A few weeks ago I met Travis Frain, a founder member of Survivors Against Terror, who explained how his life had been changed forever by the Westminster bridge terrorist attack and how he did not get the support he needed in the aftermath. This week, a survey of 130 survivors of 11 major terrorist incidents found that more than two thirds felt that the compensation scheme overseen by the Criminal Injuries Compensation Authority was unfair and unreasonable. The Home Secretary talked about a review. It is unacceptable that these people are in that position at the moment. When will the review actually be published?

As I mentioned, there are no words and there is no amount of money that can adequately reflect the pain and suffering experienced by victims of terrorism. That is why it is absolutely right that we provide victims of terrorism with full compensation and the fullest support possible and available to enable them to move forward from these tragic events. As I said, we know that more must be done. That is why we are reviewing the support available. We need to better address victims’ needs through the current schemes and ensure that they are properly meeting the needs of victims.

I suspect the Bill will end up being completely ineffective. Possibly, nobody will ever be removed to Rwanda—I hope that is the case. I would rather we stopped it here and now, and at least passed amendment 1B. That would give those whose duty it is to protect people’s rights a recognition of the conventions that we have signed up to and have spread around the world, saying how good we are at signing up to those conventions. Let us stick to our word, and stick to those conventions.

As we did not have the opportunity for pre-legislative scrutiny of the Bill and it is being pushed through Parliament very quickly, I am pleased that the Lords have sent back amendments so that we can look again and consider the unintended consequences of parts of the Bill.

I will speak to the amendments on modern slavery. Evidence presented to the Home Affairs Committee revealed the urgent need to open up more escape routes for trafficking victims, including ending the current industrial-scale sexual exploitation, with women advertised on pimping websites up and down the land, in every Member’s constituency, on websites such as Vivastreet, which allows women to be raped multiple times a day. Under this legislation, if those women come forward to the authorities, they will not be offered help and assistance but will be detained and removed. Removing those modern slavery protections will do nothing towards doing what we all want to happen: to bring the organised crime groups orchestrating that abuse to justice. So I support Lords amendment 56B to maintain the status quo.

Secondly, I am disappointed that the Lords amendments on children have not been accepted. Children constitute a small minority of those making the crossing in small boats, often arriving frightened, frequently traumatised and always vulnerable. Such were the concerns of the Home Affairs Committee about the current treatment and experience of children who claim asylum in the UK that we recommended the Government commission an independent end-to-end review of the asylum system as it applies to and is experienced by children. However, instead of that, the Government are hurrying through a Bill to reduce children’s rights. No one in this House would want such treatment for their own children, which is why I support Lords amendments 33B, 36C and 36B remaining in the Bill.

Thirdly, a year ago the Home Affairs Committee published the results of our inquiry into channel crossings and identified a slew of robust measures that the Government could deploy to stop small boat crossings and create a fair and efficient asylum system. They included the creation of safe and legal routes and international initiatives by the National Crime Agency to combat people smugglers, both of which are the subject of Lords amendments under discussion today.

Stopping the people smuggling gangs will require a raft of carefully crafted, costed and evidence-based strategies, such as the ones put forward by the Home Affairs Committee. It is for that reason that I firmly support Lords amendment 102B on safe and legal routes, Lords amendment 103B on the National Crime Agency, Lords amendments 107B and 107C on a 10-year strategy and Lords amendment 23B on removal destinations for LGBT people and other persons. These measures and the Bill as a whole must be implemented in accordance with our international obligations, as is set out in amendment 1B.

A constituent contacted me recently and said that I seemed to be speaking an awful lot in the Chamber about immigration and asylum issues. I suppose that that is correct, but then that is because the Government allocate so much time in the Chamber to immigration and asylum issues. This is the third major piece of primary legislation on immigration since 2015. However, the majority of constituents—hundreds of constituents—who get in touch with me on each of these pieces of legislation tell me just how disappointed, if not horrified, they are at the Tory UK Government’s attitude to people who come here seeking refuge.

In rejecting all the Lords amendments before us today, the Government are showing just how hostile an environment they want to create—not just for asylum seekers, but for almost anyone who wants to make their home here in the UK. The fact that they will not accept Lords amendment 1B, which is a considerably softer version of what we discussed last week, demonstrates that. If the Government are truly committed to the international conventions listed in the amendment—particularly the 1951 refugee convention—they really should have no problem agreeing that they will form part of the interpretation of the Act when it comes into force.

