Commons ChamberI thank the right hon. Member for his questions, which are serious and important, as one would expect. Let me start by pointing out that until 1992, this relief did not exist. The system has existed before and people have operated differently, although I accept it has been different for the past 30 years.
Turning to the figures, I encourage people to reach for the detail—to look at the actual figures. The only thing we can go on is the claims, and the figures coming from the Treasury on claims for the last year available absolutely reflect that 73% figure. The right hon. Gentleman raises an important point about the ringfence; that point is under discussion, but I have made assurances that the devolved Administrations will be closely informed about, and involved in, what happens. These are important points, and they should be treated seriously.
I do not really care for the high-profile voices that we have got attacking a Labour Government, but I do care about the family farms in my constituency. I know that the Minister cares for those farms as well, as does the Prime Minister. I welcome the figures we have been given. However, those figures do need to be translated to our family farmers; they need to see what it is like on the ground. I would welcome a meeting with NFU Cymru and the Minister to discuss what things are going to look like for farmers, especially in Gower and the rest of Wales, where there is a completely different landscape.
I thank my hon. Friend for her contribution. Can I say how much I enjoyed visiting Wales, with the Welsh Minister, very early in my tenure? It was an important sign from this Government that we take farming seriously across the entire United Kingdom.
I share my hon. Friend’s very strong points about the importance of the family farm. What we are doing here is protecting the family farm. I have visited right around the country over the past five years, and on almost every visit, people have told me that they are concerned about people coming from outside—they often say “up London” or “down London”—with a lot of money and buying up local farmland over the heads of local people, not because they care about farming but to use that farmland for tax evasion purposes. This policy can be helpful to family farms and protect them against—[Interruption.] The hon. Gentleman on the Opposition Front Bench says from a sedentary position that it will not, but it is people from his area who have been telling me about these problems. They repeated them constantly when we were in opposition, and here are a Labour Government doing something about it.

Commons ChamberIt is always a pleasure, of course, to gaze at you, Mr Speaker, rather than elsewhere in the Chamber.
The right hon. Gentleman makes an important point. The point of the commission is to identify ways in which we can strengthen regulation and operations so that we can bring in the investment, clean up our water sector once and for all, and reduce and remove the pollution that is destroying so many beautiful rivers, including those in his constituency.
I congratulate the Secretary of State on the commission that has been set up today—it is absolutely fantastic. Gower was the first area of outstanding natural beauty in the whole of the United Kingdom, and the bathing waters there are second to none, but some of them are less so. I would like to highlight a campaign I have set up to test the bathing water in the winter season, with my constituents, local business and the Gower Society, because data is key—it is what will drive the improvement of our bathing water. Will he congratulate Surfers Against Sewage, which has been really supportive, and everybody in my constituency who is taking part and taking control?
My hon. Friend represents an incredibly beautiful part of the country in the Gower, and her constituents and the many people who visit those beauty spots will want to know that their children can enjoy the water without risk of contamination from polluted water. Of course I congratulate Surfers Against Sewage and the many campaigners who have pushed for reform. They will be invited to participate in the work of the commission—they have huge expertise. I hope that, before long, her constituents who are testing the quality of the water will start to see improvements until it is pure and crystal clear, as it should always have been.

Commons ChamberWork is going on across the criminal justice system to drive up prosecution levels. In the Gower, charges of adult rape suspects have increased dramatically in the past year. The Solicitor General and I recently visited CPS South Wales to discuss its future plans.
The Jade’s law campaign is gathering more supporters with each passing day, united in our belief that a man such as Russell Marsh should have no say over the future of his children, whose mother he so viciously murdered. Will the Attorney General engage in a serious and sympathetic discussion with her colleagues in the Ministry of Justice about how we can make Jade’s law a reality?
While I always enjoy my discussions with the hon. Lady, I am afraid that I am not a Minister in the Ministry of Justice. I am happy to pass on her points to those Ministers. The Attorney General’s Office stays completely separate and independent of the Ministry of Justice, and it is important that we maintain that.

