My Lords, I rise very briefly and with great pleasure following the noble Baroness, Lady Boycott, who has done such an enormous amount of work on this issue—I pay tribute to that.

I was the person who started these amendments on their way back in December 2022, after we started work on this Bill last July. A consultation is something but what we really need is action, so I have a simple question for the Minister. As he said, this consultation has already started this month; if the Government see or identify through that consultation some simple, easy-to-remove barriers, will they act on them immediately rather than waiting for the end of the formal process? Surely, if action can be taken then projects, such as the one in Kensington to which the Minister referred, can go forward.

My Lords, I too congratulate the noble Baroness, Lady Boycott, on her persistence in this area. One of the strong messages that came out between Committee and Report in this House was the slow progress, and lack of progress, on community schemes. I very much hope that this consultation will reverse that trend. It seems slightly ironic, though typical, that the objection from the Commons is on there being a timetable, whereas we all know that for anything to happen, you need a timetable to focus.

On these Benches we are now keen to get this Bill on the statute book and that it becomes an Act. It has been delayed a number of times, mainly from the government side, as it has progressed through both Houses. There are a lot of important parts of this Bill that need to happen. I very much hope that the future systems operator will be quickly nominated and can move into action, so that a number of the strategic bottlenecks that we have in our energy sector can be swept away and solved. Again, I thank the noble Baroness for her persistence in this area, and I hope that consultation will move to action very quickly.

My Lords, I was pleased to add my name to the amendment from the noble Lord, Lord Whitty. There is no easy answer to the question of a social tariff—all solutions to fuel poverty have downsides—but the industry feels that this is the direction of movement and consumer groups agree, so I will be interested to hear the Minister’s response. I have also tabled two amendments in this group: Amendments 70 and 71 about prepayment meters. This is a particularly important area to me. I will not take up the House’s time by going through the arguments again, but I would be interested to hear from the Minister where the Government stand now on prepayment meters and self-disconnection.

My Lords, I have attached my name to a number of amendments in this group in the names of the noble Lords, Lord Whitty and Lord Teverson. The arguments on prepayment meters put by the noble Lord, Lord Teverson, are very clear; we have seen that all over the media.

The noble Lord, Lord Whitty, referred to the fact that this is a long-term issue, but it is worth highlighting that, since we debated this in Committee, the Government’s own figures have come out. They show that the fuel poverty level in the UK increased to 13.4% over the course of 2022 and predict that it will reach 14.4% by 2024.

Of course, these figures use the highly questioned government definition of fuel poverty, which does not allow for anyone living in a home above D classification to be classed as fuel poor even if they simply cannot afford to heat that home. According to the National Energy Action definition of fuel poverty—households spending more than 10% of their income after housing costs on energy bills—there were 7.39 million households in that condition in 2022, and the NEA estimates that this year, after April, 8.4 million people will be in households in fuel poverty.

These measures would be highly targeted to address the poorest. They are simply common sense, enabling people to live and be healthy in our society.

My Lords, it is a pleasure to follow the noble Baroness, Lady Sheehan, and to offer the strongest possible Green support for her Amendment 124, which would prohibit the flaring and venting of hydrocarbons other than in an emergency. The case has already been very powerfully made, but I will add that this has been a recommendation of the Commons Environmental Audit Committee and what is known as the Skidmore report—the Mission Zero independent review. It is something that other nations are well in advance of us on—a point that forms something of a theme for my remarks.

I also support for Amendment 131, which we have not heard fully set out yet, on no new coal mines. It has broad cross-party and non-party support, and it is obvious that we cannot have new coal.

I shall speak chiefly to my Amendment 138B, which goes further. Very simply, it would prohibit new oil, gas and coal extraction. I tabled a similar amendment in Committee and will not go over the same ground, but I want to briefly make three points. First, in May 2021, the International Energy Agency—not known as a group of radial greenies—called clearly for no new oil, gas or coal. Therefore, my amendment would deliver what the International Energy Agency said had to be done in 2021. We are now in 2023.

Since we were in Committee, we have seen increasing momentum behind the fossil fuel non-proliferation treaty, one element of which is no new oil, gas or coal. Six Pacific nations have issued a joint call to the world to say that this has to happen. The Prime Minister of Vanuatu said that polluting industries would not break from their “business as usual” behaviour without being forced. He said that we had to “explicitly stop the expansion” of production.

We often hear about the Government’s desire to be world-leading. It is actually this week, on 19 April, that the state of California is considering a resolution to formally endorse the fossil fuel non-proliferation treaty, which would deliver no new oil, gas or coal. It is going to have a Senate hearing on 19 April, introduced by the Senate Majority Whip, Senator Lena Gonzalez, and co-sponsored by the Indigenous Environmental Network. If the Government really want to be world-leading, they are going to have to catch up.

My Lords, I commend the noble Baroness, Lady McIntosh of Pickering, for emphasising the mitigation hierarchy in her amendment and for her speech. It is something that is really important to take notice of offshore. I was pleased to add my name to the amendment of my noble friend Lady Sheehan, and I have great sympathy with the amendment from the noble Baroness, Lady Bennett. However, I will speak primarily to Amendment 131.

I guess that if this Bill had come before this House three years ago, I would not have even contemplated putting an amendment down about no more coal, because it would have been totally and absolutely obvious that it would be a really stupid thing for any nation—let alone the United Kingdom—to do. However, we are in the situation where we have the Government saying that a coalmine in Cumbria should actually go ahead. I put this amendment down because I now wonder, if we have one, what else could happen. It is not specifically about Cumbria, but Cumbria is important.

Let us look at Cumbria for a moment. First, the issue does not revolve just around the production of coking coal for steel. That is estimated to be only 15% of production. The other 85% is expected to be exported. Of course, once that coal leaves our shores, we have absolutely no control over it; it is a commercial decision. We have no control over what that coal is used for, and almost certainly it is going to be used for energy and power generation. Even if we take that 15%, which is supposedly for coking coal, we have a situation where the UK steel industry is actually moving away from carbon-intensive methods into green steel. At the moment, we are some way behind our friends and colleagues in the European Union, in that they have some 38 green steel plants under plan and 10 operating at the moment, all mainly green hydrogen produced by electrolysis. The one proposed in the UK is blue hydrogen with carbon capture and storage, but that is the future. The future is not steel produced by coking coal.

So, in a way, the Cumbria mine project should be unacceptable to us, yet Michael Gove, who I had huge respect for when he was Defra Secretary of State and who introduced a huge number of important environmental improvements and plans that are still echoing beyond his tenure in that role, in December last year—only five months ago—approved the plan for that coal mine. Rather cynically, he approved it up to 2049, one year before we have to have net zero in the United Kingdom.

