It is a pleasure to serve under your chairmanship, Mr Streeter. I congratulate the hon. Member for Brent Central (Dawn Butler) on securing the debate. I genuinely commend her for the moving way in which she presented her case and the words of her song—I have to say there was a moment when I thought she was going to sing it.

I was pleased to hear the hon. Member for Glasgow North East (Anne McLaughlin) mention the great Mary Seacole. It is right that we remember her contribution. We remember her in Government too. The Home Office building in Westminster is made up of three buildings—one is named after Robert Peel, one after Elizabeth Fry and the other after Mary Seacole—so Ministers and officials are reminded of her every day as they go about their work, much of which may well be on the issue we are debating today.

On the international day for the elimination of racial discrimination—a day on which my right hon. Friend the Prime Minister has made a very definitive statement—we also remember what happened in the township of Sharpville in South Africa in March 1960 and those who died in what was supposed to have been a peaceful protest. We express our total solidarity with all victims of racism and reiterate our determination to challenge discrimination in whatever form it takes, at home and abroad. Combating all forms of racism remains an important part of this Government’s international human rights policy. I would like to set out some of the work that we are doing around the world.

The UN convention on the elimination of all forms of racial discrimination underpins international co-operation to prevent, combat and eradicate racism. Effective implementation of the convention is essential if we are to achieve its aims. That is why the UN General Assembly reviews that implementation through a UN resolution. As a co-sponsor of the resolution, the UK takes a leading role in the United Nations’ work to counter racism worldwide. Through the UN, we work to ensure the international community focuses on strengthening national, regional and international legal frameworks to make a reality of the protections contained in the convention. During the current Human Rights Council session in Geneva, we are working very hard to build international consensus about the importance of fighting racism and the best ways to do it.

The UN is not our only channel for that work. We are also working through other key international institutions. For instance, through the Organisation for Security and Co-operation in Europe we are supporting countries with a disaggregation of hate crimes data. It is fair to say that the UK has become a world leader in this area. Furthermore, last year we co-hosted, with Poland, an OSCE event in which we shared the lessons learned in our response to the absolutely unacceptable spike in reported hate crime following the EU referendum.

We are also supporting projects that tackle anti-Semitism. For example, we are funding the translation into Polish and Romanian of the “Police Officer’s Guide to Judaism”. That guide to Jewish religious practice is published by the Community Security Trust to help police officers to effectively and sensitively investigate anti-Semitic crimes. As part of our continued commitment to fight anti-Semitism, we remain an active member of the International Holocaust Remembrance Alliance.

The UK is also represented by our independent expert, Michael Whine, on the European Commission against Racism and Intolerance. That organisation monitors racism, xenophobia and other forms of hate crime, and prepares reports and issues recommendations to Council of Europe member states. Having the UK represented by an expert ensures that the UK’s approach to race equality issues is heard and properly understood in the Council of Europe.

The UK’s strong international reputation in the fight against racism is underpinned by our long and proud tradition as an open and tolerant nation. Although work remains to be done, we can credibly claim that Britain today is a successful multi-ethnic country. Members of our African, Caribbean, Asian and other ethnic minority communities are represented in every area of British society—in business, academia, sport, the arts and politics.

The UK also has some of the strongest equalities legislation in the world, but we know that on its own it is not enough. We have to recognise and challenge racism and discrimination whenever they occur. The Prime Minister has made clear her determination to do just that. One of her first acts in office was to launch an unprecedented audit of public services to reveal racial disparities. That audit is being conducted right across our public services, from health, education, employment, skills and criminal justice. It may reveal difficult truths, but we should not be apologetic about shining a light on any injustice. It is only by doing so that we can make this a country that works for absolutely everyone.

As has been mentioned today, the despicable rise in racist incidents after the EU referendum highlighted even more strongly the need to tackle the scourge of hate crime. That is why in July we published a new hate crime action plan that focuses on reducing incidents, increasing reporting and improving support for victims. It was accompanied by an additional £1 million for prevention work. We will review the plan next year to ensure it is delivering on its commitments. In January, my right hon. Friend the Secretary of State for Communities and Local Government announced a further £375,000 of new funding to tackle hate crime. The new package will support a range of organisations working with faith and minority communities that have historically faced challenges in reporting hate crime.

As part of the Government’s continued commitment to building strong, united communities, we have spent more than £60 million since 2010 on our integration programme to bring communities together. We have provided more than £5 million since 2010-11 to the Holocaust Memorial Day Trust as part of our ongoing commitment to holocaust remembrance and education, and just under 6,000 local commemorative events took place in January. We are also proud to fund Tell MAMA—Measuring Anti-Muslim Attacks—the first service to record anti-Muslim incidents and support the victims. So far, we have provided more than £1 million to fund it. In the coming months, the Government will bring forward plans for tackling the issues raised in Dame Louise Casey’s report into integration and opportunity in isolated and deprived communities.

Once again, I thank the hon. Member for Brent Central for initiating this debate. I and the Government believe that every individual, regardless of their racial or ethnic origin, should be able to fulfil his or her potential through the enjoyment of equal rights, equal opportunities and fair responsibilities. The Government reiterate our commitment to stand up against injustice and inequality wherever it occurs. As the Prime Minister said, it is by tackling the injustice and unfairness that drives us apart and by nurturing the responsibilities of citizenship that we can build a shared society and make it the bedrock of a stronger and fairer Britain that truly works for everyone.

My right hon. Friend the Secretary of State for Foreign and Commonwealth Affairs and my right hon. Friend the Secretary of State for Defence attended the joint session of the Foreign Affairs Council (Foreign and Defence Ministers) on 6 March. The Council was chaired by the High Representative of the European Union for Foreign Affairs and Security Policy, Federica Mogherini. The meeting was held in Brussels.

The meeting covered a joint session with Foreign and Defence Ministers on defence. The foreign policy agenda featured Egypt, the western Balkans and the middle east peace process. Ministers also touched briefly on migration.

Defence

EU Foreign and Defence Ministers held a joint session to take forward the European Council conclusions of 15 December 2016. The discussion covered: improving the functioning of non-executive military (training) missions through the establishment of a military planning and conduct capability; permanent structured co-operation for better joint capability development; and the co-ordinated annual review on defence. Defence Ministers also discussed the strategic outlook for the EU’s common security and defence policy. The Defence Secretary emphasised the need for EU initiatives to complement NATO and to respect member states’ competence on defence issues. He underlined the UK’s significant contribution and continued commitment to European security and defence, including meeting NATO’s target of 2% of GDP. He stressed the need for European partners to increase national defence spending.

