Commons ChamberMy right hon. Friend is absolutely right to emphasise the importance of work. I often say, with no irony whatsoever, that I spent a very happy 12 months at the Department for Work and Pensions. I am conscious of the importance of work for people’s physical, mental and emotional wellbeing, not to mention the fact that children are better off when their parents are in work. My right hon. Friend is absolutely right to mention integration. I commend the work of the Ministry of Housing, Communities and Local Government on its integration Green Paper, and the Home Office is working closely with it.
I wonder whether in her own surgery the right hon. Lady has ever had to look an asylum-seeking constituent in the eye and explain to them why they are forced to walk around with a plastic card that says, “Not permitted to work”. The right to work is a fundamental human right, so is it not about time that the Government extended that right to all asylum seekers?
I hope that the hon. Gentleman was listening when I made the point that the policy is about protecting the labour market for British workers. Of course I have met asylum seekers in my surgery. Indeed, the ward of Swaythling in Southampton has one of the highest numbers of supported asylum seekers in the entire city, and it falls within my constituency. It is important that we get the balance right and find out how we can best support people into work, but what we do not want to do is create perverse incentives for people to seek to come here by circumventing our important immigration rules, which reserve the right to work for those who have applied through the correct processes.

Commons ChamberAs this debate approached, I reflected on one of the first experiences I had when I first stood for election in 2017. It was at a hustings—although they seem to be a dying art in election campaigns, they are still a very important aspect—and I remember being challenged by a guy in the audience about what my party’s policy on immigration was. I gave a very full-throated argument in favour of immigration and why we need it. After the hustings was over, he came up to me and said, “Look, before the public meeting tonight I was intending to vote for you, but because you are so pro-immigration, I can’t.”
It was probably that experience that led me to reflect on how we managed to get into a situation where immigration has become such a hotly contested issue. There is an argument that during the Brexit referendum, leadership on this issue was completely absent from the main political parties. I believe that immigration is fundamentally a good thing, and that if politicians talked about it more, we would be less likely to be in this position. There is a degree of hypocrisy when we speak to some of our constituents. When we talk about immigrants, that means people who come here from Europe, but when we talk about people going to live in Spain, we call them expats. People will complain, “They don’t speak our language when they are on the streets of Glasgow,” but when I go on holiday to Gran Canaria or Tenerife, I do not often hear many British people speaking Spanish, so there is a degree of hypocrisy there.
On the issue of hypocrisy, I want to address very directly the absolute mess that the UK Labour party found itself in this afternoon. The shadow Home Secretary opened the debate by saying that Labour would abstain on Second Reading. It took 135 miles for Jesus and Paul to walk the road to Damascus, but today it took an hour and 35 minutes for the Labour party to make a U-turn on its position. That shows the absolutely nonsensical position that the Opposition have found themselves in—and it is the same with Brexit. If someone is trying to ride two horses, eventually those two horses will give way. What we saw today is the very beginning of that for Labour, and its Members should reflect on that.
We have to be very, very upfront about the benefits of immigration, because if we are not, there will be major challenges coming down the track for us, in terms of not just our economy and our public services, but social care. We know that the number of people with dementia will have increased by about 40% in 12 years’ time, and that means more people in care homes. It is a sad thing, but the vast majority of people that I went to school with do not like the idea of going to work in care homes—of wiping people’s bottoms or serving meals. If we do not confront the reality of our ageing population, we are going to have a very serious problem with regard to our current argument on immigration.
My hon. Friend makes a very powerful point. It is not simply about providing labour; it is also about the taxes that these immigrants will pay, which are needed to fund the social services that so many people rely on.
Absolutely. My hon. Friend almost anticipates my next point. We have an ageing population, and people are going to have to be looked after. People will live for longer and we will need others to fund the tax base that pays for their pensions, so there is absolutely an economic argument for immigration as well.
As I was preparing for this speech, I reflected on the fact that we begin the sitting day in the House of Commons with a prayer in which the Speaker’s Chaplain says:
“May they never lead the nation wrongly through love of power, desire to please, or unworthy ideals but laying aside all private interests and prejudices keep in mind their responsibility to seek to improve the condition of all mankind”.
We stand here at half-past 2 and pray that to God. We say, “Let us take decisions not just to please people but for the right reasons.” In reality, we find ourselves in a position politically in which we are not leading anymore—we are reacting to public opinion.
I make no apology for the fact that I took a very pro-immigration stance at the hustings that night. Tonight, with a German surname, I will walk through the No Lobby and vote against the Bill because I believe in the free movement of people. The sooner that Members get to grips with the challenges coming down the track and the benefits of free movement, the better, because we have serious challenges, and any vote for this Bill would be a seriously retrograde step.

