Commons ChamberIn this House, we often spend a great deal of time discussing national and international issues, but we ought not to forget that sometimes it is the seemingly smaller issues that make a real difference to the lives of the residents we represent. For many of my constituents in West Oxfordshire—rural and town dwellers alike—their first journey to work or to school takes place in a car. Even a short uneventful journey can be marred by the phenomenon known as potholes, which are caused by poorly kept roads.
Potholes may seem like a small problem, but they are in fact a large one, and there are several reasons for that. There is of course the pure discomfort and irritation that affects everybody’s quality of life, but things are much more serious than that. On small, poorly lit rural roads, particularly in winter, there is a real danger to the people who are navigating those roads. There is a danger to life and limb, and there is a danger to property. Many constituents have written to me to explain how they have spent many hundreds and sometimes thousands of pounds on vehicle repairs having hit a pothole. This is unquestionably one of the most frequently raised issues with me on the doorstep, so I am grateful to the House for giving me the time to bring the matter before the Minister and to ask for his help.
With the House’s permission, I will read out from one or two emails that I have received from constituents as an illustration of the scale of the problem. Peter from Bampton said that the road near him was like
“driving on a ploughed field.”
A couple from Finstock said that they have lived in West Oxfordshire their whole lives and are “ashamed of our roads”. Perhaps Paul from Standlake puts it best:
“The roads in the area are an absolute disgrace, and downright dangerous in many places.”
Indeed, as an illustration, I was pleased this week to welcome to Parliament for a tour a group of students and parents who had entered my West Oxfordshire schools photography competition. One of the parents took me aside and said, “While I’ve got you, could I please take a minute or two of your time to talk to you about potholes?” We cannot possibly overstate the importance of this matter to the residents of West Oxfordshire and Oxfordshire as a whole, and there will be many Members from rural and urban areas alike who will agree.
Through the armed forces parliamentary scheme, I had the opportunity to visit an RAF base along with the hon. Gentleman and experienced the roads in his constituency, so I understand that this is an important issue not only for him, but for everyone in the House. There is huge tourism potential in the hon. Gentleman’s beautiful constituency, so does he agree that we need massive infrastructure investment to ensure that roads are clearly marked, easy to use and in decent condition? Tourism is about visiting big cities and visiting and enjoying rural idylls such as his constituency, but people can do that only if the roads are decent.
I am grateful to the hon. Gentleman for making that excellent point and for joining me on that trip to RAF Brize Norton, which I like to speak about in the House as often as I can. This matter is important for tourism, absolutely, because it forms part of the offer and image that we project of our local area, but it is equally important for businesses, which are moving goods around and will wear the costs of vehicle repairs, and for private individuals.
The scale of the issue and of people’s concerns should not be underestimated. The issue is not specific to Oxfordshire, but it is more keenly felt because of the many miles of rural roads, which make maintenance a real challenge. The road network in Oxfordshire is 2,994 miles long—15% is A roads, 10% is B roads and 75% are C or unclassified roads, which are the small rural lanes to which the hon. Member for Strangford (Jim Shannon) referred. A high proportion of C or U roads are often not built to the modern standards that we would expect were the roads to be built now. They are essentially old cart tracks through the rural county which have had tarmac added to them over the decades, and rural locations are hard for maintenance teams to reach to make repairs. That is a particular problem when temperatures drop so low during the winter months.
Does my hon. Friend agree that what frustrates people across the country, and certainly in Cheltenham, is that contractors are often getting away with poor-quality repairs? If they just did the job properly in the first place, the repair would have a chance of holding and would not leak at the first sign of frost.
My hon. Friend makes a superb point. I have mentioned the concerns raised when I knock on people’s doors, and people express that frustration that potholes come back a few months after being repaired. They just wish it was done properly so that did not happen. The problem is particularly acute around street works, metalwork and so on. The Government are consulting on moves to try to remove metalwork from the roads and to put it on verges and footpaths, where it is safe to do so, as a way of making sure that the phenomenon my hon. Friend rightly mentions is ameliorated. We have to find a way to ensure that repairs remain sound not for a few weeks or months but for years to come.
Oxfordshire County Council has been given close to £20 million to solve this problem. Why does my hon. Friend think we are seeing no great improvement, despite the advent of dragon patchers? When the council has that money, why does it not try to fix the problem?
