I beg to move,

That this House has considered International Men’s Day.

It is a privilege to lead this debate. I thank the Members of all parties who have shown their support for it by being here today, and particularly my hon. Friend the Member for Shipley (Philip Davies), who has led debates about International Men’s Day in the last two years.

International Men’s Day, which is on 19 November, is now marked by 70 countries around the world and has been part of the annual events calendar in the UK since 2010. Its objectives, which apply equally to all men and boys, include the promotion of role models, a focus on male health and wellbeing, the improvement of gender relations and gender quality, and the creation of a safer world for us all. In the UK, International Men’s Day takes a gender-inclusive approach and therefore believes in ensuring that issues affecting women and girls are resolved, too. The themes in the UK this year are: making a difference for men and boys, and how we can give men and boys better life chances.

I stress that International Men’s Day is international. Although I am sure we will speak a lot about matters in the UK, we should not forget the challenges affecting men and boys around the world, which include boys having to be soldiers and the targeting of men, which we have seen in the conflicts in the middle east. That is not at all to forget what happens to women and girls. We must remember what is going on around the world, but I will concentrate on the situation in the UK. There is so much to talk about. All I can really do is skirt across a number of issues, but I know that hon. Members will go into other areas in more depth, and I welcome their remarks.

I will start with role models. I would like to recognise the huge number of men in the UK who work positively every day for their families and their communities, and who actively promote equality not just in their words but in their actions. People often ask, “Where are the male role models who can inspire other men and boys?” The answer is that they are in every community, but they often need to be encouraged to share their experiences—their difficulties as well as their successes. By their very nature, good role models are often reticent to speak about themselves and often do not even recognise themselves as role models. They think they are just doing their best, often in difficult circumstances. I think of a close friend who, as a leader of an organisation that works with hundreds of young people in north Staffordshire, is a great role model. He would be the last person to recognise himself as a role model, but he is, including to me.

How can we support such people? I suggest that promoting people publicly as role models is not necessarily the best way, and it is certainly not the only way. Everyone has their failings, and some of the media like nothing better than to raise someone up only to knock them down when they turn out to have feet of clay, as we all do. However, supporting the work of genuine but often unassuming role models who have a positive influence on men and boys and on women and girls can be really effective.

It is not difficult to identify them. Ask most local councillors, community workers, police officers and police community support officers, and they will know people who are great role models on the ground. We should see how they can be supported in their work, and perhaps supported to expand it. I have seen great and lasting work in my constituency and elsewhere by people in the scouting and guiding movements, boxing clubs and Duke of Edinburgh’s award groups, as well as by open youth groups run by committed professionals and volunteers.

The Government’s answer to problems is often new initiatives involving new organisations, which are given substantial sums of money but fold when that money runs out. In my opinion it is much better, where possible, to help existing people or organisations that have a proven track record over many years, but they are often the last to be considered for support.

I turn to health and wellbeing. Men are more likely than women to die prematurely; one in five men dies before the age of 65. Mortality under the age of 75 from cardiovascular diseases is twice as high among men as women, and it is three times as high among men for diseases that are considered preventable. Mortality before the age of 75 from cancer is almost twice as high among men as women, and it is 17% higher in cases of preventable cancer. There is so much more work to do to improve men’s health.

I congratulate the hon. Gentleman on securing this debate. Does he agree that one of the issues is improving male awareness about health? If the television breaks down, we men get the TV repair person in; if the lawnmower is not working, we take it to the gardening shop; and if the car breaks down, we take it to the garage, but we seem to be reluctant to go to our GP when we are suffering from a mental or physical health issue. We need to ensure that everybody—but particularly men, who have been reluctant to deal with personal health issues—goes to their GP or to the relevant health professional when they have such issues.

I totally agree; the hon. Gentleman anticipates what I was about to say. As he says, there is clear evidence that men are less likely than women to seek help when they are sick. That is certainly true of me. I have sometimes been reluctant to go to the doctor in case it turned out that I had something serious, as if the very act of seeking help would make it more serious than it was. I do not think it is just me. I did not want to confront the possibility of having a serious illness.