Commons ChamberI very much welcome that intervention. This is probably a good moment to pay tribute not just to the organisation my hon. Friend mentions, but to organisations across Scotland and the United Kingdom that do such good work on the ground to try to divert people away from violence.
I agree entirely with what my hon. Friend the Member for Glasgow East (David Linden) said. We can all think of similar initiatives in our own constituencies. The Children’s Wood in Glasgow North primarily supports teenagers who start to engage in antisocial behaviour. Instead of just calling the police to get them taken away, local volunteers went out and worked with them. Now those same teenagers, instead of being involved in antisocial behaviour, are active parts of that community. That preventive strategy is seen at all levels.
I thank my hon. Friend for his intervention, which highlights another very useful and innovative community response.
Both the Minister and the right hon. Member for North Norfolk (Norman Lamb) mentioned the impact of adverse childhood experiences—ACEs. More recently, and significantly, this has been an increasing focus of Scottish Government policy. There is increasingly convincing evidence about how certain adverse childhood experiences can result in long-term effects on learning, health and behaviour. Remarkable research in Wales found that people who reported experiencing four or more ACEs are 15 times more likely to have committed violence, 14 times more likely to have been victim of violence in the past 12 months, and 20 times more likely to have been in prison at some point in their life. Many other studies show similar links, so working to prevent ACEs at all and to build resilience for those who have already experienced them now underpins policies in all areas. An ACEs hub, co-ordinated by NHS Health Scotland, is progressing national action, and the implications for justice policy are now reflected in the Government’s “Justice in Scotland: Vision and Priorities” for 2017 to 2020.
While detailed policies cannot simply be transplanted from one community to the next, and each has to be tailored to local need, there is no doubt that the principles behind a public health approach to violent crime, and particularly violent youth crime, are absolutely solid and evidence-based. I welcome, for example, what Mayor Sadiq Khan has done in establishing a violence reduction unit in London.
Similarly, the UK Government’s serious violence strategy includes some welcome steps, including the establishment of the new national county lines co-ordination centre, which the Minister mentioned, and a move towards a public health approach, but there are those who have expressed concern about it. Critics have expressed the belief that it is still overly dominated—certainly, as regards youth justice—by a criminal law enforcement response, with insufficient emphasis on some drivers of serious violence, such as poverty, and insufficient recognition of the impact of trauma on children caught up in serious violence. That is what some critics are concerned about. The Minister is a former colleague from the Home Affairs Committee, and I know that she is absolutely committed to this issue, so I hope that she can bring the Government with her in being able to respond to these questions and criticisms in the best way possible by investing in putting public health front and centre of their ambitions to tackle youth crime.
The Minister also mentioned the Offensive Weapons Bill, which was a welcome, if small step, as I said when we debated it. She mentioned a consultation on a statutory duty, which seems fine to me. We will monitor that with interest. However, I think we all absolutely agree that we cannot legislate our way out of these issues any more than we can arrest our way out of them. These challenges require evidence-based strategy and policies, and, as hon. Members have said repeatedly already, they require urgent and significant investment in them. Ultimately, everyone benefits if Government genuinely and urgently commit to that approach. We will support any and all initiatives that reflect that approach.

Commons ChamberNo, I do not accept that. I speak regularly with politicians from all parties in the Republic of Ireland and that is certainly not how they see matters. In fact, politicians, businesses and the wider community in the Republic are broadly very happy with the way in which the European Union has dealt with this. It is sometimes conveniently forgotten in this House that Northern Ireland voted to remain in the European Union. It is forgotten partly because Northern Ireland has not had the democratic voice of its Assembly during this time. It is only the voice of the right hon. Member for East Antrim (Sammy Wilson) that has been heard here in relation to Northern Ireland, but his party, the Democratic Unionist party, does not represent the majority of people in Northern Ireland, who voted to remain. The Prime Minister has refused to meet the Greens, the Social Democratic and Labour party, Sinn Féin or the Alliance, which is quite disgraceful.
Meanwhile, in Scotland, the people voted to remain in the EU by an even more substantial margin than that of Northern Ireland. It was 62%, and polls show that if a vote were held tomorrow, the figure would be nearer to 70%. Despite that, the Scottish Government have concerns. They are a democratically elected Government, although I know that those on the Conservative Benches like to call them the SNP Government and pretend that they have no legitimacy. They were elected democratically, and their legitimate concerns, which are often supported by other parties in the Scottish Parliament—as they will be today when the Liberal Democrats, the Greens and Labour will vote with the SNP to try to protect Scotland from the consequences of Brexit—have been wholly ignored. We can only look on with envy as the concerns of the Irish Government are placed centre stage in Brussels. Unlike Northern Ireland, Scotland has had a strong and functioning Government and Parliament during this process that have been well able to express their views, but that has not protected us. This Brexit process has highlighted the limits of devolved—as opposed to independent—government.
