Clause 2 is purely a fail-safe if, for whatever reason, DOHL—the operator of last resort—does not have the capacity to take in a private operator’s contract at the moment it expires. We have allowed ourselves that flexibility if taking on a contract is not practically possible but, to demonstrate that it is not enabling franchising or private operations by the back door, we have also included the provision to remove that power again, to make sure that public ownership remains the default. It will happen only in exceptional circumstances for a very limited time.

As the railways’ passenger-in-chief, I am acting decisively today. This is the only response to the failure of privatisation to deliver reliable and affordable services for passengers. It also makes financial sense, saving tens of millions of pounds each year in private sector fees. That money can now be reinvested in the railways. Running the railways in the interest of passengers and taxpayers, not to the benefit of shareholders, also makes operational sense.

As a long-suffering Avanti West Coast passenger, I welcome the Government’s prioritisation of this Bill, but does my right hon. Friend agree that railway workers should not be outsourced? Will she say a little about what she intends to do to ensure that they are not?

Network Rail has done a considerable amount of work on insourcing over the last few years, and I will ask it to do a more comprehensive review to see whether there is further it can do. As private operators are brought in, their contracts and supply chains will be considered, to ensure that they are delivering the best possible service for passengers. My hon. Friend raises a very important point.

The case for public ownership should not be controversial. After all, rail infrastructure was brought into public ownership by the last Labour Government following private sector failure. Germany, France and Spain, our European neighbours, all have models of public ownership. Indeed, the architect of the previous Government’s rail reform plan endorsed Labour’s plans ahead of the general election.

As has been said, four franchises—Northern, TransPennine, Southeastern and London and North Eastern Railway—are already in public hands and have seen some improvements. As someone who relies on TransPennine, I accept that it is still far from perfect, but cancellations have fallen from 20% in January 2023 to around 5% since it was taken into public ownership. LNER recently achieved a financial surplus, which was returned to the taxpayer.

Bringing the remaining 10 operators under public control will take time but, as passenger-in-chief, I am putting them on notice. I will not tolerate the status quo, I will not hesitate to demand improvements, and I will not be afraid to rip up contracts early if operators default on their obligations to the public.

The Bill means that the railways will finally be run for the public by the public, but owning the house is just the first step. Next, we must fix the crumbling foundations. That means fundamental reform, no ifs and no buts. We will set up Great British Railways as a new directing mind. Running the network, both track and train, as one integrated system will finally put an end to the fragmentation and waste that make our railways among the least efficient because of their spiralling costs and falling revenues, competing interests and industry inertia.

We will build a growing, innovative railway that is relentlessly and single-mindedly focused on passengers. There is no questioning the benefits at stake. Because GBR will take a whole-system view, we will be able to simplify the overly complex fare system so passengers can be confident that they are getting the best value. We will take aim at overcrowding by moving rolling stock to where it is needed in the network. We will end the piecemeal approach to innovation and roll out benefits such as digital pay-as-you-go and digital season tickets, and we will put accessibility at the core of our rail offer so that passengers with disabilities can expect a consistent level of service.

Of course, such change does not happen overnight. That is why setting up GBR and delivering our plans in full will be the focus of separate legislation later in the Session. But we will not sit back and wait for that legislation to be on the statute book; we plan to use every lever available to us urgently to improve services for passengers. That includes creating shadow Great British Railways, which will focus squarely on driving improvements in the short term, from ticketing to better services. This is a crucial next step, putting passengers back at the heart of the railways and firing the starting gun for reform.

We have already begun to see the restoration of some peak-time services. It is also worth saying that very few people use the open return-price ticket—I certainly did not use it when I travelled down from Manchester on Sunday, and nor would many other travellers. We are starting to see improvements. We are seeing the profile of new drivers joining the service. Drivers already in training will be able to start driving trains before the December improvement plan is in place. However, we are clear that this is a probationary period and we look forward to seeing the outcomes.

I and my constituents know only too well that the Avanti West Coast line is the worst performing on the rail network, although the workers do a great job and should be commended. My great city of Liverpool will be hosting the Eurovision song contest in my Liverpool, Riverside constituency next year. We need an efficient and effective service to get people to the city and support the local economy. Does the Minister agree that, instead of rewarding failure, it is time to terminate the contract and bring the service back in house?

