That is another neat diversion by the hon. Gentleman, but he cannot avoid the fact that he and his colleagues have no answers on the central questions of Scotland’s economy: what currency it will have, how the banks and others will be regulated, how trade will work across the United Kingdom. On every single important question, there are no answers from the SNP. It will not be listened to until those answers come.

The UK Government provided £50 million to safeguard and improve the Caledonian sleeper service in 2011. Responsibility for taking the project forward is now with the Scottish Government. We look forward finally to seeing some progress.

I am pleased that the Government have invested in the future of the Caledonian sleeper, which is a vital transport link for business and tourism alike, but does my right hon. Friend share my disappointment that the Scottish Government have not shown the same urgency on upgrading that vital link?

I agree with my hon. Friend. He might be aware that, since the spending review, the Scottish Government have received over £1 billion in additional funding for what they said were shovel-ready projects, but the only shovelling of which they seem capable is digging the sort of hole that we saw yesterday regarding the currency.

I thank my hon. Friend for that contribution. It encourages me to look forward to the substance of the debate on the referendum, when the Scottish people will give not only their verdict on whether they think their interests lie best in the United Kingdom, but ultimately their view of the SNP Government, who, rather than addressing their interests, are for ever saying that everything can be solved through the prism of independence, without ever presenting a substantial argument for why that would be the case.

The hon. Lady touches on an important point about the Scottish Parliament legislating in the interests of Scotland. Does she agree that the Scotland Act 2012 will devolve considerable additional powers over many fiscal matters to the Scottish Parliament, and that it is surely better to concentrate on using those powers rather than constantly trying to change the goal posts constitutionally?

No. I am very happy. The hon. Gentleman is trying to put words into my mouth, suggesting that I do not understand or care what happens in Scotland. That is not the case. I am very much in favour of the order, and very much in favour of allowing the Scottish Parliament to conduct the referendum. However, I firmly believe that because the referendum will affect the future of the whole United Kingdom, this House—this Parliament—should also serve as a forum for discussion about its conduct.

Although I do not happen to live in Scotland at present, and although some Members who are speaking this afternoon do not represent Scottish constituencies, I hope that if matters will proceed with good will, the Scottish Parliament will take into consideration what we discuss in this Parliament during the process of giving it the power to hold the referendum.

I very much welcome the chance to participate in this important debate. It is a great pleasure once again to follow my fellow Hutchesonian, who made a powerful speech. If it does not damage his reputation even further, I shall point out that I agree with many of the points that he made, and I hope to build on them.

In many respects, I wish that we were not having this debate. I am a staunch Unionist, and I believe in the United Kingdom. I wish that we did not have to contemplate at all the prospect of the United Kingdom splitting up into its constituent parts. I believe that that very process will cause uncertainty at a time when we need absolute certainty for our economy. There is evidence from Canada that the ongoing constitutional debate and the uncertainty of Quebec’s constitutional status damaged the economy in Quebec, and I wish that we were not in that position. The hon. Member for Glasgow South West (Mr Davidson) made an important point from the perspective of his constituency about the uncertainty for the shipyards in Govan and elsewhere, and the fact that there will be no certainty on future orders while the constitutional question remains unresolved.

We are where we are. I am a democrat, and I fully accept that the SNP won the majority of seats in the Scottish Parliament. However much opinion polls show that the constitutional question was, or was not, part of the debate in that election, it was part of the SNP manifesto, and it is perfectly legitimate for it to hold the referendum. I accept that the Scottish Parliament is the right forum in which to set the terms of the referendum, but it must be absolutely fair, clean and decisive.

I wish to mention a few of my concerns. There must not be any question of gerrymandering with regard to the question, the electorate and the rules by which the campaign is fought. Many Members have expressed legitimate concerns about the prospects for the campaign. I commend members of the Scottish Affairs Committee for their insightful report, which highlighted a number of concerns.