My hon. and learned Friend is absolutely right. We fully expect the Scottish Parliament this evening to endorse a cross-party motion rejecting the withdrawal agreement, just as the Welsh Assembly did last night. The Scottish Conservatives are describing that debate as needless. They suggest that Scotland does not need to talk about Brexit, that the big Parliament in Westminster will make that decision for us and that we should know our place. That exemplifies just how they want to undermine devolution and use Brexit to do so.
Of course, of the Scottish Conservatives do not represent the majority of Scottish opinion in relation to anything, let alone Brexit. It is often forgotten, after the hullabaloo when they won seats here last year, that they are still very much in the minority in Scottish politics and the Scottish Parliament.
Let us look at what has happened to Scotland in the past two years. The UK Government cut the Scottish Government out of the Brexit negotiations completely. The Scottish Government put forward the idea for a differentiated deal or a compromise for the whole of the United Kingdom at an early stage, but that was completely ignored. The Scottish Parliament voted—with the cross-party support of everyone apart from the Tories and one Lib Dem—to withhold consent to the European Union (Withdrawal) Bill, but that, too, was ignored. When the Scottish Parliament tried to pass its own legal continuity Bill, it was challenged by the British Government in the UK Supreme Court, and we are still waiting for that decision. When amendments to the withdrawal Bill came back from the House of Lords to the Floor of this House, Scottish MPs got 19 minutes to debate the implications of those amendments, with the rest of the time being taken up by the Government Minister. Scotland is not mentioned in the withdrawal agreement or the political declaration, while little Gibraltar—important though it is—was afforded advance sight of the agreement. The Scottish Government saw it only when the rest of us did.
My point is that Scotland’s marginalisation and its very weak bargaining position within the Union that is the United Kingdom have been very exposed by Brexit. After our failure in the independence referendum of 2014, 56 Scottish National party MPs were elected to this House, yet not one of our amendments to the Scotland Bill at that time got passed, despite the fact that we had 56 of the 59 seats in Scotland and 50% of the vote at that time. We were told that the wonderful Scotland Act was going to give us huge amounts of power and that we would have the most powerful devolved Parliament in the world. I would like to ask any fair-minded person in this Chamber, and anyone watching, whether they think the sequence of events I have just described really makes it sound as though we have the most powerful devolved Parliament in the world. Of course it does not, because devolution’s constitutional fragility has been revealed by Westminster’s assertion of control and attempts to repatriate powers here from Brussels, and by the disregard shown for Scotland’s preferences in the negotiations in Brussels.
The Brexit process has told Scottish voters a lot about the reality of devolution. It has told them that power devolved is indeed power retained, and that the United Kingdom is not the Union of equals that we were told it was before 2014 but a unitary state where devolved power is retrieved to the centre when convenient and where no one but the Conservative party, which represents only a minority of voters in Scotland, gets a say on major decisions over trade and foreign policy.
The experience of Ireland and Scotland during the Brexit process shows a significant contrast between the way in which nations that are member states of the European Union and nations that are members of this Union are treated. I heard the distinguished former Taoiseach of the Republic of Ireland, John Bruton, speak recently. When he was asked about this by a member of the audience, he said that Scotland’s marginalisation within the United Kingdom would not happen in the European Union, and that if the European Union were taking a decision as drastic as Brexit and it had only four nations in it, all four nations would need to agree. In the UK, however, it does not matter what Scotland and Northern Ireland say. They can always be overridden by the English vote. That is not an anti-English comment; it is a comment on the constitution of the United Kingdom. If Scotland were a member state of the EU, even though we are a country of only 5.5 million people, we would have the same veto as Ireland over such a major decision, in the same way that the big countries have.
There is still a little bit of hope for Scotland, and it comes from the cross-party working that we have seen there, both in the Scottish Parliament today and from the group of politicians, of which I am proud to have been a member, who took a case to the Court of Justice of the European Union. We found out yesterday that the advocate general says that proceedings under article 50 can be unilaterally revoked. I was interested to hear the Prime Minister acknowledge earlier today, in response to a question of mine, that it is highly likely that the grand chamber of the Court will follow the advocate general’s opinion. It seems that Scotland, Scottish politicians and the Scottish courts are throwing this Parliament a lifeline that would enable it to get out of the madness of Brexit.
