Commons ChamberWe do think that Israel must do more on deconfliction, but the hon. Gentleman is right that the use of Israeli lawyers in targeting and in the planning of military activity—not dissimilar from what we do in the United Kingdom—is very important. I am grateful to him for the balance that he has expressed, as he always does.
This country used not only to respect but to champion international law. The Minister’s dismissal of ICC procedures today confirms how far the Government have fallen from their adherence to the rule of law. Why are the Government undermining the Court and its British chief prosecutor as he attempts to call those to account for war crimes, including extermination, murder, hostage taking, starvation, targeting civilians and persecution as a crime against humanity?
I am surprised at the hon. Gentleman putting it that way. He is an extremely distinguished lawyer, and I hope he will recognise that the point I am making is that the House is rushing to conclusions that are not merited at this stage in the process.

Spain, Norway and Ireland are ready jointly to recognise Palestine as a state within weeks. Four other European countries look likely to follow suit, and France recently voted to admit Palestine as a full member of the UN. Is it not time that the UK Government joined their European partners in recognising Palestine?
As we have made clear, recognition of a Palestinian state cannot come at the beginning of the process, but it does not have to come at the end.

We remain concerned about the implications of targeting civilians. Too many have been killed, and we want Israel to take greater care to limit its operations to military targets. As I have said repeatedly, we await the Colonna report about the UNRWA situation, and we will examine our response.
Some 500 health-care workers have been killed in Gaza in the past six months. That is more than the total number of healthcare workers killed in all conflicts around the world in the previous two years. Does the Minister agree with Professor Nick Maynard, the British surgeon recently returned from Gaza, that healthcare workers are being deliberately targeted? If so, why is the UK still supplying arms to Israel?
I have addressed the point about arms. The hon. Gentleman’s point about protecting aid workers is important. We believe that the Israelis need to do much more to protect them. That includes the guaranteed deconfliction of aid convoys and other humanitarian workers, to ensure that they can operate safely.

Commons ChamberAs I have set out previously to the House, we have previously assessed that Israel is committed and capable of complying with international humanitarian law, and that is kept under review. Were there to be any change in the position and view of the British Government in that respect, we would inform the House.
On that matter, the Government do sometimes publish legal position statements. According to the Cabinet Office, on 11 December 2023 the Government published a statement of the legal position in relation to the Safety of Rwanda (Asylum and Immigration) Bill, and it published a similar legal position statement when introducing the Northern Ireland Protocol Bill in July 2022. Will the Minister publish such a statement setting out any breaches of international law by any parties in the Israel-Gaza war?
The hon. Gentleman, who is an enormously distinguished lawyer, is well aware that we do not disclose our internal legal advice, and that has consistently been the position of Governments of both the major parties. We have no plans to change that position.

Lady uses florid language to describe these matters, but I hope that she will agree that the right thing is to do everything we possibly can to get the hostages out, support the people whom she so eloquently describes, and get support into Gaza, and that is what the Government are seeking to do.
Every month in Hammersmith, we hold “Ukrainian open house” to bring together all those supporting Ukrainian families who have fled that war. Every month, I am asked why there are not similar visa schemes to allow Palestinians to join their relatives in the UK, or to be hosted by families who wish to give them refuge here. What is the Government’s answer to that?
The Government’s answer is that the two positions are not analogous; they are very, very different. The hon. Member will know that we are doing everything we can to help individual cases in both instances, and we will continue to do so.

Commons ChamberThe weakness in the Minister’s statement is that it makes his Government a commentator rather than an actor in the situation in Gaza. If this House and our international partners speak with one voice in calling for an immediate ceasefire, it would carry more weight with the Government of Israel. If he accepts that the absence of a ceasefire has resulted in the deaths of tens of thousands, and the horrific suffering of 2 million Palestinian civilians, does he not have a duty to call for a ceasefire now? Would that make the Government’s case stronger?