Commons ChamberThe fundamental principle of food labelling rules is that information provided to consumers must not mislead. Based on evidence provided from a 2021 call for evidence on food labelling for animal welfare, we are still considering how to move forward.
My first rescue dog was from the Dogs Trust, which is a very important charity. On animal welfare, the hon. Lady will be aware of our good record, including Bills that have been going through this place. Business managers are aware of the manifesto commitments that we want to fulfil, and they are in charge of scheduling Government business. The Leader of the House will announce business in the usual way.

Commons ChamberThe wellbeing of farmers in my constituency is a priority, and I work closely with the NFU and other organisations. Last week, I was fortunate enough to go to Swansea Museum, where there is an exhibition called, “Stories of a Changing Landscape”. It is hoped that the exhibition will create a point of connection for agricultural workers who are struggling with their mental health and with the issues with which years and generations have suffered. They are the people who feed our country. Will the Minister join me in congratulating Councillor Andrew Stevens, and the DPJ Foundation and Kate Miles, and in supporting them in the future? We need to prioritise our farmers’ wellbeing to keep them feeding the nation.
I of course join the hon. Lady in congratulating Andrew Stevens, and all the charities doing work in the sector. Farmers work long hours and are often isolated and do not have opportunities to speak to other people. Those charities working with the sector are doing great work, but we all have a responsibility to try to help and support colleagues across our society.