Even if we do throw that lifeline, the United Kingdom Parliament takes it, there is a second referendum, and the whole UK is smart enough, having been put in possession of the full facts, to vote to remain part of the European Union, do not think that that will be the Scottish question closed, because the Brexit process has wholly revealed our inferior status within the Union, and people will not forget that. The last two years have shown us that across the United Kingdom, the leave vote was won on the back of promises that have proved undeliverable. Many people say that those promises were lies, but whether they were or not, they have proved undeliverable.
It is hard for me to be fair to the Prime Minister because of the scorn that she has shown for Scottish democracy, but I will try: I do not think that it is because the Prime Minister is a bad negotiator that the deal is bad. The truth is that there is no better deal than the one the United Kingdom currently enjoys from within the European Union.
The Prime Minister at least tried to negotiate a deal. Others who led the leave movement have totally and utterly abdicated their responsibility. I watched with interest yesterday while the right hon. Member for Uxbridge and South Ruislip (Boris Johnson) attempted and struggled to explain what he wants. I was none the wiser at the end of his speech. Let us not forget his partner in crime in the leave movement, who has now left the Treasury Bench: the Secretary of State for Environment, Food and Rural Affairs. Why did he not take the job of Brexit Secretary when it was offered to him a couple of weeks ago? If someone desires something so much, why not take responsibility for delivering it? I think we all know the answer to that question.
Then, of course, there is the right hon. Member for Haltemprice and Howden (Mr Davis). His insouciant appearances at the Exiting the European Union Committee were highly entertaining, but also deeply shocking. Now where is he? We have not seen him in the Chamber much in the last few days, but he is certainly not proposing any firm alternative to the deal.
The much maligned Court of Justice of the European Union, with the assistance of Scottish parliamentarians and the Scottish courts, has opened up new vistas of possibility for this Chamber. There is a chance of reversing the madness, but I accept that there will need to be a second vote. To achieve that, we will have to work cross-party in this Chamber. There is a lot of that going on already. May I respectfully suggest that parliamentarians in this Chamber look north to what is happening in Edinburgh this afternoon? They would see that it is possible for at least the Scottish National party, the Labour party, the Lib Dems and the Greens to work together. We know from this House that it is also possible for those parties to work with some Members on the Government Benches.
I want to make something crystal clear. Make no mistake about what would happen if there was a second vote across the UK, and England, in possession of the full facts on the reality of Brexit, again voted to leave—I am quite sure that Scotland would vote to remain. Scotland would not stand for that, and there would have to be a second independence referendum. This time, we know that we would have a far more sympathetic ear in Europe, even from the Spanish, supposedly Scotland’s great enemies. Their Foreign Minister said recently that if Scotland secedes from the UK constitutionally, he will not veto Scotland’s membership of the European Union.
As I said yesterday, I very much hope that when an independent Scotland tries to seek membership of the European Union, it will be remembered that it was Scottish parliamentarians and the Scottish courts who attempted to give the UK Parliament an escape route from Brexit. Even if the United Kingdom takes that escape route, the Brexit process has shown that the United Kingdom in its present form is not a Union in which Scotland can continue to function properly.

Commons ChamberI am pleased to have secured this debate. I start with a slight sense of déjà vu, because in June 2016 I led a short debate in Westminster Hall on visas for visitors from sub-Saharan Africa. It was a different Minister in that debate, mind you; he went on to become the Secretary of State for Housing, Communities and Local Government, so who knows what awaits the Minister for Immigration if she can improve on the answers that I received then?
Sadly, many of the issues that I raised that day are still relevant today, and if anything the situation has deteriorated further and goes beyond the experiences of those in one region of Africa. The Minister will know that at Prime Minister’s questions on 24 October I raised the increasing concerns among academics, the creative industries, businesses, non-governmental organisations and basically anyone and any organisation with links to overseas counterparts who might want to travel to the UK. The experience of the visa system of both individuals and organisations stands in stark contrast to Home Office rhetoric and the Government’s stated ambition of building a “global Britain”. The situations that I hinted at in PMQs barely scratch the surface, but they all exemplify the huge frustrations created by both practical failures in the visa application system and the overall policy failure of what essentially remains a hangover of the hostile environment policy.
Throughout the summer of this year, the media were full of reports of festivals disrupted by the denial of visas to artists from different parts of the world. The director of the Edinburgh international book festival described the problems faced by over a dozen authors seeking to attend as “humiliating”. Peter Gabriel, the founder of WOMAD, expressed alarm after at least three acts were unable to perform, saying that
“our UK festival would now have real problems bringing artists into this country,”
many of whom
“no longer want to come to the UK because of the difficulty, cost and delays with visas, along with the new fear that they will not be welcomed.”