We are all looking forward to the delivery of a successful Eurovision in Liverpool, or Lviv-erpool, as some people are deciding to call it—[Interruption]—although I understand that there is some disappointment from colleagues who were hoping that Glasgow would be the venue. Certainly, the rail network will need to play a key part in making sure that we can support that event fully.

As I have touched on a couple of times, just stripping Avanti of the contract today would not be a magic bullet to solve the problems we are seeing. Avanti has its improvement plan for December, we are working closely to monitor progress on it, and we are clear that we expect to see significant and sustainable improvements following that plan, ahead of taking a final decision in April.

My right hon. Friend is absolutely right about the skills that have been demonstrated by extraordinary British seafarers over many years. This is key to the Government’s vision of what we want to achieve, and it is particularly important to me personally. We remain committed to doing what we can to support seafarers, and all the strategies the House has heard me talk about, from Maritime 2050 onwards, remain the case. Our focus on maritime skills remains. The Government are still determined to do all we can to develop British seafarers and to continue as a maritime nation, as we have always been. He can be assured that determination remains undimmed.

My right hon. Friend rightly speaks about employment rights, which are extensive in this country. They exist for good reason, they continue and the Government support them.

As the MP for Liverpool, Riverside, I am disgusted by the actions of P&O today. Liverpool is one of the routes that will be affected by this action, and it is another example of fire and rehire by a despicable employer. Why have this Government stood by and ignored it? Actions speak louder than words, Minister, so let us take some decisive action against P&O.

It is a pleasure to serve with you in the Chair, Mr Robertson. I join my comrades in thanking my hon. Friend the Member for Birkenhead (Mick Whitley) for securing today’s important debate.

This Government have attempted to make levelling up their watchword of the day, but instead of tackling regional inequalities, they are rolling back on their promises, abandoning northern towns and cities to cope with failing transport infrastructure.

The integrated rail plan was seen as a once- in-a-generation opportunity to tackle fragmentation, deregulation and underfunding in our railways. It recommended a new line between Liverpool and Manchester, which would have transformed Merseyside, promising to bring 100,000 jobs to urban areas across the north and contributing £3.4 billion to the economy by 2040. Instead, the north has once again been failed, with no significant improvements to journey times, compromised capacity for local and freight services, and the promise of severe disruption and delays.

The bleak reality is that, with spending per head in the north half of that spent in London, transport across Merseyside and in the broader region is woefully lacking. People needing to get to work on time or get to hospital appointments are left wanting, forced to travel for hours. In failing to integrate Liverpool into High Speed 2 and the Northern Powerhouse Rail network, this Government have undermined economic growth in the city region. It has condemned us to up to six years of disruption to existing lines coming in and out of Liverpool, costing at least £280 million in every year of that disruption. If this Government are truly serious about levelling up for so-called left behind areas such as my own city of Liverpool, they need to put their money where their mouth is. Instead, they have shown once again that their promises ring hollow.

Labour leaders in the north-west and elsewhere are leading the way in investing in integrated sustainable transport systems. Liverpool’s metro Mayor Steve Rotheram has done some incredible work to roll out state-of-the-art, fully accessible and publicly-owned trains for the Merseyrail network later this year. He has already begun to deliver on a 600 km network of cycling and walking routes for the city region. He has secured £710 million to invest in further infrastructure improvement, including new green bus routes, and he submitted a welcome bid of £667 million to re-regulate and increase bus services across the network, to begin the roll-out of zero-emission hydrogen vehicles and to slash bus fares.

The task before us is enormous. We need radical change to undo the decades of decline of our transport network. The piecemeal policies and additional funding allocated so far do not face up to the scale of the challenge ahead. Instead, we need additional powers for combined authorities to bring services such as Merseyrail into public hands. We need the Government to engage with, support and finance the radical and ambitious transport plans that the metro Mayor is implementing.

