Commons ChamberMy hon. Friend has worked really hard to promote opportunities for employers in his constituency to employ people with disabilities. I welcome the fact that, over the past five years, this Government have seen an extra 930,000 more disabled people in work and that, for the first time ever, there are now more disabled people in work than not in work. The key is to give businesses the confidence to realise that they can benefit, and that this is a win-win for the disabled person and for the business.
My concern relates to the number of people who are dying after being found fit for work. Further to my letter to the Secretary of State, will she commit to publish the Department’s internal reviews of the cases of those who have died? Will she also commit to an independent inquiry? Will she ensure that if any evidence of wrongdoing by someone in public office is found, that information will be forwarded to the police?
This Government are committed to working with stakeholders and those with frontline experience to continue to make improvements. There have been two independent reviews of the work capability assessment, and we have accepted and implemented over 100 improvements. We will continue to do all that we can to improve the process for claimants.
I am happy to discuss any issues around Verify with the hon. Gentleman, but, as he will know, there is more than one way for someone to verify their identity. Of course, they can use gov.uk Verify, but they can also use documentary evidence or a biographical test. Those are known, recognised tests, and they are all available in the system.
The Secretary of State just said that universal credit is better than the legacy system, yet evidence published this weekend shows that twice as many children will be pushed into poverty by universal credit, the two-child limit and the benefit cap. On top of that, universal credit is actually increasing infant mortality—the first time we have seen an increase in 100—
I am sorry, but there is irrefutable evidence on this. Instead of the cursory responses that we have had from the Government, will the Secretary of State commit to review the up-to-date evidence and get back to this House with some detailed explanations of how she is going to stop these things?
I totally reject the hon. Lady’s approach to this. Universal credit is a welfare benefit system that, overall, is more generous and much more straightforward than the previous system. I wonder whether she has talked to any Members of Parliament who had the experience of having to navigate the six legacy benefits, of three different places to go to, and of annual tax credits. The complications were totally out of proportion compared with the challenges that people sometimes encounter now. Above all, there was the difficulty people had with the 16-hour threshold, where they could not take up new work if they were on a certain amount of benefits. We have reformed the system so that it works for people—it works for families, and it works for people trying to better themselves and get better access to work.

It is a pleasure to serve under your chairmanship, Sir Henry. I reiterate the congratulations to my hon. Friend the Member for North West Durham (Laura Pidcock) on an excellent speech, outlining some of the range of problems that we have with this work capability assessment process.
This feels like déjà vu: we are here, yet again, to argue that the current system of work capability assessment is not fit for purpose. We can use the latest available data that tells us that nearly three out of every four claimants who appeal their assessment decision telling them that they are fit for work will have the decision overturned. We can reference the five reviews of work capability assessment over the past 10 years, which have repeatedly raised problems with the assessment process, ranging from medical reports being mislaid to blatant lies in assessment reports. We can look at the Work and Pensions Committee’s report from last year on ESA and PIP assessments, which saw an unprecedented 3,500 individuals share their experience and what they had been through, as my hon. Friend described.
We can discuss the death rates for people on ESA and, before that, on incapacity benefit. In 2013 that death rate was 4.3 times that of the general population, increasing from 3.6 times in 2003. That shows the level of sickness and ill health of people in this group. As has already been said, this is a poorly group of people who deserve to be listened to and respected. We can talk about the peer-reviewed research that estimated that between 2010 and 2013, work capability assessment was independently associated with an additional 590 suicides, 280,000 cases of self-reported ill health and 725,000 additional anti- depressant scripts.
However, anyone watching this debate will be thinking, “What on earth is the point?”, because to date the Government have taken not a jot of notice. Little has changed. We know how this is affecting people, as we have already heard: people living in fear and dread of the envelope dropping on their doormat, inviting them for their work capability assessment.
The Government have said they want to amalgamate the work capability assessment and PIP assessments by 2021. They say they want a more personalised approach and will involve disabled people in this process. I ask the Minister which disabled people’s organisations have been involved in the decisions. I appreciate that charities may have been involved, and it is important that they be involved, but what DPOs and disabled people have been involved? Were they involved in the decision to put the contracts for this new assessment process out to tender? That has already happened; we had one week, and then the contract for this new process went out to tender.
What are the Government going to do in the meantime, while this Government-orchestrated harm—it is a Government policy—continues? I am really concerned, and I hope the Minister can respond, because to date there has been little but warm words and platitudes.
As we have heard, on Monday we learned that Stephen Smith, the Liverpool man whose emaciated body was reminiscent of someone found in a concentration camp, not in 21st-century Britain, had died as a result of multiple organ failure after being found fit for work. We know he is not the first. My hon. Friend mentioned Jeff Hayward, who died in 2018 of a heart attack, seven months before a tribunal overturned a decision that he was fit for work.
Also in 2018, Jimmy Ballentine committed suicide after being found fit for work, as did Amy Nice, Kevin Dooley and Brian Bailey. Jodey Whiting, my hon. Friend’s constituent, Elaine Morrall, Daniella Obeng and Brian Sycamore all committed suicide in 2017 as a result of being found fit for work. In July 2017, Mark Scholfield, a terminal cancer patient, received no universal credit before he died, in spite of his illness. Chris Gold, in 2017, was found fit for work following a stroke. He was facing foreclosure when he died as he could not work. Lawrence Bond died in 2017, collapsing and dying on the street after being found fit for work.
Julia Kelly committed suicide in 2015, as did Ben McDonald. Chris Smith, who had terminal cancer, was found fit for work right up until his death. David Clapson died in 2014, as did Michael Connolly. “George, from Chesterfield” died that year as the result of a heart attack, again after being found fit for work. Robert Barlow, another terminal claimant, died after losing his ESA. David Barr, Trevor Drakard, Shaun Pilkington and Terry McGarvey also died in 2014. Lee Robinson, Robert Christian, Jacqueline Harris, Nicholas Peter Barker and David Groves died in 2013.
That is not an exhaustive list, but those names are an indictment of this Government and their policy, and so is the lack of change that has happened as a result of those deaths. There needs to be an independent inquiry, as Jodey Whiting’s mother says, into the deaths of claimants found fit for work. Until then, there should be a moratorium on all reassessments; for new assessments, as has been said, medical evidence should be the primary data used, not the blatantly flawed assessment processes.
