I am delighted to have secured this Adjournment debate on the practice of the long-term tethering of horses. Tethering is the practice of attaching horses to a stake in the ground using a collar, or sometimes just a piece of rope around the neck, that is then fastened to a chain. The animal that once defined our great nation is now being left at risk of neglect, cruelty and abuse because of loopholes in the very legislation that was written to protect it. This debate follows the Break the Chain campaign run by the excellent HorseWorld trust, a leading equine rescue charity in the south-west, just next door to my constituency. The Break the Chain campaign aims to amend the Animal Welfare Act 2006 to include restrictions on the tethering of horses.

Traditionally, tethering has been used as a short-term method of keeping horses, but it has transformed into a method of retaining horses without having to purchase land, by using public or private grassland, often by the side of busy roads, for grazing. Because the tethered animal can be moved quickly, it is easy for people to tether a horse on land that does not belong to them and then move the animal before the authorities can identify the landowner or the owner of the animal. This results in it being virtually impossible to monitor the welfare of these animals, leaving around 3,500 horses in a state of potentially compromised welfare with little or no chance of intervention from charities.

There are a number of reasons why there has been such a large public response to the public campaign. In my constituency and the constituencies that surround it in the west of England, there is a big problem with tethering. There have been incidents where horses tethered by the roadside have been visible from the council offices in Yate, but despite this being a clear breach of the Animal Welfare Act, it could not be acted upon because the law does not state explicitly that tethering is a welfare concern. Unfortunately, because these horses are not protected by law, most cases of tethered horses that HorseWorld gets called to do not end well. The horses are simply moved before the Control of Horses Act 2015 can take effect. One incident saw a tethered horse break free near a large shopping centre at Cribbs Causeway in south Gloucestershire, next to a major road. By the time the horse was rescued and able to be seen by a vet, the injuries that it had sustained, most likely from having been hit by a car, meant that it had to be put down.

I thank the hon. Gentleman for bringing this important subject to the Adjournment debate tonight. The British Horse Society is on record as stating that although many horses will thrive on a diet consisting only of grass, it is vital that tethered horses are moved regularly to ensure a constant supply of fresh food, and that during the winter months or at any other time when grass is scarce, additional work and feeding needs to be carried out. Tethering is clearly not a long-term solution for any horse, and this has to be looked at. Does he agree that the change to the legislation that the Minister has a chance to bring in would be a way of addressing the issue?

It is a genuine pleasure be intervened on by the hon. Gentleman in an Adjournment debate, and he is absolutely right. I will come on to some examples of how long-term tethering has been detrimental and caused death to animals in a number of cases. The nature of tethering means that it does not require large amounts of land, so horses can end up tethered in inner-city locations. A pony in south Bristol spent years tied to a tree on a grass verge and was harassed by local children and frequently escaped on to roads. The reality is that that was not a one-off.

Do the majority of such incidents involve horses or ponies owned by Travellers who are just moving through?

That can often be the case. If we are looking to change the legislation, we must ensure that we stamp out tethering and animal welfare abuses regardless of who owns the animal, but my hon. Friend is right to highlight that point.

As I said, such incidents are a regular occurrence. In 2016, a pony was found tethered among fly-tipped rubbish. It was so badly tangled up in a discarded bicycle that it could not even stand. This pony, which had a life-threatening injury, was lost to the authorities after the owner simply moved it and tethered it in another location before they could arrive. Sadly, just before Christmas last year, a member of the public came across a pony that had been tethered in a wooded area. The tether had become tangled around the surrounding trees and, in a desperate effort to break free, the one-year-old pony had strangled himself and lay dead in the mud at the end of his tether. It is therefore clear that the practice desperately requires stricter regulation.

HorseWorld, the charity that started the campaign, was spurred into action by the alarming case of a mare that gave birth to her foal while she was tethered. Unable to protect her foal from the other horses who roamed free in the same field, the mare became seriously distressed. Of course, protection of the young is one of our most basic instincts. Research into tethered horses in Wales, where tethering is rife, showed that 10% of tethered horses had young foals. Those are just a few examples of the horrors associated with long-term tethering, but because tethering is not restricted by law, people can tether horses unchecked beyond the reach of the law, resulting in tethered horses reaching despicable stages of neglect before they can be rescued.