My right hon. Friend is absolutely right about contactless travel. I mentioned that the experiment that happens to run out to Welwyn Garden City has been enormously popular. The problem with actually running the system out is that, as soon as someone crosses more than one different train operating company, or even if they do not and there is only one, there is a huge resistance in the system, because it is so incredibly complicated, with its fragmented nature at the moment, to bring that in. Great British Railways will allow us to bring in more contactless travel, which he will clearly warmly welcome, and I should mention his phenomenal campaigning on the subject of transport for his commuter constituency, particularly in Tunbridge Wells and Paddock Wood. I notice all the time how hard he is working for them and I think these reforms will be warmly welcomed by his constituents.

The Labour party has long argued that public ownership of the rail network will provide better value for the taxpayer and for passengers, who deserve more than rhetoric from this Government, and yet again, the Government have not gone far enough. Secretary of State, Great British Railways is not the biggest shake-up of the railways in the last quarter of a century; it is just another example of papering over the cracks. Can he give assurances here today that this will not lead to thousands of job losses and attacks on workers’ terms and conditions?

I am sorry that the hon. Lady does not agree with quite a number of her colleagues across this House. Rather than dogma and worrying about whether it is public or private, as if there is some sort of clause IV incentive to set this up in a particular way, why do we not just do what works for commuters and for passengers? There was nothing about British Rail that worked last time in favour of passengers—except for, as I say, closing stations, closing track, serving terrible sandwiches. I do not know why we would want to go back to those days and this Government will not do that. Instead, we will do what works, and what has been working is doubling the number of miles that passengers have been taking on trains to the highest on record by 2019, before covid. The reforms today with Great British Railways are designed to take that further forward.

When are the Government going to give the financial support package to the aviation sector, as the Chancellor promised in March, so that we can ensure the protection of workers’ rights, particularly those at British Airways and EasyJet?

As I mentioned in previous answers, billions of pounds have gone into support for the sector, and even once all those schemes have been exhausted, there is a programme run specifically by the Treasury that enables bespoke support to the industry. I cannot go into details because those are confidential arrangements, but they do already exist.

My hon. Friend is right. Across Government, we are working with the sector, at pace, and with officials and representatives, to get those measures in place so that people can get back into the air and travel as soon as possible. I caveat that with the point that ultimately, limiting the spread of coronavirus and keeping the UK population safe must be our priority, but I am determined and will work hard to find a solution.

As we have heard, British Airways has taken public money from the Government’s coronavirus job retention scheme that was intended to protect workers’ jobs, and instead it has used it to put 12,000 workers on notice of redundancy. The purpose of the scheme is to keep people in work, not to let them go on the cheap. Will the Minister join me in condemning that behaviour, and will she ensure that any further support will protect the workforce as intended?

Shareholders and employers should consider their social responsibility to the people in their businesses. They take the benefits in the good times, and they should share the burden when times are harder, particularly when in receipt of taxpayer moneys. As I have said, I will do all I can to ensure that that is understood by those organisations.

As my hon. Friend has outlined, just as I have a number of times today, the Court of Appeal judgment is complex. We are considering it, and we will set out our next steps in due course. On regional connectivity, we are committed to delivering airport expansion that is in line with our environmental obligations. We are also committed to levelling up, and ensuring that people are able to travel, whichever part of the country they live in, and that obviously relates to local and regional airports.

Keith Williams has been tasked by the Government with leading a root and branch review into the rail industry, and he has confirmed that he will recommend scrapping the current franchising system. Full details will be set out in the White Paper which, all being well, will be published before summer.

I thank the Minister for his comments. Passengers in my constituency and across northern England welcomed the decision to bring Northern Rail into public ownership on 1 March, following the collapse of Arriva Rail North. In the past decade, more than £178 million has been paid in dividends to Northern Rail shareholders, while simultaneously, there have been cuts to safety-critical staff on trains and stations. Research has shown that if our railway was in public ownership, we would save £1 billion a year—enough to fund an 18% cut in rail fares. Will the Minister assure Members that Northern Rail will be kept in public ownership, to rebuild the trust and confidence of rail users, and that it will not be privatised at the earliest opportunity?

First, may I push back on the hon. Lady’s point about safety, which is completely incorrect? That issue is regulated by an independent body, and she is wrong. Since privatisation, we have seen the number of passenger journeys more than double, as well as more services and better trains. Northern Rail’s fleet is now being replaced with new trains, and that will be finished by the end of May. I very much hope that the new system will include a profuse and large group of private companies that want to run services for us.