One of the main reasons I have tabled this amendment, apart from the fact that I would not have thought it even possible that the United Kingdom would contemplate opening a new coal mine, is our international reputation. Of course, as Members will remember, we were the president of COP 26. We had a very successful conference in Glasgow and most of us—all of us, probably—congratulated Alok Sharma on the work he did as president of COP 26. During that conference, the UK Government put out a press release about their own success. This was in November 2021, only some 18 months ago, and it heralds:

“The end of coal—the single biggest contributor to climate change—is in sight thanks to the UK securing a 190-strong coalition of countries and organisations at COP26, with countries such as Indonesia, South Korea, Poland, Vietnam, and Chile announcing clear commitments to phase out coal power”.


The end of coal; that is the message.

The BEIS Minister at the time, someone called Kwasi Kwarteng—noble Lords may have heard of him—said:

“Today marks a milestone moment in our global effort to tackle climate change as nations from all corners of the world unite in Glasgow to declare that coal has no part to play in our future power generation. Spearheaded by the UK’s COP26 Presidency, today’s ambitious commitments made by our international partners demonstrate that the end of coal is in sight. The world is moving in the right direction, standing ready to seal coal’s fate and embrace the environmental and economic benefits of building a future that is powered by clean energy”.


I applaud that statement. It is strong, determined and absolutely to the point. Yet we are about to have a coal mine that will produce coal not just for an outdated steel technology but to be used for power generation.

I am very proud of Britain’s reputation on climate change. On my Benches and others we have criticised many aspects, but we have shown, over coalition Governments, Labour Governments and even the present Conservative Government, that we have moved forward—further, in many ways, than our fellow G7 countries. That is why it is absolutely wrong that we should trash that reputation by one decision to open a new UK coal mine. Who knows? If that happens once, it can happen again. That is why this amendment is so important.

My Lords, I am aware of the desire to get to votes, so I shall be brief. It is a great pleasure to follow the noble Baronesses, Lady Altmann and Lady Hayman. They have overwhelmingly made the case for Amendment 133 and the need for the systems operator to have that net-zero duty.

I shall briefly address Amendment 1, which sets the tone and direction of this debate in an important way. The noble Lord, Lord Ravensdale, and the noble Baroness, Lady Hayman, made the case for the need for an energy system to deliver for net zero. I want to focus on one word in Amendment 1—“resilience” and the need to increase it. We are now in the age of shocks. So many shocks have hit the world and our country, whether they be climatic, health or economic. There is a need for resilience. There is an idea that we can pick off these new, shiny technologies and say, “Great, we will chase after this or after that”. We should look at the basics, starting with an energy system which understands that the cleanest, greenest, cheapest, best possible energy is the one you do not need to use.

I am not sure that the report is out yet, but it is worth noting anecdotally the interesting experiments in energy demand that have happened during the winter. They will ensure that we can manage the peaks of demand and have less need for generation overall. I wanted to set out that focus on resilience because, in later amendments, we will get to the issue of community energy—local energy generation systems in local communities, spread around our islands. These will give us a real foundation of resilience and security that we desperately need for the future.

My Lords, perhaps for the purpose of the whole of Report, I should declare my interest at chair of Aldustria Ltd, which is concerned with battery storage.

I liked the speech by the noble Lord, Lord Ravensdale, today, as well as the speeches he gave on the levelling-up Bill debate yesterday evening. There is an important need for an understandable programme that moves us forward—a route map that works, rather than just targets and slogans. Of course, we will have Green Day on Thursday. When the Minister replies, could he give us a few clues as to what will be said then? The House would be all ears and grateful for the advance information. I thought that the net-zero report, commissioned by the Government and produced by his honourable colleague, Chris Skidmore MP, was an excellent document. I hope that the Government can say that we will be moving ahead in a comprehensive way in much of the area under discussion.

I will speak mainly about the three amendments that we have around Ofgem. It is just stark staringly obvious that Ofgem, our regulator for the energy industry, should have a net-zero objective. I cannot see how you can argue against that, for all the reasons that the noble Baronesses, Lady Hayman and Lady Altmann, have gone through so well. If there was one example of that to me, it is that Ofgem has clearly been very effective in its own mind at making decisions for customers of today but has been utterly unable to make decisions for customers of future generations. That area of the grid is now utterly incapable of delivering; whether it is offshore, onshore or developments on the residential side, those connections and that grid are unable to help us to move towards those net-zero objectives. On connection dates, I know one of 2035, which just happens to be the year when the Government’s target is to have finished decarbonising the electricity grid. Clearly we are not going to make that unless we move it forward very quickly, and I have concerns that we will already not be able to meet it.

The Minister and others in his position have said, all the time, “This is not necessary—it is already covered.” However, those examples already given by the noble Baronesses in the debate show that the directions and the objectives that the Government now have are not sufficient, and that this needs to change. We need to change it now, otherwise our decarbonisation of the grid by 2035, let alone net zero by 2050, will be missed. That cannot be allowed; these amendments must be part of the Bill.

My Lords, it is a pleasure to follow the noble Baroness, Lady Worthington, and to partly agree and partly disagree with her comments. I speak in strong opposition to government Amendment 58, which is the substantive amendment in this group, buried in the depths of a whole lot of technical detail.

It is worth focusing on what Amendment 58 actually does. The Minister said this in his introduction, but it deserves to be highlighted. The Minister acknowledged that these are not renewable sources of energy, but what we are doing here is to treat them as though they are renewable. That is an important distinction, which clearly needs to be made. It is quite significant.

As the noble Lord, Lord Ravensdale, said earlier, we have been debating this Bill for eight months or so. The second element of the government amendment, referring to nuclear-derived fuels, reflects something that the noble Lord brought to Committee but, so far as I can recollect across those eight months, recycled carbon fuels have suddenly popped here at Report, without any previous debate at all. That is something that presents an issue when it comes to scrutiny and examination—an issue which the other place, when this Bill reaches it, may well need to look at and consider in some detail, given that your Lordships’ House has not had the opportunity to look at recycled carbon fuels along with some of the issues that the noble Baroness, Lady Worthington, raised and which I am going to expand on.

It is worth highlighting that nuclear-derived fuel is now an extremely hot political issue—no pun intended—in Europe. Germany, Spain and Denmark are among the countries opposed to nuclear-derived fuel being classed as a renewable there, in a debate that is going on this very week, as we are meeting now in your Lordships’ House. The opposition from those states says that nuclear energy does not belong within renewable targets and that there is a risk that treating it as though it was renewable will undermine the massive expansion of renewables that we need to hit our climate goals. So this is a replacement-type issue—and that raises a very important point.

