My hon. Friend is right; it is extremely important that as we take forward the draft code and its implications, and as we look to how we ensure compliance with the law, we do support women and their rights to single-sex services and spaces, but that we do so while ensuring that we are meeting the needs of trans people too. That is incumbent on all of us in this House.

At the beginning of Pride Month, a number of trans people will be unsettled and anxious about the contents of the statement today; they will be wondering how on earth they will safely access public services. Not only have we fallen to No. 22 in the rainbow index, but we are now 45th out of 49 European nations for the service of transgender people across Europe. Can the Minister give us any explanation for why we have fallen so low? What impact does she expect this code of practice to have on those league table positions?

I always thank the hon. Gentleman for his questions. This draft code has more worked examples and it has seen consultation. He is able to speak directly with the EHRC about the way in which it has consulted and brought forward the draft code. As I have said, it is incredibly important that we have a balance, so that we are protecting single-sex spaces for women—and that should not be in conflict with ensuring that trans people continue to be protected from harassment and discrimination. I want to reiterate that the Supreme Court warned

“against reading this judgement as a triumph of one or more groups in our society at the expense of another”.

It is important to get this right for everyone.

My hon. Friend is exactly right. There is a real risk of instability in Venezuela now, and it will be crucial to build civil society and give people in Venezuela hope, rather than fear. We should ensure stability, building up capacity and work with Opposition parties and other organisations. That is something we are advocating strongly for. I have discussed this with the US Secretary of State, and said that we will continue to make that a priority, based on the work that our excellent chargé d’affaires has been doing over many years; now we need to do that extensively, including in discussion with Opposition parties.

It would be hard to find an occasion on which a British Prime Minister has looked as irrelevant and spineless on an era-defining international issue as this one does on this occasion. We are witnessing an existential threat to the international rules-based order, and the Prime Minister cannot rouse himself to give it even the meekest of defences. France, Spain, Brazil, Mexico and the UN Secretary-General have all been clear that the Trump Administration have violated international law. When will the Prime Minister and the Foreign Secretary find their voices and join that chorus of condemnation?

The Prime Minister’s response has been very much in line with the leaders of countries across not just Europe but the world. We continue to stand up for and highlight the importance of international law and focus on the realities in Venezuela, where huge damage has been done over a long time, including by the interference of Iran and Russia. We are focusing on what should be the priority of all of us now: getting a democratic transition for Venezuela.

It is a pleasure to serve under your chairship, Mr Mundell. I congratulate the hon. Member for Stourbridge (Cat Eccles) on securing this debate.

When politicians such as the hon. Member for Clacton (Nigel Farage), Conservative Members or, indeed, the hon. Member for Great Yarmouth (Rupert Lowe) want us to leave the European convention on human rights, it tells us something quite reassuring, which is that the ECHR is doing precisely the job it was designed to do to protect all of us from the whims of tinpot populists like the hon. Member for Clacton. When parties such as Reform, and indeed the Conservative party, rail against the ECHR, it tells us everything we need to know about why it is so desperately required.

Those politicians want to remove our basic rights in order to leave the disadvantaged unprotected and their authoritarian tendencies unchallenged. It is in situations like this, when our human rights are most under attack, that we must redouble our efforts to ensure that they are preserved. Let us remind ourselves of the company that the hon. Member for Clacton wants to keep: Russia and Belarus—perhaps that should not surprise us either. He spends half his time as an apologist for the Kremlin, and he has the slight inconvenience of his party’s treasurer in Wales having been found guilty of taking bribes from Russian interests.

Let us remind ourselves what this is all about. The ECHR was created from the ashes of the second world war. It was designed to ensure that the atrocities of that dark time could never be repeated. It enshrines our freedoms of speech, to assemble, to worship, to protest and to live our private lives free from interference, and it is a living instrument that evolves as our society evolves. It is everything that the populists despise. Most of the time, we are not aware of the ECHR—most of our constituents probably do not know what is actually in the document—but it is always there, guaranteeing our freedoms and our rights. It does not seek attention; it simply ensures that the Government—any Government—act in a way that respects our rights. It is our silent guardian.

Leaving the ECHR will not stop the boats or allow the Government to deport masses of our fellow citizens, but it will tear holes in our domestic law. Since 1980, the European Court of Human Rights has found against the UK in just 13 cases, only four of them concerning family life. But those politicians do not just want to leave the ECHR; they want to repeal the Human Rights Act 1998 as well. They would seek to abolish its 16 core protections, leaving the UK as about the only country with no chapter on human rights.

