It is a pleasure to serve with you in the Chair, Dame Caroline. I also pay tribute to the hon. Member for North Shropshire (Helen Morgan) for securing this important debate. I recognise the great economic, social and cultural benefits of the sport horse industry to this country, and I am pleased to have the opportunity to speak on the Government’s support for it.

On the introduction of the new import controls under the border target operating model, the introduction of biosecurity controls on imports is not optional. Now that we have moved away from the EU’s rigid biosecurity, surveillance and reporting systems, we are responsible for protecting our own biosecurity from threats such as foot and mouth disease, African swine fever and the African horse sickness virus, which we must remain alert to despite it never having reached these shores. Otherwise, such threats could devastate UK industries and cause significant damage to the environment, public health and the wider economy. We remember the impact of foot and mouth in 2001, which cost British businesses nearly £13 billion in 2022 prices. It caused massive disruption to many industries, including the sport horse industry.

Biosecurity controls are also essential to protect our exports and international trading interests. Our trading partners want to be reassured that we maintain the highest biosecurity standards. Maintaining our reputation for high biosecurity standards is in the interests of the sport horse industry, to ensure that we can continue to move first-class animals and germinal products in and out of the country.

I congratulate the hon. Member for North Shropshire (Helen Morgan) on securing this important debate. I declare my interest as a veterinary surgeon. The Minister will be aware that a couple of years ago the Environment, Food and Rural Affairs Committee published our report on the movement of animals across borders. There is a balance between allowing the smooth movement of animals and protecting the biosecurity of our animals in the UK. We looked at the key issues of trying to replicate the tripartite arrangement, which allowed for the smooth movement of high-health horses between the UK, France and Ireland, and progressing the digital identification system for horses, both of which would allow smooth but safe movement. Government progress in those areas would help to protect our industries and our biosecurity.

I am grateful to my hon. Friend for his intervention and for his work in this subject area. He is very informed on these matters and the House benefits a great deal from his expertise. We will continue to work with the sector. We want to have as much freedom of movement as possible, but in a way that protects our biosecurity. I am sure there will be more opportunity for us to benefit from my hon. Friend’s expertise as we find solutions to the challenges.

The new controls begin today. They require high-risk consignments, including equine germinal products from the EU, to enter GB via an appropriately designated border control post, where 100% documentary, 100% identity and 1% to 5% physical checks are undertaken. We are aware that the sport horse industry and its representatives, including the hon. Member for North Shropshire, have been concerned about the controls coming in during the peak season for the import of equine germplasm. We have been glad of their engagement on this topic and for their having drawn their concerns to our attention so that we can address them and make sure we get the implementation right.

The import of equine germinal products provides for genetic diversity and the rapid genetic improvement of British breeding horses. Using the chilled rather than frozen product enhances conception rates, as the hon. Member for North Shropshire pointed out. We know that the movement of these goods is highly time sensitive, if they are to be successful, so we have to consider appropriate measures that work for the sector. We have considered that in the context of the new BTOM controls.

Thanks to representations from the hon. Member for North Shropshire and others, we are aware that on some import routes logistical challenges mean that some checks required by the BTOM cannot currently be undertaken within the required timeframe for the products to reach their destination mare. DEFRA officials have therefore worked closely with the main importers of chilled equine germinal products, port health authorities and the British Equine Veterinary Association to develop and secure approval for a temporary contingency measure with an optional additional adaptation. That will facilitate trade while maintaining essential biosecurity controls.

The contingency measure temporarily reduces the requirement for official identity checks from 100% to 20%, and allows them to take place at a border control post or at the destination, using the optional temporary adaptation pilot process with the BEVA. As a result, the consignments, which also benefit from 100% documentary checks before arrival in GB, complete official import controls in the minimum time possible.

On the movement of live horses—which the hon. Member for North Shropshire was keen to address—in planning and implementing controls we aim to reduce any disruption or administrative burden as far as possible. We recognise that in the case of the sport horse industry we can often rely on robust industry processes that are in place to assure the health of the animal. For that reason, when new border controls on live animal imports come into force, we have developed and agreed, with the help of industry, an exemption for certain horses that meet a definition of high health. Verified equines used in racing, competition, breeding and sales can all qualify for that facilitation if arriving from the EU and sanitary group A countries.

We estimate that approximately two thirds of equine imports will be eligible for the exemption. They will be cleared for import on the basis of a documentary check, and their identity as a high-health horse will be verified with industry databases. That provision will allow them to avoid attendance at a border control post for a physical inspection unless a concern raised during the documentary check triggers such an inspection.

We are also focused on ensuring that the border control post infrastructure, which we will have in place for equines that must come through one, works as well as it can for the animals and their requirements. It is intended that the existing airport BCPs will be supplemented with Government-run BCPs at Holyhead and at Sevington in Kent, which will have the additional impact of assisting animals transferring from the island of Ireland and our friends in Northern Ireland. We are confident that we will have sufficient infrastructure, given the planned exemption for high-health horses, but we will continue to test that position over the intervening months.

We have already been fortunate to have had the benefit of the expertise within the industry to help to shape the physical design of the equine facilities at Sevington, and we have made many adaptations because of that advice. That co-design will undoubtedly make the site more effective in the way it operates. We hope to continue that joint work to test and challenge the operational procedures at the border control post in relation to the way horses travel to the site and are handled and inspected. Of course, that will be an area of focus for our work over the coming months.

We continue to welcome the open and supportive dialogue that we have with the sport horse industry. I again thank the hon. Member for North Shropshire for securing the debate. This is an important set of issues, and I am grateful for the opportunity to discuss them.

I thank the shadow Minister for his questions and his interest in this topic. What is clear is that there is a distinction between those goods that are coming into the country illegally, which will still be inspected at the port of Dover by Border Force, and those that are coming in via legitimate routes, by legitimate trade links, from areas that have been inspected by their own country’s equivalent of the Food Standards Agency to make sure that those port goods are safe to come into the UK with the correct documentation. Those goods will go to Sevington. But if someone tries to do something illegal, they will be picked up by Border Force at the port of Dover, via inspection, including intelligence-led inspection. [Interruption.] The shadow Minister says that there is no money, but we are in conversation with Port of Dover to resolve that.

The other challenge that the shadow Minister put to us was that we have delayed this a number of times. That has happened because we have been in conversation with those people and hauliers who have had comments on how to improve the system. We have listened to those concerns and now have the model that will operate, given the advice and liaison we have had with those companies.

As a veterinary surgeon, I am passionate about biosecurity. I am reassured that our Conservative Government are taking this matter very seriously indeed. I thank the Animal and Plant Health Agency and everyone at our borders who do so much in this regard. Prior to leaving the EU, we did not have the opportunity systematically to check animal and plant products coming into the UK. Does my right hon. Friend agree that we now have the opportunity to strengthen our biosecurity and that the introduction of the border target operator model will protect animal, plant and, ultimately, human health in the UK moving forward?

I pay tribute to my hon. Friend for his work in this area and his expertise in it. Moving forward, we will be in a much stronger place in terms of our phytosanitary and sanitary protections. That is the right outcome. We will continue to ensure that we are safe in the UK and that we protect our borders proportionately.

It is a privilege and honour to speak in this very important debate.

