I certainly take that point from my good friend. The hon. Member has worked tirelessly for the rail workforce, and I know that he means everything he says with passion and conviction. I have talked about the situation being a complex one from a legal perspective, and I would take him back to the contract award for HS2, which went to Alstom and Hitachi. That was challenged in court by Siemens; the Department succeeded on every single point, but that just shows how careful we have to be from a legal perspective during the tendering process, because it will end up in litigation. The worst thing would be to hand out contracts in a manner that is not legally fair and then find that they are being unpicked, which brings fresh uncertainty. Instead, we are looking at the entire order book to see where we can bring matters forward in the pipeline—matters that Alstom may be working on already. Where it is the fair and right thing to do, we are looking to see whether we can bring those contract orders forward in the pipeline.
The situation at Alstom is of great concern to a number of my constituents who work there. However, probably even more of my constituents work in the supply chain, so will my hon. Friend reassure me and my constituents that whatever the outcome of today’s discussions, that supply chain will not be forgotten?
My hon. Friend is absolutely right. We are talking not just about the jobs at the manufacturing plant in Derby, but about all the jobs throughout the supply chain. I work really closely with the supply chain and its trade representatives—the Railway Industry Association and Railfuture—and I am keen to continue to do so. Our work and our endeavour is to try to find a solution, not just for the workforce in Derby working directly for Alstom, but for those who are temporarily employed at Alstom and for the entire supply chain. That is why the Secretary of State is meeting Alstom right now, so that we can try to find a solution for them all.

Commons ChamberI am grateful to the hon. Gentleman for raising that issue and it is very good to see him back in his place. It is difficult to make policy based on anecdote. If he has specific examples and evidence, I would be delighted if he wrote to me or the roads Minister, and we will of course look into the serious matters he raises in the House.
Roadworks that continually reappear on the same stretch of road at multiple locations are a major cause of congestion across the towns and villages in Erewash, particularly in Long Eaton and Sawley. What steps is my right hon. Friend taking, in conjunction with colleagues in the Department for Levelling Up, Housing and Communities, to ensure that utility companies better co-ordinate their work schedules to minimise disruption to road users?
My hon. Friend is absolutely right that that can be a complete pest. Over the last few years, the Government have taken some action to address that. Utility companies have a right of access to highways to install and repair apparatus, and we rely on them to do so in many ways. The Government introduced a number of initiatives, including the development of Street Manager and regulatory changes, which are all designed to improve the efficiency of how such works are carried out and co-ordinated.

Commons ChamberIf there were no commitment to Manchester, the Bill Committee would have been disbanded, but it continues to go ahead for section 2b, and the indicative timescales remain exactly the same for the Crewe to Manchester piece. Its delivery is crucial to Northern Powerhouse Rail. That is why nothing has changed for 2b. I gently add, having been to see the engineering projects for the trans-Pennine route upgrade, that billions are being spent through the Pennines towards York to fully electrify that line, because that is where the bulk of our investment is geared—to the north and the midlands.
Over the past 40 minutes, the Minister will have realised that one of the big issues is blight. What steps is he taking to ensure that those residents who remain blighted by the original HS2 routes, such as those in my towns of Long Eaton, Sandiacre and Stanton Gate, are fully compensated now that their properties are no longer required for the revised route?
The line of route remains the same. There is a two-year rephasing of the section up towards Crewe, but the line of route remains the same as when it was announced. My hon. Friend is right that many constituents have experienced issues as a result of the impact on HS2. The process in place with HS2 ends up in appeals in the Department for Transport. I look at those individual cases, as does the Secretary of State. In some cases, although those constituents may not be strictly entitled to the cost of moving, we have looked at them and decided that their health impacts necessitate a payment and assistance from the Department. I will continue to work with my hon. Friend and all hon. Members to help their constituents.

I know that the hon. Gentleman’s constituency is affected in a big way. I refer to what I said before. This project affects a lot of people’s lives, with demolitions and the rest of it in his patch. He asked me to do this as soon as possible. I have Douglas Oakervee on an unbelievable timetable, supported by a fantastic group of people, to get this done and reported back this autumn. The hon. Gentleman will not have to wait before the end of the year.
Long Eaton, Sandiacre and Stanton Gate are grossly affected by the eastern arm of HS2, but as the Chair of the Transport Committee has already indicated, it brings advantages as well—jobs and growth as well as the pain. I will say two things. One is that any delay causes further stress and uncertainty not just for residents, but for businesses. They will be blighted for ever more, even if my right hon. Friend takes the easier way out and cancels the eastern arm. My plea to him is: do not cancel that eastern arm. I will not allow the east midlands and Erewash to be the poor relations yet again.
I think every exchange indicates that, while everyone is able to welcome a review, when we get to the announcement of that review on the other side the House will not be quite so united, but I absolutely hear my hon. Friend’s comments.