Egypt

Over lunch, Ministers discussed EU-Egypt relations with the Egyptian Foreign Minister Sameh Shoukry. They discussed political developments, economic reforms, co-operation in various sectors, including counter-terrorism and migration, as well as Egypt’s role in the region, with a particular focus on Libya, Syria and the middle east peace process.

Western Balkans

Ms Mogherini briefed the Council on her recent visit to the region. Ministers welcomed the increased EU engagement. They also discussed the challenges facing the western Balkans including increasing tensions, worsening political dynamics and a growing use of inter-ethnic and nationalist rhetoric, compounded by the role of third parties, socioeconomic difficulties and a perception of EU and US disengagement.

MEPP

Foreign Ministers discussed issues relating to the middle east peace process. The Council discussed preparations for the next EU-Israel Association Council. The HRVP suggested the Council consider holding a similar high-level meeting with the Palestinians.

Ministers agreed without discussion a number of measures:

The Council adopted conclusions on “Implementing the EU global strategy—strengthening synergies between EU climate and energy diplomacies”.

The Council adopted conclusions on the Democratic Republic of the Congo.

The Council adopted the EU guidelines for promotion and protection of the rights of the child (2017)—Leave No Child Behind.

The Council took note of the 18th annual report defining common rules governing controls of exports of military technology and equipment.

The Council adopted the updated military list of the EU in line with the provisions of the common position on arms exports.

The Council adopted the EU-Algeria partnership priorities to be adopted at the EU-Algeria Council, which took place on 13 March.

The Council adopted the EU position for the Association Council with Algeria, which took place on 13 March.

The Council approved a concept note on the operation planning and conduct capabilities for CSDP missions and operations.

My right hon. Friends the Secretary of State for Foreign and Commonwealth Affairs and the Secretary of State for Defence will attend the Foreign Affairs Council (Foreign and Defence Ministers) on 6 March. The Foreign Affairs Council will be chaired by the High Representative of the European Union for Foreign Affairs and Security Policy, Federica Mogherini. The meeting will be held in Brussels.

Foreign Affairs Council

The morning will start with a joint session for Foreign and Defence Ministers on defence. The foreign policy agenda will feature western Balkans, migration, Egypt and the middle east peace process.

Defence

Ahead of the joint session, Defence Ministers will discuss the strategic outlook for the EU’s common security and defence policy (CSDP). EU Foreign and Defence Ministers will then review the implementation of the December European Council package on defence. The discussion and conclusions will cover: improving the functioning of non-executive military (training) missions through the establishment of a military planning and conduct capability (MPCC); permanent structured co-operation (PESCO) for better joint capability development; and the proposed co-ordinated annual review on defence (CARD).

Western Balkans

Ahead of discussion on the western Balkans at the March European Council, HRVP Mogherini will brief Ministers on her forthcoming regional tour and update the Council on the EU-facilitated Kosovo-Serbia dialogue. In her 17 January speech, the Prime Minister identified the western Balkans as a region in which the UK has played and will continue to play an active role in promoting European security.

Migration

There may be a discussion on migration following the Valletta senior official meeting on 8-9 February which reviewed progress against the Valletta action plan. The UK used its chairmanship of the Khartoum process in 2016 to encourage implementation of the Valletta action plan to tackle unmanaged migration flows from the horn of Africa. The UK provided a total of £4 billion in aid for Africa in 2015-16, with an increasing focus on jobs and livelihoods.

Egypt

Foreign Minister Shoukry will attend the lunch discussion where Ministers will discuss Egypt’s relationship with the EU and role in the region. Discussions are expected to cover Egypt’s political and human rights situation, including the growing restrictions on civil society. Ministers are also likely to discuss how the EU can best help strengthen Egypt’s internal security, co-operate on bringing stability to Libya, and work together on combating illegal migration in the region.

Middle east peace process

Ministers will discuss developments on the middle east peace process (MEPP) and are likely to discuss obstacles to peace, including incitement, terrorism, demolitions and recent settlement announcements.

International Court of Justice: Optional Clause Declaration

The Government have informed the UN Secretary-General of an amendment to the United Kingdom’s optional clause declaration accepting the compulsory jurisdiction of the International Court of Justice (Court/ICJ). The declaration accepts the jurisdiction of the Court in contentious cases that come within its scope.

The Government keep their declaration under review. The ICJ case on nuclear disarmament filed by the Marshall Islands against the United Kingdom in 2014 concluded with a judgment of 5 October 2016 that upheld the United Kingdom’s preliminary objections to jurisdiction. We have now decided to build into our declaration two key elements that underpinned the principal arguments that the Government made in those preliminary objections.

The revised declaration requires other states to give six months’ notice of a claim or dispute against the UK that they propose to submit to the ICJ. This would provide an opportunity for diplomatic engagement with the state concerned. The prior notification of a claim is an established part of domestic dispute resolution in the United Kingdom, as well as being a feature of the dispute settlement provisions in many international treaties. The judgment of the ICJ in the nuclear disarmament case accepted that a state must be made aware that litigants have opposing views, otherwise a respondent state does not have the opportunity to react to those opposing views before the institution of proceedings against it. The revised declaration incorporates the UK position that was advanced in the proceedings that prior notification of the kind described is an appropriate step before an application instituting proceedings, seising the Court, can be submitted.

The United Kingdom would be held to the terms of the new declaration in respect of any proceedings that it may wish to institute. The Government are content to be held to this standard.

In addition, the revised declaration also includes a reservation excluding from the Court’s jurisdiction any cases related to nuclear weapons and/or nuclear disarmament unless the other four nuclear non-proliferation treaty (NPT) nuclear-weapons states also accept the Court’s jurisdiction with respect to the case. The Government do not believe the United Kingdom’s actions in respect of such weapons and nuclear disarmament can meaningfully be judged in isolation. This amendment to our declaration provides that the ICJ will only have jurisdiction over nuclear weapons or nuclear disarmament disputes when the proceedings involve all five of the NPT nuclear-weapons states.

We have also made changes to advance the cut-off date for historical cases to 1987, keeping it at 30 years, and to make clear that a repeated claim, as well as a dispute, is also excluded.