I want to concentrate on one or two misgivings about the franchise. The question of 16 and 17-year-olds voting has been raised. I completely accept that there is a legitimate debate to be had about whether the voting age should be lowered. Eighteen is not set in stone in this country: the age at which someone can vote has changed over the years and has been reduced in recent times. I get young people in my constituency calling on me to consider a reduction in the voting age. I have an open mind on the subject. My view is that we should agree on a common age of majority for a series of things. It is slightly daft that we have different ages of adulthood for learning to drive, voting, getting married, buying alcohol or tobacco, and serving in the armed forced. It is not beyond our wit to agree an age at which most young people achieve a degree of maturity and at which they can exercise adult decisions. I do not have a particular view about whether that should be 16, 17, 18 or some other age, but that is not the point.

That debate should be had in general terms, not in the specific circumstances of one poll. It is utterly wrong that unilaterally for one election or one referendum we make a change, and for that not to apply elsewhere. Whether 16 and 17-year-olds are more likely to support the Union or independence is not the point. The debate should be had in general terms.

Following the Edinburgh agreement, this is the only election or referendum the Scottish Parliament will have control of. We have no say on UK elections. We do not even have a say on Scottish parliamentary elections. Of course, if we had responsibility for them, we would make sure that 16 and 17-year-olds could vote. We have crofter commissions and local government elections in which we can have 16 and 17-year-olds voting, but we do not have legislative responsibility for UK or Scottish parliamentary elections.

The hon. Gentleman is making a point about a continuing process of devolution and, in the future, it might fall within the competence of the Scottish Parliament to decide these things. That is a separate debate. But to make the decision unilaterally for one poll in what I believe is the self-interest of the party—whether that is misplaced or not is another question—is fundamentally wrong in my view.

It might interest the hon. Gentleman to know that the Scottish Parliament does have control of other elections. It has control of local government elections and, in 2012, it decided not to extend the franchise to 16 and 17-year-olds. I fear he may be getting incorrect information from the hon. Member for Perth and North Perthshire (Pete Wishart).

I am grateful to the hon. Gentleman for that helpful point of information. I return to the fundamental point. If the age of franchise is changed, it should apply to every election or none, and not to one poll. I do not have sufficient knowledge of the referendum on crofting, but I suspect that is not quite as significant an issue as the future of the United Kingdom. There should be consistency and the debate should be in general terms, not unilaterally for one poll.

My next concern is about the electorate. As my hon. Friend the Member for Epping Forest (Mrs Laing) eloquently and powerfully explained, it is utterly wrong that an EU citizen temporarily living in Scotland should have a say on the future of the United Kingdom, but a Scot living in England does not. If I, for example, chose to live and work in Barcelona, I would not feel any right to take part in Catalonia’s future constitutional relationship with the rest of Spain. It would not cross my mind to exercise an opinion on that, so why should a Spaniard living in Edinburgh or wherever decide on the future of the United Kingdom?

I appreciate the hon. Gentleman’s view but if I was so fortunate as to live in Barcelona and a Catalonian vote was called, I think I might express my opinion on the issue, given that it would affect me day to day. Perhaps that is a personal difference between the two of us, but I would care about the country and the environment in which I was living and therefore I would take part.

It is perfectly reasonable for someone living in a city or an area of a country to take part in very local polls concerning the local infrastructure and services. That is quite a different matter from someone being able to take part in a fundamental decision about the constitutional status of their home country.

I hope that the hon. Gentleman understands that the upstream issue is that all the matters that he is talking about are affected by the framework in which they operate. One of the reasons for wanting an independent Scotland was highlighted last week in the debate on the Welfare Benefits Up-rating Bill. The majority of Scottish MPs were against it, yet it is being foisted on Scotland against the wishes of Scottish society. If we want to produce a welfare situation that is perfect and better for Scotland, we have to first sort out the constitutional framework around it before we can get to that point.

The hon. Gentleman is confusing a number of issues. He wants independence and separation so that Scotland can decide these things for itself. The point that I am making is that a EU citizen who is neither Scottish nor English would be able to influence that vote in Scotland, but a Scot living in England would not.

