On a point of order, Madam Deputy Speaker. On 6 November, I tabled a written parliamentary question to the Ministry of Justice regarding the number of appeals involving special educational needs cases and tribunals, asking for that material to be provided on a local authority basis. On 12 November, I received a response from the Department saying that such information would be placed in the Library. It is now 13 December and that information has not been provided despite regular calls from my office to the Library and the Ministry of Justice to try to secure it. Given that so few sitting days remain, I wonder whether you can advise me on how best to secure that information so that I may update my constituents, who are worried about special educational needs tribunals.
I thank the hon. Lady for her point of order. As she will know, the Chair has no power whatsoever over the way in which Ministers operate their Departments, but I will echo what Mr Speaker has said many times. There is a duty upon Ministers and their Departments to answer hon. Members’ questions in a timely fashion, and it would appear that the hon. Lady has waited quite some time for her answer. By raising the matter right now, she has brought it to the attention of those on the Treasury Bench, and I am sure that her points will have been noted. If she still does not receive an answer, I am sure that she will come back to Mr Speaker for further advice and that he would be happy to help.

Commons ChamberWe are tackling this through our social media hub and through the serious violence taskforce. These issues are very difficult and they need to be debated, not only by us in this place, but by the wider communities. As a mum, I know that one wants to protect one’s child and one would hope they are not accessing and seeing material such as that. We have to tread carefully around this, because one does not want, for a moment, to step over into the boundaries of musical freedom. However, we have to be a little less forgiving of those who present these very violent images on TV and then shrug their shoulders when we think it is having an impact on how our children view each other and their friends, and how they view situations in their day-to-day lives.
I will give way, but this will be the last time, as I must move on.
I thank the Minister for giving way. I recognise the debate that people want to have. With the greatest respect to all my colleagues across the House, I do not think this is really about whether we are prudes. Whatever material our young people are seeing, and whether they are seeing violence online or on our streets, the biggest difference is made by their having people in their lives who can be a consistent voice for making positive choices. I understand that there is an obsession with what is on YouTube, but will the Minister say a bit about how she wants to support those youth mentors and social workers that we know we need to be able to crack this problem? That is what this debate is really about today.
It is as though the hon. Lady had my speech in front of her, because I am just about to move on to the further work that we have announced in recent months. Of course, having positive role models is key, particularly for young people with the biggest set of vulnerabilities, who perhaps do not have someone at home on whom they can rely. That may be because their home lives are difficult and chaotic, for reasons that we have heard about earlier in the debate. There is already a programme of work: the Home Office supports charities such as Safer London and the St Giles Trust to do innovative work to try to reach and then keep hold of the young people who most need their help.
Let me put on record my awe at the work that my hon. Friend the Member for Lewisham, Deptford (Vicky Foxcroft) has been doing on this issue, along with my hon. Friends the Members for Streatham (Chuka Umunna) and for Croydon Central (Sarah Jones). It has been incredibly powerful to watch. In my short contribution I want to read into the record what it is like to be from a community in the grip of this disease, because we know at first hand in Walthamstow. I have felt like I have been living a parallel life over the past couple of years: the debates are about either Brexit or knife crime, but both have powerfully divided my local community.
We are a community who know what it means to lose our loved ones. On 7 May 2017, Elijah Dornelly was stabbed. He was 17 years old. He died. On 20 November, Kacem Mokrane died in hospital after being stabbed four days previously. He was 18. On 14 March, Joseph William-Torres was shot in his car. He was 20 years old. He died. On 2 April this year, Amaan Shakoor, 16 years old, was shot in a school car park in Walthamstow. He died. On 22 September, Guled Farah, 19 years old, was shot dead on Vallentin Road in Walthamstow.
There are not just the ones we have lost, but the ones who have—thankfully—lived through this trauma. On 14 November last year, an 18-year-old was stabbed in a Subway restaurant in Walthamstow. On 19 November, a 17-year-old was stabbed. On 5 February this year, a 17-year-old turned up at our local hospital with gunshot wounds. As my hon. Friend the Member for Lewisham, Deptford, pointed out, it is often the hospitals, rather than the police, that know about these problems. On 3 May, two young men were found stabbed in my local high street in Walthamstow. On 27 August this year, a 16-year-old was found stabbed in the neck on Markhouse Road. Mercifully, he survived. On 9 November, a 20-year-old was found with stab wounds in our local leisure centre. On 12 November, a 17-year-old was found stabbed on Hoe Street in Walthamstow. Just this week, on 11 December, a 15-year-old boy was stabbed in a school playground in Walthamstow.
It is fair to say that in the eight years that I have been an MP in Walthamstow we have always had a challenge with gangs in our local community. Professor John Pitts has catalogued that for us in work on what he called reluctant gangsters. Eight years ago, it was about postcodes and the pride that people felt about their local communities—the Beaumont estate, the Boundary Road, the Priory Court, the Drive. Kids wore their membership as a badge of pride to put fear into their rivals. People here have talked about adverse childhood experiences and definitely then that was a factor too, but now we see how it has changed from reluctant gangsters to making profits, as John Pitts points out. It is organised crime that is driving much of this violence. People have mentioned county lines already.
We might have 250 recognised gangs across London. In my local community, we have identified around 230 gang nominals. Indeed, the Mali Boys have come to devastate our local area and to frighten many. These gangs do not advertise their membership now; it is bad for business, because it is driven by drugs. They use their territories not to deter other people, but as marketing grounds—as places where they find their customers. The most valuable resource for them is the phone, so that they can be on-call to deliver the drugs, and, yes, children are sent all around the country to deal, to as far away as Scotland, but also to Essex, to Norfolk and the Thames Valley.
The public health model reflects that, over the past eight years, the same factors are at stake: the childhood chaos, the poverty and the resources that we need to address these problems. For my local community, living in the grip of this disease of youth violence, the same fears remain. There are the parents who tell me that they do not want their kids to get on the buses to go to school because they do not know what will happen to them. There is the shock when they see the police tape and, yes, the social media posts when somebody has spotted something. There is the fear of the gang knives and the guns that we now have on our streets. There are little boys who are dying—they are boys, they are teenagers—and the girls who are caught up in sexual exploitation. There is the domestic violence that is behind much of this, and the frustrations of my local social workers who do an amazing job for Waltham Forest Council, trying to work with these families. There are the people who work through Christmas trying to keep our kids alive.
We cannot pretend that resources do not matter in these circumstances. We cannot pretend that, when finally we get those resources, it does not make a difference. This October, 30 members of the Mali gang were arrested. We have seen in just one area of Walthamstow, in St James’s Street, 15 arrests in one month alone, because we are seeing guns, knives and drugs being taken off our streets. We have had a 24% increase in offensive weapon offences in Walthamstow in the past year alone, so, of course, enforcement and policing make a difference. Anybody who says otherwise simply does not understand what it is like to live within this community. But we know that that is not enough.
Finally, let me pay tribute to all the other organisations that are working with our council: Spark2life, Access Aspiration, Soul Project, Gangs United, Boxing for Life, Camara at Words 4 Weapons, Slenky, and Waltham Forest community hub and Monwara Ali. Our community will not stand by while this happens. Minister, please, give us the resources for the youth services that we need to help our young people. Give us the police that we need to work with them, because this disease is gripping us and it is frightening.

That this House has considered the gender pay gap.
It is a pleasure to serve under your chairmanship, Sir David. I feel very greedy for having just intervened in the last debate and now having my own debate, but both debates are on matters that are close to my heart, because both make a big difference to our local communities.
I mean no disrespect to the Minister present—the Minister for Women—but I see this subject as a matter for the Treasury first and foremost, because I think that closing the gender pay gap is one of the most positive economic policies that we could have in this country, given the benefits that it would bring to our country as a whole. We have spent the past eight years, since I was first elected to this House, arguing about austerity—I know that there are different views on it, but Labour Members are pretty clear that it has not been a good economic policy. There are probably different views across this Chamber as to whether Brexit is a good economic policy—many of us are certainly concerned about the impact on our economy—but I hope there is agreement across the House that closing the gender pay gap would have a positive impact on our economy.