Good public health work has been done to ease people’s fears of seeking medical help if they think something is wrong—I think the NHS recognises that—but there is a greater need for health education, starting at school, to promote healthy lifestyles and to encourage people to consult their doctor early if they believe something is not quite right. I have recent personal experience; a close friend, who was not yet 50, had his cancer caught too late because, due to the nature of his job, he understandably attributed the symptoms to work-related stress when they were in fact much more serious.

Men should not worry that they will waste valuable NHS resources by going to their GP because they have unusual discomfort in their stomach, a persistent cough or problems passing water. Any NHS professional would prefer to allay their patient’s fears by showing that the problem is not serious—or, if it is serious, to catch it early and hence greatly improve the prospects of cure.

We have a serious problem with mental health among men and boys. Some 76% of all suicides in the UK last year were among men. That is 4,287 lives lost to suicide—more than two and a half times the number of deaths on the UK’s roads. The suicide rate has fallen in the last 35 years, and I welcome that, but the fall has been greater among women than men; it has fallen by 50% for women, which is wonderful, but only 14% for men. Suicide is the leading cause of death of men between 20 and 49.

The Samaritans commissioned research on the issues surrounding male suicide, which I will go into in some detail because they are so important. It found that men from the lowest social class who live in the most deprived areas are up to 10 times more likely to end their lives by suicide than those in the highest social class from the most affluent areas. This is undoubtedly a matter of inequality. Men in mid-life are most at risk, which surprised me. Men compare themselves against a masculine gold standard, to which having a job and providing for the family are essential, especially for working-class men. Men—I speak here from personal experience—are far less positive than women about getting formal emotional support for their problems, and when they do it is at the point of crisis. There is also a well-known link between unemployment and suicide; unemployed people are two to three times more likely than those in work to die by suicide, which is why combating unemployment is an absolute moral mission.

I congratulate the hon. Gentleman on obtaining this debate. I am sure that he agrees that more needs to be done about the mental health of not just older men but young men. In my constituency, suicides have risen dramatically. The youngest person to commit suicide was 12, and one was 15. More needs to be done to help young people, especially those from deprived areas, who have social difficulties.

I absolutely agree. I will read all six of the Samaritans’ recommendations, because they are so important. The first is to recognise and take on gender and socioeconomic inequalities in suicide risk—to follow the evidence, not the preconceptions. The second is to ensure that suicide prevention policy and practice takes account of men’s beliefs and concerns, and the context of what it is to be a man. The third is to recognise that loneliness is, for men in mid-life, a significant cause of their high risk of suicide, and to enable them to strengthen their social relationships—frankly, women are usually better at doing that than men. The fourth is to ensure explicit links between alcohol reduction and suicide prevention strategies, because often the two are taken apart when they should be much more closely linked. The fifth is to support GPs to recognise the signs of distress in men and ensure that those from deprived backgrounds receive a range of support, not just medication—it seems that men from poorer backgrounds are often given much more medication than counselling and other support. Finally, and very importantly, the sixth recommendation is to provide leadership and accountability at local level, and I congratulate councils who are taking this seriously up and down the country.

I would like to hear from my right hon. Friend the Minister on how he believes we can all work together to tackle suicide in all people, and particularly the tragically high rate of male suicide. I have not gone into great detail on some of the excellent initiatives, whether sports initiatives or peer communicators, which perhaps others or the Minister will refer to, but it would be good to hear more about that.

I turn to the access rights of fathers and children. One of the saddest things I have to confront, on an almost weekly basis, in my surgeries, as I am sure all colleagues have, is the fallout from partnerships and marriages that have gone wrong. The problem is almost inevitably one of two: either a father is neglecting his responsibilities to contribute to the maintenance of his children, or father and children are denied access to each other. The causes are complex, especially in cases of the latter, and I am no expert. However, I have no doubt that, in some I have seen, there has been a deliberate attempt to use all means possible to prevent the father from seeing a child or children, just as I have seen cases in which fathers have used all means possible to avoid their responsibilities to contribute to child maintenance.