It is a pleasure to serve under your chairship, Mr Paisley, and it is an honour to be leading the debate on behalf of the Petitions Committee. The petition calls for an outright ban on water companies discharging raw sewage into watercourses. Personally, I think a lot of our constituents will be shocked to hear that it is currently legal for water companies to do this. How can it be okay for multimillion-pound businesses to absolve themselves of the responsibility for ensuring that our rivers and streams, and ultimately our seas, are free of harmful sewage?
I pay tribute to Ferry Harmer, who started the petition after seeing Feargal Sharkey raise some of the issues around the state of our rivers on the TV programme “Mortimer & Whitehouse: Gone Fishing” last year. I also thank the 111,434 people from around the UK who have taken the time to sign the petition, especially the 186 people from Gower who have signed it. I have had nearly 150 constituents get in touch with me about this issue in one way or another. That demonstrates the strength of feeling about this issue, which has featured recently in the news. When I spoke to Ferry, it was clear he is a man of real passion and determination. He spoke about the petition and told me that 41% of fish species are in decline in British waters. A third of species are in serious decline, including iconic fish such as salmon and trout.
Through my research, I have discovered astounding facts about the state of our rivers and waterways. Some 39 million tonnes of sewage were discharged into the River Thames alone in 2019—that is one river in one year. Last year, raw sewage was discharged into our waters more than 400,000 times, which is quite an incredible figure. This has now become an emergency for our waterways. Not a single river in England is in a healthy condition, not a single river meets a good chemical standard, and over 85% do not meet good ecological standards. Frankly, it is not good enough.
I am fortunate to represent arguably the best coastal community in the UK. The coast around Gower is popular all year round with families and tourists, and a growing number of local wild swimming groups took off during lockdown. It is the only contact that people have with the outside world, and it has been a saviour for so many people. The well-known Mermaids and other groups know that Gower has some of the best surfing in the UK. I will do anything I can to protect our vital ecosystem, seafood production economy and thriving tourist economy. I know that this is a devolved matter, but as I noted in a recent Environment, Food and Rural Affairs Question Time, this a UK-wide issue. What work is the Minister doing alongside the devolved Administrations, and what commitment can she give to do so, because these waterways, whether in England, Wales or Scotland, are all intertwined and all end up somewhere?
If sewage goes into our rivers and waterways, it will ultimately make its way to the sea, and even into our food chain through seafood and fish. I know we are all supposed to encourage recycling, but even I think that is going a little too far. The Government are failing in their duty of care here. The state of our waterways has not improved since 2016, despite ministerial claims that they are cleaning up their act. What is even worse, the unlawful discharge of sewage could be up to 10 times higher than the rate of prosecutions by the Environment Agency. The Environment Agency is responsible for monitoring and enforcement of water quality breaches, but it has fallen foul of the Government’s cuts; its funding has been slashed by 63% since 2010. Simple measures such as the number of points at which samples are collected have been cut by more than 40%. How can we continue to monitor the health of our rivers if less data is collected?
The Government’s response to the petition mentions that
“water companies have agreed to make available real-time data on sewage discharges from storm overflows at designated bathing waters all year round from this year. This data will be made available to help surfers, swimmers and other recreational water users to check the latest information and make informed choices on where to swim.”
Who does not want to check the amount of human waste, used sanitary products and anything else people have flushed into the water before they go for a swim? That is not a delightful thought. Let us not forget the words of the then Secretary of State for Environment, Food and Rural Affairs, the right hon. Member for Surrey Heath (Michael Gove), who back in 2018 told the Environmental Audit Committee that divergence from tough EU rules would be an opportunity for the UK Government to implement unquestionably tougher restrictions. He said that
“being different can sometimes mean being better”,
and that leavers did not automatically advocate for divergence out of a desire to lower standards. However, owing to Brexit, we have seen a shortage of heavy goods vehicle drivers and an increase in red tape, which has led to chemicals not being available to fully treat wastewater before it is discharged. What is more, the Government have granted permissions for the discharges to take place.
I am not here only to outline the increasing problems that the Government are exacerbating, because I have received suggestions of things that the Government could put into place to reverse some of the damage. To clean up our waterways, we need a fully funded and resourced action plan. We need targets for water companies and serious consequences when they break the rules. One way of doing that is to increase the environmental reporting requirement for water companies. I call on the Government to improve their plan to introduce annual reports, such as by making them quarterly reports. With more regular reporting and a system that allows for this, we can see where there are problem areas and react much more efficiently.
Does my hon. Friend also think there should be a requirement on water companies to report that information to their consumers, perhaps in the form of formal consumer committees of each water company, so that that company is more likely to be held to account by the very consumers who suffer from this dumping of sewage?
That is key. Accountability is needed. If we are to move forward, those consumer committees that my hon. Friend speaks of are exactly what we need: a practical solution in order to move forward.
I welcome the Government’s commitment to introduce measures to reduce sewage discharge from storm overflows, but unfortunately this does not go far enough. The Government must eliminate sewage discharges. That is why Labour voted in favour of the Duke of Wellington’s amendment calling for exactly that. The Government’s aim of publishing a plan on this by September 2022 is just not good enough. Let us have that plan in place early next year. This has been dragging on for far too long, and there is no reason why we cannot have a strategy sooner.
If Ministers are serious about reaching the targets for cleaning our rivers, lakes, streams and seas, they must have a fully-resourced action plan for monitoring water quality and holding companies to account. However, there are also high-tech solutions that could be employed immediately. Ferry mentioned a system called HYBACS—hybrid activated sludge process—which does not sound absolutely delightful, but is cheaper and more effective than the system that companies are currently using. That sounds like a pretty obvious thing for the water companies to put in place. Where there are capital expenditure issues, it must fall to the Government to ultimately step in and protect the waterways. Natural mitigations can also provide solutions to this problem: reintroducing beavers, building more reservoirs and increasing tree and hedgerow planting.
The Minister has plenty to answer from my contribution, but I would also like to know how many water companies have been fined by the Environment Agency. How much have they been fined? When did the Minister last meet with the Environment Agency to discuss this?
I bring my contribution to a close by asking the Government to be bold in doing the right thing and getting our rivers and streams cleaned up. They should listen to the advice of experts: beef up the Environment Agency’s powers and keep pushing water companies to take responsibility, not just for those who signed the petition, but for everybody living in the United Kingdom.
So I am not going to take an intervention on that.
I will also say that the issue is devolved. I thank the hon. Member for Gower (Tonia Antoniazzi) for introducing the debate. As she knows, it is for individual Governments to have their own powers, although Wales joins a great many of the powers in the Act.
I am leading the debate on behalf of the Petitions Committee, but it is a UK-wide issue, which I hope the Minister will work with the devolved nations to address.
I thank the hon. Lady for that; we are at pains to work with the devolved Administrations, because water does not have boundaries. I increasingly want to do exactly that, so I hand out an offer to do more. On misinformation, although I am not defending the quality of our rivers, it is comparable to that of rivers in densely populated areas of Europe.
The storm overflows system is an old Victorian plumbing system, which in many cases is not fit for purpose given our growing population, climate change and the frequent heavy extreme weather incidents that we are getting. Many hon. Members have made reference to the fact that the whole system needs improving.
I have been clear that storm sewage overflows, which are supposed to be for emergency use, are used far too frequently, which is absolutely unacceptable. I have said that frequently. We are the first Government to take decisive action on storm overflows through the Environment Act. I established the storm overflows taskforce to look into the issue and to inform us. I thank my hon. Friend the Member for Keighley (Robbie Moore), who did great work on the Bill Committee, for recognising that.
The petition calls for the elimination of storm overflows, which is a commendable ambition.