For me, it is interesting and telling that we do not see this matter first and foremost as one of economics. That is one of the challenges we have to address, because we know that closing the UK’s gender pay gap would add £150 billion to our GDP in the next couple of years and that an extra 840,000 women would be added to the UK workforce. Those figures reflect what the gender pay gap really is: untapped talent in our society. Given that we have gone through the horrors of austerity and we appear to be going through the horrors of Brexit, never more have we needed positive economic policies that tap into that talent, to help us try to redress the balance. To the person who tweeted me earlier this afternoon, saying that in debating the gender pay gap I may as well be debating “unicorns”, I say that today the “unicorns” are in the main Chamber, in relation to Brexit. This debate is very much a reality.
The gender pay gap is a reality that we have always known existed; we have always had data to show a general gender pay gap in this country. We know from the annual survey by the Office for National Statistics that the average gap is about 13%. However, what has changed in this debate in the last year has been the data about particular companies, busting open the argument in people’s workplaces and revealing to them the variations between different sectors. It has shown that 78% of companies in this country that have more than 250 employees are paying the men they employ more than the women—that is on average, so it is not just about individual men and women. That is a systematic undervaluing by those companies and organisations of the women who work for them, and of the possibilities that they could bring to their company or organisation.
I am delighted that the hon. Lady has secured this debate and it is a pleasure to join her in it. I was on the Delegated Legislation Committee that considered the Equality Act 2010 (Gender Pay Gap Information) Regulations 2017 and put them through. I was surprised, as I am sure she was, that the bar was set at 250 employees. I know that is a good start, but does she agree that some of the biggest challenges are in the small and medium-sized companies that have fewer than 250 staff, and that it would be fantastic to hear at least an expression of willingness from the Government Benches to extend that legislation as soon as possible?
I completely agree with the hon. Lady. At the moment, only about 60% of the British workforce are covered by that legislation, so when we talk about understanding the gender pay gap in this country, we still have 40% of the gap to understand. I will come on to that issue later because, like her, I am impatient and, also like her, I have a passion for that piece of legislation.
We should honour all of the parliamentarians involved in this, including my right hon. and learned Friend the Member for Camberwell and Peckham (Ms Harman), whose determination to get the Equality Act 2010 through set us on course to where we are today. Sometimes her contribution to this process is forgotten, perhaps by Members who are new to the House. Anyone who has ever dealt with her on these issues knows full well how passionate she is about them and everyone should recognise that.
The variation within sectors is also pretty telling for us, in terms of the kinds of experiences that women in our country—our constituents—might face.
On that point about looking at different sectors, I used to work in the third sector—the charity sector—which people often refer to as “the women’s sector.” However, when we look at the top and at the management, we see that it is not reflective of the sector at all. Does my hon. Friend agree that that is a big issue?
Completely. One of the things that is so powerful about this data is that no sector—public, private or third—is immune from critique, because frankly none of them is valuing women in the way they could. That is reflected in how they pay them, how they promote them and how they work with them.
I am very struck by some of the brands that make a point of selling to women. After all, the one place where women have the majority of power in our society is in their purchasing power, as we account for 70% of purchases in this country. Yet those brands that make a virtue about selling to women are often the ones that, when we look at their pay gap, are some of the worst in this regard. I would not necessarily have put Sports Direct up there as champions of feminism, but its gap is 6%. Contrast that with Sweaty Betty, which has a 62% variation; with Monsoon, which has a 36% variation; or with Boux Avenue, which sells lingerie and has a 75% variation. Even when we are buying those companies’ products, they are not necessarily using the money to pay their women employees equally.
Many people have rightly challenged the data about the gender pay gap. After all, there were only four measures, so I agree that the data is a blunt tool. There are certainly things about the data that I would like to know more about. However, my argument today is that just because the data is not perfect does not mean it is not powerful. I absolutely agree that we need to understand much more than just gender when it comes to inequality in the workplace, the undervaluing of talent and what that means for our economy. It certainly means that we need to understand whether we can get better data on how black and ethnic minority employees are treated in the workplace. We know that the full-time pay gap for black African women is 19%, and that for Pakistani and Bangladeshi women it is 26%. That is in contrast to the general gender pay gap of 18%. Black male graduates earned a whopping £7,000 less per year than their white counterparts in the past 10 years. One of the things we know is that although black men have been more likely to invest in higher education than their white counterparts, they are less likely to have benefited from it in their pay packets. That is an interesting challenge for us.
This data also does not tell us about part-time work, which is absolutely crucial for women because, at 73%, the majority of part-time workers in our country are women. We know that there is a gender pay gap within the data for part-time work, but it is not as clearcut as the one within the data for full-time work, which is the data that we have for these individual companies. The data also does not tell us about age. For many people, understanding the difference of the gender pay gap, and therefore understanding what is driving it, is crucial when it comes to age. People presume that the gender pay gap is something that happens later in life. Actually, we are already seeing a gender pay gap building up with graduates, within 18 months of them entering the workforce. Again, that tells us that the gender pay gap is not necessarily what people think it is.
Also, in relation to the point made by my hon. Friend the Member for Midlothian (Danielle Rowley), the public sector cannot lecture the private sector in this regard. When we look at the NHS, we see that 77% of its employees are women but it still has a substantial gender pay gap. That should tell us—as the people in charge of public services—something about our ability to value women and their worth in the workplace. Indeed, the private sector pay gap has decreased, from 20% to 16%, while the public sector pay gap has widened to 13.9% in the past five years.
The data also does not tell us what difference getting qualifications makes. Again, when we go on to consider what might be causing the gender pay gap, people make presumptions about the impact of training and qualifications. Actually, when we look at the data, we see that it is not necessarily the case that women who have been educated to a higher level, such as degree level, are being paid more. Indeed, despite more women being educated to a higher level, there has been little or no change in the gender pay gap between groups of workers qualified to a degree level since the early 1990s. We also see a gender pay gap when it comes to apprenticeships. For level 2 and level 3 apprenticeships, women earned an average of £6.85 an hour, compared with the average for men, which was £7.10 an hour.
One of the things that is so powerful about this data is that, because it is so localised to particular companies, it helps people understand what is happening directly to them in a way that a general statistic does not. I have met the Minister to talk about one of the challenges in this regard: when the data was published in April this year, what impact did it actually have on the ground? I ask that because it is one thing for us here in this House to analyse the data and maybe call to account those firms that sell to women without paying women properly, but it is another thing to talk to our constituents about their experiences of what the data shows about their workplace.
Therefore, when the data was published, a cross-party group of MPs put together an anonymous survey called #PayMeToo to try to understand the experiences of women at the coalface. As the Minister knows, the responses were pretty shocking. People often say, “Data is a great disinfectant. Publish the numbers and that will drive change.” The data from the #PayMeToo survey shows that we might be publishing the data, but we are certainly not telling women to talk about it, and those women trying to talk about it in their workplaces face a hostile environment—I hesitate to use that phrase, but it is very clear from the responses we got.
Women were being told that that was just the way it is; that they work in sectors where there are not any women, so why would they expect women to be paid the same as men? They were being told by HR departments that they should bury the data; that they should not be difficult; that they needed to raise a grievance if they wanted to talk about those issues. They were being told that they could get a pay rise, but it would not be equal to that of their male colleagues, because it was about trying to manage the impact of the fuss that was being created. They were recognising that their companies were using what they called “very creative reporting” to try to minimise the gender pay gap, and so pretend that the issue was not happening. They were being told, “Don’t worry. Next year we will employ some more lower-paid men, and that will sort the problem.”
One of the things that I hope the Minister will commit to is following up that data and gathering it herself next year, when the second lot of data comes out. It should not be up to MPs to try to grab these qualitative pieces of research, when what consistently comes back to us speaks of the hostility that women face regarding the impact of this data; of just how sensitive it is for people to talk about what they earn in this country; and of the presumptions and cultures behind the gender pay gap, which we have to deal with.
Let us try to deal with some of those presumptions. At the moment, it is true that we have only half the story with the data, and many commentators both online and offline, including in The Spectator—I am sure Toby Young is watching—will try to fill in the rest of the blanks for us. They tell us that it is about women and their lifestyle choices—bluntly, that women have kids, therefore they want to work flexibly and to take time out, so of course they are going to be paid less.