My hon. Friend makes an excellent point, and the Government have certainly been giving more money to local authorities, which are responsible for repairing the roads—I am sure the Minister will refer to that. I have provided some details of the scale of the problem, which perhaps has a great deal to do with it. We have a very rural area, and it is very adversely affected by weather.
One point that I have not yet covered, which relates to that raised by my hon. Friend the Member for Cheltenham (Alex Chalk), is the impact of development and of very heavy lorries. When a housing estate is built, heavy materials such as breeze blocks, girders, bricks and wood have to be brought in on small, narrow roads. There is a lot of development going on in Oxfordshire, which is a growing and economically busy area. That really adds to the scale of the challenge. The bigger the roads, the bigger the trucks and the greater the damage.
I briefly mentioned the challenge caused by the winter. The snow in December 2017 and further freezes in January and March 2018 have damaged an already fragile network, and it is worth noting that Oxfordshire has a lower proportion of roads assessed as good than the national average, but it also has a lower than average proportion of roads assessed as poor. Although Oxfordshire has a higher than average proportion of roads assessed as fair, fair means five to 15 years of life remaining. That is not a catastrophic state of affairs, but clearly it is an issue that requires a long-term solution.
I am grateful to my hon. Friend the Member for Henley (John Howell) for mentioning the work of Oxfordshire County Council. Of course we would like the council to do more, but I would also like us to recognise the work it has been doing, particularly in recent weeks and months, while drawing the House’s attention to the requirement for further works.
Oxfordshire County Council has 18 crews working on roads in the county, and I understand that is the largest number of crews it has ever used. In the summer it usually has only six crews, so the council is very much aware of the scale of the problem and is working hard to make changes
As my hon. Friend rightly said, Oxfordshire owns two dragon patching machines and shares a third with the highway authority. The machines, which are somewhat dramatically named, use hot tarmac to melt and mend potholes. Rather than just filling the potholes, which means the filler often comes out again, the dragon patchers melt and rework the surface, which is more efficient and lasts longer. Of course, it is much cheaper, too—costing about £22 per defect, compared with £80 per defect using the normal cut-and-fill method. That will help, but it only really helps in rural areas because the surrounding tarmac is melted in the process. That rural area is assisted by dragon patchers. Small crews are able to travel across the county to fix holes more quickly and cheaply and to handle traffic management at the same time. All these steps mean that the council has fixed more than 28,000 defects, of which about 23,000 were potholes, since January 2018. We are talking about potholes, drains and damaged signs.
Does my hon. Friend agree that what is so infuriating for residents is seeing one defect repaired but surrounding defects left or areas that we all know are going to crumble in the next frost left unattended? Do we not have to find a more efficient way of fixing holes and the defects around them?
I am grateful to my hon. Friend for that. I was wondering whether he was going to make that point in his earlier intervention, because this is linked to that. He rightly says that people find it frustrating is when one pothole is done but another a foot away is left because it does not meet the intervention level. We all understand that there has to be an intervention level at which county councils start to undertake work; otherwise, we will be trying to have a bowling green surface and, clearly, it is unreasonable to expect any county council to provide that.
There is a solution, which I will come to shortly. It is why I have entitled this debate “Road Restructuring: Oxfordshire”, as that is what we need to be looking at. Let me give the last of my statistics. In March alone, 5,146 potholes in Oxfordshire were fixed. A lot of work is being done; this is a major task, but a lot is happening as we speak.
I also thank the Minister and the Government for what they have done, as we must not forget that. They have acknowledged the extent of this issue—I have raised it before, and Oxfordshire received an extra £2.9 million in funding from the Department for Transport to repair roads damaged last winter. That included a £1.5 million pothole grant and £1.3 million from the flood resilience fund. I am delighted that, with extraordinary timing—I am grateful to those at the Table Office for having pulled this debate out of the hat when they did—the county council’s cabinet approved just yesterday an extra £10 million for road repairs across Oxfordshire. That will pay for a further 46 miles of surface improvements and 52,000 square metres of patching; this is on top of the £8.5 million already spent on carriageways and footway repairs.
Much as I thank the county council for that, and much as I thank the Government for the money they have given, more needs to be done, and residents of all our constituencies, and certainly those in West Oxfordshire, will be expecting me to push for more. The council has agreed in principle to invest a further £120 million over the next 10 years. That is funded by borrowing, so it will have to manage its finances correctly, although I know and trust that it will be able to do that. I would, however, like to register my concern that that is something the county council is having to look at doing, because, as my hon. Friend the Member for Cheltenham has rightly alluded to, what is happening not just in West Oxfordshire, but across the whole UK, is that the roads fundamentally need restructuring.