Food security is part of national security. It is a vital issue. The fact that three major Select Committees tabled this debate to the Liaison Committee shows its importance for our country. I am very proud to represent a constituency with a large farming footprint, both as the Member of Parliament and as a proud member of the Environment, Food and Rural Affairs Committee.

I pay tribute first to our fantastic farmers and growers up and down the land who produce the highest-quality food to the highest production standards and look after the precious environment, and to the bodies, such as the National Farmers Union, that champion the sector. Producing food and looking after the environment can and should go hand in hand, and our UK farmers are the best in the world in that regard.

Our Environment, Food and Rural Affairs Committee looked at this issue directly in producing our report “Food security”, and it has examined other aspects in studies including our ongoing study entitled “Fairness in the food supply chain” and previous inquiries such as “Moving animals across borders”, “Labour in the food supply chain”, “COVID-19 and food supply”, and “Soil health”, which was mentioned by my right hon. Friend the Member for Scarborough and Whitby (Sir Robert Goodwill), who chairs the Committee.

The challenges to our farmers and growers are huge. The importance of how we produce our food has been brought into sharp relief first during the pandemic, and now with the war in Ukraine. In Britain we have seen our excellent farmers and growers battle through this geopolitical context, dealing with factors such as extreme weather events, whether they involve a lack of water or flooding, and showing real tenacity in delivering for our country.

We all remember the startling headlines and the shortages on our shelves at the beginning of the pandemic. The concept of key workers was very much in our minds at that time. First and foremost we thought of NHS workers, but we also thought of the importance of all those involved in the food supply chain—farmers, growers, vets, drivers and abattoir workers. They were classified as key workers, and it is important to remember that.

The tragic illegal invasion of Ukraine by Russia has again brought this issue into sharp focus. Again our producers face mounting challenges: increased fuel and energy costs, increased animal feed costs and increased fertiliser costs, as well as a lack of supply of fertiliser. Bolstering our food security is an urgent task, given inflation costs and the challenges around the world such as the war in Ukraine. We must think hard about becoming more self-sufficient. We produce about 60% of what we consume, and I firmly believe that we need to produce more.

Fertiliser became an important issue as a result of the Russian invasion of Ukraine. The Select Committee took a close interest in that, suggesting that the UK needed to be more resilient. The fertiliser company CF Fertilisers UK has mothballed its Ince plant and ended ammonia production in its Billingham plant. A by-product of fertiliser production and ammonia production is carbon dioxide, which, as we know, is vital for our food and beverage industry, but which is also vital to the process of slaughtering pigs and poultry. I strongly believe that the Government need to keep a watching brief on how we can secure a resilient supply of fertiliser and carbon dioxide.

As my hon. Friend the Member for Dover (Mrs Elphicke) mentioned, biosecurity is pivotal to food security, and it is also pivotal to national security. As a veterinary surgeon, I have seen how crucial it is, and not just for our nation but for our world. I started my journey into politics as a veterinary surgeon on the frontline, witnessing and supervising the culls during the foot and mouth crisis of 2001, and I saw sights then that I never want to see again in my lifetime.

As we have heard, African swine fever is advancing upwards through the continent of Europe. It is yet to reach the UK, and I pray that it never does, but if it does it will be catastrophic for our country—catastrophic for our animal health in terms of the pig sector, but also for human mental health. Another major inquiry undertaken by our Committee, entitled “Rural mental health”, examined the challenges and pressures faced by people working in rural communities and the food production chains, such as animal disease outbreaks, extreme weather events and rural isolation. In the event of a catastrophic animal health outbreak such as swine fever, the mental health implications for people across the country would be devastating.

I pay tribute to the Government and the Animal and Plant Health Agency. We are facing many threats, including, as I have said, African swine fever, but there are also ongoing threats such as avian influenza, which is still bubbling away. I know that Ministers and officials are currently very exercised by the threat from the bluetongue virus; we have seen cases in Kent, Suffolk, Norfolk and Surrey, and when the Culicoides midge season arrives we will be under real threat. There are also ongoing, chronic threats from diseases such as bovine tuberculosis.

I hesitate to intervene on my hon. Friend, but he has just referred to TB and the mental health implications of animal health crises for our farmers. I would like to mention to the House that, on my own farm, we have just gone down with TB for the second time in six months. We have had 13 cows in calf—some have just calved, and some are about to calf—that were reactors. We do not yet know whether they were positive or were just reactors—in other words, whether they received false positives.

There was confusion between DEFRA and the vets about whether those animals could be taken to the slaughterhouse or had to be shot on farm. DEFRA was telling us that they had to go to the slaughterhouse. It turned out that had we done that, we would have been in breach of the law, because one cannot take an animal to a slaughterhouse within a month of its giving birth. Consequently, the animals had to be shot on farm, including calves and pregnant cows on the brink of giving birth. The mental health impact on the farmers who have to look after those animals is very significant. At this time of the year, this terrible disease affects many people.

I thank my right hon. Friend for that powerful testimony. In the EFRA Committee’s rural mental health inquiry, we took similarly powerful evidence on the implications of TB when there is an outbreak, but also when farmers are involved in testing. There are implications for vets and farmers while they are waiting for the results to come through, and from what happens when there are positive results, so I thank my right hon. Friend for that intervention.

The APHA is part of our frontline in protecting our biosecurity. It has its headquarters in Weybridge, Surrey, and the EFRA Committee visited the institution, which needs a radical refurbishment and redevelopment. The Government are committed to that, but I urge them to press ahead at full steam. It requires a lot of money— £2.8 billion. Some £1.2 billion has been allocated so far, but the EFRA Committee took evidence from the chief veterinary officer, who pressed the case for how important it is that the APHA is redeveloped. I hope that the Minister takes that message away. I know that DEFRA is on the same page and is making the case to the Treasury that we need to spend a fair amount of money now to prevent a future crisis.

We have talked today about some of the international challenges that our farmers and growers have faced, not least the ongoing situations in Ukraine and the middle east. As we have heard, Ukraine is the breadbasket of Europe. It is important for supplies of grain and sunflower, but also fertiliser. What we have seen throughout that crisis is a choking of supply through the Black sea, and the deliberate and cynical decision by Putin to pull Russia out of the UN’s Black sea grain initiative, leading to its subsequent collapse. That has choked off supplies to the rest of the world. What we have seen as a consequence—I am sure this is intended by Putin—are food shortages and potential famine in the developing world. As a country, we need to be cognisant of that. It is so important that the Black sea route gets back up to speed.

The actions of the Houthis in the Red sea have affected trade and the free passage of vessels, which has implications for the security of shipping and trade routes. Costs have increased due to diversions around the Cape of Good Hope, adding an extra 14 days to journeys and sometimes upwards of an extra £1 million for a vessel’s voyage. That will have unintended consequences for the price and availability of food and other supplies. Securing the passage of goods throughout the world is part of global security, and we need to think about the Black sea, the Red sea, the Panama canal and the Suez canal to make sure that such routes are viable.

Amid all these challenges, I am proud that our Government are supporting the sector. We have a Prime Minister, a Secretary of State for Environment, Food and Rural Affairs and a Government who are fully aware of the issues and challenges facing our farmers and growers, and I know the Under-Secretary of State for Environment, Food and Rural Affairs, my hon. Friend the Member for Keighley (Robbie Moore), personally feels it too.

