My hon. Friend is right to point out that this is a decade-long investment in 55 towns across the United Kingdom. We will work with people in Burnley, with its excellent Member of Parliament and with other representatives to ensure that we can tackle antisocial behaviour, revive high streets and make sure that the pride that people have in Burnley is reflected in investment from Government.

One of the economic sectors that provides levelling up across the whole of the United Kingdom is the creative industries, whether that is film production, theatre, the arts, video games or modern high tech. Will the Secretary of State have conversations with Her Majesty’s Revenue and Customs and the Treasury about the proposals to change business rates, which may have a dramatic effect and curtail the opportunities for the creative industries?

I beg to move, That the Bill be now read a Second time.

It is a real pleasure to move the Second Reading of this Bill. The Bill contains provisions to ensure that we supersede the Fixed-term Parliaments Act 2011 with appropriate, democratic and timely reform in order to ensure that we restore to this place and to the people an opportunity to ensure that the Government that govern in their name can command the confidence of this House and the confidence of the public.

The legislation that we are bringing forward will I hope command support across this House, because it was a manifesto promise in both the Conservative and Labour party manifestos. Both Front-Bench teams are committed to the legislation, and it follows on from an excellent report by the Public Administration and Constitutional Affairs Committee, chaired by my hon. Friend the Member for Hazel Grove (Mr Wragg), and from recommendations made by the Constitution Committee in the other place. It has also received extensive scrutiny and support from a Joint Committee of the Commons and Lords. With both Front-Bench teams and three important Committees all in favour of this legislation, we can see already that the arguments that have been lined up for it are powerful and command wide support. I sincerely hope that nothing I say this afternoon undermines that consensus.

Regarding the coalition years, I think that others are better placed—given that I served in the Government for five years—to decide which was the worst piece of legislation that was passed. The one thing I will say for the Fixed-term Parliaments Act is that it was very much a child of its time. It did achieve one purpose. It was introduced at the request of our Liberal Democrat coalition partners in order to ensure that, for the five years of that Parliament, neither party could collapse the Government in a way that might secure for either the junior or the senior coalition partner perceived political advantage. It did serve that purpose for those five years. Notwithstanding the points made by my hon. Friend, there was a significant range of achievements that the coalition Government can take pride in; nevertheless, the Act was specifically a child of its time. While it worked in that narrow sense, in cementing the coalition and ensuring it could achieve the policy gains that I believe were gained during those five years, its utility beyond those years in tougher circumstances has been tested to destruction.

I will let the Minister in on a secret: not all of us supported everything that was in the Labour manifesto at the last general election.

Is there not a worrying issue here, which is precisely what the right hon. Gentleman refers to as “the child of its time”? If the Government can always reconstitute the constitution every time they can pass a law, we have a problem here, because the Government are most likely always to do so in their own interests.

I take very seriously the points that the hon. Gentleman makes, because there are few deeper scholars of our constitution or parliamentary history than him, but I would say two things. First, sometimes there are constitutional experiments or innovations, and it is understandable that they will have partisans who can see benefits from them; but then we can see in real time and in real circumstances whether those constitutional innovations are right and work, or whether it is appropriate for us to go back to the situation that prevailed before, which has actually proven over time, in a variety of circumstances, to be both more robust and more effective.

The second point is that of course there is always a temptation for Governments or any Administration in power to seek to look to the rules and to derive advantage perhaps from changing them, but the critical thing here is that, ultimately, the decision on whether an election has been called and Parliament has been dissolved appropriately rests with the people. We can look at historical examples; for example, in the 1970s Edward Heath decided to go to the country to ask the question, “Who governs?”. He believed that, in choosing the timing of the election, he was doing so to his party’s advantage, but when he asked, “Who governs?”, the country replied, “Well, not you, mate.” On that occasion, it was the case that a miscalculation on the part of the Prime Minister resulted in the electorate deciding that Edward Heath’s Administration should end and that Harold Wilson’s should take over.

In which case, one could conceive of a situation in which the Government were aware of something coming up that the public were not aware of—a report or a major security breach that had not yet been made public, for example. Or, for instance, the Government might choose to hold a general election before boundary changes because they thought that it might be to their advantage. Would it not make far more sense for the House simply to be able to vote at that moment?

Historically, many different things have counted as motions of no confidence—for instance, losing a vote on an amendment to the Loyal Address following the Queen’s Speech or on an amendment to the Finance Bill, or refusing to grant supply for a military intervention or to allow a military intervention. Does the Minister think that all those things would still count as a motion of no confidence?

The formal motion of no confidence that is traditionally requested by the Opposition and has to be granted within a day is a classic example, but on the question of military intervention, I personally believe—again, it is for the House to take a view—that that is a proper exercise of the prerogative power in certain circumstances. That is perhaps for debate in other forums, but it would not count in the way that the hon. Gentleman suggests.