We are dealing with the fact that tarmac has been added to roads, which over the years have been patched and repaired. What really needs to happen is the removal of that whole surface layer, and kerbs need to be put in, along with sound, watertight, weight-proof surfaces. I accept that that is easier said than done. I understand that to bring the whole of Oxfordshire’s road network up to an acceptable standard would cost about £250 million, with a further £21 million required to keep that going through resurfacing and £5 million a year needed for regular maintenance work, such as gully cleaning.
We can use modern technology, such as the FixMyStreet app, whereby people can take a photograph of the defect and send it to the county council, which will come to carry out the repair, and people can see the log of the complaint. That is brilliant and I encourage all hon. Members to speak to their constituents to encourage them to use it. However, it does mean that councils’ workloads are dramatically increasing, because each time a defect is reported, someone has to go to look at it. Although this is very efficient, it means a lot more work is required.
I know that others want to get in on this debate, but I just wish to say something about solutions. I would like to reassure the Minister that I am not demanding that he give me a £250 million cheque for Oxfordshire this evening, although if he has got one, I will gladly receive it—I can see that he is checking his pockets as I speak. The road network in Oxfordshire is going to undergo a dramatic transformation in the near future. We have the Oxford to Milton Keynes and Cambridge expressway. We are looking at A40 improvements, which are necessary; the housing infrastructure fund bid has gone in; and the major road network fund is involved in respect of work on the A40 and A420 in the Wantage constituency. All of this, if successful, will bring much needed improvements to the road network and ease congestion. The Minister will know how often I raise the issue of the A40, and it would not be right if I did not mention it again today.
I thank the hon. Gentleman for giving way again. He has very clearly outlined the important issues on the roads, but does he accept—I say this from the knowledge that I gained of his constituency when we were both involved in the scheme that I mentioned—that the roads were not built to take the current levels of traffic, and they need to be able to do so. May I also mention rural areas and the fact that tractors and vehicles are very large and the roads are not built for them either?
The hon. Gentleman is absolutely right. In rural areas, agricultural traffic of tractors and combine harvesters is an added pressure.
The point that I particularly want to make before I conclude is that while much of it is wonderful, we do need extra work on the A40 in particular to ease congestion. That will be effective only if the feeder roads for those major roads are also repaired. That is important.
I raised the issue of potholes with the Minister in May this year. I was very pleased that he agreed with me that we need a more strategic approach to ensure that those C and U roads are not left out. We need to look at that lattice work of small rural roads that lead to the main trunk roads in a strategic way. I am looking forward to hearing from him, perhaps today or in the near future, about his plans on that score.
One thing is absolutely clear: potholes are not just a nuisance, but a real danger to people travelling either at speed on a trunk road or navigating a small rural road at night. They are a huge expense to drivers, and we must ensure that we invest what is required in our road network so that we have modern roads for a modern county.

So do many others, such as Burnley. Chronic underfunding has led to extremely worrying short-termism on the part of local councils. They have opted for the inexpensive, short-term solution, which of course fails to tackle the actual issue of repairing the whole road. We know that at some later point, there will be problems on that road.
It does not have to be that way. I urge the Government to increase funding to local authorities. They have said that they gave some money in a package in March, but that was not new funding; it had already been announced. A huge funding gap still exists, and the backlogs are still there. We need that money.
The Government need to understand a simple point: if they keep doing the same thing, we will see the same result: we will have to endure worse and less safe roads. We will have to pick up the personal costs of damage to our vehicles and the collective cost of wasted taxpayers’ money on compensation. On top of those fees, we will have to endure more years of this Government deflecting blame and refusing to take responsibility, when their miserly approach has come back to bite the people that they purport to represent.
The hon. Lady is being very generous with her time, and I am grateful to her for giving way. My constituency in west Oxfordshire has a similar great problem with potholes, on both major and rural roads. I declare my interest as a cyclist. Potholes are a danger to me, but they do damage to vehicles too. Does she agree that prevention is better than cure? Would she encourage utility companies, as the Government are doing, not to put their facilities in roads, so that when those facilities have to be fixed, damage is not caused to the roads? Potholes are much more likely to reoccur where there is a structure in the road, rather than on the side.