When I speak in opposition to this amendment, I am not necessarily saying that we should not, in a limited way, be using recycled carbon fuel of the industrial waste type to which the noble Lord, Lord Ravensdale, referred, or even, while we have the nuclear plants, nuclear-derived fuel. The question is whether it receives treatment as though it was a renewable when it is not a renewable—that is the question that arises from this amendment.

On recycled carbon fuel, as the noble Baroness, Lady Worthington, said, there are some grave concerns about burning fossil fuel wastes, particularly plastics, in incinerators or hydrolysis processes to produce fuels. I can quote some figures on this. When municipal solid waste containing 65% of non-biogenic waste, which is usually mostly plastic, is turned into fuel, the emissions range between 52.6 and 124 grams of carbon dioxide equivalent per megajoule. When the waste is all non-renewable, the impact is actually worse than conventional diesel, petrol or kerosene. Even when there are some reductions, at best they are 1% to 14%.

We come to a broader issue, and here I mention the noble Lord, Lord Lansley, who I see is not in his place. Yesterday, on the levelling-up Bill, he was expounding the virtues of the circular economy. Of course, in a circular economy, and thinking about the waste pyramid, the best thing we can possibly do is reduce the amount of waste. There is a risk if we are providing a way out at the other end for plastics, subsidising them as though they were renewables: this could encourage the production of more plastics, which is absolutely the last thing this planet needs, both for climate reasons and for all the other reasons of human health and well-being, microplastics and all the issues we have on a planet that is choked with the stuff already.

There is also the problem, of course, that while recycling is the third-best option—a bad option but not as bad as the others on the waste pyramid—anything that encourages the production of more plastics is an issue. I am aware that the Minister, when we were debating methane earlier this month, complained that people keep quoting scientists at him. I am afraid I am going to do that again, and I make no apology for continuing to do so, because I believe that we should have evidence-based policy that relies on the science. A study was published in Energy in 2017, “The utilisation of oils produced from plastic waste at different pyrolysis temperatures in a DI diesel engine”. I apologise that that is a bit of a mouthful. To boil down the point of this study, there are different ways of doing pyrolysis with fuels made from plastic, but whichever way you do it the air pollution results are worse than diesel.

Many Members of your Lordships’ House will be aware that my noble friend Lady Jones of Moulsecoomb has taken the Clean Air (Human Rights) Bill right through the House and has received very wide backing. There is a real issue here: climate is only one of the many threats we face. Air pollution is a very serious issue. Essentially, we are in a position where it is very clear that we have to stop burning stuff and polluting our planet, whether that is carbon dioxide pollution or other pollutants that come from burning fossil fuels or organic materials. There is a very grave danger in this amendment, I suggest.

Given that we are where we are, I am not going to call for a vote on this; I do not think your Lordships’ House is ready. I do not think we have had sufficient debate on this issue to do that, but I very much hope that today’s debate—and others may contribute as well—will be taken on board when the Bill gets to the other place.

My Lords, I also have great concern about this amendment. It seems to me that, on renewable transport fuels, we have a government amendment, in a group of some 20 amendments or more, that changes the taxonomy in the UK, exactly as was said by the noble Baroness, Lady Bennett, and the definition of a renewable fuel. I do not think that is particularly good practice; it is the wrong way to do this. I hope that the Commons, when this goes down the other end, will debate it rather more, because it requires a lot more thought.

I can get my head around the nuclear bit with hydrogen, which has now been well explained to me. I was trying to understand this amendment, I must admit, before the noble Lord, Lord Ravensdale, spoke, but whether it is renewable or not is a debate to be had. I do not have quite such an issue over that, maybe, but it needs to be debated fully. What I have a problem with is more the carbon side, because what we are talking about is no different from energy from waste. Energy from waste is one of the dirtiest forms of energy that is produced. It has other benefits—it does not produce landfill and all that sort of side—but it is not, in any description, a renewable fuel. So I too have great reservations about this amendment. Clearly I am not going to oppose it here today, but I very much hope that the other end of the building will give this much greater scrutiny and see it as a major decision around the taxonomy of renewable fuels and renewable energy when the Bill reaches there.

As I say in the Member’s explanatory statement, this debate is to raise issues that many people have raised with me about the purpose of Clause 230, which covers licensing nuclear sites that are on or under the territorial sea of the UK.

The noble Baroness, Lady McIntosh of Pickering, in talking about offshore wind farms, referred to the impact on marine mammals of seismic testing in particular. In the middle of last year we saw seismic surveys being carried out in the Irish Sea off Cumbria in order to assess the potential of undersea nuclear storage. At that time the Marine Management Organisation noted in a letter that those tests could cause disturbance to certain cetacean species. Those tests were carried out before this Bill became law. Those are interesting circumstances for them to be carried out in, which I will come back to.

In the Government’s own words, they need to keep the waste safe and secure for hundreds of thousands of years, give or take, for the radioactivity to decay. That is why they are seeking long-term storage for hundreds and thousands of years. The UK has the world’s largest stockpile of untreated nuclear waste, more than 100 tonnes of plutonium, and the total volume is 750,000 cubic metres. We are talking about a lot of nuclear waste. The chair of Nuclear Free Local Authorities, David Blackburn, who for full disclosure I will note is also the leader of the Green Party group on Leeds City Council, has said:

“The waste would be left in situ for millennia and, no matter how effective the barriers, some of the radioactivity will eventually reach the surface. The rate at which radioactivity would leak … can be poorly predicted and is likely to remain so for an indefinite period.”


I was in Cumbria a decade ago when there was talk of onshore storage of nuclear waste there and a great deal of local resistance. We are aware that there is no certainty. Putting it under the sea would seem to add to that uncertainty, to the risks and to the difficulties of dealing with anything should it go wrong. I put down this clause stand part debate because there is a great deal of uncertainty. People are unsure what the Government’s intentions are, which is why I hope the Minister may be able to provide more certainty.

I also refer to the fact that seismic testing was going on. The Explanatory Notes for the Bill appear to suggest that Clause 230 is actually to close a possible loophole that nuclear sites under the sea might not currently require a licence or be subject to the nuclear regulator. Page 71 of the Explanatory Notes states that:

“This clause amends section 1 and section 26 of the NIA 1965 and section 68 of the Energy Act 2013 … to make it expressly clear that certain nuclear sites located wholly or partly in or under the … sea … require a licence and are regulated by the Office for Nuclear Regulation”.


That raises a question that I will put explicitly to the Minister: are the Government aware OF or concerned about any unlicensed or unregulated nuclear sites on or partly on or underneath the sea in UK territorial waters?