Sir Henry, I am sure you agree that any Government’s first duty is to protect their citizens, but our disabled citizens have been spectacularly failed by this Government. Like millions of people across the country, I condemn the attacks in Sri Lanka, and I share concerns about the emergency that is climate change, but the deaths of disabled people as a result of Government policy are nothing less than a scandal. I challenge each and every one of us, in this room and outside, to rise and say to the Government, “Enough is enough!”

I cannot give a broad-brush answer. I know what the hon. Lady is saying and I am coming on to the use of evidence and how we can do more earlier and, potentially, then with paper-based assessments. I will come on to that. I understand, but I cannot give a definitive answer, because every claimant has their own unique challenges that have to be addressed.
In addition, SMS text message reminders about appointments have been welcomed, and there has been a lot of work on the website, which includes mock assessment videos so that people can get an idea of the sort of things to expect. Those things are all looking to remove some of the anxiety and worry about assessments. There is more to be done in that area, but we recognise that.
The improvements in the training and the extra healthcare professionals have meant that median clearance time halved from 25 weeks in March 2015 to 10 weeks in 2018, and customer satisfaction has exceeded the 92% target since that point. However, that does not mean that we are getting it right every time, and that is what I want to turn to now in focusing on MR and appeals.
All of us as Members are frustrated when what seem to be clear-cut cases come to our constituency surgeries asking for our help. There are times when we think, “How on earth can this have happened?”, and ultimately the person could have a very long appeal process to go through to get the right decision. In the majority of cases, appeals are successful because of additional oral and written evidence. That has to be addressed. We rightly are going to tackle it and will do so in two stages—first, with the MR process. We have started doing this with PIP. We are seeking to contact the claimant who is disputing a decision and talk to them directly to get the additional oral and, potentially, written evidence at that stage to see whether we can improve decisions at that point, rather than waiting for the evidence to come at the end of the appeal process.
Does the Minister think that it is unacceptable that any Government policy should cause their citizens to take their own life or to die? If he does, should there not be a moratorium on this policy until it is got right? Surely one death is one too many.

Yes, I do, but we need to solve the root cause of the problem, so that we do not have these high tribunal rates. If we do not have them, we will not have the waiting times. That is the best way to ensure that the system has a low failure rate.
I am very grateful to the hon. Lady for giving way. She is being very generous with her time. Is she as concerned as me about a report in the GP journal Pulse last week that said that the transformation of the new health assessment system could lead to unfettered access to medical records via the GP? We should surely speak up against that. Medical records are personal data; that is an absolute human right.
Yes, although we need to balance that with having enough medical data to make the assessments in the first place. I have not seen that report. I do not know whether the Minister has, and whether she can take that into account in her speech.
I am glad to hear that, following the recent Government announcements, we are moving our benefits system into the 20th century by integrating multiple data sets into one system, although I take the hon. Lady’s point that we must ensure that they are very well protected. That will streamline the assessment process and make submitting a claim much more user-friendly, particularly for people transitioning between benefits. Plans to test a single health assessment for all disability benefits will mean less form-filling, and will reduce face-to-face assessments, cutting red tape and the inconvenience it causes. My constituents who need support often have highly complex needs, so I hope the changes will save them time and stress. It is important that we listen to our constituents and put them in the driving seat of reforms. I hope the Department will do that.
An issue that has been highlighted to me is people’s reluctance to attend assessments. We must do more to ensure people feel comfortable with and trust the process. It is key that we ensure that people know that in every case they are being assessed by a qualified doctor, nurse or healthcare professional—often somebody who works in the NHS—who has undergone additional training to carry out assessments. I did not realise that every single assessment is carried out by a qualified medical assessor. Many members of the public do not realise that. They think it is some third-party company, but often nurses work for those companies. We need to do more to make sure that people are aware of that, so they feel more comfort and trust.

Commons ChamberTo ask the Secretary of State for Work and Pensions if she will make a statement on the changes that her Department intends to make to social security and employment support, including the assessment process, for disabled people and people with health conditions.
Yesterday the Secretary of State provided the House with a written statement, and delivered a speech to Scope that included, among other announcements, an announcement about changes in the delivery of health and disability benefits.
We are making significant progress in improving people’s experiences of claiming disability benefits by working through the recommendations made by several independent reviews of personal independence payments and the employment support allowance, but we need to continue to make improvements in order to give better support to people with health conditions and disabilities. The written statement set out a number of additional measures that we will implement to make improvements, now and in the future, in support for disabled people and those with health conditions.
We will improve and simplify people’s experiences by no longer undertaking regular reviews of PIP awards for claimants at or above the state pension age unless they tell us that their needs have changed. We will also transform the delivery of assessment services. We have established a health transformation programme to undertake the significant task of combining the currently separate work capability assessment for ESA and universal credit and PIP assessment services in one unified, integrated service from 2021. We are extending the contract for the health and disability assessment service, which includes the delivery of the work capability assessment, and aligning it with the duration of the extended PIP contracts. That will allow for a safe and stable service now, and as we make the transition to the new integrated service.
The Department for Work and Pensions will also be testing how we can increase engagement and build a trusted and strong relationship between work coaches and people who are awaiting assessments for universal credit or who are found to have limited capability for work. The Minister for Employment will take that forward.
The health transformation programme will be co-designed with disabled people. The Secretary of State and I will engage regularly with disabled people, disabled people’s organisations and charities. All of us, whatever our age or need, want an equal chance to live a life of opportunity and fulfilment. We intend to support disabled people during all the phases of their lives, so that the pursuit of equality is a shared goal.
Thank you for granting the urgent question, Mr Speaker. I thank the Minister for her response. I am, however, disappointed that the Secretary of State was not here to respond, and that the Minister has had to respond to an urgent question rather than making an oral statement, given the extensive scope of the proposals.
I welcome yesterday’s announcement that there would be no PIP reassessment for disabled people above the state pension age, but why are not all disabled people—particularly those with progressive conditions such as motor neurone disease, multiple sclerosis and cancer—being exempted from repeat assessments? I have a constituent with terminal secondary breast cancer which has gone into her bones, and she has been refused PIP.