That is borne out by the experience of Celtic Connections, which has been a major highlight of Glasgow’s cultural scene for the past 25 years. Its director Donald Shaw has recently said that visa refusals are undermining the festival’s musical internationalism, and that at least two major world acts have pulled out of next year’s festival simply due to the hassle and stress of the visa application process.
I congratulate the hon. Gentleman on bringing this issue to the House for its consideration and on his endeavours on behalf of universities and students from all over the world. Does he agree that it is essential to our universities that there is a quick but effective visa system, and that every effort must be made to ensure that the system for applications to study here has top security procedures but at the same time is streamlined and quick?
Absolutely, and I will have some examples from my constituency in a couple of moments.
In the debate in June 2016 I listed example after example of delays and denials experienced by members of the Scotland Malawi Partnership. I declare an interest, because the partnership provides pro bono secretariat support to the all-party parliamentary group on Malawi, which I chair. The Minister may also know that in February, I and my hon. Friend the Member for Paisley and Renfrewshire North (Gavin Newlands) had to raise an urgent case at business questions, because just days before they were due to fly to Scotland a group of Malawian schoolchildren and priests had been denied visas, which they had been assured would be granted, risking thousands of pounds that pupils and families in Scotland had raised to bring them over.
On that point about members of religious faiths, in West Dunbartonshire we have St Margaret of Scotland hospice, run by the Sisters of Charity, who have hospices across the entirety of the UK from Hackney to my constituency. Does my hon. Friend agree that the problems facing us are affecting not only people of religious faith, such as them, but those in hospices across the UK trying to deliver social work, palliative care and frontline services?
Absolutely, and I would have thought that if anyone was going to honour their visa requirement to come here for a short period and then go back to their country of origin, it would be members of religious orders whose vows of obedience and stability mean that they need to remain where they are based.
Departments at the University of Glasgow frequently encounter difficulties in bringing over visiting academics. Last year, the Home Office denied a UK entry visa to Dr Nazmi al-Masri, the vice-president for external relations at the Islamic University of Gaza, despite the fact that he had a 30-year history of entering and returning from the United Kingdom, and that he was due to travel to support research programmes funded by the UK Government’s own research councils. The situation is perverse and the list goes on.
Examples emerge from all around the world on a weekly and sometimes daily basis. No fewer than 17 researchers were reported as being unable to attend the Women Leaders in Global Health Conference hosted by the London School of Hygiene and Tropical Medicine last week, which the organisers said was tantamount to discrimination and bad for science research in the UK, and means that they may have to consider hosting events overseas in the future. Pioneering anti-poaching female rangers from Zimbabwe were denied entry to collect humanitarian awards on 3 November. The Syrian journalist Humam Husari was granted entry, again to collect an award, only after high-profile complaints. Here in Parliament, on a weekly if not daily basis, events I have been to recently hosted by the Industry and Parliament Trust and various all-party groups all have similar stories which are heard frankly with embarrassment and cringing by the UK-based participants.
Many of the academics my hon. Friend talks about are from sub-Saharan Africa, India and the middle east. Does he share my concerns that post Brexit this may involve academics from across Europe too?
That is a very real concern and I will touch on Brexit just before I finish.
It is no wonder that I heard a very senior official from the African Union, who himself had had to produce a marriage certificate and bank statements even though he was invited to attend an event by the Lord Mayor of London, tell one such meeting recently that he is not surprised when he sees business class flights from Addis Ababa to Brussels full, but similar flights to the UK more than half empty. These are not examples of a UK that is open for business. These are not examples of a global Britain. These are not examples of a Home Office that has abandoned the hostile environment. These are examples of failure across the board: failure of policy and failure of practice.
Will the Minister confirm what the Government’s policy on entry visas actually is? Can she explain why so many stakeholders feel that an effective travel ban is in place for certain countries and regions, particularly Africa and Asia? Can she explain why the reality experienced by so many sponsoring organisations is so different from the rhetoric of global Britain? Will she confirm or deny whether there is any connection with the net migration target and the rates of rejection for visitor visas? Do the Government really believe that everything on these islands is so wonderful that they must presume that everyone who applies for a visa secretly wants to abscond; that musicians, authors, academics, scientists, business owners and senior civil servants will take one look at the streets of mother Britannia paved with gold, and abandon their families and careers for a job in the UK’s gig economy? Laughable although that idea is, that is the impression that is being given.
As a representative of Scotland’s festival city and as the constituency MP for Edinburgh’s book festival, may I congratulate my hon. Friend on this important debate? Is he aware of any evidence of invited artists absconding during planned visits or festivals, which might explain why things are so much more difficult these days?