My Lords, I shall be brief. When I first read this clause I assumed it was effectively to give permission to go out to sea from land, like some coal mines. I am interested to know whether that was the Government’s intention.

I was also quite interested that the site has to be partly in territorial waters. Territorial waters go out to 12 nautical miles, so that seems to suggests that it does not. I wonder why there is the stipulation that the site has to be partly in territorial waters. It seems to me that if this is done it really needs to be within territorial waters. I have no other questions.

My Lords, I have a question for the Minister that follows on from that. I very much support the idea of an energy commission, although Chris Skidmore says very strongly in his report, on decarbonisation, that:

“None of this will happen without a step change in the government’s approach to delivering net zero.”


He says that an office for net-zero delivery within government is needed but, if we cannot get that, energy efficiency must be part of it.

When we were in the European Union and single market, part of energy efficiency was around appliances and all sorts of things that we use or do, and we have had an increase in energy efficiency—not fast enough, but a sectoral trend—largely because of the sorts of implements we use; cars, vacuum cleaners or whatever. I therefore ask the Minister: in terms of energy efficiency and standards for equipment and pieces of machinery, what is happening now? Is BEIS doing this itself? Does it have a programme? How does that relate to our export markets and manufacturing sector? I would be interested to understand.

The noble Lord, Lord Bruce of Bennachie, has presented very interesting proposals. Like the noble Lord, Lord Teverson, I think this offers us one way forward on the crucial issue of energy efficiency, but I have a question for the noble Lord, Lord Bruce. Would he agree that a useful role for the energy efficiency commission would be ensuring systems to educate people to install this new technology properly, so that people such as the plumber whom he cited had the information available to ensure that they knew that what they were installing would work for their customers?

My Lords, in the interests of time, I will comment only on Amendment 240, in the name of the noble Lord, Lord Foster of Bath, and offer strong support for it—alongside some potential improvements or broadening-out suggestions at this stage.

It is interesting that, in 2015, Steve Holliday, the then CEO of National Grid, said that the idea of baseload relying on coal-fired or nuclear power stations was “outdated”:

“From a consumer’s point of view, the solar on the rooftop is going to be the baseload.”


This would obviously need to rely on batteries for it to work 24/7. Mostly since that time, 3.3% of British homes have installed solar panels, but many of them were installed before batteries were a viable option. Those home owners should not pay the high levels of VAT to enhance the system for the benefit of both themselves and the whole of society.

I have later amendments talking about community energy schemes. I can think of numerous ones that I have visited over the years where solar panels were put on cricket pavilions, community halls et cetera. We have been talking mostly about domestic settings, but there are also many community settings in which the addition of batteries may now be a practical option.

We will be talking a lot in later groups about the issue of energy efficiency and improving energy security by reducing our demand. My understanding of the information from the Consumer Protection Association —and I stand to be corrected if I am wrong—is that double, triple and secondary glazing are not currently covered by the VAT concession. It seems to me that this could possibly be included in this amendment; perhaps it is something we can work on.

My Lords, I begin by making it quite clear that my energy storage interests are not around long-term storage or retail storage.

I absolutely support the amendments put forward by my noble friends, but I will not talk about them. Instead, I will follow up on the amendment tabled by the noble Lord, Lord Moylan, and relate it to some of the discussion that took place earlier today in the House around storage, because gas storage is really important at this present time, and it will continue to be in future. I like the way—through a percentage or whatever we use—that we can see a relevant ratchet downwards, as we would expect. However, what alarmed me earlier today was that, in terms of current storage, we appear to be in the hands of independent directors of independent companies that have responsibility to their shareholders under the law, but not to the energy security of the country. That was very clearly stated by the Minister in terms of the decision to turn off the Rough facility in 2017. As I said at the time, if that was the case then, I see no reason why that is not also the case in future; there seemed to be no proposal by the Government to change that situation. I am interested to hear the Minister’s response to that part of my original question.

I will also go back to what the noble Baroness, Lady McIntosh of Pickering, said, because part of the Minster’s earlier answer was that our storage is the gas we have in the North Sea. But we all know that that store is going down, and I certainly would not, from these Benches, resist trying to increase that in the short term during the energy crisis to ensure that our energy is there—the situation would be different in the medium and long terms. That flow is going down and our imports are going up. I do not know if these two years were particularly representative, but the last figures from the Minister’s department said that, in 2020, we imported £5 billion-worth of gas. A year later, that went up to £20 billion-worth of imports of gas—a quadrupling. That was not all because of a price increase at that time, most of which has happened in 2022.

Another statistic reveals that, while we think we have multiple sources, 75% of imports came from one country, which is Norway. Norway is a dependable friend of the United Kingdom; we would not argue otherwise. But we must be clear that Norway’s bigger customer is Germany. Germany and the other European countries which import gas from Norway are probably more desperate—this is likely not the right phrase to use—for that resource than we are. As I said, I very much support the outline of the amendment tabled by the noble Lord, Lord Moylan, and ask the Minister what security we actually have, and for how long, over our supplies—that is, the 75% of imports that we have from Norway. What is our legal entitlement to that flow into the future?

My Lords, I rise to speak to Amendment 68, which appears in my name. We have already had an interesting debate essentially about the operational independence of the bank. Looking around the Chamber, I think there are two noble Lords here who were also in the Schools Bill which we are taking in parallel with this Bill. I was rather struck by the similarity between the two Bills in that a great deal of debate on that Bill focused on what would happen if these powers were given to a Government and then a Government of a hue you did not like came in and exercised them. When I was thinking about that, I was thinking: what if we had a Green Government? Would I want operational independence for the UK Infrastructure Bank? If your Lordships’ House manages to get the objectives right as well as the composition of the board, which we will get to later, I believe we should have operational independence for the UK Infrastructure Bank because democratic control is the issue. As the noble and learned Lord, Lord Thomas, said, this is a public bank, so any steps being taken by the Government in directing it should be subject to full parliamentary scrutiny of a broader and more detailed kind than that which the Minister referred to earlier.

That brings me to my Amendment 68. In responding to some of the earlier debate, the Minister in a way made a point for me because, as the first amendment in this group states, this bank has a double bottom line. Its responsibilities include social justice and the climate emergency. Indeed, under a Green Government I might like to rename it the “Just Transition Bank” because that is essentially what it is setting out to try to do.

The Treasury is the ministry in control of this bank. What does it know about climate, nature, poverty, inequality or regional disparities? The very nature of the Treasury is that it is focused on money and what is called the economy—that mysterious thing outside human existence. What does it know about farming or health, despite the fact that it has a dictatorship over the actions of all the departments that cover them?