I have also heard from constituents who want to ensure that LGBTQ people who arrive here from places where they can face imprisonment for simply being who they are cannot be removed to those countries. That is what the Lords are seeking to achieve in Lords amendment 23B. Accepting that amendment would save time and public money because otherwise, by the Minister’s own admission, claimants would have to make suspensive claims against removal to their country of origin. That is what the Minister says he wants to avoid. He wants to avoid loopholes and needless court cases. In that case, he should support Lords amendment 23B.

The amendments that seek to protect children from indefinite detention and that maintain human trafficking protections speak for themselves, as does the Government’s insistence on rejecting those amendments. The Government keep asking those of us who are opposed to the Bill for alternative proposals for dealing with irregular arrivals, and these are clearly outlined in Lords amendment 102B and in the Lord Archbishop of Canterbury’s amendments 107B and 107C. The Minister keeps saying that he wants to establish safe and legal routes. Well, that is what Lords amendment 102B will require him to do. I have met many asylum seekers through the Maryhill Integration Network and elsewhere who would much prefer to have come here from Eritrea, Iran or other countries that have been mentioned today through a safe and legal route, rather than the risks, costs and desperation of coming on lorries and boats.

The archbishop’s proposals for the development of a strategy on refugees and human trafficking are perhaps the most straightforward and easily implementable of all the clauses and amendments so far. The Government regularly accept amendments requiring them to publish strategies and reviews on all kinds of legislation. Perhaps they do not want to support this one because the transparency and accountability that would come with requiring the Government to undertake a long-term analysis and make a long-term plan in response to global population flows would reveal the true hollowness of the rest of their proposals—the inhumanity and the self-defeating implications of the hostile environment.

Millions of people will be on the move in the coming years and decades. They will be fleeing wars that we have financed and climate change that we have helped to cause. Experiences in southern Europe and the American midwest this week suggests that they will not just be moving from the southern hemisphere either. Nobody is saying that the United Kingdom should have completely open borders and take unlimited numbers of migrants, but we have to be prepared to take our fair share, just as other countries welcomed refugees fleeing famine and clearances on these islands not that many generations ago.

If Government Ministers and Back Benchers truly respect the role that the House of Lords is supposed to play in the UK constitution, they really ought to listen to the messages that their lordships are sending today and will send in the days to come. As it stands, people in Glasgow North and across Scotland are listening to the rhetoric of the Conservative Government and deciding that they want no more of it. They will be seeking the safe and legal route to independence as soon as possible.

I want to start by agreeing with the Minister about the vital role that the other place plays as a revising Chamber in asking us to look again, particularly when we have not had pre-legislative scrutiny of a draft Bill and when, as I think most Members would agree, this legislation has been rushed through Parliament. I echo the comments of the hon. Member for East Worthing and Shoreham (Tim Loughton) about how complicated the Bill has got and the fact that we have not had much time to consider the amendments tabled by the Government late last night.

I also want to say at the outset that, in our report on small boats last year, the Home Affairs Committee made it very clear that it was not the number of people coming across in small boats that has overwhelmed the asylum system but the failure to process the asylum applications that have been made over a number of years. The Home Office has allowed the backlog to grow—it is now over 170,000—which has the effect of gumming up the system, and that is why we are spending £7 million a day on hotels. I know that the Home Office has in train plans to deal with the backlog, and the Prime Minister has said that the legacy backlog will be cleared by the end of the year. We all want to see that happen; it is in no one’s interest to see that backlog grow even more.

The right hon. Lady is right about processing being a key part of dealing with the backlog, but Lords amendments 7, 90 and 93 would allow for further legal challenges, create more delays and, in her words, gum up the system to an even greater degree than it is now. Surely she does not support that attempt to undermine the principles of the Bill and add to the very problem that she is articulating.

What I want, and what the Home Affairs Committee has been very clear about, is an efficient, speedy asylum claim process that is fair but timely. Germany, for example, has far more asylum claimants than we have and manages to process its claims within seven months. Many of the people who claim asylum in this country are waiting for years. That is why we have got ourselves into the problem that we are trying to address through the Bill.