As I have set out, a ceasefire that collapses back into fighting within weeks is not in anyone’s interest. The hon. Gentleman suggests that the Government are a spectator, but nothing could be further from the truth. If he looks at what the Foreign Secretary has been doing, at the way Britain’s humanitarian representative in the Gulf has been acting, and at all the discussions that have been going on in the region and at the UN, he will see that Britain is at the forefront of trying to achieve a humanitarian pause, leading to a sustainable ceasefire, and that is what we will continue to do.

It is a pleasure to be here under your chairship, Ms Vaz. I congratulate my hon. Friend the Member for Poplar and Limehouse (Apsana Begum) on securing the debate and on all she has been doing since the beginning of this crisis to draw attention to what is happening in Israel and Gaza, which has now spread to other parts of the middle east.
Everyone around the world was horrified by what happened on 7 October, but everyone—or almost everyone—has watched with increasing horror the effect in Gaza over the ensuing months. It is almost somewhat prurient that, as we debate this matter every week in this place and out in the wider community—as the right hon. Member for Islington North (Jeremy Corbyn) said, there is huge interest among the public in this—we are commentating on the deaths of hundreds of thousands of people, predominantly civilians and overwhelmingly women and children. That is an extremely uncomfortable position to be in, but we have to try—and, above all, we have to try to persuade the UK Government that they and their partners need to do more.
My starting point for dealing with what is different between Gaza and some other conflicts is that there was a long period before the current hostilities—since at least 2007—when Gaza was under siege, so these depredations are happening not to a robust society, but to one that has already been depleted in many ways. I visited Gaza twice during that period. The first time was just after Operation Cast Lead, another major Israeli military incursion, though obviously not on the scale of the current one, and I saw what happens when heavy-duty weapons of war are used against civilian populations. We were lucky to get into Gaza through Erez that time. The second time I visited, most political visits had been stopped, but we were able to cross Sinai—something that, again, may not be possible now—and enter through the Rafah crossing.
What impresses me most about Gaza, as others have mentioned, is the resilience of its people, despite the utter squalor of life, caused by occupation and the control of land, sea and air borders for a long period, such that most are reliant on aid, cannot leave the country, except in very few cases, and have been living almost as stateless citizens, in limbo, for nearly a generation now. Gaza has a highly educated population, and it has become clear during the current conflict, as we have seen hospitals and other civilian infrastructure destroyed, that it was there. Indeed, many doctors and other specialists have gone out from this country to assist medics and others in Gaza in running the health service as best they can, despite the deprivation of supplies. At the same time as being horrified by the conditions that people had to live in, one could not help but admire the fact that life continued as normally as it could under the circumstances. Not only did a siege go on, but there were four or five separate land or air assaults by Israel on Gaza between 2008 and the current conflict. Life had been worn down, and people had been worn down, not just physically but mentally, over that period.
The other aspect of Gaza that is perhaps unique is that there is nowhere to flee to. There is no route out of Gaza. Gazans do not want to leave Gaza. They do not want to be forced into Sinai or elsewhere, or into any of the mad schemes that extreme members of the Israeli Government have come out with. Undoubtedly, there are those who would like to be able to cross the border, perhaps because they are wounded or injured, they are foreign nationals or have family abroad, or they simply cannot stand what is happening, but they are simply unable to. That adds another dimension of horror to the situation. People are being bombed and shelled daily, as we have seen. We do not get the full picture, but we see that whole districts and neighbourhoods, and the majority of residences, have been damaged or destroyed in what would be an extraordinary level of bombardment in any war but is particularly so in such a narrow and small piece of land.
People have mentioned some of the headline statistics, if I can put it that way. The fact that 85% of the population have been displaced is extraordinary. Some 27,000 people have been killed, over 11,000 of them children, and we have heard about the half a million people who are in the most severe level of food crisis. A very substantial proportion of people around the world who are in that highest level of crisis are now living in Gaza, which previously had a first-world economy, in many ways, and first-world education and skills. That is the seriousness of the case, and that is why we have seen attempts to defend the victims through action in the International Court of Justice in the United Nations itself.