Of course that is right. Flood resilience and other funding has been made available, and can be tweaked in response to that. Many local authorities were not prepared for the severity of last winter and the repeated freezes that damaged our roads. My hon. Friend is absolutely right. The wider point is that, as part of a strategic and longer-term view of local roads funding, we can create greater resilience in the network as a whole so that those kinds of events can be better dealt with.
I am very grateful to the Minister for giving way. He is being very generous with his time. He spoke of a strategic approach to funding, but will he also consider a strategic approach to rural roads? In many parts of Oxfordshire—particularly west Oxfordshire, where I am—we are essentially dealing with cart tracks that have been tarmacked at some point and need long-term maintenance. Will he consider that point?
I very much do consider that point. I live in a rural consistency that has urban roads in Hereford and lots of rural roads around it, so I take both sides of that argument extremely seriously. The facts are interesting. Although there has rightly been a lot of concern about the recent effects of the winter, A and B roads have gradually improved, by and large, as our annual road conditions survey work shows. It may well be that, as we look at the effect of the last quarter or two, that picture will have changed due to the severity of the winter, but that is the overall picture. However, that does not address the issue of C and U roads, which are a further cause of concern, and my hon. Friend quite properly raises it.

Commons ChamberThe midlands main line changes and efficiency improvements take place in a rolling way up to 2020, which is when the significant benefits to the hon. Gentleman’s constituency will start to flow through.
The Department for Transport is providing just over £6 billion to local highway authorities in England, outside London, for highways maintenance funding from 2015 up to 2021. Of course, my hon. Friend will be aware of the £296 million pothole action fund.
I welcome the prospect of upgrades to main roads in west Oxfordshire, financed through the housing infrastructure fund and the growth deal, but what are Ministers doing to ensure that small rural roads in areas such as West Oxfordshire, which often bear the brunt of winter damage, are not neglected and are also maintained to a high standard?
My hon. Friend is absolutely right to raise that point, especially in the light of the recent very bad bouts of weather we have had, which have particularly affected local roads. Until then, it was true that the A and B roads were improving over time but that that leaves out the C and the U roads. A more strategic approach needs to be taken to that, and I am planning to do that in the months to come.
If I am not mistaken, the hon. Gentleman has just trashed the hard-working men and women of the train companies, who are trying to do a decent job for passengers; he cannot have it both ways. I am afraid that this is a problem with Network Rail, and I have said that it cannot happen again. We have now had the late delivery of the timetable twice in six months. It is not what I would have expected to happen at this moment in time, with such a big, complex change. None the less, it is happening because we are running vastly more trains to more destinations. New trains have been running this week, and there are people getting on trains this week who have a seat for the first time in four years. That is a good thing.
I am certainly aware of stakeholders’ desire for faster and more frequent services along the North Cotswold line between Worcester, Oxford and London. We will continue to provide advice to Lord Faulkner’s taskforce as it develops its proposals.

It is a pleasure to serve under your chairmanship, Mr Davies. I congratulate the hon. Member for Nottingham South (Lilian Greenwood) on securing this important and extremely timely debate.
I declare an interest: I am the chairman of the all-party group on community transport, which is backed and whose secretariat is provided by the Community Transport Association. Many hon. Members here are members; those who are not are very welcome to join. This is far more important than simply a parliamentary matter. In my constituency, I have four excellent community service providers—Our Bus Bartons, West Oxfordshire Community Transport, Volunteer Link-Up and the Villager—and they are all thriving. Only last week, I opened a new bus as it was handed over to the Villager service. Those services are all terrified about the impact of the Department’s proposed actions under the consultation.
I am very grateful to the Minister, who is very interested in this area. He has visited Our Bus Bartons with me, listened in person to the concerns and spent a great deal of time listening to my volunteers in person. I know he is concerned about this issue and he is doing his best, but there is an extraordinary problem here. The reason why all those volunteer-led services exist is that commercial providers have withdrawn. Is it not an extraordinary perversity that, as my right hon. and learned Friend the Member for Rushcliffe (Mr Clarke) said, under pressure from commercial providers, which do not want to operate in these areas, it may be difficult or impossible for such volunteer-led services to run?