Forgive me, but I want to make progress.

We all have opinions on the constitutional status of all sorts of countries. I have views on what should happen in the United States, Australia and Germany, but I do not seek to vote on them. It is fundamentally wrong that such a situation could exist. I echo the call made by my hon. Friend the Member for Epping Forest for a very simple change so that the franchise for Westminster elections also applied to Scotland. That would go a long way to removing many of the anomalies that have been mentioned with regard to members of the armed forces and their families not being able to take part in this poll. We call on these people to fight and to, potentially, give up their lives for their country, yet they will not be given the right to take part in its future direction.

Does my hon. Friend agree that if the franchise were based on that used for UK Parliament elections, as he has just suggested, instead of on the local government franchise, that would also mean not only that Scots living outside Scotland would have a right to vote, but that people who are eligible to vote in UK parliamentary elections in other parts of the United Kingdom, but who were born in Scotland and can prove it, would, too?

My hon. Friend makes another excellent point and I echo it. The other key point is—I mentioned this in my intervention on her speech—that it is up to the Scottish Parliament to decide this. There is nothing in the order that prohibits that. I urge it to look reasonably and rationally at the issue. The referendum must be fair if it is to have legitimacy. If it does not have legitimacy, I fear that we will just perpetuate uncertainty.

That leads me to my next point, which my right hon. Friend the Secretary of State also made in his opening speech. The referendum must be the end of the matter. Whatever the result, it must be clear and binding. As my right hon. Friend also said, if the decision is a yes vote—I fervently hope that it will be a massive no vote—negotiations will have to begin. I want clarity from those on the Government Front Bench on what will happen if there is a very narrow yes vote and negotiations begin on the terms of the divorce. What if the reality does not match the separatists’ rhetoric on issues such as Scotland’s membership of the EU, adoption of the single currency or any one of the number of issues that are coming to light? What if the deal for Scotland is not nearly as favourable as first envisaged? Is there scope for a second referendum within the time scale, the end date of which is 31 December 2014? Either way, I do not want a second referendum to be called in the event of a narrow yes or no vote. The decision has to be clear and final, to avoid the kind of ongoing uncertainty that existed in Quebec following a narrow no vote. That vote did not end the matter, and the separatists have come back again and again to try to get their way. Thankfully, they have not achieved it. There could be a similar danger here, and I would like clarification on what such a situation would mean for Scotland and the United Kingdom.

On the timing of the referendum, I wish that we could just get on with it. I slightly disagree with my hon. Friend the Member for Epping Forest on this matter, although she was right to say that the longer the debate goes on, the more the unsavoury consequences of separation and the confusion of the SNP’s position come to light.

This talk of uncertainty seems to be unfounded, as many investors have come to Scotland in the past year. Certainly, the only time I have heard the subject raised has been in the context of the US Government recently getting worried about the noises coming from the Conservative party about leaving the European Union. Does the hon. Gentleman think that such talk in the Conservative party should end?

The hon. Gentleman makes my point for me. Constitutional uncertainty is potentially dangerous for the economy, although I am sure that you would rule me out of order, Mr Deputy Speaker, if I started to talk about the EU argument. The danger for Scotland is real, however. This ongoing uncertainty could be very damaging, not only for Scotland’s economy but for the economy of the whole United Kingdom. I am a fervent Unionist, and I believe that we are better together. The terms of the referendum must be clear and fair, and the result must be one that can be accepted. I wish that we could just get on and have the referendum as soon as possible.

It is a great pleasure to have the opportunity to contribute to this timely and important debate, and I congratulate my hon. Friend the Member for Epping Forest (Mrs Laing) on securing it. I am proud to be a co-signatory to the motion.