The Government are firm in our commitment to a rules-based international order. We continue to accept the compulsory jurisdiction of the ICJ and believe that the Court has a valuable role to play in resolving international disputes peacefully.

The Foreign Secretary and I took part in the Geneva conference on the Cyprus settlement on 12 January. We welcome the Cypriot leaders’ commitment to resuming political level talks next month. We are keen to maintain momentum and stand ready to bring negotiations to a successful conclusion.

Will my right hon. Friend agree that third-country guarantees should have no place in a new settlement for Cyprus, because Cypriots should be able to determine their own future without the threat of external military intervention?

It is up to the two sides to decide what future security arrangements they want for a united Cyprus that will enable both communities to feel secure. As a guarantor power, the UK is playing a supportive role and is open to any arrangement that is acceptable to the two communities.

I thank the Minister for that reply. He will know that Northern Ireland has had a partnership Government who have moved forward, bringing communities together. What has been done to offer advice from Northern Ireland to bring forward a political process that works, especially in relation to gas and oil exploitation, which could benefit all of Cyprus?

I think the example of Northern Ireland is an example to the whole world, and it has been of benefit in the likes of Nepal and Colombia. The issue of Cyprus is slightly different, but I hope that the lessons from Northern Ireland can be taken into account and that they can help inform the progress we would like to see in Cyprus.

Does the Minister agree with the view of the all-party parliamentary group, which visited Cyprus last week, that the best hope for a solution is the dedication and courage of both Cypriot leaders, freely negotiating, and a realisation in the communities that the status quo of a divided Cyprus is untenable? Does he agree that we need to ensure that Turkey gets that when it comes to security and guarantees?

My hon. Friend is absolutely right, and I think we all applaud the good faith and dedication of the two leaders, who are working tirelessly towards a solution. There are other ingredients that are necessary, such as the co-operation of the two main countries next door, Greece and Turkey, and—this is very important—successful referendums in each community.

The last time negotiations in Cyprus seemed close to a deal, the effort collapsed when hackers broke into the UN’s computer systems and the documents were leaked to a pro-Russian Cypriot newspaper. The inflamed communal tensions that followed had a major role in scuppering the chance of a deal. What assurance can the Minister give that lessons have been learned from that experience and that proper safeguards are now in place to protect the negotiations from any undue influence from outside?

Friend the Member for Orpington (Joseph Johnson), is in regular contact on this issue with his European counterparts, including the European commissioner.

In paragraph 10.14 of their White Paper, the Government tell us that they

“would welcome agreement…with our European partners”

on science and technology issues, but they give no indication of how that agreement will be achieved—no timetable, no detail and absolutely no guarantees. Will the Minister tell us what discussions have taken place, rather than simply telling us that the Government have had discussions?

We are strongly committed to European scrutiny and will remain so after we leave the EU. NATO remains the cornerstone of our defence, and we will continue to play our full part in supporting European security, particularly in eastern Europe.

I welcome my right hon. Friend’s commitment to NATO, but does he not find it as depressing as I do that while other EU countries are completely obsessed with creating an EU defence identity, they are failing miserably to meet their NATO requirement of spending a minimum of 2% of their GDP on defence? Is not the foot-dragging by Germany, the richest country in Europe, and its refusal to honour that commitment until 2024 particularly perverse?

We continue to make it clear that nothing should cut across NATO’s role as the cornerstone of European defence. Other parties’ contributions being fairly distributed to NATO would make sure that NATO can remain the force it needs to be.

The Foreign Secretary mentioned the sanctions against Russia over its actions in Ukraine. Will the Minister confirm that even when we leave the EU it will be open to us to democratically agree such sanctions with the rest of the EU where it is in our mutual interest?

That is not specifically a question about defence policy, as on the Order Paper, but none the less I can reassure the hon. Lady that the answer is yes. Some kind of parallel structure for implementing sanctions will be required and I am sure will be agreed.

In July 2015, the highest court in Colombia decided that Her Majesty’s Government had discriminated against its embassy employee, Mr Darwin Ayrton Moreno-Hurtado, on the basis of his ethnic identity and religious convictions. The court ordered his immediate reinstatement, yet Her Majesty’s Government stubbornly continue to refuse to obey the court in Colombia. Does the UK Government not take seriously the judicial decisions of courts in Colombia, or do they not take seriously the need to cease ethnic and religious discrimination against their employees in Columbia?

Does the Foreign Secretary agree that any global Britain strategy should include the whole of the global British family, which means the British overseas territories and the Crown dependencies? What guarantees will the Government give that they will be included in any new arrangements post-Brexit?

The announcement by Toshiba last week regarding NuGen will mean that new foreign investment will be required for the Moorside nuclear development. Does this not place a new question mark over the UK’s decision to pull out of Euratom, which will create more instability for the industry?

We shall remain a full member of Euratom while we remain part of the European Union, and we intend to make sure that all our research into nuclear fusion will continue after we leave.

It is a pleasure to serve under your chairmanship, Mr Turner. In response to the two petitions that have triggered this debate, and having listened to the arguments of both sides, I would like to set out the position of Her Majesty’s Government and explain the thinking behind it.

As other hon. Members have said, the state visit is a uniquely British construct. No other country is able to offer one in quite the same way—it is distinctively British. Her Majesty has hosted more than 100 state visits during her reign. All such visits are a rare and prestigious occasion, but they are also our most important diplomatic tool. They enable us to strengthen and influence the international relationships that are of the greatest strategic importance to this country and to other parts of the world.

To answer a question asked by the Opposition spokesperson, the hon. Member for Hornsey and Wood Green (Catherine West), recommendations for state visits are made on the advice of the Government through the Royal Visits Committee, not by Parliament. The committee is attended by representatives of the royal household, Downing Street, the Cabinet Office and the Department for International Trade, and is chaired by the Foreign and Commonwealth Office.

No, I am going to make progress.

In an uncertain and increasingly dangerous world, the ability to work closely with key countries is critical. Strong alliances and close relationships are a central stabilising pillar for world security. This is an increasingly unstable world, but throughout modern history, the United States and the United Kingdom have worked together side by side to bring peace and security during times of danger and uncertainty. Put simply, a state visit matters so much because diplomacy matters, especially with the world as it is today.

