We continue to work closely with industry, especially BAE Systems. As we develop this strategy, four companies are at the heart of it—BAE Systems, Rolls-Royce, Leonardo and MBDA—but we are in discussions with other nations. I am afraid that I am not in a position to update the House on who they are.

First, let me join the hon. Gentleman in paying tribute to Armed Forces Day, which is growing in status. It is important that we strengthen the bond between society and the armed forces, as it is from society that we recruit. The challenge we face is in recruiting people—we need to recruit 18, 19 and 20-year-olds who are fit and able then to meet the criteria.

I have visited Brize Norton—I was trying to weave that into the end of my answer to the hon. Member for Easington (Grahame Morris)—and with the future accommodation model, we are trying to provide greater opportunity for those who want to live on the base, rent accommodation or, indeed, live outside and get on the housing ladder. I hope that that will lead to greater retention and recruitment.

I most certainly will. We celebrate 100 years of the Royal Air Force, which plays a key part in driving technological development and inspiring so many young people to enter a career in engineering. Seeing amazing aeroplanes designed and flown is an inspiration for many future generations.

This has been a very wide-ranging and cross-party debate, with Members agreeing on many areas. In the brief time I have, I want to raise one issue that worries me immensely about the future of NATO and how it operates. We will need more time on the Floor of the House for this, which I will seek from the Leader of the House during business questions at some point. It is the issue of PESCO—the permanent structured co-operation of the European Union.

There must be an honest conversation, in the NATO Parliamentary Assembly at least, about how NATO’s command and control structures will actually work given the adoption of PESCO, which was signed on 11 December 2017. My hon. Friend the Member for Beckenham (Bob Stewart) made a point about how long it would take to get a security force into the Baltic states, but that is not actually what NATO is for. It is there as a reinforcement force, and a state should be able to hold the line for 72 hours before NATO comes in and defends it, although that is probably not long enough.

As I see it, there is a problem with PESCO. I urge colleagues to go away and read article 42 of the Lisbon treaty. Specifically, it says of

“a common defence, when the European Council, acting unanimously, so decides”,

that the Council

“shall in that case recommend to the Member States the adoption of such a decision in accordance with their respective constitutional requirements.”

The phrase “their respective constitutional requirements” creates one of the problems in that constitutionally, in German law, Germany cannot be part of an aggressive pact. There are therefore question marks in relation to the operation of PESCO.

PESCO seeks to do many of the things that people recognise that NATO should do, including purchasing equipment efficiently and using it in the best way, but that actually clashes with the constitutional restraints on some NATO states. If the argument for PESCO is about having a European border force, are all European nations going to sign up to it in a way that means they will enforce the direction the Italians are now going in?

I have consistently argued that the national shipbuilding strategy should be supported across the House, as it offers real support for our shipbuilding industry. We designate warships as a sovereign capability to be built in the UK. Other ships are open to international competition, but I am confident that there will be British yards putting in bids for that work.

17. When considering a replacement for the RAF’s airborne warning and control system fleet, will the Minister commit to holding an open competition so that bids from all defence partners—from the UK as well as abroad—can be considered? Will he also consider whether Sentry and Sentinel may in future be replaced by one aircraft type?

My hon. Friend is well known for his championing of issues to do with the Royal Air Force. It is important to say that the Ministry of Defence is currently going through a process of considering the replacement for that capability, and we are also considering the situation with regard to Sentinel moving forward. A decision will be made in due course, and he will be informed at that point.

It is a pleasure to serve under your chairmanship, Mr Streeter. I rise to speak with a great deal of humility, having heard the distinguished speakers who have gone before me, who have served and who have great experience in such matters. I rise only because I would like to add something from a slightly different perspective. I have not served; I am a lawyer and I approach the debate from a legal perspective, because there is a legal as well as a moral element to it.

By nature, I am very cautious about the increasing role of law in warfare, simply because the mindset of a lawyer is so different from that of a soldier, by necessity. Lawyers are cautious and risk-averse. They explore every option. That avenue simply is not available in circumstances such as those described by my hon. Friend the Member for Wells (James Heappey). The military are all about the can-do attitude that was described by my right hon. Friend the Member for Newbury (Richard Benyon). That is even more the case when we look at cases in retrospect.

As my hon. Friend the Member for Aldershot (Leo Docherty) has just said, nobody is suggesting that the military should be able to act with impunity; all that is expected is natural justice and fairness. If laws of war or engagement are broken, of course they should be held to account, but not years and years after the event. The spectacle of repeated historical allegations is absolutely deplorable, and set against a set of standards that were often simply not available at the time. IHAT is a classic example of that, and Northern Ireland much more recently.

