At this stage, any deal that comes back from this Government ought to be put back to the public for them to decide whether those are the terms they want to leave on or not. I came to that position slowly, because I thought that if consensus was built over the two to three years since the referendum, there might have been a deal we could agree, along the lines I have suggested. But that consensus was not built, time has gone by, the deal has not gone through and now we are in a position where we cannot break the impasse without going back to ask that question. I hope that question is asked on the basis of the “best deal” that could be negotiated, by which I mean the one that does least harm to the economy and best protects the Good Friday agreement. Those are two extremely important red lines as far as I am concerned.

My right hon. and learned Friend has made an incisive point. Does he agree that this Government’s mismanagement over the past few years has been tragic in how they have tried to monopolise the negotiation on such a critical national issue? Their own partisanship has visited this grief on the country in this way, which is why the only way now to break this deadlock, this impasse, and the acrimony that has built up in our country is by discharging this through a public vote.

I do agree. I cannot help feeling that in 2015 we had a Prime Minister who promised a referendum we did not need in order to try to hold his party together, then we had a Prime Minister who would not reach for consensus because she was calculating the numbers on her own side instead of the numbers across the House and now we have a Prime Minister with an absurd do-or-die pledge, which is counter-intuitive and not putting the interests of our country first.

Let me just make this broader point: our central concern in all of this has been about the extent to which any deal will protect the economy, jobs, rights and security, not about the backstop and not the border situation in Northern Ireland, which is obviously the intense focus of the discussions going on at the moment. That is why I rejected the last Prime Minister’s deal, and it looks as though any deal the current Prime Minister manages to secure—if he does—will be worse on both the backstop and on the wider question.

On the question of the border in Northern Ireland, a summary of proposals was presented to the House on 2 October, but they were not promising, because from that summary it looks as though the Government are going back on the commitments that they made in the 2017 joint report, and their proposals would unavoidably mean physical infrastructure on the island of Ireland. The proposals lack any credible mechanism to ensure the consent of all communities in Northern Ireland, which is a central tenet of the Good Friday agreement. Frankly, it was wrong to go down the route of a veto in Northern Ireland in relation to the Good Friday agreement, which absolutely depends on the consent of both communities for anything that happens under that agreement. If the proposals have changed significantly, I would ask the Secretary of State to update the House, but we remain cautious and will not support proposals that lead to a hard border in Northern Ireland or undermine the Good Friday agreement.

On the wider issue of the protection of the economy, jobs, rights and security, the Prime Minister’s current proposals on changes to the level playing field arrangements tell their own story. The seven-page explanatory memorandum that the Prime Minister put before the House says:

“There is…no need for the extensive level playing field arrangements envisaged in the previous Protocol.”

He has made no secret of the fact that he wants to step off the level playing field arrangements. I remind the House why those arrangements were previously included and are so important: they ensure that the UK cannot deregulate or undercut EU rights and standards. They were always minimum protections. We would have liked them to have been written into the withdrawal agreement. It is extraordinary and deeply significant that the Government have now decided to strip away even these basic protections.

The bigger point—this is not a technical point about what is in or out of this particular deal—is that it sets us on a course for a distant relationship with the EU and gives the green light to deregulation and to diverge. That is what the Prime Minister has said is his intention: to diverge is the point of Brexit. It is really important that we make it clear that that kind of deal—one that rips up the level playing field for those at work, for the environment and for consumers—could never be supported by Labour and could never be supported by the trade union movement. If the Prime Minister brings back a deal along those lines, he should have the confidence to put it back to the people in a confirmatory referendum, because such a deal would have profound consequences.

The concern is about not just the technicalities of the level playing field—although it is a technical question—but the political ramifications. Once we have decided to diverge from EU rules and regulations, we start down a road to deregulation, and it is obvious where that leads. The focus on trade and on our rights and regulations will move away from the EU—

My hon. Friend is quite right. The elections in December 2017 gave the people of Catalonia the right to exercise their democratic mandate, and they did that. That created a regional Parliament that has debated the questions before Catalonia, including the question of independence, several times. It is for that mechanism, and the mechanism in the Cortes Generales if necessary, to amend the Spanish constitution to allow for legal plebiscites to take place. It is a matter for that procedure and not for illegal procedures which, of course, only cause more harm than good.

The Minister talks about acts that are lawful. We know of many acts in history that have been lawful. I am thinking of the response of the British state to the Easter rising 103 years ago—it might have been lawful, but it can be best described as a massively counterproductive act of repression. Will the Minister urge his Spanish counterparts to at least learn the lessons of history before further inflaming situations and encourage peaceful dialogue and reconciliation?

