Third party campaigners are a vital part of a healthy democracy and play a significant role in providing voters with information, but it is important that their spending and funding are transparent. The Electoral Commission continues to support the introduction of imprint requirements for digital campaign material and changes that would strengthen its ability to access information quickly about who has placed campaign material online. These changes would help provide transparency for voters and ensure that third party campaigners and others complied with the political finance laws established by Parliament--.

May I ask my hon. Friend to convey to the Electoral Commission, on behalf of a number of us in the House, the need for an urgent, more serious and in-depth inquiry into third party campaigning, particularly in respect of its role in the last general election? Will he refer the Electoral Commission to the report by openDemocracy that exposed groups such as Capitalist Worker and Campaign Against Corbynism, and the roles of Thomas Borwick, the deputy chairman of the Cities of London and Westminster Conservative Association, and Jennifer Powers, a former Conservative intern, who spent large sums on a social media advertising campaign smearing my right hon. Friend the Member for Islington North (Jeremy Corbyn) without declaring the source of their funds? This warrants a full inquiry and reform.

The Commission is aware of occasions and allegations in the past where people who might not have been expected to have a certain amount of resource were suddenly able to spend that resource. It assures me that it monitors the activity of non-party campaigners and where there is evidence that the law has not been followed, it will consider the matter, in line with its enforcement policy. I assure my right hon. Friend that I will pass on that message to the Commission.

What steps the Electoral Commission is taking to improve voting levels among Black, Asian and minority ethnic people.

The focus of the Commission’s work is on voter registration, to ensure that all eligible people are able to vote should they choose to do so. Its research has consistently shown that eligible citizens from ethnic minority backgrounds are less likely to be registered. In delivering its voter registration campaigns, it therefore targets the work towards under-registered groups, including people from black, Asian and minority backgrounds. The Commission uses advertising, media coverage and partnership work in the delivery of such campaigns.

I thank my hon. Friend for that response. How important is the Electoral Commission in preventing malign influence on elections in this country and ensuring that volunteers and ideas lead the debate, not online trolls and fake news?

My hon. Friend raises an essential point. The Commission has been doing work to get online imprints to make sure that people who put fake news and trolling online can be identified, and that any such adverts have to be registered so that the individuals who post them can be identified and, if necessary, held to account. This is a major issue that affects people from BAME backgrounds and all voters, and my hon. Friend is absolutely right to raise it. I shall pass his concerns on to the Commission.

The Commission recently submitted evidence to the Joint Committee on the Fixed-term Parliaments Act 2011, setting out the background to the current minimum timetable of 25 working days for UK elections and the administrative and regulatory implications if the timetable were to be shortened. While the specific period is for Parliament to decide, the Commission emphasises that sufficient time must be allowed for campaigners to put their arguments to the electorate, for voters to decide how to cast their vote, and for returning officers to deliver the election process.

I thank the hon. Member for his answer. As he says, this point has been exercising the Joint Committee on the Fixed-term Parliaments Act, on which I and many other Members of this House sit. Election periods have grown considerably longer over the years, which is not necessarily in the best interests of our constituents and democracy more widely, especially when an election is called to resolve an impasse. Will he be willing to inquire further from the Electoral Commission as to what the shortest potential statutory period that could reasonably adopted is, and then write to me or the Committee?

I will indeed inquire about that. Informally, the suggestion to me has been that the Commission does not particularly want it shortened too much further because of all the administrative burdens and the administrative marker points that electoral registration officers and others would have to go through, but I will pass on the hon. Gentleman’s request and ask the Commission to write to him.

What recent assessment the Committee has made of the potential merits of introducing automatic voter registration.

The Commission supports electoral registration reform, as it would make it easier for people to register or to update their details throughout the year. This might include adding people automatically from other datasets or other automated solutions that still require confirmatory action by the voter. In 2019, when the Commission investigated the feasibility of such reforms, it found that these were possible from a technical perspective and could be implemented without radically altering the structure of the electoral registration system in the UK. The Commission’s view is that that could help to improve registration levels among some under-represented registered groups, including the youngest part of the franchise. This would ensure that as many people as possible were able to participate in our democracy.

