That this House has considered support for people ineligible for Government covid-19 support schemes.
It is a pleasure to serve under your chairmanship, Ms Rees.
“Feelings of betrayal, hopelessness, abandonment and not belonging have caused me immense anguish over the last 9 months”.
Those are the words of Lisa from London, who spent 34 years as a pay-as-you-earn taxpayer and was newly self-employed in April 2019.
I am incredibly grateful, as are the many thousands of people who have been in touch—both directly and indirectly—to share their stories with me, to have been granted this very important debate, which also addresses three petitions. I am aware that many Members were unable to make the crowded call list today.
It is 261 days since the furlough scheme was announced and 258 days since the self-employment income support scheme was announced, yet those very welcome schemes had gaping holes in them. We know that some 3 million people—approximately one in 10 of the workforce—fell through those gaps. Often, they were ineligible for universal credit, so they were left without a penny of Government support over the past nine months. Their plight has been raised time and again in this place, and the largest all-party parliamentary group has been formed to champion their cause. Yet the Treasury has repeatedly refused to do anything to address this glaring injustice.
Those who have been excluded span many different categories of workers, including, but not limited to, employees who were denied furlough or were ineligible for it, which includes new starters; the self-employed, including those newly self-employed; those over the £50,000 threshold; those who earn less than 50% of their income from self-employment; directors of limited companies who are paid annually or via dividends, or directors of such companies that are not yet in profit; PAYE freelancers; those on zero-hours contracts; and new mothers. These 3 million individuals are from all walks of life, from beauticians to builders, teachers, driving instructors, taxi drivers, lawyers, those working in our world-leading creative industries, and many, many more.
I will address up front some of the misrepresentations that exist, then touch on the impact of this injustice and, importantly, refer to some of the solutions that have been proposed. To date, the responses that we have had from the Government include, “It is too difficult and complex to include these groups.” I am afraid that, nine months on, that just does not wash. I understand that the schemes were set up at speed, but there has been ample time to work through and implement solutions. Another response was that the schemes were targeted where help was most needed. It is clear from the thousands of case studies received and the surveys conducted by the House of Commons digital engagement team, the Organise group and ExcludedUK that that is simply not true. There are heartbreaking stories of desperate need, including the use of food banks and people not being able to switch the heating on this winter.
There has, at times, been a suggestion that some of the excluded are highly paid and dodging tax in some way, especially those paid via dividends. My constituent, Fraser Wilkin, who runs a travel company in Twickenham, pays himself by dividends because of the huge fluctuation in annual income due to events outside his control, such as the coronavirus. If he had drawn a regular salary through the year, he would have been unable to fulfil his statutory and contractual obligations to his clients, in terms of prompt refunds when their holidays were cancelled due to the pandemic.
Universal credit is cited as the fall-back. A survey of more than 3,000 individuals found that almost three quarters were unable to access universal credit. Let us face it: we all know that universal credit is not meaningful support. Otherwise, the Government would not have felt the need to create the furlough scheme or the self-employed income support scheme.
We know that the mental health impacts on many of those excluded from support have been stark. There have already been eight reported suicides, and one respondent to the House of Commons digital engagement team said that she almost took her life several times, and one week spent every day in contact with the Samaritans.
The Centre for Mental Health has said that covid-related unemployment has caused an additional almost 30,000 people to request services for depression. Those mental health impacts spread well beyond the 3 million individuals to their families and support networks. Many report having to move back in with elderly parents and rely on their pensions. Marriages and relationships have been strained or ended. Parents of young children talk about the stress it is putting on their children. An anonymous respondent from the north-west said:
“my mental health has plummeted and my family are anxious too, so much so my teenage daughter is getting counselling for her anxiety”.
Personal debt is rising. Rachel from the south-east says:
“I am selling my house, cannot get a mortgage, selling my personal belongings just to put food on the table. Getting into so much debt. Never been so scared in my life. I’m also a single parent and it’s heart-breaking telling my daughter that Santa can’t afford much this year”.
In terms of the wider economic impact, those businesses and entrepreneurs, who are natural risk-takers, are the wealth creators and the lifeblood of our economy. Retaining their skills and health, and stopping their businesses going to the wall are critical to our post-covid economic recovery. It is incredibly short-sighted to cast them aside in this way.
Moving on to solutions, many proposals have been put forward by a number of groups, such as the Association of Independent Professionals and the Self-Employed, the Treasury Committee, the Federation of Small Businesses, the gaps in support all-party parliamentary group and the various representative groups for those who have been excluded.
I have limited time today, but some of the solutions include using HMRC data to support claims for those with PAYE income history; widening the accepted evidence for demonstrating proof of employment; extending cut-off dates; looking at the two specific schemes that have been put forward for directors of limited companies; removing the 50% rule; removing bereavement payouts and carers’ allowance from the calculation of PAYE income; and extending the criteria for discretionary business grants. Many of those solutions just require imagination and will. Plenty of experts stand by to help make them implementable.