My hon. Friend is touching on an important issue. Is he aware of the growing number of examples of parental alienation, in which one parent deliberately turns children against the other parent in order to stop access, even when people are contributing to their children’s upbringing?

Sadly, yes. I have seen that on several occasions, and I remember one in particular in a surgery a few years ago that was just devastating; a father had lost access to all four of his children. It was very sad indeed. As I say, we need to be balanced in the debate, because there are many cases of fathers who have totally neglected their responsibilities. Both issues have to be addressed.

We must be more determined to stop people ignoring or playing around with agreements or court rulings. Such actions deny parents and children the financial support they need or the access to each other that is so critical to the development of both parents and children. I know this is a difficult area. When families have to resort to law, there is already great sadness, but when they do so, the law needs to uphold the rights and demand the responsibilities of all involved. I understand that a Green Paper on family justice will be published in the coming months and I hope that that will tackle these issues.

I turn briefly to education, on which I am sure others will speak. There is so much more for boys and men to achieve in education. In 2017, the average attainment 8 score for boys in state-funded schools was 43.4, compared with 48.7 for girls—the equivalent of about half a grade lower per subject. Only 39% of boys achieved the highest grades in both English and Maths—grades 9 to 5 in the new system—compared with 45% of girls. When it comes to higher education, the Higher Education Policy Institute published a report that identified higher drop-out rates and lower degree performance for males. However, there were other indicators where males were doing better, so the picture in higher education is not clear cut.

There are no straightforward answers to the discrepancies, as I am sure the Minister, who probably has more experience in this area than anyone in the Chamber, will appreciate. The best answer is to seek to improve attainment for all children—all students, whether male or female—but we cannot ignore the discrepancy. I would like to hear the Minister’s analysis and his proposals to address it. Technical education and investment in that area is incredibly important. It is lacking at the moment, and we need to do more in that area. There is no doubt that technical education is often more attractive to boys than some of the education that they are given and expected to complete. I know that the Government are looking at that area, but we need to take it much more seriously.

We also need to encourage more men into the teaching profession, just as we need to encourage more women into engineering. In England, 26.2% of teachers are male: 15.2% in primary and 37.6% in secondary. I spoke earlier about role models, and teaching is just about the best profession in which to be a role model. What is being done to ensure that the fine profession of teaching is introduced as a great career option to all students?

There are so many other areas we could touch on, such as rough sleepers, of whom 88% were men in 2016, and domestic abuse, which is particularly horrible for women, but can affect men as well, which is sometimes forgotten.

We have just concluded the poignant remembrance season, which brings me to a cause for great thankfulness. On Sunday, in Stafford I saw the hundreds of names of men and boys on the war memorial as I stood waiting to lay a wreath. That is not happening to our men and boys at the moment. Later, I joined the Penkridge Anglo-German Remembrance Day Association for its service at the main German military cemetery in my constituency, in a beautiful wooded vale on Cannock Chase. More than 5,000 German men—basically boys as well—lie in peace there. Finally, I went to Colwich parish church, where the names of all the men—and, again, boys, as some of them were boys—from that village and Great and Little Haywood who died in the wars of the 20th century were read out by the lychgate; sometimes two from the same family.

I and my generation, and my children’s generation, have not had to experience the horrors of a world war. That is a huge advantage. We pay tribute to the great professionals—men and women—in our armed services, who keep us safe at great personal risk. Most of us, unlike our fathers and grandfathers, have not had to spend years of our lives fighting. That gives us an opportunity and responsibility to contribute positively to our families and communities, to work for peace, to look out for the interests and welfare of others and help to build a better world. I have pointed out many areas in which we can all work together to improve the life chances, health and wellbeing of men and boys, but we can also be thankful for how much life has improved for most of us in the past 100 years and ensure that those improvements are within the reach of all.

I am grateful to the Minister and to all my colleagues who have spoken today, and I am grateful to my hon. Friend the Member for Shipley (Philip Davies) for suggesting that we have this debate. It is vital that these debates are not just words; that we see action come from them. I very much look forward to having a debate this time next year and seeing that real progress has been made. Perhaps we can all look at our constituencies and see what we can do locally, as well as encouraging national leaders to take many of these issues forward nationally, and I hope that this time next year we have a debate in which we can point to real progress in a number of areas.

