Councils are at the forefront of seeking to meet the needs of children with special educational needs and disabilities and their families, and they are being let down by a system that is broken and that the NAO shows is completely unsustainable. So we will work at pace in government, working with teachers, parents, schools, school support staff, the health service and local authorities to ensure that children get the opportunities they deserve.
Devon county council projects an overspend on special educational needs of £38.5 million. That is explained partly by additional travel costs in rural areas such as mine in mid and east Devon. The last Conservative Government threatened that such an overspend would put at risk the so-called safety valve for Devon. How will the Minister help enable good-quality SEND support to be delivered closer to home?
The hon. Gentleman is right that the solution to many of these challenges is to create inclusive mainstream education in every community, so that every child can benefit from it and thrive.

I respectfully disagree. Many concerns were expressed that unintended consequences of the Act would create a disproportionate burden, and that is why we have paused it—to step back and to reflect on whether the measures introduced by the Act are needed. We absolutely know that it is necessary to uphold freedom of speech. Provisions on freedom of expression still exist in legislation and will be upheld, and we need to make sure that we have the space to have a constructive dialogue on these issues rather than a battleground for ideological clashes. We are considering the next steps and will report in due course.
When the Minister considers whatever comes next after the Higher Education (Freedom of Speech) Act, will she consider the business of foreign funding for international students, their scholarships and research institutes? In particular, will she ensure that no tests or conditions are imposed by other states on international scholarships, bursaries and funding for research institutes?
The hon. Gentleman tempts me into a much broader discussion on higher education. We recognise the challenges, but also the opportunities in this sector. I am sure the Minister for Skills will be listening to the hon. Gentleman’s concerns and considering them as part of the wider work on ensuring we support our higher and further education sectors in the best way, which is what they deserve.

Commons ChamberWorking with employers is central to success on that point. That is why we are delivering the local skills improvement plans to ensure that we are matching the needs of businesses and employers with the workforce they need. We are working with over 5,000 employers, with over 700 different occupations, including on skills bootcamps, which bring different demographics to the workforce, to ensure that we have intensive training where industries have those skills needs. Engagement with businesses is at the forefront of our mind on that point.
This weekend, The Times reported that some Conservative MPs want to see graduate visas banned. Will the Minister ask the Home Secretary to quash that damaging rumour, given that international students provide the UK with a £42 billion boost?
We are home to some of the world’s top universities, which benefit from strong international ties. We think it is right to try to prevent any potential abuse and to protect the integrity of our higher education system, but it is true that international students make significant economic and cultural contributions to our education. We believe it is possible to balance a fair and robust migration policy with maintaining our place as a top destination for students from around the world.

Commons ChamberThat sounds like typical behaviour from a Lib-Dem council. At the end of last year, we allocated £100 million in capital funding—every local authority got some of it—precisely to help providers like the one my right hon. Friend described to expand, upgrade their buildings and so on. I would take that answer and see what the council is doing with that money.
Last year, 3,000 childminders left the sector, with the Early Years Alliance estimating that the current offer for three and four-year-olds is underfunded by £1.8 billion. That is impacting hard-working parents, particularly in rural areas such as the one I represent. Amelia, a provider in Cullompton, let me know that Devon gets just £5.20 of funding per hour for the care of three to four-year-olds, which is way below the rate in some urban areas. Westminster, for example, gets a rate of £8.17 per hour. What will the Minister do to address that imbalance and ensure that people struggling with the cost of childcare in rural areas are not short-changed?
In September we put in more than £200 million to increase rates, and in April we have put in a further £400 million to increase rates, in part to help providers meet the costs of the 9.7% increase in the national living wage that the Government have made, so rates are going up. Specifically on childminders, we have been doing a few things. We have a childminder grant scheme to try to encourage more childminders into the sector, and we have also been consulting on things that would make their lives easier and more flexible, and allow them to be part of more networks, so that we can grow what is an important part of the childcare market.

Commons ChamberTertiary education providers are themselves businesses that seek to meet local skills needs, and the University of Exeter is no different. It hosts international students who contribute £486 million to Devon’s economy. People in Devon do not think of these students as immigrants, given how this funding helps boost skills among local people, so will the Minister talk to his counterparts in the Home Office about taking students out of the net migration figures?
As a former Exeter University student myself, I know how brilliant it is, and it also has a huge and incredibly successful programme of degree apprenticeships. I am very supportive of international students; they bring a lot of income to our country. Visa matters are always matters for the Home Office but I am sure there will be discussions about the issues raised by the hon. Gentleman.

Ministerial CorrectionsIt is precisely because of the figures the hon. Lady sets out that we are helping students, with £276 million to try to ensure we help the most disadvantaged students. Her own university—she mentioned Nottingham University—gives a £1,000 bursary to disadvantaged students. We are also giving up to £90 billion of extra help to disadvantaged families, we have frozen tuition fees and we look at maintenance loan repayments if family incomes fall by at least 15%, so we are doing everything possible to support the most disadvantaged to get higher education.