I want to conclude by sharing from a children’s book sent to me by Kev Payne, who was a teacher and became an illustrator in 2018. He is ineligible for support because of the 50% rule. He wrote a story to try to explain how he feels. In it, the mice are the taxpaying workers and the bear is the Government. A storm hits and the bear provides food and shelter for all the animals, but the mice are left out and told that there is no space for them:
“‘But I gave you my food’, said Mouse. ‘You said you would help me.’
‘I cannot help you now,’ said Bear. ‘I will see you when the storm is over.’
‘But…’ began Mouse. Bear glared and growled at Mouse. It turned its vast back against her.”
My plea to the Minister is to listen to how these hard-working, tax-paying people are feeling and to look at the long-term impact of his policy. The Chancellor does not have to be the big, bad bear; he can be Santa Claus this Christmas.
I will start the winding-up speeches at 5.10 pm. There are lots of Members who want to speak, so I am afraid we will have to have a time limit of two minutes.
I thank all right hon. and hon. Members who contributed so powerfully to the debate. We have heard so many stories and about so many sectors, many of which, such as the live events industry and the weddings industry, will be among the last to return because of the nature of coronavirus.
I gently say to the hon. Member for North East Bedfordshire (Richard Fuller) that, yes, undoubtedly some of the 3 million are high earners, but the stories we have heard today, and a lot of the surveys, show that a many of those people are struggling to get by. Believe me, I know some of the freelancers who work in the creative industries and who now live from hand to mouth. I know that the Minister and, indeed, Conservative Members, are keen to recognise what the Government have done—I am sorry if that did not come through strongly enough in my speech. I said the coronavirus job retention scheme and self-employment income support scheme are very welcome, and they have been important lifelines for millions of people, but we are asking for parity for those who have been left out.
I will pick up a couple of points of detail that the Minister gave us about the £50,000 threshold and the average for people over that threshold. If the Government are worried about that, why not look at a taper? If they were worried about people who do not necessarily need support and who are high earners, why did they not put a similar threshold in place for the furlough scheme? It is quite possible that two employees earning £100,000 got furlough payments, but somebody who earned £51,000 through self-employment got no support. How is that fair? The Treasury Committee actually pointed out that example.
The Minister also talked about people who get less than 50% of their income from self-employment—they get a minimal amount through that source. As I and others have said, they often earn through PAYE, but some of those are short-term contracts. All that data is with HMRC, and, as we have heard, it is not beyond the wit of some of the very intelligent officials to work through those solutions.
I am grateful that the Minister confirmed that he will look at some of the solutions, and I am very grateful that, finally, after months of asking, a Minister—the Financial Secretary to the Treasury—is meeting officers of the APPG and representatives of the various excluded groups. Hopefully, they will look at some of the really detailed solutions that have been put forward, beyond those that the Minister referred to. I also welcome the great campaign of the right hon. Member for Tatton (Esther McVey) on supermarkets. If some of that money can be ploughed in to fill the gaps, that would be fantastic.
If Conservative Members will not listen to Opposition Members, there are many other Conservative Members who have made the case. We heard from my hon. Friend the Member for Edinburgh West (Christine Jardine) that many affected people are Tory voters. In fact, Iain Dale said to me on LBC a few months ago, “Munira, I don’t understand; these are Tory supporters. Why isn’t this Government helping them?” I said, “I don’t know. Go and ask your friends in the Tory party.”
If the points that I made about mental health are too emotive, and if the arguments around fairness do not cut through with Ministers, they should look at what makes economic sense, as the SNP spokesperson, the hon. Member for Glenrothes (Peter Grant), said.
If the Minister will indulge me, I will return to my fantastic storybook in the 40 seconds I have left. After the storm ended and Bear recognised the talents of all the hard-working mice who were left out, he apologised to all the mice and promised that they will never be ignored again: “Mouse was so happy that she painted a special picture and when it was sold, Mouse made not one, not two, but three piles of food—one for her, one for Bear and this time a much, much bigger one for all the mice to share.”
That is an allegory about the economic benefits of helping those who have been excluded. I look forward to hearing a slightly different response the next time we come back to this debate. Hopefully, there will not be a next time—the Minister will solve it before Christmas.

Commons ChamberI thank my right hon. Friend for his question. Throughout the crisis, as he has acknowledged, the Government have spent over £280 billion. He referred to the self-employment income support scheme. Support for the grant has recently been increased from 55% to 80% of average trading profits from November to January, capped at £7,500 in total, and the claims window will be open until 30 November. Obviously, a range of additional support mechanisms have been put in place, including the additional restrictions grant. As my right hon. Friend the Financial Secretary said earlier, we will continue to look sympathetically and constructively at all other representations made.