The short answer to that question is no. Perhaps the Minister has that evidence. Certainly, when I have tried to ask for similar evidence in written questions I have had very little back, because the Government do not seem to keep a track of this data. It is simply a hostile environment hangover.
The policy has to change and that means the practice should also change. The Government need to do more to respect the bona fides of sponsoring organisations. It is not in the interests of festival organisers, universities, churches, or, for example, the City of London Corporation for their guests to abscond. The Government should be prepared, either as a matter of policy or through some kind of formal accreditation, to start from a principle that guests invited by such organisations are coming for good reasons and can be expected to abide by their visa conditions and return in due course.
The Incorporated Society of Musicians has recommended that if freedom of movement for musicians cannot be preserved after Brexit, then the UK and EU should develop a two-year multi-entry touring visa for UK and EU musicians. I know that the City of London Corporation also expects to publish a major report on visas and immigration in the very near future, and I hope the Minister will look out for that and pay attention to its recommendations. I will also send her extensive documentation from the Scotland Malawi Partnership on this issue, which she may already have seen, and I look forward to her response. I hope, most importantly, that she will be willing to meet some of the all-party groups that are particularly interested in this issue. I have mentioned the all-party group on Malawi. I am also secretary of the all-party group on Africa, and I know that they would very much appreciate the opportunity to discuss this in more detail.
There is also a huge issue in my constituency with people not getting the visas that they require. The Central Gurdwara Singh Sabha has found it very difficult to get Sikh priests to come over. They have tried on numerous occasions, but they have not got in, which is also a concern of the all-party group on UK Sikhs.
There we go, and that goes back to the points made by our hon. Friend the Member for West Dunbartonshire (Martin Docherty-Hughes).
What all the stakeholders have told these groups and what all the evidence shows is that the visa processing system also needs to be fit for purpose. The level of detail being requested, sometimes from very senior or very high-profile individuals, as we have heard, has been described as humiliating. In the case of applicants from developing countries, sometimes the information requested is simply impossible to provide. Priests and pupils in remote villages in northern Malawi or elsewhere in Africa may not have bank accounts or birth certificates and almost certainly do not have credit cards or online access to pay the visa processing fees, and neither would they have the means or resources to travel hundreds of miles to a processing centre, sometimes in another country and often on multiple occasions.
Of course, all this takes place in the context of Brexit. We are told that many leave voters voted leave because they wanted freedom of movement to come to an end, but freedom of movement simply cannot come to an end without having any impact on our economy or society. We can all agree that there are different types of movement of people—for labour, for holiday, for family, and for the longer term or the short term. My concern in this debate is largely around very short-term movement, when people enter the country for specific reasons, such as a festival or an academic conference, for a short period of time before returning. Many of the examples, as we have heard, are in any event about visitors from non-EU countries, so they will not be affected by any Brexit withdrawal agreement.
I also accept that those of us who supported, and still support, remaining in the European Union could and should have done a better job of championing the benefits of freedom of movement and immigration, because after all, many people from the UK benefit significantly from ease of travel to the EU and other destinations around the world. The risk of Brexit and the hostile environment more generally is that perhaps the restrictions that the UK Government place on visitors will be increasingly reciprocated elsewhere. Indeed, many UK residents, not least artists and musicians, are already experiencing increasing difficulty applying for entry visas to the United States.
The consequences may be even more far-reaching and unintended. Last year, Corina Cojocaru, Moldova’s economic counsellor to the World Trade Organisation, and her team were denied entry to the UK, even though they wanted to come to discuss their country’s future relationship with Britain after it leaves the European Union. This year, Moldova was one of several countries to question openly the UK’s re-entry to the World Trade Organisation’s Government procurement agreement. Maybe that was just a coincidence, but the examples mount up—case after case of how to lose friends and alienate people, but that seems to be the overall direction of Government policy in a whole range of Departments.
I will not be surprised if the Minister gets up shortly and tells us that all this is imaginary, that statistics show upwards of 80% of visas are granted in a timely and orderly manner, that feedback on experiences in processing centres is positive, and that all these cases and examples are just isolated and can be easily resolved, but I am not sure that that is really the case. Even if the approval rate is accurate, how many visas are not being applied for in the first place, or how many fall at the first hurdle? If these examples are just rare, isolated, high-profile cases, why are there so many, why are they so frequent, and why should they require high-level intervention in the media or here on the Floor of the House to resolve them? How many denials or delays do not have the luxury of media or political contacts that can cut through the red tape?
The reality is that the whole immigration system needs root and branch reform, and that includes visitor entry visas. The Minister knows full well that if she does not want it to change, the Scottish Government and the Scottish Parliament would be more than happy to take responsibility and build a system that works for Scotland’s economy and society.