I would like to add one thought on a limitation Act, from a civil law perspective. I used to practise in an area of industrial disease, representing people who had suffered from horrible illnesses such as mesothelioma. In those circumstances there is a statute of limitations—the Limitation Act 1980—so after a certain amount of time companies can expect not to be pursued. There are good reasons for that: memories fade, documents get lost, standards change, and knowledge and attitudes change. Therefore, after a reasonable amount of time, they have a reasonable expectation that they will not continue to be pursued.

Here there is a clear imbalance. For example, the IRA did not keep records, while the British Army does. In civil law we would look at things very differently. I entirely support the suggestion for a statute of limitations simply because we have a similar thing in civil law. We are currently providing assistance and protection to historical industrial companies that are facing only civil claims and not soldiers, who may face serious matters that would turn their lives upside down.

Our veterans should be entitled to know that when they serve, they can go home with gratitude and not have to look over their shoulders for the rest of their lives. The Government should be clear. The public view the spectacle of Britain turning on its own with absolute disgust. We must bring peace to veterans who have worked so hard to bring peace to us.

I can confirm that is the case. Sometimes with a certain element of sadness, much of what the Ministry of Defence and our armed forces do cannot be counted towards aid expenditure. Our peacekeeping in South Sudan and our hurricane relief operation in the Caribbean alone come to £100 million-worth of expenditure. None of that can be counted as humanitarian aid and support, which I think all of us in this House would agree it most certainly is.

For reasons of development time and capability, the combat air strategy cannot come soon enough. Will Ministers please confirm that the modernising defence review will include consideration of potential national partners so that the export consequences, as well as the workshare ramifications of potential partnering with the United States, Europe or an eastern partner, can be assessed, and assessed in good time?

I am afraid that I probably will not be able to give my hon. Friend quite the answer he wants, as we probably will not be looking at that as part of the modernising defence programme but, as part of our combat air strategy, we are looking at how we can develop those alliances. We may have to start looking further afield and not just to our traditional European allies. There is a world market out there—how can we develop new relationships with different countries and develop our future sixth-generation combat aircraft with them?

The hon. Gentleman makes a very important point. One of the first meetings that I had in my new position was with MBDA. Indeed, I also met its chief executive in Paris recently. The agreement is an example of what can be done to embed innovation in the way in which we do procurement. It shows support for UK-based companies and a degree of partnership between the MOD and the companies in question.

May I also welcome the combat air strategy? Will the Minister please give a commitment that the review will look not only to ensure that the RAF has the aircraft that it needs to fight the conflicts of the future, but at how British industry will deliver them?

My hon. Friend is a great champion for the RAF and for his constituency. I believe that he called for the combat air strategy before the announcement was made by my right hon. Friend the Secretary of State. This is indeed about capability, but it is also about embedding the ability of UK industry to respond to the needs of the 21st century, and the combat air strategy will do just that.

Conservative Members have always recognised the importance of being fully engaged in what is happening in Syria and Iraq, and we will continue to look at that exceptionally closely. My hon. Friend is absolutely right to highlight that issue. The MOD is one of the largest customers of UK plc and supports over 20,000 apprenticeships throughout the UK. It is clear that the MOD contributes significantly to the prosperity agenda across the UK.

I am sure that the Minister may want to say something about that when he replies, but he will be constrained, because it is difficult to discuss the exact details of such matters in an open forum. However, when I served in the Ministry, I was certainly aware of a potential threat to those undersea cables, and everything that I have understood since then leads me to believe that that threat has increased, not decreased, so the hon. Lady makes an important point. The Chief of the General Staff, General Sir Nick Carter, sounded a timely warning in his recent very good speech to the Royal United Services Institute about growing Russian military capability and areas where we need to bolster our own Army in response.

In the United States, the recently published defence strategy, authored by Secretary Mattis, has declared that state-on-state competition, particularly with Russia and China, is now viewed as the primary threat to the security of the United States and its allies. That important change in policy was then echoed to some degree by our Secretary of State for Defence in his evidence to the Defence Committee only last Wednesday, and it is really important that the House appreciates what he said. During the sitting, he explained that the threat to the United Kingdom from other states, such as Russia and North Korea, is now greater than the threated posed by terrorism, telling the Committee:

“We would highlight state-based threats… as the top priority”.

He went on to say that state-based threats have

“grown immeasurably over the past few years.”

