Commons ChamberI want to thank the Government for making time available for this debate—looking at the Minister, I am glad that I did not wear my pink jacket today; that would have been a little awkward.
It is important for so many reasons to have this debate on the Floor of the House. We will mark and honour the important contributions that women make, not only in this place but across society. It also gives us a dedicated opportunity in this Chamber to illustrate the structural barriers that still exist for women, and to reflect on the deaths of the women who have been killed since the last International Women’s Day debate, with the names compiled by Karen Ingala Smith and read by my hon. Friend the Member for Birmingham, Yardley (Jess Phillips).
I would also like to thank Mr Speaker for continuing a tradition that I started when I first became shadow Minister for Women and Equalities, by ensuring that the International Women’s Day flag is raised across the parliamentary estate—it will be raised on Sunday and Monday to mark International Women’s Day 2020.
The theme for this year’s International Women’s Day is “Each for Equal”. An equal world is an enabled world. It is about recognising that collectively we can help to create a more equitable world. We need diverse voices and lived experiences around every decision-making table. That is not only good for society; it is also proven to be good for business.
I acknowledge that we have seen progress here in Parliament, as has been mentioned. At the 2019 general election a record number of women were elected to this House. Women now make up 34% of MPs, up from 32% in 2017. I am particularly proud that the Labour party increased its proportion of women, meaning that women MPs now outnumber male MPs in our party. One of the legacies of my right hon. Friend the Member for Islington North (Jeremy Corbyn) will be that the parliamentary Labour Party is now 51% women—which mirrors society—the shadow Cabinet is 50% women, and the most recent intake was a whopping 77% women.
For too long politics has been the preserve of a particular wealthy group in society—the old boys’ club. I am pleased that is slowly beginning to change. We in this place have a duty to lead the way. A good start would be to have a stand-alone women and equalities Department, with a full-time Secretary of State. That way, we would not have to wait a year to have a dedicated debate.
New analysis published this week by the UN reveals that across the world close to 90% of men and women hold some sort of bias against women, which provides new insights into the invisible structural barriers that women face in trying to achieve fairness. That matches recent research done here in the UK by the Fawcett Society, which found that positions of power across public life and the economy are still dominated by men. At 21%, only a fifth of senior civil servants participating in the civil service board are women. At 35%, just over a third of permanent secretaries are women, and there are no women of colour in these roles; black, Asian and minority ethnic women are concentrated in the lower ranked roles.
The Government’s race disparity audit has shown that we need to address the structural barriers that are limiting progress. In the judiciary, women make up around a quarter of those in senior positions, but the proportion falls to 17% in the Supreme Court. In the business sector, women make up just over one in 20 CEOs of FTSE 100 companies. Again, none of those CEOs is a woman of colour.
Yesterday we saw new analysis published by the TUC showing that women work for free for two months each year as a result of the gender pay gap. Fifty years since the Equal Pay Act 1970, that is still the lived reality. It shows that gender pay gap reporting needs to go much further than simply publishing; we need compulsory action plans for what companies will actively do to close the gap. The Fawcett Society’s research shows that eight in 10 men and women support women being able to find out whether they are paid less than a man for equal work. It is time to give all women the right to know. Disabled women continue to face the most significant pay gaps of all; higher than those faced by disabled men and non-disabled women. Employers must take intersectionality seriously when tackling their gender pay gaps.
The Labour party wants a workplace revolution to bring about a step change in how women are treated at work. The Government could start that process by adopting some of our policies, as they have done previously—I do not mind; they are welcome to them. They should start by enacting section 14 of the Equality Act 2010, so that people can bring forward cases on multiple grounds of discrimination. Women are more than just one-dimensional, and it is about time that the law caught up so that we can be recognised for all our intersectionalities.
How about reinstating section 40 of the Equality Act, to protect against third-party harassment? We have had this debate over and over again. It is time that was done. Section 106 would mean that all political parties would have to publish diversity data about their electoral candidates. These simple steps would make a great change in the fight for gender equality. Women deserve better pay, increased flexibility and strengthened protections against harassment and discrimination. Women deserve equal pay and equitable recognition.
Labour not winning the election was tragic for so many reasons. With a Labour Government there would have been a chance to deliver real change. Over 85% of the burden of the Tory-Lib Dem cuts has fallen on the shoulders of women. A Labour Government would have begun to undo the damage and tackle the injustice to women. In power, we would have required employers to devise and implement plans to eradicate the gender pay gap and pay inequalities. With proper enforcement mechanisms, there would have been no place for large employers to hide gender inequality in their organisations. Labour would have created extra protections for pregnant women, those going through the menopause and terminally ill workers.
Labour would have ended zero-hours contracts and strengthened the law, giving all workers the right to flexible working from day one. The Labour party would have extended statutory maternity pay from nine to 12 months, and doubled paternity leave from two to four weeks, and we would have increased statutory paternity pay. The 1950s women would have received compensation for the injustice they have suffered. Unfortunately, Labour is not in government, but what we can do at every opportunity is demand more from this Government.
If Parliament is closed because of coronavirus, that should not be an excuse for the Government to close down. We will expect daily Zoom calls, at the very least, by Ministers and the Prime Minister, to address publicly the people’s priorities, so that they can be acted upon. I hope that the Government will start to listen to people. I hope that they will have the courage to provide for women in a fair way.
The upcoming Budget provides an ideal opportunity to address the imbalance and finally give the necessary resources. I hope the Treasury will publish meaningful equality impact assessments, which have been lacking year after year, and I hope we will finally see the right level of investment in vital social infrastructure, without which we will never make sufficient progress for women.
We must not stop until we eradicate the structural inequalities in society and the violence against women and girls. Thankfully, the Government brought back the Domestic Abuse Bill earlier this week, and I pay tribute to all the campaigners who fought tirelessly to make sure that happened. I welcome the Bill, which includes a new legal obligation on councils to provide secure refuges for victims. That is progress, but we need to be certain that refuges have secure long-term funding. The Government have cut funding, and we have seen the closure of specialist services, which has affected the life chances of very vulnerable women.
I also want to see better protection for children. Although we have seen a shift in how sexual violence and harassment are discussed following the #MeToo movement, we urgently need to consider the experiences of black, Asian and minority ethnic women and girls. That is why the Bill needs to be amended to recognise BAME women and migrant women.
I hosted an event here in Parliament yesterday at which Imkaan launched its new report, “Reclaiming Voice: Minoritised Women and Sexual Violence.” It is the first report of this nature in the UK, and it specifically focuses on survivors of sexual violence and BAME women’s experience of sexual violence. We must look at the evidence in this report, and I will happily provide the Minister with a copy. As well as the report’s findings, we must listen to the voices of all women and groups and make sure that we do not leave any group behind.
Violence against women and girls is unacceptable, as is how women are treated in the criminal justice system. The number of women in prison has more than doubled since 1993. There are around 2,400 more women in prison today than in 1993, which is disturbing. We know women account for a disproportionate number of self-harm incidents in prison, despite making up only 5% of the total prison population. Almost 60% of women in custody or supervised in the community have experienced domestic violence. That figure is too high, and we need to do more to address it. As a former magistrate, I have seen the failures of the justice system towards vulnerable women, and it needs to be looked at.
Last year, the UK fell six places in the global rankings of gender equality. It is simply not acceptable that we dropped from being the 15th most equal nation in the world to the 21st. I want to be up there with the likes of Iceland, Norway and Finland. It is time the Government woke up, fixed up and took on board some of the progressive agenda of those countries.
This year, on International Women’s Day, let us celebrate and unite, let us support each other and let us elevate and empower all women. No more excuses, no more reports, let us get equality done. The time for audits, reviews, roundtables and gender pay gaps is over. What we need now is action. We cannot wait another 50 years to see progress. Let us make 2020 the year that we have the vision to deliver for all women.

