On a point of order, Mr Speaker. This debate is obviously of extreme importance and it is vital that Members are able to hear the speeches, particularly those made by the proponents of the different motions. There is obviously a disturbance in the Gallery, and whatever the rights and wrongs of that protest, I am sure you would agree that we need to ensure that people can be heard in the debate and that the situation in the Gallery is appropriately handled so that we can proceed with our debate today.

My right hon. Friend makes an important point, but there would be a profound effect as a result of the rejection of this SI, and I shall come to that later in my speech. It is important to state that, were we to reject this SI, it would leave the UK statute book in a mess, so I do not think that is a good course of action.

The Minister referred a moment ago to the House passing the withdrawal agreement by this week. We obviously heard Mr Speaker’s ruling earlier and rumours abound that the Government intend to introduce the withdrawal and implementation Bill on Friday. Could he confirm whether that is correct and whether it would have any provisions to alter section 13 of the European Union (Withdrawal) Act 2018, which is of course intimately tied up with this statutory instrument?

It will be a matter for the Leader of the House to announce business, not for me. I heard, as I am sure the whole Government heard, the Speaker’s ruling. We take careful note of what the Speaker says and of course we will act with due respect to that. However, I hope that the House has the opportunity to consider the only withdrawal agreement that has been negotiated and agreed to by the EU.

Well, I do wonder whether the hon. Lady is describing her own Front Benchers’ policy, because they have put forward a proposal that the House has rejected and yet seem to be intent on still putting forward the same policy. From speaking to EU leaders, as I know the right hon. and learned Member for Holborn and St Pancras will have done, what consistently comes across from senior figures in the EU is that the proposal put forward by the Leader of the Opposition is simply not credible. For example, he thinks that he can retain control over state aid and that he can have a say on EU trade deals. These are things that are simply not on offer.

The Secretary of State seems somehow to be surprised that the House has been asking urgent questions today, has been seeking this debate, and has been subjecting the Prime Minister to scrutiny. This is the greatest crisis that this country has faced since Suez. Countries around the world are looking at us, our international reputation in tatters. Our businesses are losing jobs and investment day by day, and we are peeing millions of pounds down the drain that could have been spent on our public services. And he wonders why this House is asking questions. It is absurd.

With respect to the hon. Gentleman, that was not the point I was making. Of course it is quite right that the House asks questions. Mr Speaker, you have always personally championed the House asking questions—indeed, urgent questions are something in which I think, quite rightly, you take much pride. But the point that the hon. Gentleman is not addressing is that people around the world also look to this country to respect its democracy. They say that this House gave the people the decision. Indeed, the Government of the day wrote that we would honour that decision, but—[Interruption.] He chunters from a sedentary position, but what is damaging to our reputation around the world is a sense of our asking the people for a decision and then not acting on it.

I am very happy to clarify: what I was referring to was the amendable motion that the Government have committed to. I refer back to the remarks of the Chancellor of the Duchy of Lancaster, who made that commitment on the record in Hansard.

Three years after the country voted to leave, Parliament continues to debate the manner in which we should leave, while some, having stood on a manifesto to respect the result, work tirelessly to frustrate that decision. I am sorry to interrupt, Mr Speaker, but I am afraid that I am not satisfied with what the Secretary of State says. Given its importance in relation to next week’s business, I wonder whether it is possible to check with the Official Reporters of Hansard what the Secretary of State actually said. He has said lots of different things at the Dispatch Box before and left the House in confusion, and all sorts of rumours are swirling around about what is happening on Monday.

It would be difficult to get it immediately, although those who take down verbatim what is said in this House work extremely skilfully and conscientiously, so it is reasonable to expect that what was said will wing its way to the Chair before very long. Moreover, if the Secretary of State in any sense misspoke, it is open to him to clarify what he meant.

On a point of order, Madam Deputy Speaker. I am sorry to make a point of order before the start of the next debate, but during the vote, the Leader of the House walked into the Chamber and shouted angrily at me, jabbing her finger, saying that she deserved an apology from me because I, alongside other Members of all parties, had raised concerns about her comments on LGBT education earlier today. Do you think that it is appropriate for the Leader of the House to shout and jab her finger at another Member rather than raising the matter in private in an appropriate way, given that she is responsible for tackling bullying and for conduct in this House?