I say this to Labour Members: instead of fully defending the ECHR, the Government accept the premise that there is something wrong with it—that it needs to be amended and made compliant with Government interests. They talk about article 8 as being redefined—

If I heard the Foreign Secretary correctly, he said that the UK would act if Iran sought to block the strait of Hormuz. Did he mean “act militarily”? In what other conditions would he consider military action, and what would he say if the Americans turned to this Government and asked them for support in any military adventure to do with this conflict?

This has already been an extremely interesting debate. We heard from the shadow Foreign Secretary, the right hon. Member for Tottenham (Mr Lammy)—

I will give way later, but I am not giving way for the moment.

The shadow Foreign Secretary spoke about the huge benefit of our speaking with one voice. The hon. Member for Foyle (Colum Eastwood) talked about there being more cohesion in the House than people currently think. The shadow Foreign Secretary talked about the importance of having some humility, because Members of Parliament are not in the room.

I emphasise that the Government are in the room. There was a call for the tone be lifted; the shadow Foreign Secretary said that we should “come together.” I submit that the right thing to do is to support the Government amendment. The Opposition have been supportive in the past, and the House’s speaking with one voice helped Britain’s argument, which he and I share, in the middle east.

Subject to your advice, Mr Speaker, we will move our amendment, which I want to be sure that the House will consider seriously and in the tone that the shadow Foreign Secretary called for. Our amendment states that the House,

supports Israel’s right to self-defence, in compliance with international humanitarian law, against the terror attacks perpetrated by Hamas; condemns the slaughter, abuse and gender-based violence perpetrated on 7 October 2023; further condemns the use of civilian areas by Hamas and others for terrorist operations; urges negotiations to agree an immediate humanitarian pause as the best way to stop the fighting and to get aid in and hostages out; supports moves towards a permanent sustainable ceasefire; acknowledges that achieving this will require all hostages to be released, the formation of a new Palestinian Government, Hamas to be unable to launch further attacks and to be no longer in charge in Gaza, and a credible pathway to a two-state solution which delivers peace, security and justice for both Israelis and Palestinians; expresses concern at the humanitarian crisis in Gaza and at the prospect of a military offensive in Rafah; reaffirms the urgent need to significantly scale up the flow of aid into Gaza, where too many innocent civilians have died; and calls on all parties to take immediate steps to stop the fighting and ensure unhindered humanitarian access.”

I submit that that carefully crafted amendment ought to carry the vast number of right hon. and hon. Members with the Government as we seek, in this incredibly difficult situation, to forge a common path and a common purpose.

I will do so, but not yet.

This morning I returned from Qatar, as part of the British Government’s collective efforts to make progress on key objectives. I must apologise to you, Mr Speaker, and to the House, because I will need to be absent for part of the debate, as it now extends to 7 o’clock, to engage in other ministerial duties. We all want an end to the fighting as soon as possible, but we must also recognise and understand that a ceasefire will not last if hostages are still being held, and if Hamas still rain down rockets on Israel and maintain control of Gaza with capabilities to carry out further terrorist atrocities. The immediate priority must be negotiating a humanitarian pause, because that will create a window to get more hostages out safely, to get considerably more aid in quickly, and to get further negotiations on a sustainable ceasefire going immediately.

We want the pause to become a complete ceasefire without—I say this to the hon. Member for Perth and North Perthshire (Pete Wishart)—a return to fighting. That is the focus of our diplomatic efforts as talk turns to a military offensive in Rafah, which has the potential for devastating consequences. I therefore welcome the opportunity to reflect to the House on the latest developments. As the Prime Minister said to Prime Minister Netanyahu last week, we continue to support Israel’s right to defend its people against Hamas’ terror, but we are deeply concerned about the loss of civilian life in Gaza and the worsening humanitarian crisis.

Order. Some 397 votes were cast, none of which were invalid. The counting went to four rounds. There were 375 active votes in the final round, excluding those ballot papers whose preferences had been exhausted. The quota to be reached was therefore 188 votes and the person elected Chair, with 204 votes, is Harriett Baldwin. She will take up her post immediately, and I congratulate her on her election. The results of the count under the alternative vote system will be made available as soon as possible in the Vote Office and published on the internet.

With permission, Mr Speaker, I wish to make a statement on global Britain, following the Prime Minister’s written ministerial statement today.

