Lords ChamberMy Lords, I support the noble Lord, Lord Bird, and his splendid Bill. It is a measure fit for the 21st century and a rejection of top-down government in favour of a truly integrated model in which well-being goals will be set.
I have spent my entire adult life promoting the importance of the health and well-being of children and young people. As I have always said, childhood lasts a lifetime. What happens to us in childhood stays with us right through our lives and shapes us in every way, from our view of society, culture and the wider world to our wealth, health and mental well-being. Every decision made by Governments, businesses, industrial and religious leaders, and media influencers affects children, and when people live in a society which does not value the right of children to be happy, safe, healthy and financially secure, they become angry, disenfranchised and radicalised. The ones who suffer most as a result are the children.
Today there is a lot to be worried about. The actions of Governments, industry and financial institutions across the globe mean that we have arrived at a critical point in humanity’s very existence on this beautiful planet. Now, more than ever, the decisions we make will have colossal implications for the survival of humankind. The mistakes we have made in the past are impacting not just on this country but globally. Every day, children and young people hear terrifying reports about climate change, global warming, war, disease and pestilence, and are having to deal with social media issues. Should we be surprised that they are feeling more and more anxious about life? Of course not. This is why the Bill is so important. It is all-encompassing, it thinks big and is visionary. The only way forward is to think out of the box. The only way we are going to fix this wounded planet is by innovating our way back to a better, more caring, kinder and more socially and environmentally aware society that practises consideration, contentment, confidence and courage.
During my time in this House, I have co-founded the All-Party Parliamentary Group on a Fit and Healthy Childhood and championed our recommendations on the early years, food in schools, physical activity, the national child obesity strategy, children’s mental health, and many other vital issues, such as implementing age verification for accessing online pornography. We know that childhood in this country is in a crisis; a vicious circle of inactivity, mental health problems and being overweight feed off each other and are likely to result in the least healthy adult population in living memory. We have, therefore, argued consistently for a Cabinet Minister for children and young people, to ensure that children’s needs are central to decisions across the policy range. We believe this is essential to the success of the Bill. It means prioritising an evidence-based child health and well-being strategy to underline all policies and all departments, covering the whole of childhood. There has to be a clear accountability framework, setting out responsibilities for professionals, and public and civil society, as well as essential detail about the resources and funding to deliver it.
We strongly believe that it is vital for the noble Lord’s Bill to succeed, because it has the potential to ensure that children’s interests are enshrined in law. There also has to be an annual well-being report published by the appointed Secretary of State. The Bill proposes that we should adopt a child health approach in all decision-making and policy development. I am honoured to support it and wish it a safe passage through Parliament and beyond. I thank the noble Lord for his wisdom in introducing it.

Lords ChamberMy noble friend is absolutely right. The statistics showing the percentage of those from ethnic minorities employed in the public sector are in the report. She is right to say that there is good representation at the lower levels but much less as one goes up the chain. Again, that is a question for the Government to explain or change. If one looks at the Armed Forces, the Army has a relatively good record with some 10% of personnel coming from ethnic minorities, but the RAF has a less good record. Therefore, there are challenges for the Civil Service and those in the public sector to look at the figures and establish why those from ethnic minorities are disproportionately represented in the less well-paid posts.
My Lords, I welcome this report because it focuses on an issue that affects the whole of society, even more so than when I came here from Trinidad as a 10 year-old in 1960. I was born in Trinidad so I knew that I was worthy and I knew about my history, but a lot of young black and Asian minority children do not know about their history. It is Black History Month so I have visited schools, universities and prisons. Just this morning I visited a school in Bedfordshire to talk about Black History Month. When I visited prisons, I realised just how much black men did not know about their history and how they felt let down by the education system not focusing on who they are. To move forward you need to know where you have been and where you have come from. What are the Government doing to create a safety net and ensure that BAME children do not fall through it? We need a safety net to help and protect them and show them that they belong. We owe it to them and we owe it to our young people—not just black people but white people too—to teach them about black history and how we can all move forward to make our country, Great Britain, great again.
