Commons ChamberThe hon. Gentleman may not be aware that the political editor of The Sun has just tweeted that the Government have conceded on the 9 December election date. If that is the case, does he agree that we should just get on with the vote?
The editor of The Sun has not contacted me personally, so I was not aware of that, but I am grateful to the hon. Gentleman for enlightening not just me but the whole Chamber.

Commons ChamberIt has been obvious to me for some considerable time that Brexiteer politicians have never fully understood the consequences of their policies. That is why during the referendum they were able to claim that they wanted to end free movement while staying in the single market; why they said that leaving the customs union was compatible with the Good Friday agreement; why they claimed the new free trade agreement with the EU would be the easiest in history; and how the British state would be able to sign trade deals around the world based on divergence from EU tariffs and regulations while maintaining frictionless access to the European economic area. The Bill clearly shows that all of those claims are completely false.
Because of the obsession of the British Government and the Labour Opposition with ending free movement, the British state will have to leave the single market. The new FTA with the EU will not be negotiated until after the British state has left the European Union, meaning that this continues to be a blind Brexit.
Compatibility with the Good Friday agreement has only been vaguely achieved by effectively keeping Northern Ireland in the customs union and the single market, ending the economic coherence of the British state. Far from removing the backstop, as claimed by the British Government and the Prime Minister, it is now enacted as policy in the withdrawal agreement for Northern Ireland—a frontstop, as some have called it. In my country, people are asking, “If it’s good enough for Northern Ireland, why isn’t it good enough for Wales?”
We now know that it would be impossible to sign trade deals with the likes of the United States without drastically reducing our access to the European market. Writing last week in the Evening Standard, the right hon. Member for South West Hertfordshire (Mr Gauke), the former Chief Secretary to the Treasury, said that assessments indicated that for every £1 gained from international trade agreements, £33 would be lost through loss of access to European markets owing to the need to diverge on standards and the extra costs of tariffs.
“Get Brexit Done” is the latest slogan that we have heard ad nauseam from the British Government, but allowing the Bill to move to the next stages would not mean an end to Brexit. It would not even be the beginning of the end; it would simply be the end of the beginning as we enter phase 2 and start discussions on the trade agreements. The British Government will be negotiating one of the most complex trade deals in history, different from all others in history as it will seek to build barriers rather than break them down. They hope to do that in just over a year. As has been mentioned many times, the EU’s free trade agreements with South Korea, Canada, Singapore, Japan and Vietnam have taken between six and eight years to negotiate, with some of them still awaiting ratification.
The hon. Gentleman is right to draw attention to the EU free trade agreements. We have probably got the best in the world. Any free trade agreements the UK has, say with the United States, will be only about a fortieth of what we will lose with the European Union. In total, from the 6% to 8% we lose with the European Union, a free trade agreement with every country in the world will only make up about 1.4% of GDP—a huge loss.
The Chair of the International Trade Committee speaks with great experience. That is, of course, why the British Government are refusing to publish the impact assessments on the deal.
The British Government will be negotiating the new FTA from a position of extreme weakness. We all know that at the end of the transition we will face the exact same situation as we currently face—further delays and extensions or a no-deal cliff edge.
My party will base our approach to the next stages of the Bill on some key areas. First, we will demand impact assessments on the withdrawal agreement in time for consideration and scrutiny. Secondly, we will seek membership of the customs union—not a customs union—with the European Union. A customs union would mean that the UK would have to open up its markets to any trade deals the EU makes, while not having reciprocal access to those other markets. Thirdly, we will be calling for the UK to remain in the single market. Fourthly, the Bill as it currently stands denies the voice of our democratically elected Parliament in Wales, y Senedd.
If this Government respected the principle and legitimacy of devolution, they would require any future free trade deal struck by the British Government with the European Union to have the consent not only of this House but of the Senedd, the Scottish Parliament and the Northern Ireland Assembly. As the Bill currently stands, the Parliament of Wallonia, a constituent part of Belgium, would have more influence over the future trading relationships between the British state and the European Union. That is simply not good enough.

As the right hon. and learned Gentleman knows, the British Government are planning a £100 million propaganda campaign to sell the virtues of a no-deal Brexit. Could they not save a lot of taxpayers’ money by agreeing to the terms of this motion, which will see the documents published on Wednesday?

Commons ChamberAbsolutely. I will meet the hon. Lady and work with her to co-ordinate our response. I recognise the priority she has placed on this operation for some time and she highlighted some of the risks and concerns she had some time ago. Yesterday, I spoke to Roy Rickhuss from Community union. I have, naturally, also spoken to Tata. We are working with the Department for Business, Energy and Industrial Strategy in terms of challenging the issues that Tata is raising to seek to bring it to the most competitive position possible.
With reports that the British Government are stockpiling body bags as part of their no-deal Brexit preparations, what assessment has the Secretary of State undertaken of the amount of Welsh people who may die as a result of medical shortages for a no-deal Brexit?
The hon. Gentleman, by supporting the motion last night and the Bill this evening, is simply prolonging the uncertainty. The Welsh people and the British people want certainty about our exit from the European Union. We are determined to leave at the end of October. We would like to leave with a deal—that will give us the smoothest possible exit—but at least we can plan for the opportunities the future brings. [Interruption.]

If we are really serious about dealing with the huge geographical wealth inequalities within the British state, surely we should debate moving this Parliament outside London and the south-east.

