Commons ChamberI send my best wishes to the hon. Member for Newcastle upon Tyne Central (Chi Onwurah); I understand why she cannot be here. I appreciate the response from the hon. Member for Feltham and Heston (Seema Malhotra), and I will try to answer some of her questions.
The hon. Lady talked about Ministers’ role in this. Clearly, the role of our Department, Government and Ministers will be included in the inquiry. We do want to learn the lessons, and that will be the case, but as we have seen from the judgment, the Post Office consistently maintained that Horizon was robust and was misguided in its approach to the issue, leading to the decision to prosecute these postmasters. We pressed management on issues regarding complaints brought by postmasters about Horizon and received repeated assurances that the system was reliable. As I say, the inquiry will look into that.
In terms of the Government’s response, we clearly recognise the impact that convictions have had on individual postmasters and their families. That is why the Prime Minister and I met with a small group of them last month, to hear directly from them. They had some incredibly tragic and terrible stories, and I can understand why they find it difficult to trust anybody in this regard after many, many years of difficulty and the impossible situation that they and their families have been in.
On Horizon itself, the Post Office is looking into that. It cannot, unfortunately, just switch off a system and change midstream, but clearly it will be looking to work on the successor CRM—customer relationship management —system. Yes, the terms of reference and the statutory footing allow Sir Wyn to compel people to give evidence and documents, and there are sanctions on them if they should fail to do so, under the Inquiries Act 2005. One of the reasons for that, as we move to the second stage and, I hope, engage more sub-postmasters to give their stories, is that we want to give them the confidence that people will be giving their evidence. I must say that, to date still, everybody involved in this whom Sir Wyn has asked to do so has given their full undertaking and worked on it. Nobody has resiled from the inquiry, but it is important that we do this.
On the terms of reference in relation to compensation, an inquiry, whether statutory or not, cannot determine liability in itself—that still has to be done through the courts—but sub-postmasters clearly can raise, and I would fully expect them to raise, the issue of the losses and difficulties as they outline the difficulties they have had. On Fujitsu, as I have said, clearly the Post Office will be looking at what it does in further compensation, and that will include Fujitsu. There are criminal investigations going ahead, so that is outside the scope of the inquiry, but the GLO—group litigation order—settlement was a full and final settlement. The Government did not have a part in the litigation. It is not part of the inquiry itself, but none the less, this is one part—an important part, but one part—of making sure that we get to the bottom of this and get sufficient justice for the postmasters so badly affected.
I warmly congratulate the Minister on his statement, and I think it is fantastic news for sub-postmasters. I would like to thank the Prime Minister for meeting sub-postmasters, including my constituent Tracy Felstead, and for understanding the terrible injustice that they have suffered for so long. Can the Minister assure me that compensation will be paid to all those affected, including those who were party to the horrendous struggle that was the group litigation? Does he agree that these sub-postmasters should not be penalised for shining a light on the conduct of the Post Office, and they should not be required to fund the pivotal judgment of Mr Justice Fraser, without which no convictions would have been overturned? Can he please agree with me that compensation must be fair to all sub-postmasters?
I thank my hon. Friend, who has been really dogged in her championing of Tracy Felstead and many others who have been affected. I was pleased to meet Tracy—who gave such tragic testimony—alongside the Prime Minister. On compensation, the Post Office is engaging in the compensation process. I will, in my regular meetings with the Post Office, make sure that we keep on top of that, because we want to ensure justice and fair compensation for all who have been affected.

Commons ChamberThe hon. Gentleman has represented his constituent, Janet Skinner, as both a constituency MP and a former solicitor, so he has a lot of experience of this. We will work to ensure that the Post Office does not defend anything that is indefensible, and that we get answers. That is exactly what Sir Wyn is there to do, and he will produce his report by summer so that we get answers this year.
The Minister is a decent, able man who I know will do his best to put right these terrible wrongs. Some 555 sub-postmasters showed tremendous courage and dignity in the group litigation against the Post Office, which concluded in 2019. Will the Minister ask his officials whether his Department authorised the Post Office to use millions of pounds of taxpayers’ money to fight the sub-postmasters in that litigation, waging a war of attrition on them, purely to disguise the Horizon failings? Will he ask whether his predecessor, the Minister responsible for post offices in 2018-19, was aware of that, and if not, why not?
The litigation was taken on entirely by Post Office Ltd, and my hon. Friend does not need me to ask those questions, as they are exactly the kinds of questions that Sir Wyn Williams will be asking throughout his independent inquiry, which will report back in summer this year.

Commons ChamberThe right hon. Gentleman has a long-standing interest in this issue. It important that we set out long-term plans both to help the cohort of people who came in off the streets through Everybody In and to make further strides in our overall effort to reduce rough sleeping to the absolute minimum. In the summer we asked local councils, including the right hon. Gentleman’s, to draw up a plan for how they would assist those people who were in temporary accommodation into move-on accommodation, and then ultimately into either social housing or the private rental sector. We supported that with almost £100 million of funding.