I was pleased to attend the Prime Minister’s Farm to Fork summit. Food production and food security being brought into the heart of No. 10 is an important statement to the country. It is important that we are maintaining the farming budget for England at £2.4 billion a year through this Parliament and, coming into this election year, we need clarity that that level of funding will continue. Farmers and growers need to be able to plan, so we need to have security.

Our horticulture and agriculture have been bolstered by additional visas, allowing people to come in to harvest crops. That has been expanded to the poultry sector, but we need to keep a watching brief. My right hon. Friend the Member for Ludlow (Philip Dunne) talked about animals being put down on farms. In the pig sector, where we have had labour shortages in the abattoir and processing sectors over the past couple of years, upwards of 60,000 healthy pigs were culled on farms. That is awful food wastage, but it is also harrowing and incredibly distressing for the people who reared those pigs. We need to keep a watching brief so that those situations never happen again.

Our Committee and the EAC have called for food security to be reviewed annually. I am pleased that the Government have announced an annual food security index that will underpin the food security report, which is an important statement. The last food security report was in December 2021, prior to the Ukraine war. We need annual check-ups, and I am pleased that the Government have responded to the Select Committees’ reports.

The Government are also very aware that good farming and food production and a healthy environment go hand in hand, and that the ELM scheme is pivotal in supporting both those goals. I am pleased that the Secretary of State has announced an expansion of ELMS in recent months.

My right hon. Friend the Member for Scarborough and Whitby (Sir Robert Goodwill) mentioned the situation in Wales. If that is going to be Labour’s blueprint for England, there is a real concern that 10% of food-producing land will be diverted to planting trees and that another 10% will be diverted to wildlife habitats. That is a noble intention, but the idea of forcing farmers to take 20% of their food-producing land out of production is deeply alarming. We have talked about TB policy, and the statistics for cattle herds in Wales and England show that the TB situation is worse in Wales. We need to be cognisant and follow the science. We need evidence-based policymaking to control the dreadful threat of bovine TB.

I congratulate the Government on their important Genetic Technology (Precision Breeding) Act 2023. The Act, which some of the reports touch on, allows the technology to produce climate-resistant and disease-resistant crops, as well as disease-resistant animals and birds, which will reduce the need for drugs and antimicrobials and will indirectly help public health. It will help animal health, bird health and public health, and it will support the environment. The Environment, Food and Rural Affairs Committee visited the world-leading Rothamsted Research to look at its work.

I support the Government’s animal health and welfare pathway, their legislation to ban the live export of animals for fattening and slaughter, and their £4 million fund for small abattoirs. Those measures will help animals to be produced, reared, slaughtered and ultimately consumed locally, which is a win for local communities and for animal welfare, because animals will not have to be transported long distances. We have the highest animal welfare standards in the world, and we can be a beacon to the rest of the world in our policymaking. I am proud that our Conservative Government have done that.

The Government paused their trade negotiations with Canada, which was an important symbolic statement. They said, “No, we have red lines on hormone-treated beef, ractopamine-treated pork and chlorine-washed products. These are red-line products that are illegal in this country, and we will not import them.” I congratulate the Government on standing firm, because that says to the world, “This is where we stand and these are our values. If you want to trade with us, meet our standards.”

We cannot shy away from the need to do more to bolster our food security, domestic production and standards. The environmental land management schemes are good measures. We must ensure that all types of farmer are fairly rewarded, including commoners, tenants and upland farmers. Our Committee has looked at the issue and we have been calling for that. We also need to make sure that we are training up the next generation of people to go into farming by supporting our land-based educational sector. My colleagues have talked about food waste and we need to tackle that. We also need to think about fairness in the food supply chain, which our Select Committee is very much looking at.

In conclusion, I pay tribute to all our farmers, growers and producers, and everyone else involved in producing food in our country. Doing that and looking after the environment go hand in hand. We are a beacon to the world in our production standards. This area is vital for our communities and it is so important that our Government continue to support it, and I commend our reports to the House.

Animal Welfare (Import of Dogs, Cats and Ferrets) Bill

It is a privilege and an honour to speak in this vital debate. I declare my strong personal and professional interest as a veterinary surgeon and a fellow of the Royal College of Veterinary Surgeons. I strongly support the Bill.

I have had to frantically rewrite the introduction to my speech, having heard my colleagues name-check their pets. I know that my two lovely dogs, Poppy and Juno, are following the debate closely, so I now have to name-check them. They would never forgive me if I did not, and I am sure that they would punish me by rolling in something unspeakable.

We are a nation of animal lovers. Animals provide us with so much companionship, and help our physical and mental wellbeing. I commend my hon. Friend the Member for North Devon (Selaine Saxby) for driving forward this important Bill and colleagues across the House for supporting this important area of legislation over many years. I also commend many charities, institutions and organisations. The British Veterinary Association, Dogs Trust—I mention specifically Paula Boyden, its veterinary director, who has done so much work on this issue—Cats Protection, Blue Cross, Battersea, the RSPCA, Four Paws, the Conservative Animal Welfare Foundation and the veterinary surgeon Marc Abraham have done so much on this issue.

The Environment, Food and Rural Affairs Committee has taken a close interest in this area for many years, and we have run various inquiries in recent years. One was about moving animals across borders, and we have a current inquiry on pet welfare and abuse, which deals with a lot of the issues that we are discussing today. We had an emergency special session this week on issues facing the veterinary sector, and we looked at biosecurity and animal welfare as well.

I welcome the fact that this Bill is about dogs, cats and ferrets, because it is important that we encompass all those animals. I also welcome the fact that the Bill will increase the minimum age on importation to six months. I note that some measures are not in the Bill, but also that we want to get this legislation on the statute book as soon as possible. I hope that the Government will bring in secondary legislation to add things as and when necessary. We need to keep the option open for future secondary legislation to include things such as reinstating the rabies titer checks and increasing the post-rabies vaccination wait time to 12 weeks. Such measures would help to reinforce the increase in the minimum age to six months.

I hugely welcome the change to the policy on heavily pregnant animals. On the EFRA Committee over the last few years, we have taken harrowing evidence of the awful trade in heavily pregnant animals being shipped into this country to give birth and then shipped back out again, sometimes with fresh suture wounds. It has been awful and harrowing to hear that evidence. Since 2019, Dogs Trust has taken in 168 pregnant dogs that have been transported. Currently, it is not permitted to transport dogs and cats in the last 10% of pregnancy. It is difficult to assess when that is, so including the last third of pregnancy in the ban is a very important step.

We need to keep a watching brief on whether unscrupulous traders are flipping between the non-commercial and commercial movement of animals, and whether we need to act on the commercial importation of pregnant animals as well. We have taken evidence showing that there are bad people shipping animals in. Over recent years, these unscrupulous traders have been switching between commercial and non-commercial movement, and when the authorities move one way, they move the other. We need to keep a watching brief on this.

I welcome that clause 4 states that a movement is not non-commercial if there are more than five animals per vehicle. That is very important. Many institutions and charities wanted the figure to be three per vehicle, but five per vehicle is an awful lot better than 20 per vehicle, because people were picking up passengers and saying, “These pets are with these passengers on board.” The five animals per vehicle rule will be a game changer.