Last Friday, 31 January, the United Kingdom left the European Union. Before then, for three long years, we had debated the European question. Members on both sides of the Chamber were weary and people out in the country were tired of the wrangling, so I think there is relief on all sides that the question is now settled. I know that the point of departure is difficult for many people—decent people who love their country and who did not want us to leave—so it is incumbent on this Government to show that leaving marks not an ending, but a bold new beginning. We take that responsibility very seriously.

When we ratified the withdrawal agreement, this Government and this Parliament finally delivered on the promise made to the British people over three years ago. We did that as a matter of democratic principle. We did it to keep faith with and to retain the confidence of the British people. In doing so, we sent a strong signal to the EU and to the world about our ambition and our resolve as we chart the course ahead. As one United Kingdom, we are now free to determine our own future as masters of our own destiny. We are free to reinvigorate our ties with old allies. We are free to forge new friendships around the world. As we seek those new relationships with friends and partners, the interests of the British people and the integrity of our Union will be the foundation stone of everything we do.

The Prime Minister’s speech this morning and the written statement to the House start us on that journey by setting out the Government’s proposed approach to our relations with the EU in 2020. The most important thing about 2020 is that having left the EU at the start of it, at the end of it we will fully and with absolute certainty regain complete economic and political independence. That is when the transition period ends, and it will not be extended.

We will have a new relationship with the EU, as sovereign equals, based on free trade. Between now and the end of the year, we will work with the EU to try to negotiate a free trade agreement, drawing on other recent agreements, such as the one between the EU and Canada. That should be the core of our future relationship. We will look to reach agreements on other priorities, including fisheries, internal security and aviation. These will be backed up by governance and dispute settlement arrangements appropriate to a free trade agreement, with no alignment and no role for the European Court of Justice, respectful of our democratic prerogatives. We hope we can agree. If we cannot, we will of course carry on trading with the EU in the same way as Australia and many other countries around the world—as a free country, collaborating where we can, and setting our own rules that work for us.

Of course, the EU is not our only trading partner, and at the same time we will be seeking to get agreements with other great trading countries around the world. We are delighted—in the words of US Secretary of State Mike Pompeo, when he was here last week—that the UK is now front of the queue for a free trade deal with the United States. We expect to open negotiations with the US and other countries very soon—in that way we can broaden our horizons to embrace the huge opportunities in the rising economies of the future, where 90% of the world’s growth comes from. My right hon. Friend the Secretary of State for International Trade will set out more detail in a written statement later this week, and I will visit Australia, Japan, Singapore and Malaysia over the next two weeks.

At such a crossroads moment, it is fitting and timely that this Government will engage in a thorough and careful review of the United Kingdom’s place in the world, including through the integrated security, defence and foreign policy review. This review is an opportunity for us to reassess the ways we engage on the global stage—including in defence, diplomacy and our approach to development—to ensure we have a fully integrated approach, because now is the moment to look ahead with confidence and ambition, to signal to our future partners the outward-facing, trailblazing country that we intend to be.

We have a vision of a truly global Britain. The first pillar of our global Britain strategy will be to continue to prove that we are the best possible allies, partners and friends with our European neighbours. We are working closely with our European partners to find a political solution in Libya. We will continue to stand together to hold Iran to account for its systemic non-compliance with the joint comprehensive plan of action, the nuclear deal. We will work together to tackle shared threats and global challenges, whether it is Russia’s aggression, terrorism, rising authoritarianism, climate change or, indeed, health crises such as the coronavirus. It was our honour on Friday to bring home 29 other Europeans on the UK-commissioned charter flight from Wuhan, along with the 97 Britons, because we will always look out for our European friends, with whom we share so many interests. I am grateful to the Spanish Foreign Minister for Spain’s help in co-ordinating that effort and to the French Foreign Minister in relation to the flight that came home on Sunday.[Official Report, 5 February 2020, Vol. 671, c. 6MC.]

The next pillar of our global Britain strategy will be the UK’s role as an energetic champion of free and open trade—to boost small businesses, cut the cost of living, create the well-paid jobs of the future for the next generation, provide more consumer choice and to raise UK productivity, which is so important for our “levelling up” agenda right across the country. The pursuit of shared prosperity has an essential role to play in our approach to development policy, too. As we maintain our 0.7% commitment on development spending, we need to find better ways of making sure it contributes to long-term and sustainable economic growth. As we demonstrated at the UK-Africa Investment Summit, we believe the UK has a unique and competitive offer to tackle poverty and help poorer nations benefit in a way that benefits us all over the longer term.