The settlement announced today provides further funding for the next financial year that is the same as or greater than the amount of money that was available in this financial year, and it will be £750 million in total. We have also secured £430 million for new move-on accommodation and asked every local council in the country to bid for that so that they can invest in accommodation to help to support the people they have taken in off the streets.
On no recourse to public funds, we have taken a number of steps this year. We extended the derogation, not just to London but to the whole country, so that local councils can support European economic area nationals. There is of course, a cohort of people who are not EEA nationals, and we have allowed councils the discretion to support them when there is a risk to life. Many councils have chosen to do that throughout the pandemic and I am sure will do so this winter.
I thank my right hon. Friend for his statement and for the generous support that my local council has received during the pandemic. In particular, I wish to mention the £1 million rough sleepers fund and the £600,000 winter grant fund that we have received to support struggling families at this very difficult time. My local council staff have been doing a fantastic job, and my right hon. Friend is right to thank them for going above and beyond to serve our community.
My constituents are being told that in future they should expect council tax increases of 5% and that they should also expect to see cuts to vital services. Will my right hon. Friend please reassure my constituents that the generous funding settlement announced today, together with all the other measures, will mean that there will be no need for the council to choose to take such draconian measures as increasing council tax by 5% or making cuts to vital services?

I thank the right hon. Gentleman for those points, and I will try to deal with them directly. The decision to prosecute postmasters was an operational matter for the Post Office, and the Government are not involved in operational decisions. However, in hindsight, knowing what we know now, it is clear that different conclusions could and should have been reached by the Post Office, and that is why the inquiry is there to look at the lessons.
The right hon. Gentleman asked about a route for compensation, should postmasters who have been convicted have their convictions overturned. There are processes in place for them to receive compensation if appropriate, and that includes a statutory scheme under section 133 of the Criminal Justice Act 1988.
In terms of the latest update on the historical shortfall scheme, the Post Office launched the scheme on 1 May to allow postmasters who were not part of the group litigation to have issues with shortfalls recorded in Horizon investigated and addressed. The window for applications formally closed on 14 August, but late applications are being considered by the Post Office on a case-by-case basis. There have been over 2,200 claims, and the independent panel advising the Post Office on the scheme is now assessing those.
The right hon. Gentleman talked about the inquiry. A judge-led inquiry is very much what was asked for. We have Sir Wyn Williams, a former judge, at the head of that. He will be an independent chair; he will be able to ask the questions, push back at the Government and the Post Office, and get evidence. The reason it is an inquiry rather than a review is that, reflecting on the way its remit was worded, I have always wanted it to be a backward-looking review that enabled evidence to be sought, rather than to be done on just a desktop basis. We have clarified that in the written statement, and I believe this is the inquiry—albeit on a non-statutory basis—that will actually get the answers, and do it in a quick way that hopefully satisfies the sub-postmasters and gets the answers they want.
Almost 20 years ago, Telford resident Tracy Felstead—then a 19-year-old post office clerk—was wrongly convicted and jailed because of a glitch in the Post Office computer system. Last week, the Post Office finally conceded defeat in the long-running battle between David and Goliath. How did a respectable organisation such as the Post Office, a major software company such as for Fujitsu, the great and the good in the civil service, and Ministers from all parties fall prey to groupthink on such a grand scale, so that, despite this computer error occurring across the country, it was assumed that the only possible explanation was that all sub-postmasters affected were dishonest? What action will my hon. Friend take to ensure the Post Office and Fujitsu are properly held to account, and will he commit to determining who knew what and when during this shameful saga?
My hon. Friend is absolutely right that we need to get to the bottom of who knew what and when. That is why I am determined that, under Sir Wyn Williams’ chairmanship, we can seek evidence to complement what is already available from Mr Justice Fraser’s findings by speaking to the Post Office and Fujitsu, who have agreed to comply fully with this inquiry. I also hope that sub-postmasters will, through conversation with Sir Wyn Williams, agree to get involved so that they can share their evidence and stories and so that we can get to the bottom of this, exactly as my hon. Friend says.

I thank my hon. Friend. One of the problems with this case is that it has happened over 20 years, which means that a lot of people have moved on or moved around, and it has been difficult to follow those who have gone through the system in all this time. [Interruption.] I hear the right hon. Member for North Durham (Mr Jones) say from a sedentary position that we gave the former chief executive a CBE. We have followed that up: she went through the independent honours commission, which works on that in a separate process, but we have actually made sure that we have written to the Care Quality Commission to ask if she is a fit and proper person in terms of the position she now holds.

I sympathise with my hon. Friend, and I know that he will have heard what has been said today and will be listening very carefully. A succession of his predecessors have come to that Dispatch Box over years to read out statements from officials who we know have closely connected relationships with Post Office management and who knew that an injustice had occurred. What will he do to tackle the network of intertwined vested interests on his doorstep—and I include the Cabinet Office and ex-Fujitsu employees—that led to this shameful and tragic scandal and cover-up?