The relationship between the United Kingdom and the United States is built around a common language, the common principles of freedom and democracy, and common interests in so many other areas. Our relationship is undoubtedly special. On security, defence, trade, investment and all such issues, the United Kingdom and the United States are and will remain the closest of partners. The United States is the world’s greatest power. In the light of America’s pivotal role, it is entirely right that we should use all the tools at our disposal to build common ground with President Trump.

As the baton of office passed seamlessly and constitutionally from one President to another, we were already well placed to have a productive and meaningful engagement with the new Administration. The British embassy in Washington has been working with key figures in the US Administration over many months. British Secretaries of State have built relationships with their opposite numbers after their congressional confirmation. The Prime Minister’s visit last month was of enormous significance. Only last week, the Foreign Secretary and the Defence Secretary met their opposite numbers. On Friday, I met the US Secretary of Homeland Security, John Kelly.

The Government place our national interest at the heart of our decision making, and the special relationship is a central part of that national interest.

The special relationship transcends political parties on both sides of the Atlantic, and it is bigger than individual personalities. It is about the security and prosperity of our two nations. The Prime Minister’s meeting with President Trump in Washington last month identified many areas of common interest on which we will work with the new Administration. A state visit will provide the opportunity to further advance those common interests.

Hon. Members have mentioned timing. State visits are not necessarily the sole preserve of long-serving heads of state. In the past, a state visit has been extended to the Presidents of South Africa, France, South Korea, Finland and Poland, among others, each within their first year of office.

Does the Minister agree at least that extending a state visit in this way and at this time could effectively be seen as a validation of the views and statements of President Trump? It has been seen in that way by many of my constituents, who feel very concerned about the message that it sends.

I understand the hon. Lady’s point exactly. I accept that that is a powerful counter-argument to the case that I am making, but I do not accept that the process of a state visit will be seen as such validation. Let me explain further what I think the value of the state visit will be.

The Government strongly believe that it is a perfectly legitimate decision to use the full impact of an invitation to maximise the diplomatic significance of a state visit at the start of President Trump’s term of office. President Obama and President George W. Bush both visited the UK on a state visit during their first term in office, so it is entirely appropriate that President Trump, too, should be invited in his first term. However, since timing has been raised today, let me be absolutely clear that neither the precise timing nor the content of the proposed visit has yet been agreed.

Mention has been made of the prospect of the President addressing Parliament in some manner or other. In fact, only three guests in the past hundred years have addressed both Houses of Parliament as part of a state visit: President de Gaulle in 1960, President Mandela in 1996 and President Obama in 2011. In any event, as the House is aware, whether that ever happens is solely for the relevant parliamentary authorities to determine.

I was talking about the prospect of the President addressing both Houses of Parliament. Comment on whether that might happen has run completely ahead of itself. The simple fact is that no request for any parliamentary event to take place has been received from Washington. The question of addressing a meeting of Parliament has never even been mentioned. Any discussion or judgment of that possibility is therefore purely speculative.

Within the views that have been expressed about the appropriateness of a state visit from the President, there lurks a fundamental principle that Members of this House should consider very seriously—the principle of freedom of speech. President Trump was democratically elected by the American people under their own constitutional system. To have strong views about him is one matter, but to translate a difference of opinion into a demand to ban him is quite another.

Given the understandable questions on certain policy stances that arise on any change of Government, it is prudent for us to work closely alongside the United States as the new Administration chart their course. We have already seen the importance of that engagement: the Prime Minister’s early meeting with the President has elicited key commitments on NATO, which were echoed by the vice-president in Munich on Saturday, and has laid the groundwork to establish a swift post-Brexit free trade agreement. Further constructive engagement will be helped by a state visit.

In February 1917, a century ago, The Spectator published its view on the US and the UK:

“It would be easy to write down a hundred reasons why unclouded friendship and moral co-operation between the United States and Britain are a benefit to the world, and why an interruption of such relations is a detriment to progress and a disease world-wide in its effects.”

It is that historic normality that is reflected in this invitation.

This is a special moment for the special relationship. The visit should happen, the visit will happen, and when it does I trust that the United Kingdom will extend a polite and generous welcome to President Donald Trump.

My right hon. Friend the Secretary of State for Foreign and Commonwealth Affairs attended the Foreign Affairs Council on 6 February. The Foreign Affairs Council was chaired by the High Representative of the European Union for Foreign Affairs and Security Policy, Federica Mogherini. The meeting was held in Brussels.

Agenda items included Libya, Ukraine, Egypt and the Middle East Peace Process. Ms Mogherini briefed Foreign Ministers on the Serbia/Kosovo dialogue and on planning for a conference on Syria to be held in Brussels in the spring.

Libya

The Council discussed the situation in Libya and adopted conclusions. The EU remains committed to an inclusive political settlement under the framework of the Libyan political agreement, with Libyan ownership of the political process and encouragement to all Libyan actors to engage constructively. There can be no military solution to the conflict. The EU reaffirmed its continued support for the UN Support Mission in Libya and welcomed engagement by Libya’s neighbours and regional organisations. Ministers also discussed the need to stem irregular migration along the central Mediterranean route.

Ukraine

Foreign Ministers discussed the recent escalation in violence in eastern Ukraine and the resulting humanitarian situation around the town of Avdiivka. They also discussed how the EU could increase support for the full implementation of the Minsk agreements. Ministers agreed on the need for continued strong support for Ukraine’s reform agenda, which is crucial to strengthen Ukraine’s resilience, and welcomed the progress Ukraine has made on reform to date.

Egypt

Foreign Ministers discussed the economic and political challenges facing Egypt, including the human rights situation, and agreed on the need for closer co-operation on these issues. Ministers also agreed that working more closely with Egypt on regional issues is a priority, given Egypt’s status as a strategic partner in countering terrorism and tackling illegal migration.

MEPP

Foreign Ministers discussed issues relating to the middle east peace process. The Council discussed possible timing for the next EU-Israel Association Council and agreed to revert to the issue. Member states expressed concern about the increase in Israel’s settlement building and the new settlement legislation passed by the Israeli Knesset.

Ministers agreed without discussion a number of measures:

The Council updated the information related to 21 persons and one entity subject to restrictive measures against the Democratic Republic of the Congo.

The Council took note of the annual progress report on the implementation of the European

Union strategy against the proliferation of weapons of mass destruction (WMD).

The Council took note of the annual report on the implementation of the European Union strategy to combat the illicit accumulation and trafficking of small arms and light weapons and their ammunition —actions in 2015.