It appears to me that clause 5 will allow Ministers to bring in secondary legislation, so we do need to keep a watching brief and to allow secondary legislation. When previous laws have come in, unscrupulous people have found loopholes that were not predicted by the legislators drawing them up, so we need to be able to act to close the loopholes.

There has been a lot of discussion today about the mutilation of dogs and cats, and the Bill will do much to tackle that. To be clear, ear cropping is an absolutely horrific practice that has no role in a civilised society. There is no medical or clinical benefit to the animal in having its ears cropped. As has been discussed, a lot of this is about how the dog looks—it makes them look more formidable or ferocious. There has been an upsurge in the prevalence of dogs with cropped ears; when we are walking around, we see these dogs now.

The Select Committee has also taken harrowing evidence on this practice. It is illegal in this country to crop a dog’s ears, but we have evidence that it has been taking place here. People are doing it in horrific circumstances, potentially in their back garden sheds. Looking online, we see that the situation is horrific; there are online ear cropping kits. We need to stamp that out as well. This law is important and it will help address that; it will close the loophole.

We must look at popular culture as well, including popular animated films. One of my favourite films that I watched with my children was the Disney Pixar film “Up”, which we all absolutely love, but if you look closely at the dogs in that film, you will see that many of them are cropped. If people are going to the cinema with their kids and seeing this on the big screen, it looks normal, and that is wrong. In the last couple of years, there was another hugely successful animated film, the “Super-Pets” movie. Again, the lead character was an ear-cropped dog. Many people in our country who love their animals do not realise that ear cropping is not normal and want their dogs to look like that. Unfortunately, there is a popular and celebrity culture as well. We need to educate people that these dogs have been horrifically mutilated. The Bill will close that loophole.

My hon. Friend the Member for North Devon raised the important issue of brachycephalic dogs: dogs with very short faces that have real difficulty breathing. That is so important, because they are lovely and wonderful dogs but they have a lot of clinical difficulties. We need to do work to make sure that in the future breeding of these dogs, their noses become longer again so that they can breathe more easily. Again, this appears in popular culture and in the advertising of products. I will not name them, but a lot of major products use images of brachycephalic dogs in their advertising. We need to be very cautious about that.

May I draw the hon. Gentleman back to his previous profession? When a vet sees a dog that is unsuitable for breeding, does the hon. Gentleman think that the vet, instead of facilitating the breeding process, has a responsibility to say, “No, we’re not letting this go forward”?

I can give the hon. Lady a categorical reassurance that the veterinary profession is strongly looking at the issue very closely. It also has a role in educating the pet-owning public about where to source their dogs responsibly and to ensure that those dogs have a good and happy life. But yes, the veterinary profession is looking at this closely. What comes into frame with ear-cropped dogs is an upsurge in the past few years of unregulated canine fertility clinics, where acts of veterinary surgery are being performed by people who are not qualified. In future, we need to ensure that we strongly clamp down on those practices as well.

I am absolutely delighted that the Bill includes cats. The mutilations include those cats that have been horrifically declawed. There is no benefit to the cat in being declawed. The Bill will help an awful lot of cats.

In future, we need to look at whether secondary legislation is needed. We will ban the import of ear-cropped dogs, but we need to think, too, about banning the onward sale of those dogs in this country. However, I hope that the Bill will stop the importation, so that that may not be necessary. Again, we need to keep a watching brief.

Many colleagues today have talked about diseases. The importation of animals presents a risk to not only animals in this country, but people. One major disease that we are concerned about is canine brucellosis, caused by Brucella canis. There were 143 positive cases in dogs from 2020 to 2022 and 160 positive cases in 2023. There have been two laboratory-confirmed cases in people. This is a disease—zoonosis—that can be transmitted from dogs to people.

The Bill will ban the importation of heavily pregnant dogs. One of the main exposures to brucellosis is when a pregnant dog comes into the country and whelps here—the birthing fluids are a potential risk for people. Vets, nurses and practitioners on the frontline are at risk, as are owners. As I said, two people in this country have contracted the disease.

Brucellosis is an unpleasant disease for the dog. Treatment is not recommended; the prognosis is poor and often euthanasia is recommended. It is also an unpleasant illness in people, especially in vulnerable and immuno-compromised people. It is a salient point to make that we need to be cognisant that laws like this will help the situation, because we have seen an increase of dogs coming in that have such diseases.

The hon. Gentleman is making an excellent speech. Given his experience as a vet, to what extent does he think that enforcement is an issue? I think that there is widespread support around the House for the provisions in the Bill, but enforcement is key. Does he think that that is getting better or worse?

Enforcement is pivotal. I chaired the EFRA Committee this week, in the Chair’s absence, and we had a special session on issues facing the veterinary sector. We looked closely at biosecurity, animal health and welfare, and things like the Animal and Plant Health Agency. It is about being vigilant about diseases and monitoring them. Later in my speech, I will touch on how we can do more in that area.

On the importation of dogs, as we have said, in the UK people love their animals. A lot of people think that they are doing the right thing by importing and rescuing those dogs. We have seen a surge of dogs coming over from the continent of Europe—from eastern Europe, Macedonia and so on—and some of those dogs have had diseases like brucellosis and leishmaniasis, and that is where we need to be careful. People think that they are doing the dogs a favour, but unscrupulous people are probably rounding up street dogs to bring them over, when that does not benefit the dog in its own country. At the same time, we need to remember that we have animal welfare charities in this country absolutely full of lovely dogs that need to be rehomed. People in this country can do a better thing by seeking their dogs, cats and other pets from such charities.

May I give a huge shout out and say thank you to all those animal welfare charities and shelters that do so much to rescue these animals? We have seen a real upsurge in pet ownership through the pandemic—people talk about pandemic puppies. People took on animals in different circumstances, and now many have gone back to work and cannot deal with them. Many of these animals were not socialised. In the EFRA Committee inquiry, we have seen an increase in behavioural issues, with animal welfare charities picking up the slack. I pay tribute to those charities; they have a really important and stressful job, and we are very lucky to have them.

We need to keep vigilant when it comes to biosecurity. We should think about introducing secondary legislation on pre-importation checks for dogs, so that we can check them for brucella canis when they come in.

In 2012, the EU stopped the mandatory treatment against ticks and tapeworms in some animals coming in. Now that we have left the European Union, we have the opportunity to reinstate that mandatory treatment. Let me illustrate how that could be important. Madam Deputy Speaker, just up the road from your constituency in Epping Forest is Harlow. A few years ago, a dog picked up babesiosis on a walk in Harlow. The dog had never been out of the country, so had picked up that disease from a tick in a field in Harlow, Essex. Obviously, a dog had gone out of the country, or come back in, and had not been treated, dropped the tick and a dog here got that disease. That illustrates how a simple change through secondary legislation could protect dogs in this country. That is something that we need to consider.

We have talked a lot about biosecurity, and we have mentioned today the Animal and Plant Health Agency, which does fantastic work in keeping our country safe. It has dealt with incredible threats in recent years: it has been tackling avian influenza; it is working closely on bovine tuberculosis; and now there is the increasing threat of bluetongue, which the Minister for Food, Farming and Fisheries, my right hon. Friend the Member for Sherwood (Mark Spencer) is looking at very closely. As the midge season approaches, this virus will put everyone under pressure. Again, I pay tribute to those people on the frontline who are trying to do so much to keep the animal and plant health of our nations safe and, indirectly, human public health as well.