The launch of a transformation programme whereby PIP and WCA assessments will be integrated by 2021 is interesting, given that the Government have previously said that that could not be done. How exactly will the two assessments be merged? Who is involved? I am grateful that the Minister has said they will be co-designed with disabled people, but will she commit to supporting the principle of “nothing about you without you”? Will there be a pilot? If so, where and when, and what would be the sample size? Will there be an independent evaluation?
Who will provide the new service? There are real concerns about the profiteering enabled by this Government at the expense of disabled people. There are also worrying reports in various GP journals this week that the medical records of claimants will be made available to the DWP or their social security support will be denied. So I will be grateful if the Minister can confirm that this is not, and will not be, Government policy. Obviously there are huge issues around privacy and ethics.
There is also strong evidence of the physical and emotional harm that these assessments are having on disabled people, over and above their condition. What is being put in place before 2021 to improve the poor quality, validity and reliability of these assessments?
On UC and the role of job coaches in determining limited capability to work, the detail was most unclear in the written ministerial statement. Can the Minister expand on it and confirm that work coaches may start an assessment to determine a claimant’s capacity to work? Can she also confirm a shift in the Government’s approach to sanctions and expand on her Department’s approach to conditionality?
I welcome the review into the inadequacy of social security support for disabled people and more widely. Poverty is a political choice, and 4.2 million disabled people have been pushed into poverty as a result of the £5 billion in cuts since 2010. So what form will this review take and, again, who will be involved?
On the Government’s more ambitious targets to get disabled people into work, again the pendulum is swinging back. The Conservative general election pledge in 2015 was to halve the disability employment gap, but it is actually 4.4% lower than 2015. Then in 2017 there was a pledge about 1 million additional disabled people getting into work, but there was nothing about access to work.
Finally, what is the Minister going to do about the cultural changes needed in her Department to ensure that disabled people and other claimants do not feel demonised, even dehumanised, as happens all too often?
I fear I will test your patience, of Mr Speaker, if I try to answer all of those questions at once, but I will do my best.
I welcome the hon. Lady’s tone and her welcome for the measures we announced in the written ministerial statement. Clearly we have been listening very hard to Members across this Chamber and, most importantly, to disabled people themselves about the changes they would like to see, and that is what has driven the changes we are going to be making. I absolutely want to confirm that throughout the process—in fact this is how we work now—we engage fully with disabled people, enabling them to help us develop the services which are for them.
The hon. Lady touched on a few points about people being repeatedly reassessed. I remind her that we brought in the severe conditions criteria so that people who have reached the highest level of support on PIP will not be routinely reassessed; we have introduced a 10-year light touch review so that many people with the sorts of conditions and illnesses the hon. Lady described will not be undergoing further reassessments. We also have a special process for people who are terminally ill. I undertook research in the summer—and I have been delighted to work with the hon. Member for Bridgend (Mrs Moon) on the work she has been doing—looking again at how the special rules for people at the end of life are working. We have worked very closely with the medical profession, which I think was not often aware of the special processes that could so easily be put in place to enable people to get benefits within days. I will shortly be announcing new guidance which is the fruition of the work we have been doing over the last few months.
I want to remind everyone that in the transition from DLA to PIP many more people with mental health conditions are now receiving support, particularly at the highest levels. Concerns have also been raised about work coaches and their ability to work with people with disabilities and health conditions, and I want to reassure the House that all of our work coaches are receiving extensive training and will continue to do so. Over 10,000 work coaches have already received training in mental health services, so I believe that that personal relationship that we want all people claiming benefits to have with their work coach is a possibility and is happening the length and breadth of the country.
We are looking at conditionality and have taken up the recommendations given to us. When people with severe disabilities and health conditions apply for UC there is no conditionality; that conditionality will be switched off, and then as the relationship develops with the work coach, if and when they are prepared to take those steps to work, they will be fully supported by their work coach and other resources that they have available.
As would be expected, we listened to and worked with a range of stakeholders before the announcement to develop the new service. I can absolutely commit to the House that the co-design will be ongoing and there will be plenty of opportunities for everyone in the House to be involved in how we take that forward. But the simple ideal behind it is to reduce the number of assessments people have to take and reduce the amount of information they have to give to the Department. We have all heard in our surgeries each week particularly in terms of people in receipt of both ESA and PIP that they can be asked to complete a whole number of forms where they give us the same information, and are going to assessments where they give the same information. The whole aim of this is to reduce that and to simplify it, so that people give us the information once and we are able to make the best decision we can right from the outset.

Commons ChamberWhat assessment have the Government made of the changes to pension credit that will come in in May this year, making it unavailable to people whose partner is under 65? How many more pensioners will be driven into poverty as a result?
There are two elements to that. First, it depends on individual circumstances and the impact of factors such as different arrangements in whether people are working, their caring responsibilities, and their health conditions. Secondly, it is about the principle of fairness, in that those of working age should not be accessing pension-related benefits. We should not be taking people of working age out of the workplace. Pensioner poverty continues to stand at one of the lowest rates since comparable records began, and we intend to keep it that way.
I should point out that I spent 10 years as a pensions specialist before coming into this place. The hon. Lady is not actually correct. What has happened is that the increase in life expectancy is slowing down. That is not a UK-only phenomenon; it is happening right across the western world because of very large advances. It is not unreasonable or linked to austerity. Longer lives mean that there will be an increasing number of older people in our society; the proportion of people aged 85 and over is projected to double over the next 25 years.
I am afraid that the hon. Gentleman has made an error. Public Health England published a report, alluded to by the hon. Member for Glasgow Central (Alison Thewliss), that says exactly that life expectancy is flatlining for certain groups but going backwards for others and for certain regions. Not only that, it pointed the finger at austerity as the cause.
I thank the hon. Lady for that intervention, but I would point out that that is not what the hon. Member for Glasgow Central (Alison Thewliss) actually said.
I want to address the order, which delivers on the triple lock to the state pension and provides an extra £3 billion for pensioners in 2019-20, uprating in line with earnings at 2.6%. The UK has a system whereby today’s taxpayers pay for pensions currently in payment. When people are living healthier lives for longer, spending much greater proportions of our lives in retirement, that is both unfair and unsustainable. The figure has already grown from 26.5% in 1981 to 33.1% in 2013. In 2010, the basic state pension stood at 16% of average earnings. Thanks to the triple lock, it will soon be around one quarter of average earnings. That has contributed to pensioner poverty falling significantly in recent years and the Government can be rightly proud of that. By some estimates, typical pensioner households now have higher incomes than their working-age counterparts. The triple lock has therefore served its purpose, and I would argue that it cannot be maintained indefinitely.
