At the heart of this issue, I believe, is accountability. What should happen to Members who break the rules, and how open should our procedures be? What should the public be allowed to know?

Let me say at the outset that I am very sorry that the Speaker feels that my revealing his decision not to have a debate in the House about our Committee’s report has put him in a bad light with the public. That was never my intention. My intention—[Interruption.] If Members allow me to develop my speech, they will hear my points. My intention was merely to let the public know what had been decided.

I am accused of breaking a rule myself, and I would like to explain the circumstances to the House. I am a member of the Digital, Culture, Media and Sport Committee. We held a hearing with the then Culture Secretary, the right hon. Member for Mid Bedfordshire (Ms Dorries), at which she claimed that a Channel 4 reality series in which she had appeared some years ago had used actors pretending to be members of the public. She claimed that they had confessed this to her. A member of the production team who lived on the estate concerned—

Order. I am sorry that the hon. Gentleman missed my opening remarks, but it is quite clear that this is not about the actions of any other Member. It is not about what happened in the Committee with any other right hon. Member. It is about the motion before us.

Thank you, Madam Deputy Speaker. Let me say that there was considerable press interest in our Committee’s work, and I decided that we should send a copy of the report to the Speaker. I thought that time might be set aside for a debate about referring it to the Committee of Privileges. However, the Speaker wrote back to me saying that he did not believe the case met the threshold for a debate. I recorded a video summarising the Speaker’s decision, and I tweeted it. I offered no comment about the Speaker, nor did I criticise him. There was considerable public interest, and I soon discovered that the Speaker was angry. He believed that I should not have reported his decision. Last Wednesday, he told me in the House that he thought I had not summarised him accurately, and that I should not have reported him at all. It was not my intention in any way to summarise him inaccurately.

Before I was elected to the House, I was a journalist—a reporter for “Newsnight”, among other current affairs shows. I believe in open democracy, but I also believe in maintaining agreed confidentiality. It did not cross my mind that revealing the Speaker’s decision on this was a breach of privilege. After all, what was I to say if journalists asked me whether I had written to the Speaker? Was I to say, “Yes”? If they asked me, “Has the Speaker responded? Has the Speaker given a ruling?”, was I then to say, “I’m afraid I can’t tell you”? I did not consider that I had broken any confidence or betrayed any trust. I did not imagine that the Speaker’s decision on a matter of importance to my constituents could not be revealed. Moreover, I believe that I summarised the Speaker fairly, but I am in the unfortunate position of finding myself unable to prove that, because in order to do so I would have to release the Speaker’s letter to me in its entirety—something which, as we have established, the Speaker does not believe I should do.

There has been a suggestion that I printed only half the letter. That is not the case. The Speaker’s letter to me came as a letter through the post. There was no need for me to print it, nor did I publish it, nor did I show its contents to the camera, nor did I leak it to others. I was very open in the way I talked about it, which I hope shows that I did not think I was behaving improperly. There has also been some suggestion that the Select Committee did not wish to see this matter proceed to a privileges debate. That, too, is not the case. The Committee decided not to refer the Member concerned because she was no longer a Cabinet Minister, but the Committee left open the option for others to do so. Indeed, some Committee members expected that to happen. I agreed with the findings of the Committee, which were unanimous and cross-party.

The right hon. Member for Haltemprice and Howden (Mr Davis), who wrote to the Speaker asking for this debate, has just spoken again. I have never met the right hon. Member or spoken to him here, although I may have interviewed him in the past. He is not a member of the Select Committee, and he has previously championed free speech.

The right hon. Member for Haltemprice and Howden spoke last Wednesday following the Speaker’s remarks from the Chair, and he laid into me with some vigour, using what appeared to be a pre-prepared speech. He was especially exercised by what he saw as my breach of parliamentary etiquette. It is worth me pointing out in that context that he did not contact me to inform me that he planned to speak about me, which as we all know is the convention. I was not afforded the opportunity to reply last Wednesday, but before moving on to other business the Speaker concluded:

“I am going to leave it there for today”.—[Official Report, 23 November 2022; Vol. 723, c. 292.]

I therefore assumed that the matter had been laid to rest. However, the right hon. Member then took to Twitter to pursue his criticism of me, complete with a video of his speech.