It may be that many Government Ministers have come here, but it is this Government Minister who has actually pushed to make sure that we can have a review and that we can have it independently chaired—separate from the Post Office, separate from Government —to come up with those answers. That is what postmasters want. We have made sure in Government that we have come up with a new framework for an increased frequency of shareholder meetings to ensure that we can hold the Post Office to account for its actions, but also ensure that the taxpayer gets the most out of the Post Office, communities get the most out of the Post Office and, importantly, postmasters can feel confident they can build up a trustful relationship as valued stakeholders within the post office network.

I am grateful for the hon. Gentleman’s comments. I agree with him that our message and our processes need to be as consistent as possible, not least for people across the UK, but also for the companies operating in each nation of the UK. That is why colleagues from my Department have regular conversations with the devolved Administrations, including the Scottish Parliament. We must continue to work to get into the detail to give employees that confidence. We will continue to work through that with businesses, unions and others who are feeding in day to day, so that we can provide a consistent, robust line and give confidence, with examples of best practice from businesses that have remained open and from which we can learn.
Enabling people to go back to work safely is key to getting through this crisis. Safe working will inevitably be different for different businesses in different settings. Will the Minister do all he can to ensure that Government guidance focuses on general principles of social distancing and hygiene, and avoids being overly prescriptive, so that as many businesses as possible can reopen safely?
I am grateful to my hon. Friend for that question. She is absolutely right, and that is why we have consulted as widely as possible. We will continue to do so, because we need to ensure that all these guidelines give confidence to people in every type of workplace, in every part of the UK. It is also important to reiterate that many companies are still operating. We need to ensure that our economy stays open and working, so that we can bounce back as quickly possible, and those companies are already offering best practice for that.

Commons ChamberI congratulate the right hon. Gentleman on his excellent speech and his stoical determination in trying to get to the bottom of this. Is he also aware that the head of Fujitsu UK is now working in the Cabinet Office?
I do not know whether the hon. Lady has read my speech, but I am just coming on to the Cabinet Office, because lo and behold, guess where Paula Vennells also ended up? She was a non-executive member of the Cabinet Office. I am told that she was removed from that post yesterday; I do not know whether it was because of this debate. I welcome that, but why is someone who has overseen this absolute scandal still allowed to hold public positions? Worse than that, she is a priest. I respect those who have religious faith, and she does, but the way that she has treated these people cannot be described as very Christian—she certainly would not pass the good Samaritan test, given the way she has ignored their pleas. I hope she thinks about people like Tom, who have lost their livelihoods and are now living in social housing because of her actions. It angers me that these individuals have gone scot-free, and they need to be answerable for their actions.
I am grateful to the hon. Gentleman. I have described this as the most grotesque version of predatory capitalism I have ever seen. Why? Because £1 billion was invested and senior officials in the Post Office and Fujitsu did everything they possibly could to protect themselves. They knew. Let us be absolutely clear about that. They knew that there were victims who might go to prison—or who had already gone, at that point. It is utterly disgusting.
I, too, have a constituent in exactly the situation the hon. Gentleman has described, who was 18 years old and was sent to Holloway for six months, accused of theft and failing to apologise to the grannies she was supposed to have stolen from. She has not had her name cleared. She has been waiting five years for the Criminal Cases Review Commission to do that.
The hon. Lady is absolutely right. These sub-postmasters were respected in the community. The Post Office is a respected organisation that we should all be incredibly proud of, but that was part of the problem. The Post Office was believed. The lies that Ministers, officials and everyone else were told along the line were believed as well. That is why only a judge-led inquiry can possibly sort this out. We need to know who knew what, what they knew, when they knew it and why they acted as they did.
I want to say something briefly about one of those senior people in the Post Office, Paula Vennells. I do not know Paula Vennells but I do know that she apparently earned something in the region of £5 million over a six-year period. I believe wholeheartedly that she would have had a very good inkling of what was going on at the time. This is utterly scandalous and a judge will be the person who can get to the bottom of it.
The right hon. Gentleman is absolutely right and makes an excellent point. Evidence about the infallibility of the system would have led to the conviction of these sub-postmasters, and that is why we need to look at how to progress this further. While after the trial the Post Office chairman conceded that it had got things wrong in the past, the fact was that the Post Office fought the action until the bitter end, and that speaks volumes.
Does the hon. Gentleman agree that the way the Post Office conducted itself throughout the litigation process was shameful in terms of trying to grind down the claimants, so they would withdraw their claim?
The hon. Lady is absolutely right. The Post Office seemed to have unlimited funds at its disposal to fight this action, whereas the sub-postmasters had to collectively bring the action together and rely on support from free solicitors to get them through the case. The Post Office is an arm’s length organisation, but there seems to be no accountability for its actions, and in this matter there seems to be no scrutiny, despite it receiving public money for its functions.