I congratulate the hon. Member for North West Durham (Laura Pidcock), who will be a powerful advocate for her constituents and the whole country. I also congratulate my hon. Friends the Members for Ochil and South Perthshire (Luke Graham) and for Aberdeen South (Ross Thomson) on excellent maiden speeches, along with all the others who have made their maiden speeches today.

I also wish to thank the electors of Stafford for returning me and, even more so, for turning out in such numbers; at 76%, our turnout was one of the highest in the country. One thing I was disappointed about during the election was that the economy was hardly mentioned, and nor were those hard-working people up and down the country who are not on great salaries—perhaps they are working from home, trying to juggle a small business and looking after their family. Yet they, along with all others, are the wealth creators in this country; they are the people on whom we rely in order to have the taxes out of which public services are funded. I hope that in this Parliament they will hear many voices, from all sides, speak on their behalf.

As we have a two-year Parliament, I hope that some of the concerns my constituents put before me on the doorstep can begin to be sorted out. In particular, I am talking about long-term funding settlements for health, social care and education. As I have said many times before, we need to work across parties to sort this out. We have two years now to start to do that—hopefully we will have longer.

Health and social care in my constituency is under great pressure. We are being asked to tackle deficits that are insupportable. Of course efficiencies can be made, but the funding is insufficient. We are asked to remove, potentially, one A&E out of three in Stoke and Staffordshire, but that cannot happen, because the other two could not cope.

In education, we have had a bit of an arms race to say which is the poorest funded county in England. I can say that Staffordshire is one of the poorest. I will not say whether it comes first, second or third, but we are down at the bottom. That has to change. It is a matter not just of a new formula to juggle the numbers around, robbing Peter to pay Paul, but of putting more money in real terms into education. I am not advocating that we increase borrowing to a substantial extent to cover both those areas; we must have additional revenues—potentially slightly higher taxes—to pay for these things. The Liberal Democrats were at least honest in their manifesto, saying that we would have to raise taxes to pay for increased investment in health.

On a constituency point, I will have to oppose one measure in the Queen’s Speech, which is phase 2a of HS2, which goes directly through the villages of Great Haywood, Ingestre, Hopton, Marston and Yarlet. It is unnecessary that it does so. I know that there is a need for capacity. I am not averse to a new line, even one that goes through my constituency, but the way in which this line has been designed is dreadful, and it is because it has to go at 400 kph. There is no reason for a design to go at 400 kph; it could be cheaper and better and have less impact on my constituency and elsewhere in the country if it went at 300 kph to 320 kph.

On the European Union, my hon. Friend the Member for Eddisbury (Antoinette Sandbach) has said most of what I would like to say, but let me make just a few points. First, we want a smooth and sensible transition, with the economy and jobs put first, as the Chancellor has said. Secondly, let us look at working together with others to form a new common market, perhaps based on the European Free Trade Association. Thirdly, let us welcome the generous offer from the European Parliament regarding associate European citizenship—why not? Finally, we want more student exchanges and more modern languages.

The hon. Lady has asked a range of questions. In summary, I have made it clear in my written statement today that no authority will lose funding either for schools or for high needs. This will enable us to give authorities a firm foundation on which to start planning for next year. The reality is that we have seen funding for schools and across education rising. This has been one of the areas that this Government and the coalition Government have sought to protect, and that has been evidenced in the results. We now have 1.4 million more children in good or outstanding schools, and we want that progress to continue.

Schools in Staffordshire are among the lowest funded in the country, and that is a matter of great concern for the headteachers I met last week. We understood that we were moving to a fairer funding formula from 2017-18, but it now seems that it will happen a year later. Will the Secretary of State make it absolutely clear that there could be transitional funding for 2017-18 for those authorities that are in a desperate position, as Staffordshire is?

My right hon. Friend makes an interesting point, on which I am sure there will be further discussions.