I thank my hon. Friend for his answer. The Capitol insurrection in Washington, fraudulent elections in Belarus and the military coup in Myanmar provide three very recent and very real reminders of the importance of defending democracy. Does my hon. Friend agree that democracy is sacred, and what better way to protect it than to automatically ensure that everyone is able to take part in the process?

The Commission absolutely sees its primary role as ensuring the smooth delivery of the democratic processes fairly and responsibly across the whole of the UK. It has looked at ways of improving registration and looked at evidence that has previously been given, but ensuring that as many people as possible are able to register to vote and deliver that vote is one of its primary concerns.

What steps the Committee is taking to ensure that elections are able to take place in May 2021.

The commission believes that it is an important democratic principle that elections should proceed as scheduled whenever possible. To ensure that can happen in May, the commission is working closely with electoral administrators, political parties and other campaigners to provide the necessary support and guidance, informed by the latest public health advice. The commission’s objective is for voters to be able to participate in the polls, campaigners and parties to be able to put their case to the electorate, and electoral administration staff to be able to run the polling stations and count centres safely and competently.

Looking at the electoral procedures to be followed, though, we can all see areas, such as the collection of nomination signatures, where there is potential for unnecessary face-to-face contact. Surely this is a moment when we can look at doing these things differently, but if we are to make any changes in time for May, that work would need to be done now. Can the hon. Gentleman tell me whether that work is being done by the commission?

The commission is undertaking work to ensure that the elections can proceed in May in as safe a way as possible, and is working with electoral administrators to achieve that. They will be following public health advice, but at this stage, as the elections are going ahead in May, there is little time to make changes to some of the procedures before those elections.

Has the Electoral Commission looked at the possibility of having all-postal ballots, or, failing that, at least providing households with postal vote application forms and a freepost return service, so that anyone who wants to vote in May’s elections—as everyone should—is able to do so safely and without any financial barriers?

May I take this opportunity to wish my hon. Friend a very happy birthday?

The commission has highlighted that there would be significant practical challenges in delivering an all-postal election in May. In particular, collecting personal identifiers from all eligible electors, which is a key part of important security checks, is not practicable in the time available. The commission considers that, where possible, voters should be able to choose how they wish to cast their vote, including having the option to do so in person. It will make available all options to proceed as safely as possible for the elections in May. Whether the elections continue in May is a matter for the UK Government and the Governments of the devolved Administrations.

Yes. The Agriculture Act 2020 sets out clear objectives on animal health and welfare, as well as the environmental objectives. We recognise that animal health and welfare is a public good, and it is right that the public are willing to support improvements in that regard. The Act also includes support for genetic resources—such as our native and rare breeds—that many farmers in many parts of the country will be able to access.

The Secretary of State is a farmer himself, so he will know that farms cannot simply be turned on or off, as local farmers around my constituency in Cheshire have pointed out to me. They have noticed that participants in the ELM scheme will be paid a “competitive” rate; when will they be given details of what that competitive rate is, so that they can start to plan for the future and know exactly when they can alter their long-term plans for the management of their farms to meet the requirements proposed in the White Paper?

What steps the commission is taking to strengthen the regulation of digital campaigning.

The Electoral Commission works proactively to regulate digital campaigning under the rules currently set out in law. It publishes data on digital spending by campaigners to provide transparency for voters, monitors online campaigning activity and supports campaigners with targeted advice. In 2018, it published a comprehensive package of recommendations that would increase transparency for voters, and it continues to recommend changes that would help voters have confidence about online campaigning.

I thank the hon. Member for that answer. The reality is that we know that Vote Leave did all sorts of myth-spreading using digital campaigning. The same people then moved and masterminded the Tory 2019 general election campaign, so it is no wonder that the UK Government have not done anything yet to change the rules. Does the commission agree that there has to be not only better regulation, but fines that go beyond business-as-usual amounts, so that they are a real deterrent to myth-spreading online?

The commission has recommended that its current maximum fine of £20,000 per offence should be reviewed to ensure that it is proportionate to the income and expenditure of parties and campaigners. As a Member from Scotland, the hon. Gentleman may have noticed that the Scottish Parliament recently increased the commission’s maximum fine for Scottish referendums to £500,000. The commission continues to recommend that its sanctioning powers should be updated by other Governments and for other polls, to provide a more proportionate regime.