My right hon. Friend is exactly right. If any Prime Minister felt that the House’s decision not to grant supply, the House’s decision to censure an individual Minister or the House’s decision not to authorise support for military action was a matter of confidence, that might mean that it would be appropriate to request a Dissolution at that point.

Not for a little bit, because I want to run briefly through the clauses in the Bill.

There are six clauses and one schedule. The first clause repeals the Fixed-term Parliaments Act. The second clause revives the prerogative power and allows the Prime Minister to request a Dissolution from the monarch. The third clause is specifically to ensure that that decision cannot be reviewed in the courts. It is what might be called an ouster clause. It is there explicitly to say that proceedings in this House relating to the exercise of the prerogative power should not be justiciable.

It is very important, following on from the points made by my right hon. Friend the Member for New Forest East (Dr Lewis), that the House understands, appreciates and supports the Bill on that basis. It has been constitutional practice since 1688 and the Bill of Rights that it should not be the case that these matters are reviewed in the courts. Let me say that judicial review is an important part of keeping Governments honest, but there needs to be an absolute limit on what is considered justiciable and it should not be the case that the courts can prevent the request for a Dissolution on the part of a Prime Minister. If that decision is mistaken, then it is for the people to decide in a general election what is appropriate. I was very pleased that the Joint Committee confirmed in its report that it would be appropriate for Parliament to affirm that.

Exactly so, and it is absolutely important, as my right hon. Friend points out, that we stick to the principle that, immediately upon receipt of a request from the Opposition for a vote of no confidence, such a debate is granted and that the Prime Minister of the day would make their case. Following the defeat of an earlier attempt by my right hon. Friend the Member for Maidenhead (Mrs May) to secure support for her withdrawal Bill, a motion of no confidence was tabled by the then leader of the Labour party. That motion of no confidence was defeated and that allowed the Prime Minister to consider other ways of fulfilling that mandate.

I do not want to test everybody’s patience, but the one time when that course is not available to the Opposition is immediately after a general election, before Parliament has got on to actually meeting; and it is the Government, and only the Government, who decide when the House meets and what it debates. I note that we still have no formal process in our system of knowing when, after a general election, the House will meet to transact substantive business, other than to elect a Speaker and have the swearing-in.

That is an important point, but it is also important to recognise that no newly elected Government can effectively govern without Parliament. It would be impossible without a vote of supply and without a Queen’s Speech to ensure that the basis on which they were elected, and the effective governance of the country, could continue. It is important that we recognise that that is the principle that prevailed beforehand, and it is the principle that we should adopt now.

I shall conclude, because many hon. Members wish to speak. I return to the point that I made at the start. Those who brought forward the Fixed-term Parliaments Act were motivated, I think, by two entirely reasonable motivations. The first was to ensure that the coalition Government—the first coalition that we had had since 1922—was able to proceed and govern in an effective way; of course it was against the backdrop of economic crisis. As a member of that coalition, I do not resile for a moment from the many decisions that were taken during that five years, and I take the opportunity to thank the right hon. Member for Orkney and Shetland (Mr Carmichael) and others who served in that coalition for putting the national interest first at that time.

The second thing that the Fixed-term Parliaments Act was designed to do was to ensure that our constitutional arrangements became more predictable. Although the FTPA succeeded in the unique circumstances of the coalition years, it emphatically has not made our constitutional arrangements more predictable, as what happened in 2017, and indeed between 2017 and 2019, reinforced. Indeed, the circumstances of the 2017 to 2019 Parliament reinforced in the public mind—and certainly that was reflected in the general election result of 2019—the need to move to a more flexible, more responsive, more agile, more familiar and more tried and tested set of constitutional arrangements. It is for that reason that I commend the Bill to the House.

Given that there is very little trade that I am aware of in conflict diamonds from Northern Ireland to Great Britain—if anything, it is an even smaller trade than, for example, endangered species products such as tiger skins—I suspect that the bureaucratic burden will be so small as to be almost naked—sorry, I mean invisible to the naked eye. [Laughter.]

The mind boggles.

I am all for pragmatism, because that is the best way to sort out a deal that works for Welsh lamb farmers and, for that matter, British car manufacturers and all the rest of it, but I want to ask the right hon. Gentleman about the foreign policy element. On a pragmatic basis, we have always done rather well out of persuading other countries in Europe to adopt, for instance, sanctions against Putin, and we have tried to get people on board with our policy on Hong Kong. How will we be able to do that in future if we have poisoned the well by not having any long-lasting trade deal at the end of the week?