It is excellent news that record numbers of students are securing a university place. What is more, the proportion of young people from disadvantaged backgrounds going into higher education is up too. UCAS data show that young people from the most disadvantaged backgrounds are applying at a record rate in the 2016-17 academic year. This is excellent progress. But with more demand for graduates and more skills required in the workplace, the sector cannot stand still, which is why I welcome the provisions in part 1 of the Bill making it easier for new high-quality universities to enter the market. This will mean that more places can be created and that students will have more choice, as well as encouraging greater diversity and innovation in the sector.

Does my hon. Friend therefore welcome the news that Chinese investors propose to take over the Staffordshire University campus in Stafford, vacated by Staffordshire University, to provide precisely that additional choice and—I am sure—excellence?

I thank my hon. Friend and constituency neighbour for his point. He is absolutely right. In fact, he must have been reading over my shoulder, because I was just about to talk about Staffordshire University. I currently do not have a university in Cannock Chase, but we have businesses and organisations with close links to Staffordshire University, and I have a lot of constituents who go there. As a consequence of the Bill and opening up the market to new entrants, perhaps one day I will have a new university in my constituency.

In conclusion, we have a world-class higher education sector, but we cannot be complacent. Our economy needs high-quality graduates and our graduates need the skills to contribute to our economy. I welcome the Bill. It demonstrates that the Government have a clear plan for higher education and builds on the progress already made.

I am delighted to have assisted my hon. Friend and those parish councils, if that is the case. It was important that we made the announcement. I congratulate him on being a governor of the school. On the arts, I visited the fantastic Lings primary school in Northampton—I think I have mentioned it in the House before—which has embedded Shakespeare in the curriculum from reception to year 6. That shows what inspirational headteachers, with the support of an academy trust, can do to transform education in their schools.

I thank my right hon. Friend for listening on both academies and fair funding. Will she or one of her ministerial colleagues meet me and my right hon. Friend the Member for South Staffordshire (Gavin Williamson) to discuss the situation in South Staffordshire, where schools are working really hard but suffering tremendously in comparison with neighbouring authorities on the question of funding per head?

Yes, of course. The Schools Minister or I would be delighted to meet my hon. Friend. We have made a very clear commitment, which was not taken up under 13 years of the previous Labour Government, to transform how fair funding works across the country. It has to be right that the same pupils with the same characteristics attract the same funding. That is what we are determined to see.

May I join my hon. Friend the Member for Worcester (Mr Walker) in congratulating the Minister on the way in which he has handled the Bill? Again, is it not the case that the Minister has had conversations with many people from all parts of the House, including on the Government Benches, both in the Commons and in the other place, about their concerns and that many of those concerns have now been addressed without any concessions at all being made to us?

I can confirm that, and none was more important than my hon. Friend, who had some very serious concerns. He did exactly the right thing: he came to see me privately about them as we were deliberating in the House. He tabled an amendment on Report, which he did not move because I had reassured him that we would look at closely as the Bill progressed. Yesterday, when he was not in the Chamber, I specifically mentioned that he had been influential in our decision ultimately not to press ahead with the measure that would have removed the check-off arrangement for trade unions in the public sector.

I know the Minister, and I take him at his word when he says that that is not his intention and that this is not a delaying tactic. However, to coin a phrase, he is a here today, gone tomorrow Minister—I say that from experience, as a former Minister—and somebody else may well occupy his place in the future. That person may not have the good intentions the Minister has outlined to the House today, and we must legislate for that possibility, rather than assume that somebody with good will is going to occupy his seat in perpetuity.

The Government propose that they would not have to publish a strategy after the review. Let me be clear: their amendment is not necessary. I accept that they have moved a long way in accepting the review, the pilots, the requirement to lay a report before Parliament, the need to consult experts and to get advice and recommendations, and the need to commission a report within six months of passing the Act. Those changes are significant, and they go part of the way towards achieving what we have argued for right from the start, as well as achieving most of what was agreed in the other place with cross-Bench support.

As someone who, along with other colleagues, including my right hon. Friend the Member for Haltemprice and Howden (Mr Davis), considers that electronic balloting is probably the right way to go, may I ask whether the hon. Gentleman welcomes the progress the Minister and the Government have made in that direction? I believe that the Minister, and indeed any future Minister, although I hope this Minister remains in his place for a long time, will ensure that the evidence is looked at and that, provided it shows that electronic balloting is the right way to go, which I very much hope it does, we will go forward with it.