The commission is working to ensure that the elections in England, Scotland and Wales next May can be delivered safely and effectively. This includes close collaboration with the UK Government, public health officials, returning officers and political parties, and it is also closely monitoring comparable international elections taking place during the pandemic to see what may be learned from others’ experiences. In collaboration with the UK’s electoral co-ordination and advisory board, it is now working on additional guidance and resources for those administering May’s elections to address the specific challenges of managing the polls in a covid-19 secure way.

Throughout the pandemic, people are accessing news and public affairs online more than ever. Does the hon. Gentleman agree that this highlights more than ever the need for increased investigatory and sanctioning powers for the Electoral Commission, as has been passed in Scotland in the Referendums (Scotland) Act 2020, rather than the public attacks on it from Government Members?

It is true that electoral law as it stands predates much of what we now have from the internet, in terms of the way that information can be found. Any changes to those laws will be a matter for the House, but I am sure that the Electoral Commission will use its experience to give us advice on how those changes might be brought forward.

The Electoral Commission’s independence is established in statute. It is a public body independent of Government and accountable to Parliament through the Speaker’s Committee on the Electoral Commission, which I represent here today. Its independence is a vital part of ensuring that it is able to deliver the vital functions allocated to it by Parliament. The Speaker’s Committee seeks to uphold that independence when it fulfils its statutory functions in reviewing the Commission’s estimates and plans and overseeing the appointment of electoral commissioners.

I thank the hon. Member for that response, but will he tell me whether he agrees with the eminent QC, Timothy Straker, that the Electoral Commission has made “gross errors”; that it

“always has its own interest to protect”;

that in legal terms, it had committed

“a gross error which would not have been committed by a first year law student”;

and that it should be stripped of its existing enforcement powers? Or does he just agree with me that it is time to scrap the Electoral Commission?

The hon. Gentleman has always made his views in the House very clear on this matter, for which I am always grateful. I have seen the reports of Mr Straker’s comments, which have been made to the Committee on Standards in Public Life, and we await its report on the evidence from Mr Straker and others coming to it. The commission’s record of having had about 500 adjudications, only five of which have been challenged, and only one of which has been upheld in the courts, is a record that I think the commission can be proud of.

Ironically, I have come in to the House today in the middle of a training programme that I am doing with the Commonwealth Parliamentary Association on electoral monitoring. Of course, it is a feature of any proper democratic system that there is an independent electoral commission, and it is a feature of corrupt countries that they seek to undermine the work of independent electoral commissions. The remarks by the hon. Member for Wellingborough (Mr Bone)—I wonder whether the committee would agree—are typical of those who do not wish there to be an independent Electoral Commission, because the Electoral Commission found out that the activities of Vote Leave were illegal and fined it £61,000 as a result. That is the reason for these attacks.

Again, I am grateful to my hon. Friend for the clarity of his position. The commission will continue to undertake its role independently, as decided in statute by this House. I would say respectfully to those hon. Members who seek to replace or abolish the commission that it might be helpful to bring forward proposals as to what they would replace it with so that we have some clarity about possible alternatives.

The committee has received no representations regarding the media reports to which the right hon. Gentleman refers, which relate to a submission to the Committee on Standards in Public Life. That committee is undertaking an important review of electoral finance regulation, and the commission looks forward to engaging with the conclusions of its work in due course. The Electoral Commission is established by statute, and any changes to its constitution would be a matter for Parliament, not the Speaker’s Committee.

I am grateful to the hon. Member for his answer. Would he agree with me that, while we can probably all think of occasions where we disliked adjudications from the commission, the fact that the Government—or the governing party—clearly want to be rid of it is an indication that probably, as an independent body, it is doing rather a good job?

I refer the right hon. Gentleman to the figures I gave earlier to the hon. Member for Wellingborough (Mr Bone). The track record of the Electoral Commission is one in which over 500 adjudications have been made, five have been challenged in court and only one of those challenges has been upheld. So far as that works out, I think that record stands on its own two feet.

May I start by thanking the hon. Member for Romford (Andrew Rosindell) for allowing me to speak in the debate? I pay tribute to his outstanding opening contribution, which set the tone. I go beyond that and thank and congratulate him on the leadership he has consistently shown on this issue over many years. It is inclusive leadership, which takes in the detail of the case so very often. As we saw from his contribution, the work that he does is detailed and well informed, which makes it so much easier for the rest of us, because he does the hard miles. He is a fantastic leader of the all-party parliamentary group on zoos and aquariums, and I for one am extremely grateful to him.