Commons ChamberI do agree with the hon. Gentleman, and I am grateful to him for his question. Sadly, he is right about the increase in hate crime against LGBT people, and he is right that educating children at school so that we change the culture that may exist among some people is one of the many ways we can tackle this.
This is my first time at the Dispatch Box this year, so may I congratulate you on your re-election, Mr Speaker, and say happy new year to all the staff in the House?
I thank the Minister for her response. Now that the general election is over, there seems to be no need to prolong the decision making any further. She should have had plenty of time to study carefully the consultation on the Gender Recognition Act 2004 and consider the Government’s response. Will she take this opportunity to update the House?
My hon. Friend is absolutely right: there is a huge opportunity to get more people, particularly more women, starting their own businesses. I would be delighted to meet him and work with the all-party group to make it happen.
The Home Secretary’s response to a question on race relations was actually quite damaging. I am really pleased that the Minister is listening to Labour MPs, but can she clarify what is happening with the Government’s race and disparity unit, and outline steps that she is taking to address the fact that there are no women of colour in top civil service jobs?
The Home Secretary was absolutely reflecting the fact that Britain is a great country in which to live and that we have very low levels of discrimination compared with the rest of the world. Of course, there is always more that we can do, but that is what this Department is about: removing the barriers that are based on race, gender or disability and making sure that people can thrive. I am proud of the fact that our Home Secretary is from an ethnic minority and that our Chancellor is from an ethnic minority. We have also had two female Prime Ministers. How is that going for the Labour party?