As I said at Prime Minister’s questions, Brexit is a small, isolationist retreat from the world stage. The reality experienced by those going through the visa and immigration system is one of suspicion, frustration and all too frequently, rejection. It is not conducive to growing the economy or building a more tolerant society and it will not be without fundamental change.
How would the Minister feel if the situation were in reverse? If she wanted to visit a country in sub-Saharan Africa, or in years to come wanted to travel to promote her autobiography—about how she survived the final days of the May Administration—or had been invited by a major Government-backed non-governmental organisation in the country concerned, and was asked before she could travel to produce her birth certificate, marriage certificate, bank statements and biometric information, to pay an exorbitant fee and to travel hundreds of miles to do so, perhaps multiple times, and all at risk of being denied because there was a presumption that she would stay in the country and never leave, would she even bother applying for the visa? If she would not want to go through that experience herself, why do the Government continue to inflict it on others?
As I said earlier, I will send the Minister some of the documents and evidence that have been produced by the Scotland Malawi Partnership, not least the denial form which contains the words “Reason for denial—insert reason here”. Even when reasons are approved, that often happens very late in the application process, sometimes after the flights on which people have been booked have departed. The Minister needs to look into that a little bit more.
I look forward to receiving the information from the hon. Gentleman, but, as I have said, our statistics show that most visas are being granted within 15 days.
The hon. Gentleman also referred to scientists and academics being refused entry to the UK. Of course we welcome the brightest and the best, allow academics on exchange programmes to come to the UK as visitors, and welcome them to conferences. However, they must meet the requirements of the immigration rules, which apply to all visitors to the UK. Applications for visitor visas, or for entry as a visitor, are considered on their merits regardless of the nationality of the applicant. Among the points on which applicants must satisfy the decision-maker is that they are genuine visitors who will leave at the end of their visit, and will not make the UK their main home through frequent or successive visits—for instance, that they have family, work or study ties in their home country. They must also be able to show that they are able to support and maintain themselves during their visit.

Commons ChamberMy right hon. and learned Friend makes a good point. First and foremost, it is worth stating again that it should never be mandatory to supply DNA evidence. He is right to point out that where individuals feel it can help their case and want to submit DNA evidence voluntarily we should always be open to that. He is also right to say that in many, many cases it helps individuals to make their application and get exactly what they want.
I am grateful to the Home Secretary for advance sight of the statement, although when I saw the title “Immigration” I hoped perhaps he was coming to provide a more detailed answer to my question to the Prime Minister yesterday about the crisis in the visa system. But then the Home Secretary has his fair share of crises to choose from.
The Scottish National party accepts that from time to time DNA can be a fair and useful tool in processing immigration applications, but it is clear now that it has become dangerously and unethically overused by the Home Office, making life unnecessarily difficult for applicants. We have seen: children who already have British passports being asked for DNA when trying to renew them; other kids being asked for a new test, even though it had already been provided; and, the root of today’s statement, people receiving demands for their DNA even though the guidance said that alternative proof was perfectly acceptable. This is another example of the Home Office being out of control and the result of a migration target with which they are still completely obsessed. It is more evidence that the hostile environment lives on.
We welcome the clarity that it is absolutely not and never will be mandatory for DNA testing, and we welcome the apology that has been offered. Will the Home Secretary confirm that it is now policy that acceptance of the relationship by Government for a different purpose, such as child support, will be sufficient for immigration purposes? Is it the case that if the relationship is accepted for one immigration or nationality purpose, it will not subsequently be challenged unless there are exceptional reasons? Is there guidance on how to handle unexpected DNA results? I understand there used to be publicly available guidance about what happened if a DNA test showed that the biological father was not the presumed father. Where is that guidance, and will it be released and updated?
Finally, sometimes DNA can be the only means of proving a relationship in refugee family applications and Dublin III applications. Such tests used to be funded by the Home Office for family reunion, as many refugee families are destitute. Why not return to that position if the Government are genuinely keen to pursue a humane approach? Of course, they could also do that by adopting the private Member’s Bill on family reunion promoted by my hon. Friend the Member for Na h-Eileanan an Iar (Angus Brendan MacNeil).
First of all, the hon. Gentleman refers to DNA testing with regard to the immigration system being overused. I would just caution him. As I said in my statement, more work needs to be done to see how widespread what should not have happened, the mandatory use, was. In many cases, it is voluntary. I hope the hon. Gentleman is not suggesting that it should not even be allowed in voluntary cases. [Interruption.] No, he is not. Clearly, where an individual feels it would help their application, I think it is right and proper that the Home Office takes that into account. But let me be clear: where it has been mandatory that it is not acceptable. That should not have happened.