The Minister knows where I am going with this. We had the chief veterinary officer in front of the EFRA Committee this week, again reaffirming the importance of upgrading and doing a full refurbishment of the APHA headquarters in Weybridge. It needs a £2.8 billion refurbishment, which is a lot of money when we are financially constrained as a country, but that money needs to be spent because it will save a lot of heartache and money in the future. I urge the Government to move forward on that; we need to be prepared.

Now that we have left the European Union, there has been much talk about enforcement and checks of animals coming in. Prior to our leaving the EU, these animals were coming in with no checks at all, so we have a real opportunity now to strengthen our biosecurity. There is now the border target operating model, which has been the subject of many questions. Our Select Committee is taking a close interest in that, so we have been down to Dover. As I said, we have an opportunity now to strengthen our biosecurity and we must get it right. We must fund it right and staff it properly. We need to make sure that we inform these bad people—the unscrupulous people who will try to unpick this legislation and find loopholes—that there will be random checks on ports to make sure that, if they are coming in on a weekend, on a different day or through a different port, they could be detected. That will protect animal health and welfare in this country.

I digress a little, but we have talked a lot about animal health and welfare and cropped dogs, so let me mention the XL Bully dog, which has had an awful lot of ear cropping. The Government have now introduced, in my view, the necessary legislation to protect people and other animals from some of those dogs. Some are fine, but some are really very dangerous indeed. I am very appreciative of the Government, including the Secretary of State and Ministers for listening to me, the BVA and the EFRA Committee on extending the neutering deadline for young dogs under seven months at the end of January this year. The neutering deadline has been extended to June 2025. That might seem a small point, but it is important for exempted registered XL Bully dogs. There will be health benefits—if they are spayed or castrated too early, they have clinical difficulties— and this will relieve pressure on the veterinary sector moving forward.

I am glad to welcome the legislation. The Conservative Government have a strong record on animal welfare, as we: passed the Animal Welfare (Sentience) Act 2022; instituted the Animal Sentience Committee; introduced the Sentencing Act 2020, which increased sentences for cruelty to animals; introduced compulsory microchipping of cats; and banned the keeping of primates as pets. We also have further Bills coming in, including on pet theft and livestock worrying.

We are a nation of animal lovers. We have the highest animal welfare standards in the world. With Bills like this, we can be a beacon to the rest of the world. Animal welfare unites us in humanity and across the House. As a Member of Parliament and a veterinary surgeon, I welcome the Bill, which has my full support.

We are talking here about Palestinian and Israeli counterparts being in compliance with international law, but I am of course delighted to say again to my hon. Friend that this Government are committed to international law—we have said that repeatedly from the Dispatch Box—and I do not see any need to lay a statement such as he suggests, but I will continue to enjoy our conversations on this topic.

This week, in the other place, the Foreign Secretary said on the tragic conflict in the middle east:

“You have to obey the rules and obey the law”.—[Official Report, House of Lords, 12 March 2024; Vol. 836, c. 1915.]

That is an important affirmation from this Government that Israel both has a right to self-defence and very much has a duty to obey international humanitarian law. Can the Attorney General reaffirm that the Government will continue to stress both that right and that duty in this conflict, which we all want to end as soon as possible?

My hon. Friend makes an excellent point, and I would not like any Member of this House to be in any doubt: we all, across this House, want the fighting to stop now. That message is delivered by the Government on behalf of the House and the nation repeatedly and loudly. We are calling for an immediate pause to get aid in and hostages out, and then progress to a permanent ceasefire. We need five things to happen: the release of the hostages; the formation of a new Palestinian Government; Hamas’s capacity to launch attacks stopped; Hamas to no longer be in charge of Gaza; and a credible pathway to a two-state solution. I think we can all get behind that.

The hon. Gentleman should look at what we are doing on peatland; I have just mentioned it. There is all the work to restore peatlands, both upland and lowland, and all the work on pilot projects so that farmers can transition to new crops to grow on peatland. We have taken quick and decisive action following the concerning rise in fatalities; there have been nine recent fatalities. We have now seen 30,000 dog owners registered as part of the balanced approach we are taking.

Following the ban on XL bully dogs, owners will have applied for a certificate of exemption, so that they can keep their dog, and as part of that, the dog has to be neutered. The British Veterinary Association has put forward a prudent neutering suggestion: given the evidence that neutering large-breed dogs before they are 18 months old can increase the risk of developmental orthopaedic disorders and other medical conditions, will the Government take the reasonable, small step of extending the neutering deadline to the end of June 2025 for those dogs under seven months of age at 31 January 2024?

Given my hon. Friend’s expertise on this issue as Parliament’s only vet, I listen closely to what he proposes. As he knows, neutering is a necessary population control, and we have already responded to the greater risks to dogs of a young age by taking action to extend the deadline. I am happy to take away the proposal that he raises and look at the issue again.

As was mentioned earlier, that report was based on two months of data within a 25-year plan, and was therefore somewhat premature in its judgment. This is the first Government in the world to put legally binding targets to reverse nature decline into law. Yesterday, we marked the first anniversary of those targets at Kew, and set out further proposals which have already been touched on. We have also provided international leadership by putting nature at the heart of tackling climate change at COP26, which was strongly reflected at COP28.

T4. The Select Committee has been consistently holding water companies and regulators to account for the inexcusable levels of sewage being illegally dumped in our precious waterways, but more can be done. Does my right hon. Friend agree that given our plan for water, our record levels of investment in monitoring and improving water quality, and the unlimited fines imposed on water companies, while the Opposition parties have no affordable plan and just throw muck from the sidelines, it is this Government who are actually getting on with and dealing with the issue?

The hon. Lady is right that this is matter of huge public concern, and understandably so. The Government worked very hard during the pandemic to ensure that support was provided, but clearly where people have taken advantage of a system, that must be pursued. That is why we are looking at the fraud strategy, for example, and the economic crime plan part 2. We will continue to drive forward to see what further action can be taken.

Friend reassure my constituents and the country that the Conservative Government, the police and the criminal justice system will do all they can to bring those immoral criminals to justice?

Yes, I can. My hon. Friend is right to draw attention to this, as people being taken advantage of is one of the great issues of our age. It happens to members of society of all kinds, but particularly to those who are elderly and vulnerable. Work continues on a number of sector charters, which have been successful in bringing forward positive outcomes. For example, 870 million scam texts have been blocked. We have taken forward work on the Online Safety Act 2023, as well as the charters I referred to, but I assure my hon. Friend we will continue to see what more can be done.

I am delighted to speak to the amendments and grateful to hon. Members for their continued interest and engagement in ensuring that this ban on live animal exports for slaughter is effective and comprehensive. The question of which species should be included in the ban is indeed crucial and is one to which we have given careful consideration. When we carried out a wide-ranging consultation on banning live exports in 2020, we were clear about the species that we were seeking to apply the ban to. We received no evidence then, and have received none since, that a ban on other species was at all necessary.