I know about the difficulties that the hospitality sector is experiencing at the moment. The hon. Lady will know that the various measures she spoke about—the business rates holiday and the VAT cut—last all the way through to next spring, so they will provide support during the winter, and we have in place a grants programme that provides grants to businesses in the hospitality sector, whether they are open in tier 2 or closed, with further support provided to local authorities for discretionary support, as they see fit.

Commons ChamberThat is an excellent question. I have been particularly disappointed at the amount of anti-vaxxer disinformation campaigns that are out there. I have received three separate messages myself from people telling ethnic minorities not to take part in vaccine trials. I am really sorry to say that an Opposition Member said in this House that the Government were using ethnic minorities as cannon fodder in their battle against coronavirus—one of the worst things that I have ever heard said in this House. That really causes division and tension. We need people to have faith in the Government. We need people to have faith in our health service and trust it in order to take part in things like vaccine trials. I hope that the work we are doing will go some way towards remedying some of the scaremongering.
I welcome the Minister’s acknowledgement early on in her statement of the disproportionate impact of covid on disabled people. She said that work is ongoing and there will be future reports, but I hope she will agree that we need urgent action. She will know that disabled people are 11 times more likely to die from coronavirus. We have also heard very disturbing reports of “do not resuscitate” orders being put in place, particularly for those with learning difficulties, without consultation with their families. I recognise that the Care Quality Commission is investigating this, but will she commit to ending this injustice urgently?
The Government rightly take very seriously the outcomes for those with disabilities. The largest disparities were by age for both males and females, done by gender. However, there is a wider strand of work that the hon. Lady references, where this will be looked into. We cannot allow any part of the population to feel that they have been forgotten; they have not. I can assure her that we are taking this seriously, not just in the equality hub but in the Department for Work and Pensions.

Commons ChamberMy hon. Friend is absolutely right. There are practical ways through this. We do not pretend that it is not difficult, but the problems are not insurmountable if the Government would only show flexibility and willingness to listen. Millions of people’s hopes were crushed and their lives thrown into chaos and anxiety when they saw the ship was sailing and had left them behind.
I do not need to list the exclusions, but can we drop this idea once and for all that these are all super-wealthy people living it up on savings or shares? One of my constituents affected is a face painter and balloon artist. She has a simple job, which is to bring joy to children, and it is a job she loves doing, but it is a job she could not do when, like every other business, she went into lockdown and her business closed. Now, as she is trying to get her business back up and running, she finds the rule of six has once again crushed the party business. She is not super rich, she cannot do her job through no fault of her own and she has not had a penny of support since April.
We have heard other powerful examples, including from my hon. Friends the Member for Bristol East (Kerry McCarthy) and for Enfield, Southgate (Bambos Charalambous). There are so many examples we could give, but we have so little time and those people have even less time. “You will not face this alone”, the Chancellor said. Unfortunately, that was true in only one respect: they found each other. Through ExcludedUK, ForgottenLtd and other campaign groups, they have found a support network and managed to win a hearing in the huge cross-party support they have built in this House. So why is the Chancellor not listening? Why is he being so stubborn and inflexible? Why, even now, do Ministers refuse the basic request, which is just to meet and talk with people who are willing to come forward with ideas and practical solutions? The consequences of the Government’s failure to act are clear. Before the crisis began, around 15% of the workforce were self-employed. That figure has fallen sharply during this crisis. We heard powerful personal testimony on this from the hon. Members for Buckingham (Greg Smith) and for Warrington South (Andy Carter)—people who know what it means to take the plunge, take the risk and start a business.
We have heard powerful contributions on the arts and creative industries, not least from my hon. Friend the Member for Batley and Spen (Tracy Brabin), who knows how to build an audience. We have heard other brilliant speeches, too, from my hon. Friends the Members for Hammersmith (Andy Slaughter) and for Belfast South (Claire Hanna), from Conservative Members, such as the hon. Members for North East Bedfordshire (Richard Fuller), for Hastings and Rye (Sally-Ann Hart) and for Congleton (Fiona Bruce), and from right across the Back Benches, from SNP and Plaid Cymru Members.
People might think that theatre is frivolous and all about singing and dancing and having a good time, but there is an important economic issue here. There is a reason central London is empty: the theatres are closed. The live music sector contributed £4.5 billion to the UK economy in 2019. We also see in the figures that some of the sharpest falls have been in construction, professional, scientific and technical services, and administration and support services. The Resolution Foundation has highlighted the sharp fall in these people’s earnings.
Labour has repeatedly called on the Government to listen to the concerns of the excluded. The shadow Chancellor has written to the Chancellor four times in recent months to highlight problems and suggest solutions, and we are always willing to meet, if only the Government were not so stubborn and unwilling to listen. The Federation of Small Businesses—experts in this area—has repeatedly called for a rescue plan for those left out of Government support. It is right to argue that those whose businesses are often suffering through no fault of their own should not be left out of support. As my hon. Friend the Member for Brentford and Isleworth (Ruth Cadbury) underlined, the Government do not understand Britain’s self-employed. As a result, they have not valued them and because of that they have not provided them with the support they desperately need.
