its budget cut by £140 million since 2010. We have seen cuts to the Prison Service; prison officer numbers have fallen by a quarter between 2010 and 2015, which has left many of our prisons—including high-security prisons—being staffed by inexperienced officers. We have seen an ill-advised decision to break up the probation service, with catastrophic consequences—something that the whole House now accepts—and just days ago, we were found to be leaving the public less safe as a result of under-staffing and overloading with casework.
Prosecution and conviction rates for serious offences have stalled. That has been driven by these cuts to important services that work to keep reoffending down and the public safe. Most alarmingly, prosecution and conviction rates for the offence of rape have fallen by 32% and 26% respectively in a year, creating a situation that women’s groups say effectively amounts to the decriminalisation of rape. Reoffending rates across the whole range of offences remain stubbornly high, with proven reoffending rates for sexual offences fluctuating at about 14% between 2006-07 and 2016-17. The figures for violence against the person offences have increased from 20% to 26%.
Under this Government, the public are less safe. Faced with such a record, we and the public should rightly be sceptical when the Government talk about cutting crime and keeping the public safe. To try to correct their abysmal record and create an impression that they are tough on crime, the Government have brought forward this order, but even they know that it will not be enough to overturn the problems that they have created. Taken on its own, it will increase neither public confidence nor public safety, and it is far from the silver bullet that the Prime Minister would like to praise it as being.
Throughout this process, the Government have consistently failed to make the case for the order and its implementation. As their own impact assessment and explanatory note point out, judges already have powers akin to the ones set out in this order for dangerous offenders. They have the ability to hand down extended determinate sentences, which not only require an offender to serve longer in custody, but are subject to the double lock of the requirement that the parole board be satisfied the offender is no longer a danger to the public before they are released. Conveniently for the Government, however, Ministers seem to have been remiss in telling the public about that when talking about the action they are taking.
Instead of the Government bringing in such measures without properly making the case for them, and without showing evidence that supports their proposal, they should get serious and tell us how they will reduce the rampant overcrowding and violence in our prisons; how they will increase the quality and availability of real, purposeful activity both in prisons and in the community; how they will deliver an effective probation service that is not hampered by the Government’s failed privatisation agenda, which has proven so disastrous; and for non-violent and non-sexual offenders, how they will deal with the number of ineffective super-short sentences that their own evidence, in the report the Ministry of Justice published last year, shows lead to more people becoming victims of crime than if effective alternatives were used. The Minister accepted that earlier.

Commons ChamberWe are working very closely with the social sector and private owners. I am afraid that, frustratingly, progress has been extremely slow, as my hon. Friend and others across the House know. The fund that we opened for the taxpayer to pay for the remediation has so far seen only four successful applications. However, there is evidence that progress is moving at a pace that we have not seen before. There are now only 10 buildings in the private sector that have not begun the process of remediating, which means drawing up a plan and beginning with or contracting workers who can come on site and take away the cladding. There are exceptional circumstances with all those 10 buildings because, unfortunately, they have been identified only recently as having ACM cladding, so they have come to the process only over the course of the autumn. I want that work to proceed at a pace that we have not known before. As I said yesterday, we are now commissioning an independent building safety construction expert to advise my Department on how we can get that moving very quickly.
It was clear to me when I became Secretary of State—this was confirmed by Sir Martin’s report—that we need to go further to bring forward a series of very significant reforms and ensure that the work moves at pace. In response to Dame Judith Hackitt’s report, we are creating, immediately, the new building safety regulator. As I announced yesterday, we have chosen that that will be established within the Health and Safety Executive. The new regulator will raise building safety and performance standards. It will oversee a new and more stringent regime for high rise buildings and for higher risk buildings more generally.
Non-compliance is an issue in the industry, and the building safety legislation announced in the Queen’s Speech will ensure that the new regulator has the appropriate powers to sanction those responsible. This is a new and significantly tougher regime, underpinned by improved enforcement, dedicated to ensuring that our buildings are made with the necessary high safety standards and that the people within them always feel safe.
My right hon. Friend refers to people who suffered from the fire. Can he confirm how many of those families are still waiting for permanent housing? If there are any, what is he doing to find them a permanent home speedily?
Of the households who lived in Grenfell tower, 10 are yet to move into permanent accommodation. Of them, one is in hotel accommodation; the others are in high-quality temporary accommodation. Without going into the personal details of each household, which would not be appropriate, I can tell the House that I have personally reviewed the circumstances behind each of them, and my right hon. Friend the Housing Minister and I have worked closely with Kensington Council to review them again several times since coming to office. They are complex cases with a range of individual circumstances behind them, but we are hopeful that many of them will move into accommodation in which they feel comfortable as soon as possible.