As my hon. Friend says, her husband has kids. She pre-empts what I am going to say: this is not about women, but about parenting. One of the challenges for us is to support both parents to be equally culpable for the child that they have created, including looking after that child, because that is one of the things that would help women in the workplace. There is an impact on women’s earnings when they become parents, but there is not as much of a gap for fathers. For mothers the pay gap is 30%; for fathers it is around 10%. We also recognise from figures provided by the Office for National Statistics that having children can only account for a third of the variation in gender pay. One of the things we have to nail in this debate, if we are to close the gender pay gap and get that economic benefit, is the idea that this is all about having kids. A big chunk of the variation cannot be explained by childcare or caring commitments.
The second thing people say is, “This is about women putting themselves forward. Women do not ask for pay rises; women do not seek promotion; women do not want to be in charge.” Thankfully, we also have research showing that is simply not the case—that, as much as we might admire her in many other ways, Sheryl Sandberg is wrong. This is not about leaning in; this is about systematic discrimination against women in the workplace. An Australian study. Clearly shows that men and women ask for pay rises, just as much as each other, but that men are four times more likely to get one. That is the same for men and women of similar attainment or qualifications, and for men and women of certain ages. Let us stop blaming women for the gender pay gap, because it is not their fault; it is the fault of the environment they are working in.
That environment is what we need to tackle, and that is not just about getting a few more well-paid women at the top—although, if we are honest, we have seen over the past eight years that that is not going brilliantly either. Britain’s public companies will need to appoint women to 40% of their board positions over the next two years if they are to meet the voluntary target that the Government have set, and 100 companies in the FTSE 350 have either no women or just one woman on their board. However, if I am honest, it is not women at the top who I am really concerned about, because the vast majority of the gender pay gap is about low pay and women. It is about the value that we attribute to certain sectors, and the fact that those sectors are dominated by women. The silent majority in this country that we need to speak up for is not the women who we are going to see on the back page of the Financial Times. This is not about getting a few more women in top positions, although some companies have worked out that that would skew their figures; this is about the millions of women working in jobs that are systematically undervalued and underpaid.
We see a lower pay gap within low-paid industries, but we still see a pay gap. Over one in five female workers are low paid, earning less than two thirds of a typical hourly wage or just £8.55 an hour, compared with just 14% of men. That silent majority needs us to recognise that challenging the gender pay gap, and getting the better productivity and the economic benefits of doing so, comes about through how we think about those industries. It comes about through how we think about progression and flexible working within them, and not taking no for an answer; not thinking that this is somehow just about women being more confident or more articulate, or even a bit of anti-bias training, welcome though it would be.
My hon. Friend is making a fantastic and powerful speech. Some 80% of administrative and secretarial staff tend to be women, and when a construction company in my constituency of Midlothian went bust, the men who were the engineers and had the manual jobs found further employment quite quickly. However, the women who were in the admin roles did not, and found themselves unemployed. Does she agree that is another issue that is creating gender inequality in the workplace, on top of the gender pay gap?
Absolutely. One of the things I want to come on to is the rise in self-employment, and in particular how that affects a lot of women who have lost their jobs in industries where self-employment is now the norm. A lot of our equal pay legislation and gender pay work is out of date because of the way in which people are now working, and I would love to hear the Minister’s thoughts on whether we need an equal pay Act for the 21st century that can take account of what a comparator is for somebody who is self-employed. Certainly, for a lot of those women, that will be a live issue.
Equal pay is still a problem. The Equal Pay Act 1970 is older than I am, but we know that women are still facing basic problems in being paid the same as men to do the same jobs. We know that the 84% drop in the number of cases is more to do with the cuts in legal aid than with an end to the problem, as the legal cases involving the BBC and Asda prove all too well. However, the gender pay gap is not illegal; it is just immoral and, frankly, inefficient. That is the issue that we have to get right, because it is an issue that our competitors are getting right.
That is the third thing that I want to say to the Minister. We can argue about the data—I press her to improve the quality of the data we get with the second lot in 2019, because there is more we can do—but data is not enough. Indeed, the data and the reaction to it shows that people are quite comfortable with the idea that we should have a gender pay gap, in a way that they would not be comfortable with poor productivity in their firms. We have to change that culture, and when our competitors are doing that we have a real problem.
On the matter of culture, does the hon. Lady agree that the erroneous and inappropriate misuse of non-disclosure agreements is making a massive contribution to poor culture, with women particularly being silenced, resulting in the suppression and oppression of women and their voices in the workplace?
I absolutely agree. Indeed, that hostility to women’s voices being heard at all is one of the things that has come out of the #PayMeToo data. The fact that someone is powerful and has the money to silence someone else does not mean that that person’s voice should not be heard. I will support any of the measures on non-disclosure agreements that I know the Select Committee on Women and Equalities is looking at, not just about sexual harassment but about harassment in the workplace, because it is clear from the data we are getting that women do not feel able to come forward and do not feel protected. Indeed, when we see the BBC—a major public employer—trying to silence women, what message does that send to women who want to talk about equal pay?
We can learn lessons from our competitors. We can learn from Iceland, which has brought in some very serious fines to make sure that there is enforcement of equal pay. It is no good having legislation if there are no real teeth to enforce it. In Germany, employees can now get the details of six of their colleagues’ pay so that they can do a direct comparison, which has had a big impact on changing conversations about the worth of women in the workplace.
However, I am also here to say to the Minister that time is up for asking nicely, because we have been asking nicely for some time for these issues around pay and progression to be dealt with, and the pace of change is glacial. When our competitors in Germany, Belgium, France, and elsewhere across the EU—even in California, for Christ’s sake, which is hardly a bastion of socialist public policy—are introducing quotas and recognising that pushing those quotas helps push the pipeline, the question for us is, “Why do we want to be left behind as a nation?” Left behind we will be, because even if we can struggle to get a few more women on boards to meet that target for 2020, we are not doing anything about that pipeline. We are not doing anything fundamental to ensure that the talent that exists on the shop floor that is currently underpaid is being picked up and fast-tracked. That would help change the country.
That matters because of the economic impact of failing to pick up that talent. It matters when we hear companies saying that when it comes to promoting women, “Most women don’t want the hassle or pressure of sitting on a board.” Of course, we know that women do not deal well with pressure, obviously. They say, “All the good women have already been snapped up. That’s why you can’t find them,” or, “We already have one woman, so that’s enough, surely.” Of course, all women can be represented by one woman on a board. They say, “Shareholders just aren’t interested in this issue.” Frankly, if shareholders are not interested, they are not watching the world or their bottom line.
A global analysis of more than 2,000 companies showed that companies with women in at least 30% of leadership positions had profits that were on average 15% higher. If shareholders are not pushing for and demanding change, clearly they do not want to make any money, but that is what is happening now. We can keep asking nicely and trying to improve the data, but even if we improve the data there is that comfort with having a gender pay gap that means our economy is going to be held back, and that needs to change.
We should be asking about part-time work and whether we need to lower the threshold, at least from 250 to 100 employees. We should hold to account those companies that try to avoid putting in their partnership data, and we should get the data on black and ethnic minority employment and disability within our workplace. But we should also make a commitment that we will act, and acting means doing what our competitors are doing. It means setting some clear targets and having consequences for those firms that fail to act.
We know that next April we might see data that is a little bit better. After all, they will have had a year to try to figure out how to game the system, but gaming the system does not get the economic benefit. Let us stop apologising for wanting to close the gender pay gap and start demanding that we do, because this country cannot afford not to. What will the Minister do to ensure that the data we get next year is better, clearer and more diverse? What does she think is the appropriate timescale to keep asking nicely? Will she commit to when we might bring in quotas if we do not see change? She will find friends and champions across the House if she does. I also know that if she does not, Britain will not get the productive workers it needs. Blaming women for the problem will not help our economy. Helping ensure that every firm, every public sector organisation and every charitable organisation makes the best use of its staff will give this country the brighter future that the Prime Minister claims she wants. We want more than one woman at the top; we want many. That is what Britain deserves.