Commons ChamberI have been absolutely crystal clear that the amount of sewage discharged by water companies into our rivers is unacceptable. We have our Environment Bill and our strategic policy statement which, for the very first time by any Government, directs the regulator to ensure that water companies tackle sewage discharges, so we are right on it. We have strengthened the Environment Bill to get a new duty on water companies to progressively reduce discharges. Last week, we voted through six pages of measures to stop raw sewage going into our watercourses.
Despite bizarre assurances that the Government have been working on their U-turn for weeks, it was the public outcry about sewage being pumped into waterways that forced a change of mind by the Government. In Gower, the number of people enjoying the sea and swimming in Caswell bay and Langland bay has increased, as many Members know, especially during covid. What work is the Minister doing to work with devolved Governments to ensure that the whole United Kingdom is protected for people to swim and enjoy?
Yes, it is a beautiful part of the world. We have to remember that water issues are devolved, so water companies are working in their own ways, but it is absolutely right that they need to work together across our borders. We are at pains to make that clear. Indeed, there were measures in the Environment Bill to highlight the fact that partnership working is so important. All the measures in the Bill will make a significant difference to any of this pollution going into the river. I remind her that a fifth of the pollution is from sewage, but four fifths is from agricultural pollution and waste treatment works. We are also working on very strong measures on this issue, not only through the Environment Bill, but through the farming rules for water.

It is an honour to serve under your chairship, Mr Hosie, and I thank the hon. Member for North Devon (Selaine Saxby) for securing and leading this important debate to consider World Oceans Day.
I am the Member of Parliament for Gower, and I am very proud of the Gower peninsula and all it has to offer. A precious and diverse seabed surrounds the peninsula—we must consider that on World Oceans Day, and work with our fishing industry—and the Gower constituency is renowned for its salt marshes, its cockle beds and its environment.
When we talk about plastics pollution, it is important to consider the many organisations that help to keep our beaches and our seabeds clean, as well individuals, such as young Sonny in my constituency, and community groups such as Pennard Community Council, which go out and keep their precious areas clean. They are to be commended for their hard work, but the Welsh Labour Government are also to be commended, because it is so important that we work together across the four nations to protect our seabeds. The UK marine strategy is already backed up by secondary legislation and works across all four nations; however, in its current state, it is no longer fit for purpose. There is a focus on indicators rather than action, and insufficient accounting for the increase in the effects of climate change on our seas. This year, the United Kingdom has a prime opportunity to set a new mandate for our marine strategy: to restore and safeguard declining coastal ecosystems and to demonstrate global leadership in ocean recovery.
I, along with many other politicians, support the OceanHero programme: it was really important that we were there to speak to the World Wild Fund for Nature about the problems that we have on our seabeds. We have to take control now, and understand that we have to change to move forward. “The Blue Planet”, as many have mentioned, was an eye-opener for so many people, sitting in their armchairs and watching the world around us. We have to look after our seabeds, and I totally support what the hon. Member for North Devon has said in today’s debate. I will draw to a close and say thank you very much, Chair.