The Council approved the conclusion of an agreement aimed at continuing the International Science and Technology Centre (ISTC).

My right hon. Friend the Secretary of State for Foreign and Commonwealth Affairs will attend the Foreign Affairs Council on 6 February. Foreign Affairs Council

The agenda for the Foreign Affairs Council (FAC) is expected to include Ukraine, Egypt, Libya and the middle east peace process.

Ukraine

Ministers will focus on the importance of sustained international support for Ukraine’s reform process. The UK strongly supports Ukraine’s reform agenda which is crucial to build a modern, stable state. We expect discussion will also cover developments in relation to the Minsk agreements.

Egypt

Ministers will discuss Egypt’s bilateral relationship with the EU and Egypt’s role in the region. We expect discussions will cover Egypt’s political and human rights situation, including the growing restrictions on civil society. Ministers are also likely to discuss how the EU can help strengthen Egypt’s internal security, co-operate on regional stability and work together on combating illegal migration in the region.

Libya

Discussions will cover the latest developments in the Libyan political process. We will encourage the EU to consider how it can best continue to support the Libyan political process.

Middle east peace process

Ministers will discuss progress on the middle east peace process (MEPP) and may reflect on obstacles to peace including incitement, terrorism, demolitions and recent settlement expansion.

First, I thank you, Mr Speaker, for granting this special debate, even though it followed 90 minutes of questions to the Foreign Secretary on the same topic. It is important that we have been able to air our views. It is no part of my comment tonight to find partisan difference or to argue with the fundamental moral arguments that have been put to the House today.

I commend the right hon. Member for Doncaster North (Edward Miliband) for pressing this issue. The House has every right to speak out. We are seen throughout so much of the world as the voice of democracy and as a lighthouse of justice and decency. It is in that vein that we have witnessed a debate of the highest quality that I hope will be noticed and listened to, and I hope that all those who have participated will feel proud of the contribution they have made on a very important issue.

We witnessed the most deeply moving speech from my hon. Friend the Member for Stratford-on-Avon (Nadhim Zahawi). It was clearly a moment of deep personal emotion for him. It illustrated what has fired us up today, along with millions of other people. There is a moral dimension to this issue, as we have been discussing, but perhaps we have not emphasised quite enough the intensely personal dimension for the individuals whose lives are going to be affected. That is what we must understand when we debate this issue.

From my right hon. Friend the Member for Chelmsford (Sir Simon Burns), with his encyclopaedic knowledge of US Presidents, we have learned about previous presidential visits to the UK. I acknowledge my hon. Friend the Member for Reigate (Crispin Blunt) for mapping out some of the broader strategic issues within which this very difficult issue has to fit. One of those is, of course, our relationship with the one superpower in the world, our closest historical ally, with which we have very close interests that affect all our constituents. I urge the House to appreciate that the Government have to see it from that perspective.

Perhaps, in addition to the fervent moral arguments we have heard, I can map out some of the practical side. On Friday, after the Prime Minister had left Washington, the President issued his Executive order banning the citizens of seven countries from entering the US for a period of 90 days. We know which countries they are: Syria, Iraq, Iran, Somalia, Yemen, Libya and Sudan. The order makes clear that no US visas will be issued to citizens of those states, and that anyone who already has a visa will be denied entry. I acknowledge the point made by the right hon. Member for Doncaster North that that is a significant extension of and is different from the list drawn up by the Obama Administration when those countries were withdrawn from the US visa waiver programme in 2016. What President Obama did in December 2015 was amend the visa waiver. From January 2016, it did not include individuals or dual nationals who had, in the previous five years, been to Syria, Iraq, Iran or Sudan. In February last year, the new provisions were extended—this is the origin of the list—to people who had travelled in the previous five years to Somalia, Yemen or Libya, but were not dual nationals of those countries. It is true that President Trump’s Executive order is more extensive and sweeping, and it is altogether of a different order.

The House has yet to debate what Brexit means in practice, but after the events of this weekend can we at least all agree that the last thing that it should mean is biting your tongue in the hope of doing trade deals and thereby abandoning all the values that this country has long held dear?

I do not think anyone would disagree with that. This is not just about trade deals, although trade deals matter; it is part of a broader relationship in which many other things matter, too. But let us focus on the one topic of this emergency debate, which is the immigration policy of the United States in what is only the second week of the presidency of President Trump. Obviously, we have very strong views, but we are not empowered to make a decision as such, because the immigration policy of the United States is a matter for the United States.

I grew up listening to my father talk about the dangers of powerful and deeply divisive rhetoric like that of Enoch Powell. Is the Minister not concerned that when the President of the United States is invited on a state visit, there is a real danger that his rhetoric will be deeply divisive and threatening to many Muslims in this country? Will the Minister ensure that if the Government pursue the policy of rolling out the red carpet rather than having some other sort of official visit, there is proper protection against dangerous rhetoric that incites people to violence?

I fully appreciate what the hon. Lady says. Indeed, we have debated such issues on many occasions. I have been in the House for nearly 25 years, and I think I am well known as someone who has defended Muslims at home and abroad throughout that period. To turn on a sixpence, when I was Minister of State, Department for International Development, I had to focus more than £1 billion from the growing DFID budget on Syrian refugees; perhaps my one pleasure amid the challenges that we faced was being able to say that that was 25 times more than was provided by the French.

Let me concentrate on what the Government had to do in response to the announcement of the Executive order. It had a serious effect, and there were serious consequences for some British citizens. It is the Government’s duty to protect the interests of British citizens and, where we are able to do so, make sure that we get things changed so that they are not detrimentally affected. That is what we decided we primarily had to do, why the Foreign Secretary spoke to the US Administration, and why my right hon. Friend the Home Secretary spoke to General Kelly, the new Secretary of Homeland Security, to seek clarification.

One of the points that I ask the House to understand is that we did not appreciate right from the start all the implications of the Executive order. It was announced as the Prime Minister left Washington to fly overnight to Turkey, and during the next day it was full steam ahead in Turkey, so I think the House ought to row back from the personal attacks on the Prime Minister.

Let me make it clear what has resulted from those contacts: we have successfully protected British citizens. It would have been ill advised to be diplomatically offensive in a way that would have reinforced any detriment to British citizens. Instead, we have achieved something.

I will tell the right hon. Gentleman exactly what we have achieved. We have achieved an outcome in which all British passport holders remain welcome to travel to the United States, which would not have happened if my colleagues in Government had not made the contacts they did.