I have been in this House for 21 years, and as you know, Madam Deputy Speaker, I have been a member of the House of Commons Commission for something like four years. I had absolutely no idea that we could not reveal that we had had correspondence with the Speaker or summarise what it was. How on earth was my hon. Friend supposed to know that, when I, with my 21 years in this House and my service on the Commission, did not know it? All of this seems to be, at best, some sort of means for retribution and, at worst, institutional bullying, because that is what it is starting to feel like right now.

Order. Interventions can be made, but they should be brief. I would also remind hon. and right hon. Members that if the House decides to refer this matter to the Committee of Privileges, these sorts of arguments can be made there. This debate is on the simple matter of the motion. Other arguments can be made to the Committee if the House decides it wants the matter to go to the Committee.

I know that the Speaker has been on the receiving end of often unpleasant comments from the public since I revealed his decision. That was never my intention. I did not use his name, I did not link to him and I did not post contacts for him. I am very sorry that a pile-on has ensued. I have friends across the House, and I believe in vigorous but fair debate. I have no time for abusive behaviour; I do not engage in it and I deplore it.

I am advised that I breached a parliamentary rule by referring to the Speaker’s letter, but as I have explained, I did not knowingly do so. I would never reveal a confidence. I did not believe that the Speaker’s decision on a parliamentary matter was a secret. Indeed—this is perhaps not a matter for today—should there not be a distinction between correspondence containing confidences and correspondence on policy decisions? Has every Member who has revealed a Speaker’s decision by letter found themselves the subject of a parliamentary privilege debate, as I am today? Although this convention appears to exist, is it not the very antithesis of open democracy? Many Members on both sides of the House have told me privately that they did not know this rule existed.

I should declare an interest as another Member who appeared in the very same reality show that the hon. Gentleman’s Committee discussed. He has not apologised to the Speaker. Does he not think that, having betrayed what was marked as private correspondence, which clearly and rightly aggrieved the Speaker, if he had given an apology at the time when it was raised by the Chair last week, he would not be in this position now? Why did he not do that? Would he not like to bring back at least some decorum by apologising profusely to the Speaker and the House now for the offence he has caused?

The hon. Gentleman says the letter was marked “private”. I do not know how he knows what was on the letter. I have shown the letter to absolutely nobody. But since he challenges me, the letter was not marked “private”. If it had been, I would not have talked about it. It is a core belief of people in my former profession that we hold confidences and that we will go to prison rather than reveal our sources. The letter was not marked “private”. It was about a matter of policy on whether or not a debate could be held, and I did not think that it was confidential.

The hon. Member has said that he was aware that the Speaker had become very angry. As the Speaker serves all of us, and as this is all about decorum, is it not time that he apologised to the Speaker? Maybe that would resolve a lot of things.

I want to answer that question honestly. I am slightly torn because, on the one hand, I am deeply sorry that the Speaker is upset. Those who know me will know that I do not ever conduct politics in a way that aims to be offensive, and I am truly sorry that the Speaker is upset. I am truly sorry that I have upset the Speaker, but it would be disingenuous of me to say that I knowingly revealed this. I could not have been more open by going on camera and discussing this. I clearly was not trying to hide it. If people in my profession—my former profession and this profession—want to pass things into the public domain in a sleekit or surreptitious way, they give them to journalists. I did not do that. I stood up and talked about the letter, not revealing its contents in detail but summarising it.

This place often seems hard to understand for the general public, and its procedures can appear opaque. I suspect that most people will find it curious that the Member who misled the Select Committee was subject to no consequences but the Member who revealed that—

I withdraw that remark. I, however, am subject to the current debate. I note that, over the years, these debates have been confined to people who have committed or been accused of committing some of the most egregious offences, but I have yet to meet a Member who thinks this falls into that category.

I want to conclude by saying again that it was never my intention to insult the Speaker. I do not know him well but we have only ever had friendly exchanges when meeting. I bear him absolutely no ill will. I deplore any and all online abuse that he has suffered. Nobody, I imagine, is enjoying this debate—least of all me. I find interpersonal conflict stressful and unpleasant. I hope the House concludes that there was no malicious intent in anything that I did, and I apologise to the Speaker for breaching a House rule, but given the all-party nature of the Committee report I sought no party political advantage and I hope that Members here today will seek no party political advantage. My only motivation was to do what I always try to do, and that is to engage with the debate and to communicate my work here with constituents and with journalists as openly and fairly as I can.