Growing up in Cheshire, a visit to the zoo, whether with my family or with the school, was always a highlight. A visit with my family to Chester zoo, which lies within my constituency and that of my hon. Friend the Member for Ellesmere Port and Neston (Justin Madders), is always a great highlight, as it is for so many other families around my neck of the woods.

It has been a difficult couple of weeks for the zoo, for the reasons that my friend, the hon. Member for Romford, talked about. It ran a high-profile public campaign, which I must inform the House it did not want to run. For a couple of weeks beforehand, it was briefing me and other interested parties on the difficulty of the situation, for all the reasons outlined by the hon. Gentleman: its responsibilities to maintain animal welfare; its responsibilities to maintain the scientific basis for which it is renowned; and its inability to do so because money was, quite frankly, running out. It made the very difficult decision to go public just over a week ago, when the Government made it clear that zoos were not allowed to reopen.

If I have a criticism of the Government at that point, it is that no reason was given for why zoos could not reopen. We know, for example, that IKEA was allowed to reopen, and I am pleased for it. We know that Kew Gardens was allowed to reopen, and it is a beautiful place to visit. Chester zoo lies in 128 acres of parkland and gardens. The inconsistency was not easy to understand.

I pay tribute to my hon. Friend for the leadership he has shown in the campaign and the excellent result we have got. Obviously, there are further things we need to do to secure the future of all the zoos in the country, but it is a good start. On the point of consistency, part of the zoo is in my constituency, as he has rightly pointed out, but also in my constituency is the Blue Planet aquarium. Unfortunately, as we have heard, it is not going to be able to reopen. Can he understand the confusion we have, where Cheshire Oaks, which has hundreds of shops with confined spaces, is basically next door to the aquarium and is able to reopen next week, but the Blue Planet aquarium will not?

My hon. Friend gives the perfect illustration of the confusion that the organisations feel and that members of the public will feel. I say to Ministers, to the Government and to Government Members who are speaking to Ministers that they should try to treat the public with a bit of respect. If there is a reason for the closures, they should explain it to us. They should tell us why some things can open and others cannot, but should not be inconsistent or illogical, for the very reason that my hon. Friend has talked about.

Chester zoo is a huge expanse of parkland and gardens. It is not like some small private animal collection somewhere. It is a big outdoor event, and it is not opening any of its indoor attractions. My personal favourite, the bat house, as well as the camel house and the chimpanzee viewing area—all will be closed. Only the outdoor viewing areas will be open. The zoo has put in place very careful visitor management procedures regulating the flows within the zoo, but limiting, as my good friend the hon. Member for Romford talked about, the number of visitors outside the zoo, including by managing the car parks correctly, so that all visitors will be covid-safe.

Those procedures have been given the seal of approval by safety officers from the local authority, so Chester zoo is akin to so many others in the work that it has done to ensure that it is safe for visitors. The Government, I hope, will take that into account when they are considering further regulations or the relaxation of further regulations right across the patch.

I rise as someone who has contributed to Chester zoo—two Barbary apes, Iggy and Flossie. They were married. Well, she was a rather reluctant bride, but they were married. We, the Cheshire Regiment, sent them all the way back from the middle east to Chester zoo. I do not suppose they will still be alive, but there was a little plaque there that stated, “Iggy and Flossie: a gift of the Cheshire Regiment.” The hon. Gentleman knows the story. I say no more.

Ah, yes, the story of Iggy and Flossie from the hon. and gallant Member for Beckenham and the contribution of the Cheshire Regiment, as was then. His reputation is very sound in Chester, and it is well known in this House. Mr Deputy Speaker, would the House mind if I did not recount the story of Iggy and Flossie? It is perhaps best left for the bar when it reopens, knowing him, as we all do.