Again, I commend the work that the noble Baroness has done in this field. If I may say so, she is an admirable role model for those in our country. The specific question she raises—the extent to which one wants to change this issue and inject into it the dimension to which she referred—is one for the Department for Education and the national curriculum. I very much hope that schools will teach not just British history but history more generally, particularly in those areas where they have children coming from a wide variety of different backgrounds. I will certainly pass that suggestion on to my noble friend.

To ask Her Majesty’s Government what steps they are taking to encourage links with young entrepreneurs in the Caribbean and across the Commonwealth.
My Lords, at the UK-Caribbean Ministerial Forum in June, both sides committed to bringing together young leaders in business, entrepreneurship, civil society and academia. In 2014, our support for the Caribbean has included progressing scholarship programmes between higher education institutions and the UK, and enhancing regional competitiveness and enterprise innovation. In the wider Commonwealth, the range of UK programmes includes supporting a social entrepreneurship programme for young women in India.
I thank my noble friend for that encouraging Answer. As part of her Diamond Jubilee, Her Majesty created the Queen’s Young Leaders Award. Part of that programme is to discover, develop and nurture young entrepreneurs across the Commonwealth, which is wonderful. However, more opportunities are needed for young entrepreneurs, especially in the Caribbean. What are the Government doing to encourage links between business schools here in Britain and those in the Caribbean? How much priority does DfID give to encouraging entrepreneurship in the Caribbean?
My Lords, it is not just a question of DfID programmes: there are also UKTI programmes and British Council programmes. The British Council is concerned particularly with a creative young entrepreneurs’ programme, which covers the Caribbean as well as some other areas. It is clearly the sort of area where services and new industries can develop.

Lords ChamberMy Lords, I, too, express my heartfelt thanks to my noble friend Lady Scott for securing this important debate and for her excellent opening speech. The voluntary sector has a unique role in reaching out to every area in society—to the most disadvantaged and vulnerable groups—as well as in funding vital medical research. I should like to highlight the voluntary contribution made by three of the numerous charities with which I have been involved over many years, so I declare an interest.
First, I would like to draw attention to Sparks. Last year, medical research charities invested more than £1 billion in the UK. That has had a considerable impact on patient well-being, has brought huge economic benefits and has attracted industry investment. The UK is a centre of excellence for paediatric research and the world’s brightest young scientists come here because of our long-term investment in child health. Sparks, now in its 21st year, is one such medical research charity. It is dedicated to funding medical research into all conditions that affect babies and children, helping to improve quality of their lives and giving families hope when they think there is none. It is the biggest UK funder of paediatric research—ground-breaking research which has the potential to have a global impact, such as research on body cooling, now used as NHS standard treatment to prevent brain damage in babies born deprived of oxygen and at risk of lifelong disability. That is probably the most important advance in neonatal intensive care for babies in the last decade. Sparks’s legacy and contribution to child health is truly significant.
Scientific research needs to continue but there is a decline in young people studying science, so what are the Government doing to ensure that our schools and universities are preparing our children to be the scientists of tomorrow?
During debate on the then Health and Social Care Bill, it was stated that the voluntary sector would be relied on for crucial developments that the NHS and public health faced over coming years. The Sickle Cell Society does just that, by helping to articulate the concerns of people living and struggling with that disease. Even though the Sickle Cell Society community hub was commended, its application for Section 64 funding was turned down, despite the potential for inequality that will arise when the specialist commissioning takes effect. Its proposals would have ensured that the interests of people affected by sickle cell disease continued to be counted. The Sickle Cell Society, its clients and the wider BME communities are concerned about that situation, and I ask the Government to meet interested parties to discuss how the society can continue to support its important work within the framework of the appropriate NHS Commissioning Board authorities.
Although local authorities provide many excellent services, the voluntary sector can offer a number of advantages as it operates with greater independence, which means that it can co-ordinate support from a variety of agencies to get the whole family the help that they need, and can reduce excess bureaucracy. Barnardo’s has done just that for decades. Last year, it helped over 190,000 children, young people and their families in over 800 services, including young people in care, those not in education or training and children of prisoners. Barnardo’s also lobbies and campaigns on behalf of disadvantaged young people, and its evidence feeds into government policy-making. It has secured numerous changes in England, Scotland and Wales, such as to retain savings accounts for children in care. Through its Cut Them Free campaign, in which 103 local authorities have signed up to tackle the evil practice of child sexual exploitation in their areas, it has secured a government publication—a national action plan—on the topic, which is long overdue.