I want to touch on the current regulations and legislation surrounding equine welfare and explain why they are not protecting tethered horses in practice. The Minister may refer to the Department for Environment, Food and Rural Affairs code of practice, which acts as a guide to safely tethering horses, but the code is not being adhered to in reality, as demonstrated by an investigation conducted in south Wales in 2014 by the excellent University of Bristol’s veterinary school, which gave five main conclusions.

First, the code of practice states that water should be made available on a regular basis in a spill-proof container, but the research concluded that up to 90% of animals were not given water regularly. Secondly, the code states that animals should, as a minimum, have shelter from the sun and wind and that the area should be well drained in the event of heavy rain, but the research tells us that no shelter was provided in over 80% of cases. Thirdly, animals should be given the freedom to exercise off the tether for a reasonable period at least once a day. In reality, however, less than 3% of horses spent more than five minutes a day off the tether, and no one would argue that five minutes is a reasonable amount of time. Fourthly, according to the code of practice, the tethering site should not contain anything that might injure the animal, but the reality is that sites contained potential hazards in 50% of cases. Fifthly, the code states that tethered horses require a high level of supervision, with inspections

“no less frequently than every 6 hours”.

However, it was found that only a third of horses were visited that regularly. While we have a code of practice, it is clearly not being adhered to, and the fact that an individual can move an animal before they ever reach the stage of being prosecuted renders the code of practice redundant.

If a horse is tethered and left, the area around the tether will soon have no grass and will become muddy if it is wet, hugely damaging the horse. That is one of the other problems of tethering.

My hon. Friend is right about damage to the environment, and I urge colleagues to look at some of the photos of horses that have been treated so badly. I mentioned the pony in south Bristol that was tied to a tree, and the surrounding area was a small stretch of grass between a pavement and the road. Yes, there was huge damage to the local environment, but there was damage to the pony, too.

The code of practice informs us that tethering is not a suitable long-term method of managing horses, as does the RSPCA, the British Horse Society, World Horse Welfare and Redwings, but absolutely nothing can be done legally to prevent someone from tethering a horse for its whole life.

Further, long-term tethering directly infringes the five freedoms set out by the Animal Welfare Act 2006: the need for a suitable environment; the need for a suitable diet; the need to be able to exhibit normal behaviour patterns; the need to be housed with, or apart from, other animals; and the need to be protected from pain, suffering, injury and disease.

A tethered horse is not free to express natural behaviours. A horse that is free to roam will, on average, walk or run 10.6 miles a day, and the reality is that a tethered horse can come nowhere near that. As my many colleagues who keep horses can attest to, horses are flight animals. A horse’s most basic instinct is to flee from danger, which tethering does not allow. Tethering restricts a horse’s most natural behaviour.

I thank the hon. Lady for her intervention. We are seeing horses being tethered all across the country, potentially leaving them open to neglect, cruelty and abuse, and potentially posing a danger to the people around them, too.

Tethering is not deemed enough of a breach of the Animal Welfare Act to allow horse charities to intervene. A tethered horse also does not have the freedom to interact with its own species, as the Act says it should. Leaving horses isolated has been shown to increase stress levels and stress-related hormones, which can cause them to display stereotypical behaviours that cause physical and psychological harm.

Stereotypical behaviours are strongly linked to isolated horses; stabled horses tend to perform behaviours that engage with the stable around them, such as crib biting or weaving. Horses that are tethered long term have a total lack of environmental stimuli, so they are much more likely to develop stereotypical behaviours such as pacing or self-mutilation. This clearly raises questions about the clarity of the existing legislation and regulations on the grounds for removing a horse from a tether and on the capacity of law enforcers to act.

Long-term tethering is in direct conflict with legislation, yet in many instances authorities have not felt that the Animal Welfare Act is strong enough grounds to rescue horses, despite the obvious suffering. It is therefore my belief, and the belief of the charity that initiated this campaign, that the Act needs to be amended to state explicitly what constitutes inappropriate tethering.