Although the civil action may be over, the nightmare continues for my constituent. Kamran is still trying to get his conviction overturned. The Criminal Cases Review Commission board is meant to be meeting next week to discuss what steps it will be taking; I am not sure if that will be going ahead, but I hope it does. He is also still considering further civil action, and he is not alone. After having been failed by the legal system, it seems that justice is now finally being done, but at a very slow pace.
I therefore invite the Minister to do whatever it takes to get justice for the sub-postmasters, and I also join the call for an independent, judge-led public inquiry into this shocking scandal.
First of all, I congratulate the right hon. Member for North Durham (Mr Jones) and my hon. Friend the Member for North West Leicestershire (Andrew Bridgen), who cannot be here today, for securing today’s important debate. I thank all Members for their contributions to this excellent and heartfelt debate.
We know that the Government recognise the role of post offices, and that was articulated by my hon. Friend the Member for North Norfolk (Duncan Baker). It is so important that we make sure that we build on the network. There is no programme of closures—there have actually been 400 new post offices in the past few years, and I want to make sure that we can develop on that, although individual post offices may open or close at various points. I want to make sure that I spend the rest of my time covering as many as possible of the questions that have been raised in this interesting debate.
It is impossible to ignore the impact that the litigation process has had on the affected postmasters and their families. We have heard about Tom Brown, Janet Skinner, Alan Bates, Kamran Ashraf, Siobhan Sayer, Elizabeth Barnes and Jacqueline El Kasaby, among others. As my hon. Friend the Member for Broadland (Jerome Mayhew) said, they are all real people, not just people on a spreadsheet or a list. They are individuals whose families have been affected, so I will not hide and I will not wash my hands of it. It is so important that we get as much done as possible, even if we cannot achieve everything that has been asked.
I am glad that the Post Office has accepted that it got it wrong in the past on the Horizon accounting system and in its dealings with a number of postmasters, and that it has apologised. I am glad that we got a comprehensive resolution to the litigation following several days of respectful, challenging and ultimately successful mediation, although several hon. Members have raised issues about where we go from here.
Beyond the financial settlement, the Post Office committed to directly address past events for affected postmasters, so it will shortly announce a scheme to address the historical shortfalls for postmasters who were not part of the group litigation. That scheme has been designed to offer a fair, fast and transparent means for postmasters’ historical issues to be resolved.
The terms of the settlement put the onus on the Post Office to implement the necessary cultural and organisational changes highlighted by the litigation, which means that the company should foster a genuine commercial partnership with postmasters. Clearly, it has to settle its past relationship with postmasters to look forward and ensure that postmasters can have confidence in their future relationship with it.
It is important that the necessary support for postmasters to operate branches successfully is available. That includes newly established area managers to deliver support on the ground, an improved branch support centre to support teams throughout the UK, an overhaul of postmaster training and, above all, a further increase to postmaster remuneration, as we heard earlier.
In terms of the management of the Post Office, there is a new chief executive officer and two new non-executive directors, so its leadership has changed significantly in the last few months as a result of the situation. I recognise the strength of feeling surrounding the case, which is why the Government and I are determined to take the necessary steps to ensure that lessons are learned from the Horizon litigation and that past issues will not be repeated.
We have talked about the independent review, which the Prime Minister mentioned a couple of weeks ago. We are looking at the best way to do it. There will be a further announcement as soon as possible in the very near future. I know that hon. Members want progress, but I want to ensure that we get it right, rather than rushing into the terms of reference and other details. I want to make sure, as I said, without hiding and without washing my hands of it, that we actually get something that means something to the affected postmasters.
Does the Minister agree that the most important thing is for the wrongful convictions to be overturned? We cannot learn lessons and move forward if that is not addressed. Will he please address that point?

Commons ChamberThe hon. Lady will know as a follower of Treasury matters that what we announced yesterday in the Budget with reform of the Public Works Loan Board makes it cheaper for councils to borrow to invest in housing and regeneration. I hope that she will support the changes that we made. The changes we are making to the PWLB will make it harder for councils to waste money on speculative investments outside of their boundaries and get highly indebted, and make it easier to spend money on things that really matter. We have lifted the housing revenue account borrowing cap, and many councils across the country are responding to that and building council houses at a pace that we have not seen for many years, as was reflected in the statistics I gave earlier. We built more council houses last year than we have done for many years, and I hope that her local council in Oxford will do the same, if that is what she wishes.
I warmly welcome my right hon. Friend’s statement. It is absolutely right that we look afresh at the planning system, and I am so glad that he is doing just that. My right hon. Friend knows a great deal about the challenges that new-build housing can create for existing communities as well as for owners. What more can he do to ensure that developers properly consider the rights and needs of local communities, as well as of the new build home owners, which are often impacted by their behaviours?
Quality is extremely important, and we have seen evidence of poor-quality development in this country in recent years, including by some of the most prominent house builders. That needs to change, and if we are going to reform the planning system to make it easier to build, then house builders must respond in turn by ensuring that homes are well designed, safe and environmentally sustainable. My hon. Friend has seen examples of poor practice in Telford and has campaigned on that. We are placing the new homes ombudsman on a statutory footing, and that will ensure that anyone who purchased a home has a proper system for redress if the usual complaints mechanism of the house builder does not suffice. I hope that that will see a big change in the quality of output from house builders very rapidly.