The debate is about one narrow aspect of this crisis and conflict—aid. Whatever the Government say about aid shipments that they have authorised, it is clear that aid is not getting into Gaza in anything like the amount that is needed. UNRWA is not the only aid agency; there are many others, such as Islamic Relief and Medical Aid for Palestinians, whose local staff are working on the ground under appalling conditions. Those charities do a very good job, but they do not do what UNRWA has done since 1949 and provide whole-infrastructure support for a population that, through no fault of its own, is unable to supply it itself. UNRWA also provides education, healthcare and employment for many thousands of people.
Let us not disguise the fact that what some UNRWA staff—a very small number—have been accused of has to be investigated. Those staff, quite rightly, are out of a job while that is being investigated, and if it can be proven that they played any part in the 7 October events, they must be punished with the full severity of the law. But the idea that the whole organisation should be effectively brought to a halt by being defunded seems extraordinary. The Minister for the middle east said, and I am sure he is sincere, that he does not believe the defunding will make a difference because we have made the current financial year’s payment and are not due to make the next one until the next financial year, but will the various inquiries—there are more than one—be resolved by then? I would like a commitment from the Minister today that, as long as we are assured that investigations are being properly carried out, we will not restrict the funding we would otherwise have given to UNRWA, which itself is only a fraction of what is needed and is less than used to be given.
The Government are failing. Even with respect to aid, they have singularly failed to give a political lead. They have singularly failed on many of the issues that have arisen since 7 October, including on what is happening in the west bank and the wider middle east, but every time questions are raised about those things, we get the reply, “Yes, but we are prioritising aid.” Well, with respect, that does not appear to be happening. If it were, we would be working more closely with the UN, our European allies and the US, as well as bilaterally, to ensure the necessary amounts of aid are getting into Gaza through a variety of crossings and in a variety of forms, and many of the current hold-ups would be relieved.
It is so obvious—and I think this is the Government’s position—that aid cannot be got into Gaza in any meaningful way without the cessation of hostilities. We may differ on what that cessation should involve and on the terminology, but it would be good to hear from the Minister that the Government wish to see an end to the hostilities between Gaza and Israel until such time as the famine and disease that are running rife are ended, and the wounded and others who are suffering in Gaza have received proper medical attention, food and other supplies. Surely that is the least that we should demand.
The way that Ukraine is reported in the UK differs from the reporting of Gaza. There is rightly a high degree of access to what is happening in Ukraine, so we get a good picture of the atrocities visited on the Ukrainian people by Putin and his forces. Despite the brave efforts of many journalists, many of whom have been killed, we do not get a full picture of what is happening in Gaza. For those of us who are familiar with the region, it is possible to imagine it, but probably not on the current scale. The suppression of information coming out of Gaza is being used to disguise the full horror of what is happening there.
Despite that, it is clear from every polling exercise and from the correspondence that every MP receives— I have had more than 5,000 emails on this subject, calling for an immediate and full ceasefire by a ratio of 100:1, and others have had considerably more than that—that the public in this country are deeply concerned about what is happening and want to see their Government take action to stop the killing, particularly of children, and the destruction of a whole civilisation. There is clearly a targeting of civil society bodies, records, courthouses, Parliaments and business districts, which can have no military significance whatever, in a way that punishes and degrades the entirety of the Gaza strip. I want the Government to speak out against that more and, above all, take many more steps to ensure that aid is delivered in secure circumstances in the course of a ceasefire.
I am very grateful for those questions. We have made these specific points to our Israeli counter- parts. We believe that there are 10 steps that they should be taking to increase the flow of aid. Primarily, of course, we need a humanitarian pause to allow humanitarian agencies and Gazans to operate more safely right across Gaza. We need to ensure effective systems to guarantee the safety of aid convoys, humanitarian operations and IDP returns and facilitate access. We need to ensure that the UN has the people, the vehicles, the equipment and the fuel to distribute aid safely across Gaza once it is inside Gaza. That includes the issuing of visas.
We need to extend the opening hours and the capacity of the Nitzana screening facility and Kerem Shalom checkpoint so that more trucks, aid and fuel can enter Gaza. It needs to be open seven days a week, not just five. We need to remove restrictions in order to ensure greater consistency on the goods allowed in, as the hon. Lady referred to. We need unencumbered access to aid coming in from Jordan. The Israelis need to open Ashdod port as a route for aid to reach Gaza. The Israelis need to open the Erez crossing to allow direct access to north Gaza. And, of course, there needs to be a restitution of water, fuel and electricity connections. We continue to make these points to our Israeli interlocutors.