Colyton Grammar School in my corner of Devon is one of the 27 schools added today to the list of 147 schools already known to have RAAC on site. The National Association of Head Teachers has pointed out that propping up ceilings with metal poles is clearly not a serious option. I want Colyton Grammar School to be able to open up the small part of its estate that has had to close, but if there is new money, and works will not impact on the existing school rebuilding programme, what impact can we expect them to have on funding pledged last year to schools such as Tipton St John Primary School and Tiverton High School?
I can assure the hon. Gentleman that we are doing a very professional job. There is no intention of propping schools up with metal poles; they will largely be horizontal props involving tempered beams, which is how buildings are built in the first place—[Interruption.] The hon. Member for Houghton and Sunderland South (Bridget Phillipson) shows her absolute ignorance of this. They will be either steel structures or wooden structures that will then have another roof underneath. I urge everybody to go and look at these classrooms, because they will see that there is no vertical propping—not in any of the schools that I have seen so far—and that is certainly not a long-term solution. The hon. Gentleman will be satisfied that these are very high-quality solutions for our children.

Commons ChamberAsbestos management in schools and other buildings is regulated by the Health and Safety Executive, as the hon. Lady will know. As part of that, the Department has published bespoke guidance on asbestos management. The “Asbestos management assurance process” was a survey launched in 2018 to understand the steps that schools are taking to manage asbestos. The DFE published a report of the overall findings in 2019, which showed that there are no systemic issues with schools’ management of asbestos. The HSE advises that as long as asbestos-containing materials are in good condition, well-protected and unlikely to be damaged or disturbed, it is usually safer to manage them in situ. But where they are dangerous, they of course take priority in all the capital bids that schools make.
The condition of buildings and premises is dynamic. We know that buildings need looking after and maintaining, which is why we have allocated more than £15 billion to improve the condition of schools since 2015, including £1.8 billion committed in this financial year. We allocate funding by taking into account the data we have on the condition of schools, so that schools in relatively poorer condition attract more funding. In December, we also made an additional £500 million of capital funding available to improve buildings and facilities, prioritising energy-efficiency. In addition to providing annual capital funding, our 10-year school rebuilding programme is committed to rebuilding or refurbishing school buildings in poor condition across England. We pledged to upgrade 500 schools in this programme, and we have already announced 400, including 239 in December, reserving some places for the future.
I am impressed that the Minister manages to maintain a relaxed, calm tone when talking about this, because Councillor Jess Bailey, from my part of Devon, has said:
“I have witnessed children as young as four and five practising their escape drill with a rope across the road to prevent children being swept away in the rising waters.”
Tipton St John Church of England Primary School, which she is describing, has been identified to join the school rebuilding programme, but my concern is that such schools are being rebuilt at a rate of 50 per year —projects are commencing at that rate. Yesterday, I learned that the west country received the lowest allocation in respect of condition improvement fund bids in the country. I question whether the west country is being looked after by this Department.
The hon. Gentleman almost answered his own question, because I understand that the school he referred to was successful in the school rebuilding programme. It is difficult to respond to hon. Members’ questions and concerns when they highlight the fact that schools are rebuilt and that where there are serious problems with them, capital funding is available under a range of funds that schools bid into.
To qualify for the school rebuilding programme, schools such as the one the hon. Gentleman mentioned were assessed on their condition. Nominations for inclusion in the programme could involve including evidence of buildings in exceptionally poor condition or of potential safety issues. The bids were robustly evaluated by specialists and in the latest round all nominated schools with verified structural issues that met the programme’s criteria were included in the programme.

It is a pleasure to serve under your chairship, Mr Sharma. SEND services in Devon have been in serious crisis for a long time, probably three or four years, with the situation deteriorating lately. Last year, Devon County Council apologised for failing to improve SEND services, and promised that things would improve and that it would redouble its efforts. We are continuing to see a problem around a lack of political leadership and of oversight at the council. My postbag is heavy with correspondence from constituents who are at their wits’ end trying to get the support and educational placements that children need.
The wait times for assessments are far beyond the statutory 20 weeks. The lack of educational psychologists is leaving families uncertain, having to juggle work commitments and looking after their child at the same time. It is definitely leading to people being outside of the workforce who would otherwise be fulfilling an important role in it. The looming threat in Devon of these services being placed in special measures, or removed from the council’s remit, shows that things must change. The promise of more money in the forthcoming council budget is welcome. The Government’s recent announcement of a new SEND school at Cranbrook is again welcome, but we need to ensure that taxpayers’ money is being spent effectively to deliver the SEND placements that our children deserve.
I have had constituents contact me to highlight situations where a child is allocated a placement that is wholly unsuitable for them, and the child cannot take it up but remains on the school roll, with the funding also remaining assigned to that school. We need to ensure that money follows the child and that appropriate frontline services are delivered regardless of where the child then moves. I have seen for myself in East Devon that SEND pupils are being taught in cupboards and storage rooms, and I know that that is not unique to my part of Devon, because I have also seen it reported on the BBC. We should not allow that to continue. I cannot help but admire the parents who are pushing Devon County Council and the Government on this. Devon SEND Parents and Carers for Change staged a protest at county hall in Exeter last month, and they are trying to shine a spotlight on some of these failings.
It is not all gloom; there are some examples of best practice. My constituent, Danielle Punter, has written books and a blog—autability.co.uk—with tips on education and support in understanding neurodivergence. Danielle pointed out last month that when partial school closures happen as a result of lockdown or strikes, it is often special needs school pupils who are most affected, because those schools need to be fully staffed in order for children with a high level of SEND requirements to get the best possible care, otherwise they need to stay at home. In short, we need to get to grips with some of these repeated failures, particularly in Devon, and that will require political leadership and political oversight.
I am now formally introducing a four-minute time limit.