That this House has considered the Criminal Cases Review Commission’s process for review of convictions relating to the Post Office and Horizon accounting system.
It is a great pleasure to serve under your chairmanship, Mr McCabe, and a privilege to have secured this debate. Following the completion of the litigation process, I am sure it will be the first of many on different aspects of this miscarriage of justice.
I pay tribute to those who have fought the corner of postmasters affected by the Horizon IT system over many years, particularly Lord Arbuthnot of Edrom and my hon. Friend the Member for North West Leicestershire (Andrew Bridgen). I also pay tribute to the right hon. Member for North Durham (Mr Jones) for his sterling work, my hon. Friend the Member for Woking (Mr Lord), who has worked so hard on the terrible case of Seema Misra, and many other Members across the House who have long campaigned on this issue.
I pay a particularly special tribute to those Post Office workers and campaigners who have had to overcome the myriad obstacles and hurdles that have been put in their way over the years. I am humbled by their fortitude and dignity, as they have continually—indeed, stoically—endured much in many ways, as their quest for justice goes on.
I have not come to Westminster Hall today to level criticism at the Post Office, nor to set out the background to the successful group litigation against the Post Office. I have no need to do so because the honourable Mr Justice Fraser, who I am sure will eventually go down in history as the next Lord Denning, has already comprehensively done so in his very fine judgments, particularly that handed down on 16 December 2019. I will, however, draw attention to the way in which the Post Office embarked on what appears to any outside observer to have been a war of attrition against its former employees throughout the litigation process, repeatedly appealing every decision, seeking to recuse the judge, and appealing the judgments that were handed down. That war of attrition ground down the claimants and forced them into a settlement, most of which will go towards meeting their legal fees.
My hon. Friend makes a valid point about the settlement. The case was supposed to be settled through a process of mediation. The settlement came to more than £57 million. Does she not think that it is outrageous that most of that sum is going to lawyers, which brings into disrepute the whole process of mediation—and I say that as a mediator myself? It is outrageous that mediation can charge so much for what was a fairly straightforward operation.
I am grateful to my hon. Friend for making that vital point. Many of the postmasters thought that the £57 million would go to them, as was announced in the press. However, after the legal costs have been paid, it is unlikely that sufficient moneys will be left over to compensate even those from whom the Post Office extracted money when their tills did not balance. Even that money may not be refunded, never mind the costs for the actual losses suffered by postmasters. There will be nothing at all left for actual compensation.
I am sure the hon. Lady will agree that this whole episode has had far-reaching consequences for those affected by it. She will also be aware that the Select Committee on Business, Energy and Industrial Strategy Committee is going to hold an inquiry. Does she share my view that there needs to be more than that? We need a full and comprehensive public inquiry, to ensure that this kind of shambles, which has cost so many people so much, never happens again.
The hon. Lady makes a very important point, which I will return to a little later in my speech. It is very welcome indeed that the BEIS Committee will look at this issue.
I am sure the hon. Lady will agree that this business—the Post Office—was effectively wholly owned by the Government. None of us should argue about whether lawyers should be paid for bringing litigation on behalf of these victims, but should not the Government themselves step in to ensure that all of that money—all of those lawyers’ fees—is paid by the Government?
The hon. Gentleman makes a very important point, and it is absolutely right that those sub-postmasters who paid money they did not owe to the Post Office—simply on the basis of their tills not balancing, which was due to a flaw in the Horizon IT system—should be fully compensated for those losses, not to mention those they then suffered as consequence.
Actually, Fujitsu has a role to play in this process as well, because the judge made clear in his judgment that he doubted the veracity of some of the information he was given, and he subsequently made a referral to the Director of Public Prosecutions to query that information. There is a separate debate to be had on that issue, which we could have at a later stage.
May I praise my hon. Friend for her campaign against this miscarriage of justice? I and many other MPs are here in Westminster Hall today on behalf of our constituents. I am here on behalf of just three of the victims of this scandal: Gillian and Graham Howard, and Maria Lockwood. There are other victims across the country. Will my hon. Friend continue to work with me and other MPs so that we get justice and full redress for the victims of this miscarriage of justice?
I thank my hon. Friend for his intervention, and he is absolutely right that it is now down to us as parliamentarians to put right this miscarriage of justice. I am grateful for the support of many MPs from all parties, but I am also grateful, as I said earlier, for the incredible campaigning work that was done long before I came to this place.
I will make just one more point before I move on to the main issues I want to raise. I will put on the record that the judge handed down findings that confirmed that bugs, errors and defects did indeed exist in the Horizon IT accounting system, and that these defects had caused financial discrepancies, for which postmasters were held accountable. That is a very important finding and I am pleased to place it on the record.