We have received assurances from the US embassy that the Executive order will make no difference to any British passport holder, irrespective of their country of birth or whether they hold another passport—[Interruption.] The right hon. Member for Normanton, Pontefract and Castleford (Yvette Cooper) has asked, “What about residents?” I am holding her back from intervening so that I can answer her question. We are advised that the only material change for the UK is that citizens of any of the seven designated countries who do not hold a British passport but are legally resident in the UK will still be able to apply for visas, but that they may face additional screening at their port of entry into the United States. I apologise for making the right hon. Lady wait to intervene.

The Minister is making a thoughtful speech, and I welcome the work that Ministers have done to safeguard the interests of British citizens. However, may I ask him about the wider points? Has the Foreign Office made representations to the US Administration to lift the refugee ban in the interests of international refugee policy, and to stop the targeting of Muslims in the interests of our shared values and common security?

Given that the emergency debate has had me rushing to the Dispatch Box at short notice, I have not been involved in any such discussions so I cannot give the right hon. Lady a categorical answer, but one can speculate on what political events might now unfold. Executive orders are, at least, limited for 90 days. They are a command from the president to instruct Congress to do something, so the order will now move to Congress within the democratic process of the United States. They have their democracy as we have ours, and this will ultimately be their political decision. I have no doubt that there will be strong political voices within the United States, as we have heard today in this House and, indeed, outside it.

I reiterate that the order is not the kind of policy of which this Government approve or would ever introduce. As the Foreign Secretary said in his statement earlier, we have already made very clear our anxiety about measures that discriminate on grounds of nationality in ways that we consider to be divisive and wrong. Indeed, it does not really help—although it is true—to say that, although all the countries listed are Muslim countries, the list does not include all Muslim countries. In fact, the vast majority—[Interruption.] The hon. Member for Bethnal Green and Bow (Rushanara Ali) might just listen to the point I am trying to make. Although the vast majority of the Muslim world is not mentioned in the Executive order, the political language around it is unacceptably anti-Muslim. As such, it is divisive and wrong, and will cause an effect in the entire Muslim community.

As the Prime Minister expressed during her visit to the States last week, the point of having a special relationship is to have frank and honest discussions on all issues, whether we agree or disagree. We do not hesitate to state that, although US immigration policy is ultimately a matter for the US Government, we do not agree with this kind of approach. It would be wrong to think that the relationship means that we agree on every issue. That has never been the case throughout the history of the special relationship. One could cite the example of former Labour Prime Minister Harold Wilson not joining the US in fighting in Vietnam.

As my hon. Friend the Member for Stratford-on-Avon clearly said—frankly, he has spoken in today’s debate with extraordinarily personal and moral authority—we should not forget the indispensable nature of this country’s alliance with the US. In defence, intelligence and security, we work together more closely than any other two countries in the world. America’s leadership role in NATO, which the Prime Minister was able to reaffirm and reconfirm in her visit, is the ultimate guarantor of security in Europe. The President told the Prime Minister of his 100% commitment to NATO. The trade relationship is of importance; we export more to the US than any other nation. The relationship is overwhelmingly to our benefit. I believe very strongly that the Prime Minister’s visit to the White House last week underlined the strength of that transatlantic alliance. Where we have differences with the United States, we will not shy away from them, and we will express them clearly, as I have done today, but I also echo the Foreign Secretary and the Prime Minister in repeating our resolve to work alongside the Trump Administration in our mutual interest.

It is a great pleasure to serve under your chairmanship, Mr Turner. I pay tribute to the hon. Member for Strangford (Jim Shannon) for proposing the debate. We all know that he is a tireless and relentless campaigner on these issues. It is a great pleasure to take part in this debate, and to follow him and the hon. Members for Congleton (Fiona Bruce) and for Glasgow East (Natalie McGarry).

It is truly shocking that, according to the International Centre for Not-for-Profit Law:

“Since 2012, more than 120 laws constraining the freedoms of association or assembly have been proposed or enacted in 60 countries.”

I am not proposing to read out any more facts and figures from that organisation, but that gives us some context. There are many ways one could start with a debate on civil society, but I suspect that, in common with most people in this country, I began at the first course of refuge, which is Wikipedia. It describes civil society as the

“aggregate of non-governmental organizations and institutions that manifest interests and will of citizens.”

That is all very good. “Collins English Dictionary” told me that sometimes the term is used in the more general sense of

“the elements such as freedom of speech, an independent judiciary, etc, that make up a democratic society”.

Of course, if one wanted to look at it in an even more erudite way than Wikipedia, there is Aristotle’s “Politics”, where the whole idea of civil society—the “koinonia politika”—was of the community coming together with shared values for common wellbeing. More recently, we have works such as Robert D. Putnam’s “Bowling Alone”, which make the point that social capital and people coming together are vital in creating cohesion in different societies.

One very important thing to consider when we look at civil society internationally is how what we do can affect cohesion in this country. The hon. Members for Strangford and for Congleton spoke about a comprehensive range of countries and themes, as they so often do. I do not pretend to have such expertise, but I want to look at the impact of what happens in this country in the context of civil society abroad. An important manifestation of civil society in this country is the coming together of different communities. In north-east Wales we are privileged to have an organisation called Together Creating Communities. Since 1995, it has brought together a range of community groups: faith groups, some unions and other community groups. Together they have facilitated and become strong so that local people can take action.

At the end of last year in December, TCC won a charity award from The Guardian. TCC has a range of different activities that bring society together, including accountability meetings—it sounds a little terrifying and sometimes is—for candidates standing for election. It brings together a range of other campaigns, too. It brought together a diverse range of groups to make Wrexham the first fair trade county in Wales, forming the basis for which Wales became the first fair trade country in the world. It worked with statutory and voluntary bodies to create an emergency night shelter in Wrexham. Critically, it supported the Muslim community in establishing the Wrexham mosque at the old Wrexham miners’ centre.

Interestingly, the English Defence League in north Wales—I emphasise that it was the English Defence League —held a protest, although it did not attract many people. A key figure at the mosque made the point that, although it was Muslims in the area who wanted the mosque, they were backed by members of Christian Churches and by representatives of other groups all standing firm together. There is a lovely quote by one of the Muslim leaders on the Together Creating Communities website:

“When we went to negotiate with the council”—

this was to do with planning and land—

“we had two other TCC members with us and they were wearing dog collars. The deputy chief executive said: ‘Excuse me, I’m a bit puzzled, you’ve come to talk...about the mosque, so what are the two clergy wearing dog collars doing with you?’ The clergy said: ‘We support them, we are with them.’”