The Foreign Secretary also announced work with Qatar to get more aid into Gaza. Our joint consignment containing 17 tonnes of family-size tents was flown in last Thursday. Last month, RFA Lyme Bay delivered 87 tonnes of aid into Port Said. Crucially, we are supporting the United Nations World Food Programme to deliver a new humanitarian land corridor from Jordan into Gaza, which has already delivered more than 1,000 tonnes of aid. It is vital that we sustain this support and go further.
We are clear that Israel must take steps, working with other partners including the UN and Egypt, to significantly increase the flow of aid, including by allowing prolonged humanitarian pauses, opening more routes into Gaza and restoring and sustaining water, fuel and electricity. Above all, the best way to address the humanitarian situation is by bringing an end to the fighting as soon as possible, which is exactly the point that right hon. and hon. Members have made this afternoon.
The Foreign Secretary was in the region last week to urge de-escalation and build towards a sustainable and permanent ceasefire without a return to the fighting. We have identified five steps to allow that to happen—first, the release of all Israeli hostages; secondly, the formation of a new Palestinian Government for the west bank and Gaza, accompanied by an international support package; thirdly, removing Hamas’s capacity to launch attacks against Israel; fourthly, Hamas no longer being in charge of Gaza; and fifthly, a political horizon that provides a credible and irreversible pathway towards a two-state solution. We will continue to do all we can diplomatically to push this agenda forward in order to save lives, quite frankly.
I doubt that there is anybody here who does not fully agree with those five points, beginning with the release of the hostages; it is indefensible that they should continue to be held. Realistically, however, given the nature of the Netanyahu Government, does the Minister expect those things, including looking forward to a new peace process, to happen before there is a sustained ceasefire?
Despite the difficulties, there will come a point at which a humanitarian pause can lead to a ceasefire if international assurances are given, if the contents of the five-point peace plan are catered to and if there is confidence on both sides. As difficult as it may seem to imagine that now, we believe that it could be possible to get to a ceasefire, and a horizon of statehood would be a necessary component of that.
As has been discussed this afternoon, it is clear that children are the worst-hit by this conflict. Even though too much of the humanitarian relief that children need is not getting into or across Gaza, UK aid is saving children’s lives and we are doing everything we can to get more of it into Gaza. We are working hard to generate momentum towards a permanent peace, as difficult as it may seem. That is the only way we can give the children and the people of Gaza hope for the future and a better life.

Commons ChamberWe work closely with Thailand, and our officials in the country, led by our ambassador, do a great deal of work around these difficult issues when they arise. I have picked up some of the consular cases myself. If there are specific issues that the hon. Gentleman wishes to raise, I am happy to meet him to discuss them.
I have 10 and 11-year-old constituents—British citizens—who are stuck in the Israeli fire zone in southern Lebanon. The Foreign Office is urging them to return to the UK, but as their mother is not a British citizen, the Home Office is preventing that. Will the Minister help me to persuade the Home Office to relent on this issue?
I am happy to look at the case that the hon. Gentleman raises immediately after Question Time, if that is convenient to him. The Foreign Secretary is in the region today, not far away from the country that the hon. Gentleman mentions, and I am sure that we will be able to advance the talks that are going on.

Commons ChamberMy right hon. Friend makes an extremely good point. We and our allies and friends, and virtually everyone in the region, believe that the only answer is a two-state solution, with Palestinians living behind safe borders and Israelis living behind safe borders as well. That is the policy of the Government, this House and the Opposition. We are pursuing it vigorously, as Lord Cameron showed in his many meetings last week.
The Minister said that the Government did not support the reference to the ICJ, but that they support the outcome that justifies that reference. Given those mixed messages, what confidence can we have that he is communicating to his Israeli counterpart that the legally binding orders of the Court must be complied with?
I have already set out the Government’s response to what the Court said, but in response specifically to the hon. Gentleman’s question, he may rest assured that those points were made by the Foreign Secretary throughout his extensive trip to the region last week.