Commons ChamberI share the hon. Gentleman’s frustration, but that is actually already illegal. I am working with a number of charities, including Guide Dogs, to ensure they can complain effectively and that the local authorities handing out licences are far more diligent about who those licences go to. As I mentioned earlier, once we are able to put together a national database, it will be a lot easier to stop people who have already broken the law from getting licences.
It appears that the introduction of the hybrid Bill for HS2 phase 2b has been delayed yet again, causing further uncertainty and stress to my residents and businesses. Will the Minister give a cast-iron guarantee that my constituents will receive a bespoke financial package, given that Long Eaton is grossly affected because the line goes straight through it and put that into the Bill?
I recognise my hon. Friend’s passionate and persistent campaigning on behalf of her constituents and the businesses in Erewash. I also recognise the disruption that HS2 causes for people’s lives and for properties. Support is provided through the statutory and non-statutory property compensation schemes, which aim to strike a good balance between ensuring fair compensation and protecting the public purse. A consultation on design refinement is running up until 6 September, and I urge my hon. Friend to make sure she puts forward her evidence.

I absolutely agree. When I was preparing for the debate I was thinking about Netherfield, as I often do because I have canvassed there an awful lot in my life. Those stations are important to people and provide the ability to get to and from Nottingham or other places.
The figures do not lie, although I know that anything can be proved with figures. The latest statistics show that £70 per head is spent on rail infrastructure in the east midlands and more than 10 times that is spent in London. We can play with those numbers, but fundamentally, there is an extraordinary imbalance that is unsustainable economically—and, frankly, practically—and it will not do. I am a realist, however, and practical, so I am not out with a begging bowl asking for investment levels to be equalised overnight in a vacuum for no purpose. I am here to make a positive case for my constituents and our region to get a good shake of the dice.
I am fortunate that there was investment in a new railway station in Ilkeston not long ago, but even from there, or from Long Eaton station, which is also in my constituency, it is hard to go from east to west, so I welcome the debate. The hon. Gentleman is correct that we need more investment in our railways, so that more trains can stop more frequently at our smaller stations.
I appreciate that intervention. We talk about north and south and going to and from London a lot, but for our constituents and the communities in our part of the world, that east-west link and the link to Birmingham is just as important.
It is the perfect time, after an intervention from the hon. Lady, to mention that HS2 is coming down the line. We still have some significant work to do to make sure that the east midlands is not erased from that map. We have a real opportunity to gear up our region’s infrastructure and economy.

Recent vegetation management alongside the railway has destroyed huge swathes of the Erewash landscape. Will the Minister outline what further steps have been taken to ensure that Network Rail does vegetation management responsibly and does not take the drastic measures it has taken throughout my constituency? It is really affecting the wildlife, as well as my constituents’ wellbeing.
We have been reviewing Network Rail’s environmental performance, and the consequences of the recently published new environmental strategy should follow through all areas of Network Rail’s work. We obviously need to maintain a safe rail network, but we also want to see the embankments and all the Network Rail land deliver environmental benefits. The two are not incompatible. I do not know about the specific area around my hon. Friend’s constituency, but I am happy to look at it. As regards the overall picture, we have seen some real change and progress in this policy area, and it will be a priority for the future.

Commons ChamberFirst, let us be clear: there is no perfect, off-the-shelf system available to airports that will simply deal with this problem overnight. I pay tribute to those in the police and the military, and across government, who responded so quickly to the Heathrow problem, ensuring that the runway was closed for a very short length of time, and to the team at Heathrow who did the same.
Now that the consultation on the High Speed 2 working draft environmental statement has closed, has the Minister had any indication of when HS2 Ltd will publish its response? Can she ensure that every submission will be given careful consideration?