Before I was elected to this House, I spent just a year as a freelancer. It was one of the most terrifying professional experiences of my life—not knowing if I would get the next job, or if the invoice would be paid on time; worrying about things such as my cash flow, bills, my incomes, my outgoings. It is a stressful experience. I can speak for the self-employed and the excluded in my constituency—we have heard so many others speak for their constituents too—but none of us can truly understand what these people have been through this year, seeing other people receive support and themselves left behind.
Does the hon. Member agree that many freelancers, particularly in the creative industries, where it is really precarious and people live contract to contract, make ends meet with casual work, but that has totally dried up in the hospitality sector, in ushering and in box office work, for example? So they have absolutely nothing, and they are desperate and running out of savings.
That is absolutely true. One of the things I find most worrying about the trends we have seen is that—as if the inequality that has gripped this country was not bad enough entering the crisis—there have been two very different experiences of the pandemic. If people are in a job with stable employment and have had money coming in every month, they may well be one of the households who has contributed to a record rise in savings. They may well feel that their outgoings have gone down and that they can start planning for home improvements or a decent family holiday. However, if people have lost their job, or were self-employed or freelance and their business activity went completely down to zero, this has been an absolutely terrible experience. I do not think that any of us, unless we have been in that position, can really understand what those people are going through.
In conclusion, I say to the Minister, whose task in responding to the debate I do not envy—with the notable and honourable exception of the hon. Member for South Cambridgeshire (Anthony Browne), I think she has found herself pretty alone in this debate—that the cross-party calls for the Government to listen, even to meet, are overwhelming. The privilege of being able to govern comes with the responsibility of taking action, of seeing people through difficult times. We know that the Government have a difficult job. We would not have wished this pandemic on anyone, but so many of us on both sides of the House simply do not understand the Chancellor’s intransigence, stubbornness and unwillingness to listen on this issue. So please, I beg the Minister, on behalf of millions of people across this country who have felt unheard or excluded: it is time to act.

Commons ChamberAlthough many of the measures announced today are welcome and will help create jobs down the track, there are millions of small businesses and self-employed individuals whose livelihoods are going under today, and these entrepreneurs are the growth drivers of our economy. Today’s statement was a missed opportunity to plug the gaps in the Chancellor’s coronavirus support schemes. The Minister knows very well who these 3 million excluded are. With over 11,000 self-employed in my constituency, I have been inundated with messages from those left out in the cold—heart-breaking stories of ordinary, hard-working people who help to keep our economy and our society ticking, like the single mother of a child with special needs who decided to switch to being self-employed just last year so she could better support her son.
Many of these self-employed individuals and small businesses are in the sectors that will be among the last to recover from this crisis: creative industries, including arts and entertainment; travel; and events companies. Many businesses have inexplicably been asked to remain closed while pubs and others are open. They have already been mentioned today: beauticians in our high streets; complementary therapists; elite gymnastics clubs, such as the Richmond Gymnastics Association; and swimming pools, such as the open-air Hampton pool in my constituency. Not only are these businesses and establishments important to the local economy and at risk of going bust; they also have an important role to play in promoting health and wellbeing.
I want briefly to comment on two sectors. The arts fund announced earlier this week was very welcome, if long overdue and late for many, but it fails to support the highly skilled individuals who make the UK’s world- leading industry what it is: the freelance cameramen and women, make-up artists, costume makers and sound engineers. We cannot afford to lose these skills and small businesses from our economy, and they need support now. Importantly, the arts fund must trickle down to local venues, which are central to our local economies, such as the Landmark Arts Centre, Hampton Hill Theatre and The Exchange in my constituency.
The travel industry will take a long time to recover. Locally, I have a number of small independent tour operators and AITO The Specialist Travel Association, representing 120 members, which employs 4,000 people across the UK. They are not looking for a bail-out. They need a temporary change to the package travel regulations, as many other European countries have done, where Government endorse refund credit notes.
In the short term, these sectors can be enabled to kick-start the recovery now. In the longer term, the Chancellor has talked a good game on green jobs, but his announcement today does not go nearly far enough. We need an ambitious green recovery package that seeks to insulate every home in the next 10 years and massively expand renewable energy and new air quality standards. That is why it is also time that the Government put the final nail in the coffin of any plans to build a third runway at Heathrow.

Commons ChamberWe need flexibility and the ability to respond to what our economy needs. Our immigration system needs to be based on a proper understanding of our own labour market and the needs of each local area, and yes, that will present us with opportunities that we need to be ready to seize.