Yesterday, I announced a series of new measures, including the appointment of a construction expert, to quicken the pace of the remediation of ACM cladding. I announced that I was minded to lower the height requirements for sprinklers in residential buildings from 18 metres to 11 metres, and I will set out a full proposal on how we intend to deliver that in February.
As I have stated, I have had the privilege of meeting survivors and their families and friends as well as people from across the community of north Kensington, and from the schools, such as Kensington Aldridge Academy and St Francis of Assisi Catholic Primary School, that provide a safe and caring space for children affected by the tragedy to reflect and remember their loved ones, to the worshippers at the Al-Manaar north Kensington mosque, who came together to support the community after the fire and continue to do so. One thing has been clear to me: this is a community of people who look after one another, who will continue to support one another and who will never forget what happened on the evening of the fire.
We owe it to them to ensure that their views are heard throughout our work, that justice is delivered and that the system is changed so that such a tragic fire can never happen again. That means reforming our building safety regime, but it also means reform of social housing to ensure tenants’ voices are heard and that their landlords provide good-quality, safe accommodation with strong and robust sanctions in place to hold them to account where that does not happen.
The Prime Minister and I have committed to bringing forward a social housing White Paper. This will set out further measures to empower tenants, hold social landlords to account and support the continued supply of social housing. This will include measures to provide for greater redress and better regulation and to improve the quality and safety of social housing.

Commons ChamberThe Minister says it went up, but actually it confirmed what many of us feared, because under this Government there will never be an end to the pain of austerity. Nothing has changed. Let’s bust this myth. This year’s funding package, while it offered an increase in spending power next year for local government, came with a £1.3 billion extra cut from central Government funding to the revenue support grant. An uplift in spending power has been paid for by local people through increased council tax. That is not fiscal devolution; it is another attempt by this Government to shift the burden on to local taxpayers and to devolve the blame for these decisions to councillors of all political persuasions, including Conservative councillors.
Areas such as the one I represent cannot bring in anything like the resources they need to meet the growing demand for social care and our neighbourhood services through local council tax increases alone. This has left areas with the greatest need unable to mitigate the cuts imposed by the Government and residents paying more in council tax for services to be stripped back even further.
My right hon. Friend the Member for Ludlow (Mr Dunne) made the point that the last Labour Government shifted money from the shire counties to the metropolitan areas. The shadow Secretary of State described them as areas of increased need, but does he recognise that in rural areas such as Lincolnshire, where my constituency is, services cost more to deliver because of the geography?
The hon. Lady makes the case that in rural areas there are greater costs to providing services. In some cases, that is correct, but it is a minority of cases. All the evidence, including in a report commissioned by the Secretary of State’s Department, shows that the opposite is actually true. I do not want to get into an argument with the hon. Lady about how we should cut the cake. The cake is shrinking. We need to grow a bigger cake so that we can share out the slices more fairly. As we continue to shrink the cake, all we do is pit her area against my area and her area’s needs against those of the area I represent.
First, I would like to pay tribute to the fabulous work of the council staff in my area and the local councillors of the Conservative party, independents and others, who work so hard to deliver excellent services for our community.
My right hon. Friend the Member for Ludlow (Mr Dunne) made the point that the previous Labour Government moved funding from shire constituencies to metropolitan areas. As a resident of both South Kesteven and Westminster, I thought it would be useful to illustrate the difference between the two. In South Kesteven District Council area, the average weekly gross wage is £453.20, and the council tax for a band D property is £1,589.38 a year. In Westminster, where I am during the week, the average weekly wage is £786.10, and band D council tax is £710.50. This means that the average person in Westminster is earning more than £300 a week more but pays £879 less in council tax for their local services.
Despite the challenges to funding and the fact that if Lincolnshire County Council were funded the same per capita as the average council in the country, it would receive £116 million more than its current budget of roughly £500 million, it has been able to do some very innovative things with its funding. We have discussed the environment a lot this week. South Kesteven District Council introduced “The Big Clean” initiative last year, which visits each village of the district to remove fly-tipping, clean signs, remove undergrowth and do other things suggested by the local residents to improve the environment in which people live and ensure that they can take pride in their surroundings.
Gravity Fields festival, which has been running since 2012, is an innovation of our local council. This goes beyond delivering the basic services; this is the best in the country. It is a festival of art and science inspired by Sir Isaac Newton, who was from Grantham and went to the local school. The festival not only provides the people of Grantham with information on art and science and very interesting experiences, but it raises £1 million for the local area through visitors staying there and spending their money on food and drink and the like. This is a Conservative council doing its best to deliver really innovative stuff, despite having a stretched budget.
North Kesteven District Council, which covers the other part of my constituency, is similar. It has looked carefully at the challenge of being good to the environment while providing the social housing that is required. It has won awards for building curved homes and passive houses, delivering the next generation of social housing in an environmentally sustainable way. It is not only providing basic services but going above and beyond, to provide excellent services. Lincolnshire County Council receives lower than the average per capita funding, as I have said, but it is still providing our children and young people with what Ofsted describes as “strong and effective” services for those with special educational needs and disabilities.