Commons ChamberThe hon. Gentleman has great experience and he is right to say that Government time signals the importance that the Government give to the business they bring to this House. While the Backbench Business Committee does an important and useful job, it is Government time that matters. Since the Defence Secretary has been in post, we have not had that general debate on defence, and we should. We have not had a debate on Ukraine for four months, and we should, certainly ahead of the bloody two-year anniversary next month of Putin’s illegal invasion of Ukraine.
We have also not had a debate since 7 October on Israel and Palestine, which is extraordinary. There is an irony that, had we gone ahead with the original debate on international relations, that could have been a subject for debate, but we are restricted by this debate. It is clear why the situation in the Red sea is a priority, but that is probably also a priority, which the Government might wish to take up, and which I have raised previously with the Leader of the House.
At the risk of sounding a bit like the shadow Leader of the House responding to a business question, my hon. Friend is right. He is very experienced and I am sure he will find a way, as the Prime Minister did yesterday in his statement about the Red sea action, to talk more widely about Israel and Palestine without testing Mr Deputy Speaker’s patience too far.
The freedom of navigation, maritime security and upholding international law are fundamental principles, and this country, along with international partners, has a duty to uphold them. We have heard about the economic consequences. The disruption caused by what is happening in the Red sea affects peace not only there but throughout the region.
As the Defence Secretary and the Chair of the Foreign Affairs Committee said, there are complex and historical issues that will need political solutions in due course. These are long-standing disputes with complex origins, whether that be the interference of colonial powers in the past; communal, religious or ethnic rivalries; or the struggle for oil and other natural resources. I do not claim to be an expert, but there are certainly parallels with what happened in the 1960s, with the North Yemen civil war and the Aden emergency—UK forces occupied Aden from 1839 to 1967—and many of the issues have ancient origins.
However, I add a note of caution. I know exactly what has been said by many speakers so far in relation to conflating the actions of the Houthis in Yemen with what is happening in Israel and Palestine. Nobody should be so naive as to think that the motives of the Houthis are humanitarian or unselfish. As the Defence Secretary said, the Houthis are entirely opportunistic in what they are doing, but that is not necessarily the way that it is seen on the Arab street, or by our constituents, so we must address that issue head on. The priority given to dealing with attacks on shipping in the Red sea should also, as many of my constituents say to me, be given to dealing with attacks on human life in Gaza and wherever else, including in Yemen.
Let us look at what the Prime Minister said at Prime Minister’s questions. If I understood him correctly, he set a number of tests that had to be met before there could be a ceasefire in Gaza: all hostages should be released—presumably he means Israeli and Palestinian hostages; Hamas should disarm and disappear from Gaza, so as not to be in a position to threaten Israel or anyone else; and the Palestinian Authority should take over the role of governance there. Nobody would be more pleased than I if those three criteria were met. Indeed, I am sure that hostage release and swaps will be part of any ceasefire, even a temporary one, but how realistic is it to expect that Hamas will disappear overnight or that, to use their own phraseology, the Palestinian Authority will ride into Gaza on the back of Israeli tanks? I do not believe that that is a realistic assessment of where we need to go before a ceasefire occurs.
Today, the Prime Minister was asked by the leader of the Scottish National party—this question is often asked of the Government—whether he believed that war crimes had been committed in Gaza. That is not a difficult question. Yes, it is absolutely true that there are restrictions on journalists and international observers going into Gaza, but there is enough coming out of Gaza to see that it is not an exhaustive list. None the less, many leading international jurists have seen deprivation of life, collective punishment, arbitrary detention, denial of basic services including healthcare, forced displacement and ethnic cleansing. Simply to reply, as any Government spokesman does, that Israel should comply with international humanitarian law, is not sufficient. The question is: is Israel complying in that way?
Today, I noted that a 200-page opinion piece, published by Lawyers for Palestinian Human Rights but authored by independent jurists, found that in Gaza, persecution—a crime against humanity—had been committed more intensely since 7 October, but that it goes back to 2007, when the siege of Gaza began. If the Government’s position is to be credible they must address those events. What is happening in Gaza is extraordinary: 1% of the population—25,000 people—have been killed in three months under the most horrific circumstances. We heard the shadow Defence Secretary describe that in his opening remarks, and there are strong parallels with what is going on.