I thank my right hon. Friend the Member for Haltemprice and Howden (Mr Davis) for moving the motion. I deeply regret it, but I understand why he has had to do so.

I heard what the hon. Member for Ochil and South Perthshire (John Nicolson) said today, and I am glad to see him in the Chamber. I do not think his argument that he was not aware of the right course of action or of the appropriate response to journalistic inquiries, which is to state that any such correspondence is confidential, is a reason for not passing the motion. I sincerely hoped he would make an apology. I think there is consensus across the House about the right course of action. Had he taken that opportunity, the matter could potentially have been brought to an end today.

The procedure for raising breaches of privilege is a long-standing and important convention that ensures the privileges and rights of this House are protected.

We now have two potential press regulators, both of which are independent, running self-regulatory systems with sanctions, and certainly represent a considerable improvement on the Press Complaints Commission, which went before. It is still early days and obviously we will watch carefully to see how the new system operates and whether it is delivering the proper protection that we all want to see to ensure that the abuses that have taken place in the past do not happen again.

We all support freedom of the press and broadcasters, but in the case of the BBC we also expect our national broadcaster to reflect the society in which we live. I am sure that the Secretary of State will have seen highlights of the House’s recent debate on BBC diversity. All sides were in complete agreement that there is a striking shortage of black senior managers, an inexplicable lack of openly gay and lesbian presenters in high-profile news and current affairs roles and a shocking absence of older women on screen anywhere. The House agreed that the time for BBC studies and targets had passed and that action was overdue. Has the Secretary of State had a chance to pass that on to the director-general?

I have quite a lot of sympathy with the hon. Gentleman’s comments. Obviously, we are still in the process of drawing up the new BBC charter but I can assure him that this issue will feature in the White Paper when we publish it, I hope quite soon. It is something we take seriously. I do not believe in instructing the BBC or setting quotas for the number of ethnic minority faces, older female faces or, indeed, Scottish faces that appear on screen or behind the camera, but all those groups, and others that are currently underrepresented, need better representation and that is what we are working to achieve.

I join my colleagues in thanking our hon. Friend the Member for Stirling (Steven Paterson) for calling this debate. Although my contribution comes towards the end of it, I would like to begin by talking about the start of the West Highland Way—both its origins as Scotland’s first long-distance walking route more than 35 years ago and the town of Milngavie in my constituency of East Dunbartonshire, which is the official beginning of the walk.

While walking on the slopes of Ben Lomond after the second world war, the creator of the West Highland Way, Tom Hunter, noted the building developments on the western shores of Loch Lomond and thought of ways to limit the same thing happening on the loch’s eastern shores. As we have heard, Tom was a keen walker himself, loved the outdoors and, together with his wife, Margaret, and their walking companions, decided to design a long-distance walking route from Glasgow to Fort William. The idea of this long-distance, signposted route was not universally supported at the time. It is hard to imagine that now, but there was significant opposition from landowners—quelle surprise, some might say—and the Countryside Commission. However, Tom persevered and the West Highland Way was officially opened on 6 October 1980.

As we have heard, Tom sadly passed away last month at the age of 90. My local paper, the Milngavie & Bearsden Herald, wrote that he was

“a modest man whose achievements were far from ordinary.”

It is evident from this debate that his legacy has benefited the Scottish economy, the Scottish environment and the Scottish people.

Of course, the West Highland Way is traditionally walked south to north. That not only helps to keep the scorching Scottish sun from one’s eyes, but allows walkers to enjoy their time in Milngavie. As many people will know, Milngavie marks the northernmost point of the Roman empire. Having conquered Gaul, Hispania and of course Anglia, the Romans were halted in their tracks by the douce charms of the locals and built the Antonine wall—some say to keep the locals out.

These days, visitors can appreciate the town’s charms and history, relax in cafés and restaurants in Milngavie precinct and of course stock up on supplies before beginning their own adventure. It is an adventure, it has to be said, that many begin in some discomfort. The Romans may have instituted indoor water closets—“cludgie-orums”, as they were known locally in Latin— but the East Dunbartonshire Labour, Lib Dem and Conservative council has yet to catch up on Roman plumbing, refusing, despite an active local campaign, to provide a lavatory for the thousands who pass through the town without being able to pass, literally—not so much spending a penny, but council penny-pinching.