The purpose of this debate, now that the litigation is complete, is to highlight the need to find a mechanism that will allow those Post Office workers affected by this scandal to put the nightmare behind them and move forward with their lives. Of course, until convictions are quashed and criminal records expunged, it is very hard to see how they can possibly do that.
So many of these decent people were pillars of their communities, working in a respected role in what was once a respected institution. They speak of the way that the wrongful allegations of theft and fraud, and their wrongful imprisonment, affected their reputations in their community, causing a deep sense of stigma, social isolation and shame for themselves and their families. For some of them, that was too much to bear.
I thank the hon. Lady for bringing this matter to Westminster Hall for us all to comment on, and so we can support her, too, as always. Does she agree that, since our courts have found that the Horizon system was unreliable, it follows that the convictions that relied on the Horizon data may also be unreliable? The argument that the interests of justice cannot be met unless we review convictions based on this flawed system is, therefore, understandable. The judgment, however, did not deal with the question of convictions, so there is still work to do to address that.
The hon. Gentleman is absolutely right, and I thank him for his intervention, because we are just at the beginning. We now have the opportunity, as parliamentarians, to start work. This matter is no longer sub judice—we can talk about it—and it is fantastic that there is a groundswell of support from right across both Houses.
My hon. Friend and neighbour is making a very powerful case on behalf of all the victims, including my constituent, Rubbina Shaheen, who is one of three or four postmistresses who got into severe difficulties as a result of this error on the part of Fujitsu. She was convicted in 2010 and spent 12 months in jail. Her life was destroyed and she and her husband lost their home. What does my hon. Friend think we can do to try to hold to account those who are responsible and provide some justice for our constituents?
My right hon. Friend and neighbour is absolutely right, and I am glad he has had the opportunity to raise that distressing case. There is a great deal we can do to correct this miscarriage of justice. This debate is just the beginning. I have had very constructive conversations with members of the Ministry of Justice team. Overturning the convictions is one element, but we must have a mechanism to hold to account those who were responsible, who at some point in this saga were fully aware that the Horizon system was flawed. I am delighted that the BEIS Committee will, I hope, invite many of those responsible to give evidence.
I congratulate the hon. Lady on securing this debate and on the work she has done. My constituent Karl Reid describes himself as one of the lucky ones because he was not jailed or convicted, but he did lose £50,000 and two businesses. He felt that he had to move out of the area where he used to have those businesses because of the associated shame and concern. Does she agree that, although it is a priority to get the convictions overturned, the consequences of the scandal go so much broader, to people such as Karl Reid? He describes himself as lucky, but I would not describe him as lucky, and I am sure the hon. Lady would not, either.
The hon. Lady is right and I fully endorse what she says. One direct benefit of the settlement and the conclusion of the litigation is that, as the representatives of postmasters who have been so grotesquely wronged, we now have the opportunity to correct that. I am thankful that the day has come.
I say to all those postmasters affected by this injustice that this debate is just the beginning. The Prime Minister has promised to get to the bottom of what happened, and I understand from what I heard at Prime Minister’s questions last week that he has agreed to an independent inquiry. Regrettably, in my experience, those responsible will have long since retired before any such inquiry even gets under way, but it is in any event a welcome first step.
What is hugely to be welcomed—I think all sub-postmasters affected will welcome this—is that next week the BEIS Committee will begin holding its inquiry and taking evidence. My constituent, Tracy Felstead, will be giving evidence next Tuesday. She is perhaps one of the most tragic cases, having only been a young 18-year-old girl in her first job straight out of school, delighted to be going to work for the Post Office. She ended up in Holloway Prison for six months and is still struggling to come to terms with the reality of what happened to her. The BEIS Committee inquiry is a fantastic opportunity for all the issues of the Horizon accounting system to be explored, in-depth and in public, and that is very important. The hon. Member for Leeds West (Rachel Reeves) is a very thorough Chair, and she will hold those responsible to account through her Committee. I know that all of us here today will welcome that.
I thank the hon. Lady for bringing this debate. I certainly welcome the BEIS Committee inquiry into the issue. Although justice and compensation are entirely appropriate, does she agree that no amount of compensation will restore the dignity that was lost by so many or repair the damage done to people’s physical and mental health by this long-standing scandal?
The hon. Gentleman is absolutely right: no amount of money will ever compensate those affected. We need to help them get their lives back on track, and there are various ways we can do that. Having a sense that justice has been done is incredibly important, even if it is not possible to fully compensate for the losses suffered.
My constituent Pamela Lock had 80 hours of community service and, like many others, was sacked from the Post Office, but she continues to have a successful shop and bakery. We all understand that the financial pay-out will not be enough for the people affected and does not cover the losses, but the hon. Member said this debate is just the beginning. If this is the beginning, what hope can we give to victims of this travesty in terms of the timescale they have to work in?
The hon. Lady is right to raise that point, because many of these people have been suffering for many years. My constituent was one of the very first victims of this miscarriage of justice, with the event happening to her in 2000, so Members can imagine how she has suffered throughout that period. Indeed, her family have suffered, too.