I am grateful for the hon. Gentleman’s question. I think the Spanish Government and Spanish parliamentarians of all stripes and colours will be exceptionally mindful of history. If anybody has read Antony Beevor’s “The Battle for Spain” about the terrible events that took place in Spain between 1936 and 1939, they will understand what can happen when disagreements get out of hand. I am sure that the Spanish Government, the Spanish Opposition and many people in Spain are very mindful of that.

We can make our position clear both to the Administration in Hong Kong and to my Chinese opposite number, as the Prime Minister and all Members of the Government do. We also need to work with our international partners to look carefully at the situation to ensure that we are telegraphing as clear and broad a signal as possible to the Government in Beijing about the concerns that my hon. Friend rightly raises.

Further to the comments from the hon. Member for Ochil and South Perthshire (Luke Graham) about the Chinese side repudiating the joint declaration, will the Foreign Secretary consider making it clear to the Chinese side that there is disquiet in this House about the status of BNO nationals and that if China continues to repudiate that international treaty, this House would consider revisions to the Hong Kong Act 1985 to extend full citizenship to BNO nationals?

I do not think that the point right now is to issue threats to the Government of China. The UK and our international partners need to be very clear that we want to respect the one country, two systems model and that some of the things that we are seeing in Hong Kong and the military build-up of troops on the Chinese side of the border—about which concern has been expressed on both sides of the House—would put that at risk.

As my hon. Friend will know, we are very careful about talking about sensitive intelligence. I can tell him that contrary to the Houthi claims that 10 drones were used, imagery of the damage caused clearly shows that there were not just 10 but between 16 and 19 strikes on the Abqaiq facility. Imagery from the site also shows the remnants of Iranian-made land attack cruise missiles and, frankly, attacks of this scale and sophistication could not have been done by the Houthis.

Although I welcome the Government’s commitment to the International Maritime Security Construct, the British capacity to contribute to it has been impaired by the Government cutting the Royal Navy surface fleet by a third. What are the Government going to do to enhance British capacity to contribute to the protection of freedom of navigation in the Persian gulf, including British merchant shipping?

We have assets in the region. We are contributing to the IMSC and we—[Interruption.] The hon. Gentleman says not enough, but what we actually need to do is get the broadest international support for that and a bit more support from our European partners. We need to bring the Europeans and the Americans together—Australia is already involved, as are other partners—and to have a burden-sharing arrangement that means we can police the strait of Hormuz and the other freedom of navigation areas in the region as effectively as possible.

I am unable to confirm that I have any such evidence; I have not been advised as such. Obviously, it is very much our view that any police response should be proportional and lawful. Of course, if the demonstrations are peaceful, we hope that no such violent, or forceful, response is in any way needed, but if there are acts of vandalism, that would then put any such engagement into a different context.

While the escalation in violence in Hong Kong is deeply regrettable, and every effort should be made to de-escalate it, it is clear that there is continuous provocation by the Chinese side, particularly with regard to the repudiation of the validity of the 1984 Sino-British joint declaration that underpins the highly successful one country, two systems structure that has guaranteed Hong Kong’s success. Far from simply asserting Britain’s continued recognition of that declaration, what will we do to enforce it in practice?

We are not a position to, as the hon. Gentleman puts it, enforce it, but if there were a breach, as I said, we would engage China in a proper bilateral discussion. We speak very forcefully and loudly about upholding the 1984 agreement, and, in doing so, the hon. Gentleman is absolutely right in what he calls for.

I understand that my right hon. Friend swam a long way—I am a non-swimmer myself—and raised a lot of money. I hope that in the two neighbouring parts of Essex he and our hon. Friend will be sinking rather than swimming. [Interruption.] I think I got that the wrong way round. I meant “swimming rather than sinking”. [Interruption.] I always thought I would be the straight man in the Foreign Office—that was certainly the case with the last Foreign Secretary.

As my right hon. Friend knows, he and I disagree slightly on this matter. We feel that the JCPOA is the only game in town. We feel that, broadly speaking, it has worked, and we wish to see it work. I know that my right hon. Friend takes a different, albeit very principled, view, but we will continue to do all we can to ensure that the JCPOA succeeds in its own terms.

Obviously the risk of an escalation in the middle east will be significant if Iran decides to resume its nuclear programme. What is the Minister doing to address the risk of a further escalation, with responses from Saudi Arabia and also Israel, and a potential arms race in the middle east?

I can give that assurance. We obviously want to defend human rights everywhere, and we want to maximise our trade, but we will not pursue a trade opportunity at the expense of human rights.