The work of the zoo is not simply as a visitor attraction. The hon. Member for Romford has talked about that. Chester zoo was founded by George Mottershead as a zoo without bars, but it has become a world conservation centre. In particular, I am always proud to talk about the work that it is doing on sustainable palm oil. Chester zoo is itself leading on the campaign to take palm oil produced in mass plantations in south-east Asia out of the food production chain and the consumer products production chain, and instead to use palm oil produced in plantations that do not completely destroy the rainforest in those areas, thereby conserving the habitats of many magnificent creatures, such as orangutans.

Let us be clear: as soon as budgets start to dwindle—the hon. Member for Romford is right that Chester zoo is losing hundreds of thousands of pounds every month and will make a loss this year—those conservation programmes are the first to go. The work that is being led in the United Kingdom and is being undertaken to maintain habitats across the world will therefore be very badly damaged. It is absolutely essential, therefore, that zoos are able to continue to bring in the income, which is providing not just jobs and tourism revenue, but a real difference across the world in terms of ecology.

In paying tribute to the work of the zoo, I have to say that the zoo’s management team has been absolutely outstanding in ensuring that the zoo is ready to open, and that the public will be protected, and I thank it for that.

I thank my hon. Friend for giving way. One of the most important aspects of the zoo’s work is with the schools in my constituency, which is, no doubt, the case in his constituency. Does he agree that that kind of important ecological work needs to carry on, and that, given the difficulty we have with schools going back, we need to make sure that that work is given some extra focus in the months ahead?

My hon. Friend is absolutely right. I visited Chester zoo many times as a child, as I am sure he and other hon. Members did. That link with the natural world ties in with our responsibilities as a human race not to destroy the planet, but to leave it in a better condition than we found it in. That can be done in practical ways, as I have talked about with palm oil and as the hon. Member for Romford has also mentioned. Talking to our youngsters and giving them an appreciation of the wider world is important. Of course, it is about the animals, but it is also about the biodiversity and the habitats in which the animals live.

I want to thank the public for their massive support for Chester Zoo. I had so many hon. Members asking me, “What’s happening with the zoo?” That was because they had received so many emails. In one of numerous conversations that I have had with the zoo management last week, they said, “Chris, we are going to set up an email campaign so that people can email their MPs to tell them that they want to keep the zoo open.” I thanked them very much, but I did not mean it. Hon. Members from right across the House have been touched by this campaign. I will not be begrudging with the Minister at this stage. The hon. Member for Romford was right on that. I am pleased that the decision was reversed. Much more needs to be done, but I am grateful that Ministers did listen finally and took the decision. I thank the public for their support for Chester zoo and their support for the work that Chester zoo has undertaken and will continue to undertake, and I commend the hon. Gentleman for his leadership, which does have an effect in the United Kingdom and right across the globe.

In accordance with its functions under the Political Parties, Elections and Referendums Act 2000, the Speaker’s Committee met on 24 March to examine the Electoral Commission’s main supply estimates for 2020-21 and its five-year plan. In doing so, the Committee had regard to the advice from the Treasury and the latest report made to it by the Comptroller and Auditor General. The Committee was satisfied that both the estimate and the plan were consistent with the economic, efficient and effective discharge by the Commission of its functions.

May I congratulate the hon. Member on his new responsibilities? But this is not about figures— it is about the way that the Electoral Commission has hounded leave campaigners. There have been 34 investigations, eight court cases, and at least four people referred to the police for criminal investigation—and it has all come to nowt. Would the hon. Member support a review by the Public Administration and Constitutional Affairs Committee?

I hope that the hon. Gentleman feels that the Speaker’s Committee is doing a decent job in maintaining scrutiny of the Electoral Commission. It is entirely appropriate, from time to time, for Select Committees to look into public bodies that fall under their competence, and I suggest that he write to the Chair of the Public Administration and Constitutional Affairs Committee making that suggestion.

The Local Government Boundary Commission for England continues to recommend fair electoral and boundary arrangements for local authorities in England. Last week, it published final recommendations for Westminster and Richmond upon Thames. These local government boundaries generally become the building blocks for parliamentary boundaries, which are, of course, a matter for the four Boundary Commissions, reporting through the Cabinet Office.

I thank my hon. Friend for his answer. The covid-19 virus has, of course, had an impact on every facet of our lives at the moment. Will he tell us more about its impact on the commission’s boundary work and whether it has been able to co-ordinate its work with other Boundary Commissions, such as those working on the parliamentary boundaries?