I want to get to the Front Benchers by 5 o’clock. There is only one Member standing, but there is not much time in a one-hour debate.
I do not have long. I had asked the Minister whether she would consider the Government Equalities Office doing its own survey of the direct experiences of women of the impact of the data. I again make that plea to her. It is absolutely no use us talking about that here without the data. We did that through the #PayMeToo campaign, which I hope the Government Equalities Office will look at. We know that 9% of organisations submitted data with impossible outcomes; there was 1% with bonus payments of essentially more than 100%, which does not make any sense. There are questions about the data.
The Minister talks about 40% of companies having action plans, which means that 60% do not. We could have several years of trying to refine the data, but fundamentally, women in this country are being underpaid, and our economy is suffering as a result. Please, Minister, do not think that this is just about trying to explain to Ryanair that you do not, frankly, need a penis to fly a plane; this is about what drives change. If it is not quotas, it is not asking nicely—that is what the data tells us. I really hope that she will recognise the change.

My hon. Friend is right. There are countries around the world that we recognise have due process, the rule of law, separation of powers and values we agree with. That is why we share intelligence with some of those powers and why, in the 8,000 mutual legal assistance requests a year, we often share evidence that leads to prosecutions in court. We will always do that where we think it is about seeking justice and the best place for that justice to be delivered. In this case, we felt the best place was the United States of America.
Everybody in this House agrees that the crimes being talked about are abhorrent and that there is a desperate need for justice, but no straw man should conceal the fact that that should never come at the loss of our principled opposition to the death penalty. If the Minister is so confident that this is the correct decision, will he publish the legal advice that he and other Ministers have had that confirms they do not even need to ask the question for this country? On that point, he says that the Prime Minister is aware of this decision. Does she agree?
On the first point, the hon. Lady will know that it has been the policy of numerous successive Governments not to publish legal advice. On the second point, the Prime Minister was aware of the decision. The decision was made between the Home Office and the Foreign Office, and she agrees.

The Chamber has been packed with MPs from all sides, as it was when many of us gathered together two days after the disaster in this very room, frankly stunned by the enormity of what had happened in north Kensington and what was unfolding before our eyes. Some MPs have not had an opportunity to speak. Next to me is the Minister for the Constitution, my hon. Friend the Member for Norwich North (Chloe Smith), and opposite me is the shadow Home Secretary, the right hon. Member for Hackney North and Stoke Newington (Ms Abbott).
Those campaigning for this change and the many bereaved and survivors—the victims of the Grenfell Tower disaster—can be in no doubt about the attention and focus that this place gives to Grenfell and to the journey towards truth, justice and healing. I congratulate my hon. Friend the Member for Sutton and Cheam (Paul Scully) on setting the tone so well at the start of the debate by reading out in such a poignant way the names of the 71 precious lives lost. He was quite right to add to that list the name of Maria Del Pilar Burton, who very sadly died earlier this year.
When we met almost 11 months ago, we were reeling. This afternoon, we meet clearer about what we are dealing with. In terms of loss of life, we are dealing with the worst disaster to hit this country since Hillsborough. We are dealing with a disaster that should not have happened. Those 71 precious lives should not have been lost that night. The lives of their friends and families should not have been torn apart by trauma and grief. More than 300 people should not have been made homeless—most of them losing all their possessions. Local residents who did not live in the tower should not have been traumatised by what they saw and heard that night, which will stay with them forever.
First responders have not been mentioned so far, but police, fire and ambulance staff should not have had to face what they had to face that night to keep the peace and save lives, often at huge risk to themselves. Grenfell will always be part of their lives.
Since then, of course, thousands of people have stepped up to try to help, either because they are part of the extraordinary voluntary effort or because it is their job and their duty. Grenfell will always be part of our lives. Of course, for all of us, as expressed so powerfully this afternoon and before in Parliament and through the media, there remains profound shock and horror across the country that such a disaster could happen in modern Britain.
Given all that, we cannot put everything right, but as a country we can and must do at least three things. First, we must honour the dead in the most appropriate way. I thank those people—many of them are sitting in the Public Gallery this afternoon—who have worked with us on the first steps of a process that I believe will lead to a beautiful and appropriate memorial on the site of the tower, which is a journey with the community at the driving wheel and the voice of the bereaved carrying the most weight.
Secondly, we must do everything we can to help the bereaved, the survivors and the traumatised residents to heal, and to rebuild their lives and—as far as is possible—their hope. The hon. Member for Birmingham, Yardley (Jess Phillips) was absolutely right that that must be done in a way that is human at all times and not bureaucratic and remote. Have we succeeded in that fully? No. But that must be our continued aim. For the homeless, that means settling in new homes that they like and that they feel safe in.
Can I expect the House to have full understanding of all the underlying complexity? No, of course not. It is absolutely right to express frustration, rage and disappointment at the pace of progress. In fact, the Government have put on the record our profound dissatisfaction with the pace of progress.
Let us not lose sight of the fact that, when we started this process, of the category A households—residents of the tower and the walk—210 needed to be rehoused, and we are now in a situation where the number of households in emergency accommodation who have still not accepted offers is down to nine. That is nine households too many and nine households that I am personally committed to trying to sit down with and meet personally, to understand how they are feeling, but it would be wrong to say that no progress has been made or that no action has been taken.
I thank the Minister for giving way. Nobody here can doubt his commitment, but he has just said that the Government have put on the record their frustration. Can the Government put some resources behind resolving this question, so that we do not have to listen to more stories of people who have been through something horrific and are still without settled accommodation?
With respect to the hon. Lady, it is not an issue of resources; there is no shortage of resource that has been directed to this problem. If she happens to drill down into the underlying details of every single case, she will see that it is not an issue of resource. It is an issue of a deep underlying complexity about some of the things that are still getting in the way of a victim of the disaster finding the home that they feel is right for them and that they feel secure in, which ultimately is all that matters.
Last but not least—it is the theme of this debate—we must deliver truth, we must deliver accountability and we must deliver justice, because we must ensure that such a disaster never happens again, so that no family has to go through this hell.

The Minister talks about wanting women, and indeed men, to be able to use this data to have conversations in their workplace. Just two weeks ago, a cross-party group of us set up the #PayMeToo campaign precisely to help women and men to do that and to make sure that they know their rights in being able to have these conversations at work. We have already had hundreds of reports back from our anonymous survey of the experiences they have had. Women are being told by their employers to raise their grievance with HR if they want to talk about these issues, being told that their careers could be damaged by talking about them, and being told, “Don’t worry—we’ll just employ some more junior men to even out the figures.” There is a clear difference between what is happening on the frontline and what the Minister is talking about.
Will the Minister join me and other parliamentarians in encouraging people to use our anonymous paymetoo.com website to report details? Will she meet us to go through the findings and look at what we can do to make sure that the culture is changing on the ground, that men’s and women’s rights to speak up on these issues are protected in the workplace and that we finally close the gender pay gap?
The hon. Lady brings her usual passion and strength of argument to the House. I will be delighted to meet her to discuss this. I am most interested to hear about that campaign. She and other colleagues have rightly raised the question how we ensure that women feel empowered to raise issues in their workplace. I note the insightful contribution of the right hon. and learned Member for Camberwell and Peckham with regard to the role that trade unions play. I very much share the hon. Lady’s commitment, and I would be delighted to meet her.

I thank my hon. Friend for raising this. I am sure that the thoughts of the whole House are with the Member of Parliament concerned and his members of staff, although I have received a note—I hope that it is accurate—saying that the package found in Norman Shaw North was not hazardous. That must be of significant relief to all those concerned. As ever, we give our sincere thanks to the police and others who went to the rescue of those members of staff when they found the package.
It was Friday night when I started to receive reports from residents in Walthamstow that they had received one of these letters, with the fear and the terror that that caused, at the very point when I was helping other residents to report anti-Semitic graffiti that they had found in our community. Will the Minister join me in welcoming the work that Tell MAMA and the Community Security Trust are doing to support these groups? Does she agree that we have to do more than condemn these individual instances? When we see Steve Bannon come to Europe and tell people that they should be proud to be called a racist, we in this House must speak up for the communities that we represent and the power of diversity and immigration to enrich all our lives. I tell the Minister: the people in Walthamstow need and demand nothing less from this Government.