It is difficult to fathom the logic of such senseless barbarism in Saudi Arabia’s policies, and this has wider implications, particularly in relation to Iran and the geopolitical stability of the middle east. At what point will this country’s commercial and geopolitical interests come second to the need to demonstrate moral courage and real economic consequences of Saudi Arabia’s continued behaviour?

Absolutely. We were particularly concerned by the Hong Kong authorities’ unprecedented rejection of a visa extension—it was actually a small visa extension for the senior British journalist Victor Mallet who is now the Paris correspondent. It was simply a matter of the last two or three months of his time in Hong Kong that was at stake. In the absence of an explanation from the authorities, we can only conclude, as my hon. Friend rightly points out, that this move was politically motivated. I believe that it undermines the basic idea of freedom of speech and freedom of the press in Hong Kong, which, as I have said, are guaranteed by that joint declaration.

The creation of Hong Kong was a fantastic example of British-Sino co-operation in building a global city that is a massive player in the global economy. Indeed, the Sino-British joint declaration itself was a great achievement of co-operation and it was done with great sacrifice from the British side, as Hong Kong Island and Kowloon, had been part of the British territories in perpetuity. It was done for practical and diplomatic reasons. Can the Minister reassert the continuing mandate that Britain has to ensure that the Sino-British declaration is respected until July 2047? What practical steps will he take to achieve that?

The hon. Gentleman makes a very good point. In many ways, the joint declaration and the Sino-UK discussions were a fantastic template for broader co-operation and it is to our regret that that is now under pressure, and we will continue to stand up for it. I will, if I may, make this point. Obviously, there has been speculation in relation to what might happen in the broader region around Shenzhen and Guangzhou, which may be linked together as a particular region along with Hong Kong. Again, we will keep our eye on exactly what changes are being made in that regard, although one can see the importance of the interconnections economically within the broader region. I shall certainly be noting what happens in the greater bay area, which is an area that I am looking to visit later this year. I will be going to Guangzhou and Shenzhen and then to Hong Kong at the same time. Obviously, we will report back to the House after that time.

The hon. Lady represents a city centre seat, as I do, and I am well aware of the issues faced by people who want to make their lives in the United Kingdom and who would make a great contribution here. Those people want their situation to be regularised, but these are inevitably issues for the Home Office. I am sorry—I am not trying to get out of this matter, but I think it would be useful for her to contact the Home Office with the specifics.

Libya is a country with immense potential, given its resource wealth and its position in the Mediterranean, yet there is something quite tragic about the fact that, having effected the displacement of its Government, the British state has not been in any way competent in effecting the transition to a peaceful solution in Libya. We have to take responsibility for that reality. What will this Government do to ensure that the United Nations-backed Government of national accord are properly resourced to effect security and stability on the ground? They are clearly failing to do that at the moment, and they are being displaced by other forces sponsored by other foreign powers.

While everyone needs to take responsibility for issues that have happened in the past in Libya, it would be a little unfair to suggest that things were perfect before our engagement there in 2011. We all recognise that there have been major problems for some time, but the tragedy of what has happened in Libya and elsewhere is that things at least seemed to be better when there was a strongman dictator in charge, and that when we tried to move towards a more pluralistic and democratic outcome, things got worse. In my view, that should not in any way be a justification for dictatorship or autocracy, but it has tended to be the case. A number of dictators, including Gaddafi, have been supported by the west in the aftermath of 2003 and leading up to 2011. These are difficult issues that we inevitably have to deal with, but responsibility has to be shared with the people on the ground. The tragedy of what has happened in Libya is that it has been a divided country almost since it was created—it was created using rather an artificial divide—and the only time there appeared to be stability was under a dictatorship. That is a terrible lesson for future generations of Libyans to learn.

I think people would see it as very curious that a country that voted to take back control was choosing to cede control in a number of areas of vital national interest. I think they would also be concerned that it would not resolve the national debate on Brexit, because many of the people who voted for Brexit would not see this as delivering a true Brexit.

Will the Secretary of State recognise the incredible action by thousands of young people across our country in striking for action on climate change? Will he not only recognise that we are facing a global emergency on climate change, but declare a national emergency on climate change, just as the Labour party has done?

I very much welcome young people being involved in climate change issues; I do not welcome quite so much their missing school to do so. I would say that we are making a lot of progress in this country—in fact, I think we have done more than anyone else in the G20 on climate change—but it is not enough. As a global community, we still need to do more, which is why we want to host COP 26 and galvanise the world to take more action.