The ageing population presents one of our nation’s most profound challenges. It raises critical questions about how, as a society, we enable all adults to live well in later life and how we deliver sustainable public services to support them to do so. There will be 2 million more people aged over 75 in the next 10 years, and many of those will be managing long-term conditions. It is vital to make sure that local councils are supported to provide for elderly citizens so that they can age with dignity. That is why I am glad this Conservative Government have invested in social care, with a 23% increase in the improved better care fund to £1.8 billion, an additional £410 million through the social care support grant and £10 billion for adult social care being provided to councils by 2020.
I really welcome the additional resources that have been provided for social care by this Government, but as a Member representing a rural constituency it is important for me to emphasise that an extra £1 for social care in London will go further than an extra £1 in Lincolnshire. Rural areas face higher costs for the delivery of public services than urban areas. [Interruption.] The hon. Member for Denton and Reddish (Andrew Gwynne) says from a sedentary position, “That’s not true”, but if one is visiting an elderly person in their home and then travelling on to visit the next elderly person in their home, there is of course a gap.
I am not saying that is not true; the Ministry of Housing, Communities and Local Government’s own report says it is not true.
I hear what the hon. Gentleman says, but it seems to me that rural shires often have Conservative-led local authorities that provide their services more efficiently. In practice, if we ask a carer to go out to visit three elderly people in a morning, for example, and those houses are very close together, as they may be in Westminster, they will be able to visit, spend longer with them and have lower travel costs than they would if they had to visit three houses in my constituency, which covers 433 square miles and is all within the same county council.
As I was saying, when it comes to social care, this problem is in large part due to both the demographics and the distances involved. As I have said, my constituency spans 433 square miles and has a low population density, and there are longer travel distances for staff to deliver care. Furthermore, Sleaford and North Hykeham, as a rural area, has a higher number of older residents. Those older residents have worked hard their entire lives and now need support from our public services to ensure that they can maintain a higher quality of life.
However, this is not all about funding. Actually, I think it is sad that so much of the debate has focused almost entirely on who is going to provide the most money, while only a little bit has been on how to pay for it, and not so much on innovation and quality of care. The important thing is not shouting about who can spend the most money, but who can deliver the best outcomes and provide the best care for people, because that is surely what everybody on both sides of the House wants.
Last year, there was the launch of the National Centre for Rural Health and Care in Lincolnshire. This is a grouping of the NHS, the University of Lincoln, Health Education England, Public Health England and the East Midlands Academic Health Science Network. This pioneering group will look at improving how we deliver care in local areas.
There is also the social care and digital innovation programme, which is run by NHS Digital. This gives money for local projects, so somebody with a local project that they think could improve care for residents, if they had a little bit of start-up funding to test it, could receive money to support the design and trial of digital solutions to improve care and provide value for money. Previous projects include an exoskeleton device in the Isle of Wight to give people greater independence, and the provision of Amazon Alexa in Hampshire to help people to maintain independent living.
There are other projects, too. In Cornwall, Peninsula Community Health Services is looking at how to prevent pressure sores. We know that 500,000 people in this country develop a pressure sore every year. These are excruciatingly painful, can become infected and, in the worst cases, can lead to such a serious infection that the patient dies. The continuous pressure monitoring technology devices will be able to help people identify hotspots even before the skin damage occurs and prevent that from happening. That is an investment in something that, overall, will not just improve patient care but save money.
The Leeds Care Record looks at how information can be shared—data protection means that in some cases it is difficult to share information held by hospitals and GPs—and how referrals are made. When I first qualified as a doctor, all the letters were dictated and signed, but now they are typed and sent electronically. Cumbria, for example, saves £400,000 a year by sending referrals electronically. That also saves time, which means not only saving money but improving the efficiency of the service delivered to patients.
I am glad that the Government acknowledge the need to change the outdated funding formula, which has failed accurately to recognise the discrepancy in need between urban and rural areas; that need is often hidden in rural areas. As Ministers review the consultation findings, I hope they will ensure that the new funding formula adequately takes that into account.
Finally, as a member of the Conservative party, which has long been the best custodian of the public finances, I say that it is imperative that money is spent both wisely and efficiently. The issue of social care goes much wider than just funding. Despite the challenges facing local councils, I have seen at first hand how the brilliant work by North and South Kesteven District Councils and Lincolnshire County Council can support the people in my constituency and make our resources go as far as possible.

Commons ChamberWe provide regular updates that specify the work taking place through the remediation programme to deal with this very serious issue of combustible cladding. The hon. Gentleman will well know the work that is in place, both in the public sector and in the private sector, but I underline to him the urgency I attach to this and how I am not keeping anything out of consideration in making sure that people are safe and feel safe.