Finally, the third pillar of our global Britain will be the UK as an even stronger force for good in the world. Our guiding lights will remain the values of democracy, human rights and the international rule of law, and we will lead on global issues that really matter, such as climate change. That is why this year we will host the UN climate change summit, COP26, in Glasgow. We will lead by example and rise to the challenge by harnessing all the British talents in tech, innovation and entrepreneurialism to find creative solutions to global problems. We will champion the great causes of our day, as through our campaign to give every girl access to 12 years of quality education. We will defend journalists from attack, stand up for freedom of religion and conscience, and develop our own independent sanctions regime to tackle human rights abusers head on. Together, united, we can show that this country is so much bigger than the sum of its parts.

I know the hon. Gentleman does not like that commitment, but it is what the Scottish people voted for.

The 31st of January was a day that will be etched in our history. It has been hard going, and I know that many good people on both sides of the House and all sides of this totemic debate still bear the scars of the last three years, but now is the time to put our differences aside and come together, so together let us embrace a new chapter for our country, let us move forward united and unleash the enormous potential of the British people, and let us show the world that our finest achievements and our greatest contributions lie ahead. I commend this statement to the House.

I wholeheartedly concur not only with the criticisms that my hon. Friend has levelled but with his solution, which is based on the development of employment rights that have been consistently undermined in recent decades in this country.

As I was saying, there is a well founded concern that withdrawal will put jobs, investment, trade and employment at risk. The unpredictability of the outcome of this leap in the dark has united virtually every economist and economic institution of any standing, from the International Monetary Fund and the OECD to the Bank of England and the Institute for Fiscal Studies, in expressing their concerns about the risk to the economy. In the past 72 hours, we have witnessed the reaction of the world markets to shifts in the polls pointing to a possible Brexit, with £100 billion knocked off the value of shares, and the value of the pound dropping. The Brexit campaign has done more damage to capitalism in four days than the Socialist Workers party did in 40 years. This comes at a time when our economy is extremely fragile. Six years of unnecessary austerity, the chaotic failure of the various fiscal rules adopted by this Government, and our record current account deficit have made our economy extremely vulnerable to even a minor shock. And as the markets have just demonstrated, leaving the EU would certainly not be interpreted as just a minor shock.

Let me turn to the issue of migration. I believe that the economic arguments for remaining are overpowering—

I want to make an appeal to the hon. Gentleman and the Labour Party: please don’t go near immigration. You have no credibility on that issue. You’re all over the place. You’ve been bullied by the Tories, and raising immigration will only help the leave case.

I am going to do something very unusual, very different and possibly subversive here today with this speech. On one of the days set aside for the consideration of the estimates of this House, I am going to actually speak about estimates. When I was researching my contribution, the one thing I was told that I must not do was to raise the issue of estimates during estimates day debates. What other House in the world would have such an absurd principle of debate? What other modern Parliament would even start to consider doing its business on the basis of such an absurd and ridiculous ruling?

Estimates are not about the allocation of pencils and rulers to the civil service, or even the price of beer in Strangers Bar. The estimates process is this House having to give its authority to the Government’s spending plans. This is what we are doing, in accordance with Standing Order No. 54 of this House, in the three days that we have been given to debate the three large estimates documents I have here. However, they are the one thing we are not supposed to debate! This is absolutely and utterly absurd and bizarre, and it has to change. This cannot go on. Something as important as this has to be considered.

How did we get here? Two centuries ago, the House actually debated and considered every single estimate in the House. Every piece of departmental spend was debated to the nth degree, considered and voted on. Now, we do absolutely nothing. This House has abrogated its responsibility for looking at departmental spend, and that is utterly unsustainable.

Well, the estimates are the estimates, Madam Deputy Speaker. I struggle to think that when we talk about the estimates, the totality of the Foreign Office budget would fit into what we are actually debating and considering. This is a day set aside for the consideration of estimates. We have to debate this. We are abrogating our responsibilities as parliamentarians if we fail to have some sort of say and some sort of discussion and debate about how this House does its business.