That is an important message from a part of the country where Muslims are a small minority and were supported by a larger faith group and wider society.

As I have said, TCC has a range of campaigns. I have described one of them. Others include tackling debt and irresponsible debt lenders and there is also the fair funeral campaign. TCC asked every funeral director in the county to commit to giving out the funeral price before it takes place, and it has secured that commitment from every one. TCC shows a flavour of what good civil society organisations can be like in bringing people together.

More widely in this country, we can be proud of a great deal of our charitable and civil traditions. I am often amused when I read about this subject. The whole gamut of opinion from neoliberals to Marxists have claimed different bits of the tradition as their own. That is because it is a rich tradition, including churches, faith groups, a range of different charities, mutuals, trade unions and a great many advocacy groups. They are all part of what we see as our tradition. That is why many of us were perturbed by certain aspects of the Transparency of Lobbying, Non-Party Campaigning and Trade Union Administration Act 2014, which ran counter to that tradition. I will not dwell on that Act today, but I will dwell on how our tradition matters.

I am intrigued that, in 1601, charity was discussed in Parliament for the first time. The preamble to the Charitable Uses Act 1601 contained a list of purposes that the state believed were of general benefit to society. Of course, that was later developed by case law, which helped to form our modern definition of charitable purposes. So far, so good. What intrigues me even more was that all that was happening at the time of Elizabeth I, a Protestant monarch, who refused to insist that Catholics converted. That was in the early 17th and late 16th century when she repeatedly said,

“I would not open windows into men’s souls.”

She was told time and again, no doubt by the many advisers—I do not know whether there were special advisers in those days but I imagine there were—

Probably. The tradition of civil society and openness goes hand in hand with the development of charity in our country. It is fascinating that freedom of thought happened at the same time as freedom of action. That is very important for us to consider today.

I want to move on a few centuries and pay tribute to the work of the Charities Aid Foundation, which, as we know, provides great assistance to UK and international charities. It promotes general donations to charities and operates on six continents with services provided by local experts in nine countries: America, Australia, Bulgaria, Brazil, Canada, India, Russia and southern Africa. CAF has called on the Government to consider working even more with Governments overseas to develop civil society infrastructure where the UK is transitioning out of aid funding. In view of CAF’s expertise, will the Minister comment on that point?

My final thought on that subject is that we are probably in a time when nationalisms of different hues are growing and there is a populist message. The hon. Member for Congleton used a word that perhaps more of us should reflect on: incrementalism. It often starts with something small: a comment, a bit of rhetoric or —dare I say?—a bit of banter. It can then grow to something quite unmanageable: the bashing of Muslims and the insidious growth of anti-Semitism of different varieties on all parts of the political spectrum.

I thank the hon. Members for Strangford (Jim Shannon) and for Glasgow North (Patrick Grady), and my hon. Friend the Member for Congleton (Fiona Bruce), for securing this important debate.

Poverty, violence, extremism and large-scale migration are some of the most important challenges of our times. Evidence shows that those problems are most acute in countries where civil society is not allowed to function. Democracies do not start wars with each other—[Interruption.] I challenge my hon. Friend to name two democracies that have ever gone to war. By and large, democracies do not suffer famine, nor do they trigger the uncontrolled exodus of their people in a way that leaves them vulnerable to all manner of abuses, such as modern slavery. Democracies are countries in which civil society is allowed the space to thrive, to challenge authority without fear and to work for the good of society as a whole.

The space in which civil society operates is under ever-increasing pressure throughout the world. Her Majesty’s Government are fully aware of this disturbing trend, and we are working hard to counter it. The Government believe that a free and vibrant civil society not only helps safeguard individual human rights but contributes to a country’s security and prosperity. I should like to highlight some of the ways in which this Government work for the promotion and protection of civil society space overseas.

The Foreign and Commonwealth Office’s annual human rights report shows that the issue of civil society space has been increasingly prominent in our human rights work in recent years. Last December, we placed civil society organisations at the centre of our activities to mark UN human rights day in London and across the entire FCO network. In her speech on that occasion, my noble Friend the right hon. Baroness Anelay stressed how she sought to champion civil society organisations on her official overseas visits. The message was echoed by our diplomatic missions around the world, which celebrated human rights day by reflecting back to their host Governments our admiration for the dynamism of local civil society, or our disapproval, and frankly our bafflement, when they tried to clip its wings.

We also support civil society around the world through our human rights programme work, funded by our Magna Carta fund. In 2016-17, we invested £1.6 million to support 14 projects designed to protect civil society space by promoting freedom of expression, including online, which is important in the modern age. The projects took place in countries as diverse as Bangladesh, Burma, Syria, Pakistan, Rwanda, and Uganda.

The Government are equally proud of the effective work of the Department for International Development in this field, which I recall from when, as has been said, I was Minister there for four years from 2010. Since 2014, DFID has been an active supporter of the Open Government Partnership, which drives up global transparency standards and promotes civic space in developing countries. Recently, Pakistan, Afghanistan and Nigeria have joined the partnership, bringing membership to 75 countries.

In November last year, DFID published its civil society partnership review, which assessed the results and effectiveness of DFID’s work with civil society. In that document, the Secretary of State for International Development stated:

“A healthy, vibrant and effective civil society sector is a crucial part of Britain’s soft power and leadership around the world.”

She also pledged to

“robustly defend the rights of civil society in a dangerous and uncertain world.”

One could not hope for a clearer statement of the Government’s position.

The Treasury has also played its part, working with the Charity Commission to prevent the misuse of Financial Action Task Force standards, which are designed to prevent the financing of terrorism, to restrict civil society. Many hon. Members will be aware that the Government sponsors the Westminster Foundation for Democracy. Through its programmes to support democratic practices and institutions around the world, the foundation shares the experience of our democracy, in which the relationship between civil society, Parliaments and political parties is of fundamental importance. We welcome that approach and want WFD to continue to promote that healthy respect for civil society that we enjoy, and that we know is critical for the quality of democracy everywhere.