The CBI says that the coronavirus has left companies with almost zero resilience to a chaotic exit from the single market. Ending the Brexit transition period without a deal would on its own be an act of economic vandalism. To do so in the face of coronavirus would be economic vandalism on steroids. This is no longer about leave or remain; it is about a Government acting responsibly in the interests of their citizens. Will the Minister please put ideology aside and persuade her colleagues that it is time to seek an extension to the transition period?
All that seeking an extension would do is to prolong negotiations. We need to conclude the negotiations and get a good outcome. Not pushing deadlines out will help do that. Then we need to give our citizens and our businesses time to prepare; time to socialise them with the new border operations. That is our plan; that is what is going to happen. All that extending the transition process would do is push negotiations out. We would be back to where the British people do not want to be—to uncertainty and chaos. They want clarity. They want to get a move on and they want to maximise the benefits of being outside the EU.

Commons ChamberHistory will judge us by how we treat the most vulnerable and poorest in our society during this pandemic. Today, the Office for National Statistics revealed that the lowest paid people are disproportionately more likely to die from covid, and among them, careworkers are twice as likely to die, compared with NHS workers. We know that there have been at least 6,600 deaths in care homes since the start of this pandemic, and it has become clear that the social care sector has been something of an afterthought in the Government’s pandemic planning. The Prime Minister has acknowledged that there is an epidemic in care homes, and we must not forget the hundreds of thousands of people who receive care in their own homes, some of whom will have died from covid and will be lost in the community statistics. We are talking about individuals of all ages who may be frail, have complex conditions, and significant needs. We are talking about staff who are often forced to work on the national minimum wage, and with zero-hours contracts and only statutory sick pay.
On 11 March I asked the Secretary of State for Health and Social Care whether he would be issuing personal protective equipment to social care workers, he said
“we are taking that into account”.
Staggeringly, it took until 15 April and thousands of deaths before he announced a plan to tackle coronavirus in the social care sector, including measures for getting PPE to providers. In the meantime, councils and providers struggled every day to get hold of it. With domiciliary care staff visiting many different households in a day, and residential care staff often working in more than one setting, that delay in getting vital equipment to the frontline has undoubtedly cost lives. What assurances can the Minister provide that all social care providers now have access to the protective equipment they need to keep their staff and clients safe?
It is welcome that provision has been expanded to ensure that all those working and residing in care homes are able to access testing. On 23 March, I raised in the House the dangers of discharging patients from hospitals into care homes without testing, but policy change came far too late. The long delay in access to testing enabled the virus to enter care homes with a lethal impact, spreading like wildfire. It has been reported that some care staff do not wish to take a test because they are concerned about the financial impact of taking time off work. Statutory sick pay is simply not enough to survive on, and it must be addressed urgently.
We must not overlook the impact of the crisis on the wellbeing of care staff, many of whom are experiencing things they have never been trained for. Some fear that they are being blamed for the spread of the virus, and some that they may suffer from post-traumatic stress disorder at a later date. What measures will be available to support their mental health?
It is right that we champion the NHS and, in the words of the Chancellor, give it “whatever it needs” to cope with coronavirus, but we must do the same for social care. We know that the extra funds granted to local authorities do not go anywhere near far enough. For too long, social care has been a poor relation to the NHS, and reform has been kicked into the long grass time and again. This crisis has brought into sharp relief just how important social care is in enabling the NHS to function well. It has also brought into sharp relief the many problems facing the sector. The covid crisis will precipitate many long-term changes in policy, and first and foremost among the areas for change must be social care.

Commons ChamberI rise to welcome the Government’s new clause 19 and to support in spirit the amendments of my right hon. Friend the Member for Haltemprice and Howden (Mr Davis).
The idea of two years was unconscionable; six months is liveable with, but three months would have been better for this draconian Bill. We need that reduction because it provides a much more reasonable basis not only to assess the unparalleled restrictions that may be imposed on people, but to enable an alignment of timeframes between our medical responses and the impact on the economy.
I wish to make some brief comments on the issue of balance between those two features. At the moment, we are passing this legislation when a monopoly of voices point in one direction—do more, go faster and impose more restrictions. What we need is an environment of balance to understand that all those measures, as we pursue with all of our hearts and heads the medical cures, the support for our NHS workers and the care for the sick, have consequences: consequences for our economy and for the mental health and well-being of our citizenry, and consequences as yet unforeseen.
A restriction in the timeframe for the legislation is absolutely crucial. Embedded in the phrase “whatever it takes” is a blank cheque that has to be paid at some point. It may not be favourable in public discourse to talk in that way. It may appear callous to talk in that way, but, at some point in the future, a reckoning for the decisions that have been made in response to this medical crisis and the economic consequences for families across the country will come. Whether the Government like it or not, the Bill they are passing today—new clause 19 that they are passing today—will become the vehicle on which they are held to account.