Commons ChamberI completely condemn bullying or violence towards trans people, but I do not think that that could be confused with the complex piece of work that is the reform to the Gender Recognition Act. In particular, I will not be rushed into it. I am very keen that we protect single-sex spaces and vulnerable women, and that we do not rush into reform before we have had full, proper discussion.
I welcome the Minister to her new position and look forward to working with her on all these issues. I am losing count, but I think she is the fifth Minister whom I have shadowed since I have occupied this position. However, we do not start from the beginning every time we change Ministers.
Reform of the Gender Recognition Act was promised in 2016. The Minister does not need to look at it carefully; the Minister just needs to expose what came out of the consultation and amend the Act as promised. The Minister needs to stop kicking the can down the road. There has been a 37% increase in hate crime against transgender people, and the Minister is exacerbating the pain and the hurt in the LGBT+ community. Please, Minister, just reform the Gender Recognition Act already.
As I have said, I completely condemn violence against trans people, and we and the Home Office are doing a lot of work to combat it, but I think it is completely wrong to conflate that with a complex piece of legislation that we need to get right. There are serious concerns about single-sex spaces and ensuring that vulnerable women are protected, and we should get the legislation right rather than rushing into things.
I am afraid that the hon. Lady is trying to make this into a political football. What I am interested in is making the right decisions for the people of Britain so that we have proper protection for transgender people and also ensure that we protect our single-sex spaces.

Commons ChamberThe Government said that it would take two weeks to resolve the Windrush cases; it has been over 64 weeks thus far. I have a live petition, which garnered more than 800 signatures a day, which I plan to present to the Prime Minister next week. Will the Minister join me in fighting for justice and fairness for the Windrush generation, and support the call to get all cases resolved before we break for recess?
I thank the hon. Lady for her question. As she knows from the work she has done, every case is complex. We want to ensure that they are being thoroughly considered. We will continue to update the Select Committee with work and progress on this, but I refer her back to the fact that more than 6,400 people have been given some form of documentation and more than 4,200 people have successfully applied to become British nationals through the scheme.
The consultation has finished, and some funding is ring-fenced as part of the inclusive transport strategy for ensuring that audio-visual equipment is installed on buses. The Department for Transport is in the process of bringing forward regulations and publishing guidance. That will be later this year. In the meantime, we are encouraging operators’ efforts to ensure that there is accessible information on their services.
The Prime Minister cites the race disparity audit and the gender pay gap regulations as some of her proudest achievements, seemingly not realising that they are symbolic of her failures. The report highlighted the systematic institutional racism of her Government’s policies, and we now have the real possibility of a casual racist and misogynist entering No.10—[Interruption.] I am afraid it is true. I hope the Minister will give assurances that the women and equalities agenda—[Interruption.]
Order. Let me be absolutely clear: nothing disorderly has occurred. People have free speech within the rules of the House. I will adjudicate the enforcement of those rules. Nothing disorderly has taken place, and I certainly do not require any assistance from occupants of the Treasury Bench.
Thank you, Mr Speaker. I could go through the list of things that have been said, but we do not have time. I hope the Minister will give assurances that the women and equalities agenda will not go backwards under the new Prime Minister. To adapt Stormzy lyrics:
“We have to be honest
Rule number two, don’t make the promise
If you can’t make the deal, just be honest
Equalities will never die, it’s like Chuck Norris
Rather, chuck this Government and chuck Boris.”
Although I am sure that there will be a lot of column inches and debate about the Prime Minister’s legacy, one of the things she can be proud of is setting up the Race Disparity Unit and the work she did to shine a spotlight on practices in particular parts of Government and public services. She has also supported me in setting up the equalities hub, which brings together that disparity team with disability, women and equalities and LGBT issues at the heart of Government. She should be very proud of that.
I gently point out to those on the Opposition Front Bench and all Members of the Labour party that they really should have come to the House today with a bit of humility, following the shocking and, quite frankly, chilling things we saw last night. There are Members of the Labour party—a once great political party—who are standing up for the Jewish community, and long may they continue to do that, but those on the Front Bench have to understand the graveness of what we saw. It is one thing to be incompetent and fail to grip a situation. It is quite another to be complicit in it.