One of the reasons why this is such an emotive subject is the location of tethered horses. As I said earlier, the main purpose of long-term tethering is free grazing, so horses end up on any strip of grass available, with the roadside, grass verges and even the middle of roundabouts, as we have seen in south Gloucestershire, being popular choices. It goes without saying that this is not remotely appropriate. Horses are easily spooked by traffic, and if the tether were to fail, there would be a loose horse on the road.

Advances in equine and animal science mean that we are much more able to understand what constitutes poor welfare, but our laws have not caught up with that deeper understanding. When I met HorseWorld staff, who are so passionate about what they do, I was told about a pregnant mare that escaped her tether and got on to a busy A road, where she narrowly avoided being hit by a lorry. Police had to attend the scene to monitor the horse until HorseWorld could assemble a team at 3 am. If the tethering laws were stricter, the lives of the mare and her unborn foal would not have been risked, a lorry driver would not have had to make an emergency stop on a main road and numerous hours of police time would not have been wasted.

That leads me on to my second point, which has been raised by other equine welfare charities in a number of reports: only appointed animal welfare officers or police constables have the authority to seize an animal. However, councils are in no way mandated to employ an animal welfare officer, so many choose not to do so. Our understanding is that as many as 40% of councils do not employ an animal welfare officer. In these areas, the police are the only organisation that has the power to rescue an animal from a situation where its welfare is compromised. I therefore ask the Minister to update us on what steps he is taking to gain a deeper understanding of the depth of the problem. The result of this situation is that police time is being spent attending horse rescues, which often just involve hours spent holding a horse at the side of the road when it had got on to the road. Only a police constable, once contacted, can authorise a charity to remove a horse. It is clear from written parliamentary questions I have tabled that the Government have no idea about the amount of police time that is spent dealing with these incidents. Clearly, police time can be better spent in the community. Having clarity over who should be dealing with equine welfare complaints will reduce the time that it takes to deal with them and will save the lives of animals. The councils that do employ animal welfare officers need to ensure that they are trained to handle horses. That could easily be achieved by collaborating with voluntary organisations.

Let me now address what needs to change. In the past, DEFRA Ministers have said that the current legislation appropriately meets the needs of tethered horses. The 19,000 people who signed a petition to get the tethered horses rescued from Rovers Way in Cardiff would disagree. The 12,000 people who have emailed their MPs about getting tethering laws tightened would disagree. I also think that all the experts who have been in touch with me and the voluntary organisations calling for stricter laws on tethering would also disagree.

There are therefore four changes that I would like to see incorporated into the 2006 Act to improve the lives of horses. The first is that there should be a 24-hour legal limit on how long horses can be tethered for. That is important, because DEFRA’s code of practice states that long-term tethering is inappropriate. That needs to be clarified, backed up and given status in law. The second is that there needs to be a complete ban on tethering horses on the roadside or in dangerous locations. The third is that if a tether is someone’s only method of keeping an animal, they should not be allowed to keep that animal. The fourth is to make it a mandatory duty for local councils to employ an animal welfare officer or to ensure that arrangements are in place with neighbouring authorities to ensure that those officers are in place.

There is currently too much room for interpretation within the legislation. It needs to be clear-cut that long-term tethering infringes on equine welfare, leaving horses at risk of harm and suffering. We need to give the relevant authorities the means and confidence to rescue horses that desperately need protection. We need to step up and take action to protect these most majestic and iconic animals. Making these changes will protect thousands of horses across our country. Minister, please help us and break the chain.

8. Can the Minister update us on what analysis the Treasury has conducted of the effectiveness of the apprenticeship levy in helping young people get into high-paid roles once they finish their apprenticeships?

We are seeing a growing number of young people taking up high-quality apprenticeships, which is fantastic news. We were able at the Budget to improve flexibility, so that it is easier for small and medium-sized enterprises and companies in the supply chain to take on apprentices.

Yes, my hon. Friend is right. The Government have delivered eight straight years of economic growth, over 3.3 million more people in work, and higher employment in every region and nation of the United Kingdom. Wages are growing at their fastest pace in almost a decade, and the deficit is down by well over four fifths. In the Budget, we have gone further, cutting taxes and funding our vital public services.

With the tax gap now at its lowest level on record, does the Chancellor agree that this Government have done much more to ensure that the taxes that are owed are paid than the Labour Government ever achieved?