I wonder whether the right hon. Lady can explain how doing nothing about thousands of undocumented people landing on our shores week in, week out will help speed up the Home Office system.

I say to the hon. Member with the greatest respect that he might want to look at the Home Affairs Committee report on small boats, published last summer, in which we made a number of key recommendations for how the Government could start to address the small boat problem, one of which was, as I started off by saying, addressing the backlog. We know that people can come to this country, disappear and feel that their claims will not be heard for years. That is not in anyone’s interest. If he takes the time to read the report, he might get some idea of the recommendations that we have put forward cross-party, including a pilot to allow processing in France, to stop people making that perilous journey across the channel.

I turn to the Lords amendments. First, I want to deal with the removal of retrospective application under Lord Carlile’s amendment. I am really glad to see that the Government have agreed to remove the retrospective element of the Bill, with Royal Assent as the start date, which means that there will not be an immediate backlog of people waiting to be deported. However, this could provide a false sense of security about the Bill’s implications.

It seems to me that when the Bill becomes an Act, a new backlog will be quickly growing, with thousands of people detained if we see the same numbers coming across in small boats that we have seen in the last few weeks and months, and we have no third country to send them to. With the Court of Appeal judgment now being appealed in the Supreme Court, we do not know whether the Rwanda plan will be lawful. So far this year, over 12,500 people have made that dangerous channel crossing to the UK. There may well be hundreds more arriving each month once the Bill is enacted, and I am concerned about what happens to them.

I associate myself with the words of the Chair of the Women and Equalities Committee, the right hon. Member for Romsey and Southampton North (Caroline Nokes). I agree with everything that she just said. More than a year ago, the Home Affairs Committee recommended that all police forces should establish specialist rape investigation teams. We know that they produce better decision making, can address delays and improve communication with victims and the CPS.

We also urged the Government to collect and publish data on the number of police officers in each force with specialist rape and serious sexual offence training. Can the Minister explain why specialist rape investigation teams are still not in place in every police force and what she will do about that? Can she confirm how many serving police officers, as of today, have received specialist training on rape and serious sexual assault? What proportion of the 20,000 new recruits will also receive that specialist training?

I thank the right hon. Lady for her incisive questions. I suggest that the issue is about specialism, rather than specialist units. All police forces have different operational ways of working. She will recall the evidence of Sarah Crew, who said that there is no quick fix for each particular force. She said that every force must look closely at the way they are operating. However, specialism of training is key. The National Police Chiefs’ Council is very firmly looking at what will be rolled out. The modules in relation to domestic abuse and to rape and serious sexual offences are being updated. The right hon. Lady is quite right to point to training, as that is important. She mentions data, which is also very important. We are improving and collecting more data—far more than has been collected previously, as far as I am advised. I am optimistic that we are working together. Her Committee plays a vital role in assisting the experts and informing the way that they work.

In the chief inspector of borders and immigration’s latest report on the Home Office system to remove foreign national offenders, he said

“the Home Office does not have a firm grip on its caseworking operations”,

and

“This is no way to run a government department.”

He also said

“I found the Home Office’s inability to provide reliable or consistent data and management information of particular concern.”

Given that, will the Minister explain how the Department will cope with the increase in casework, detention and removals planned under the Illegal Immigration (Offences) Bill?

We take that report, as we do all others, very seriously. The right hon. Lady is right to say that there are lessons to be learned. However, returns are increasing as a result of deals such as the one we have done with Albania, as a result of reforms such as those we have made to the national referral mechanism and as a result of the 50% increase in illegal working visits that we have secured this year alone.

Two weeks ago, when the Home Secretary gave evidence at the Home Affairs Committee, I asked her when the impact assessment for the Illegal Migration Bill would be published. While I welcome the fact that it has been published today, or last night, it is after the Bill has completed all its stages in the House of Commons and is three quarters of the way through the House of Lords. That is wholly unsatisfactory for Parliament to undertake its role of scrutinising Government legislation. At that Select Committee sitting, the Home Secretary also said:

However, I would also say that to my mind it is pretty obvious what the economic impact of the Bill will be. We will stop spending £3 billion a year on our asylum cost. It is a Bill that will lead to the cessation of 45,000 people in hotels and £6 million a day. To my mind, those are savings that we cannot ignore.”