The hon. Member for Livingston (Graeme Morrice) set out very well many of the practical benefits that Scotland and, indeed, the rest of the United Kingdom gain from the Union, be it in defence, finance and economic matters, or our influence on the world stage. We could, and should, have a full debate on each of those points, and I am sure that in the course of the next year or two, leading up to the referendum, they will all be fully explored. To summarise the benefits—I think that the hon. Gentleman used this phrase—the strength of the whole is greater than the sum of the parts. We are stronger together.

Scotland could go it alone as a separate country. I am not one of those who believes that it would be an impoverished basket case of a country that could not survive on its own. Of course it could, but at what cost? Together, we are stronger, more influential, safer and more prosperous. It would be much riskier for everyone if Scotland went it alone.

Does the hon. Gentleman have a list of nations of about 4 million to 5 million people that might be better off joining the UK because they would be safer, more prosperous and more influential? Is he considering Denmark, Sweden or Finland? What is at the forefront of his mind?

I am puzzled. Is the hon. Gentleman asking for other countries to come and join us in the United Kingdom? That is a very interesting notion.

A few years ago, the global banking crisis sent economic shockwaves around the world. The SNP used to make a claim for the arc of prosperity that would link a separate Scotland with Ireland and Iceland, but that arc has rusted somewhat in the light of events. A separate Scotland could have weathered that storm, but the resilience that we had as a country was much stronger because we were the United Kingdom and not split up into atomised parts.

I am sure the hon. Gentleman does not want to cast aspersions on Iceland and will therefore know its unemployment rate and GDP per capita as against those of the United Kingdom.

I cannot give those figures off the top of my head. If the hon. Gentleman is suggesting that Iceland was any better placed to weather the storm than the United Kingdom, that is a slightly revisionist view of history.

Another issue is Scotland’s role in the European Union if it becomes a separate country. There was an interesting debate on that in Westminster Hall last week. In the interests of brevity, I will not rehearse all the arguments. I believe strongly that if Scotland went its own way and wanted to be part of the EU, it would happen on the EU’s terms. Scotland would be sucked into full currency, fiscal and political union, which would not be to its benefit.

The EU issue makes a mockery of the SNP’s independence policy. It is perfectly logical to argue that if Scotland does not like one economic union and wants to be the master of its own destiny, it should go its own way, but to argue that it should then join an ever-deepening union is utterly illogical.

The fact that we are having a referendum at all is risky as it may be a distraction from what we should be concentrating on. I do not doubt for a minute that it is perfectly within Scotland’s right to have the debate and to have the matter resolved. As a democrat, I fully accept that the Scottish National party won a majority in the last Scottish Parliament elections and that a referendum was part of its manifesto. It is therefore perfectly legitimate to have the debate. But at what cost? The constitutional uncertainty in Canada in the 1980s and 1990s had a severe impact on the economic prosperity of Quebec. The EU admitted that in a report.

If the hon. Gentleman will forgive me, I have a number of points that I want to make and I have already been generous in giving way to him.

A report by economists at the appropriately named Scotiabank in Canada said of the 1995 referendum:

“The palpable fear in the markets was keyed off deep intertwined concerns about the country’s fiscal, economic and political circumstances.”

The very fact that we are having this debate is therefore risky as it may distract us. However, I accept that it is legitimate that we are having it.

My main point relates not to the economic or defence arguments or to Scotland’s influence on the global stage, but is a personal and emotional appeal. My nationality is British. I do not want to be rendered stateless or to be forced to choose between the place of my birth and the place I now call home. The country that would be left would be the rest of the United Kingdom and its flag would be, as the noble Lord Forsyth described it, “an anaemic red asterisk” once the blue of the saltire was taken out.

As far as I can tell, my blood is 100% Scottish. My father has traced the generations of the family back to the 1700s. Unless there is something we do not know about, my family came from a small area in Lanarkshire and Ayrshire. I spent my childhood in Scotland. My primary and secondary education was in Scotland, but my higher education was in England. Three quarters of my working life has been spent in England. Through marriage and my family, I have many relatives who are part Scottish and part English. I have stood for public office five times: twice in Scotland and three times in England. My Scottish ventures were somewhat less successful than my English ones. I stood for South Lanarkshire council and for Glasgow Rutherglen. Let us just say that I saved my deposit on both occasions.