The hon. Gentleman makes an important point. Obviously it would be in our interests to secure a deal, but not at any price. He has been a consistent champion of a tougher approach towards Russia and an advocate of the Magnitsky sanctions. The Foreign Secretary also was a consistent champion for that. We adopted those sanctions, and the EU followed. That is no criticism of the EU, but it is the case that we can continue to have influence. Obviously, if we have a satisfactory arrangement with the EU, that would work for everyone.

I quite agree with my hon. Friend. One of the surprising things about the tone taken by some Members on the Opposition Benches is the idea that someone who has dedicated their life to public service, such as David Frost, should be barred from office.

If I am honest, I do not really care who the Prime Minister appoints as his National Security Adviser. It is entirely up to him; he can appoint all the duff ambassadors who have ever walked through the Foreign Office, if that is what he wants to do. However, my fear is that in creating this mixed role, where somebody is a quasi-Minister who has been given a job for life in the House of Lords, who is a member of the legislature but it is meant to be a special adviser, and who is a special adviser who can none the less give direction to civil servants, he has created Frankenstein’s monster.

He was a very distinguished civil servant, and it is certainly the case that those whom I know who work in the Foreign Office have nothing but praise for him. Talking about political appointments, the distinguished former Cabinet Minister, Paul Boateng, was appointed by a Labour Government as high commissioner to South Africa and, as I mentioned earlier, a Member of the House of Lords, Michael Levy, again a distinguished figure who was a fundraiser for the Labour party, was appointed as a special envoy to Israel. My own view is: Michael Levy, Paul Boateng—good appointments; David Frost—excellent appointment.

Two industries in Wales are particularly interested in what will happen in relation to any trade agreement. The first is Welsh lamb, because there is a real danger that the Welsh lamb industry will collapse if we do not have a completely tariff-free arrangement with the EU. We hardly sell any Welsh lamb outside Europe. The second is the avionics industry, which is so important in my patch and across the whole of south Wales, where thousands of people are already in great uncertainty about whether their job will still be there later this year. They need to know whether BA, GE and many other companies will be able to flourish in the new environment.

The hon. Gentleman makes two important points. He is right that the avionics industry is a jewel in Wales’s and the United Kingdom’s crown, and everything we do in these trade negotiations will be intended to support it. He is also right that Welsh lamb is second to none—well, apart from Scottish lamb.

My right hon. Friend makes a very important point. I suspect that many people watching our debates and knowing that we are discussing home affairs and the Home Office will be asking, “Why are MPs not concentrating on improving our migration system? Why are MPs not doing more to ensure that our police are supported in the fight against organised crime? Why are MPs not making sure that we take an even stronger stance against terrorism?” It is vitally important, of course, that the ministerial code is upheld and defended, but it is also vitally important, as he points out, that the Government deliver for the people on their manifesto promises.

I gently caution the Minister against his two central arguments: first, that a strong and exacting Minister can pretty much get away with anything, and secondly, that the Home Secretary is charming, so that is all fine. The truth of the matter and the experience in this House—and my personal experience when I was a Minister—is that the way bullying normally happens is that somebody one minute is extremely charming, praises you to high heaven, and then the next day humiliates you in front of staff and colleagues or behind your back. That is the nature of bullying and I urge the Minister not to dismiss all this talk of bullying, because too many people out in the country still get bullied.

The hon. Gentleman makes an important point. We do not dismiss any allegations or concerns about bullying. It is vitally important that Ministers, special advisers and civil servants all work together in an atmosphere of mutual respect. He is right that bullying can occur in any workplace and we must be vigilant about bullying behaviour, but I also say that simply because allegations have been raised or complaints have been made, it should not automatically be the case that people then, whether through trial by media or other means, attempt to besmirch the reputation of someone who is an outstanding public servant.

I think it is the case that we are absolutely committed to there being no hard border. One of the reasons is that—certainly governing the United Kingdom and Ireland, Great Britain and the island of Ireland—we have had a common travel area since 1922, and we are pleased to be able to maintain that. It is not the case that people will require any checks to travel between these two islands.

I wish that the Chancellor of the Duchy of Lancaster had been able to join me over a Welsh cake last week in the kitchen at Llwyncelyn Farm, where I met farmers from the Rhondda and nearby. They do not have biblical concerns—they are not worried about plagues of locusts, or anything of that kind—but they have genuine concerns about what will happen to Welsh lamb, because 35% of it is sold in the European Union at the moment, and they fear that if there is a 48% tariff on it, they will end up having to burn carcases. They are also worried that there are not enough UK and national vets in the abattoirs and elsewhere to ensure that they can continue their business into the future. We are relying on migrants from elsewhere in the EU. Will the right hon. Gentleman come to the Rhondda to meet those farmers again, just to make sure that he really has everything in place to protect them if there is a no-deal Brexit?