It is a pleasure to follow the hon. Member for Argyll and Bute (Brendan O’Hara). I think it would be useful to reflect on the categories of claimant who will not be receiving this uprating. Among those who will not receive any additional support this year are people on child benefit, on jobseeker’s allowance, on employment and support allowance who are looking for work, on income support and on housing benefit. It will not affect local housing allowance rates, child tax credit, working tax credit and the majority of comparable elements of universal credit. These have all been subject to a four-year freeze, and before that they had two years of just a 1% uprating. The freeze since 2015 is equivalent to a 6.1% cut. So I would be grateful if the Minister could confirm the savings to the Exchequer for this year alone. Could he also confirm that 10.5 million households will have the equivalent of £150 less in support available to them?
We have already heard estimates of the impact on child poverty, but it is important to reflect on them again. The freeze of child benefit and the child element of universal credit will be responsible for pushing 200,000 more children into poverty by 2020. The Minister said at the beginning of this debate that in his view the Human Rights Act is not affected. One of the rights in the Act is the right to education. How can children in poverty who are hungry and cold maximise the potential made available to them through education if they are hungry? More and more children are facing that.
More and more people from across all parts of this House are calling for the freeze to be ended, as are charities. My hon. Friend the Member for High Peak (Ruth George) has written to the Chancellor and the Secretary of State calling for the freeze to be lifted. I hope that the Minister can give us some good news at the end of the debate.
We had the DWP estimates debate last week, as I know you are aware, Madam Deputy Speaker; you were in the Chair at the time. We debated how in some respects the DWP budget has increased to cover the additional pensioners we now face and the fact that tax credits in terms of universal credit have transferred from HMRC to DWP. But, as has been mentioned, the generosity of other social securements has actually decreased. The freeze and other social security changes have meant there have been £30 billion of savings to the Exchequer. By 2021, that will be £36 billion, rising to £38 billion by 2023. I understand that there has not been an assessment of the uprating order, so I would be very grateful if the Minister committed to undertaking an assessment of the impact on poverty levels of disabled people in the work-related activity groups. Will he also conduct an assessment of the impact of this social security uprating on overall poverty levels? Does he think it is acceptable to make these cuts and to cause these levels of poverty at the same time as cutting higher rate tax levels? Last week, the Office for National Statistics published data revealing the increase in income inequalities across the UK. What is the Minister’s assessment of how much further these inequalities will increase if the Government fail to change their regressive tax and social security policies?
In 2018, inflation stood at 2.48%, and although this has fallen since the beginning of the year, estimates for the rest of 2019 are not favourable, with Brexit-related uncertainty a key driver. Research by the Joseph Rowntree Foundation shows that the price of essentials has risen, with domestic fuel costs increasing by more than 40% over the past decade and the overall cost of food rising by a quarter in the same period. At the same time, the stagnation of wages and the rise in insecure work are putting immense strain on family budgets. Last year, working lone parents saw a decline in the adequacy of their income to meet minimum costs, whether they work full time or part time. Even those working full time on the national living wage typically fall £70 a week short of the minimum income standards budget advocated by the Joseph Rowntree Foundation.
In addition, what are the Minister’s estimates of the impact of a no-deal Brexit on these levels of poverty? What are his contingency plans for this? Will he be transparent and publish these reports? By continuing the freeze on the social security payments not included in this order, the Government are subjecting 10.4 million households to an average cut of £150 this year. I would be really grateful if the Minister would comment on the freeze, and on any opportunity there might be in the spring statement to bring it to an early end.
The dehumanising treatment of social security claimants is reflected not just in the poverty-level support they receive but in how they are treated. Many people have heard of claimants being sanctioned for months on end, but I have been contacted by some claimants who say that they were visited by DWP officials when they were ill in hospital. I would be grateful if the Minister could confirm whether this is Government policy or, as I hope, a mistake. Will he also tell us whether he intends it to be Government policy for the DWP to have unfettered access to claimants’ medical records, as was reported today in the GPs’ journal, Pulse?
I have already mentioned my concerns about the changes to pension credit and the lack of availability of this for a couple, when one of the couple is under retirement age. Age UK has described the change as a “substantial stealth cut” that could have a devastating effect on the health and wellbeing of some older people and increase the number of pensioners in poverty. Again, I would be grateful for the Minister’s assessment of the increase in pensioner poverty as a result of this measure.
We have to welcome any small changes in the uprating order, and of course we do, but we cannot get over the fact that 10.4 million people will still be worse off. As my hon. Friend the Member for Wirral West (Margaret Greenwood) has mentioned, those people are in absolutely dire need, so I hope that the Minister will be able to respond positively to this.
I will just make some progress.
Many speakers talked about poverty. Income inequality has fallen—it increased under the previous Labour Government. Rates of low income and material deprivation for children and pensioners have never been lower. There are 300,000 fewer children in absolute poverty and 200,000 fewer pensioners in absolute poverty. In the past five years food affordability has almost halved and is well below the EU average.
According to the Child Poverty Action Group, 100,000 children are in severe poverty as a result of the benefits freeze. Would the Minister like to accept that fact?
The stats are very clear: there are now 300,000 fewer children in absolute poverty. Where we are in agreement in this debate is that all speakers rightly welcomed the additional £1.7 billion for the universal credit work allowances. We continue to support those who are seeking to enter work, increase their hours or increase their pay.
Overall, this order is about striking the balance between targeting support to those who most need it and what is fair for the taxpayer. Under the previous Labour Government, who increased welfare spending by £84 billion—the equivalent of £3,000 per working household—that was not a fair balance.

The social security system was designed to be a safety net, but it has now become so threadbare and the holes so wide that many people are slipping through it. One key reason is that, although DWP spending has increased since 2010, we are supporting a larger pensioner population. There is also the introduction of universal credit, which replaces the previous system under HMRC. The generosity of many other support payments is decreasing. The changes and cuts to social security add up to savings of £30 billion for the Exchequer this year. That is going to rise to £36 billion in 2021 and £38 billion by the end of 2023-24, and this is in the context of Brexit.