I thank my hon. Friend very much. I recognise a fellow MP’s pain when I hear it.

The West Highland Way plays a significant role in Milngavie’s economy and those of other towns and villages along the route to Fort William. Some 39,500 walkers each year complete the route, along with many thousands of others who walk part of the trail. As we have heard, that generates £5.5 million of tourism revenue and directly supports approximately 200 businesses.

In a wider Scottish context, walking is clearly the most popular nature-based activity for UK residents holidaying in Scotland, with 47% of total UK visitor trips involving some form of walking activity. Studies have shown that long-distance route users are twice as likely to use accommodation, and spend twice as much on food and drink, as the average holidaymaker—although possibly not the average Member of Parliament from Scotland. That provides a huge financial contribution to the hotels, bed and breakfasts and shops in Milngavie and along the route. Many businesses simply would not exist without the West Highland Way. That includes the unique and innovative Travel-Lite, which for 21 years has transported the luggage of walkers from Milngavie to various points along the route for those who do not want to carry their own body weight in spare clothing and equipment.

Conveniently connected to Glasgow city centre through rail, bus and road links, Milngavie also prospers from day visitors who come to walk part of the route on weekends and during holidays. It is not uncommon for many visitors to walk just a wee bit of the route in the morning and to return in the afternoon, spending and contributing to the economy of the beautiful town that I am so fond of, Milngavie, in my constituency.

One of the key factors that led to the inclusion of specific routes in a recent review by Country Walking magazine of Britain’s 50 greatest walks was sufficient variety along a route to maintain interest. One of the most popular routes—possibly the most popular—is the West Highland Way. Within 30 minutes of starting the way, walkers will leave my constituency. They will be able to look out over Glasgow and Strathclyde and look forward to the castles, mountains and distilleries not far in the distance. They will be entering the countryside towards the highlands, having left the bustling city, with busy streets and planes overhead from Europe, North America and the middle east delivering the next cohort of walkers ready to tackle the way.

There is a significant international dimension to the West Highland Way, because it attracts people from all over the world. It is estimated that the Scottish Government’s proposal to reduce air passenger duty will create nearly 4,000 jobs and add £1 billion to the Scottish economy by 2020. That would surely benefit the West Highland Way, among other places in Scotland. However, out of 28 European Union countries, only Denmark and Slovenia have higher VAT rates than the UK. As we have heard, the Republic of Ireland has significantly reduced VAT on tourism, and the Treasury must explore the possibility of reducing VAT to support tourism in Scotland.

We can all agree, I hope, that the West Highland Way is a national icon and its name is immediately recognisable worldwide as being Scottish. It harnesses some of Scotland’s greatest assets—our biggest city, our largest loch, the last remaining Roman wall north of the border and our tallest mountains—and it delivers significant benefits to our economy, environment and society. Its contribution, locally and nationally, is vast.

I agree with my right hon. Friend very strongly. This year is the 400th anniversary of Shakespeare’s death. It is an enormously important event and the BBC has a crucial role to play. I had the pleasure about 10 days ago of watching the filming of Ben Elton’s new comedy, “Upstart Crow”, which is based on Shakespeare. As my right hon. Friend says, I suspect that that is the sort of thing that only the BBC would do.

Does the Secretary of State agree that the proposals of BBC Scotland to strengthen its news output by investing in jobs and production for an entirely editorially independent “Scottish Six” programme, anchored from Scotland, are a development that all of us across the House can welcome as an example of a long-term commitment to public service broadcasting? Will he just promise us that there will be no interference from Downing Street?

I had a very good meeting with Fiona Hyslop a couple of weeks ago to talk about the way in which the BBC meets the requirement to serve all the nations and regions of the United Kingdom. I obviously welcome any investment at the BBC that will create additional jobs, particularly in Scotland, which I know the hon. Gentleman will value. How the BBC goes about meeting the obligation to serve the nations and regions is a matter for the BBC. Certainly, neither I nor my colleagues in No. 10 would want to instruct it on how to go about it.