They are getting it. I am extremely grateful to the hon. Lady for setting out the concerns of her constituents; she has highlighted the fear that people must have felt when they received those letters. She is absolutely right to say that Tell MAMA is an organisation that is universally recognised as playing a very important role in this field. I am told that from 1 January 2015 to 31 December 2015, 2,622 anti-Muslim hate incidents were reported to Tell MAMA by victims, witnesses, third parties or the police. That shows us the scale—certainly three years ago—of these worrying incidents of hate crime that we are facing in this country. We support Tell MAMA to the tune of £1.9 million, and its work is highly valued.

Commons ChamberI am delighted to agree with the hon. Lady about the importance of that meeting of the commission. Her emphasis on making sure that we get real policies for women in rural communities is essential.
I am proud to be part of a Government who are wholeheartedly committed to improving the lives of women and girls. Since 2010, we have made significant progress in accelerating gender equality at home and abroad, whether by empowering women in the workplace, tackling violence against women and girls or improving girls’ education around the globe.
We all know, though, that there is more to do, with sexual harassment scandals, stories of debauched dinners, one third of women worldwide experiencing physical or sexual violence, and the fact that it will take an estimated 118 years to close the global gender pay gap. As the theme for this year’s International Women’s Day makes clear, we must continue to “press for progress”. This effort must span countries and continents, policy areas and political allegiances.
I wish to kick off today’s debate by talking about three areas in which I think women are still losing out to men globally, and what we are going to do about it. The first is violence: too many women and girls face harm and abuse. The second is money: many women still earn less than their male counterparts. The third is influence: around the world, men still occupy the majority of the top jobs.
Let me start on the first point, violence. A truly equal society is one in which everyone is free from the threat of gendered violence. Today, I am proud to announce the launch of the Government’s consultation on tackling domestic abuse, which will help to inform the introduction of the domestic abuse Bill. Domestic abuse affects approximately 2 million people in England and Wales every year, and the majority of the victims are women. The Government are determined to do all we can to confront the devastating impact that such abuse has on victims and their families, and in doing so to address a key cause and consequence of gender inequality.
Our consultation seeks to transform our approach to domestic abuse, addressing the issue at every stage from prevention to early intervention to bringing more perpetrators to justice. It reinforces our determination to make domestic abuse everyone’s business. This comprehensive consultation will last for 12 weeks, and I encourage every Member of the House to engage with it and share it with those in their networks who have, or who should have, an interest in this area. This is a critical opportunity to bring these crimes out of the shadows.
The Minister will know that, last week, the United Nations convention on the elimination of all forms of discrimination against women said that the way we treat women in Northern Ireland, denying them access to abortion in their home nation, is a form of violence against women. Today, 135 parliamentarians from throughout the House have written to her asking her to commit to providing an opportunity to put that right in the legislation she is talking about. Will she give us a right to vote to give women in Northern Ireland equal access to abortion rights?
The hon. Lady will know about the limitations on my announcing any such statement, but may I nevertheless take the opportunity to thank her for the good work that she has done in this area, including in ensuring that, for the first time, the women of Northern Ireland have access to abortions? We now have a new system—a centralised system—for those women so that they find it much easier than ever before to access the health support that she, like me, thinks is so vital.
The consultation will last 12 weeks, and I urge every Member of the House to engage with it. Domestic violence is not the only type of violence that demands our urgent attention, though. Internationally, too, we must continue to combat violence against women and girls. Globally, one in three women are beaten or sexually abused in their lifetime. We are generating world-leading evidence through our £25 million “What Works to Prevent Violence Against Women and Girls” programme. This year, results from 15 innovative interventions being evaluated across Africa and Asia will provide new global evidence about what works to stop violence before it starts. We want this evidence to be a game-changer in supporting more effective UK and international support for ending violence against women and girls globally, and it is essential that we put what we learn into practice.
Thank you, Mr Deputy Speaker—it is wonderful to see the number of men who are in the Chamber for this debate growing exponentially as we continue, in whatever role.
So many Members have made fantastic speeches, talking about the past and what we have achieved, but I want to honour International Women’s Day in the way that I feel is best. I consider International Women’s Day to be feminist Christmas; it is about what goodies and actions are coming. I want to talk about that because we need to learn from what the suffragettes drummed into all of us: deeds, not words, make a difference. Even when there were men who claimed to care for women’s rights and for the future of women, they knew that it was not enough to have them speak for them. The true deed was to have true and equal representation.
We must learn that lesson today as we continue to look at the inequalities in our world. It is simply not enough to pay lip service to equality. It is not enough to march and to use the hashtag. I am struck when I go in to shops such as Hennes that people can now buy plenty of t-shirts that say, “Female Equals Future”. But we will only have a more equal future when we have deeds, and when we actually tackle the barriers to discrimination and the inequality that holds 51% of our population back.
In perhaps being the Grinch of feminist Christmas, I am inspired by Mary Wollstonecraft, who said:
“My own sex, I hope, will excuse me, if I treat them like rational creatures, instead of flattering their fascinating graces, and viewing them as if they were in a state of perpetual childhood, unable to stand alone.”
When we view the world as it is and are rational creatures, we see that if the call is to push for progress, we are not making the progress that we think we are and its pace is agonisingly slow. We are celebrating 100 years since some women got the vote, and we have talked about the fact that we have now achieved a 30% share of this Parliament for women. A whole 12 extra women were elected at the last general election. If we carry on at that trajectory, we will need another 14 general elections to achieve parity. I know that we have been having elections more frequently than we used to, but we need more appropriate action.
It is not just national Government where we fail to make the progress that we want. The hon. Member for Cheadle (Mary Robinson) rightly pointed out the progress in local government. I am proud that we have one of the few female leaders in local government in my borough, Clare Coghill, the new leader of Waltham Forest Council—the first woman to be elected there. Only 17% of council leaders in this country are women. We would need 12,000 women to stand for election if we were to achieve the extra 3,000 who would give us parity in local government.
We know that this country continues to fail what I shall now call the Piers Morgan test. This morning, Piers Morgan tweeted that the fact that there were six women in positions of responsibility in the country meant that the country was run by women. Job done: we can all go home. The point is that such women are still too often the exception rather the rule. That is why we can name them. True equality will come when there are so many women from so many backgrounds in those positions that it is simply the norm, and the fact is that we are nowhere near the norm. Only 11% of surgeons in this country are women—it will take 100 years to achieve parity—and only 24% of judges are women. Why do we never hear about all this? I would wager that it is because only 34% of people in senior roles in our press are women.
Too often we tell ourselves that because we have seen one woman, there must be more behind her, but the truth is that this country is still agonisingly behind where it needs to be to realise the potential of all its people. We see that not least in the arguments that we are having about equal and, indeed, fair pay. The equal pay legislation is older than I am, but we still have to explain to the young women coming into our workforce that there is a 14% gap—and, yes, it is growing for their generation. This is not just about women having children. Women ask for pay rises just as often as men, but men are four times as likely to get them. We are starting at lower salaries, and that inequality is continuing and is not being reduced.
Companies facing gender pay gap reporting are now hiding behind each other. I welcome the legislation: we all fought for it, and we can see the cleansing effect that it is starting to have. However, we know that only 1,200 of 9,000 companies have declared their data so far, and we know that the deadline is fast approaching. That tells us that plenty of companies are waiting until the very end, hoping that they can find cover in each other. Let us send a strong message today, on International Women’s Day: “ It does not matter whether you publish today, or whether you all publish together. We will look at every single set of data, and we will hold to account every single company that does not offer equal pay.”
We must also, as a House, speak up for the right to talk about equal pay. As we have seen at the BBC, when women start asking questions, they get shut down. Freedom of speech in the workplace is a fundamental human right, and the legislation relies on the principle that we can start to have such conversations. We must not give an inch on the idea that it is acceptable for managers to tell employees that if they start asking those questions, they will be labelled difficult and it might harm their chances of promotion. It is what we might call the John Humphrys test.