On a point of order, Madam Deputy Speaker. This is a most important point. When I was Chairman of the Public Accounts Committee—I am now a member of the Procedure Committee— I produced a report for the Chancellor on this. What the hon. Gentleman says is quite true and he is doing a great service to the House. The fact is that we spend £600 billion of the people’s money every year, but the one thing we are not allowed to talk about on estimates days is estimates. The hon. Gentleman is therefore making a fundamentally important point. When the hon. Member for Southport (John Pugh) tried to talk about estimates on an estimates day a couple of years ago, unbelievably he was ruled out of order. You have the power now, Madam Deputy Speaker, to say that on estimates days we are allowed to talk about estimates. You can give the hon. Member for Perth and North Perthshire (Pete Wishart) authority to carry on giving his speech.

I thank the hon. Gentleman for that point of order, but we are debating a specific motion on the Order Paper, which is Foreign and Commonwealth Office estimates. The hon. Gentleman has been a parliamentarian for a very long time. He understands how this works and he may feel that this is an injustice. There are other places where this can be debated, but today this is specifically about a very important estimate, which is the expenditure of the Foreign and Commonwealth Office.

There are plenty of ways in which the hon. Member for Perth and North Perthshire (Pete Wishart) can debate estimates more generally within this framework, but he must stick to what is on the Order Paper. We are debating a motion and it is very specifically on FCO expenditure. If he can do that, he will not be ruled out of order. If he does not, then I am afraid he will be.

I will make an attempt to stay in order, Madam Deputy Speaker. According to Standing Order No. 54, three days of each parliamentary session is to be allocated for the consideration of estimates. I am attempting to uphold that Standing Order. One of the days on which we are allowed to debate estimates is today. I therefore seek your ruling as to why I cannot debate the estimates on one of the days set aside for estimates.

The answer, as the hon. Gentleman knows, is that this is not a general debate on estimates. This debate is on one particular estimate relating to FCO expenditure. That is, therefore, what we are debating here today. He also knows that the Procedure Committee is the place to go to for answers to more specific questions. There are other ways to have debates on the principle of estimates debates. Today, however, we have on the Order Paper the specific estimate for the FCO. That is what we are here to debate.

As the hon. Gentleman knows—he has been here a very long time—there are Treasury questions, Budget day, parliamentary questions, letters to Ministers, Adjournment debates and so on. There are any number of avenues by which these matters can be debated. Today, we are debating Foreign and Commonwealth Office expenditure on this particular estimates day.

With that, I think that is enough. If the hon. Member for Perth and North Perthshire wants me to rule him out of order I can do so, but if he can just stick to the FCO expenditure and bring his points in under that he will remain in order.

I will give it one last bash, Madam Deputy Speaker. Let us hope we can make a little bit more progress. The hon. Member for Gainsborough (Sir Edward Leigh) is absolutely right. This House has to be given the opportunity to debate this. It is critically and crucially important. If we cannot do it on days set aside for estimates, we have to determine when and how we can do it. If I can just explain why this is important, you can rule me out of order all you want, Madam Deputy Speaker.

This is important for us in the Scottish National party because we have been invited by the Government, by the Leader of the House, to investigate, debate and look at the estimates process to determine the issues around Barnett consequentials, which you and Mr Speaker have to rule—

Order. I think that is enough. I think we have had the debate. The hon. Gentleman has had a debate on the Floor of the House about estimates in general, but we are debating, scrutinising and looking at a very important particular estimate on Foreign and Commonwealth Office expenditure. If the hon. Gentleman can keep his debating points to that matter, I will allow him to continue; otherwise, he will be out of order. It is a particular estimate day, not estimates day. It is a particular day on which we are debating FCO estimates. If he would like to continue I will allow him to do so; otherwise, I will call the next speaker.

It is quite clear that the massive cost involved is largely for the replacement of the submarines. I argue that it is a breach of the treaty to replace submarines that will carry nuclear weapons, because that is an expansion of the nuclear capability, even if the number of warheads carried on each submarine is reduced as a result.

A review is being undertaken within the Government, following pressure from the Lib Dem part of the coalition. It fought the election on the basis of not having a like-for-like replacement of Trident.

The hon. Gentleman is making a passionate and cogent case for the non-proliferation of nuclear weapons around the world. Does he agree that if we pursue this multi-billion pound like-for-like replacement of Trident, the UK will almost commit what can only be described as unilateral nuclear rearmament in the face of every other nation’s attempts to disarm on this issue? Does he also agree that we in Scotland—if we vote yes in the referendum next year—can play our part by putting a shot across the bows of the UK’s nuclear intentions by ensuring Trident’s removal from Coulport in Scotland?