My hon. Friend is absolutely right. We have to recognise the vital role that farmers and growers play—not just in providing us with food, but in ensuring that our countryside is beautiful and that we are fighting climate change. I particularly thank the leader of the National Farmers Union, Minette Batters, who has committed the NFU to having net zero agriculture by 2040. She is a fantastic champion not only for British food, but for our environment.

Home energy conservation is going to be vital if we are to achieve these goals. Many of the poorest households in the land unfortunately live in homes that are very difficult to insulate through traditional means. Is it not time that we introduced a new scheme that makes it possible for people like my constituents to do their bit?

I absolutely take the hon. Gentleman’s point. We must ensure that new construction meets high standards not just in carbon emissions but in the provision of domestic heat. He is right that we need to look at retrofitting existing housing, particularly in some of the poorer areas of the country and in areas such as the hon. Gentleman’s constituency, where the case is most pressing.

That is a great question from the hon. Gentleman, for whom I have an enormous amount of respect, and who has taken a brave and principled position on Brexit as on every issue he has faced as a Member of this House. It is right that we hold up to scrutiny some of the alternatives that are put forward, in order to say that they are not realistic and not deliverable so that we can focus on what is realistic and deliverable. He also makes the important point that Brexit creates opportunities for this House to reshape policy in a number of areas. Many people outside this place, whatever their view of the original referendum result, now want us to focus on dealing with the challenges but also on exploiting those opportunities.

I want to say one thing briefly, however, about an attempt by some Members of this House, in all sincerity, to put forward a case that would mean that instead of focusing on the opportunities and dealing with the challenges we would simply be rerunning the arguments of the past, and that is the case for a so-called people’s vote—a second referendum in other words. There are people I really like and respect who put forward this case so I hesitate to put the contrary case, but I have to, because if we were to embark on a second referendum, we would spend months in this House debating how to construct that second referendum, and there is no consensus about what the question should be.

Every single Member of this House who argues for a second referendum had previously argued to remain, so if this House supported a second referendum it would be seen by many people as an attempt by those who lost to rerun the contest, and the inference that many would draw is that we did not have faith in their judgment and in our democracy—that we thought they were somehow too foolish, too stupid, too prejudiced to make an appropriate decision. That would do real damage to our democracy, and far from allowing us in this House to concentrate on the NHS, education, the environment and jobs, I am afraid people would see this as not just an exercise in protracted navel-gazing but a thumbing of our nose at the British people. That is why I believe that this is profoundly dangerous and playing with fire in our democracy. I have enormous respect for many of those who make the case and I understand their motivation, but I ask them to use their considerable energy and intellect to focus on making sure that Brexit can work in the interests of their constituents, rather than on attempting to say to their constituents, “You got it wrong.”

Every single Minister I have spoken to privately outside the Chamber has said to me that the vote is going to go down on Tuesday. Every single Minister has then said to me, “And then we’ll bring it back a second time.” Will the right hon. Gentleman guarantee that if the Government lose on Tuesday they will not bring it back to this House a second time? Otherwise everything he has just said would be a pile of nonsense, wouldn’t it?

The hon. Gentleman is one of those people who is a supporter of a people’s vote and for whom I have enormous respect, and he is a keen student of this House and its procedures. We all have an opportunity and a responsibility to think hard about the decision we will take next Tuesday. If we do vote to support the withdrawal agreement, imperfect as it is—it has flaws in my eyes and in his—we will nevertheless then be able to secure a Brexit that works in everyone’s interests. That is why between now and next Tuesday evening all I am focusing on doing is talking to the hon. Gentleman and other Members of this House to convince them of the merits of this agreement. That seems to me to be, following on from the point made by the hon. Member for Bassetlaw (John Mann), the single most important thing I can do.

We recognise that biodegradable packaging should be an alternative to existing forms of packaging wherever possible. We are considering how we can change the taxation and regulation of packaging in order to facilitate the use of biodegradable materials.

What is the Secretary of State going to do to stop the ludicrous and unpleasant practice of farmers illegally putting up great big hoardings in their fields, on the side of motorways? Surely one of the things that makes the British landscape different from elsewhere in Europe is that we have legislation to prevent that.

I am grateful to my hon. Friend for his point. In the light of what has been revealed, it is important to have a debate about the proper place of faith in education, but I have to say that I respectfully disagree with him. I think that the role of a number of faith institutions from a variety of faiths in education has been all to the good.

Of course we must draw an important distinction between devout conservatism—whether it be Catholic, evangelical, Christian or Muslim—on the one hand, and extremism on the other hand. But has not all of this shown that the Achilles heel in the Secretary of State’s education policy is that there are more and more schools now in which there are fewer and fewer means of preventing fundamentalist indoctrination?

I do not accept that that is the case. If we look at the problems identified, I believe that they arose well before this Government were formed, and that it is as a result of this Government—and, in particular, as a result of the higher level of accountability that exists in academies and free schools—that we were able to take the exemplary action that we did.