My original plan, which I alluded to at Second Reading, was to take the bank out of the Treasury’s hands entirely and put it in the hands of the departments that know about the things that it is supposed to be trying to do. However, the Public Bill Office—and I thank it for its patience and assistance on this—told me that that was, technically, practically impossible. The phrase “A Green Government wouldn’t start here” crossed my lips, but the Public Bill Office came up with Amendment 68, which would ensure that the Treasury fully consults the Secretary of State for Environment, Food and Rural Affairs, the Secretary of State for Energy and Climate Change—I admit to something of a Freudian slip and apologise to your Lordship for the error in this amendment, because proposed new paragraph (b) should, of course, refer to the Secretary of State for BEIS, although whether we should have a department entirely dedicated to tackling the climate emergency is a question to raise on another day—and the Secretary of State for Levelling Up, Housing and Communities.

I thank the noble Lord for his support for my somewhat unintended amendment.

We come back to: what is this bank for and what is the economy for? The bank is supposed to serve the people of this land. The departments that focus on the people and the climate emergency this bank is serving should surely have an explicit statutory role in oversight. I have not been in your Lordships’ House that long, and I cannot count the number of times I have seen a Minister stand at the Dispatch Box and say in response to a question, “Well, I’d love to do that, but the Treasury —” and roll their eyes. That is the way the country is being run, and it needs to change. This could be a small way to step in that direction.

My Lords, I would gently challenge the noble Lord, Lord Tunnicliffe, on jobs. I have long experience in the far south-west—a deprived area that needs levelling up—of European funding, which always had jobs as its major output. The challenge is not normally jobs because, in the sort of areas that need levelling up, the jobs created by employers are normally low-grade jobs, so that is what you get. The real challenge, particularly on a levelling-up agenda in deprived areas, is actually careers, productivity and high-paid jobs. It is very easy to fill in a jobs return on jobs that are not very skilled or high grade, whereas we need to improve and raise the whole base level. I understand exactly what he is trying to get but I think it is a fundamental problem that we look at these issues in relation to grants, funding regimes, loans or other such systems. That is just a comment from my experience in Cornwall and the far south-west.

At the risk of ganging up on the noble Lord, Lord Tunnicliffe, which is not my intention, I would add a supplementary comment to his statement. When we talk about job creation, people will say they are building a new supermarket and that it will create 150 new jobs, but there is never any attempt to account for how many jobs will be destroyed by that development. It surely should be about net jobs.

My Lords, I always think that ping-pong can be rather a brutal affair. I have spent months working on an amendment; the combined House of Commons comes back and says

“the provision made by the Amendment is unnecessary”—

and there we are, it has been written off. However, the House of Commons, in its wisdom, is absolutely right: the amendment was unnecessary because all it actually needed was for the Prime Minister and this Government to declare, as many local authorities have, a climate and biodiversity emergency. Therefore, I accept what the Minister has said. The Prime Minister in his foreword to the Net Zero Strategy—a document that we all welcome, although it is rather late, before COP 26—says:

“We will meet the global climate emergency”.


I truly welcome that; it is a shame in a way that he then says

“but not with panicked, short-term or self-destructive measures as some have urged.”

That somewhat takes the shine off it—but I accept that that declaration is there; it is by the Prime Minister and it is published in one of the most important documents that the Government have released in recent times, in the run-up to COP 26. However, I also point out that it does not include the biodiversity crisis, which is particularly pertinent to this Bill. The motive for this amendment was to give equality to both those emergencies, and to stress their interconnectedness—the vital relationship between the two.

However, that declaration is there. The other Motions that we are going to debate during this afternoon are, perhaps, of greater practical importance to the future of the environment, our country and our planet, so I shall not contest this. I thank the Minister and his officials for the conversations that we have had since passing the Bill in this House and today in finding ways in which to solve this area. I shall not contest this judgment, brutal as it was, by the House of Commons.

My Lords, it is a pleasure to follow the noble Lord, Lord Teverson, and to agree with every word that he just said. I thank the Minister for his introduction to this debate and thank him and his officials for the very detailed and useful discussion this morning, particularly with such a lively avian accompaniment.

I shall take a second to reflect on the place of your Lordships’ House. I had a discussion a couple of days ago with a Cross-Bench Peer for whom I have the greatest respect, who expressed great frustration at the huge amount of work done in your Lordships’ House, which so often—as the noble Lord, Lord Teverson, has just said—gets casually dismissed in the other place. Yet we are so often told, “Oh, we can’t send too many things back to them; we can’t resist too hard; we’re the unelected House.” That, of course, raises a whole other question about the constitution. None the less I fear—and we have seen some cases of this already—that many of our strong, fine Peers are getting fed up and really considering whether they are going to continue to devote their time to your Lordships’ House. It is crucial that we recognise that we are in a different political time and that we are crucial to the future of this country, its environment and people, and we need to stand firm.

I have come under strong pressure, as I am sure many are aware, not to push forward with the soils amendment. Those looking closely will notice that I have not pushed forward with the same amendment as was sent to the other place. My amendment in lieu simply refers to soil quality rather than soil quality and soil health, as in the amendment sent to the other place. Health very often talks about the biology of the soil; quality is frequently used to refer to the structure. I am guided here particularly by the Sustainable Soils Alliance but also by academics, independent experts and farmers, who say that it is possible to use the metrics from the soil structure monitoring scheme to establish a target specifically for soil structure which would fit the definition of quality. As the Minister said on Report, targets can be iterative—they can be developed, evolved and finessed over time.

I acknowledge that the Minister here and those in the other place have spoken often and very clearly, and clearly are engaged with the issues of soil that are so crucial, but we all know that Ministers change. The only thing that will guarantee a way forward is with soil being on the face of the Bill. I put it to noble Lords that this Bill will be fundamentally deficient if we do not have soils there with equal weighting and place alongside air and water. I am afraid that the Minister in debate also said at one point that, if we were looking after air and water, we will sort of be looking after soils as well. I am afraid that very powerfully makes the argument for me—that soil risks falling into a second order unless it is given the same status.

I note that, in your Lordships’ House on Report, the margin by which this vote was won was equal top with that for the amendment on sewage tabled by the noble Duke, the Duke of Wellington. This was a very clear voice from your Lordships’ House on Report.

I also particularly wish to acknowledge the very strong efforts in this area by the noble Earl, Lord Caithness, who has done a tremendous job and has seen some steps forward from the Government. But those steps are still not enough.