Let me give the Minister some suggestions that she may like to pass on to the Government for them to think about in terms of what we might be discussing in six months’ time. First, we need to set a clear goal. Secondly, we need to outline the reasonable, measurable benchmarks needed to show that we are making progress in achieving that medical goal.
We need to explain the exit strategy for our medical plan. In six months’ time, or at some other time, the Government have to say what considerations they have made if the approach to secure those medical goals has not achieved what they wanted it to achieve, and what the costs and consequences are for the economy. There are no easy answers here, of course, but as we pass this legislation at this difficult time, it is important that we understand that we will have to do that evaluation in a mood of much more balance than we can today.
I rise to speak in support of the amendment and new clauses that my Liberal Democrat colleagues and I have tabled. We are not seeking to divide the House, but we are keen to put our concerns on the record. In the interests of time, I want to focus on two areas—social care and the self-employed.
There is unanimity in the Chamber about the fact that exceptional times call for exceptional measures. It is strange to find myself in violent agreement with the hon. Member for Wycombe (Mr Baker) and, indeed, the right hon. Member for Haltemprice and Howden (Mr Davis). In these difficult, challenging times, the measures must be proportionate, strictly time-limited and with appropriate safeguards in place. I therefore welcome the Government’s concession that the Bill will be reviewed every six months, although our amendment seeks a review every three months, with a full review by both Houses. I note the concerns about whether we can amend or discard parts of the Bill in each review, and I hope that that will be taken on board by Ministers.
The Bill gives the Government sweeping powers over our civil liberties, and impacts on how we look after the most vulnerable in our society, which is dealt with in our amendment 14 and new clause 14. Social care provision is inextricably linked to NHS provision—they are two sides of the same coin. Fast and safe discharge into the community is essential to free up hospital capacity for those who are critically ill.
The system is already stretched to breaking point, and many people think that care standards are on the border line. The Bill seeks potentially to lower standards, which could be dangerously reduced, putting many elderly and disabled people of all ages at risk. Although the Secretary of State told me that the provisions seek to do the opposite by enabling local authorities to prioritise, I fear that the only safeguard is the European convention on human rights, resulting in many vulnerable people being harmed. They must not be cast by the wayside in this crisis.
The Bill has been introduced to tackle a serious threat, but it potentially raises another threat for the most vulnerable people in society. The Chancellor made it clear that he would give the NHS whatever resource it needed to deal with coronavirus. The same commitment must be given to social care, as the sister service to the NHS. Amendment 14 seeks to address that very point.
I turn to new clause 13, on statutory self-employment pay. The Chancellor has rightly stepped in with a far-reaching set of economic measures to support the millions of people across the country whose livelihoods and incomes have been decimated by the pandemic. As many Members from all parts of the House have said, the 5 million self-employed and freelancers feel that they have been completely overlooked. With over 11,000 self-employed people in my constituency I, like many others, have been inundated with hundreds of emails, from childminders to event organisers, to tradesmen and women, to musicians and those who work in the TV industry, begging for action. Many have seen their incomes dry up overnight, with no prospect of knowing when they might be able to work again.
New clause 13 seeks to provide for the self-employed on the same terms as the wage guarantee scheme for employees. I fully understand that the mechanism for delivering such a provision is not straightforward for Government, but let us not let the best be the enemy of the good. The situation is urgent for millions of people across the country who are struggling to put food on the table for their families and keep a roof over their heads right now.
In 2008, the Government stepped in to bail out the banks. Now it is time to do the same for everyone whose livelihood is under threat, whether employed or self-employed. At this time of national crisis, of course we support the Bill with an extremely heavy heart, but I implore Ministers to take on board our grave concerns, particularly on care of the vulnerable and providing for the self-employed. Let us make sure that not one single provision in the Bill is in place for a minute longer than it has to be.
First, let me thank the Government for their contribution and highlight the plight of the NHS staff who do not have enough protection gear. Will the Minister ascertain whether any factories can be used to assist in the interim? I have also been approached by someone about whether, in relation to new clauses 3 and 4, those with an HGV licence could step in to drive supplies—due to a DVLA technicality, they are precluded from doing so. Can we lift that restriction legally, as it is only a technicality, and allow him and others to step in?
The shadow Minister referred to the 80% of wages being available by 1 April, but may I implore her to make that money available from March?
On new clause 4 and factories producing the food and medication we need, I am thinking of TG Eakin in Comber, producing colostomy bags. They cannot go home; what help is in place for them?
On new clauses 9 and 11, what about the self-employed? I have electricians with no premises because their jobs consist of fixing electrics in homes and businesses; can they access the business grant? I have self-employed café owners who have been asked to close their businesses—their staff are getting a wage, but they are not. What is being done to help them? What about a constituent who has a shop stocking cleaning products and basic groceries who is delivering cleaning products, potatoes, milk and other things free of charge? What help is there for him and his staff in new clauses 9 and 11? The business grant will only pay his rent for a few months, so how does he feed his five children?