Does the hon. Lady agree that one of the problems is the fact that we do not have as many trade unions operating in as many workplaces? I used to be the mother of the chapel when I worked at Central Television, which was obviously a very long time ago. One of the things that shop stewards do is to act on behalf of all their members when, as sometimes happens, they are fearful of stepping up to say the sort of things that the hon. Lady rightly identifies. If we had better, more democratic, more open trade unions, that would go a long way towards advancing the cause of women.
I completely agree. Let me put on record that if I were ever to face problems in my workplace, I would certainly hope that the hon. Lady would act as shop steward.
I know that the hon. Lady would fight the good fight. She is absolutely right: this is about representation and voice, and we see the impact of women not having that voice.
This is not just about gender; it is also about ethnicity. We know when we talk about inequalities in pay that our sisters from the black and ethnic minority communities face even higher differentials, and we, as a country, are a long way from knowing how to tackle that. I welcome the initiative from my hon. Friend the Member for Brent Central (Dawn Butler), who said, “It is not enough to have data—we need to see what you are going to do about it.” It is clear from the data that we have already seen from only 1,200 companies how far we have to go.
This is also not just about the major companies. We know that 62% of people earning less than the living wage are women. It is about persistent poverty pay, and what it does to families around the country. It is little wonder that one of the themes of the debate that we have started to have in 2018 is period poverty. All too often, women are trying to pick up the pieces of a failing economy in an institutionally unequal society. What does that mean? It means that women are often the ones trying to make the difference, and it is the men who, like Piers Morgan, simply say, “I’ve seen one of you do it. If one of you can do it, all of you can do it.”
We see that nowhere more than when we try to tackle violence against women. The writer Margaret Atwood said:
“Men are afraid that women will laugh at them. Women are afraid that men will kill them.”
As my hon. Friend the Member for Birmingham, Yardley (Jess Phillips) set out so clearly, that is still a challenge for us in our society. Violence against women is endemic; the #MeToo movement has started a conversation about something that has been part of our society for generations. It is just a conversation, and we have not yet seen the real change—the real progress—we know we need to make. When 85,000 women report being raped, and 400,000 report sexual assaults, we know that that is just the tip of the iceberg. Then there are the 12,000 honour-based violence crimes and the 135,000 women and girls living with female genital mutilation. That only 15% of these crimes get reported is not about the women, but about the society we are right now; and about our failure to understand these crimes and prosecute them, and to support the people affected by them.
As part of dealing with that, I very much welcome the Government’s commitment to ratifying the Istanbul convention, but one of the things I want to do today is to hold the Government to account for deeds not words. If we are going to ratify the Istanbul convention, we have to right a long-standing wrong. I pay tribute to the words of my hon. Friend the Member for Heywood and Middleton (Liz McInnes), who made a powerful speech about the importance of women’s reproductive rights, because women’s reproductive rights are human rights. I want to put on record my gratitude to every one of the parliamentarians who has signed the letter to the Minister for Women and Equalities calling for us to give equal access to abortion for women in Northern Ireland.
Members may say, “A year ago, we decided to provide funding to help women from Northern Ireland to travel to England to have an abortion.” The figures we have today show that 600 women have taken part in that scheme—clearly, there is a demand. But it is little wonder that the United Nations says very clearly that the way we treat Northern Irish women—by making them travel, and by putting that restriction on their access to a basic human right—is degrading and inhuman. We cannot ratify the Istanbul convention unless we right that wrong. That treatment is inhuman. Not everybody can travel. We are treating women in one part of the United Kingdom differently—the women who cannot travel, the women in coercive relationships, the women who have small children and the women who are undocumented.
We cannot leave this to chance. We cannot say, “Because we can give you some ability to travel, that means you have equal access.” We cannot let whatever deal the Government may have needed to do with the DUP allow us to get away with arguing that women’s rights are devolved, especially when the Government have committed to giving us a vote on same-sex marriage. Equality cannot be selective. It is right that people should be able to love who they love and to record that in the way they want to, and it is right that women should be given control over their bodies and not be forced to continue an unwanted pregnancy.
I say to Ministers that these things are there in the Istanbul convention. We are treating citizens of this nation with contempt and in a way that the UN called degrading. If we are not going to have a free vote on the domestic violence Bill, which is supposed to ratify the convention, when will we have parity? When will we treat equality as what it truly is—about solidarity? If we want to show solidarity with our Northern Irish friends and their right to marry who they want, we should show solidarity with our Northern Irish sisters in giving them back control over their bodies.
I also want to echo the call by my hon. Friend the Member for Heywood and Middleton on the global gag rule, but I would go further. On International Women’s Day, the deed that we need is for this Government to commit to contribute to the SheDecides fund. It is one thing to face Donald Trump and his decision to withdraw funding—we know that women have died in the last year because they have not been able to access maternal healthcare following the funding cut he made to stop abortion services—but it is another thing when other countries step up to the plate and say, “We will bridge the gap.” However, this country shies away from being part of that fund.
This is not just about the money; it is about the message of solidarity it sends when we are part of the SheDecides fund. I call on the Government not simply to tell Donald Trump that he is wrong to cut this funding, but to put our money where our mouth is and to stand with our sisters around the world who need the services that his withdrawal of money has cut.
We have also today had the wonderful Women for Refugee Women organisation in Committee Room 10. I am sure that they are still up there singing, and I hope that Members will go up and join them. They are singing for their sisters who are in Yarl’s Wood. In 2018, we in this country are not making the progress we think we are if we are still locking up women who have been the victims of violence, sexual abuse and torture in conflict, yet that is exactly what we are doing in Yarl’s Wood. The fact that 75% of the women in Yarl’s Wood are set free, sometimes to be detained again and then set free again, tells us that the system is broken. This expensive system enshrines inequality in the way in which we treat the most vulnerable women in our society, and I urge Ministers to rethink their determination that this is the only way to manage our immigration system.
Like many of us, the lessons that I take on International Women’s Day are from my constituents, and I want to share two quick stories. In 1962, Beryl Swain was the first woman to compete in motorbike racing on the Isle of Man. The men were so horrified that they changed the weight categories to prevent women from taking part, and that continued until 1978. Karpal Kaur Sandhu was the first Asian female police officer in the world, and she proudly served Walthamstow. She was murdered by her husband in 1973 because he disapproved of her job. What that tells us is that the backlash, the power, the abuse and the violence will always mutate.
We have to keep fighting the patriarchy, and in that sense, that is why I am proud to see so many men here today, including the hon. Member for Boston and Skegness (Matt Warman). In creating these deeds, men have a vital role to play. As we have all tried to remind Piers Morgan, we do not think that all men are violent. This is about standing up for the reputation of men and for the better world that men and women working together as equals can create, and we ask men now to be our allies and to show solidarity. This is also about cold, hard economic logic. More equal societies are more prosperous, more resilient and more diverse. The right hon. Member for Putney (Justine Greening), who is no longer in the Chamber, said that the equal employment of men and women would create $28 trillion in growth, from which we could all benefit.
That is why I say to the men in this Chamber and the men in Britain: do not leave it to the women of Britain to resolve these problems. Do not expect us to lead this fight on our own and to come up with all the solutions and the deeds. Do not tell us that you do not think that quotas work or that you do not think that turning misogyny into a hate crime is a good thing. Tell us what you will do to create an equal society. We all have a responsibility to come up with deeds, not words. I will end with the words of Millicent Fawcett, who said:
“What draws men and women together is stronger than the brutality and tyranny which drive them apart.”
I will champion the contribution that every one of my constituents, male and female, makes to this country, but I know that only a truly equal society will realise that for all of them. On International Women’s Day, I call on every man and woman in this country to ensure that we have not just one day of fighting for that better world, but 365 days of fighting for it. Truly, it is worth it for all of us.

It is welcome to hear that it has been a success. The police more widely do not seem to object to the extension of the definition of hate crime. The police are looking to the Government to support them in that action and to ensure that appropriate sentencing facilities are available to support any action they might take.