When coronavirus-related restrictions were introduced, the commission shifted entirely to home working. It took forward work on reviews where further external information or input was not required, such as those for Westminster and Richmond. The commission aims to deliver external reviews informed by local needs, views and circumstances. It therefore paused some reviews that were part way through the review process while it considered how to proceed. It has now developed new ways of working, and commissioners are meeting today to agree how and when to restart paused reviews and begin others. On the wider issue of parliamentary boundaries using these building blocks, because that is a rolling programme, many of those building blocks will already be in place and other reviews perhaps would never have been ready in time for the particular parliamentary reviews.

To ask the hon. Member for City of Chester, representing the Speaker’s Committee on the Electoral Commission, what recent discussions the Committee has had with the Commission on improving transparency in digital election campaigning.

At its meeting on 24 March, the committee approved the commission’s interim corporate plan, which includes plans to address voter concerns about digital campaigning. The commission’s recent report on the 2019 general election highlighted significant public concerns about the transparency of digital election campaigns, which risk overshadowing their benefits. The commission has set out actions that parties, campaigners, Governments and social media companies should take to support trust and confidence at future elections. The actions include extending the imprint rules for printed materials to digital campaign materials so that voters know who is trying to influence them.

This follows on from what the hon. Member for Wellingborough (Mr Bone) asked earlier. Last week, he said the Electoral Commission, which, as my hon. Friend said, is asked to do this important work on digital campaigning, was “arrogant”, “incompetent” and

“politically corrupt, totally biased and morally bankrupt”.—[Official Report, 13 May 2020; Vol. 676, c. 246.]

This was because it had the nerve to enforce the law and fine Vote Leave £61,000. Would the committee agree that to try to intimidate an independent electoral body in this way is more in the tradition of the politicians of Zimbabwe than of Britain?

The Electoral Commission has a regulatory role and regulatory authority which are the same as those of many regulators throughout the United Kingdom. I suggest that the track record of the Electoral Commission is one that perhaps does not bear some of the description that has just been repeated. In the past five years, it has carried out approximately 500 investigations into a variety of electoral offences. Only five of those have been challenged in the courts and only one challenge has been upheld.

Such incidents are an issue for the Environment Agency, which is the first port of call in a pollution incident. Water companies have water management plans and, under the new Environment Bill, will have to have sewage management plans as well, which will help. Of course I will meet my hon. Friend to discuss the issue.

I understand that in 2019, the Department for Environment, Food and Rural Affairs and FareShare worked on a pilot scheme to make sure that surplus food was diverted to people who needed it. That is still being evaluated. When will Ministers come up with the evaluation? Is now not a good time to put the scheme into practice?

What a great pleasure it is to follow the maiden speech of the new hon. Member for Aylesbury (Rob Butler). I look forward to him bringing in his “Blankety Blank” chequebook and pen so that we can all admire it in the Tea Room. May I also pay a very warm tribute to his predecessor, David Lidington, who I shadowed for a while? I have to say that I did not actually enjoy shadowing him—not because of his intellect, which was clearly there, but because he was a thoroughly decent person, and I did not like to argue or battle with him because that just was not his way or mine. I congratulate the new hon. Member for Aylesbury and welcome him to this place.

I also welcome the Environment Bill as a step in the right direction, as my hon. Friend the Member for Plymouth, Sutton and Devonport (Luke Pollard) has said, in tackling the existential threat that we face. After years of delay, we cannot afford to wait any longer to pass robust climate legislation matching the scale of the emergency. A year and a half ago, the Intergovernmental Panel on Climate Change made it clear that we had to act urgently over the next 12 years or forever miss the opportunity to prevent climate catastrophe, but nothing has changed since that announcement, except that we have lost one and a half of those 12 years. While the Government have been preoccupied with the chaos of Brexit, natural wildlife continues to disappear at an alarming rate, flooding is at a record high and fossil fuel production continues to damage our climate. We keep getting told that weather extremes are unprecedented and one-in-100-year occurrences—and then they happen again the next year.

I welcome the opportunity to debate this Bill, but the Government must address its significant limitations. I share the widespread concern expressed by the climate groups that there are significant gaps in the Bill, weakening our capacity to take urgent action. I also generally worry that, despite all the assurances to the contrary, the Conservatives are using the opportunity of Brexit to reduce standards and environmental protections and enforcements, as the Labour party warned they would seek to do.