In the 10 years prior to EU exit, the live export trade for slaughter and for fattening mainly involved sheep and unweaned calves. The numbers of deer, llamas and alpacas kept in the UK are extremely low compared with the species for which a significant slaughter export trade had existed in the past. For example, the June 2021 agriculture census records showed that there were about 45,000 farmed deer, 12,000 alpacas and 1,000 llamas in the United Kingdom, compared with 33 million sheep and 10 million cattle. About 35,000 cattle and 220,000 sheep are slaughtered every week in England and Wales.

I can reassure the hon. Member for Westmorland and Lonsdale (Tim Farron), who is not in his place, on his concerns in relation to his amendment about reindeer. Although reindeer are kept in the UK, they are not really farmed, and they are small in number. Of course, they are imported mostly for use in visitor attractions, especially at Christmas.

We are not aware that any species proposed in the amendments are exported for slaughter or for fattening. It is important to make that distinction: we are talking about the export of animals for slaughter and for fattening. The numbers of llamas and alpacas might be increasing, but they are not consumed as meat in the United Kingdom. Although there is no evidence of demand for trade in live exports from the EU to elsewhere, the definition of relevant livestock covers all live exports where major animal welfare concerns have been identified and a trade existed in the past.

The Minister is detailing the species involved in the Bill and those potentially not involved. I heard what my friends in the Democratic Unionist party said about animal health and welfare issues in Northern Ireland, and I am sympathetic, not least on the supply of veterinary medicines in Northern Ireland. Although the point has been made that there have not been live exports from the mainland since Brexit, the Environment Food and Rural Affairs Committee has taken much evidence from World Horse Welfare—horse is a species included in the Bill—that hundreds if not thousands of horses have been illegally exported to Europe under the guise of sport or breeding when they were actually for slaughter. This welcome Bill will stop that illegal movement of horses.

Back in 2010, 40% of all energy in this country was produced from coal; now, we are at 1%. The Government are taking the reduction of emissions incredibly seriously. We were the first major economy to set a net zero target in law, and we cut our emissions by 48% between 1990 and 2021. Coupled with that, we are taking more proactive measures, including by doubling the amount of funding for improving our flood-resilience programmes from £2.6 billion to £5.2 billion, to better protect more frequently flooded communities, businesses and homeowners.

I thank my hon. Friend the Minister for his statement and efforts, and I thank the Secretary of State, DEFRA and people across Government for all their work in these challenging times. I pay tribute to the Environment Agency, the emergency services, local authorities and volunteer workers for all that they do to keep people safe at this time.

My hon. Friend will know from our work together on the Environment, Food and Rural Affairs Committee that our “Rural Mental Health” report addressed the impact of extreme weather events on people’s mental health, in terms both of the anxiety about being flooded and the trauma afterwards. Can he reassure people and communities across the country that they will be supported when the blue lights leave and the waters subside?

I absolutely can. When I was a member of the Environment, Food and Rural Affairs Committee, my hon. Friend, I and others on the Committee did a lot of work to produce that worthwhile report. It is vital that the Government not only pay close attention to the immediate impacts caused by flooding but provide reassurance to homeowners, businesses and those in the farming community who have been affected. We must also pay attention to negative implications, such as the effect on health and wellbeing. I am keen to ensure that we deliver on the recommendations of that report.

Making changes through private Members’ Bills is not leadership. Rather than Tory Back Benchers leading on animal welfare legislation, Ministers need to get on with it. I pay tribute to all the stakeholders and campaigners who devote their time and attention to fighting for the strongest animal welfare provisions we can deliver. The Opposition stand ready to facilitate a speedy journey through the House for the Bill, but we will seek to make it as strong, effective and durable as we can.

The hon. Lady is talking about the Labour party promoting animal health and welfare. How does she square that with the Welsh Labour Government’s policy on tuberculosis in cattle and the UK Labour party saying it will stop control of the wildlife reservoir for tuberculosis, when it has been scientifically proven that that Conservative Government policy has been reducing the instance of tuberculosis in cattle in the United Kingdom?

I pay tribute to the hon. Gentleman for his interest, knowledge and expertise in this area, but the science is disputed. We will continue to listen to all sides of the scientific argument and look forward to discussing the issue in Committee.

I am grateful for advance warning of the Committee of the whole House, so staff who support the shadow DEFRA team can do some planning over the festive period and enjoy a well-earned rest. I wish the Bill well. When the question is put today, we will support it and I look forward to seeing it signed into law—the sooner the better.

I declare a personal and professional interest as a veterinary surgeon.

I very much welcome not only the introduction of this animal welfare legislation but, importantly, the cross-party support for it across the United Kingdom. The Bill will ban the export of cattle, sheep, goats, pigs and horses from Great Britain for slaughter or fattening. That has a huge benefit for animal welfare, decreasing both the stress on the animals that have travelled long distances, and the incidences of injury and diseases that are associated with long travel. This will fulfil a 2019 Conservative manifesto commitment, and I strongly welcome that. As has been mentioned by Members across the House, it will also help to ensure that animals are slaughtered domestically and close to home. That is so important to improving animal welfare, because if we reduce the distances that animals are transported, that will be a huge benefit to the animal. It is so important that animals are reared, slaughtered and then eaten locally. That is good for the environment, good for animal welfare and good for local businesses.

Importantly, this Bill stipulates that the meat can then be transported and exported as well. It is much better to transport on the hook rather than the hoof. However, we still need to work on improving transport conditions for all animals—farm livestock as well as horses. I urge everyone not to drop the ball on that. Just because this brilliant Bill is coming in, it does not mean that we do not still have work to do to improve transport conditions for animals.

I welcome the comments of the Secretary of State on the exemptions for the movement of animals for breeding and other purposes, potentially including sport. However, it would be helpful if that was made a little clearer in the Bill and the explanatory notes, so that any doubt is removed. As I said, it is important that animals are slaughtered close to home. The Environment, Food and Rural Affairs Committee has produced reports on that topic, such as “Moving animals across borders” and many others. One of our key recommendations was that we need to support the UK abattoir network, and ensure that sufficient numbers of abattoirs are spread around the country to reduce the distance to travel. I hugely welcome the Government’s announcement last week of the £4 million smaller abattoir fund, which will go a long way to help with that situation.

I also welcome the Bill’s stopping the export of young unweaned calves for long journeys for fattening and slaughter. In addition to the Bill, we need to ensure that we adapt, and use more of the animals farmed here. We need to reduce the production of dairy bull calves that are then lost to wastage. We can do that with such things as semen selection. We should also encourage the rearing of dairy bull calves locally and the use of less popular cuts and types of meat, such as rose veal. That will help animal welfare in the future too.

Throughout the debate we need to be cognisant of food security, which came into sharp focus with the pandemic and the war in Ukraine. Food security is so important for our country, and we need to be much more resilient in producing food. We need to think about the workforce issues. Again, I declare an interest as a veterinary surgeon. An EFRA Committee report recommended that we keep an eye on the number of vets we train and retain in the profession. Prior to our leaving the European Union, 90% to 95% of veterinarians who worked in the meat hygiene sector were from the EU. We need to keep on our radar the need to staff our abattoirs and food processing plants adequately. Last year, we had a crisis in the pig farming sector, with pigs damming back on farms because they could not be taken to slaughter to be processed.