Obviously I cannot comment on how long the Minister will remain in his post—we will see what happens in the forthcoming reshuffle. However, I did recognise the movement the Government have made, although I made it clear that their amendment to their lordships’ amendment is unnecessary and that the whole matter could have been dealt with in a much more straightforward manner. However, we are where we are, having received these amendments from the Lords, and those are all that we can discuss today.

Ultimately, it is inconceivable that any Minister, having received a report on how e-balloting could be introduced safely, would then deny trade union members the opportunity to participate in a ballot using modern electronic communications. The only possible reason for Ministers at that future point to reject an expert report outlining the appropriate way to introduce modern technology into ballots and to offer the opportunity for easier participation in a democratic vote would be a desire to suppress turnout.

Exactly. How proudly I stood on that manifesto. [Laughter.]

Returning to my speech, if the number of problem institutions could be numbered in the tens, why should all these voluntary groups be subject to inspection by Ofsted? Why does that mean that churches could have inspectors deciding whether their doctrine meets the “British values” test? Why should totally moderate, mainstream mosques and madrassahs have to register on a list of potential extremists?

The DFE says that an out-of-school education setting is

“any institution providing tuition, training or instruction to children aged under 19 in England”.

Exceptions are schools, colleges, and registered childcare providers. The Government talk about “intensive education”. That sounds bad—like it has a controlling influence on children—but the document says it is

“anything which entails an individual child attending a setting for more than between 6 to 8 hours a week”.

It says that that could be an hour or so every day after school.

I speak as somebody who even this coming weekend will be engaged in working with young people in a Sunday school. Does my hon. Friend think that, even if we normally do one or two hours a week, the proposals will apply if we take the children away for a weekend, which will be far more than six hours?

I do indeed. My hon. Friend represents an area that has many trade union members, and he is absolutely right. It is shocking that the Government have not published those figures. I hope that the Minister has deep pockets, because he might well have to dip into them when he finds out how much this policy is going to cost.

Some councils actually make money from check-off arrangements. One or two examples have been given to me of councils not only repaying the costs of check-off but getting extra funding that supports council services.

The hon. Gentleman is right. As I have said, he has put his finger on the matter in his amendment, which we will discuss later. His intervention now has drawn to my attention the point that the state should not be interfering in this kind of voluntary transaction, which is entered into freely by all the parties concerned and which is neither illegal nor immoral. What is wrong with an employer in the private or public sectors voluntarily agreeing to help to collect trade union subscriptions, as part of an attempt to maintain good relations with its employees, in exchange for an administrative payment? In what other field would a Conservative Government legislate to ban a simple, mutually beneficial transaction of this kind? The hon. Gentleman is to be congratulated on spotting that flaw, and the basic illiberalism, at the heart of this measure in the Bill.

My hon. Friend is absolutely right about that. He knows well, and Conservative Members ought to know, that the festering resentment that would arise as a result of this kind of approach to industrial relations would last for many years, and in some communities would never be forgotten.

The TUC is firmly opposed to this proposal, which in its opinion will breach international law. The International Labour Organisation’s freedom of association committee has confirmed that

“the hiring of workers to break a strike in a sector which cannot be regarded as an essential sector in the strict sense of the term...constitutes a serious violation of freedom of association”.

New clause 1 would insert in the Bill a ban on the supply of agency workers during strikes, and we will therefore support it if it is pushed to a vote tonight. I also want to press amendment 6 to a Division—the lead amendment in this group, which is in my name and the names of my hon. Friends.

Let me say a few brief words about amendment 5, which was tabled by the hon. Member for Stafford (Jeremy Lefroy). It would allow check-off if employers and unions agreed that they wanted it, provided that the unions paid for the service. I understand why the hon. Gentleman would table such an amendment, as it seems to reflect some of the basic values that I thought were supposed to be in the DNA of his political party. When one party is willing by agreement to provide a service to another party in exchange for payment, the state should not interfere unless the service forms some kind of criminal or immoral activity.