My hon. Friend, who is an excellent Member of Parliament in the west of England, is right. We get lots of suggestions from the Labour party about what we should do about tax. Labour was in office for 13 years and had Treasury Ministers answering questions for 13 years. Not a single one of these things happened when they were in charge, and no one believes that if Labour were ever back in charge, it would be tough and take action.

First, I wish to associate myself with the call made by my hon. Friend the Member for Eastleigh (Mims Davies) for people to shop locally. Before coming to this House, I worked in retail from the age of 16, so I would say to people that the next time they are in south Gloucestershire, they should go to the high streets in Chipping Sodbury or Thornbury, which are two of the most beautiful in the UK.

I also wish to clarify a point. It was said earlier that the deficit was cut by just a third before the election, not a half, but figures released by the Office for National Statistics on 22 September demonstrate that public sector net borrowing fell between 2009-10 and 2014-15 from 10.2% to 5%, which is a fall of more than half in the last Parliament.

Managing a country’s finances and responsibly managing taxpayers’ money is one of the most important tasks of any Government. When the Government came to power in 2010, the country was borrowing more than £150 billion a year and unemployment had increased by nearly half a million. We had the second biggest structural deficit of any advanced economy. There have been some huge achievements over the past six years: as I have said, the deficit is down by more than half; there are over 900,000 more businesses, which have contributed to creating 2.5 million more private sector jobs; employment is up by over 2.1 million ; there are more women in work than ever before; unemployment in my constituency is down by over 60%; and there are more women in work there than ever before, too. But the job is not done, and I urge the Minister to remind this House that there is more to do.

There are risks in the global economy that are threatening this country. I urge the Minister to stick to the plan and principles that have got us this far. I want to see those 2 million more jobs delivered, so that unemployment in my constituency can continue to fall. I want to see the 3 million more apprenticeships delivered, so that South Gloucestershire and Stroud College in my constituency can continue the excellent work it is doing by training more apprentices. I want to see taxes cut so that when those young people start apprenticeships or go into work they will be keeping more of their own money. I want to see us reform welfare, so that we can assure those young people that work always pays. I do not want to explain to my children, grandchildren and great-grandchildren why my generation has burdened them with more debt than they can ever hope to repay.

Positive economic news has continued to come in the past few weeks. The OECD has forecast that we will be the joint-fastest-growing major advanced economy this year. The CBI has forecast that the UK economy will grow by 2.4%. The UK’s trade deficit narrowed in September, construction grew in October and manufacturing growth accelerated in October. A World Bank report has ranked the UK sixth for “ease of doing business”, so we are up two places from last year. I know that there will be more difficult decisions to come in the years ahead, but this Government will work tirelessly to continue to tackle them. It is clear from what we have seen over the past five years that markets, manufacturers and businesses around our country and in my constituency have confidence in this Government. I congratulate the Government on their fiscal management and policy, and ask that we plough ahead with our long-term economic plan.

Thank you, Mr Speaker, for giving me the opportunity to speak in this debate. I will keep my remarks brief, because I know that a number of colleagues wish to speak.

Specific reforms announced in the Budget should be discussed in the context of the new deal announced by the Chancellor. The problem is that some Members of the House want to pick and choose the elements of that new deal, welcoming the extra spending but never endorsing any of the difficult decisions that the Government have had to take. The current situation is this: Britain is home to 1% of the world’s population, generates 4% of the world’s income, but pays out 7% of the world’s welfare spending. We are currently spending more on family benefits than Germany, France or Sweden.

This Government were elected six months ago with a mandate—an instruction—to balance our books and to reform welfare, as stated in our manifesto. I have listened to Opposition Members, but we have to seek to avoid the mistakes of the past. Spending on tax credits more than trebled under Labour in 10 years, while in-work poverty rose by 20%. In 2010, 90% of families were eligible for tax credits—a disproportionate amount. After these budgetary changes, that will be reduced to five in 10, a much more sustainable number. Ultimately, these changes will return tax credit spending to pre-crisis levels—the level under the Labour Government in 2007-08—and deliver £4.4 billion of savings in 2016. That money can be invested in our national health service.

I will not give way because time is short.