When I put it to the Secretary of State at that hearing that what he was announcing—the primacy of state-based threats to our security—was a massive change in focus and that it would have a knock-on effect on how Britain’s military was structured and its readiness for war, he replied unequivocally, “Yes it does.”

That means that the defence review that is currently under way—the modernising defence programme—is now taking place against a significantly revised strategic background, in which deterring military threats from other states such as Russia, North Korea and, to a lesser extent, China is now to become the primary focus of this country’s defence policy. This new context brings with it certain important implications.

First, we absolutely must retain our independent strategic nuclear deterrent as the ultimate guarantee of our national security. All three states I just mentioned are nuclear armed, and it is important that we retain our deterrent to deter any nuclear threat against us.

Secondly, if we are to deter state-on-state threats, clearly we must bolster our conventional defences. Joseph Stalin is reputed to have said, “Quantity has a quality all of its own.” We can no longer rely on advances in technological capability always to give us the edge in any future war. We also need to make sure we have sufficient mass—the number of platforms—to deter our potential enemies. That means, for instance, rebuilding our air defences and bolstering our anti-submarine warfare capabilities to help to protect the sea lines of communication across the Atlantic, which will be vital in any conflagration on the European mainland.

My right hon. Friend is making a powerful speech, and I am interested in his comments on rebuilding our air defences. Is he as encouraged as I am by the announcement last week of the combat air strategy? Does he also agree that, given the enormous cost of modern aviation programmes, we will have to look at doing one of two things? We will either have to take a very serious strategic look at what kind of aviation military capacity we want and then to plan accordingly or, if we want full-spectrum military capability, it will ultimately mean more money.

I agree with my hon. Friend. He is right that the Secretary of State for Defence announced the new combat air strategy at the Committee, but what he announced on state-on-state threats was even more important. If we now have to deter Russian aviation capability as a state-on-state threat, it will be extremely expensive but, as my hon. Friend the Member for Gainsborough (Sir Edward Leigh) wisely reminded the House in his excellent introduction to this debate, the first duty of Government, above all others, is the defence of the realm. Our whole history as a nation reminds us that we forget that at our peril.

Thirdly, we must seriously consider how we could reconstitute forces in a national emergency. We must accumulate war reserves in order to show that we have the ability to sustain a fight if we were ever to get into one. As just one example, the Committee took evidence from BAE Systems executives a few months ago. When we asked how long it would take to build a Typhoon from scratch, we were told it would take four years or, if they attempted to accelerate the process, perhaps three years at best.

Those long lead times for manufacturing sophisticated modern military equipment mean that, in reality, we would likely have to fight a so-called “come as you are” war, which involves using equipment that is either immediately available or that can be reintroduced into service at short notice. It follows from this that we should now adopt a practice of mothballing highly expensive and complex equipment when it goes out of service—rather than disposing of it all, often for a pittance—so we have the ability to reconstitute at least some mass, should that be required if the skies were ever to darken again.

Fourthly, in light of the new strategic situation of state-on-state threats, spending 2% of our GDP on defence is simply not sufficient. We helped to deter Russia during the cold war by spending 5% of GDP on defence. If we now have to deter Russia again, we will simply not be able to do so by spending only 2% of GDP on defence —our allies also need to make a greater contribution. If we are to maintain an independent nuclear deterrent, bolster our conventional forces and build up our war reserves, we obviously need to spend something much nearer to 3% than 2% on defence. If we will the ends, we must also will the means.

Finally, I went to the cinema recently to watch Gary Oldman’s wonderful portrayal of Winston Churchill in “Darkest Hour”—he got the BAFTA and I very much hope he gets the Oscar, too. That film brought home graphically what happened to our nation after the policy of appeasement in the 1930s and our having run down our armed forces to the point where they were unable to deter war. I humbly suggest that my friends the “pinstripe warriors” of the Treasury, as I call them, should be taken en masse to watch that film as part of their continued professional development, in the hope that that might yet bolster our overall determination as a nation to defend ourselves.

I absolutely acknowledge that. Defence is not really a party political issue; it is an issue of national security, and I am heartened by the fact that Members from all parts of the House are here engaging in this debate.

The second set of problems with the plan laid out in SDSR 2015 relates to timing. As the name implies, joint force 2025 is some years away. We have a capability gap, and delivering that capability is some years off. It is also important to remember that this is not the generation of a new capability. The force laid out in SDSR 2015 is essentially making up for ground lost in 2010, when the MOD suffered a 8% reduction in budget and our fighting power was reduced by about 25%. We have to put things in context: having a deployable war-fighting division as laid out in SDSR 2015 is nothing new. We deployed a division of 45,000 soldiers to Iraq in 2003 and a division of 53,000 men in Operation Granby at the Gulf war in 1991. We are essentially making up for ground that we lost in 2010, and it is important to bear that in mind. It is also important to bear in mind that with joint force 2025, there is not much fat in the system—it is quite a bare-bones approach.