The voluntary sector faces problems due to public sector cuts, but the Government could take a number of steps to support it even in times of austerity. One way is through local authorities’ procurement processes, as they often fail to engage potential suppliers in pre-procurement talks. I ask the Government to consider a standardised application process, which would reduce repetitive procedure and save potential suppliers large amounts of time and money. I also ask them to put together a list of preferred suppliers for certain themes of work.
Another problem is the lag time inherent in payment by results, which could mean six months before payment starts, making it difficult for charities to compete in the private sector for contracts. That means that charitable assets face a high risk. Will the Government explore the use of staged payment schedules to reduce the risk that charities are exposed to and reward achievements and outcomes, especially when working with the most vulnerable?
We must treasure and preserve our voluntary sector, and support the valuable contribution that it makes to our society. As a country, we have a rich tradition of giving and volunteering, and in times of hardship and financial turmoil it is often the only source of help and respite for those in difficulty. Let us ensure that our policies help rather than hinder our voluntary organisations.

Lords ChamberMy Lords, if the ghost of Spencer Perceval was to pass through this Chamber today, surely the question he would ask is, “Why, 200 years after my assassination, are not just slavery but discrimination and racism so rampant, and what is being done to eradicate them from society?” In honour of Spencer Perceval, therefore, will my noble friend tell the House how determined the Government are to completely wipe out this evil practice that affects certain parts of our society today who feel excluded?
My Lords, it might be beyond the capacity of government in an open society completely to eradicate all forms of prejudice. The Government are actively aware of the problems of the trafficking of women and children. Going around Yorkshire, I am aware that one of the things that the police come across, for example, is Vietnamese children trafficked into Britain to tend illegal cannabis factories. The trafficking of Nigerian children is also a problem. We are working closely with the authorities in a number of other countries. The Government and the relevant agencies have close liaison with their Chinese opposite numbers to combat Chinese people-smuggling. We are working as actively as we can.

Lords ChamberMy Lords, I thank my noble friend for securing this extremely important debate and I look forward with great interest to hearing my noble friend Lord Gold’s maiden speech.
Transparency and accountability are vital when companies are in receipt of public funding. The creative industries receive public funds in the form of grants: theatres, museums and art galleries receive funds from the Arts Council, and investment in films comes from the BFI. The commercial broadcasters obtain their revenue on the basis of lucrative licences awarded by Ofcom. Therefore, it is reasonable that the public should be entitled to expect these organisations to be accountable and transparent in all areas, including their equality and diversity policies, and to expect the funders and regulators to enforce this transparency on their behalf.
Unfortunately, they have fallen short on this. The Arts Council requires equality monitoring of the funding recipients but keeps the results secret, as does Ofcom of the companies which have been granted licences. Both merely publish sector-wide summaries. Before the BFI took over, the UK Film Council required equality monitoring of applicants for funding but did not require or collect data for productions when they went ahead. All that means that the public cannot find out what progress has been made in our creative industries regarding diversity and equality.
All major political parties recognise that the influence of broadcasting on society is so great that it should have higher standards with regard to equality and transparency, and be held to greater account. There is separate legislation covering the BBC and all parties in government have ensured that the BBC continues to have a strong equality and diversity remit. Previous Governments also ensured that the same practice applied to commercial broadcasting. The Broadcasting Act 1990, which established the Independent Television Commission to regulate commercial terrestrial television, includes Clause 38 which states:
“Any Channel 3 licence or licence to provide Channel 4 or Channel 5 shall include conditions requiring the licence holder … to make arrangements for promoting, in relation to employment … equality of opportunity between men and women and … persons of different racial groups”.
This clause was expanded to include disability in the subsequent Broadcasting Act 1996.
The ITC included in every licence a contractual obligation to carry out equality monitoring of staff and management, and this data was published annually. The public was able to see how well the licence holders were reflecting the diversity of the audiences they served and allowed those broadcasters who were making good progress to be congratulated.