Commons ChamberMy right hon. Friend raises an important point, and the Government take these issues very seriously. For example, our apprenticeship diversity champions network is working in partnership with employers to help to overcome gender stereotypes in sectors such as science, technology, engineering and maths and industries such as construction. My right hon. Friend will be pleased to know that since 2010 there has been a 26% increase in the number of girls entering STEM A-levels in England, and that in the United Kingdom the number of women accepted on to full-time STEM undergraduate courses since 2010 has increased by 28%.
On 22 April, we marked the very first National Stephen Lawrence Day. It has been 26 years since his tragic racist murder. Sadly, as the Prime Minister acknowledged, racism and racial discrimination are still very prevalent in our society.
In 2018, the UN special rapporteur on contemporary forms of racism, racial discrimination, xenophobia and related intolerance stated that any measure that directly or indirectly targets and undermines the rights of marginalised groups must be understood as breaking international human rights law. This Government have presided over an immigration enforcement system in which people are being unfairly racially profiled; refused to allow people to bring forward discrimination claims based on more than one aspect of their identity; introduced voter ID, which will disenfranchise marginalised communities; failed to act on the results of their own racial disparity audit; and introduced hostile-environment policies. Will the Minister inform the House whether, as well as breaking the UN’s human rights law, her Government are institutionally racist or just do not care?
The hon. Lady raises some very important issues. I am sorry about the tone of her question, because I do not recognise the attitude that she implies among my colleagues, including the Prime Minister, who has done some groundbreaking work in this area. What I would say to her and other hon. Members who rightly are concerned about these issues is that part of the motivation for moving the Government Equalities Office into the Cabinet Office, so that it can sit alongside the race disparity team, is to look at these things in the round. As well as the issues that she identified, individuals in this country face multiple discrimination. For example, an enormous number of people sleeping on the streets in London are young, gay, black men. Only by working together and looking at the disaggregated data will we really understand how we can improve lives for everyone in this country.

Commons ChamberYes, we have. I am sure that all Members across the House will welcome the recent announcements on schools, hospitals and colleges, but we want to look at the issue in the round. That is the job of the taskforce, and it will be about Departments, the private sector and the third sector coming together to create ways to sort this for any woman or girl who may find herself in that situation. On other issues such as primary schools, workplace settings and so forth, the taskforce is looking at all those, but I am also interested in ideas that hon. Members have, because I know that there are many great schemes out there in their constituencies.
I thank Amika George, the Red Box Project, the British Medical Association, the Communication Workers Union, Girlguiding UK, Plan International, Bloody Good Period, Beauty Banks, On The Ball, Hey Girls, Bloody Big Brunch, my hon. Friends the Members for Dewsbury (Paula Sherriff) and for Midlothian (Danielle Rowley), and Monica Lennon, the Labour Member of the Scottish Parliament, who helped with the policy on period poverty. I thank the Secretary of State and the Chancellor for the announcement yesterday. I am really pleased to hear that there will be a taskforce, and I wonder whether the Secretary of State would like to work with me and Monica Lennon so that we can make sure that refugee and homeless shelters all have free menstruation products.
Absolutely. This is an issue that can unite the whole House, and we need such issues, especially at times like this. When I launched this, I also paid tribute to many organisations, including those that the hon. Lady mentions, for the fantastic work that they are doing. We do not want to reinvent the wheel. There is great, sustainable work out there, and we want to take those ideas, help them scale up and ensure that we can end this issue for good.