As my hon. Friend the Member for Epping Forest said forcefully, of course Scotland and England have distinct cultures that are expressed through the arts and on the sporting field, but both can be vibrant within the Union. Patriotism does not require nationalism to flourish. Beyond a patriotic pride, the United Kingdom has something that is much stronger. Team GB at the Olympic games exemplified it, the monarchy exemplifies it, and even James Bond exemplifies it. We have an identity that has been forged through more than 300 years of the world’s most successful and enduring Union. We do not need to change. The hon. Member for Angus (Mr Weir) said that that is history. It is history, but it is also the present and I believe that it is the future. For goodness’ sake, let us not throw away what we have achieved and what makes us strong, prosperous and successful in an ever-changing world that is becoming more dangerous and uncertain. We have something that is strong and that works; let us keep it.

I enjoyed my visit to Troon. I made the offer to the hon. Gentleman at that time that I would happily share a platform with him to defend our United Kingdom, but for some reason the invitation got lost in the post. I therefore make the offer to him again.

The hon. Gentleman makes a serious point about payday loans. We have seen the preliminary report by the Office of Fair Trading. We need to take action, and that is why we are giving the OFT a new power to suspend a consumer credit licence with immediate effect when there is an urgent need to protect consumers. The report shows that many companies are not sticking to the guidelines, and that is not acceptable.

Has my right hon. Friend seen the recent Experian study which shows that Milton Keynes is the area of the UK best placed to lead economic growth, with a forecast growth of 3.1% a year?

My hon. Friend is a great spokesman for Milton Keynes and has welcomed me there many times. It has a successful economy based largely on small and medium-sized enterprises. One thing we need to do, in Milton Keynes and elsewhere, is to get the housing market moving again. I am convinced that that is an important part of driving recovery in our economy.

I regret to inform the hon. Gentleman that I have not made as much progress as he would wish me to. I hope, however, that he will recognise the important support that we have given to Irvine, in the form of the enterprise allowances—the 100% capital allowances that are now available—and I will be happy to catch up with him on the school-industry partnership and the Scottish Government’s role in it any time soon.

I am grateful for the opportunity to speak on this group. I will speak specifically to Lords amendment 18, but before I do so, Mr Deputy Speaker, I hope it is in order for me, having taken part in all the Bill’s proceedings in the House, to place on the record how much I welcome the progress that has been made, both here and in the Scottish Parliament; I particularly welcome the unanimous approval given by the Scottish Parliament on 18 April. I believe that the Bill as a whole embodies sensible evolutionary progress on devolution. It represents a measured and calm approach, which takes forward at a sensible pace the whole devolutionary process, and it avoids some of the risk and uncertainty that would be involved in more extreme constitutional change that some Opposition parties want.

On Lords amendment 18, the publication of an annual statement of progress on the transfer of fiscal powers is a welcome and sensible move. I do not think we should underestimate the scale of change that will occur when capital borrowing powers are devolved, when income tax powers are devolved, and when stamp duty and the other measures are passed down. A huge sum of money is involved and, as other right hon. and hon. Members have mentioned, it will mean that the Scottish Parliament is responsible for raising more than one third of its spending. When coupled with the actual amount of money involved, the process of disentangling what has been a unitary tax system should not be underestimated.

Does my hon. Friend agree that producing such a report will bring greater openness and transparency to the financial affairs of the Scottish Parliament, and that it will also allow greater scrutiny of issues relating to the Barnett formula?

My hon. Friend makes a very important point, as the essence of the Bill is that it creates additional transparency and provides for democratic scrutiny of the decisions made by the Scottish Parliament. That is important not only in Scotland, but in England. I am sure that constituents write to him to complain about some of what they see as the largesse given to Scotland. Some of what is reported to us is not accurate—the media tend to whip up a storm about the bounty that is provided to Scotland. Some of what is said may be true, but greater transparency will be healthy for democracy and it will remove some of the myths from the debate. I think that this measure will be good for the Scottish Parliament, for devolution and for the Union.