We have to reconcile ourselves to the situation we find ourselves in today, and I would be interested in the Minister’s comments. My judgment is that we cannot credibly claim to be able to deploy a war-fighting division within six months. That is some years off. We also lack the air defence that is particularly important to protect our enhanced force presence in Estonia. The Minister will perhaps mention that.

I thank my hon. Friend for giving way and congratulate him on this timely debate. I am grateful to him for mentioning air defence. He will appreciate that the Typhoon force will not be able to operate effectively without the tanker force that is based at Brize Norton in my constituency. He mentioned the Russian threat, which almost weekly we now see, as we did in the 1980s, probing our air defences. Does he agree that it is essential to make a cool, dispassionate assessment of that threat and make sure that our capacity and capability match it, rather than to reduce the threat to match available resources?

I absolutely agree. The response has to be threat-based, and the review must not be a sticking plaster. We need a large-scale solution for what is a large-scale problem.

To conclude my remarks on the SDSR 2015, there is also a gap in the extent to which we have the capability to co-ordinate artillery fire with cutting-edge technology, which was mentioned by CGS on Monday. The Russians have done that very effectively by co-ordinating long-range artillery fire with unmanned aerial vehicles. Furthermore, one of our big current gaps is that we do not exercise on any scale whatever. In their Zapad exercises, the Russians exercise north of 70,000 troops, whereas we in this country and across the NATO alliance are nowhere near that. That is a critical capability gap that we need to resolve.

A lot of what I have mentioned is tied up in CGS’s stark warnings on Monday. I look forward to the Minister offering reassurance on some of the points, particularly with regard to our forward presence in Estonia.

So where do we stand now? It is good news that the review that is under way has been restructured. We expect an announcement today from the Secretary of State for Defence to indicate that the defence component of the review will be extracted and given a little longer to run. That is a good development. In my judgment, the review that was under way, led by the National Security Adviser, was essentially misconceived. It was supposed to be initiated because of an increase in threat, but at the same time it was supposed to be fiscally neutral, so it was inherently problematic from the very start, and I am glad that that restructuring has developed.

I am also pleased that the former Secretary of State, my right hon. Friend the Member for Sevenoaks (Sir Michael Fallon), has indicated his support for an increased overall defence budget moving up to 2.5%. We have to see this slightly longer review, which I think will run into the summer, as an opportunity for a wholesale refunding of defence and the achievement of a proper long-term financial settlement for our military. I am confident that our Secretary of State gets that. I hope the Minister will reassure us that that is the case, and that Ministers see this as an opportunity for a long-term solution.

It is important that MPs, like all of us in this Chamber, make it clear to the Treasury that we insist on the proper resourcing of defence. That is important for a number of reasons, not least because I, like every Conservative Member, stood on a manifesto that committed us to maintaining the size of our military. Page 41 of the Conservative party manifesto commits us to maintaining the size of our armed forces. Apart from the politics, it is a national duty to achieve that.

We have to get the politics right. We cannot simply demand more money for the Ministry of Defence. We have to continue to insist on the MOD achieving efficiencies and best practice, including things such as competitive procurement. I am encouraged by the detail in the national shipbuilding strategy that sets upper limits on expenditure. Also, we need to consider seriously the removal of expenditure on Trident from the MOD budget.

In simple terms, we must reconcile ourselves to the fact that a world-class military cannot be bought cheaply. I conclude by saying that we should see this as investment, not spending. This is not money that just gets spent to no consequence. Spending on our military is an investment in our national profile globally. A strong national military does not simply defend us militarily domestically and internationally. It secures our global reputation. It is a fundamental enabler of our foreign policy, our humanitarian effort around the world and our passing global trade, so we get a phenomenal return on that investment. Members who have travelled around the world in connection with the military know that the British armed forces have, without doubt, a phenomenal global reputation for higher standards of excellence. We should recognise that as an asset, not just a cost.

I finish by repeating a quote from Trotsky that was mentioned by CGS. I am not given to quoting Trotsky in this place, but Trotsky rightly said:

“You may not be interested in war, but war is interested in you.”

A properly resourced military is not a luxury; it is an absolute necessity. Given our heritage and our history, I am confident that we can rise to the challenge.