Commons ChamberUnder the auspices of the Office for Disability Issues, and subsequently the assistance dog sector, all those fantastic organisations and charities have come together to harmonise their standards, so that the owner of a café or pub, or a taxi driver, can identify legitimate assistance dogs more easily. There is absolutely no excuse for excluding people who have assistance dogs. We are considering what further measures we can introduce to ensure that that can be enforced, and in particular whether the rules on licensing of venues and premises can help with that issue. The Home Office is setting out its plans for a formal consultation with disabled people’s organisations and other representative groups in due course.
This week I had a phone call with regard to a young man who tried to commit suicide and a mother who felt that she did not want to burden her children any more, all because of the Windrush scandal. They say that to educate a woman is to educate a nation; therefore, to humiliate a woman is to humiliate a nation. Will the Minister assure the House that the Government will provide urgent and necessary help, support and assistance to women and vulnerable people affected by the Windrush scandal?
May I again set out the Government’s apology to those who have suffered through this terrible incident and reflect on the fact that this was not just one Government who got it wrong, but many Governments of all political colours? I welcome the fact that colleagues across the House are bringing individual constituency cases to our attention. We can then feed them into the system that has been set up so that we can provide help and support. The hon. Lady must, of course, let us know of any cases she wishes to raise, but the Government must learn from mistakes, which was why we set up the review. We are pleased that more than 4,000 people have been helped through the scheme—not just Windrush victims, but people from other countries. It is very much a work in progress, but we welcome Members across the House continuing to raise these issues in the Chamber.

Commons ChamberMy right hon. Friend makes an incredibly important point. The Cabinet Office is doing great work to create more diversity in the honours list, but inequality is baked into the system, including in the use of courtesy titles. It is quite wrong that people are treated differently in this way, so I have written to my right hon. Friend the Prime Minister to ask that it is remedied.
May I take this opportunity to wish you, Mr Speaker, everyone who works here and all Members a very merry Christmas? On the Christmas theme,
There are five days to Christmas, so will the Minister promise me:
An action plan to close the pay gap;
To end period poverty;
Sustainable funding for refugees;

Commons ChamberI go up and down the country to jobcentres, and I will, of course, go to Scotland in due course, but what I hope the hon. Gentleman will do in turn is talk to local jobcentres in his area and seek that assurance as well for his constituents.
The reality is this: women who work, women without children, women with children, disabled women, black, Asian and minority ethnic women and women fleeing domestic violence have all been punished by universal credit. Report after report has issued stark warnings about the design of universal credit and its impact on survivors, but the Government refuse to listen. Instead, they make claims about a landmark domestic abuse Bill, while their policies, staff and systems are failing to protect survivors. It makes no sense. Will the Minister show some compassion when he gets to his feet and halt the roll-out of universal credit until it is fixed?
We are keen to support everyone who is coming on to universal credit. That is why earlier this year we introduced £1.5 billion of support. In the Budget, we had another net £4.5 billion of support produced. With respect, I say to the hon. Lady that if she wants to help her constituents, she should vote for the measures whereby we put more money into the system.

Commons ChamberThere are now 1.1 million women-led small and medium-sized businesses in the UK, and I want that number to grow, having been a small business owner before I arrived in this House. It is fantastic to hear about my hon. Friend’s constituent, Mrs Darlington, and I am pleased to hear about her success. The Government-supported Start Up Loans company had given loans worth nearly £450 million, nearly 40% of them to women, by March this year. We also have 38 growth hubs across England providing information and support to anyone—that includes women—who wants to start and grow their own business. I wish Mrs Darlington continued success.
We welcome the fact that upskirting has been made into a specific sexual offence. It cannot be right, therefore, that victims of revenge porn are not afforded the protection of anonymity. The Government’s new victim strategy, which was released on Monday, failed to address the lack of protection for victims of image-based sexual abuse. When will the Government close this loophole in law and give all sexual abuse victims the protection that they deserve?
The hon. Lady has raised this matter with me on previous occasions, and I know that she will welcome what is in the victim strategy. She highlights an important issue. As she will be aware, in terms of tackling the publication of upskirting images and voyeurism online and via social media, the Law Commission is looking, as part of the DCMS-commissioned review into online abuse, into the sharing of intimate and sexual images. I believe that that is the right way for us to proceed with looking at the important issue that she rightly highlights.