There is only one constituency in the land where Winston Churchill was never welcome, including after the second world war: the Rhondda. I am therefore delighted that this curriculum, which bizarrely insists on only one politician—Winston Churchill—being studied in the whole of the history of the 20th century, will not apply in Wales or in the Rhondda. Why will the Secretary of State still not make clear his position on sex and relationship education, which is the one thing that can make a dramatic difference to the number of teenage abortions and teenage pregnancies?

Small businesses, like all businesses, want to ensure that students have the English language skills necessary to communicate with confidence in a business setting and the arithmetical and mathematical skills necessary to compete effectively in the 21st century. I believe that the changes we are making to English and maths—the benchmark qualifications—will meet the needs of business.

Would that every young person who had failed their resits on three occasions was able to claim that they were merely engaged in a process of Hegelian dialectic with the examining authorities, although I would prefer a more Socratic dialogue, such as has been engaged in in Wales. It is a real shame that the Secretary of State has set himself against coming to a common position across the whole of the United Kingdom. What I really do not understand for the life of me is why he thinks that learning vast quantities of “The Wreck of the Hesperus” or “The boy stood on the burning deck” or “If” will make young people better equipped for the work environment.

There are two things that I would say. First, I am always anxious to reach consensus with colleagues in Wales, but it takes two to make a consensus. [Interruption.] At least two. The second thing that I would say is that when it comes to learning English, yes it is important to have the utilitarian skills that business demands, but it is also important that children from every background are given a chance to appreciate beauty—the best that has been thought and written. I know that the hon. Gentleman appreciates beauty in many spheres of human endeavour—

I am grateful to my hon. Friend. It is absolutely the case that I have strong views about improving the education system, and that I am happy to debate in any forum in order to present those views, but it is also the case that I believe that it is through debate—through the testing of propositions—that we can reach a consensus, a synthesis, on how best to proceed. I am delighted that so many of the changes that we have made which were initially controversial and vigorously contested—from the introduction of academies and free schools to changes in the way in which teachers are paid and rewarded—are now accepted. However, when the arguments overwhelm me and I recognise that I am wrong, I think it best to retreat.

Basically, the Secretary of State has failed his resits. It is a delight to see him eating humble pie. Boris Johnson might say to him festina lente, and that might become his motto for the rest of his career in his present job.

The Secretary of State has said that he wants all schools to flourish in many different ways, and wants the methodology of teaching to be different in every one, but it is teenage pregnancy that has prevented many young women from being able to prosper in society. It means that poverty is as hereditary as wealth in this country. When will the Secretary of State ensure that proper sex and relationship education is statutory?

Let me say two things to the hon. Gentleman. First, I congratulate him on his deployment of Latin. [Hon. Members: “What did he say?” He said, essentially, “Make haste slowly.”

Secondly, I happily acknowledge—as one who, as was pointed out by the hon. Member for Cardiff West (Kevin Brennan), took seven opportunities to pass his driving test—that resits are sometimes necessary. Winston Churchill once said that success meant moving from mistake to mistake without any loss of enthusiasm along the way.

As for the hon. Gentleman’s point about sex and relationship education, I can tell him that sex education is already statutory.

In that respect, Mr Speaker, may I also say that I hope you, like every Member, has the chance to enjoy a well-filled stocking this Christmas time? [Interruption.] It is a tradition of this time.

Behind me there are many Members who support our position on EMA and they, like me, are committed to making sure that young people participate in education and training until they are 18. Therefore, we will replace EMA with a fund that can more effectively target those young people who actually need the support to enable them to participate in learning.

No, I shall not.

I believe that the time is right to consider a different approach. We should listen to some of the voices that are equally as committed to sport as the right hon. Gentleman. They include organisations such as Compass, which represents those who are involved in providing coaching support for schools. In a letter to me, it says that it is important that we cease

“to fund a costly central management and control system”,

and argues that

“the most sustainable model in primary schools is where coaches work alongside teaching staff...This will require no expenditure on centralised management and infrastructure.”

I have to take account of what it says.

In the same way, I listen to Greenhouse, a charity that has done a fantastic job in encouraging more children, particularly from areas of deprivation, to take part in sports. One of the trustees of Greenhouse, David Meller, says to me—[Laughter.] For the avoidance of doubt, I should stress that this is David Meller, the sponsor of Harefield academy, which I have had the opportunity to visit.

Not the gentleman who forced down the price of Chelsea strips everywhere. That was not all he forced down, but I will put that to one side.

This is a serious point. David Meller says:

“The quality and effectiveness of”

the existing approach has

“varied from borough to borough”—

exactly my point—and that the

“structure is overly bureaucratic and not sufficiently focused on delivery.”