I finish, given the pressure of time, by noting that I do not believe that the amendments we are looking at today are either/or. All the amendments that have been retabled today are crucial. My noble friend Lady Jones of Moulsecoomb will address interim targets in more detail, but I stress that that is crucial as well. I also want to acknowledge the efforts of the noble Lord, Lord Deben, and the noble Baroness, Lady Brown, in supporting my amendment last time. I urge your Lordships to show that we are really here to make a difference. I give notice of my intention to push this Motion to a vote.

My Lords, it is a great pleasure to follow the three noble Lords who have already spoken on this group. They have given us a comprehensive explanation of why we need all these amendments. I shall speak chiefly to Amendment 121 in the name of the noble Lord, Lord Randall, also signed by the noble Baroness, Lady Boycott, and the noble Lord, Lord Teverson, on the global footprint timetable. It has already been clearly set out why this amendment needs to pass: we need drastic action now.

A large number of amendments in Committee addressed the broader issues here. There was the call to look at not just resource efficiency but cutting total resource use in Part 1. There was the call to move towards the Treasury managing our economy for the purposes of people and planet, not chasing after growth that we cannot have more of on a finite planet. Your Lordships have heard the Government’s cries about their desire to progress the Bill quickly, so many of these amendments have not been put. They have been boiled down to some very clear, simple essentials that need to happen. I offer support for all these amendments.

The questions that the noble Lord, Lord Randall, asked were very clear and important, but I will address a direct question to the Minister on Schedule 17. It is crucial that Schedule 17 covers the main commodities driving global deforestation, so can he confirm that it will cover beef and leather, cocoa, palm oil, pulp and paper, rubber and soy? They are not currently defined in the schedule, and there is concern that any limits to the approach would utterly undermine the intentions expressed in this provision and by the Government.

I also want briefly to address Amendment 107 on the rights of indigenous people. We know that many of the parts of the world that still remain relatively pristine rely heavily on indigenous people to protect them, and how often their rights to do so and to live their lives are threatened by mining companies associated with us—often large multinationals with close ties to the UK. When one considers that and our historic legacy, as well as the impact of colonialism on those communities, we have a particular responsibility to ensure, practically and morally, that they are being listened to.

My Lords, I start by congratulating the noble Lord, Lord Randall, on his speech and his due diligence on this issue, which is crucial in terms of deforestation. We have the frustration whereby we want extraterritoriality, which we do not normally have in the UK, but we can influence some of these matters only through supply chains and our own British corporates. The United States seems to get away with extraterritoriality in relation to more or less everything. We do not have that privilege.

As regards this approach, I also like the reference to recognising indigenous people. It is clear and obvious that it is so much more effective to keep forests rather than start to regrow them. That is the other side of the coin, as it were, to the previous debate and perhaps is even more important. That is why these Benches are very much in favour of the system proposed—although one of the big challenges that we have faced regarding environmental regulation and the Bill is enforcement and making sure that the regulations that we make can operate and are policed. We have the FSC, the Forest Stewardship Council, which works okay but all of us know of instances of duplicity in the system—not in the work of the FSC itself but among those copying and wrongly branding products. That challenge remains, but that does not mean that we should not move ahead in these areas.

I want also to congratulate the noble Lord, Lord Randall, on his pioneering work on the global footprint. We have mentioned a number of areas but the Dasgupta review, sponsored by the Treasury, again stressed that in terms of natural capital we are extracting far more than we are putting back into the planet. I suspect that the noble Lord is not expecting the Minister to accept the amendment but I hope that the Government will do further work in this area. I agree strongly with a point that the noble Lord made: if we can become the leader of standards in this area, it would be incredibly important.

Lastly, I come to the amendments of the noble Baroness, Lady Meacher, on urgency. That is the word I hear from her and she is absolutely right. We have so little time in so many of these areas and here, through these amendments—which I hope the Government and the Minister will accept—we have an opportunity to wind up that urgency and start to make right what we need to do soon and so urgently.

My Lords, I want to speak to my own Amendment 128, which goes back even further into the depths of this Bill to Schedule 6. It is a probing amendment in many ways, and very mild, just to tease out where the Government stand on this. Although, as the noble Baroness, Lady Jones of Whitchurch, said so well, this seems to be a very technical area, these issues are absolutely essential in making the future circular economy, and everything we want in terms of resource efficiency, actually to work and become public friendly—and the way that it faces the public becoming friendly as well.

It comes down to labels. We have had some mention of labels already, particularly from my noble friends Lady Scott and Lord Bradshaw. What I am trying to get at here is that there are provisions, rightly, for the Secretary of State to be able to make regulations about such things as labels on products, but what it does not do is suggest that there should be some consistency about that labelling so that we all find that interface useful, friendly and usable.

I am thinking of two other areas in particular. When I put the laundry into the washing machine at home, there is the occasional garment that I do not have a clue how it should be washed. So what do I do? I look at the label on the garment that has all those little symbols that tell me how I should wash this—at what temperature and all that sort of information. It might tell me not to wash it at all, but to dry-clean it instead. Over the years, I have got to know those symbols. Everybody else has: they are actually fairly international rather than national; I am not even asking for them to be international. Through that, we get to know what we should do.

I think it was the noble Lord, Lord Lucas, who mentioned electrical appliances. Whether it be a dishwasher or a dryer, they also have labels that give an energy efficiency rating. That has been so successful that we have had to reinvent or restate what the most efficient levels are, because people have got to know them and simply go for green rather than red.

This amendment is merely offering a suggestion to the Government. It would give the Secretary of State the power to ensure that labelling on goods in the system that will become part of the circular economy is consistent, so that everybody gets to understand the symbols and they are therefore effective. We should not have a wide range of different labels from different manufacturers, or different systems, which would confuse consumers. In labelling, we need consistency, good design and systems that have been tried and tested, and last. As, I think, my noble friend Lady Scott said, this will make sure that people who want to do right can achieve that.

My Lords, it is a great pleasure to follow the noble Lord, Lord Teverson. I rise chiefly to speak to Amendment 292, which appears in my name and has the backing of the noble Baronesses, Lady Boycott and Lady Meacher, and the noble Lord, Lord Hunt of Kings Heath. I thank them all for their support and note that a number of other noble Lords would have signed this amendment had there been space.

I was simply going to speak to my amendment, but I must briefly and strongly commend Amendment 119, which was so ably moved by the noble Baroness, Lady Jones of Whitchurch. The noble Lord, Lord Teverson, highlighted in a previous group that I had focused on the word “urgent” a lot. With this amendment the noble Baroness has really driven home the need for urgent action. We have a plastic and waste-choked planet and nation that cannot take any more: it cannot take the volumes we are imposing on it every day.