We need to keep an eye on the workforce issues, and think about the resilience of some of the infrastructure. Carbon dioxide is an indirect result of fertiliser production, and CO2 is needed for the slaughter of poultry and pigs. In the last couple of years, CF Fertilisers has shut its plant in Ince and ceased ammonia production at its Billingham plant. For food security and resilience, Government need to keep a watching brief on that.

As my hon. Friend has mentioned pigs twice, another area where we would like the Government to move—I hope with the support of all parties—is on banning the awful use of pig farrowing crates. I am sure that were the Government to introduce legislation for that purpose—again, the issue was close to Sir David’s heart—it, too, would enjoy great support in this House.

I thank my right hon. Friend for that intervention.

On horses, I welcome the comments of the Secretary of State, and the Bill’s provisions, but huge numbers are still being illegally exported to Europe, under the guises of sport, competition or breeding, where they end up being slaughtered. On the EFRA Committee we heard harrowing evidence from World Horse Welfare that the practice still goes on. I welcome the Bill’s trying to stop that illegal practice, but we need to do more work on that. We need to improve the identification of horses and get a central equine database. The Bill is welcome, but we must not drop the ball on other issues.

Prior to our leaving the European Union, we had a tripartite agreement whereby high-performance, elite and high-health horses were able to move smoothly between Ireland, France and the United Kingdom. We need to try to get a replacement scheme in place. The movement of animals in and out of the country is important in animal health and welfare, and for the United Kingdom’s biosecurity. I welcome the Government’s moving forward with the border target operating model. Hopefully, the station at the Sevington campus in Kent will be in place soon to help with that.

The Secretary of State mentioned the great work of the Animal and Plant Health Agency. I put on record my thanks to the staff of APHA for maintaining our biosecurity—for animal health, plant health and, indirectly, human health. Those staff do so much in keeping the sector safe. As has been mentioned, avian influenza is still with us. The Farming Minister is well aware of that; I have had correspondence with him about it. The bluetongue episodes in ruminants that we are seeing in both Kent and Norfolk show us that we must be diligent with our biosecurity. African swine fever is rising up through the continent of Europe; we need to ensure that we are vigilant to stop that horrific disease coming into the United Kingdom. Heaven forbid that another disease like foot and mouth disease comes into the country. That shows us how important APHA is for our biosecurity and for the future of British business. I urge Ministers to keep making the case to the Treasury to refurbish the APHA HQ in Weybridge, Surrey. It is so important for our national security.

The Bill also has many pragmatic measures. It does not apply to movements within the United Kingdom, which will help, and importantly Northern Irish farmers will still have access to the UK and Irish markets. Some of the practical measures in the Windsor framework are developed in the Bill, but we need further clarity on the movement of animals between GB and Northern Ireland, and vice versa. I know that colleagues in the Democratic Unionist party feel strongly about the availability of veterinary medicines in Northern Ireland; 50% of veterinary medicines were going to be lost, but a suspension in December 2022 has extended availability for a further three years to 2025. It is important that we work with our European friends and allies to get clarity on long-term availability of veterinary medicines in Northern Ireland.

The Conservative Government have a strong record on animal welfare. I agree that it should not be a party-political issue. The Government have passed the Animal Welfare (Sentience) Act 2022; created the Animal Sentience Committee so that every piece of legislation must have due regard to animal sentience, which is so important; passed the Sentencing Act 2020 to increase the penalties for cruelty to animals; and brought in the compulsory microchipping of cats. Just last week, we talked about banning the keeping of primates as pets. As we have heard, individual Bills such as today’s are being introduced, as well as private Member’s Bills to tackle pet theft, pet smuggling and puppy smuggling, and to stop the import of dogs that have had their ears horrifically cropped, of cats that have had their claws horrifically taken off them, and of heavily pregnant cats and dogs. Those Bills are being introduced, as is another on livestock worrying.

Animal welfare unites us in humanity and across the House. It is so important that we pass the Bill. I welcome the cross-party support, and I wish the Bill well as it travels.

I did not expect the debate to be going in that direction, but I wholeheartedly agree with my hon. Friend. He is absolutely right. How can we get game meat into our schools and places of education? How can we find a better link to that and a better understanding of the food that is in abundance across this country? I think that is a perfectly reasonable and sensible point.

My proposal, as I said, is a simple concept but a complex challenge. We spend £2.4 billion annually on public sector food procurement and catering, and there is the opportunity to support local producers, improve food quality and diets, and safeguard the environment, all of which can be achieved by setting national standards. As I have found over the last four years, half the battle in this place is persuading others, including the Government, that a point of view or argument is the right one—and even when we are proven right, it may not count for much.

I congratulate my hon. Friend on securing the debate. Food security and the production of high-standard, locally produced food are vital. In 2021, the Environment, Food and Rural Affairs Committee produced a report on public sector food procurement. It highlighted the loophole in Government buying standards for food and catering that allows public sector bodies to purchase food that does not meet our UK legal standards in food production or animal welfare on the basis of cost.

Does my hon. Friend agree that we should close that inconsistent loophole as soon as we can, so that we can become a beacon to the rest of the world on food production and animal welfare standards? In so doing, we would be backing our fantastic British farmers and food producers, who produce food to the highest animal welfare and environmental standards.

I congratulate my hon. Friend on all his work as a member of the EFRA Committee, in which he brings his expertise both as a veterinarian and as a representative of a rural constituency with many farmers. He is absolutely right that we must close those loopholes. We must take the recommendations in the EFRA Committee report, to which I will refer later. I will be happy to follow through with anything he needs to strengthen his arm on that point.

The Government already accept the premise of what I am calling for. The Department for Environment, Food and Rural Affairs consultation on possible changes to the public sector food and catering policy stated:

“Government is adopting an ambitious and transformational approach to public sector food and catering. We are determined to use public sector purchasing power to ensure positive change in the food system. Our vision is that public sector food and catering is an exemplar to wider society in delivering positive health, animal welfare, environmental and socio-economic impacts.”

That is exactly the point made by my hon. Friend the Member for Penrith and The Border (Dr Hudson). The consultation ran from June 2022 to September 2022, and there were hundreds of submissions from worthwhile national organisations. Unfortunately, the Government have yet to respond to their consultation. Will the Minister say when we are likely to see the findings of the consultation and any recommendations, so that we can recognise the opportunity to see those targets and ambitions met?

To make those changes and recognise the ambitions stated in the consultation, the procurement process has to be widened to encourage and incentivise small businesses to engage with the system. Whether it be a national or a local authority contract, it is time consuming, risky and costly for small farms, fisheries or local food producers to submit a bid. That clearly needs to change. The Procurement Act 2023 reforms the procurement process to make it simpler, faster, more transparent and less bureaucratic. It is perhaps one of the most boring pieces of legislation that has ever been passed by Parliament, but it is an important one that will make a huge difference to small businesses. With the measures coming into force in October 2024, the Government have rightly made it their ambition to open the market for public contracts to new entrants, especially small and local businesses. The Act is the catalyst for reforming our food procurement system, to ensure healthier, higher-quality food is at the heart of our publicly funded organisations.