Contrary to media hype, there was not a surge of reports complaining of wolf-whistling, but arrests have been made for public order offences and actual bodily harm incidents that were classed as misogynist. That certainly reflects the experience of my hon. Friend the Member for Ashfield (Gloria De Piero), who claims that the initiative has been a success. There are specially trained officers in place in a city that has two universities, and the change has made positive difference to women, who feel better able to report unwanted attention and receive appropriate support where necessary.
Ultimately, I hope that if we set our laws appropriately, there will be a reduced need for police intervention, because behaviour and culture will evolve to fit the new standard. Dame Lara Cox, who chaired the Fawcett Society sex discrimination law review, said:
“Laws are instruments in changing attitudes, setting the bar for expectations of treatment and behaviour”.
She made the point that our laws are not stagnant and that they must reflect the reality of today’s society.
The reality, as borne out by campaigns such as #EverydaySexism, #goodnightout, #girlsagainst and, more recently, #MeToo, as well as, internationally, #StopStreetHarassment, is that today’s society is awash with misogynistic acts such as groping, sexual comments, upskirting, revenge porn, sexual remarks, leering and stalking. As the nature of harassment changes, so must the laws that govern it, and too many incidents do not meet the criteria for assault, discrimination or public order offences.
The fact that I have had the temerity to call for this debate—this exploration of ideas—has provoked a backlash of vile fury. I have been told that I am in some way a man-hater, that I have no sense of humour and that I should most certainly learn to take a compliment. Because I am not a snowflake, as has been suggested, that has not dissuaded me from continuing to discuss these ideas, but it highlights why women and girls are so often put off from directly challenging behaviour at the time the incidents occur. They are put off from even reporting them, given that the potential response is so aggressive.
I am pleased that my hon. Friend has introduced the debate, not least because I am a strong defender of the reputation of men. Sexual harassment is not a given—people can choose not to do it—so it is really important in debates that we do not disrespect men by somehow suggesting that they are incapable of controlling their behaviour. I am pleased that she is setting out a way in which we can differentiate between the men who understand the 21st century and those who do not.
My hon. Friend makes an excellent point that is hard to disagree with. Some responses that I have received over the last few days have not shown men in their best light, which is incredibly unfortunate, because all the men in my life accept that any actions or behaviours that put women in an uncomfortable position or make them feel unsafe or not secure in their environment are not acceptable. The defence of some of that behaviour has been quite surprising.
It is a pleasure to be able to contribute to the debate, Sir David, and I apologise for having been a little late, due to the vagaries of the Victoria line. My hon. Friend the Member for Great Grimsby (Melanie Onn) made a powerful speech and has campaigned powerfully on this issue.
Women in Walthamstow feel very strongly about the gauntlet that they too often have to run when they walk down some of our main streets where there are busy cafés and pubs, especially when the weather gets a little warmer. For many, it is a nightmare. As the first female MP for Walthamstow, I have received a deluge of emails from residents who say that they cannot walk down their streets and feel safe during the day time, let alone at night. We have campaigned about this problem for many years—I pay tribute to the Take Back the Streets group in Walthamstow. Literally, women cannot go about their business. This debate is fundamentally about freedom—the freedom for women to be able to use the spaces and places in our society just as equally as men do.
It is a sad fact that Hoe Street in Walthamstow is a gauntlet for women to walk down, especially on a warm and sunny day, and that in workplaces women do not always feel safe. As a society, that holds us all back. Half of women say that they have been sexually harassed at work; one in five regularly experiences sexual harassment on our streets. There is a day-to-day phobia of passing a group of men, although sometimes it is unfounded— I am sure that the hon. Member for Shipley (Philip Davies) wants me to point that out. But all too often, women know that as they walk past, they may be subject to touching; somebody may follow them; and somebody may try to engage them in a conversation, even when they have said no.
The other night, when I left Parliament I was followed down the street by a young man who would not take no for an answer—he kept trying to put his arms around me and touch me. Sadly, that is a day-to-day experience for too many women in our society. The trouble is that women are taught to minimise that behaviour—to brush it off, to somehow find a way of avoiding it, to feel that perhaps they should not be out on the streets late at night or that perhaps they should scream.
Sadly, it is part of our culture that someone feels they have the right to touch and to feel a woman at will. We need to change that. We know that 400,000 women were sexually assaulted in our country last year. That comes from being in a culture not of sex but of power. It is about entitlement. It is about the concept that a woman’s body is the primary thing of interest about her and therefore what matters is how men respond to it.
We should be very clear that this is #NotAllMen. What is so powerful about recognising misogyny as a hate crime is identifying that that is not normal human behaviour. It is not about men and women flirting with each other; it is not about men and women being able to banter with each other; it is not about men and women being able to ask each other out. Perhaps they exist in our society, but I have yet to meet a women who went out with a man who followed her down the street and tried to put his hands on her bottom. It is about being able to say that this sort of behaviour is holding too many back in our society.
Let us look at the figures for sexual harassment of young women in our society: the figure of 50% of women experiencing sexual harassment in the workplace rises to 63% among 18 to 24-year-olds. It is a damning indictment of Britain in 2018 that a young woman cannot start her career without the fear that she might face groping in her workplace, unwanted sexual advances and being told that she cannot seek a promotion if she dares to say no. The #MeToo campaign in particular shows that that is widespread behaviour.
The good news for all of us is that the public are with us. In surveys about sexual harassment, 80% of the public recognise that harassment. No woman should have to fear when she gets on a tube train that the man opposite has a mobile phone with him and what he might try to do with it. Upskirting is a completely unacceptable form of harassment. It is an abuse of the power of a man to define what is important about a woman. No woman should be subject to groping of her breasts in the workplace, but we have seen those reports. Through treating misogyny as a hate crime, we can change the conversation about what is acceptable. That is why I am such a fan of what has been done in Nottinghamshire and why I hope that the Mayor of London follows suit.
We women in Walthamstow know first hand how difficult that is. The honest truth is that when we started recording the spaces and places in our local community where women felt unsafe—where they could not walk past a particular pub or café without feeling attacked or being harassed—the police told us it was a cultural matter. They said we simply could not stop men hanging out together and that that was just what happened. As a big champion and a big respecter of men, I believe that is simply not the case. There is nothing that says that, when men get together, they have to harass women.
Importantly—I really hope the hon. Member for Shipley defends us and supports us in making this argument—making misogyny a hate crime is a way of clearly stating that. It is a way of standing up for men’s reputation and men’s right to be seen as equal citizens rather than as predators in waiting, by separating out unacceptable behaviour and recognising those men who abuse their power and strength. That is the difficult thing. People might think this debate is about jokes, but a rape joke is never funny, because it is always about the power imbalance. It is always about the possibility that someone might follow through and use their physical strength to pin you down—the possibility, when they follow you down the road, that they might follow you all the way home and force their way into your house. That is a threat that women often live with daily.
By categorising sexual harassment as a hate crime, we would change the conversation so that it was not about what women need to do to avoid it. I am sure many of us have been frustrated when police officers have suggested that women need to change their routes. I was furious when my local police suggested to girls at a local school, because we had had reports of someone flashing, that they needed not to travel home alone—that they needed to moderate their behaviour, rather than us needing to catch the man who was doing that. We must change the conversation and say, “Here are people committing a crime.”
We do not let the victim drive what we do about other crimes. We do not say when there is a burglary, “What really matters is that you have better locks on your house rather than that we find the persistent burglar in this community,” but all too often we do when it comes to sexual harassment. We warn women to be careful rather than finding the peepers and flashers. We warn women about being alone at night rather than saying we will put more police on the streets. We say that we cannot tackle men’s behaviour rather than asking them to change.
We have had a great experience in Walthamstow: when we have gone in to talk to café and pub owners, we have found that they want change, too. They recognise that it is bad for their business to have a reputation for being a hotspot for sexual harassment. They recognise that their patrons’ behaviour might be inappropriate and that that is bad for them. We have tried to use anti- social behaviour legislation to challenge that behaviour and to make those businesses take it seriously, but many of them have risen to the challenge without being asked.