Businesses and our constituents will be looking on at this farce in horror. The Minister is either unable to answer questions or gives contradictory answers, upsetting everyone on both sides of the House. He referred to your statement, Mr Speaker, and said that he still thinks that there is a slim chance that the meaningful vote could go through. Is that because, as the Leader of the House has been muttering in the corridors, the Government intend to try to suspend the Standing Orders to get the vote through, despite what you have said?

The Prime Minister and the Chancellor of the Duchy of Lancaster both made it clear that the Government would bring forward legislation to implement any extension to article 50 and that the date would be amendable, so will the Minister explain how it will be amendable?

I am unsure what the hon. Gentleman is referring to as being amendable. The motion will or may well be amendable with respect to—[Interruption.] A motion on 25 March will be amendable if we have another vote, but my understanding is that the SI will not be amendable.

With respect to conversations that the Leader of the House may or may not have had, I have no idea what she has been saying in the corridors. I have been in the Chamber for most of the day.

I will make some progress and then take further interventions.

The withdrawal agreement is the same document that was before the House when the Prime Minister announced that she was postponing the vote. It is the proposition that she said she thought would be defeated by a significant margin. No changes have been made either to the 585-page, legally binding withdrawal agreement or to the incredibly vague political declaration. There is no new text for this House to consider.

Some of us expected the Prime Minister to make a statement on Monday to tell the House what had happened while we were in recess, to update us on any meetings or discussions that she may have had—we read about them in the press—and to say whether anything had changed. She did not come to make a statement. The Brexit Secretary handled an urgent question, the central thrust of which was about what progress had been made and what changes there had been. The Brexit Secretary defended his position with a smile, attacking the Opposition, as he always does, by asking, “What’s your proposition?” while ignoring the fact that we are voting on the withdrawal agreement, not on what anyone else is saying. He smiled, attacked the Opposition and swerved challenges, but he did not answer the question, and the reason why is that there has been no meaningful change.

I will just make this point and then give way.

I was here for Prime Minister’s questions today, and I carefully noted what the Prime Minister said in answer to the first question from my right hon. Friend the Leader of the Opposition. First, she said that the changes that she is now relying on are the results of the December European Council summit, at which the EU agreed that it would use “its best endeavours” to secure the future relationship as quickly as possible. What else could it say? Of course, we would hope that it would do that. However, the EU also said at the same summit that the withdrawal agreement cannot be renegotiated, so that does not take us very far.

Secondly, the Prime Minister said that further clarifications might be “possible” by Tuesday, so we are in exactly the same position as we were on 10 December, with a hope for possible assurances—there may be something coming.

Thirdly, the Prime Minister referred to the paper on Northern Ireland published this morning, and the Brexit Secretary referred to it, too. Members may not have had the chance to read this 13-page document, but I have read it. I do not dismiss anything that marks a step towards ensuring that the concerns in Northern Ireland and across the whole United Kingdom are addressed, whatever they are, so I am not dismissing this document. However, on my reading—if I am wrong, I will correct this or be corrected—I think I am right in saying that the document does not contain any new commitments. It brings together the unilateral commitments made in other places at other times into one document. I have been going through the document as I have been in the Chamber, so if I am wrong, I will be challenged but, as far as I can see, it just builds on the unilateral commitments in paragraph 50 of the phase 1 joint report document from December 2017 and adds the commitments that the Prime Minister has made in Belfast and other places. I am not saying that those commitments are not important or are without significance. I do not dismiss them, but we need to see the document for what it is, which is a bringing together of existing commitments. The position has not changed between 10 December and today.