When the Act was debated in the Lords, a number of amendments aimed to set national targets, such as ensuring that 50% of purchases must be from the UK or that “locally” would mean within 30 miles of a contracting authority. I understand that those proposals would have contravened many of our World Trade Organisation legal obligations, but there are steps that we can take to develop and improve local purchasing strategies while continuing to adhere to WTO standards. Will the Minister say when the Government will use section 107 of the Procurement Act to introduce secondary legislation to disapply section 17 of the Local Government Act 1988, which

“currently precludes local authorities from awarding public supply or work contracts by supplier location”?—[Official Report, House of Lords, 28 November 2022; Vol. 825, c. 1641.]

That was stated at the Dispatch Box in the House of Lords by a Minister. Introducing secondary legislation would be welcomed, I presume, by both sides of this House—I see the shadow Minister, the hon. Member for Cambridge (Daniel Zeichner), nodding—so there is an opportunity to quickly see that reform brought to reality.

The more sceptical might think that this is all wishful thinking, but international comparisons should be made, and some of the successes are remarkable. For instance, in 2001 Denmark introduced an organic action plan aimed at 60% organic procurement in all public kitchens by 2020. Evidence showed an increase in public kitchen procurement of organic food of 24% by 2016. The policy proved so popular that the city of Copenhagen increased the target and achieved it, at 90%, earlier this year. The policy improved not only the health of those using public kitchens, but the understanding of food and nutrition, as well as cooking skills. The Danish agricultural community also found themselves boosted when able to bid for local tenders, with small and medium-sized businesses actively engaging and benefiting from the policy.

Brazil passed a law that requires 30% of the national budget for food served in school meal programmes to be spent on food from family farms, with priority given to those using agroecological methods. Perhaps the most interesting point about that policy is that it has also restricted the purchasing of processed and ultra-processed food with taxpayers’ money. That has had a positive impact on the farming and fishing communities, as well as benefiting schools, hospitals and other publicly funded organisations. In the United States, which we are often quick to deride, states such as California and Massachusetts have put in place frameworks that steer public purchasing towards local sources, with the express purpose of improving the diet, health and nutrition of their citizens. Austria and the Nordic countries also have fantastic examples.

Even in my area of south Devon, in the south-west, we have piloted interesting and innovative schemes such as the dynamic purchasing system to help to facilitate greater buy-in from small and medium-sized enterprises to allow them to take advantage of public tenders—all with the express hope of streamlining the consolidation and delivery of orders from multiple suppliers with an online food store, a local delivery hub and knowledge of local suppliers. Both at home and abroad, there are examples of how the proposals that I have put forward could and should work.

The Government buying standard for food and catering services sets out what public sector organisations should apply when procuring food and catering services. The standards relate to food production, processing, distribution and nutrition. Some of the standards are mandatory; some are best practices. DEFRA is responsible for updating public sector procurement standards, and the Department of Health and Social Care is responsible for the nutrition standards in the GBSF, as it is known.

The “National Food Strategy” report and the Environment, Food and Rural Affairs Committee report that has already been mentioned on public sector procurement of food rightly consider what needs to be done to update the GBSF: the buying standards should be updated to ensure procurement of healthy and sustainable food; standards should be mandatory across the entire public sector; the monitoring of compliance with the standards should be improved; and supply chains should be opened up to a wider range of businesses. Some of those measures are already under way.

However, it is frequently remarked on that the lack of joined-up thinking between Departments when it comes to food has been the predominant block to action in this space. Reshaping the GBSF to take on board the food strategy recommendations plus improved oversight and strategy, coupled with mandatory targets and enforcement mechanisms, will be the only way in which we can speed along the change that we wish to see in our public sector. Mandatory standards across all sectors of public sector food procurement would not only be a huge vote of support for our food, farming and fishing communities, but necessitate an oversight body to ensure that targets were met and promises delivered.

I have sought to demonstrate that my proposal is not out of kilter with the Government’s ambitions. I have referenced the fact that the Government’s consultation on this topic asked for submissions on the very points and ambitions that I have raised. We wait in hope for its findings. I have provided the international comparisons that show that we can not only be compliant with WTO rules, but ensure that we have strong and robust legislation that meets our own domestic interests. We can do that while adhering to our international commitments.

I will end on the work of the Food, Farming and Countryside Commission, whose excellent work on this topic and so many others has demonstrated the overwhelming positive public appetite—no pun intended —to change the public food procurement system. Specifically, citizens across this country want the Government to improve public sector food procurement and nutrition standards, with 84% of people believing in stronger standards for the food provided in our hospitals and schools.

Can I just highlight again the loophole in the Government buying standards the Minister mentioned? The public sector can deviate from buying high-quality food on the basis of cost; it can deviate from animal welfare standards if it is cheaper to do that. The Minister’s predecessor gave us very encouraging answers on the EFRA Committee on our recommendations for closing that loophole. It is a simple thing to do. I really urge the Government to look at that and to close the loophole, so that we can give the best example with our local public sector food procurement.

Of course, we want those consuming food purchased in the public sector to have access to the healthiest, best-quality food possible. We need to balance that with a desire to get good value for taxpayers’ money at the same time. Where foods are of the same quality and standard, we would of course expect people to purchase locally wherever possible. We want to use our influence to encourage people in the public sector to make the most of locally produced, high-quality British food. That is done through a blend of mandated standards that apply to central Government Departments —His Majesty’s Prison and Probation Service, NHS hospitals and the armed forces in England—and best practice standards, which exist to encourage all public sector organisations to work towards having healthier and more sustainable food in their supply chains.

Public sector food should champion healthier, sustainable food that is provided by a diverse range of suppliers. To underpin that approach, we held a consultation last year on public sector food and catering policy, including on updating the Government buying standards for food and catering services, which were last updated in 2014. Leaving aside the nutritional standards, which were updated in 2021, there was broad support for some of the proposals we included in the consultation, including pursuing greater environmental sustainability gains and increasing the opportunities for small and medium-sized businesses in the sector.

I am pleased to say that we have worked hard with colleagues across Government to take our response through to the final stages of drafting. I am confident that the revised standards will deliver positive change, as well as making life easier for those implementing them. The team has been working across Government with those Departments that have a vested interest, such as the Ministry of Defence, which has specific operational challenges in feeding its workforce, and with the Crown Commercial Services to oversee the consideration of SMEs in its new Buying Better Food and Drink agreement. That agreement will help SME food producers to access public sector food opportunities, provided that they meet the GBSF.

The GBSF already supports and strengthens cross-Government policies linked to environmental sustainability, animal welfare, food safety and nutrition. With regards to the environment, for example, the standards encourage the championing of seasonal produce and mandate that a proportion of food in the supply chain meets higher environmental production standards. That can currently be demonstrated through membership of organic and LEAF—linking environment and farming—assurance schemes, and we will continue to work to link them to world-class environmental land management schemes.

As well as bringing the standards up to date, the refresh will make the GBSF simpler and more engaging for those in the sector to interpret, whether returning to the standards or coming to them for the first time. Accompanying guidance will clarify how any changes can be applied, as well as improve the transparency of the supply chain, so that a greater range of potential suppliers are able to understand the opportunities the sector has to offer. To continue driving improvement and ambition in the sector, we will continue to develop and refine guidance following publication by engaging with the sector to improve uptake and retain Government focus on the priorities I have mentioned.

We have had a very interesting debate. I hope I have reassured Members that we are on the right track.