The Government have sought to save money from changes to benefit rules, and we have heard about the freeze. There are the £4.8 billion cuts affecting disabled people; disabled people need that extra support because of the extra costs that they face, but that seems absolutely to have escaped the Government. The other thing is penalising children and children not being supported, as they have been in the past, and, of course, restricting women’s eligibility for the state pension by pushing the state pension age up.
My hon. Friend has to remember that this is against a background of the £12 billion cuts that the present Government fought general elections on. They have no mandate for it, so this all falls into place. However, she raises a very important point that is still a very live issue—women born in the early ’50s being denied their pension. The Government have just shut the door in their faces. I think that it is a disgrace given some of the problems that these women experience now. Some are on the poverty line as a result of all this. Does my hon. Friend not agree?
I totally agree. I have visited my hon. Friend in Coventry and many of the women from the so-called WASPI group who have been campaigning vigorously on this.
Although we did see a welcome increase in spending on UC in last year’s Budget, at the same time, the disability benefits and benefits for carers went down. Even though there were changes to universal credit last autumn, 3 million people will still be worse off under universal credit. Nine out of 10 low-income disabled households will not benefit from the Budget increases, alongside 640,000 self-employed households and 475,000 working lone-parent households. The effects of these social security cuts in the context of a rising cost of living are there for everyone to see. We have heard about the rise and rise of food banks. I never had a food bank in Oldham until this Government came in.
There has been the increase in personal debt and rent arrears. Eight million—the highest level ever—working households are in poverty. Two thirds of the 4.1 million children living in poverty are from working households. Four million sick and disabled people are living in poverty. Over 300,000 more older people are living in poverty since 2010. Our life expectancy is stalling—this is in the context of an increasing state pension age—and infant mortality, for the first time in 100 years, is increasing. Four babies in 1,000 will not see their first birthday.
The austerity agenda has not helped the economy one iota. Analysis used in the Office for Budget Responsibility’s model has shown that the independent effects of austerity have been to stifle economic growth by at least £100 billion in the last year alone—that is £3,600 per household. However, it is not just about that—the human toll as a result of these cuts cannot be underestimated.
Last week, we heard about Jodey, who took her own life after she was found fit for work following her work capability assessment. The DWP failed five times to follow its safeguarding rules in the weeks leading up to Jodey’s suicide, although it knew that she had a history of mental health issues. We learnt about 52-year-old Jeff, who won his appeal against his work capability assessment saying he was fit for work seven months after he had died. A few days earlier, we heard about 64-year-old Stephen Smith, whose emaciated six-stone body was photographed by the Liverpool Echo in a hospital bed. He had also been found fit for work. In my Oldham East and Saddleworth constituency, one of the worst cases I ever had involved a man who had a brain tumour. He was refusing to have the life-saving surgery that he needed because he was scared that he was going to get sanctioned. His medical team contacted me, pleading with me to intervene on his behalf.
I have a whole list here of different constituents and the struggles that they have had with the DWP, whether that is with PIP, the work capability assessment or UC. I want to particularly thank my team for the work they have done; without them, I could not do my job.
We are the sixth richest country in the world, and it is reprehensible for us to treat our citizens in this way. We must never forget that, like the NHS, our social security system should be there for all of us in our time of need, providing security and dignity in retirement and the support needed should we become sick or disabled or fall on hard times. It is a vital weapon in our fight against poverty and inequality—and one of which we should be proud, not ashamed.

Commons ChamberI thank my hon. Friend for raising that question. This was an official error, so the income disregards do apply and his constituents should not be disadvantaged in the way he describes.
Given that 20,000 disabled people have died while the review has been going on, it is a shame that the issue had to be investigated via an urgent question rather than an oral statement. We know that the figures have been amended since the last update and that 30,000 more people are being reviewed. Is it likely that the number will continue to change?
I disagree with the hon. Lady about our motivation. Since the issue came to light, we have had ministerial statements, written statements and debates in the House. We are absolutely determined to do the right thing by claimants.

Commons ChamberSince 2013, nearly 8,000 disabled people have died within six months of being found ineligible for personal independence payments—yet more evidence that the assessment process is not fit for purpose. If the Secretary of State is not prepared to scrap this inhumane process, will she at least support the Bill promoted by my hon. Friend the Member for Bridgend (Mrs Moon), which would remove the arbitrary and cruel six-month time limit for people with a terminal illness?
The hon. Lady will be aware that under disability living allowance there were also assessments and difficulties with getting people paid on time, so let us not pretend that this is a wholly new change in terms of the consequences. I have started to look at the proposal from the hon. Member for Bridgend (Mrs Moon), to make sure that people with a terminal illness are treated correctly and get the support that they need as soon as possible.

That would be absolutely fine if the assessor had that level of medical qualification and experience. The point is that they do not. It is fine for a doctor to say that they would ask those questions, and of course any doctor reasonably would, but that is not how this has been delivered. It has not been asked by a trusted medical professional such as a doctor, psychologist, psychiatrist or other professional with the correct experience and understanding of how to handle the situation, the follow-up aftercare or anything that comes with it. The assessor is an individual sitting with a form; it is not the same experience, so I appreciate the hon. Gentleman’s point, but that is just not how it works in reality.
The hon. Lady is making a very powerful speech. Are not DLA and its successor, PIP, meant to be about supporting disabled people with the extra costs that they face, which are about £560 a month? This system fails to recognise the real injustice that disabled people are experiencing, and unfortunately the Government are just not addressing that.
I completely agree. The point is that mental illness is a disability—that is what we have argued in previous debates—and should be recognised as such and handled appropriately. I am grateful for the point made by the hon. Member for Central Suffolk and North Ipswich, but we are not having this debate because there is an issue with the healthcare system; I am arguing that there is an issue with the practitioners in the Department for Work and Pensions.
The question to which I have referred has been asked without any follow-up, without any understanding and without the qualification and experience to handle it appropriately. I just cannot understand how it is appropriate or why it is necessary for the assessor to ask that. The ultimate fact is that it can be devastating for people with suicidal depression to have to justify such a dark thought; it can shake the foundations of their wellbeing and make them question their worth. It is not uncommon to hear from people that their personal independence payment or work capability assessments have made them feel worthless. It is not uncommon to hear that from my constituents; indeed, it is all too regular. That is why I am raising this matter with the Minister.