Let me mention someone else who has a valid point to make in this debate—the hon. Member for Vauxhall (Kate Hoey), who used to be Minister for Sport. I do not know whether the right hon. Member for Leigh has respect for the hon. Lady, but I certainly do. She says:

“It was always expected that, if School Sports Partnerships were a success, they would become embedded and the Youth Sport Trust would then withdraw. If schools and parents feel that their SSP has been valuable, I suspect that it—or at least many of its functions—will continue in some form. Where the contribution of the SSP has not proved valuable, new solutions will be sought. This is exactly how it should be: schools themselves taking more responsibility for school sport.”

Steve Kibble, an individual who delivers sport for a local authority in Devon, has written to me, as have several other teachers and head teachers. He points out that in his area, school sports partnerships

“have drawn down £1.4M per year”

and argues that

“if the money had gone direct to schools we would have had £4,110 per school per year to invest in PE”,

noting that instead some schools have had just £200.

Those are all powerful voices who care about sport just as much as the right hon. Gentleman, and who say that we can reform the way in which we deliver school sport.

No, I shall not give way.

It is critical that we recognise what a different approach might involve. It is important for those of us who care about delivering school sport in a better way to acknowledge that the way in which the curriculum is currently designed means that those who wish to deliver competitive sport often have to do so outside school hours. Is it worth thinking about how we can reform the curriculum to better support school sport? I think that it is.

It is also worth acknowledging that there are bureaucratic requirements for coaches who support particular school sports to be qualified at a specific level and in a specific way. Perhaps we could look at that bureaucracy and make better use of the volunteer army that is determined to encourage more children to take part in sport. There are rules governing everything from health and safety to who is qualified to drive a school minibus that restrict that volunteer army in committing to school sport. Is it appropriate that we look at all those rules and reform them? I think that it is. In all those areas, action could have been taken in the past 13 years, but it was not. I would like to see a different approach.

I shall not give way.

We must acknowledge the reality regarding school playing fields. There cannot be effective school sport without school playing fields. A number of hon. Members have made the point that Labour has an at best ambiguous record on this matter. In 1997, the Labour party manifesto stated:

“A Labour government will take the lead in extending opportunities for participation in sports; and in identifying sporting excellence and supporting it.

School sports must be the foundation. We will bring the government’s policy of forcing schools to sell off playing fields to an end.”

That was an admirable aim. However, in January 2000, it was revealed that of 103 applications to sell playing fields, 101 had been approved.

Elsa Davies, director of the National Playing Fields Association, said that the previous Government did not even pay lip service to their election pledges:

“They have said one thing and done precisely the opposite. It is a very sad U-turn. These pieces of land are disappearing forever and they are part of our children’s heritage.”

In November 2000, the sell-offs had still not been stopped. Elsa Davies pointed out that 190 applications had come forward, and that only four had been refused. In February 2002, after more than 18 months in which £125 million had been due to be handed out to 12 partner organisations to support school playing fields, the Daily Mail and the BBC revealed that they had contacted all of those groups and found out that not a single one had opened new playing fields with the money. Kate Hoey, the then Minister for Sport said:

“Trying to stop the sale of playing fields was another uphill battle. No one wanted to admit”—

As the hon. Gentleman will know, I have a consistent record of opposing Islamic extremism. One thing we have done is to set up a new due diligence unit within the Department in order to ensure that the threat of extremism—not just from anyone who might wish to promote a free school, but from anyone who wishes to infiltrate our state school system—is dealt with. The hon. Gentleman will be aware that in both Surrey and Birmingham there were genuine dangers due to extremist influence in state schools. I take the issue very seriously and I am delighted to work with others such as the hon. Member for Birmingham, Perry Barr (Mr Mahmood) in helping to counter it.

That brings me to another key point on which I agree with Tony Blair—no slouch when it came to opposing Islamist extremism. If we automatically assume that any parent who believes it is right to set up new schools is an extremist, we are saying to the overwhelming majority of people in this country who want better state education, “I am sorry; you are outside the mainstream.”

The Secretary of State refers to deprivation and how to tackle it. He will know that the inheritance of teenage pregnancy is an issue that affects deprivation and the poverty of ambition of many families. If we look at the map of teenage pregnancy in this country, we see that it is also the map of deprivation. I acknowledge that we did not have complete success on this issue, although we had partial success. We cut the numbers. They had risen dramatically under Mrs Thatcher’s era. They fell in ours, but not as much as we would have liked. I think that was partly because we did not learn the lessons from countries such as Holland—where the figure is five times lower than it is in this country—and introduce statutory sex and relationship education. Will the Secretary of State think again about his opposition to that?