I would love to take this opportunity to praise the scout movement and all the volunteers and voluntary organisations that do so much for the arts. Their contribution should not be forgotten; we should not simply look at those organisations that are funded by the Arts Council.

On the issue of disadvantaged communities and their languages, the Gaelic language is the most endangered in these islands. Why, therefore, in the autumn statement did the Government withdraw their total direct UK funding of £1 million, and can I ask him to reconsider?

As the hon. Gentleman knows full well, there were two one-off grants in the last Parliament to support that important work, and those contributions have made a valuable difference, but they were not annual grants stretching way back into the past. They were two one-off grants strongly supported by the then Chief Secretary.

Officials have kept the Treasury informed about the methodology adopted by the independent options appraisal and have taken advice from the Treasury on the treatment of major projects, such as the restoration and renewal of the Palace, in terms of the Treasury’s Green Book business case guidance. It would be premature to discuss the cost of specific options until the Joint Committee on the Palace of Westminster has concluded its work.

Given that the project will be paid for by the taxpayer, have there been discussions about how the House will liaise with the Treasury about keeping costs under control and how best to provide ongoing scrutiny for Members?

Clearly, there will be such discussions, given that restoration and renewal will be a costly project. If the hon. Gentleman has strong views, I encourage him to submit evidence to the Joint Committee, which will take evidence until 22 January. I am sure the Committee will want to take his concerns on board.

We support the video games industry, not least with the £4 million prototype fund, which we recently launched with Abertay University, based in Dundee. I was delighted when Tech North announced last week our new visa policy to allowed highly skilled people into the country to support the highly successful Scottish and indeed UK games industry.

The Secretary of State will recall that when he came before the Select Committee on Culture, Media and Sport on 9 September, he said:

“At the moment, there are no plans to sell Channel 4”.

Shortly afterwards, on 24 September, one of his officials was photographed marching into Downing Street clutching a memo that said:

“work should proceed to examine the options for extracting greater public value from the Channel 4 Corporation…focusing on privatisation”.

That is devastating news for the creative industries and current affairs. I have a simple question: when did his officials break the news to him that they were working on privatisation proposals for Channel 4 behind his back?

May I say what a joy it was to see the hon. Gentleman at the PinkNews awards last night at the Foreign Office where I was privileged to present the public sector equality award to the Ministry of Defence? I wish to put on record my congratulations to the Ministry—[Interruption.] I am pleased to hear the hon. Gentleman say from a sedentary position that it was a mutual pleasure. I can also say with pleasure that of course he would expect us to look at every option when it comes to considering the future of Channel 4.

My right hon. Friend makes an interesting point, but as I have suggested to the hon. Member for Cambridge (Daniel Zeichner), it is a matter for individual sports governing bodies as to whom they sell their rights to, and each governing body will want to weigh up the balance between maximising the revenue that will go into sport and trying to ensure that as many people as possible have the opportunity not just to watch but, I hope, to participate.

Will the Secretary of State tell the House exactly how he plans to involve the Scottish Government in the charter renewal process? Lord Smith says that the Scottish Government should be involved, but he is a bit vague about the process itself.

I have been in correspondence with the Scottish Government Minister and we have given an assurance that we will abide by the terms of the Smith commission agreement. We will, therefore, involve the Scottish Government and, indeed, the Governments of the Welsh and Northern Ireland Assemblies in the charter review process. I shall give further details in due course.

My hon. Friend is absolutely right to say that we have to stop that illicit trade. We work with partners in the global coalition to put in place international sanctions to prevent the illegal trading of Syrian and Iraqi antiquities. We also have an effective legal framework to tackle the illicit trade, including specific legislation for antiquities from Iraq and Syria.

I congratulate the Minister on his reappointment. What support can we give through our museums, universities and galleries to protect and preserve artefacts already removed from areas under ISIS control?

If you will indulge me, Mr Speaker, I would like particularly to welcome the hon. Gentleman to the House, although he did defeat a colleague of mine from the coalition Government. He is an old friend; I hope that that does not hurt his career in the House.

The hon. Gentleman’s point is well made. The British Museum, for example, leads the way in helping to preserve antiquities that have been saved from looting. All our museums, working with both the Department for Culture, Media and Sport and the Department for International Development, will continue that work.