Lastly, self-employed people should get a basic wage when we are telling them to close and when they cannot reasonably stay open. Again, I would ask what has been done for those who are self-employed. New clause 8 is about education: what about self-employed coaches who are essential in day-to-day life to the mental health and physical wellbeing of our children? What about agency staff working in colleges and the civil service? Do they qualify for the 80% wages that they should under new clauses 9 and 11?

It is a pleasure to serve under your chairmanship, Mr Pritchard. I am delighted to be leading my first debate in Westminster Hall as a new Member on this extremely important topic, which impacts some 1.3 million children up and down the country. They are often the most vulnerable and needy children in our education system.
My predecessor, Sir Vince Cable, led a debate in this Chamber on this very topic less than a year ago. The fact that I am leading a similar debate today underlines just how urgent and important an issue it continues to be, not least in Twickenham, despite funding announcements from the Government since the previous debate. Since the Children and Families Act became law in 2014, the number of children and young people with statements or education, health and care plans has increased across the country by almost 50%. The increase in my own borough of Richmond upon Thames is in fact more than 50%—the number of EHCPs there has risen from 941 in 2014 to almost 1,500 now.
That legislation was designed to put young people at the heart of the system but, as the Select Committee on Education recognised last October in a report, that ambition has yet to be realised and has been hampered by both poor administration and a challenging funding environment. We are here today to debate the latter challenge, but on the Committee’s other key point, regarding poor administration, I must acknowledge the local government and social care ombudsman’s report, published earlier this month, which strongly criticised Richmond Council’s children’s services provider, Achieving for Children, for not effectively supporting children with special educational needs and disabilities. I was horrified to read about the three cases highlighted in the report of young people missing out on support and education between 2016 and 2018 because of failures by the provider, for which of course Richmond Council is ultimately responsible.
I am pleased that the council has accepted the ombudsman’s recommendations in full—both to compensate the families impacted and to conduct a thorough audit in respect of all the children for whom Achieving for Children is responsible for providing SEND support. I will personally be keeping a close eye on the results of that audit, meeting with local SEND groups as well as senior councillors and council officers, to ensure that any issues arising are urgently addressed and that Achieving for Children is held properly accountable.
I congratulate my hon. Friend on securing the debate, and I declare an interest as the father of a child with special needs and an EHCP being administered by Achieving for Children. Does my hon. Friend agree that not only does that company have to improve, but the accumulated debt on Kingston Council’s balance sheet, on Richmond’s balance sheet, and indeed on those of local authorities across the country, creates a huge crisis in funding not just for SEND but for schools and local authority services across the board? It is time that the Government got a grip of this, either by shifting that accumulated debt on to central Government balance sheets or by special funding relief, because this crisis could blow up in councils across the country if they do not act.
Absolutely. My right hon. Friend makes an excellent point. I was going to touch on deficits later, because Richmond’s finances are in a parlous situation for that very reason.
To return to the main topic of SEND funding, many children are missing out on the support that they require and deserve, because of the enormous funding pressures on local councils and schools throughout the country. The SEND funding landscape is complicated by the fact that there are two separate funding pots. There is the high needs block for EHCPs, special schools and alternative provision; and children with moderate SEND, requiring in-school support, are funded out of core school budgets. Simultaneous demands on both have created the perfect storm. School cuts since 2015 mean that support staff have been the first to be cut. That in turn has led to increased demand on EHCPs, causing delays.
As a parent of two young children, I know that if either of them needed additional support, I and my husband would explore every single avenue open to us to apply maximum pressure on decision makers to ensure that those needs were met fully. However, many parents do not have the time, resources or confidence to navigate the complex system of appeals, ombudsmen and tribunals—even with the support of SEND advocacy groups such as the excellent Skylarks charity in my constituency. The result is that the most disadvantaged families often lose out.
I commend the hon. Lady for bringing such an important issue to the House today. I refer the House to my entry in the Register of Members’ Financial Interests. Does she agree that part of the funding issue is that there is now a lack of educational psychologists who are able to assess children at an early stage, particularly in relation to disability, learning disability and autism, and that means that a much greater burden is placed on teachers? That cannot go on, because we are failing the children we really need to be supporting.
Absolutely. The hon. Lady makes an excellent point, which feeds into all the wider workforce debates that we are having in relation to both health and social care and the education sector.
With both schools and councils under serious financial strain, perverse incentives in our SEND funding system start to emerge. Councils expect schools to cough up £6,000 before they will consider a pupil for an EHCP, so headteachers are often more reluctant to send children for a diagnosis. When councils, schools and health services are all cash-strapped, is it any wonder that EHCPs might be bland and vague, failing to guarantee the support to which a child is entitled? That in turn may lead to further delay or indecision. And what is the result? Many children are missing out, and local authorities find themselves in dire financial straits.