We have heard some excellent speeches today. I just want to mention a couple of the comments made by my hon. Friend the Member for Cheltenham (Alex Chalk) and my right hon. and learned Friend the Member for Rushcliffe. I apologise to my hon. Friend the Member for Charnwood (Edward Argar), but there are in fact three barristers here.
My hon. Friend says we will get six opinions—I am sorry all the barristers are agreeing with each other.
My hon. Friend the Member for Cheltenham is absolutely right that there is clearly space for interpreting the law here, and that is exactly what we have to do. The sections 19 and 22 system, which has existed for so long, is a classically British compromise. It has created a benign environment under which community transport can operate. It is essential that we continue to go through the regulation and the law with a fine-toothed comb. Simply put, we cannot allow a situation to arise in which community transport providers are not able to operate.
Will the hon. Gentleman join me in thanking all the groups across our county that do this, and especially Christopher Gowers from Wolvercote? Many of them cross our constituency boundaries, because our communities are interwoven.
The hon. Lady is absolutely right. I mentioned Our Bus Bartons, which from my constituency runs a service to not only the Banbury constituency but Oxford Parkway railway station. It provides vital links, not just to stations but to doctors’ surgeries, for people to go shopping or for young people to go to work. The impact and essential value of the services simply cannot be overstated. She made that point very clear.
I, too, thank all the volunteers, without whom the services would not run. They put an incredible amount of effort into ensuring that when commercial services were withdrawn, communities could step in and fill the breach. We must make sure that that can continue to happen.
Rural isolation is a real challenge for any of us who represent a rural area, and I know that the Government are combating it and worried about it. That is another essential reason for community transport to continue.
I gave a full response to the consultation, in which I made some of the more technical points that I do not have time to make now. I urge the Minister to engage with the all-party parliamentary group and all of us, because we want to help. We must find a way through to ensure that community transport can continue to thrive, as it has done so far.

Commons ChamberI absolutely recognise the campaign that the hon. Lady fought, and I think it is very worthwhile. I slightly doubt whether what she suggests is in fact the case, but attempts can of course be made within the rules. This is a very narrowly defined piece of legislation that focuses very specifically on permitting and on trailer registration, so there may not be scope to add other things, but I continue to be delighted to talk to her about the campaign that she is waging.
From the need for a final fix to the A40 to urgent upgrades to the Cotswold line, the need for a boost to west Oxfordshire’s transport is now acute. Will Ministers agree to work with me to make it happen?

Commons ChamberThere will be a continuation of the accessibility fund in the next control period. We have not decided exactly how much it will be, but I can give the hon. Lady an assurance that I will want to make sure that where commitments have been given in the past, we will seek to fulfil them in the next control period.
Will the Secretary of State confirm that privatisation has brought investment of £6.4 billion to our railways over the past 10 years, and that when awarding franchises both on the east coast main line and on the Cotswolds line—the GWR franchise, which is being consulted on at the moment—his guiding light will always be the quality of service provided to passengers?
This is now very much my approach. My view is that if the service is really good, revenues will follow. While it is absolutely essential that one seeks to achieve best value for the taxpayer in a bidding process, there is already a different balance between the amount of money bid and quality, and the balance will continue to evolve towards quality. That is what matters to passengers, and what drives revenues.

Commons ChamberI do not recognise the description that the hon. Gentleman gives. I have been up and down the country talking to community transport schemes. It is not at all clear that the implication for local community transport operators will be anything like as severe as has been suggested, and the one case that has been tested has been referred back for further evidence gathering.
I am grateful to the Minister for recently visiting my constituency, where he saw the great work being done by Our Bus Bartons. He will know that such companies all over the country are urgently seeking reassurance, but can he clarify whether any action proposed by the transport commissioner reflects upon the consultation that is taking place, or whether the consultation will be taking place in any event?
The consultation will be taking place in any event, and the details will be announced shortly. I greatly enjoyed my visit to see the Our Bus group, which is a model of good practice in local community transport.

Commons ChamberTo answer on my right hon. Friend’s behalf, I should say that the answer is in so far as the situation allows us to. As the hon. Gentleman will know, we have not ruled out legal action of our own. We are waiting for the German legal authorities—under European law, given the origin of these technologies—to make their decisions. Once they have done that, we will take a final view. But we have been extremely clear about our view in general about how the company has behaved.
