Commons ChamberThe NCA takes its duty to seize criminal assets very seriously. In that work, it will be assisted by the new joint agency taskforce on cross-jurisdictional crime, which will be established from April. It will consist not only of the NCA, Border Force, the immigration service and HMRC, but of the Irish Revenue Commissioners and the Criminal Assets Bureau. That will significantly enhance the excellent efforts already being made in Northern Ireland on these matters under the Organised Crime Task Force.
Fuel laundering and smuggling is part of organised crime. What recent assessment has my right hon. Friend made of the fuel marker that has recently been introduced, and is she convinced that it will be effective enough?
The fuel marker Accutrace was introduced in April 2015. A six-month report on its use was deposited in the Library of the House in November. The review suggests that the new marker is having a very positive effect. It is too early to say whether the reductions are sustained and to establish causality, but the results are positive so far.

Commons ChamberI just want to make a fairly brief intervention in this debate. Before I do so, Mr Deputy Speaker, I wonder whether you will allow me a few seconds to refer and pay tribute to my constituency assistant who died very suddenly a few days ago. His name was Mark Calway, and he worked for me for 14 years and took a particular interest in matters Northern Ireland—and indeed in matters the Republic of Ireland—helping me quite a bit with my work on the Select Committee and as co-chairman of the British-Irish Parliamentary Assembly. His death is a stunning shock, and my heart goes out to his parents, Brian and Maureen. I do hope it is in order for me to pay the greatest tribute to him possible today. All hon. Members know how much we depend on our staff, and when they are personal friends as well, such a loss, at the age of 49, is terrible. Thank you very much indeed, Mr Deputy Speaker.
May I pay tribute to the Secretary of State for the work she has done in getting us to this point? I know—or I think I know—how difficult things were back in September when it looked as though the institutions in Northern Ireland might collapse. I know how much work she put in—or I am guessing I know that. Her dedication was total. She was absolutely determined that the institutions would not collapse and that we would in fact find some degree of agreement and a solution that would enable us to move forward. The fact that we are here today demonstrates that she was successful in that, so I really do want to pay tribute to her—and her team—for the very hard work and extraordinarily long hours put into this.
Before I was Select Committee Chairman, I served as shadow Minister for about five years. During some of that time we dealt with an awful lot of legislation—statutory instruments—in Committee upstairs, taking major decisions on behalf of the Province and the people in Northern Ireland. On many of those occasions, at the beginning of my speeches I said how wrong and inappropriate it was to govern the Province in that way, yet we really did face the prospect of going back to the previous situation, and that worried and frightened me. It came about as a result of a couple of tragic murders in Northern Ireland and the linkage between them and people in the Assembly who were allegedly sympathetic to that kind of activity. I am very pleased that this Bill makes it clear that there is no place, either in this place or the Assembly in Northern Ireland, for people who hold those beliefs.
Many years ago we heard the famous and chilling statement that some people would proceed with the Armalite in one hand and the ballot box in the other. Those days are long gone, and anybody who tries to practise that or carry out politics in that way should be in prison, deprived of their liberty. There is no place in the Northern Ireland Assembly for that kind of people. We would not want to work on Committees in this House or anywhere else with people who by day are in the debating Chamber and at night are on the streets causing trouble and wreaking havoc. We would not accept it in this place, and it should not be accepted in Northern Ireland, so I am very pleased that the Bill paves the way for removing that kind of behaviour.
I appreciate the point the hon. Gentleman is making. Sometimes we do have to stop and pinch ourselves and recognise how far Northern Ireland has come in recent years. The point he is making about Northern Ireland politicians taking decisions about the needs of the people of Northern Ireland is emphasised today, as there have been something like 26 amendments on the Floor of the Northern Ireland Parliament today, being voted and consulted on and considered by Northern Ireland’s elected representatives. That shows that instead of decisions being taken in Committee Rooms here, they are being taken in Northern Ireland by the elected representatives on the Floor of the Assembly, and they are very prosperous and good decisions.
I am grateful to the hon. Gentleman for making that point, which emphasises far more strongly than I was able to the importance of the Assembly’s functioning. When we sat in Committee taking big decisions, the great problem was that by the nature of the arithmetic of this House, there were very few people on the Committee from Northern Ireland. The decisions were taken by people like me and many others from English constituencies, with very few representatives from Northern Ireland, so the hon. Gentleman is absolutely right to make that point.
The most urgent priority was dealing with the paramilitary aspect, but there were other issues, which are dealt with in the Bill. One was the agreeing of the budgets. I have mentioned before what happens when there is power-sharing rather than the straight democratic system that we have in this House. We all know why we have that power-sharing, and it has brought people together, but there may be times when there has to be compromise in the way the Northern Ireland Assembly and Executive do business. There may be times when politicians in the Assembly and the Executive take their stances, make their points and make their objections, but at the end of the day there has to be agreement; if not, and if there is an overuse of the petitions of concern—I accept that both sides have used them to excess—it is not going to be very helpful. If we cannot get agreement on important issues such as the budget, we face the rather dark prospect of the institutions collapsing, as we almost saw, and power being brought back to this House. That is not something I want to see.
The hon. Gentleman refers to issues on which consensus and agreement were reached. Does he agree that the issue of corporation tax was one on which consensus was reached eventually, and that people were and are looking forward to the prospect of possibly tens of thousands of jobs being created in Northern Ireland? How does he feel about the fact that the delay in reaching that consensus was principally down to Northern Ireland’s and the UK’s membership of the EU? It seemed to delay it for many years.
The hon. Gentleman makes a very good point and I would make two points in response. When the Select Committee looked at the issue—it was the first issue we looked at under my chairmanship back in 2010—it was not unanimous in its support for devolving responsibilities for corporation tax, but all the parties in general were in favour of it. Corporation tax was one of the few issues that every party in Northern Ireland agreed with the policy on, which was a real positive.
The hon. Gentleman is absolutely right, I am afraid. We could have done something about it then. The corporation tax rate for Northern Ireland could have been changed in 2010, or long before that, had it not been for our membership of the EU. I am not sure how far Mr Deputy Speaker will allow me to pursue that argument, but even if we wanted to reduce VAT on tourism in Northern Ireland, it would not be legal under EU rules. There are a number of ways of looking at membership of the EU. We spent two and a half hours on it earlier, and I do not suppose we will be allowed to spend too much longer on it now, but the point the hon. Gentleman makes is absolutely right.