Commons ChamberI praise West Mercia police for their work to help tackle cross-border crime, particularly around county lines. The Government will always look to provide the powers and resources that the police need to tackle that, but it is also vital that we have joined-up working. It is also right that, as was touched on in the comments, we look to tackle the kingpins of those organisations, not just the street dealers, who we can see most easily.
If Welsh policing was devolved as is the case in Scotland and Northern Ireland, there would be a £20 million windfall for Welsh policing. Does it not show how bad the England and Wales grant system is that we were better off under the Barnett formula? Is it not time that the British Government dropped their ideological obsession against devolving policing to Wales?
I do not recognise the figures that have just been used. As we touched on in answers to two previous questions, crime does not stop at political boundaries. Criminal gangs in the north-west of England target victims in north Wales as much as victims within England. The real political obsession is that of Plaid, which wants to determine things on political boundaries, not on how communities and criminals work.

Friend will know, having heard my remarks about what I think a Labour Government would do to the economy, that I do not think the Labour party should be in government. It is the Conservatives who are delivering for people. The Leader of the Opposition and I have different opinions on a number of issues, and I will highlight just one. When this country suffered a chemical weapons attack on the streets of Salisbury, it was this Government, with me as Prime Minister, who stood up to the perpetrators. The right hon. Gentleman said that he preferred to believe Vladimir Putin than our own security agencies. That is not the position of someone who should be Prime Minister.
The hon. Gentleman should look at the funding that has been made available to Wales by this Westminster Government. He talks about the Government of Wales. There are indeed issues there that I think we should be focusing on, such as the national health service in Wales under a Labour Government. [Interruption.] Yes, Members may well point. That is what we see when Labour is in office: a national health service that has not met its A&E target for over a decade.

Commons ChamberBut paragraph 12 explains why, because it describes a scenario in which the United Kingdom had not participated in European Parliament elections and did not have any duly elected MEPs. In that case, we believe from all the feedback that we have had from the European Union that a second extension is not considered to be viable, because without UK MEPs being present from the date at which the newly constituted European Parliament met—namely, in a plenary on 2 July —the European Parliament would be improperly constituted. It is for that reason that we do not see any willingness, or, indeed, any legal power under the treaties, for the European Union to agree to a second extension if we were in those circumstances at that date.
Further to the intervention of the hon. Member for Dover (Charlie Elphicke), will the Minister confirm that the Electoral Commission, which I believe comes under his responsibilities, is contacting returning officers to tell them to advance their preparations to hold European Parliament elections?
The hon. Gentleman asks a perfectly fair question, but he will also know that the Electoral Commission is a statutorily independent body—it does not fall under ministerial direction, but reports to a Committee chaired by Mr Speaker—so it is for the commission to say what, if anything, it has been doing.
Before I explain my party’s position, I would like to add my voice to those who have been calling for the House of Commons to have a full portfolio of votes on the various options. On 15 January, I wrote an article for The Huffington Post making the case for using a voting system designed to create a majority. I was delighted to see the Father of the House bring forward an amendment to that effect a few weeks ago. I hope that if amendment (i) passes this evening, that will be looked at in all seriousness.
The key question that will face us after this evening if we support an extension to article 50 will be this: for what purpose? Without finding a purpose for the extension, we still face the prospect of no deal by default. The publication of the Government’s tariff proposals gave us a good idea of what that would mean. It would be a disaster for Welsh agriculture, in particular, because if we set very high import tariffs, that would be reciprocated in terms of exports. Half of all Welsh lamb goes to the European Union, and that sector would be decimated. In keeping an open border between the Republic of Ireland and the north of Ireland, the British Government signalled their intention to sink the ports of my country.
Our amendment (a) would extend article 50 to cover phase 2 of the Brexit process. That would help to deal with the backstop. Although I do not share the concerns of hon. Members in relation to the backstop, that issue would be dealt with by our suggestion. It would deal with the problems of a blind Brexit. It would deal with the problem of no deal. It would encourage a more sensible approach to other trade negotiations. There is something for everybody in our suggestion, apart from those who seem obsessed with leaving on 29 March.
I look forward to voting for amendment (h). I say to Labour colleagues that the right moment does not always come in politics—there is only the moment, and the moment is now.

Commons ChamberThe arbitration panel and the arbitration process will exist to judge whether the parties have delivered on their legally binding obligations under the withdrawal agreement, which will have the status of a treaty in international law.
Is it not the case that, despite this statement, the major problem for many of us is that supporting the British Government’s Brexit policy tomorrow would mean leaving the EU without any detail on the future relationship—a blind Brexit, which would be completely irresponsible?
I would dissent from that. The Government made it very clear in the White Paper published last summer what their objectives in that negotiation would be. The political declaration shows the extent to which there are shared objectives for that deep and special partnership. As the political declaration says, there is a spectrum, and this House and the Government have to choose the degree of alignment that we prefer. There will be opportunities in the withdrawal implementation Bill and subsequent legislation for Parliament to express its views. Of course, if, as I hope, we agree on a new partnership treaty with the European Union 27, it would be an international treaty that would have to go through ratification processes, including consideration by this House in the normal way.

Commons ChamberIf we were in a position where we wanted to extend article 50, it would be necessary to get the agreement of the European Union to do that. Time and again, I am asked to listen to the views of this Parliament. What I have set out in my statement is that if we were in that circumstance, a motion would be brought forward and it would be for this House to decide whether it wished to ask for an extension to article 50, and that decision would then be taken to the European Union.
I must admit to being somewhat confused following the statement, so can the Prime Minister confirm that when we vote against the deal on 12 March, as we undoubtedly will, it leads to a vote on no deal on 13 March, and that when we vote against no deal again on 13 March it leads to a vote on extending article 50 on 14 March and, if we vote for extending article 50 on 14 March, that leads to no deal coming back on the table for the duration of the extended negotiations? Is this not the political equivalent of swimming round in circles?
I refer the hon. Gentleman to the timetable I set out in my statement. I am working to bring back a deal that this House is able to agree.