One report estimates a national high needs spending deficit of between £1.2 billion and £1.6 billion by 2021. Many authorities are relying on reserves to make up the shortfall. In Richmond this year alone the SEND funding gap is £4.9 million in year. The cumulative figure will be a staggering £15.85 million by the end of this financial year. That is despite tight financial management across the wider schools’ budget to keep the high needs deficit down. Such a significant and growing deficit is unsustainable and could result in other, non-statutory council services being cut. That is merely robbing Peter to pay Paul, and we are all too aware that local authorities have absolutely no fat left to cut.
The recent Government announcement about putting £780 million into SEND funding was of course very welcome, but that does not even begin to scratch the surface. Not only was it a single-year announcement but money was not targeted at those authorities where the SEND need was greatest, because of the way the funding formula operates. That meant that some local authorities with no SEND deficits received significant additional funding, whereas others, such as Richmond, received the minimum, barely 50% of the current year shortfall, so we have half a sticking-plaster solution.
The Department has previously advised Richmond Council to ring-fence the dedicated schools grant deficit, but auditors, the Treasury and the Ministry of Housing, Communities and Local Government refuse to accept that approach. I hope that the Minister can provide further cross-departmental guidance on that point. Indeed, I would like to request that the Secretary of State for Education meets me, my hon. Friend the Member for Richmond Park (Sarah Olney), and senior Richmond councillors and officers to find a solution to the incredibly challenging situation in which the borough finds itself.
I have spoken extensively about the impact on council finances, but we must not forget that at the centre of every tough and contested decision is a child in need of support in order to learn, develop and flourish to their full potential, and a family experiencing stress, anxiety and often financial hardship to ensure that their child has the appropriate support in place. Richmond SEND Crisis tells me that some families spend £30,000 on tribunals, sometimes remortgaging their homes to do so, and we know that many people cannot afford to do that.
Last year, four in 10 EHCPs were not finalised before the statutory 20-week deadline, according to freedom of information requests via the BBC. Many parents are resorting to home schooling because they have given up waiting for a placement in an education setting.
What are the solutions? As well as a significant cash injection, we need to remove the perverse incentives. For example, at the election the Liberal Democrats proposed reducing the £6,000 that schools are expected to pay for each child with SEND. We should not punish schools for doing the right thing. Councils need to get the basics rights on EHCPs, and they need adequate staff and resources to do so.
Finally, a national SEND strategy from the Government would encourage councils to share specialist SEND services where relevant, such as provision for deaf children. A national strategy should also set out steps to ensure that central Government, local government, schools and, critically, health and social services—which have not always stepped up to the plate on EHCPs—work together more effectively.
I congratulate the hon. Lady on securing her first Westminster Hall debate on this very important topic, and on her speech, in which she is making powerful points. We have all experienced the difficulties of dealing with parents and their children who have been tragically let down. On the strategy, does she recognise the need for better resourcing, and for greater understanding of all the conditions that people present with? For example, pathological demand avoidance, on the autistic spectrum, is recognised in some areas as a specific condition requiring resource and targeted support, but not in others. It would be helpful if the national strategy ensures that we are consistent across the country in identifying the range of needs and responding to them appropriately.
Absolutely. A national strategy would address this point about variability and joining up all the services required.
To conclude, every child deserves the best possible start in life. The life chances of children with SEND depend upon appropriate and adequate support, and intervention at the right time. We must realise the ambition of the Children and Families Act 2014 to put young people at the heart of SEND provision. We cannot keep cutting corners and expecting hard-pressed local authorities to pick up the pieces. It is time for the Government to step up, and to provide the necessary funding and a joined-up strategy.

I thank all hon. Members who have contributed so well today. We have heard a lot of common themes from all sides, including delays in children getting the EHCPs they need; the horrendous deficit that councils are carrying, and the financial strain they are under; the strain that families are put under; and the schools that are penalised for doing the right thing. Some powerful contributions were made about exclusions and off-rolling; I was not able to cover those very valid points at the start of the debate, but they should be taken into account. The consultation that my hon. Friend the Member for Oxford West and Abingdon (Layla Moran) referred to, which still has not been addressed, needs to be included in the Government review of SEND that the Minister discussed.
I thank the Minister, first of all for agreeing to meet my council colleagues and me, and secondly for the fact that the Government are looking at what can be done to ring-fence the deficits, so that other council services are not put at risk. I reiterate, however, that the funding that was announced was a one-year one-off, and therefore is not going to help bring down those enormous deficits—which, again, will be a cumulative £15.85 million by the end of this financial year. For a council such as Richmond, that is unsustainable, so I ask again for that provision to be examined. We have had so many reviews, including by the NAO, the Select Committee, the LGA and the London Assembly, and now there is this cross-Government review. We absolutely need action to follow those reviews—action for children, their families and local authorities—if we are going to meet these needs properly and appropriately.