Check-off is a voluntary agreement by an employer to collect through its pay roll the union subscription of trade union members who are its employees. Despite what the Government seem to think, that is not a criminal or an immoral activity. Why on earth would a Conservative Government think it is right for the state to proscribe a voluntary agreement between an employer and an employee where a payment for that service is involved? I completely understand why the hon. Gentleman has tabled his amendment.

What is wrong with an employer, in whatever sector, voluntarily agreeing, as part of an attempt to maintain good relations with employees, to help collect the trade union subscription in exchange for an administrative payment? How on earth is it the responsibility of Government, particularly a Conservative Government, to introduce a provision of this kind?

The hon. Gentleman has anticipated the remarks that I would have made had I caught Mr Deputy Speaker’s eye. Does he agree that many employers in both the private and the public sectors have said how convenient, positive and mutually beneficial this arrangement is and how they do not see any downside to it whatsoever?

Clearly, the hon. Gentleman is as baffled as I am as to why the Government are going down this road. It really is quite an extraordinary provision in the Bill. Can anyone on the Government Benches answer this: in what other sphere would a Conservative Government legislate to ban a simple, mutually beneficial transaction?

I rise to speak to amendment 5, which appears in my name and those of my hon. Friends the Members for Stevenage (Stephen McPartland) and for Totnes (Dr Wollaston) and my right hon. Friend the Member for Haltemprice and Howden (Mr Davis). I do so with a heavy heart, because clause 14, to which the amendment relates, is entitled, “Prohibition on deduction of union subscriptions from wages in public sector”. As a Conservative, I am not greatly in favour of prohibition in many instances and I certainly am not in this instance. The clause was not in the Bill on Second Reading so we did not debate it and I am disappointed that it has been brought forward. Because it has been brought forward, I will speak to my amendment.

When we introduce a prohibition, we must ask what the penalties will be. If a union and an employer decide that this kind of arrangement is so important and so difficult to unwind that they will continue using it, what will happen to them? Will the police be involved? Will the employer and the union be fined? If there is a prohibition, there must be some way of enforcing it. There is no sensible way of enforcing this kind of prohibition on what is a relatively sensible arrangement between an employer and a union.

Let us be clear that we are talking about an agreement between an employer and a union, not something that is imposed on either of them. It is a partnership. In my view, it is generally a positive one as it enables people to work together. Surely that is what all of us are here to encourage. Nobody is required to have such an arrangement.

If my amendment were accepted by the Government at some point, it would require the cost to be reimbursed, as it is in many arrangements up and down the country, including in my county of Staffordshire, where there is a perfectly good arrangement between Unison and Staffordshire County Council.

I support amendment 5 because it is my understanding that local authorities and other such organisations would be able to charge a commercial rate to recover the costs.

Yes, and they do. As I mentioned in an intervention on the hon. Member for Cardiff West (Kevin Brennan), some councils make a surplus from it that goes towards their services.

As has been pointed out, clause 14 singles out union subscriptions. There is no prohibition on other deductions for which there might not be compensation to the employer, such as deductions for season tickets, which have been mentioned, or professional fees. Even on my payslip as a Member of Parliament, the top deduction every month is £2 for the Members fund. There will be no prohibition on that deduction, unless the Members fund is a national union of Members of Parliament, which I do not think it is.

Other people have made the case much more eloquently than I have, so I will not detain the House any longer on this point.

The hon. Gentleman makes a convincing and measured case, and I have looked closely at the wording of his amendment and think it very reasonable. Given what he has just said, if the Government are unwilling to accept this reasoned amendment, does he think that we should test the view of the House on it this evening?

I will wait to hear what the Minister says. He is an extremely reasonable person and there are other ways in which such things can happen. I encourage the Government to accept the amendment because I do not want to see this clause unamended in an Act of Parliament signed by Her Majesty.

Let me quote someone I greatly admire:

“In most parts of the world the suggestion that someone might be both conservative and liberal would be viewed as absurd…In the UK there is no finer tradition, no more established custom and no stronger institution than that of freedom under the law…That’s why in Anglo-Saxon countries conservatism is freedom’s doughtiest defender and why the advance of freedom gives conservatism its moral purpose.”