I will move on to the question of how we get to the review of these convictions. A group litigation order was approved by the president of the Queen’s bench division, so it follows that a group remedy is possible when there are clearly common themes. One such common theme must surely be that convictions were achieved on the basis of the Horizon IT evidence, which Justice Fraser has ruled, as I said earlier, to be not “remotely robust” and prone to errors.
Dialogue with the Criminal Cases Review Commission has been helpful, and I am confident that it realises that the case is exceptional and should be treated as such, and that it will carefully consider all the common themes that would enable a referral to the Court of Appeal to be grouped. I very much hope that the CCRC continues with that mindset. I understand from my discussions with representatives of the Post Office that it would prefer each case to be treated separately. They have said that the Post Office will insist that those who pleaded guilty to false accounting should be excluded from the process. However, it seems to me that that should not be a matter for the Post Office to involve itself in. Should the cases be referred by the CCRC to the Court of Appeal, the Post Office will be a respondent. It would be wholly wrong for the Post Office to be involved in any decisions around the mechanisms for the quashing of the convictions, given that the convictions are of people whom it sought to prosecute.
One of the representatives of the Post Office said to me that he doubts many cases will be referred to the Court of Appeal and that those that do are unlikely to succeed. It seems to me that rather than learning the lessons and moving forward, as the Post Office suggests it has, it is in fact still intent on protecting the interests of the institution at all costs. That is hugely damaging to the Post Office. We love the Post Office. We support the Post Office and we want it to thrive, but to continue with that mindset, which Justice Fraser referred to as “institutional obstinacy”, is not only damaging to the Post Office brand and reputation, but adds insult to injury for those who have suffered as a direct consequence of its failure to see the world as round.
I have huge admiration for the Minister, who I know is a man of enormous integrity with an inquiring mind. He will, I have no doubt, read around the subject in depth, and I wish him well in his new role as Minister for the Post Office. With a new Minister in post, a new Government in office and a fine judgment from Justice Fraser, we have an opportunity to get justice done. I look forward to hearing what the Minister has to say about how Government can help postmasters overturn wrongful convictions in a timely manner. I urge him to work with the excellent Minister for miscarriages of justice, my hon. Friend the Member for Cheltenham (Alex Chalk), to see how Government can help to support the CCRC in these unique circumstances and ensure that the Post Office and its management stay well out of these decisions.
As well as encouraging the Minister to see whether there is a way to overturn these wrongful convictions, does the hon. Lady agree that he should see if there is a way that people such as my constituent, who suffered losses of more than £100,000 and was forced to sell his business, are rightfully compensated? When I heard the size of the award, I was so pleased for all my constituents, but the majority of it seems to have gone on legal fees. My constituent tells me that he will receive hardly any of the £100,000 he lost, not to mention compensation. Does the hon. Lady think that the Government should seek to ensure that the majority of the award goes to the victims?
The hon. Lady makes an important point. It is unbelievable that the announcement was made by the Post Office on 11 December, when we all know what we were doing on 12 December. It was supposed to be part of a confidentiality agreement, and the Post Office announced that £57 million was to be paid to sub-postmasters when that was of course not the case. That is further evidence of the way in which the Post Office has conducted itself throughout the process. It is not acceptable to mislead in that way. The judge said almost the same thing regarding some of the evidence that was put before him. I therefore fully agree that that was a shameful part of this saga, although the whole saga is deeply shameful.
I invite the Minister to consider the many very real conflicts of interest. I will not outline them all, but I will put on record that his Department owns the equity in the Post Office, provides up to £1 billion in debt funding, approves the board, monitors performance, and provides annual grants. Last year’s grant was £50 million. I will say no more on that, but I will give him a list of the conflicts of interest, which also include personnel, at a later date. In a modern business environment, we need to be alert to the fact that such conflicts do not prevent justice from being done.
I am encouraged by discussions with Ministers and across parties. There is a clear will in Parliament to move forward and see justice done. Whatever obstacles the Post Office continues to put in the way, I hope it senses the appetite in Parliament and hears the voice of the judge in this case. The Post Office needs to stop putting obstacles in the way of justice; it is doing the organisation no favours whatever.
I am sure the Minister will agree that the Post Office has had the opportunity to be part of the solution over and over again, and that that time has passed. Given all its actions throughout, including the mediation process back in 2015 that it simply cancelled—it did not like what the forensic accountants were saying, and it fired them—the Post Office has had its opportunity to be part of the solution. Its behaviour in the litigation suggests that it has no interest whatever in finding a solution for postmasters; its interests lie in preserving the institution no matter what.
I hope we can all ensure that the Post Office does not stand in the way of the work of the CCRC or the Court of Appeal. I put on record my thanks to the campaign group, which has done amazing work against the odds, and to the Chairman of Ways and Means, who allowed this debate. I know that many others wanted to be granted a debate on this subject, and I am grateful that I was given the opportunity. It is we, in this place, who must now find a solution to this grotesque injustice—a miscarriage of justice of immense proportions—and we must do so whatever the obstacles, come what may.