Since 2011, assessors are meant to have had, as part of the assessment process, access to a mental function champion or mental health champion for support and training. I am not sure whether that is working in practice, which is why I urge the Minister to look at it. In not one of the cases that I have dealt with regarding mental health problems has a mental function champion been used. That prompts the question: if the training and capacity are there, why is that not being used by the local DWP jobcentre staff? Why is it not being used to assess people appropriately? Why are assessors not using the support that is available to them if it is in fact there, provided by the Department for Work and Pensions?
I have made challenges in a number of cases in which some support for the assessor on mental health issues would have been appropriate, yet such an intervention has never been used. I have had trouble trying to find concrete figures for how many mental function champions there are across the service and what their role is. I would be grateful if the Minister could enlighten us on exactly what the mental function champions are supposed to do, what role they are supposed to play in the assessments, and how their effectiveness is being measured, because ultimately I was unable to get relevant or accurate statistics from the Department outlining how well that function is being used. If it is there and not being used, it seems that assessors are doing a disservice to the individuals who come face to face with them every day.
When someone is found fit for work but in fact is not, they need to go through the arduous process of appeals. For people with a depressive or other mental illness, that process is extremely difficult and can exacerbate their symptoms. For some, the process is too daunting and they will simply go without the support that they need. I can only imagine the number, because we will not have accurate statistics for how many people go without as they are unwilling to go through that process. I do not believe that that is the right approach to mental illness—or to public expenditure; it would save the Government time and money if assessments were correct, and the correct benefits were awarded at the first stage, in the first instance. The fact that people are having to go through the appeals process and decisions are being overturned at the mandatory reconsideration stage tells us that there is something wrong with the system that could be fixed.
Not only is this a waste of resources for the Department for Work and Pensions and our courts system, but it depletes the mental resources of people who do not have the energy to spare to go through the process. I believe that, ultimately, discrimination against mentally ill people is built into the whole culture of this system. If people disagree with that, they can just ask the High Court. The Government were found in 2018 to have discriminated against mentally ill people in the High Court ruling on regulations that meant that people who were unable to travel for reasons of psychological distress were debarred from the enhanced rate of the mobility component of personal independence payment.
I do not even know where to start with that. If someone has identified under the previous, legacy system that they are unable to travel or have limitations, and then that is undermined in the new system, that seems counter-intuitive. There is surely a better way of operating. The transition from DLA to personal independence payment has been anything but smooth; in fact, there are still flaws and errors in the system. That is all that I am trying to get to here. I really want the system to work better for people, because ultimately I would rather not have to deal with individuals having this horrible experience every day. They should not have to come to me to get things improved; the system should just work better.
The regulation to which I referred was introduced in March 2017 without any stakeholder consultation. I urge the Minister to reconsider that. There are mental health charities and experts outside the House who would be able to provide the relevant and necessary information to the Minister, if she were willing to hear it. That civic engagement would get things correct for those who have used the service and had an adverse experience; it could only enhance and improve the experience.
The High Court ruling represents just a small part of the benefits system, but I think that it represents well the Government’s approach to people with mental health problems. The personal independence payment system, contrary to the Government rhetoric, was designed so that fewer people would be eligible for it than were for the legacy benefit of DLA. If the entire concept and design of a system is to get more people out of the system, it is not really doing what it was designed for, which was to help people. It just seems ridiculous that we are working to these arbitrary targets; that is the only way I can understand this. If we are trying to reduce the number of people on the benefit, even if there is no reduction in the number of people who need the support, ultimately we are just letting people fall through the net. That is a dereliction of our duty of care to the people we serve.
One quarter of people claiming DLA for mental health conditions do not qualify for PIP when reassessed, so they lose the support that they need.
My view is that the fundamental flaw was built into the system from day one, when the entire review started from the bottom line of financial saving and everything else was built on top of that. A benefits system cannot be built on a price tag, especially a price tag significantly lower than the current cost of the benefits system. That will guarantee that a significant number of people will be left a lot worse off than they were. A system has never been invented that ensures that the tiny minority of people who play the system are called to account and those who need to benefit are protected. Far too often, the system hits the easy targets rather than the ones who should be stopped from abusing the system.
What are the assessments for people with mental health problems in the benefits system supposed to do? They are supposed to give additional support to anyone living with a disability that makes it dearer for them to have the basic essentials of life. They are supposed to provide financial support for people who cannot get into work and help those who will be able to get into work to get there. We must recognise that some people will never be able to carry out enough work to support themselves financially. For those facing that reality, the system is supposed to help.
Instead, our system makes the situation worse for somebody with mental health problems that prevent them from working. We are talking about things that on their own might not seem that severe, such as anxiety, which can be made worse if they keep getting knocked back or psychologically beaten about. These people struggle just to carry on the usual social contact that some of us take for granted and lack the simple social skills that are essential to survive in the workplace.
For people struggling with those problems due to mental illness, which can be exacerbated by the way they are being treated, the worst thing we can do is force them through a system that makes them feel even less worthwhile than before they went in, even worse about themselves and even more anxious about their next assessment.
We would not assess a blind person with a paper form and we would not assess a deaf person over the phone, unless there was somebody at the other end to interpret for them. Why should it be any different when assessing somebody whose difficulties are related to severe anxiety and the inability to cope with going out the door and taking a bus on their own? They are told to go to an address they have never heard of, in a place they have never been to, to find their way there by a bus that they do not know exists, by a time set by the assessors, and to pay their own way there. By the time they get there, if they are lucky, an assessor will carry out the interview, but if the assessor does not turn up, that is okay. However, if the claimant does not turn up, they get their benefit stopped. Then we wonder why people think the system is rigged against them.
The whole work capability assessment is lengthy and demeaning. It treats people as numbers—as statistics. Sometimes it treats people as problems, instead of as human beings who need the support of a caring and civilised society. For example, most of my constituents are quite surprised, if not astonished, when they discover that it is not routine for the DWP to ask for a report from their GP or community psychiatric nurse, if they have been getting support from a nurse. They will sometimes ask for it, if the claimant themselves insists on them asking for it, but why do they not do it routinely? Surely the person’s own GP and the health professionals—those with qualifications in psychology or psychiatry—who have worked with this person, sometimes for years, have something important to say about their ability to work now and the realistic prospects of them getting back into work in the future.