Where do we go from here? We can either run a high welfare, high tax, low pay economy or continue with the job of reforming our economy to have high pay, low tax and lower welfare. Controlling welfare spending is part of this Government’s wider offer to working people. We are raising the personal allowance so that by the end of this Parliament people will not have to pay anything on the first £12,500 they earn. We are introducing 30 hours of free childcare for working parents—tax-free childcare worth another £2,000 a year. We are freezing fuel duty and introducing the new national living wage. These reforms cannot be viewed in isolation. They form part of this Government’s new wider deal with the British people, supporting people into work and ensuring that we deal with our debts now rather than burdening our children, grandchildren and great-grandchildren with more debt than they can ever hope to repay. That is why I will support the Government this evening.

Thank you, Mr Speaker, for giving me the opportunity to speak in this debate. I will keep my remarks short, because several other colleagues wish to speak.

This Government were elected just over four months ago with a clear mandate to get our country’s books in order, balance our finances and run a surplus. Our manifesto included the commitment to make £30 billion of savings, including £12 billion in welfare. Although the deficit was halved in the last Parliament, Britain is still borrowing too much money, with a budget deficit of 5%. The sheer scale of tax credits is

“subsidising lower wages in a way that was never intended”.

Those are the words of the former Chancellor Alistair Darling.

Under Labour, spending on tax credits more than trebled in its 10 years in office. In fact, as my hon. Friend the Member for Havant (Mr Mak) pointed out, the original tax credit system cost just £1.1 billion in its first year, but will reach a cost of almost £30 billion this year. Reductions in spending are therefore vital to ensure that we are not burdening our children, grandchildren and great-grandchildren with more debt than they can ever hope to repay.

In 2010, 90% of families were eligible for tax credits, which was a disproportionate amount. After these Budget changes, that will be reduced to five in 10, which is a much more sustainable number. Ultimately, the changes will return tax credit spending to pre-crisis levels—to the level that it was under Labour Governments in 2007-08—and deliver £4.4 billion of savings in 2016-17.

The Chancellor’s Budget delivered the promised increase in the personal tax allowance, which will rise to £11,000 next April and to £12,500 by 2020. The living wage will be £7.20 an hour, and employers are already pushing wages up to match that figure. That is equivalent to annual gross earnings of £13,100 for someone aged 25 or over working 35 hours a week. The projected increase to £9.35 an hour will increase the figure to £17,100 for someone aged 25 or over working 35 hours a week, which is a huge increase in a basic salary. In general, the losses from the combined effect of the threshold reduction and the taper increase will be greater for tax credit claimants with relatively high incomes, which is vital to ensure that our welfare system is kept affordable and provides support for those most in need.

In summary, the Government have a clear mandate to control our spending, to reform welfare and to balance our country’s finances. The proposed tax changes, combined with the increased personal allowance and the introduction of the first national living wage in the first Conservative Budget for 18 years, demonstrate that this Conservative Government are committed to creating a higher wage and lower tax economy. I believe that these changes will put our welfare system on a long-term sustainable footing, and I will support them today.

Let me give the hon. Gentleman a figure: 200,000 workers in Scotland will gain from the new national living wage, which is 9% of the workforce. The Budget is offering people in Scotland and across the United Kingdom higher wages, lower taxes and, yes, lower welfare, as part of a new contract whereby this country lives within its means. That is one reason why jobs are being created in Scotland.

T2. I welcome the Chancellor’s recent announcement on Sunday trading hours. What steps can he take to ensure that neighbouring authorities take a joined-up approach, so that consumers have confidence in the consistency of Sunday trading hours and we provide the maximum possible benefit to our economy?

I remember visiting a vibrant high street in my hon. Friend’s constituency before the general election. It is for local areas to decide whether to extend Sunday opening hours and to work in partnership with other local authorities. My personal view is that doing so will help to protect the high street because an increasing amount of online shopping is done on Sundays. However, it will be for local people and local authorities to make that decision.