The Home Secretary told the Home Affairs Committee that those savings would happen. Can the Minister help me by pointing to where those savings are in the impact assessment? I am struggling to find those figures in the document that the Government have produced.

The document makes it abundantly clear that, were costs to continue to rise on the current trajectory—we are in an age of mass migration and the numbers of individuals looking to cross, for example from north Africa to Europe, are extremely high so there is reason to believe that numbers will remain high for a sustained period—by 2026, which is just a few years away, the system would be costing an additional £11 billion. We cannot countenance such waste of taxpayers’ money. As we have seen in other parts of the world such as Australia, where systems of this kind have been implemented, by delivering this system and ensuring a genuine deterrent effect, we will ensure that we save the taxpayer that money. But, more important than merely saving money, we will save the British public the stress and the strain on public services, housing, integration and community cohesion that tens of thousands of illegal migrants bring to our country. That is a prize worth fighting for, and that is why we are delivering this Bill.

In 2021, the Home Affairs Committee inquiry into how much progress had been made in tackling racism in policing since the landmark Stephen Lawrence inquiry found, as a cross-party Committee, that the disproportionate use of stop-and-search powers against black people was even greater than it had been when Sir William’s inquiry concluded 22 years earlier. No evidence provided to the Committee adequately explained or justified the nature and scale of racial disproportionality in the use of stop-and-search powers. That has damaged confidence in the tactic and in policing by consent.

Of course, stop and search is a valid policing tactic, as the Home Secretary said, but it must be used in a focused and fair way, and underpinned by an evidence base. Can she explain what evidence base she is drawing on when she says that police forces need to “ramp up” the use of stop-and-search powers? Will she commit to commissioning a fully independent and comprehensive study of the efficacy of stop-and-search tactics, and to undertaking an equality impact assessment on this new policy?

As I mentioned in my statement, the Department is trialling a more sophisticated approach to calculating disparity, with a focus on the Metropolitan Police Service. That has produced a useful analysis based on actual suspects of violent crime, rather than the totality of usual residents of an area, as a denominator for calculating the rates of stop and search. It is experimental, but the data emerging from that advanced study demonstrates that disparity ratios are significantly reduced for black people compared with the traditional method, falling from 3.7 to 1.2. That is an emerging evidence base upon which policy will be made.

I also extend my thoughts and prayers to all those who were killed and injured, and their families and friends. Of course, we all recognise the vital role of the emergency services in dealing with these very fast-moving incidents. Can the Home Secretary say whether she has identified any additional support that Nottinghamshire police need at this time?

The right hon. Gentleman raises an important point. The Government’s job is to provide sufficient, lawful and proportionate powers for the police to exercise. They have operational independence, and they need to make decisions and judgments based on the particular circumstances. Our job is to give them the powers to enable them to take the fullest and most lawful approach.

Have the police specifically requested these new powers? The deputy assistant commissioner of the Metropolitan police, Ade Adelekan, has said about recent slow-march protests

“once a protest is deemed to have caused serious disruption or may do so, we are taking swift action to stop it.”

Does the Home Secretary disagree with what he is saying, that the police already have the powers they need?

I add my thanks to those involved in the arrangements for the coronation and keeping the public safe. However, the Home Affairs Committee will no doubt want to look at the policing of protests at the coronation and, in particular, the specific provisions in the Public Order Act 2023, brought in just last week and used to arrest members of Republic.

We have heard a lot about the operational independence of the police this afternoon. Will the Minister explain why on 27 April the Home Office’s police powers unit sent an official letter to Republic, ahead of the coronation? Republic has no history of its members locking on. How many other organisations and groups received such letters? On what basis were they sent those letters? Will that practice now be the norm for the Home Office?

I do not believe that any such letters were sent in my name, so I cannot comment on who may have received them. I suspect, although I am not certain, that those letters related to clarifying the new statutory provisions that were recently brought into effect through the Public Order Act 2023. The operational independence of the police is important, because Parliament legislates and it is then for the police to apply those laws without fear or favour, and they did so on this occasion.