I understand the desire to build a lot of new homes, but I share the concern of many of my constituents that this could lead to large housing developments of identikit houses. What steps is my right hon. Friend taking to enable small builders to bid for smaller areas of development? That would support our excellent small builders and encourage a more beautiful built environment.
I recognise and appreciate my hon. Friend’s championing of good design and the sense of place and space, which is something the Building Better, Building Beautiful Commission firmly intends to achieve. We have specific funding to support small builders so that we can have a strong, diverse economy in housing.

Commons ChamberOur policies are not about the many, not about the few; they are for everyone in terms of delivering on our housing agenda. Yes, we will consult on the new draft amended community infrastructure regulations, and I look forward to having the debate on them. It is this Government who are taking action to build the homes that our country needs. We will certainly take no lessons from the other side.
We are undertaking a review of local authorities’ relative needs and resources to address concerns about the fairness of the current system. That will determine the new baseline funding allocations for local authorities through a more up-to-date, transparent and fairer funding formula.
My right hon. Friend will be aware of the extra pressures on local authorities in rural areas with sparse populations and many miles of road network. Will he assure me that the Government will factor in those pressures when allocating funding to rural areas such as Lincolnshire?
I recognise my hon. Friend’s point about remoteness and accessibility, and the impact of journey times on things like labour costs. My officials are working with the Department for Transport to look at how the extra costs can be taken into account.
What I would say to Ealing Council is that it will shortly receive several million pounds extra to spend on its social care priorities. I would also point out that its reserves have increased in the last few years and are available for it to spend as it requires.
Housing remains the Government’s top priority and the work of my Department continues at pace. The latest figures show that we have delivered more than 222,000 new homes—the highest for a decade—but especially as the temperatures drop, we are taking decisive action to support vulnerable people without a home and have published our rough sleeping strategy delivery plan. Shortly, I will publish our draft local government finance settlement with a new fairer method for allocation to help our councils to deliver high-quality services. Finally, as Jewish families across the country gather to light the candles of Hanukkah, I want to wish everyone celebrating a happy and peaceful Hanukkah.
When I find time to do my Christmas shopping, I will do my best to support the local high streets in Lincolnshire. Will my right hon. Friend tell the House what his Department is doing to ensure that our high streets have the support to survive and thrive in our communities?
High streets are the hub of our communities, which is why I am delighted that we have announced a £675 million future high streets fund to invest in our high streets, as well as, for example, launching an open doors pilot to bring empty properties back into use, and matching landlords of vacant premises with local community groups to ensure that our high streets are vibrant community places.

Commons ChamberI rise briefly to welcome this Bill and to congratulate the hon. Member for Westminster North (Ms Buck) on bringing it forward. We all need a good home. It brings us stability and a place of family and of safety. As has been said today, we recognise that the vast majority of landlords are providing safe, secure and nice accommodation for people to live in, but it is unacceptable that, for some, that is not the case.
As a doctor, I wish briefly to highlight the medical and health implications of poor housing conditions. The hazards of having things such as faulty wiring or faulty boilers are very obvious, but living in a cold or damp home has significant effects on health, particularly for the elderly and young children. Things such as eczema, depression, asthma and all sorts of respiratory conditions are made significantly worse if someone lives in a home that is cold or damp.
As has been mentioned, this is costing the NHS around £1.4 billion a year, but it is not just costing the NHS—it is also costing those individuals who are suffering. We need to recognise the effect on the individual as well. Like me, many doctors have, over time, written to authorities to highlight the fact that people are not being discharged from hospital because their home conditions are not satisfactory. That is a particular issue for pre-term babies, who may be on oxygen. It is clear that we have an obligation to make this change. We must remember that children suffering from ill health do not sleep very well. When they do not sleep well, they attend school tired and perform less well, so they are less able to pull themselves out of the poverty trap in which they have found themselves. We have a clear moral obligation to ensure that people have safe homes that are healthy for them.
Is the hon. Lady worried, as I am, that not only do we have homes that are not really fit for human habitation, especially for families with children, but that we often do not know where those children are? With the growth of home schooling—look at what happened in California, news of which has emerged in the past week—there are some very serious problems confronting society.
I agree with the hon. Gentleman that it is extremely important that we make sure that all children live in safe and secure homes. The Bill brings a welcome ability for people to have individual redress against their landlords, and takes away the conflict of interest from local authorities, which would effectively have been asked to enforce themselves. We are putting this provision into law to ensure that people have this ability and are empowered. It is important for the Government to ensure that people know that the Bill has been passed and that they have this right, and that they have access to the advice and legal representation they need to be able to enforce that right. I welcome the Bill.