I am listening to the hon. Gentleman with keen interest and I very much approve of the tone of his remarks. Will he ensure that when nonsensical claims are made about Scotland having this “largesse”, as he describes it, he will deal with them all in the same way as he just has?

I am grateful to the hon. Gentleman for that intervention. I always try to be reasonable and measured in my comments. These issues are important and I have long argued—I will not repeat the arguments that I have made in other debates, as I think you would quickly rule me out of order, Madam Deputy Speaker—that there is a great deal of confusion about the fiscal relationship between Scotland and the rest of the United Kingdom. I think that this measure will give extra clarity. Some of the claims are justified; others are not. I shall not be tempted down the path of identifying which are and which are not, but, as my hon. Friend the Member for Carlisle (John Stevenson) says, it is important to have that scrutiny so that we can keep tabs on this very complex change. The last thing our economy needs in these difficult economic times is additional uncertainty about changes that are being rushed through that might provide uncertain trading conditions for companies. The proposed process is measured, calm and sensible.

I am glad that some of the other demands for fiscal transfers have been resisted at this stage. We have talked about corporation tax and I will not re-enter that debate. The demands made by the Scottish National party initially included the transfer of excise duties, but even they now realise the complexity that that would involve, thanks to the fact that such an august body as the Scotch Whisky Association—a very fine body—pointed out that different alcohol duties north and south of the border would require the introduction of some sort of tax border policing to ensure that there was no abuse of the system. I am glad that that demand has been dropped.

As my hon. Friend says, the additional transparency will be good for our constituents. The publication of the annual reports will also be helpful in relation to another sensible change that has been made during the progress of this Bill, which is the proposed adjustment to the annual block grant. Initially, I think there was to be a one-off assessment of what change should be made to the block grant as a result of the fiscal changes. That has now been amended to be an annual assessment of what I think is known as the Holtham approach, which has been considered for funding for the Welsh Assembly. Having that annual check on a very complex and dynamic fiscal situation will be sensible. I recall that similar changes were made to the calculation of the Barnett formula in the 1990s when the initial formula, which had been set in stone since it was first introduced in the late 1970s, had resulted in some disparities and anomalies as a result of changing population levels. That has since been adjusted to an annual change.

As my hon. Friend says, a change has been made at the last moment to what is called the no-detriment principle, which was indeed set out in the Holtham report, produced in July 2010. Does he concede that the majority of the Holtham report focused on a needs-based funding formula, and that we are not implementing that at this time?

I am grateful to my hon. Friend for that intervention but I do not think that you would be terribly enamoured of me, Madam Deputy Speaker, if I widened the debate into a discussion of the Barnett formula and fiscal matters more generally. My hon. Friend is right, however, that that is not part of the Bill. It is a subject to which I think we will return on another day.

In conclusion, I welcome Lords amendment 18, which would make a sensible change to the Bill. I welcome the Bill as a whole, as it is a sensible change and a sensible evolution of the devolutionary process, and I think that it will be welcomed both north and south of the border.

I want to say only a few words about this group of amendments. They are very welcome, particularly the scratching out of some of the re-reservations. We tabled amendments, of course, to remove the re-reservation of insolvency and health professional regulation matters in a previous stage, but the Government rejected them at that point, as did the British Labour party. I am delighted that there is now unanimity that those re-reservations should be removed.

Lords amendments 12 to 16 would amend clauses 25 and 26 to devolve completely to the Scottish Parliament all aspects in relation to speed limits on all roads in Scotland. They follow the recommendation of the Calman commission and resolve the ambiguities and uncertainties that might have ensued from a partial devolution of the national speed limit for Scotland in respect of certain vehicles or roads.