The hon. Gentleman has been a consistent proponent of better sex and relationship education, but I have to tell him that it is a statutory part of the present curriculum. The critical question is how we can improve the quality of guidance and the quality of teaching. The hon. Gentleman is passionate, and in this respect his passion is in a good cause, but I fear that he has got his facts wrong. Sex and relationship education is already compulsory; personal, social and health education, which is a broader issue, is not yet compulsory in the national curriculum. Now that I have cleared up that confusion on the hon. Gentleman’s part, I hope that we can work together to ensure that our sex and relationship education reflects 21st-century values. I have been delighted to work with Liberal Democrat colleagues to achieve just that.

I have quoted politicians who back our reforms, but it is important for us to hear from teachers as well. I mentioned head teachers earlier, but let me run through what some are saying about coalition policies. These are head teachers who have taken advantage of the changes that we have made: changes that the right hon. Member for Leigh said had been introduced in a rush, and were ill-conceived and ideological.

Headmistress Lesley Grace, of Seaton primary school in Cumbria, says that as a result of our changes

“we can be totally focused on our age group and our community… we can target resources to employ specialist staff, such as speech and language therapists or reading intervention specialists.”

The school could not do that before.

At Durand primary school in Stockwell, London, 52% of pupils are eligible for free school meals. What does the head teacher say when he thinks about how to improve outcomes for those poor children? He says:

“Academy status does give us greater freedom to deliver an even more bespoke education, tailoring it to the needs of our specific intake.”

He says that the school is giving more

“time and space in the curriculum back to subjects like sport and music, the importance of which have been lost over recent years.”

What about Patricia Sowter, headmistress of Cuckoo Hall school in Enfield, whom I mentioned earlier? She says that academy status enables her to invest more in

“training, development and non-contact time for senior teachers.”

Jonathan Bishop, headmaster of Broadclyst primary school in Devon, says that academy freedoms give him the opportunity

“to deliver an outstanding environment”

for his students, adding

“I don't understand why anyone would not want to do it.”

As a result of academy status, the headmaster of the Premier academy in Milton Keynes can

“employ two or three more teachers to cut class sizes.”

While we are talking about smaller class sizes, let me cite Paul Gazzard, head teacher of St Buryan school in Penzance, who has been able to bring the average class size in his school down to 18 by introducing academy reforms.

The question for the right hon. Member for Leigh is this: will he reverse these changes? He opposed them, which is fair enough. It is understandable. A new, keen, young Opposition spokesman is entirely entitled to fly an opportunist flag, but now that real schools and real pupils are benefiting, the question for him is this: will he turn the clock back?

I have more confidence in the right hon. Gentleman than in his predecessor. I think he will see that our changes are bringing real improvements, and I do not think he wants to turn the clock back. However, that is the test for Labour Members. Are they ready to embrace reform and to acknowledge that it is now the coalition Government who are delivering improvements in state education, or do they want to go back to where they were in the 1980s? Do they want to go back to being the voice of the conservative teaching establishment? Do they want to be the voice of those individuals in trade unions who are opposed to reform and opposed to change?

We should bear in mind the words of Tony Blair. When he was introducing his reforms, there were Labour Members—although not many—who opposed them. He said:

“Parts of the left will say we are privatising public services and giving too much to the middle class.”

That is broadly the case made by the right hon. Member for Leigh; but Blair continued:

“both criticisms are wrong and simply a version of the old ‘levelling down’ mentality that kept us in Opposition for so long.”

If we are to extend opportunity more widely, we need to ensure that the head teachers whom I have cited, and the others who are anxious to take advantage of these reforms—to invest in improving teacher quality, to invest in better discipline and behaviour, and to invest in higher academic standards—are given the freedom to do so.

I beg to move, That the Bill be now read a Second time.

Today’s Second Reading marks the first legislative step towards the fulfilment of our manifesto commitment to improve England’s education system. It grants greater autonomy to individual schools, it gives more freedom to teachers and it injects a new level of dynamism into a programme that has been proven to raise standards for all children and for the disadvantaged most of all.

The need for action to transform our state education system has never been more urgent. In the past 10 years, we have seen a decline in the performance of our country’s education in comparison with our competitors. We were, 10 years ago, fourth in the world for the quality of our science education; we are now 14th. We were, 10 years ago, seventh in the world for the quality of our children’s literacy; we are now 17th. And we were, 10 years ago, eighth in the world for the quality of our children’s mathematics; we are now 24th. At the same time as we have fallen behind other nations, we have seen a stubborn gap persist between the educational attainment of the wealthiest and the opportunities available to the poorest.

Pioneering work by Leon Feinstein for the Institute of Education has proven that educational disadvantage starts even before children go to school and that children of low cognitive ability from wealthy homes overtake children of greater cognitive ability from poorer homes even before they arrive at school. As they go through school, the gap widens. Schools, instead of being engines of social mobility and guarantors of equality, are only perpetuating the divide between the wealthy and the poorest. At key stage 1, some 71% of pupils who are eligible for free school meals are reading at the expected level, compared with 87% of pupils who are not eligible for free school meals. At the end of key stage 2, the gap has grown wider. By the end of primary school, just 53% of pupils who are eligible for free school meals reach level 4—the expected level in English—compared with 76% of pupils who are not eligible for free school meals.