Another vehicle for our support for civil society space is the Community of Democracies, a democracy-building alliance of Governments and civil society, the governing council of which we joined in December last year. Its working group on the protection of civil society space issues a call to action whenever it sees a threat to civil society space emerging through new legislation or regulation, or whatever it might be, anywhere in the world. Last year, for instance, it successfully helped to influence decisions in Kyrgyzstan, deterring the adoption of an anti-civil society law along the lines of Russia’s deeply cynical and very damaging foreign agents law. I reassure hon. Members that the UK’s diplomatic service works tirelessly to support civil society and to defend its right to function freely.

I do not cover Hong Kong—I cover the other half of the world, which keeps me quite busy —but I note what my hon. Friend said. I will ask the relevant Minister to write to her with a specific reference to Hong Kong. Our ambassadors and high commissioners frequently stand shoulder to shoulder with those who seek to defend the values in which we believe, including the rights to freedom of expression and freedom of assembly, and the right to live without discrimination of any kind.

At the multilateral level we play a leading role in defending the rights of civil society. We support the accreditation of legitimate and serious NGOs to take part in the workings of the United Nations, including the Economic and Social Council. Knowing the keen interest of the hon. Member for Strangford in the freedom of religion and belief, I am sure that he will appreciate our continued strong support for the efforts of Christian Solidarity Worldwide to be so accredited. The UK plays a leading role at the Organisation for Security and Co-operation in Europe in the struggle to keep open civil society space. This year, we are proud to chair the Human Dimension Committee of the OSCE and are developing a work plan that reflects the importance of civil society to human rights, security and prosperity.

Let me turn to some of the very important points that have been made in the debate, in order to give a proper and thorough answer. The hon. Member for Strangford emphasised the importance of freedom of religion and belief, as I mentioned. Freedom of religion promotes prosperity and security and is also an important part of countering violent extremism, so we always urge our international partners to allow freedom of religion and belief, and to end all forms of discrimination on religious grounds.

The hon. Gentleman raised the question of freedom of religion in Pakistan. The Government have urged Pakistan to uphold religious freedom and the rule of law. During the Foreign Secretary’s visit to Pakistan in November last year, he raised the issue of religious tolerance and the importance of safeguarding the rights of all Pakistan’s citizens. The hon. Gentleman also raised the case of Shahidul Alam in Bangladesh. We are aware of the apparent detention of Shahidul Alam in Dhaka this morning. The British high commission is monitoring the situation very closely and will diligently follow that up.

Although the right hon. Member for Carshalton and Wallington (Tom Brake) has left the Chamber, he raised some specific points, so it is only fair that I should answer them—my hon. Friend the Member for Congleton also raised the question of Egypt. It is no secret that we want to see more political freedoms and space for civil society in Egypt. The Prime Minister raised the ongoing foreign funding NGO case with President Sisi when they met in New York in September at the United Nations General Assembly. Restrictions on civil society take Egypt further away from implementing the freedoms that are in the 2014 constitution. I can also confirm to the right hon. Member for Carshalton and Wallington that we have raised the issue of discrimination against the Baha’i with the Government of Iran, and the arrest of Nabeel Rajab with the Government of Bahrain.

I join the hon. Member for Glasgow North in praising the excellent work of our ambassador to Colombia. I have seen at first hand the work of our diplomats overseas who work with human rights defenders, often in very difficult environments. I am sure everyone here joins me in recognising their work.

It has to be recognised, and stated for Hansard, that the Government have worked very hard to get a peace agreement in Colombia. However, as the Minister knows, right hon. and hon. Members of this House have made significant contributions—some of my colleagues from Northern Ireland are perhaps an example—on all sides of that political divide. They have also helped to encourage the Colombian Government to move forward. Their contribution is sometimes overlooked, so it is good to have it recorded.

From my DFID days and now from my desk in the Foreign Office, the path to peace in Northern Ireland is a fantastic example of how something can be achieved in this field. By taking other countries’ politicians to Northern Ireland to show how it was done, we have made progress in countries such as Nepal, Colombia and potentially Burma, in a slightly different field. Therefore, one cannot exaggerate or over-praise the example of Northern Ireland in having a beneficial effect on other parts of the world that are trying to find a path to peace and security.

I will, however, raise one issue in response to the hon. Member for Glasgow East. I fully understand everything she said, and fully recognise her personal interest and the experience she underwent when she was in Turkey. May I just say to her that she did not say anything about the other side of the picture? I am very familiar with Turkey—I have been there three times since I became a Foreign Office Minister, including a visit of three days after the attempted coup. It is important to experience how traumatic that attempted coup has been to the entire population of Turkey. One has to understand that they went through—they have, through their history, lived through this risk—a day, the equivalent of which in the UK would be like a regiment of the Army driving tanks up Whitehall, shooting people on Westminster bridge, trying to kill the Queen and the Prime Minister, bombing Parliament while it was sitting and taking over the BBC. That is what they went through. One has to understand the trauma and the existential threat of that experience to understand Turkey, and indeed to understand everything that followed, which she described.

I have not finished. The other point to make about that side of the equation is this: it was not just the one day or one night event on 15 July last year. In the past year, 500 people have been killed in Turkey as a result of terrorist attacks. I find it astonishing that the hon. Lady did not mention the shooting at the nightclub in Istanbul on new year’s eve. I can also tell her from my experience that, as I was walking up to the Ataturk memorial, a suicide bomber had been arrested half an hour before whose target, by his own later admission, happened to be the Ataturk memorial. Those are the threats that that country has to live through every single day.

The Minister makes an important point about the other side, but I was merely raising the issue of the Government. I take him to task, however. We are talking not only about what happened subsequent to the coup or the actions of terrorism and the closing down of space, but about the actions of the Government, with the transformation into a presidency and the removal of the hugely important rights of MPs. Post-coup—the very next day—there was a prepared list of people who were removed from their positions. That looks like a predetermined eradication of opposition voices.

The threat the hon. Lady describes did not start on the day of the attempted coup. This is a country that has to live every day with threats from the PKK, ISIS and the state within a state. I find it unfortunate that she did not choose to mention any of that. None the less I sympathise with her experience of arrest, and I consider it fortunate that she was so ably assisted by Her Britannic Majesty’s Government and the competence and capability of officials in the Foreign and Commonwealth Office.

Any Government confident of their own legitimacy and their commitment to democracy should allow civil society to operate freely. We will continue to state that position, often privately but often very loudly in public too. We will continue to make the case for civil society to flourish everywhere and to defend it wherever and whenever it is under attack.