Those are the words of the Minister, my hon. Friend the Member for Grantham and Stamford (Nick Boles), and I entirely agree with him.

Does the hon. Gentleman agree that there are echoes in that speech of the Transparency of Lobbying, Non-party Campaigning and Trade Union Administration Act 2014, in which charities were almost proscribed for doing what they believed was right? There are also echoes from the attempts to change or alter the Human Rights Act 1998—it feels as if there is a creepy sense of authoritarianism, which I do not think Members in this place agree with.

I respect the hon. Lady but I do not entirely agree with her. I would be interested to see whether the chilling effects that people so often claimed the 2014 Act would have on the 2015 general election campaign actually took place—indeed, we should have a review of that Act as it is important. I have made clear my views on the Human Rights Act: I believe that we should remain signatories to the European convention on human rights, and I hold to that. We look forward to seeing what the Government bring forward. I urge the Government, and especially the Minister whom I greatly admire, to have another look at the Bill, and to come forward with proposals that allow people who want to work together in this sort of format, and who are paying the right costs, to do so.

I declare an interest as a proud member of Community union. I represent the south Wales constituency of Aberavon which is steeped in the history of the trade union movement—Members will imagine the strength of feeling and amount of correspondence that I have received in opposition to this unjust and vindictive Bill. We now need a cultural change in Britain’s industrial relations, and a move away from the Punch and Judy style that has evolved thanks to legislation such as this Bill. There is an urgent need to move towards more collective bargaining across the economy, as that would have a direct and positive impact on productivity—something that the Government claim they are campaigning for passionately. Regrettably, the Bill will neither change the culture nor increase productivity. Instead, it will lead to an entrenching of the “them versus us” culture that is bad for workers, employers, customers, business, and the public at large.

Let me draw the House’s attention to the sections in the Bill that deal with picketing. Conservative Members have failed completely to demonstrate why the picketing provisions in this Bill are necessary or justified. The Government’s regulatory policy committee concluded that the Department for Business, Innovation and Skills impact assessment on picketing restrictions was not fit for purpose, and that no full impact assessment of the Bill has been published.

Under these new provisions, trade union pickets will be subject to levels of police scrutiny and control that go far beyond what is fair or necessary. Most importantly, the changes in the Bill will also be a waste of police time. That issue was raised by the National Police Chiefs Council and the Police Federation in oral evidence to the Bill Committee. Steve White from the Police Federation said:

“We are finding it extremely challenging to cope with day-to-day policing with the current resource levels, and the likelihood is that they are going to become squeezed even more. If there is an increased requirement for police involvement around the policing of industrial disputes, that would be more challenging.”

I understand that Conservative Members are friends and supporters of the police, so I hope they will listen carefully to that.

I am aware of that, because I was in the Committee, and the general secretary of Unison is an unforgettable man, and no one forgets when he makes them an offer. However, the purpose of the Government’s measure is not suddenly to undermine the representation of unions in the public sector—that is not what has happened in the civil service, where check-off has been removed—but to create a direct relationship between members and their trade unions by enabling them to make an active choice about which union will best represent them. We have heard from other unions that this has enabled them to compete for the membership of some in the civil service, and to form a more direct relationship with their members.

I understand my hon. Friend’s argument, but of course the choice would be made by the employer and the union, not the individual members. I have not yet been persuaded by his arguments, and will resist his amendment, if he pushes it, but I hope I can reassure him that we absolutely do not intend the measure to be a way of making life difficult for unions or of reducing their membership. We will double the time trade unions have to transfer members from the existing check-off arrangement to the new direct debit arrangement from six months to one year. That will not satisfy him and those who support his amendment, but I hope that it will at least reassure him that we do not intend this to be a way of making life difficult for unions. If there is anything further we can do on that point, I am happy to have further discussions with him.

On that basis, I hope that my hon. Friend will be persuaded not to press his amendment. We will talk about this more. I hope that I have reassured him that trade unions will have time to form the direct relationship with their members that the Bill seeks to provide.