Friends the Members for Cardiff West (Kevin Brennan), for Eltham (Clive Efford), for Feltham and Heston (Seema Malhotra), for Brentford and Isleworth (Ruth Cadbury), for Gower (Tonia Antoniazzi), for Pontypridd (Alex Davies-Jones), for Neath (Christina Rees), for Oxford East (Anneliese Dodds), for Ealing, Southall (Mr Sharma), for Denton and Reddish (Andrew Gwynne) and for Canterbury (Rosie Duffield); and my right hon. and learned Friend the Member for Camberwell and Peckham (Ms Harman). I give a massive vote of thanks to my hon. Friend the Member for Southampton, Test (Dr Whitehead) for his work on the early stages of the Bill and for all his work to challenge the outdated and unambitious approach of this Government to the future of our planet.
Here we are, back in the House and back discussing the Environment Bill and, I hope, setting out a clear plan to preserve our environment and protect our planet. We are in the middle of a climate and ecological emergency. I know that the Minister knows it, and so do the people of this country, but this climate emergency is no surprise to any of us and did not start yesterday. That is why I remain disappointed that the Tories have voted against every single Labour amendment in Committee and on day 1 on Report. I fear they will do the same today—although, of course, I am happy for the Minister to prove me wrong.
Today has been a long time coming, and I know that many stakeholders, campaigners and people up and down England will be pleased that we are finally here discussing the Environment Bill and looking to make it fit for purpose. Many stakeholders and campaigners will want to see less party politics and more environmental politics in this debate and throughout the Bill’s remaining stages before it moves into the capable hands of our colleagues in the other place.
A person does not need to be a green-fingered disciple of Alan Titchmarsh or an animal-loving admirer of Sir David Attenborough to know that wildlife in Britain is on a downward spiral. We are in a period of crisis that demands real action, not empty words.
I thank my hon. Friend for all the work that she and her team do on these issues. Does she agree that the Minister would do well to look to Wales to see what a bold, ambitious and committed Labour Government can do to protect the environment and preserve our planet?
I do agree with my hon. Friend: Wales is leading the way and I urge the Minister to seek meetings with the First Minister of Wales and his Environment Minister Lesley Griffiths as soon as possible, so that lessons can be learned and rolled over to England.
As we heard in the previous debate, we have seen 44% of species decline over the past 10 years—and that was on the Minister’s and her party’s watch. Now that we have left the European Union, it is vital that we seek to maintain the highest of environmental standards. That is the approach that the shadow Secretary of State—my hon. Friend the Member for Plymouth, Sutton and Devonport—and my colleagues and I in the shadow DEFRA team have taken to this Bill, from Second Reading through to Committee and to today’s Report and remaining stages. We have proposed fair, balanced and necessary amendments, all of which were defeated by this Government. Not one of them was partisan, and not one of them was done to play games. All were done to make this Bill fit for purpose, and our new clauses 12 and 24 do just that. They are balanced and they are fair, and they reflect the will out there of those in communities across England who want an Environment Bill that will preserve our planet and protect our environment.
That brings me on to another opportunity the Government have missed with this Bill. This Bill, this debate today and this moment were the Government’s chance to tell the fracking companies, “Your time is up”, but given the choice between doing something bold and doing nothing at all, we know what DEFRA under this Secretary of State always goes for.
My position and that of the shadow Secretary of State and the Opposition is clear: fossil fuels need to stay in the ground. This is doubly true when we take into account just how damaging fracking is for our environment. When a third of England’s drinking supply is in the groundwater, do we really want to engage in a risky industry that could poison it for good? Even more disturbingly, fracking is causing earthquakes of up to 2.9 on the Richter scale.
In our recovery from covid, we need to focus on creating good green jobs for the future. Fracking is not green and it does not create jobs. According to the fracking company Cuadrilla’s licence application in Lancashire, for example, just 11 jobs will be created across two sites—just 11. Labour MPs up and down the country are standing up for their areas in opposing this. I want to give a special mention to my hon. Friend the Member for Lancaster and Fleetwood (Cat Smith), who has done so much work in this area, and I commend her for all she does. Now is the time to join France, Germany, Ireland, Bulgaria, the Netherlands, Scotland and, of course, Wales, and put this destructive industry to bed once and for all.

Commons ChamberAs well as seeking to unblock this problem with the Commission and resume the trade, which is obviously our first and most important objective, we are considering other options and other interventions to help the industry to adapt should the EU permanently change its position.
Does the Secretary of State have any idea of the devastating financial impact that the ban is going to have on historic cockling communities such as Penclawdd in Gower? What conversations has he been having with the Welsh Government to ensure that the fisheries disruption fund reaches Penclawdd?
As I said in my opening remarks, we realise that this situation is devastating for many sections of the mollusc industry. We recognise that a large proportion of bivalve molluscs—in some cases up to 80%—are exported, which is why we are working so hard to get the Commission to revisit its decision. We have indeed had conversations about the fisheries disruption fund. It is a UK-wide scheme and will be open to anybody, including those from Wales, who attempted to export and ran into difficulties.