Amendment 292 is about nappies. That might sound like a minor issue but I hope that by the time I have finished, noble Lords will understand that it is not. Before I begin, I declare my position as vice-president of the Local Government Association, since that will become relevant. For full transparency, I declare that I have worked on this amendment with, and many noble Lords will have received briefings from, the Nappy Alliance, which represents makers of reusable nappies. Supporting a green industry and working with it is not something I am going to make any apologies for, but I think it is important we acknowledge such ties and where the resources come from.

On average, each single-use or disposable nappy generates 550 kilos of carbon dioxide throughout its whole lifecycle, from production to disposal. From birth to stopping using nappies, an average child will use the equivalent of 15,000 plastic bags and half a tree in fluff. This is why the Local Government Association is relevant: at a local level, single-use nappies account for some 4% of residual waste in England. That is 3 billion nappies each year, and it costs local authorities £600 million a year to dispose of them. When such nappies are sent to landfill it takes 300 years—roughly 12 generations—for them to break down. Incinerating them gives rise to significant carbon emissions and local air pollution levels, an issue we keep coming back to. This is where my amendment links to that tabled by the noble Lord, Lord Bradshaw: single-use nappies often end up contaminating waste for recycling because of misleading labels and consumer confusion. Many people do not realise they contain plastic, and think they are a kind of paper.

By way of contrast, reusable nappies use 98% fewer raw materials and generate 99% less waste. They save the equivalent of 17 plastic bags per day. Here, I think I need to dispel some misunderstandings. As we have seen in many other areas of health and environment where there are powerful industry interests, there has been a lot of confusion and misunderstanding about environmental impacts and comparative environmental impacts. In March 2021, in a report I would be happy to share with any noble Lord who is interested, the United Nations Environment Programme published a comparison between single-use nappies and reusables. It concluded that reusable nappies had a lower environmental impact across all trial scenarios when compared to single-use nappies.

Michael Gove seems to be coming up a lot this evening. Back in 2018, he did actually suggest that disposable nappies might be banned. In a very rare occurrence, I am not going to go as far as Michael Gove did in 2018. When people are travelling or when there is a new babysitter, for example, there may be an argument for the occasional use of single-use nappies, but it should not be the norm.

This brings me to some other aspects of the amendment that really start to address how we change the situation. There are some really good local authority small-scale practical schemes that are helping people change to using reusable nappies and get away from single-use nappies. Often, they are based on nappy libraries—frequently run by volunteers, most usually women—which have a range of nappies that families can try out. People can see which ones are suitable before they spend money. Many local authorities—by no means all and by no means extensively—offer schemes that can help families to purchase reusable nappies. The problem is, of course, that when you have a new and growing baby, you need a set of nappies, which is a big initial outlay beyond the reach of many people. Subsection (8) of my amendment would allow the Secretary of State to make regulations for a levy to be paid by nappy manufacturers to fund a scheme to help people use reusable nappies. We are talking about ensuring that people can afford to buy them and that they have access to understanding and knowledge—nappy libraries also share information about how to use nappies and what the best ones are.

There is a comparison here. The noble Lord, Lord Teverson, talked about energy labels on packaging, and that is partly what this amendment calls for. But in fact, it is a bit like cigarette packets, for which we have labelling and pricing that acknowledges the cost of the product that applies to all of us.

So, I strongly commend this amendment to the Minister. I point out that I have probably been approached by more noble Lords on this amendment than on any other I have tabled—and I have tabled some with very wide-reaching effects. This issue is of great interest to people for many reasons. One, of course, is something I am sure we will be referring to a lot in the next few hours: litter. There is a big problem with litter from single-use nappies. It is a deeply unpleasant thing. I am sure most noble Lords have been volunteer litter pickers in some form or another, and it is not a pleasant thing to encounter when doing that.

What we are talking about here is changing things to make life better. It is about the kind of systems thinking that I very often refer to. This is the Environment Bill, and when we talk about the environment people ask if we can we afford the cost of this or that measure. If we can help most families to use single-use nappies, that would save them, on average, £11 a week. That is a lot of money to many families—money that could be spent on healthier food or on taking off some of the stress and pressure. This amendment has environmental and social benefits: it is a win-win. If the Minister is being pressured to offer some yeses, here is an easy win.

My Lords, it is a pleasure to follow the noble Lord, Lord Faulkner of Worcester, who, along with many other noble Lords in this group, focused on public health. Covid-19 has reminded us how unhealthy our society is and how inadequate current arrangements are.

Given that my noble friend Lady Jones of Moulsecoomb has spoken with great power and eloquence in this group, I will be brief and address only Amendment 51 in the name of the noble Lord, Lord Stevenson of Balmacara, to which I attached my name. That amendment would provide public interest defences on trade restrictions; environmental standards and protection; animal welfare; consumer standards; employment rights; the health and life of humans, animals or plants; cultural expression; regional sociocultural characteristics; and equality entitlements, rights and protections. These describe what should be the goals of a decent Government aiming to deliver a healthy life for all their citizens and the sustainable development goals that they are signed up to.

The term “public interest” makes me think of public money for public goods. I am aware that “public goods” has a technical definition but the parallels with “public interest” in this amendment are obvious. I cannot, therefore, see how the Government can oppose it, given that they want to spend significant sums of public money for some of the same goals through the mechanisms of the Agriculture Bill and the Environment Bill, whereas here we are simply applying standards to deliver public goods. I am aware that some Members of your Lordships’ House believe that trade, and the greater volume of it, is a good in itself and should be our primary or sole aim, but we come back to the question: do we work for the economic system, or does it work for us?

Many of these discussions have a distinctly Groundhog Day feeling and the Government may respond by saying, “Our intentions are good and we are trying to deliver all these things”. I come back to the word “dictatorship”, my use of which the noble Lord, Lord True, objected to. I reserve my own right to judgment on that. In fact, I do not have to go that far for the purpose of arguing for this or other amendments. We know that Prime Ministers and Governments have not had a long shelf life in recent times, and who knows how long this one will last? We are creating a legal framework and the possibility for action by any future Government, whatever they might look like. Giving the right to all devolved Governments to act on behalf of their citizens to defend them against chlorinated chicken or fruits laced with dangerous pesticides can be the only basis for continuing in a democratic manner.

My Lords, I declare my interest as chair of the Cornwall and Isles of Scilly Local Nature Partnership. I wish to speak to Amendment 52, although I support a number of other amendments in this group. That amendment has been tabled by the noble Baroness, Lady Boycott, who, in a topsy-turvy way, will follow me.