One of the great pleasures of representing my hometown of Chester is representing Chester Zoo, which is more than simply a tourist attraction; it is leading the way in conservation and wildlife protection, and is a centre of global expertise and leadership in conservation and environmentalism. The zoo’s work spans a wide and diverse range of conservation challenges, with a specific concern about protection of biodiversity. The zoo’s representatives tell me that they welcome the Bill, but share the concern that biodiversity protections could be diluted or ignored as local authorities struggle to implement targets, and they emphasised that the climate emergency is also a biodiversity emergency.

The introduction of a mandatory 10% biodiversity net gain requirement for all new developments is a step in the right direction, but it puts the responsibility for implementing and enforcing biodiversity targets on the shoulder of local authorities, which are already on their knees due to the central Government-imposed cuts that have crippled local government since 2010. Local authorities have neither the funding, nor any longer the capacity, to enforce these crucial biodiversity targets. My local authority of Cheshire West and Chester has lost £300 million since 2010, forcing it to make difficult financial choices. For example, at least half of its expenditure goes on adult social care and care for the vulnerable. It is unrealistic for the Government to further burden councils with the responsibility for enforcing the 10% biodiversity net gain without providing additional funding or expert staff.

Habitat and species loss is a devastating result of climate change that cannot be overlooked. Will the Minister tell me what the Government are doing to address this shortfall and provide a realistic solution to the continued devastation of natural biodiversity across the country? Would the Government be willing to consider making the 10% increase in biodiversity a minimum requirement to encourage developers to exceed the target? And I have to ask: is the planning system really the correct vehicle for restoring UK nature and wildlife? It has consistently failed to address other areas of societal challenges, such as the provision of affordable housing, so why do the Government think it is fit for purpose as a means of reversing the destruction of UK wildlife and habitats?

I have concerns about the Office for Environmental Protection. As we have already heard, perhaps the most disappointing part of the Bill is its failure to create a truly independent environmental watchdog with any enforcement capabilities. The OEP’s budget is decided by the Government, meaning that the office will be under the control of the same Government that it is designed to be holding to account. The lack of accountability is astonishing and removes any sort of independence, allowing the Government to overlook environmental regulations whenever it is politically beneficial.

As we reach the crucial tipping point for climate change, the Government will be preoccupied with new trade deals, cosying up to the climate change denying President Trump in a desperate attempt to secure any trade deal—however bad—to justify their exit from the European Union. The OEP is a toothless environmental watchdog with no capacity to issue fines or stand independently from the Government to ensure that environmental protections are upheld. A further weakness identified by both Chester Zoo and the World Wildlife Fund is that the OEP has no jurisdiction over the private sector, particularly fossil fuel companies. The UK has the biggest fossil fuel subsidies in the EU, with £10.5 billion a year in support for fossil fuels, and the Tory party accepted generous donations from fossil fuel investors during the election, at the same time as cutting support for solar and onshore wind.

The absence of proposals to promote ethical procurement and sustainable, deforestation-free supply chains is a missed opportunity, and will prevent the Bill from achieving its stated goal of being an “historic step change”. We should be following the lead of Chester, led by Chester Zoo, which has developed the sustainable palm oil city model, making Chester the first city in the world to adopt sustainable palm oil city status. Some producers and retailers such as Iceland—the shop, not the country—have chosen to step away from using palm oil at all. I welcome their commitment to preventing deforestation, especially in south-east Asia, but I also note the view that the adoption of sustainable palm oil production, as promoted by Chester Zoo and others, would be a more long-term solution.

The UK has a chance to lead the way globally in tackling the climate emergency. We cannot afford to be less ambitious. I hope that the Government will recognise the constructive points that my hon. Friends and I are making. The Bill has a long way to go before it can successfully uphold the promise to leave nature in a better state for the next generation, because at the moment it seems that we have a Government who are reneging on their promise to maintain standards in environmental protection and enforcement after Brexit, just as we warned they would do. And if they do that on environmental commitments, they will do it on food, consumer standards and employment protections. As the Bill progresses and we seek to amend it, I hope that the Government prove me wrong and act on these concerns.