The fourth thing that has been relied upon as a change that the House needs to take into account is that it is now said that Parliament will have a role in July 2020 when we must choose whether to apply for an extension of the transition or to go on to the backstop. There are several points about that, one of which is that it does not change the options, and I will develop why I think that those options will have to be exercised. Arguably, it is the logic of the article 50 case in the Supreme Court, certainly if we go on to the backstop, because the whole argument in the Supreme Court was that if we change the rights of individuals in this country as a matter of international law then we have to have a vote in this House, so I am not sure that this is much of a gift or concession from the Government.

The other point is the practical reality, which we have seen today and yesterday: the idea that the Prime Minister or anybody else was going to get away with freezing Parliament out of that decision in July 2020 is misconceived. We were always going to have a say on that, because it is such an important position. So the proposition on the table is not altered. The Brexit Secretary did not answer substantively on Monday because the December summit does not really take us anywhere: further clarifications may be possible but they are still long awaited, the Northern Ireland paper is a bringing together of existing commitments that does not change anything, and Parliament was always going to find a way of having a say in July 2020 as to which option we take.

I concur with my right hon. and learned Friend that nothing has changed. Does he therefore agree that the Prime Minister’s decision to delay was not only wrong, but irresponsible, because on every single day that has gone by during that time we have seen the Treasury spending more and more taxpayers’ money to prepare for a no deal that it says it does not want, businesses cancelling investment plans, and jobs being put at risk? All of that is deeply irresponsible, particularly when nothing has changed.

I agree with that, because if the Prime Minister’s own judgment is right that this deal as it was on 10 December is likely to go down by a significant margin, that brings into sharp focus the role of this House in debating and deciding what happens next, and the more time we have for that, the better. We have just been deprived of 30 days of that because we will not now get on to it, probably, until next week.

I agree with my hon. Friend; there is a very good reason why the backstop is there. It is a reflection of two things. First, it is a reflection of our firm commitments under the Belfast agreement, reflecting the difficult history of Northern Ireland and the violence that the people of Northern Ireland have suffered. Also, Northern Ireland is the one part of the United Kingdom that has a shared geography with Ireland. That is why there are special circumstances and it is why the backstop is required. The reality is that whatever deal is put forward—including any put forward by Labour, if the Leader of the Opposition were to work one out—it would still require a backstop.

Mr Speaker, before I ask my question I should like to draw your attention some further serious events going on outside Parliament today. They include intimidation, threats and potentially unlawful actions targeting Members of this House, members of the press, members of the public and peaceful activists. May I urge you to use your offices to communicate with the Metropolitan police at the highest level to ensure that proper action is taken, as this issue has been repeatedly raised?

I would say to the Secretary of State that there has clearly been no progress in the negotiations or on the Government’s position. There has, however, been progress on spending taxpayers’ money. Will he tell us how much the delay has cost the taxpayer on a daily basis and in total since the Prime Minister decided to delay the meaningful vote?

On the hon. Gentleman’s first point, I have obviously not seen the incidents outside, but anyone who stands at this Dispatch Box is mindful of the plaque commemorating Jo Cox, which I know is so dear to many Members, not only on the Opposition Benches but across the House. I am sure that we would all unite in believing that, wherever we stand in the Brexit debate, all of us in this House should be able to air our views with respect and proportion.

On the hon. Gentleman’s question on spending, the reality is that we do not want to spend money on no deal—[Interruption.] The amount of money for no deal has been set out by the Treasury—that is a matter of public record—but the fact is that those who criticise that spending, which any responsible Government need to allow for, need to explain why they are not backing the deal. It is the fact that people are not backing the deal that is requiring the Government to divert spending to no deal. The best way to avoid spending on no deal is to back the deal and give businesses and citizens the certainty that they need.

I certainly agree that we need the vote as soon as possible, and I really do think it should have been on 11 December—if not then, it should have been this week. To elaborate on the point just made, the only purpose now in deferring the vote until 14 January is to run the clock down, and to attempt to present the vote as a binary choice between the Prime Minister’s deal and no deal.

Does my right hon. and learned Friend agree that it is deeply dangerous to use the sort of scare tactics we saw being briefed out from No. 10 this morning, when it was said that somehow 3,500 troops were going to be put on the street? I asked the Home Secretary repeatedly about that after his own permanent secretary had told me that there were no such plans for troops to be used at our borders. Somebody is not telling the truth here—it is either the briefings coming out of No. 10 or somebody else.