The Communications Act 2003 extended this clause across cable, satellite and radio, and provided transparency and accountability on equality and diversity across commercial broadcasting. But in 2005, Ofcom, the successor to the ITC, decided that it would no longer enforce this clause. It chose instead to encourage “a climate of compliance” and concluded that allowing the public to see the licence holders’ equality monitoring data might discourage broadcasters from sending it in. This move clearly set back diversity and equality in commercial broadcasting. The 2009 report on equal opportunities published by Ofcom showed that the employment of women and people from culturally diverse backgrounds fell and that 16 companies had no information on whether any of their workforces had a disability.
There have been suggestions that the Equality Act 2010 on its own is sufficient to cover the broadcasters and that Ofcom should have no role with regard to promoting equality among the licence holders it regulates. But the Equality Act places no greater responsibilities on broadcasters than any other industry in the private sector and will not ensure the level of transparency that is absolutely essential in our extremely influential broadcasting sector.
The coalition Government have made clear that equality in employment is a priority. They have said:
“We need concerted government action to tear down these barriers and … build a fairer society”.
It also set out several clear commitments to transparency, such as:
“We will create a new ‘right to data’ so that government-held datasets can be requested and used by the public, and then published on a regular basis”.
The Secretary of State, Jeremy Hunt, has made statements in favour of transparency and accountability for what is spent on behalf of taxpayers.
The Prime Minister, David Cameron, said:
“For too long those in power made decisions behind closed doors, released information behind a veil of jargon and denied people the power to hold them to account. This coalition is driving a wrecking ball through that culture—and it’s called transparency”.
The Government’s commitment to equality and transparency should mean that all public bodies, including regulatory bodies, should be doing all that they can to promote equality and diversity, rather than taking the view that it is not their responsibility.
I believe a simple amendment to Section 27 of the Communications Act, to clarify what steps the regulator should take to promote equality of opportunity in employment by those providing broadcasting services, would demonstrate how well the mainstream media is succeeding in reflecting diversity and equality. For several years, the broadcasters have sent this data in for each qualifying licence, so this is not an additional proposal. This approach costs virtually nothing and will permit the greater accountability and transparency that has been lacking for the last six years. I urge the Government to take note of this suggestion. It will send a positive signal to young people from diverse cultures, who often feel excluded, that the coalition Government understand the additional pressures that they face, and are determined to insure that their voices are heard in the public sphere.
I ask my noble friend the Minister whether the Government will ensure that organisations which receive public funding, or are in receipt of licences, are made to publish data fully demonstrating their commitment to transparency and accountability in the areas of equality and diversity.

Lords ChamberMy Lords, I, too, thank my noble friend for securing this debate. There is no better feeling than going to sleep at night knowing that you have done something unconditionally to make life better for your fellow human beings. While volunteering is lacking in many communities the concept of the big society, implemented inclusively, is a way to encourage those who perhaps had never thought about social action.
I believe it is young people who will play a vital role in building a better society because of their energy, instinctive optimism and compassion. I visit schools to speak to children and young people about caring for each other and about the philosophy of contentment and real happiness. It never ceases to amaze me how, through their schools and clubs, they do tremendous fundraising and charitable work. It is clear to see that they get a huge amount of pride and satisfaction out of it. Once given the opportunity to do something constructive, they instinctively embrace the concept of the big society. This therefore needs to be encouraged so that society does not lose out on this rich resource.
Many adults who want to play their part by volunteering their time and expertise to inspire and motivate children and young people are often hampered by the cumbersome and expensive system of CRB checking. However, there are those who fear that if the CRB checks are relaxed it will endanger vulnerable children. Abusers are within the school gates as well as outside. How is the Minister proposing to improve the CRB checking system while making it more robust, effective and less costly? I am an advocate of extended learning, teaching youngsters basic life skills as well as how society works. What measures are being put in place in the national curriculum to ensure that young people are fully aware of their responsibility to society?
Also, what is being done for the many young people from minority communities who feel alienated and excluded from society, and do not feel the incentive or desire to participate in the national citizen services? Meanwhile, those from disadvantaged backgrounds, where the benefit culture is generational and the concept of contributing to society is difficult for them to grasp, need positive role models to give them inspiration and aspiration. Once again, what is being done to encourage more social action in deprived areas among those who have taken to a life reliant on the state and a drug and gang culture?