That is one of the important things about this conversation and why, for too long, we have let hate crime against women somehow be seen as hate crime against any other protected characteristic. In having the conversation, we have not spoken up for the best of people or for the best of characteristics: treating one other with respect. Respect is not just about being in a workplace with a colleague without feeling the need to touch their bosom; it is also about a man being able to walk along the street with a woman and feel that she is not frightened of him. Yet the honest truth for many women is that if a man is walking behind us late at night, many of us might stop, look at our phones or cross the street. What a damning indictment it is of men in our country that we are in a position where we feel like that!
Making misogyny a hate crime would help us change the conversation about men as much as it would help us ensure that women are safe. I really hope that the Government listen and work with police forces to get this right. My biggest fear is that the police will say, as they have said to me, “What would we do with all the reports?” as though the problem is the amount of data rather than the fact that these things are happening. Data drives conversations. When I talked to people from Nottinghamshire, they made such a powerful case about how data had driven conversations, not just about street harassment but about the connection between sexual assault and violence against women more generally. That has been a powerful way of changing the conversation.
Sir David, 2018 is the year of #MeToo. Everyone asks whether this will be a watershed in the way women are treated in our society. The honest truth is that we will not be able to answer that question until 2019, but I really hope that the Minister listens to the powerful case my hon. Friend the Member for Great Grimsby made and to the pleas from women in places such as Walthamstow and that he helps to ensure that that happens. Perhaps then, in 2019, we will be able to look both our sons and our daughters in the face and say, “Finally, we are moving towards a better society.”
Very much so. I am setting out these points because one’s instinctive reaction might be, “Yeah, let’s go for it”. But we must be mindful of unintended and inadvertent consequences. I wonder whether hate crime legislation is definitively the best way to treat these crimes. Women are not a minority, and I would be hesitant to put us forward as one.
Perhaps I am a little more robust in the way that I would like this abuse and harassment to be treated. Within equalities legislation, it is being a minority covered by the five strands that causes something to fall under hate crime legislation. [Interruption.] I see that the hon. Member for Walthamstow is perched on her seat.
We must be very careful when we talk about being “robust”, because we are putting this back on to women and how they manage these experiences, rather than challenging the behaviour. The Minister says that this is about being a minority, but the disproportionate balance of power in our society means that one “minority”—men—have disproportionate power over women.
These incidents are about the abuse of that power, just as we see the abuse of people on the basis of their religious characteristics or ethnic identity. I do not think the Minister’s minority/majority point is robust enough to defend not looking at whether, if we were to categorise misogyny as a hate crime, that would recognise fully the protected characteristic that we are seeking to include.
I am so glad that the hon. Lady clarified that. I was not for a moment suggesting that women themselves must be more robust in the way they deal with such things. That is not my intention. I am saying that we as a society should be more robust.
It comes down to attitudes—something that has been raised a great deal in the debate. I am treading carefully at the moment with respect to equalities legislation because, as far as inserting anything into the current hate crime provisions is concerned, there are legal wrangles that we have to consider. We want to ensure that any changes that we make in the law to reflect the abuse in question would not have any impact on the five protected strands—of religion, and so on.
No. At the moment we do not have any clear evidence and, as I have said, we welcome the evidence from the pilot projects. However, the practical legislative steps are what we must put our mind to—as we are doing. I am flagging them up as issues that we shall have to settle one way or another.
For example, there are high rates of under-reporting of the existing five strands of hate crime. We would not want to remove the focus from them, because we want to encourage more people to report that they have been abused racially or because of their religion. Perhaps the best way I can sum up our position is to say that the Government are listening.
There have been calls from both sides of the Chamber for a change in attitudes. When I practised at the criminal Bar, I used to say that by the time things have got to court the harm has been done, and it would be much better if they did not happen in the first place. We all need to challenge the attitudes that normalise or excuse the abuse and harassment of women. We have had examples today of the abuse that colleagues have, sadly, faced in their professional lives. I commend their calling out those instances of abuse. Perhaps I may say that I constantly admire the hon. Member for Swansea East (Carolyn Harris) for the beautiful necklaces that she always wears, and I do not understand why anyone would feel they had reason to make any criticism about that.
The Government Equalities Office is taking forward a programme of work to identify and challenge harmful social norms, ensuring that men and boys are included in the conversation as well as women. We need to ensure that all children grow up understanding that we should all be treated with respect, and not abused on the basis of gender, race or religion, and so on. Working with the Advertising Association, we have provided teachers and parents with resources to improve primary school children’s resilience with respect to harmful gender stereotypes. In addition, following on from the successful “This is abuse” campaign—and it was successful in teaching people about what constitutes an abusive relationship and what should be normal and acceptable in a loving relationship—the Home Office and the Government Equalities Office have provided £3 million in the past year to develop and run a new “Disrespect NoBody” campaign, to tackle abuse within teenage relationships and encourage teens to rethink their views on violence, controlling behaviour and the meaning of consent in relationships.
Modern life can impinge on those matters as well, in the form of sexting and so on. We are also engaging with young people on questions of respect and equality to prevent such behaviour in the first place. That is why we have committed to making relationships education mandatory in all primary schools, and relationships and sex education mandatory in all primary schools from September next year.
I completely agree about the importance of getting sex and relationships education into every school. It is age-appropriate and sensitively done, so does the Minister share my concern that parental withdrawal might undermine the principle of giving every young person the best start in life and the best values about how we should treat each other?
I must admit I am naturally cautious about the state interfering—or rather, because “interfering” is too pejorative a term, about the reach of the state into family life. Of course it is justified on occasion, but at the moment I do not have enough evidence to suggest that the rate of withdrawal would be very high; we simply do not know at the moment. Also, we should try to take parents with us. There is a lack of understanding about the education intended for primary school children about relationships and respect. We need to explain that more, so that when children start to receive that education people understand the boundaries of what their seven, eight or nine-year-old will hear in school. I would naturally just pause before setting out such legislation to make it mandatory, before we have evidence about how many families are going to withdraw.
To move on to the legal framework, there are of course criminal laws that prohibit sexual harassment, assault and rape. They include the Protection from Harassment Act 1997, which could cover sexual harassment, as well as the Sexual Offences Act 2003 and the Public Order Act 1986. We want women to know that those protections are there for them in law. It is also vital that when women and girls report their experiences they feel that they are treated with dignity and respect. We have recognised in our violence against women and girls strategy the gendered nature of crimes such as domestic abuse, sexual violence, so-called honour-based violence and stalking. As I have said, we have committed more than £100 million over this spending review period for critical services for victims of those crimes. We are committed to ensuring that victims of sexual assault have access to the specialist support that they need. We are also ensuring that the police and Crown Prosecution Service use the powers that they have to charge and prosecute for the abhorrent practice of upskirting. We are reviewing those powers to ensure that they are still fit for purpose.
Laws need to keep pace with modern life—and upskirting is, indeed, an example of that. We are determined that the internet should not be a safe place for those who carry out threatening or abusive behaviour online, whoever is being targeted. The Government are clear that what is illegal offline is illegal online.

Commons ChamberIn upholding our immigration rules, we seek to assist those who have no right to be here to return home, whether on a voluntary basis or indeed, on occasion, by force. It is really important that we have an immigration system that is robust. We do not have indefinite detention. The hon. Lady will have heard me say that 92% of those held are released within four months and 63% are released within a month. It is important that we have a system where we can be confident that when we are able move people to removal, we have the capacity to do so.
I want to put on record my support for the work that the shadow Home Secretary has been doing on this issue and for the work of my hon. Friend the Member for Stoke-on-Trent North (Ruth Smeeth), who has fought tirelessly for her constituents. I am grateful that the Minister has listened and agreed to review the case. For many of us, the trouble with this is that we are talking about an environment where we know that two thirds of the women in Yarl’s Wood have experienced rape or sexual torture and that 85% of them are then released back, not deported. Does the Minister recognise that, rather than continuing to keep Yarl’s Wood open, there may be not only cheaper but much more compassionate and humane ways in which we can manage our immigration system that would speak to the best of British values?
The hon. Lady will have heard me say that 95% of immigration offenders are in the community and only a very small proportion—5%—are in detention. However, detention does play an important part. We will keep people in detention where there is a realistic prospect of removal and where they might cause harm out in the community. It is important that we retain that facility.