Commons ChamberOrder. The hon. Member for Erewash (Maggie Throup) is in a category of her own. She is the only hon. Member standing who has thus far not asked a question this morning. I know that colleagues will agree, in a spirit of equality, that their own need is secondary to hers.
What assessment has my right hon. Friend made of the review into non-statutory property schemes for High Speed 2, and why did it fail to deliver a bespoke package for Long Eaton, which has been promised by Ministers on more than one occasion?
My hon. Friend and I have had many discussions about Long Eaton. I am very keen to make sure that we have done the right thing by the different people affected by the proposed railway line through Long Eaton, whether it is the businesses affected or the people who live in the railway cottages. If there are things that we are not yet doing, I suggest that she and I sit down and go through it again.

My hon. Friend is right. Many community organisations, some very successfully, have achieved greater self-sufficiency and sustainability by cross-subsidising what can be thought of as core community transport services with income from contracts for school and social care transport, for example.
And so to the bombshell of last summer. At the end of July, in what the Department seems to have hoped would be a relatively innocuous letter from a senior official to issuers of section 19 and section 22 permits, it set out a new approach, which was contrary to the official guidance that had been applied for decades but in line with a new interpretation of EU regulation 1071/2009, which has been in force since 2011. This is the crux of the matter: there is a potential misalignment of the relevant sections of the 1985 Act and its associated guidance and practice, and EU law.
The European regulation defines three derogations from the operator and driver licensing requirements on the mainstream commercial sector: where organisations are engaged in road passenger transport services exclusively for non-commercial purposes; where they have a main occupation other than that of road passenger transport operator; and where organisations have only a minor impact on the transport market because of the short distances involved. Member states can choose whether to apply the third derogation.
The Department’s letter noted the findings of a DVSA investigation into the licensing arrangements of an individual community operator in Erewash, Derbyshire—I see the hon. Member for Erewash (Maggie Throup) is present. Essentially, that investigation, which was conducted in response to a complaint from a commercial operator, found that as the operator in question held a number of competitively tendered local authority contracts, it could not be considered to be operating for non-commercial purposes.
Is the hon. Lady aware that to date this is the only case that has been brought forward in response to this letter issued by the DFT?
Yes, the hon. Lady is right—absolutely. For years, guidance and practice in the UK had considered “not-for-profit” and “non-commercial” to be interchangeable terms. The DVSA investigation and the DFT’s letter signalled a completely new interpretation. The consequence for the operator investigated by the DVSA was that it could no longer operate on the basis of community transport permits, because—according to the new interpretation—the derogations from full public service vehicle operator and passenger carrying vehicle driver licensing did not apply.
It is a pleasure to serve under your chairmanship, Mr Davies. I, too, congratulate the hon. Member for Nottingham South (Lilian Greenwood) on securing the debate.
As I reflected when I led a Westminster Hall debate on this issue back in December 2015, community transport occupies a unique central ground between the passenger transport industry and the voluntary sector, providing innovative solutions to the otherwise unmet transport needs of local residents. Figures suggest that Erewash Community Transport alone generates £1.3 million of social value for the communities in which it operates. We all agree on the importance of these types of transport services run for and by our community, so the changes made to the guidance with regard to section 19 and 22 permit holding organisations are particularly concerning.
The problem appears to have arisen as an unintended consequence of what is, in my opinion, poor EU regulation, rather than any specific action taken by Her Majesty’s Government. Where operators such as Erewash Community Transport are affected, Ministers have announced that they are making £250,000 available to help to fund advice for those drivers requiring a public service vehicle licence. Ministers have also issued new guidance to the Driver and Vehicle Standards Agency to ensure that a proportionate approach is taken to enforcement for operators who demonstrate that they are working towards that compliance. I accept that this situation is far from ideal, but from conversations that I have had with the Minister, it is evident that the Government are doing everything they can within the scope of the law to mitigate this issue.
As part of the Select Committee’s evidence-gathering process, it heard oral evidence from the chair of Erewash Community Transport, Mr Frank Phillips. Although I cannot say that Frank and I always see eye to eye on everything, as he also serves as a local Labour councillor, we have a shared passion for the community transport sector and agree with members of the Transport Committee that the social value of what these organisations do in providing essential community-based transport services to vulnerable people who would otherwise suffer isolation is paramount. I am confident that the Minister shares that view and would urge him to continue in his efforts to negate the negative impact of the revised directive and to look at what further steps his Department can take to ensure the continued success of a sector that benefits my constituents in Erewash, as well as the wider community as a whole.