I have two things to say. First, we very strongly support community transport operators in general. Secondly, we have been under some pressure to clarify the rules regarding local transport operators who are tacitly operating commercially. I am sure that that is not the case in Oxfordshire, but it is in other parts of the country. If my hon. Friend’s transport authority has a difficulty, he is welcome to get it to talk to my officials and/or the Community Transport Association.

It is a pleasure to serve under your chairmanship, Mrs Gillan. I congratulate my hon. Friend the Member for Bexhill and Battle (Huw Merriman) on securing this important debate. I shall take hon. Members through the issues affecting my constituency, travelling through them quickly, as it were—which is more than anyone could do trying to travel on the roads themselves. I assure our excellent and generous Minister that, despite what may be heard from other hon. Members present, there is no project more worthy of investment than the A40 running through West Oxfordshire.
As anyone who has visited West Oxfordshire or spoken to a local MP will realise, the A40 is the pre-eminent issue there. Not only do my constituents spend hours stuck in traffic doing the short journey from Witney to the centre of Oxford, but the economic potential of an enormously successful area is being constricted. One need only look at Carterton, where world-beating industries such as Boeing and Airbus are present on the base, but where the slip road access to the A40 is restricted; or Eynsham, where Siemens, with its word-beating medical engineering, is restricted in relation to travel on the A40. There are many other businesses there, as is shown by the West Oxfordshire business awards, but I cannot mention them all because time is limited. They are restricted in the economic growth that they could deliver, because of the road.
The A40 is the central issue in West Oxfordshire, but not the only one. It has spin-off side effects. Traffic trying to avoid the A40 travels, for example, on the A4095 through Bladon, where I live. It is a world-famous village because it is where Winston Churchill is buried, and we have many coaches per day. Visitors are of course welcome, but through the narrow pinch point and the coach parks further on there is excessive congestion. There is also particular congestion in Burford, with its world-famous hill, with traffic backed up along it.
Hon. Members will realise that that high street is called the gateway to the Cotswolds; nearly every building is listed, and there are HGVs stacked up on it, because there is nowhere to go. A bypass for Burford would also be high on the list for residents in that part of the world. Horsefair in Chipping Norton and Bridge Street in Witney are two areas in West Oxfordshire that have high levels of pollution, and a bypass around Chipping Norton to remove the weight of traffic—figuratively and literally—is absolutely necessary.
There is also a great need for public transport. We have already heard from the hon. Member for Oxford West and Abingdon (Layla Moran) about cycle paths, and I would like the B4044 cycle path to happen. I cycled from my home in Bladon to Oxford, when I worked there, along the A44. There is an excellent cycle path there, but we need more of them. Commons ChamberIt is an honour to be called to speak in the debate on the first piece of substantive legislation in this Parliament, and to be the first Back Bencher to do so. The Bill brings back some traces of memory lane for me; I declare an interest in that I practised in consumer protection at the independent Bar before my election to Parliament. Indeed, I was involved in lecturing and cases in this very area. Somewhat optimistically, I called it “holiday law”, which makes it sound—I can hear one of my colleagues saying this—like rather good fun. Having spent years prosecuting trading standards legislation and defending criminal law, as well as working in the personal injury sphere, I must have been on my way back from holiday while looking for a new area to branch into, and then an opportunity came up. I obviously decided that if I could not actually be on holiday, I might as well at least talk about being on holiday. I therefore produced a lecture, which I covered with lots of rather attractive pictures of happy people on holiday, sun-dappled beaches and palm trees, but that of course rather missed the point, because when one goes to see a lawyer, one is telling them not how good a holiday was, but that something has gone wrong. That is the all-important point that I was addressing in my career and that the Government are seeking to address through this Bill.
Things occasionally go terribly wrong when people are on holiday and, from my experience at the Bar, that can be anything from simply poor quality through to a catastrophic failure of holiday, injury or, in some cases, even death. That is what we are seeking to address through the Bill.
I started my lecture to the Bar with the same story that the Minister told of the temperance campaigners—it is one of those throwaway anecdotes we tell at the beginning of what can sometimes be detailed lectures—and I thought for one moment that I was about to hear him repeat my lecture back to me. I am glad that he went on to more substantive matters.
In my constituency I have not only a great many places that people come to visit—I will refer to some of them in a moment—but, of course, many people who, as we all do, look for places to tour abroad. It is for the constituents of Witney and west Oxfordshire that I most strongly desire to see the Bill enacted.