As students go through secondary school, the gap becomes even wider. By the time they are taking their GCSEs, just 27% of pupils who are eligible for free school meals get five A to C grades, including English and maths. That is exactly half the figure for those students who are not eligible for free school meals. When it comes to A-levels and university entry, the gap is wider still. In the last year for which we have figures, of the 81,000 who had been eligible for free school meals, just 45 made it to Oxbridge by the time they turned 19, whereas one top London school gets an average of 82 Oxbridge admissions a year. We cannot go on with such a drastic waste of talent, which is why we need to legislate now to ensure that opportunity becomes more equal in our society.

As well as the legislation that we are bringing forward today, the coalition Government are bringing forward a series of changes to transform our educational system. We are hoping to transform teaching for the better by doubling the number of graduates on the Teach First scheme, which has already been proven to raise attainment, particularly in the poorest areas. The expansion of Teach First was backed by every party in the House of Commons at the time of the last general election, but it is the coalition Government who have found the money to ensure that the very best graduates are in the schools that need them most. We will be bringing forward proposals to improve the continuous professional development of all teachers to ensure that the current crop of teachers—here I agree with the shadow Education Secretary that they are among the best ever—can benefit from the best evidence available on how to raise attainment.

When it comes to attracting great teachers, we know that we need to take action on discipline, because the biggest single disincentive for talented people going into the classroom is the standard of behaviour that they encounter. As a result, the Minister of State, Department for Education, my hon. Friend the Member for Bognor Regis and Littlehampton (Mr Gibb), has outlined proposals to change the rules in order to give teachers greater confidence on the use of force, greater confidence when they exercise search powers and greater protection when false or vexatious claims are made against them.

As well as changing the rules on discipline, we are conducting a thoroughgoing reform of special educational needs. The Bill makes it clear that in future there will be protection for all pupils who have statements when they apply for academy schools, so that they are treated on an even keel. We shall have a comprehensive review, led by the Minister of State, Department for Education, my hon. Friend the Member for Brent Central (Sarah Teather), to ensure that the heartache suffered by so many children who cannot get the school they need for their special needs is addressed.

We shall also be taking steps to ensure that our children are reading fluently earlier in primary school, and we shall be transforming our curriculum and our examinations so that they rank with the world’s best—less prescription in the curriculum, more rigour in our examinations.

The right hon. Gentleman was speaking expressly about the curriculum that those schools will pursue. Many of us are worried about two areas where the schools may effectively opt out of things we believe are important to everybody. The first is religious education. Schools might advocate a set of religious prescriptions that were inimical to the broad understanding of most people’s expectations about British society. The second is sex and relationship education. We believe that it is important that every child should have an opportunity to understand their self-worth, so that they can make better decisions affecting their future.

I respect the hon. Gentleman for his commitment to both those issues. As part of our curriculum review later this year, we shall address both religious education and sex and relationship education. I agree that it is important that when sex and relationship education is reformed—as it will be—we go for the maximum consensus across the House, and that we do so in a way that ensures that as many schools as possible buy into our belief that we should have a 21st-century curriculum that reflects a modern understanding of sex and relationships.

I am grateful to my hon. Friend for his question. It is a tragedy that the ideologically driven closure of special schools under the last Government meant that so many children with special educational needs did not receive the education they deserved. That ideologically driven closure will end under this Government, and under the Minister of State, Department for Education, my hon. Friend the Member for Brent Central (Sarah Teather) we will review support for children with special educational needs. Their care should always be our first concern.

T9. The Secretary of State will know that one problem in many of the poorest constituencies in the land is the high level of teenage pregnancy in this country—five times higher than in the Netherlands. Before Government Members start blaming Labour—or, for that matter, me personally—let me tell them that the figures rose dramatically under the Conservative Government and then did not fall sufficiently under a Labour Government. The Secretary of State fought hard in the previous Parliament to ensure that we did not have good compulsory sex and relationship education, for every child, in all schools in the land. Will he reverse the argument that he advanced then, because in countries with low levels of teenage pregnancy, the existence of such education is the big difference?

The hon. Gentleman is a former vicar of the Church of England; he has been accused of many sins, but contributing to teenage pregnancy has never been one of them, to my knowledge. May I say that I entirely appreciate the importance of proper sex and relationships education? My dispute with the previous Government was simply over a question of individual liberty. I felt it important that parents had the right to withdraw their children from sex and relationships education if they thought it inappropriate. I agree, however, that it is vital that all children have high-quality sex and relationships education, in order to ensure that they make the right decisions later in life.