On international law, let us face it: international humanitarian law is the last resort, when other things have gone wrong. Perhaps the side that we politicians can take is that of morality. What is the right thing to do? What is the humanitarian thing to do? What should we do about human misery? That is why the immediate bilateral ceasefire is so important. There is a choice. The International Court of Justice and the International Criminal Court will be looking at the war crimes, and it is right to let the courts do their job, but the Government could also have made a moral judgment. Does the hon. Gentleman agree?
I think I always agree with the hon. Member on this issue, if not on others. She has clear personal knowledge of it, and is under particular strain because her extended family are in Gaza. I pay tribute to her ability to maintain the objectivity that she has just shown in her comments.
We have just had a debate in Westminster Hall on human rights, and Gaza came up. During the debate it was revealed that the Foreign Office had sought evidence from its legal advisers on the legality of actions that have been taken by Israel, going back to 10 November. We did not receive a satisfactory answer from the Minister responding to that debate, but should the Government not publish that advice? I also understand that since the new Foreign Secretary arrived he has asked for a review of that legal advice.
I also agree with my hon. Friend.
The deaths that continue to occur daily in Gaza have so far been mostly the result of military action, but we have reached a point where the number of deaths through privation and disease is overtaking them. There is a strong parallel with what happened in Yemen, where about 150,000 people—mainly civilians—have been killed over the course of the civil war that began in 2014. At least another 200,000 have died through disease and privation as a consequence of the civil war, and we are at that tipping point in Gaza. Yes, those are higher numbers, but they are from a much longer period. Many of the same arguments apply, and I do not think any Member present would not wish to see an end to the suffering in both Yemen and Gaza. We need a ceasefire and an end to hostilities, and pressure from the UK alongside partners could play a much bigger role in achieving that.
Secondly, we need aid and reconstruction, but that requires a more permanent peace, because many donors, including EU and UK donors, who have contributed to the reconstruction in the past have seen the money wasted as a result of further military action. Better governance is also needed, and support for civil society. One of the most cynical things that has happened since the terrible, tragic events of 7 October—we all feel for the people of Israel for what they suffered then—is that the response has been not just to go after Hamas but to destroy civilian neighbourhoods and civil society. Destroying law courts, destroying the Parliament, and destroying the records office appears designed to make Gaza ungovernable. That has to be addressed as well.
One could make exactly the same points in relation to Yemen. These are two of the great catastrophes going on in the world. There may be points where we do not want to link the two, but there are clear points where we do. What puts Gaza in a different category than Yemen, is that we are dealing with occupation. Following his statement yesterday, I asked the Prime Minister when the UK will recognise a Palestinian state. Unsurprisingly, he gave an answer that will be familiar to everyone present, and said that
“we will recognise a Palestinian state at a time that best serves the peace process.”—[Official Report, 23 January 2024; Vol. 744, c. 166.]
That time is now, or nearly now, because it is impossible to have serious negotiations towards peace unless they are between two sovereign states, notwithstanding conditions in Gaza and, increasingly, conditions in the west bank as well.
Let us not pretend that the recognition of a Palestinian state would put Israel and Palestine on an even keel, but without it as a precondition of the negotiations, they simply will not get off the ground. I hope we see that change in position. There is strong support not just for our military, but for the diplomatic initiatives that the UK is doing in the middle east.
Order. I have given the hon. Member a lot of latitude, as he is focused on one aspect, but the debate is on the situation in the Red sea. If he could direct his attention towards that subject, I would be extremely grateful.
I should have taken your advice, Mr Deputy Speaker, rather than the advice of the shadow Defence Secretary, my right hon. Friend the Member for Wentworth and Dearne (John Healey), at the beginning of the debate. You interrupt me at an appropriate point, because I am concluding my remarks. There is strong support from all sides, but we need to go further. Britain’s historical responsibility in the region requires us to make that additional diplomatic effort.