I express my support for the Bill at the outset, because ATOL protection is a critical part of the protection that we all rely on when we book a tour. It is only right—and necessary—that we seek to extend that protection to a broader range of holidays. When ATOL protection started in 1973, the world was very different from the one that we inhabit now. It was a world with few airlines—a world of British Caledonian and nationalised airlines such as British European Airways and British Overseas Airways Corporation. One might even say that it was an era before the benefits of a free market were fully explained and realised in this country—we should perhaps remember that at all times in this debate. It was a day before the internet. It was a day when going abroad was full of uncertainty, and sometimes even danger. It was into that world that the package tours regulations came into being, and rightly so.
Does my hon. Friend agree that at that time it would have been unimaginable that someone could use a mobile phone to book a holiday with an operator in Germany, France or another country in Europe? At that time, walking into a travel agent on the high street was the only real way of booking this type of project.
My hon. Friend makes an outstanding point. We could be sitting in the Chamber now, if we were not paying attention to the debate—I am sure every Member is paying attention with alacrity—and booking ourselves a holiday on our mobile phone. Such a world was not even envisaged in 1973, but we did have the advent of the package tour, and British Airtours, a subsidiary of British Airways, was one of the leaders. People’s ability to have their package holiday protected, provided that they had a flight, was a major innovation, and it is something that we have now lost.
I say that from personal experience because, through my work, I have first-hand knowledge of how the package holiday industry now works. Not only do we have what is called “dynamic packaging”, in which a vast choice of providers, destinations and activities are available to members of the public, who can tailor bespoke packages for themselves, but those selling holidays can seek to step around some of the relevant legislation. A website might purport to be operating and offering a package but, when one actually looks, it turns out that the flight is offered by a subsidiary, the accommodation is operated and offered by another company, and other packages—perhaps excursions—are dealt with by someone else. It is quite easy in this day and age to step around the regulations that ATOL provides, which is why the Bill is so necessary. The travel market has changed significantly in recent years. Talk of romance was not what drew me to my feet, although it might have done. My hon. Friend talks about the changing character of the industry and the need to ensure that the regulations are updated. Reflecting on the remarks made by the hon. Member for Middlesbrough (Andy McDonald), who speaks for the Opposition, I reaffirm my commitment to consult further before any regulations are brought before the House under the affirmative procedure. I draw the attention of my hon. Friend the Member for Witney (Robert Courts) to section 71B of the Civil Aviation Act 1982, which already makes provision for consultation by the CAA in the light of any such changes.
I am grateful to the Minister for making that clear. The prospect of amendment has been ongoing for some time, so I am delighted that we are addressing it in the House today.
Although the image we all have of walking down the high street, flicking through a brochure and speaking to somebody behind a till still happens in many cases—many people avail themselves of the services that exist, including at the excellent travel agencies in my constituency—many people do not do that. It is now so easy to go on the internet to put together a bespoke package for ourselves. In a sense, we have become our own travel agents, but that brings challenges as well as opportunities for this new generation of travellers. In this House we embrace the opportunities that come with those challenges. Indeed, I would go so far as to say that we have seen the free market in action with the expansion of providers, destinations and activities. We have seen so many of the advantages that a free market can bring in the interest of consumers. Indeed, the online travel market has led to reduced costs for holidaymakers, as well as increased choice and flexibility.
Of course, we have to reassess protections at the same time as we reassess, and benefit from, those changes. The mix and match of lower prices and wider opportunities has to be seen alongside the protection. Many holidays now fall outside the scope of ATOL, which is very different from the situation in 1973. In 1998, approximately 90% of all leisure flights were covered by ATOL, but I understand that the figure has fallen to under 50% in recent years. I welcomed the Minister’s comment at the start of his speech. As much as I have praised the free market and its benefits in terms of opportunities, choice and reduced costs, I also understand that there is a role for Government. I agree with him that it is appropriate for the Government to step in and ensure that consumers in this field are protected.
That is why I welcome the measures in the Bill to address such changes. The Bill will ensure that the ATOL scheme keeps pace with innovation in the online travel market, while also ensuring that protections are in place, regardless of whether someone books online or on the high street. We will therefore ensure that more than 20 million holidaymakers each year continue to be protected.
Given my hon. Friend’s comments, will he say something more about clause 1, which extends ATOL to sales made by UK companies within the European economic area? Does he think that that provision is worth while?