I congratulate my hon. Friend the Member for Telford (Lucy Allan) on securing this important debate about the Criminal Cases Review Commission’s review of the convictions. As we heard, there has been a lot of human cost to what has happened over the past few years, and as the new Post Office Minister, I will dedicate my time to ensuring that we can see this through, keeping the Post Office on its toes, so that we come to a proper conclusion that means something to the postmasters who have suffered in the past. We also want to give confidence to the postmasters of the future about their ability to work in the network.
I am responding to the debate, rather than a Justice Minister, because, as I suspected, the debate has widened beyond the CCRC part of the situation. I hope to respond more fully to those wider points.
The hon. Member for Gower (Tonia Antoniazzi) asked what hope we can give to the victims about timescales. That will obviously depend on the complexity of each case so, yes, although we want to get this dealt with as soon as possible—it has without doubt been going on a long time—just having a tick-box approach would not be fair on those postmasters or give the answers that we need to move forward.
Does the Minister agree that the convictions should be treated as a group? They should be overturned as a group, with a common theme, rather than individually, case by case, which would make it a much longer process.
I will come back to my hon. Friend’s point in a little more detail, but the way in which our legal system works means that, at the moment, we cannot do that. The CCRC can analyse the cases that come before it as a group, and it still needs to do a lot of forensic accounting, but the Court of Appeal can only deal with each case individually. The legal structures that we have at the moment prevent just one single hearing with a view to taking on board all the people who have gone through this process.
I thank everyone who has participated in the debate. I am truly grateful for the level of support and passion that we have heard across the House and across the country. We have to recognise that this was a unique set of circumstances that deserves a unique remedy. There is no point hiding behind the CCRC not having a mechanism; we must give the CCRC a mechanism—we must invent a mechanism to deal with this, because it is so unique. People have suffered, and they will go on suffering if we do not do something about it. I urge the Minister, please reread Justice Fraser’s judgment—

Commons ChamberIt is a pleasure to see you in the Chair, Mr Deputy Speaker, and I congratulate the Front-Bench team on bringing forward this measure today. It is a real delight to be standing in this place, welcoming and supporting it with open arms, and there is a very good reason for that.
This issue has affected my constituents very deeply. They have had to live with the consequences of the early release of a serious sexual offender just five years after he received a 22-year sentence for his role as a ringleader in a Telford child grooming case. He was convicted of controlling child sexual exploitation and trafficking for the purposes of child sexual exploitation, and the victims were as young as 13. This was organised child rape with a profit motive.
The impact on the victims and their families and our wider community was such that I began to campaign assiduously for the very measure before us today. I approached many Ministers in the course of this campaign and I do not have time to pay tribute and give thanks to all of them today, but I would like to say that my right hon. and learned Friend the Lord Chancellor and Secretary of State for Justice and of course the Prime Minister have done a fantastic job in leading the way on this issue; as the Minister rightly said, they have done so very early in this Parliament, having promised that they would. It is a proud moment to be standing here to welcome this legislation.
In December 2012, an eight-week trial led to a grooming gang-leader being handed down a sentence of 22 years, of which 14 were to be served in custody and eight on licence. The victims had been put through the ordeal of an adversarial court case and had been rigorously cross-examined on their testimony and character, and they felt that it was a price worth paying to know that justice had been done. The community was able to breathe a sigh of relief, and victims and survivors and their families set about the process of rebuilding their lives. In this case, however, without it even being considered by the Parole Board, the offender was eligible for automatic early release just five years after the case had been sentenced. It was because the 14 years in custody was cut in half to seven years and he had already been two years on remand pre-trial. The reaction locally was one of shock and disbelief. There was a sense that the system had once again failed those who needed it most. The victims felt that their experience had been trivialised and demeaned, and the community felt afraid that the offender would return to Telford and still be a risk to the public.
No one in Telford could understand how this had happened and I had no answer to give them. How could victims of serial child rape begin to rebuild their lives if the system failed to recognise the seriousness of the offences committed against them? Yes, there was anger, but the overriding sentiment was: “The people in charge don’t care about us. We’re nothing. If the system doesn’t work for people like us, what is the point of having a system at all?” It made a mockery of justice. There was absolutely no confidence in a system that could trivialise such serious crimes.
What was particularly troubling in this case was the concept that the offender who had committed such crimes was going to be released on licence, and that we should simply expect that he would adhere to his licence conditions and therefore custody was not necessary. He did not adhere to his licence conditions and, fortunately for my community, he is now back in prison for a serious breach of those conditions—indeed, so serious that he is now serving all 22 years of the original sentence.
It is absolutely right that the Government have taken such prompt action on this issue. I thank all those involved in prioritising it. It was in the manifesto and it was in the Queen’s Speech. My constituents are deeply grateful, as I am. It restores trust and confidence in our justice system, and sends the right message to victims of sexual violence.