We have naturally and correctly been obsessed by the Covid-19 crisis, yet we still very much have the climate change issues—the loss of nature, the biodiversity challenge and a raft of other environmental issues of great importance, such as plastics, marine pollution and so on. Those challenges are not just global; they are national, as well as being regional and subnational. In the United Kingdom devolution is a fact of life and something that I certainly welcome. Those devolution principles allow the nations that make up the United Kingdom to be able to set their own standards in a number of areas. One key area where those standards can be different and which I believe has been particularly successful is the environmental area, and there is potential in climate change as well.

The history of devolution and different decision-making within the UK in the environmental area has been very positive. There has been almost a competition, if you like, to get ahead of other nations within the UK, and that way the bar has been raised in terms of environmental legislation and what we are trying to do. In fact, the word “experimentation” has been used previously. It is important to see what works in one part of the UK, as this is sometimes copied by others. The plastic bag policy in supermarkets, cotton buds, plastic straws—all are examples of one leading and others following. Indeed, as we have heard many times, even within the EU single market, member states have been allowed to have enhanced standards and have not been challenged.

The challenge is: how do we meet the environmental and climate crises that we have and still keep our internal market? To do that, we cannot rest on the status quo. We have to move forward on all those agendas, as indeed the noble Lord, Lord Callanan, will know well, being the Government’s climate change Minister. We cannot stay where we are and have business as usual.

We therefore need to keep these positive, competitive aspects of environmental and climate change legislation within our devolution in the United Kingdom while keeping that important single market. As has been said before in this debate, no one in this Chamber is looking to restrict that single market in any way in principle. But I believe that this Bill undermines our ability to meet our environmental objectives easily and quickly.

What does the blanket—as I see it—market access principle risk here? One thing we have is offshoring. We have been very good performers in the United Kingdom on our carbon footprint, but that is because a lot of manufacturing has perhaps gone to Asia. That is not the whole story, but it is some of it.

As the Bill stands, if we have stringent rules within one part of the UK, manufacturers would just move to another part of it and effectively import into those other regions or nations. That would be extremely negative. But one key thing would happen: rather than having a “raising the bar” competition between national authorities within the UK, we would risk moving the power to the corporate sector, which is more likely to look for efficiencies or the lowest standards in order to make sure that they can remain strong within the market. That would be a very undesirable outcome of this legislation, which is not the Government’s intention. We risk, potentially, more of a commercial race to the bottom. I have nothing against industry whatever—indeed, I wish to see it promoted—but this would change the power structure within the supply chain. It is as if the legislation were applying the harshest WTO rules internally to our own internal market.

We need to have sensible derogations that can avoid these downsides and outcomes. Amendment 52, in the name of the noble Baroness, Lady Boycott, is exactly what we need for the environment and climate change agenda and for the United Kingdom to stay ahead in this area, not just globally but nationally and regionally as well. Without such derogations, other environmental legislation at a devolved level becomes almost redundant, as it cannot be enforced because goods will come from elsewhere in the United Kingdom—or else devolution will become redundant in this area because, since England is the largest part of the market, Westminster will effectively decide the rules. That is why this amendment is vital.

My Lords, I have attached my name to Amendment 1 and shall speak also to a number of other amendments in the group. I thank the noble Earl for tabling Amendment 1: it was something I was thinking about. Indeed, I spoke to the Table Office, because much of the discussion around the Bill has focused on the fact that it provides powers but not duties. I suggested to the Table Office that we could go through the whole Bill and change every “may” to “must”, and those in the Table Office persuaded me that that might not be the best way forward. I thank them for their patience and all their expert assistance. I think the noble Earl has managed to focus on the key part of the Bill, where “may” should be changed to “must”. I know he tabled it as a probing amendment, but we should think about this as a serious way forward: a duty to look after the key principles of carbon storage, ecosystems, the state of our natural world and healthy food. These should be a duty of the Minister.

Amendments 8, 22, 25, 31 and 50, in the name of my noble friend Lady Jones of Moulsecoomb, are all about air pollution, which is a huge gaping hole in the Bill. It looks at water, at soil and at our ecosystems on the ground, but does not talk about the air; yet it is all part of an interrelated system and we know that air pollution and farming issues are closely interrelated.

I have also attached my name to Amendment 67 in the name of the noble Lord, Lord Teverson, which says:

“Financial assistance may only be given for Environmental Land Management Schemes Tier 2 and Tier 3 if those individual schemes are in line with the local Nature Recovery Strategy”.


This addresses a crucial point: we need joined-up, systematic thinking about the nature of our countryside. At the moment, we have a number of silos. We have the Environment Bill, the Agriculture Bill and the now delayed food strategy, and we need to make sure that these are all joined up and working together, not at cross-purposes to each other. We need a whole-landscape approach, something the Wildlife Trust has been doing a lot of excellent work on, although we have to notice that what we see in the Environment Bill will lay new duties on councils, which, as we discussed in Oral Questions, already have enormous burdens on them.

Finally, Amendment 234 in my name, would add a clause headed “Agricultural extension”. It has notable similarities with an amendment in another group—Amendment 122, in the name of the noble Lord, Lord Grantchester. Both of us are getting at the point that farmers need reliable, independent, secure, certain expert advice. In preparing for today I looked at the debates in your Lordships’ House back in 1996 and 1997 when the Agricultural Development and Advisory Service was privatised. There were some very telling words from the late Lord Mackie of Benshie, who talked about how, since the Agricultural Development and Advisory Service had started charging for its services, less use was being made of them. Some people —perhaps those who needed them most—could not afford them.

The state of our countryside and our agricultural land is a matter of national interest. It is something that we cannot leave to market forces. We have seen, in terms of agricultural extension and advice, a huge reduction, huge privatisation and a move towards many farmers being forced to take advice from the suppliers of agricultural chemicals and agricultural seeds, and even from their buyers, the supermarkets. Farmers need independent, expert advice. We need people to be able to develop careers in providing that advice. If we have an expert on growing potatoes in the south-west who spends decades focusing just on that, that is very hard to do in the private sector. If potatoes have a few bad years, no one can afford to pay that person and they do not have the chance to develop their skills in the way that they would in an advisory service.

We have to look at the whole system here. Part of a proper agricultural system has to be a government-run advice service. That is something that has existed historically for a very long time. It can a be traced back three millennia: in ancient China we know that there was a government Minister advising farmers on how to improve agricultural systems. This is a matter of national interest; it needs national involvement and a proper advice service.

My Lords, I shall speak to my Amendment 67 and I thank the noble Baroness, Lady Bennett, for her support for it. My main interest here is in connection with the broader environmental policies of the Government as they bring these forward in legislation. As I said at Second Reading, I very much welcome the ELMS initiative; it is a major step forward in the use of state aid for the farming industry and how it is to be targeted.