We are pleased to support the amendments, and I echo the right hon. Gentleman’s thanks to the officials and team in the Scotland Office for piloting this hugely significant Bill on such a relatively smooth course through not just this House, but the other place. It now has the approval of the Scottish Parliament, too—no mean feat. On that basis, we on the Opposition Benches wish the Bill a speedy journey on its passage into law in the coming days.

I am very happy to support this group of Lords amendments and, indeed, the provisions in the Bill.

I must confess that this is an issue on which I have changed my mind. On Second Reading, I had concerns about creating different speed limits north and south of the border. I did not say so from any great constitutional position; I was very much wearing a “road safety” hat. I serve on the Transport Committee, and road safety is an issue that we take with great seriousness. Indeed, we are conducting an inquiry into it.

Drivers can get lulled into a sense of security on a long journey, and for long-distance drivers in particular, going up the M6 and then the M74, I was concerned that if the speed limit changed suddenly at Longtown or Gretna, depending on which way they were going, it could result in some road safety issues. But as part of the Committee’s inquiry we have been looking at different speed limits in different parts of the country, through managed motorway limits and other road safety measures, and by considering the evidence I have been persuaded that it is not the issue I thought it might be, so I am happy to welcome the changes before us. Rather than having the United Kingdom Government responsible for some speed limits and the Scottish Government responsible for others, it makes sense to group them under the auspices of one Government.

My only additional point, which echoes that of the hon. Member for Edinburgh North and Leith (Mark Lazarowicz), is that if we reach a situation in which there are differing speed limits on either side of the border, we will need proper signage and, through the Highway Code and the driving test, to explain those differences properly so that there is proper education and awareness.

With that small caveat, I am happy to support the Lords amendments, and in the last few seconds before I am cut off in my prime, I too congratulate and thank the officials who put together the Bill.

I add my support for the Lords amendment. It makes sense. We have to realise that drivers of all kinds cope with different speed limits, even within one county. This Bill has had a long journey, but there has also been a long journey for those of us who, like you, Madam Deputy Speaker, were here in 1997—

Yesterday, I made a statement announcing a consultation to seek views on how any referendum can be made legal, fair and decisive. I discussed this yesterday with the First Minister, and I hope to have further discussions with the Scottish Government, along with other politicians and people from across Scottish civic society, during the consultation.

The House of Commons Library has given me strong evidence to show that the economies of Quebec and Canada as a whole suffered in the 1990s due to constitutional uncertainty. For the sake of jobs in Scotland and England, does my right hon. Friend agree that the last thing we need is a prolonged period of constitutional uncertainty, and that the First Minister should stop playing politics and get on with it?

My hon. Friend is correct to point to that independent analysis and the experience of Quebec and the rest of Canada. It is vital that the economic uncertainty we now face because of the referendum is resolved, which is why we have brought forward proposals to make the referendum legal, fair and decisive. I want it to happen as soon as possible.

I reciprocate the wishes of the hon. Gentleman for a happy new year and hope we may all be in a good mood throughout it. Of course there will be a cost to any democratic process, but it is clear that we have a major historic decision to make. I am keen that we get on with that and that we do it in a clear, fair and decisive way.

During the consideration of the Scotland Act 1998 in this place, the then Scottish Secretary, Donald Dewar, said:

“A referendum that purported to pave the way for something that was ultra vires is itself ultra vires.”—[Official Report, 12 May 1998; Vol. 312, c. 598.]

In the absence of his being able to publish legal advice, does my right hon. Friend agree that that statement makes it perfectly clear where the law stands?

As ever, my hon. Friend has been assiduous in his homework, for which I commend him. Indeed, the late sadly lost leader, Donald Dewar, when he debated it from the Dispatch Box all those years ago, set out clearly what he believed would or would not be allowable within the law. I think the Act was well written. It is clear and I invite everybody to scrutinise it. I believe that when they do, they will come to the same conclusion as we have. Therefore we need to get on and provide a legal basis for the referendum.