I am grateful for my hon. Friend’s timely intervention, as the next page of my notes deals with clause 1. Existing ATOL legislation applies only when the first leg of a relevant flight booking departs from a UK airport. The new legislation introduces a single-market approach to insolvency, whereby EU-established companies will be required to comply solely with the insolvency protection rules of the state in which they are established, as opposed to the place of sale, which is the current position. The legislation is therefore much wider, and the company will only have to be established.
Does my hon. Friend agree with me and several consumer groups that £2.50 is a low price to pay for ATOL protection compared with the cost of standard travel insurance? In the longer term, we might see a decline in the cost of travel insurance as more holidays are covered by this enhanced ATOL protection.
My hon. Friend makes an excellent point. He is right that the ATOL scheme is funded by a levy of approximately £2.50 per protected passenger and that it would be extremely unwise of any holidaymaker to go abroad without adequate travel insurance. I encourage everyone always to have such insurance, although it can sometimes be pricey, especially if someone is looking to protect themselves against some of the more routine failures that are easily covered in the ATOL scheme. However, more serious misfortunes can occur when people are on holiday, which is why travel insurance is, of course, still advisable. As my hon. Friend suggests, the cost of insurance may come down in time as a result of this enhanced package.
Clause 1 will allow travel companies established in the UK that sell flight-inclusive packages to use their ATOL membership and protection to cover all EU-wide sales without needing to comply with the insolvency protection rules of any other member state. Clause 2 deals with funding and qualifying trusts within the ATOL trust management structures. The Department for Transport is alive to the fact that because we have seen significant changes to the travel industry—not only since 1973, but since 2004, as well as more recently—it might be necessary to enter into separate trust arrangements for the greater business model, such as linked travel arrangements, to give greater transparency to businesses and consumers. It might be necessary to introduce a new form of qualifying trust to ensure that the ATOL trust will still protect consumers in the all-important area of flight accommodation. The Bill allows the flexibility under trust arrangements so that we can increase funding and ensure that ATOL is adequately funded as time goes on.
Clause 3 addresses a slightly different point: the ability of the CAA—the House will realise that the authority is responsible for running the ATOL scheme—to require and request information from airlines selling ATOL-registrable products within the UK and more widely. Under the Bill, an important change would apply to airlines that have an air service operator’s licence from another EU member state and therefore would not need any of the licences that have been granted by the Civil Aviation Act 1982.
The House will be delighted that this is a short Bill, containing only four clauses. I have needed to deal with only three, so I do not need to go through the other one—I am sure everyone is delighted. [Interruption.] The Bill is short in terms of clauses, as the House will realise.
My hon. Friend referred to clause 3. Those who have an air service operator’s licence from other European countries will not need a CAA licence. Is he satisfied that the measure will still give full consumer protection?
I am indeed satisfied that it will give full consumer protection. I say so because the Government have consulted widely. Once again, my hon. Friend has somehow, with extraordinary prescience, managed to prompt me to move on to the next stage of my speech, which may have been his subtle intention.
The Government have consulted widely, and the industry’s response has been favourable. We have received broad support from a majority of respondents to the proposals to harmonise ATOL with the scope of the EU package travel regulations. I noticed that during proceedings on the Vehicle Technology and Aviation Bill, evidence given by the group director of consumers and markets at the CAA stated:

I hope that the House will forgive my mentioning that in detail. I do so simply because of my experience of having argued the concept of what a package is in the courts of this country throughout my career at the Bar. The Bill has wide support in the industry.
I wish to make one more point, which is simply to note the educating effect of tourism. We are of course leaving the EU, but we are not turning our back on Europe or ceasing to be a European country—I will not make more detailed comments. As all Members will appreciate, travelling to a new country and appreciating a new culture is one of the most educating and enlightening things an individual can undertake. We will want people from this country to be able to expand their horizons throughout the EU, as indeed we will want people from the EU to be able to come here. West Oxfordshire has a plethora of tourist attractions, such as Blenheim palace, the great stately house; Cotswold wildlife park; and Crocodiles of the World, which is an excellent attraction that I invite all hon. Members to visit—I have been. We have many picturesque villages throughout west Oxfordshire, including Bampton, of “Downton Abbey” fame.
I have gone on at some length. The House will probably realise by now that this Bill has my full support, and I urge Members to give it its Second Reading.