Tomorrow, it will be exactly a year since I asked an urgent question in the Chamber about changes to personal independence payment assessment criteria. That followed a Government defeat in a case in the High Court where, in essence, the Court ruled that the assessment process the Government had put in place was illegal, because it discriminated between people with mental health problems and people with physical disabilities. On 23 November last year we received an update on that case: 140,000 cases had had to be reviewed and £4.5 million in benefits had been paid back to 1,000 people. I know that the succession of Ministers we have had in the DWP like to quote statistics about the percentage of people who like the result and the percentage of people who do not. In that case, 1,000 people were owed the money, which they needed just to have a decent standard of life. This Government had unlawfully withheld that money from them. We still do not know how many more people are due to get money back once the full review has been carried out. These are not the actions of a caring society.
Some of my constituents have turned up at assessments that were difficult and stressful to get to and found that the assessment had been cancelled. They had paid the cost of getting there, sometimes borrowing money to pay the bus fare, and the assessment was cancelled. At other times they have turned up and the paperwork had been lost or the person who had read the paperwork had phoned in sick. A different assessor had no idea who the person coming in to be assessed was. It is no wonder it creates the impression that, “The system really does not care about me. It does not see me as a human being. It sees me as a problem instead of as a human being with intrinsic value and the same rights to be treated properly as anyone else in our society.”
The hon. Gentleman is making a powerful speech. Is he as concerned as I am about the York University report that came out today, which states that people with mental health conditions are two and a half to three and a half times more likely to have their PIP claim reduced or stopped than people with physical health conditions? Does he share the view of the Royal College of Psychiatrists that if there is parity of esteem for mental health and physical health conditions in the health service, there should also be parity of esteem in social security?
I am grateful for the hon. Lady’s comments. I have not seen the report, but my impression has been that people with significant mental health problems do not always help themselves and act in their own best interest. As a society, we have not got a balance about how far we allow someone to be who they want to be and live their own life. At what point do we step in and say, “You are not doing yourself any favours”? I have met far too many people whose initial problem started with a letter saying they had to go for an assessment, but, because they were scared of an assessment, they did not go, and from then on the problems multiplied.
I had one recent case of a constituent whose behaviour admittedly sometimes was completely unacceptable. One of the ways that he responds to the fact that he cannot cope is by getting aggressive. In at least one instance, he caused damage in a DWP office. I cannot condone that, but it turned out that one of the things he was annoyed about was the fact that his benefit had been substantially reduced. He did not think he had seen a letter telling him why it had been reduced, and we could not find anything, either. It turned out the DWP had decided that because he might react badly to being told that, it cut his benefit, but decided not to tell him what it had done. So that information was kept in a part of the system that assessors could see, but he could not. The assessor was supposed to try to help him get back into the workplace. The DWP thinks he is capable of doing some work, so it thinks he is capable of all the stresses and strains and upsets that go with going out to work in the morning, or in the afternoon, but he cannot be trusted with information about his own claim in case he reacts to it in the wrong way.
I do not think anybody here would like to sit down and design the perfect benefits system from scratch. I do not suggest that I have all the answers, and there will always be difficult judgments to be made. There will always be cases when someone has to decide, “Is this somebody who knows how to work the system and is chancing it, or is this somebody who really needs help?” I would much rather the system was biased a little more towards accepting that a tiny minority of people can play the system in order to make sure that nobody who needs the support of the system is left behind, but the experience of my constituents is that it is very much loaded in the opposite direction. In numerous cases that I have raised with various Secretaries of State for Work and Pensions—more than six since I was elected—after a few months, the answer has come back that the person has abandoned their appeal and is not going through with the latest stage in the process. Some in the DWP see it as a success every time someone does not carry through an appeal, because that means they have accepted the result. They do not think it means they have given up because they simply cannot win against a system that they feel, and sometimes I feel, is designed to stop people getting what they are entitled to get.
If we look at what has been happening since some of the benefits system was devolved to the Scottish Government, they were criticised for not moving quicker, but the first thing they did was to embark on a major consultation and engagement process not only with the usual suspects, but with people who had been through previous processes. They went out and actively looked for people who had either got successful claims or had lost out under the previous system to find out from them what they thought the system should be like.
The Scottish Government have given an assurance that any benefits assessments they are responsible for will not be carried out by private companies, so any suspicion that there is something in it for the private assessor who says no instead of yes is immediately taken out. The DWP will always say that that is not the case, but if a private company hopes to get the contract in a few years’ time, there will always be that suspicion, especially in the minds of those who do not get the result that they want.
We need to go back to the basics of what people are entitled to get either from the benefits system or from any other part of the state. The Scottish Government have said from day one that their system will be based on fairness, dignity and respect. Every one of our citizens deserves that, whether they are dealing with a benefits application to the DWP or in any other interaction with the Government. At the moment, far too many of my constituents do not feel they are being treated fairly. They do not feel they are being respected as human beings and they definitely do not feel that they come out of the process with the dignity that each and every one of us is entitled to. Until that changes, I cannot support the system. I want to see it fundamentally changed or scrapped altogether so that we go back and start again.

I begin by my adding my praise to that of other Members for the hon. Member for Lanark and Hamilton East (Angela Crawley), both for securing this debate and for the way in which she addressed the House. She and others are absolutely right: I am utterly determined to make sure that we improve the system by which we assess people for employment and support allowance, the personal independence payment and of course universal credit. I am just as ambitious as everybody else in the room to ensure that we treat everyone in society with respect and dignity, and really promote their human rights.
On independent assessments, people who go on this journey—I do not want to call them claimants or customers; that was a good point well made by the hon. Lady—through the system give the approach that we have taken to both ESA and PIP a satisfaction rating in the high 80s. That is the vast majority of people applying for these benefits. This is not something we measure internally; it is properly independent research that we publish and is open to scrutiny. One poor experience is one too many. We are utterly determined to improve the experience at every stage of the journey, and really put the person at the centre.