I share my hon. Friend’s concern and will elaborate on that point in just a minute. To build on that comment, as I have been saying for some time, I do not think for one moment that this House is going to accept the binary choice that the Prime Minister will attempt to put before us. A choice between bad and even worse is not a meaningful choice. Nor is leaving the EU on 29 March next year without a deal viable. It has never been viable, and as every day goes past it becomes less and less viable.

The problem is that nobody believes the Government anymore. That is exactly why the Attorney General should, as my right hon. Friend the Member for Normanton, Pontefract and Castleford (Yvette Cooper) said, be forced to come to the House and to put in writing the assurances that the Minister has given. Today the Minister has simply been put up as chaff for other Ministers above his pay grade who, quite frankly, are willing to resort to any level of trickery and contempt for this House. That is the reality. Speaking of trickery, will the Minister be very clear about whether any EU member states or European Commission officials were informed of the plan to pull the vote before the Cabinet discussed it and before this House was told?

I have to say that chaff is a new description for me that I am honoured to receive from the hon. Gentleman. I am here to be very clear about the Government’s interpretation of section 13 of the withdrawal Act and to answer that we will have a meaningful vote. I am not here to speculate on other matters.

I will say two things to the hon. Gentleman. First, although I understand his disappointment, not to say irritation, that the Secretary of State has not remained in the Chamber, strictly speaking, points of order are raised with the Chair. It is not a formal obligation for Ministers to remain for the duration of points of order. Whether the Secretary of State thought that points of order appertaining to him were at an end, I cannot know because I do not know what was in his mind, but the situation is that the point of order is raised with me.

Secondly, I have a sense that the hon. Gentleman and the hon. and learned Member for Edinburgh South West are not going to let this issue go, and I dare say it will be played out and replayed out in days to come. I think we should leave it there for now.

On a point of order, Mr Speaker. It may interest the House to know that while Ministers are fleeing the Front Bench, the Prime Minister has apparently left the country in the last few minutes; apparently she has gone to Berlin, Brussels and The Hague. Is this not rather strange when this House has not yet actually taken a decision as to whether to continue with the debate? Have you had any notice that the Prime Minister intends to return to this House after these visits in order to explain what she has been doing and what she has been seeking? I am told that she is seeking a political statement that the backstop is not enforceable—extraordinary.

First of all, I am not responsible for the whereabouts of the Prime Minister. It is not customary for the Prime Minister to copy me in on her travel plans and I have made no request for her to do so. Related to that, I would say that whatever the House may decide in the course of this evening, that would not carry an implication for the presence of the Prime Minister because there was no expectation that she would be here to take part in any vote this evening. There was only an expectation that she would otherwise have been here tomorrow. Nevertheless, the hon. Gentleman has made his point with his usual force and vigour, and we are grateful to him for that.

All I would gently say to my hon. Friend is that there is nothing meaningless about this vote. It would be one of the most ground-breaking decisions that the House has had to make for a generation: the decision on whether or not to accept a deal negotiated by the Government with the EU that works for all parts of the United Kingdom. I hope that at that point we would have some consensus in the House on a decision to accept the deal and move forward to the implementing legislation.

Let us cut to the chase. The Government have tried to gag Parliament at every turn in this process. Now they have a choice. The position that the Secretary of State is trying to take is, essentially, that it is no deal versus the deal that the Government have. That is not politically, constitutionally or morally sound. Further to the question from the right hon. Member for Loughborough (Nicky Morgan), will the Secretary of State tell us whether he took legal advice, when he took it, and who commissioned it? Was it him?

I have not commissioned any specific, bespoke legal advice on the point the hon. Gentleman raises, but we have been informed right the way through about the implications. Section 13 of the withdrawal Act was informed by legal advice not just from Government lawyers, but from all the lawyers across the House. It was scrutinised very carefully and at length in Committee, and it will give effect to what the House voted through in the Act.