I congratulate colleagues on the excellent maiden speeches we have heard this afternoon. My hon. Friend the Member for Kensington (Victoria Borwick) made a passionate speech about the work she wants to do for the House and what brought her here. My hon. Friend the Member for Brecon and Radnorshire (Chris Davies) reminded me, as another Member of Parliament who represents a rural constituency, that the green of these Benches reminds us of home when we are so far away. The hon. Member for Paisley and Renfrewshire South (Mhairi Black) made a passionate speech. I very much enjoyed her signpost analogy and might well use it myself in future.

This was by far the most aspirational Budget I have seen delivered. It speaks to people who want to get up, work hard and get on in life. It promises that work will be rewarded, and seeks to cut taxes and let people spend their hard-earned money as they see fit.

People who work on the minimum wage in my constituency, as I did for a number of years, will take great pride in the implementation of the living wage. I am sure they will also be extremely pleased to know that the Government are clamping down on tax avoidance on a scale never seen before. For those who are successful, who put money away and who want to support the next generation, it is a welcome step that the inheritance tax threshold has been raised.

I should like to discuss the Chancellor’s proposals for devolving Sunday trading hours rules. I am a retailer who has worked in supermarkets since the age of 16. I remember somebody on the campaign trail telling me they would vote for me if I could tell them the price of milk. They were very surprised when I told them not just the price, and how many millilitres were in the carton, but that the barcode was 20076795, and that they could get it mix-and-match with a loaf of bread at best value at the shop round the corner.

I am familiar with the Sunday trading hours rules and they have caused me and other retailers no end of frustration. I understand that there are concerns about the reforms among some smaller retailers and have spoken to a number of retailers in my constituency in the past few days. Many stores are extremely keen for the right to trade when and how they wish, as they already do online, but Stanshawe service station, a local business in my constituency located within a mile of a Tesco, a Lidl and a Morrisons, is concerned that it could lose business to larger stores if opening hours are relaxed.

The Government’s stance is the right one. The internet is a risk to the high street and I want shops to have the freedom to work and innovate wherever possible. I have heard stories of stores doing whatever they can to ensure cash flow by bending the Sunday trading hours rules and serving customers on Sunday when opening hours are restricted. I understand that, in some cases, stores even provide computers for customers to order the product online before giving it to them inside or just outside the store. The stores do not want to break the rules. They simply want to be able to trade freely at times when they know they can sell their goods.

The internet does not rest on a Sunday. In 2011, online sales accounted for just 8.3% of all retail sales. That figure is now at 11.2%. Wherever we can, we must help stores manage that shift in consumer behaviour and for some stores—especially those that serve weekend activity, such as garden centres—Sundays can be the busiest trading day of the week because of the nature of the business. It is right that local authorities can determine the opening hours of such businesses.

I absolutely agree that we should do everything we can to support retailers, including the option of trading online. Removing the restrictions on Sunday trading will give consumers and families the flexibility that they need. People who work in small businesses often have Sunday as their day off, because it can be an easy day to manage stores. Current restrictions mean that their first day off—Sunday—is often the least productive and, in the modern world and the retail industry, convenience is key.

I will work closely with local shops in south Gloucestershire to ensure that their voices are heard when local authorities consult on these changes. It is vital that any consultation includes all retailers in any area, and that small shops in the catchment area of larger stores and supermarkets have a strong voice locally in any consultation.

In conclusion, I once again voice my support for the Budget, and I look forward to hearing ones like it in the future. We should support workers by ensuring that work always pays, encourage employers and free the market to provide what the public demand. The Budget delivered the Conservative promise and supports our long-term economic plan to get this country moving forward.

Across the British financial system, there has been a very marked reduction in our exposure to the Greek economy and banking system over the past couple of years, so we are much less exposed to the direct consequences of financial problems in Greece than we would have been a few years ago. More broadly, that is also the case across the European economy. The biggest risk that we faced a few years ago was our exposure to economies and banking systems in other eurozone countries that had relationships with Greek banks, but they too have reduced their exposures.

We all urge the people of Greece to reach a resolution to the current situation. Does the situation not perfectly demonstrate why Britain needs a credible economic plan that keeps our economy secure when there is uncertainty abroad, as well as when there is stability?

My hon. Friend is absolutely right. The situation illustrates why you need a credible economic plan, why you need to make sure that your country is protected from shocks happening around the world and, in short, why you should fix the roof when the sun is shining.