PIP was introduced to ensure that mental and physical health conditions have parity of esteem. Many more people are benefiting from it than ever did from disability living allowance, and are getting the higher rates of support, for both their daily living and their mobility. Broadly, therefore, it is working, but as we have heard, there are some absolutely horrendous and terrible cases of unacceptable behaviour, where things are going wrong. I thank all hon. Members who have come along today. It is clear that everyone here wants to do the best they can for their people and to work with me to absolutely get this right, and I welcome that.
I want to answer questions, but I have been given very little time to respond; that is the nature of these debates. As always, I will write to hon. Members on any questions that I do not have time to address. I start with the invaluable work of the Work and Pensions Committee. It is great to have one of its members here speaking up for that. The Committee gathered a huge amount of evidence, and I looked through all the research findings and the Committee’s recommendations thoroughly. We have agreed to implement all those recommendations, and we are carefully working our way through every single one of them. I want to reassure hon. Members that I work very closely with SSAC. It is an invaluable body. Everyone in the Department always thoroughly considers its reports and recommendations, and whenever possible we seek to implement them.
A few hon. Members mentioned video recording, which, when I came from the Home Office to take up this position, I thought was a really good idea. One of the fundamental problems we face with people claiming benefits is a lack of trust. Unfortunately, too many people are worried. We have today heard eloquent contributions about people being really worried about having to go through the process. In spite of the fact that most people have a really good experience, most of them are worried before they enter the process. I obviously want to eliminate that, as does everyone in the Department.
I want people to fill in the forms confidently, and pick up the phone or go into their jobcentre thinking, “There will be compassionate people who will help me”. That is what we are all striving to achieve. I believe that video recording the assessments will play an incredibly important role in regaining people’s trust in the whole process. Hon. Members will know that audio recordings are already available, but they are not done with the most up-to-date equipment. It can be a clunky and difficult experience, and I want to make it as easy as possible.
Throughout the summer we did a lot of work both with people who are claiming benefits and with healthcare professionals. All assessments are undertaken by fully qualified healthcare professionals. They are mostly nurses, but they all have experience and they have additional training in how to undertake the functional assessments. They are highly motivated and trained individuals, and it was important to consider how they felt about the video recording, just as much as how people coming in to be assessed felt about it. Having taken all that into consideration, we have started a pilot, which is going well. It is voluntary, because we wanted to ensure that people felt really confident about having their assessments videoed.
The strength of the pilot will be that lots of people take up the opportunity. There is no point coming up with a videoing possibility if people are not prepared to say, “Yes, I would like my assessment to be videoed”. We have been working carefully on the pilot and will review the findings to see how and when we can roll the initiative out. There is an absolute determination and commitment to doing that, because it will build the trust and confidence in the system that we want.
We have also been looking at every single stage of the process. I really want to assure hon. Members that I regularly meet our stakeholders—the large charities and disability rights organisations. We have a PIP forum and a stakeholder team working with us on improvements to the work capability assessment, and disabled people are really getting alongside us and working with us on improving the process. I have already commissioned an independent review of the PIP application process. We have been looking carefully and in detail at every single part of the claimant journey—the person’s journey—through the system to see what more we can do, right through to how we can improve our mandatory reconsideration process. At the same time, as I said, we have been implementing the very helpful findings of the Work and Pensions Committee.
Going back to comments about what happens in the assessment, we will make a decision based just on the application, without sending someone to a face-to-face assessment, if we can gather enough information from the person applying for the benefit, and if they provide information from healthcare professionals, whether they be consultants, GPs or community mental health nurses. We will use that information whenever possible. A lot of our work over the summer was engaging with healthcare professionals to try to understand the barriers to their providing us with information. Relatively small numbers of people go to appeal, and relatively small numbers have decisions overturned. Most often, decisions are overturned because more information has become available by the time of the appeal. I am determined to see what we can do to have the information provided up front by healthcare professionals, so that we can make more paper-based assessments, without the need for face-to-face ones.
Hon. Members will know that we have introduced a set of new criteria called the severe conditions criteria, for employment and support allowance and now for PIP. If people have severe mental or physical health conditions that, sadly, are not going to improve, we put them into a category where they do not have to be reassessed, apart from a very light-touch reassessment after 10 years, just to ensure that their circumstances have not changed. That means that fewer people will be reassessed, and I hope that everyone here can commend that.
On some of the other observations on face-to-face assessments, we have had quite a discussion about the mental health questions. The questions that the assessors use and the training they receive is all approved by the National Institute for Health and Care Excellence. I think hon. Members were referring to the mental state examination questions. As my hon. Friend the Member for Central Suffolk and North Ipswich (Dr Poulter), who has left the room and is a doctor, said, this is the best practice of the medical profession. It is really important that the Department takes its duty of care very seriously—and we do. Right through from our job coaches in Jobcentres Plus to people in our telephony services, we have a really good process to ensure that anyone expressing suicidal thoughts is supported. For example, everyone in our jobcentres is going through mental health training to ensure that they feel able to chat to someone with suicidal ideation and keep them safe and in front of them while their colleagues secure additional support from the NHS. We take that extremely seriously and are led by the best evidence—
I have so few minutes and so many questions to answer.
I want to reassure hon. Members that our work in this area is led by the best possible clinical input. The deputy chief medical officer, Professor Doctor Gina Radford, oversees all this work, because keeping people safe is just as important as treating everyone with respect and dignity and ensuring that their human rights are upheld.
I will conclude, so that I can give the hon. Member for Lanark and Hamilton East a few moments to wind up. I am absolutely determined to carry on our work on fibromyalgia and on all the issues she has mentioned. I have invited people into the Department for weekly meetings, so that together we can make the changes we want to see.

My right hon. Friend is, of course, right: throughout this process, we must provide support for the vulnerable in particular. As he will know, once universal credit is fully rolled out, there will be over £2 billion more in the welfare system than there is under the current legacy benefits. One of the changes made in the Budget was the uplifting of work allowances, which will help young parents and also the disabled.
Any improvements in this hideous programme are welcome, but there will still be thousands of universal credit claimants who are moved on to it this year as a result of natural migration, with no transitional protections. How many people will be pushed into poverty by that move and the Government’s lack of compassion in failing to unfreeze the benefits system?
As I have said previously in the House and as I said earlier this afternoon, we have put more money into the system to support the most vulnerable, which is absolutely right. As for the pilot phase, we will of course work very carefully with stakeholders to make sure that we get it right.