The hon. Gentleman asked about other parts of Government, in particular the Department for Work and Pensions, and, where there is voluntary testing, whether it can be used between Departments. I am happy to take that to my right hon. Friend the Secretary of State for Work and Pensions, and I will make sure that the hon. Gentleman gets a response on that.
The hon. Gentleman talked about the funding of DNA tests and whether there is help with funding. The key point is that if a DNA test is funded by the Government, for whatever circumstances, it should only be in a case where it is voluntary, not mandatory.

My hon. Friend makes an important point and reminds us that we have to balance everyone’s rights—the rights of my constituents to go about their business securely and safely and their right to life against the rights of other people to a fair trial and not to be subject to torture and other conditions. There are no easy solutions. Where we find we have the powers to deal with individuals we explore all of them, including deprivation of citizenship, royal prerogatives to prevent people travelling and prosecuting people in a United Kingdom court, as we have done in some cases where we have the evidence to do so. We recognise that over many decades there has been a deficiency in offences on the statute book such as in extra-territorial legislation; sometimes we might have evidence of travel but the intelligence cannot be submitted in court. That is why in the Counter-Terrorism and Border Security Bill, which I am pleased to say the Opposition support, we have sought to improve the statute book so that we do not face problems like this in the future.
The Government are tying themselves in knots over this. If it is the Government’s position, as the FCO reaffirmed yesterday on World Day Against the Death Penalty, that they oppose the use of the death penalty in all circumstances as a matter of principle, it stands to reason that, no matter how heinous and barbaric the alleged crimes are—and they are—if individuals are brought to justice, they should be not subject to the death penalty.
If that is the Government’s position, why are they not willing to state that clearly and seek the assurances from the US Government that others suggest we should ask for? What is the point of the special relationship if we cannot speak clearly and honestly to what is supposed to be our closest ally?
Can the Minister confirm whether the US or other allied countries were the subject of the two other cases that have been raised in which assurances were not sought?
It is the policy of this Government to seek justice for the victims, in accordance with not only our principles but the OSJA guidance, which is the published policy of this Government, introduced under the coalition Government in 2011. I asked whether I had received any representations from any Member of the House on the OSJA guidance while I have been Security Minister or whether my predecessor had. I have not seen anybody take issue with that guidance.
Our key aim is to seek justice. Our preference for Mr Elsheikh, for example, would have been to seek justice in this country if we had the evidence. The CPS was clear that it did not have the evidence to try them in this country. That was a challenge for us. Opposition Members say, “We want to see justice for everyone,” but I have yet to hear a solution from them or what they would do in this type of case, other than to just let these people go who would ultimately wreak havoc and death on the streets of Syria, Iraq or the United Kingdom.

The Minister will be aware, as I have raised it before, that many of the Chagos islander community in this country are also seeking to establish their citizenship. We would not want any more scandals in the mould of Windrush. Will she therefore make sure that their citizenship is considered as the Government take forward progress on Windrush?
I am not sure if the hon. Gentleman was in the Chamber for Foreign and Commonwealth Office questions earlier, when he would have heard the response by the Minister for Europe and the Americas on the subject of the Chagos islanders and the Government’s long-standing policy.

Commons ChamberI will not speak about the legal case, for obvious reasons, but I have to disagree with the hon. Gentleman. It is right that there is a balance between the costs faced by the individuals who make applications and those faced by the taxpayer. It is sensible to keep those costs under review, and it is right that Parliament makes the decision on whether costs are changed.
The hon. Gentleman talks of it as profit, but the revenue generated is used not just to provide public services to those people who make applications but to support wider public services. As I said, it is right that we have a balance between the costs of an application and the costs to which the taxpayer is exposed.

Commons ChamberMy hon. Friend is right. The process should absolutely be clinically led. We should listen to evidence from clinicians while drawing on international evidence, too. That is exactly what should feed into the outcome of the review.
I think we all welcome the progress that is being made, but there are questions about people who need help now. My constituents Laura Murray and John Ahern have a one-year-old daughter, Bláthnaid, who has been diagnosed with Aicardi syndrome. She suffers very severe seizures throughout the day and her parents believe that these medicines could help. I will write to the Home Secretary with more details about that situation, but may I ask him how much discretion he still has, and how much he is willing to exercise?
As the rules stand, until the review is complete and changes are made, any use of cannabis for medicinal purposes will require a Home Office licence or, in the case of Northern Ireland, a licence from the Health Department there. I hope that what I have set out today has given reassurance that I recognise the need for action now, not tomorrow or in a few weeks or months. We need action now, and that is the purpose of the expert panel—to make this a much smooth, quick and clinically-led process.