I was saying that I accept that petitions of concern have been used to excess by both sides and had not been very helpful in coming to agreements on important issues. This is not contained in the legislation, but I know that the fresh start agreement did address that point and did request in a very strong way, as it were, that that facility should not be abused for the reasons we have given.
I do not wish to detain the House any longer, but this small but important Bill moves us in the right direction. I compliment and congratulate the Secretary of State on introducing it and—as I said earlier—on the enormous amount of hard work she has put in.

Commons ChamberThere is a temptation in front of me. What I would say is that to date membership of the European Union has been good for Northern Ireland. I support the Prime Minister’s efforts to achieve reform. A reformed EU is where the United Kingdom wants to be: an EU that works for the benefit of everyone in the United Kingdom. If we can achieve that, we can take advantage of being neighbours of Ireland, one of Northern Ireland’s biggest economic partners, to make sure that the economy goes from strength to strength.
Later this week I will have the pleasure of visiting Royal Portrush golf course in Northern Ireland, which has been awarded the 2019 Open golf championship for the first time since 1951. Does the Minister agree that this is a tremendous achievement and opportunity for Northern Ireland? Will he work closely with the Executive and the golf club to ensure that it is a success similar to that in Scotland last year, which brought £140 million into the economy?
I am struck by how much effort Northern Ireland has made in trying to secure becoming the new home of golf. The marketing and promotion of golf courses in Northern Ireland is a real strength. [Interruption.] I know Scottish nationalists are so insecure about everything that they may take issue with that, but what is good for Northern Ireland and golf is also good for golf in Scotland. It will go from strength to strength. Major sporting events, whether horse-racing or golf, bring in real money in today’s economy.

Commons ChamberThe Conservative party is a strong supporter of devolution. Previous agreements with the Northern Ireland Executive make it clear that we are open to considering the devolution of further tax powers, but the Executive’s highest priority is the devolution of corporation tax, which we hope to press ahead with as soon as the Stormont House agreement conditions on financial sustainability are met.
The petition of concern advice in the fresh start agreement is not compulsory or binding on all parties, but does the Secretary of State agree that adherence to it will be important in enabling the Assembly to function properly and set a budget in a timely manner next year?
My hon. Friend puts his points well. I agree that it is important that petitions of concern are focused on those matters for which they were devised—where individual parts of the community need to be protected on equalities issues—and I believe that the protocol agreed under the fresh start agreement will help to focus them on matters for which they were always intended.

Commons ChamberExperience leads me to agree with the hon. Gentleman that implementation is key, and that reaching an agreement is just the start of a broader process. However, I warmly thank him for his support for this agreement and the Stormont House agreement. I also agree with him that a strategy to end paramilitarism in Northern Ireland must include programmes for young people to ensure that they are not drawn into activity of this kind. We had some constructive discussions about that during the talks, and I am sure that it will form part of the strategy foreseen in the agreement.
The hon. Gentleman asked about the task force, the surge in criminal activity, and the cross-border work. That work will be based on structures that already exist, but it will involve renewed vigour and activity, and there will be £25 million of additional funding to support action against paramilitarism. The UK Government are determined to do all that we can to work with the devolved bodies, the Minister of Justice and, of course, the Irish Government and the relevant agencies there. The PSNI and the Garda are working together, which is crucial. They do tremendously effective work now, and I am sure that the existing levels of co-operation will rise still further in the future. I agree with the hon. Gentleman that progress on matters relating to flags and parades is urgently needed. One of the aspects of the agreement that I welcome most is the fact that it allows that progress to be made.
I share the hon. Gentleman’s disappointment that we were unable to reach a conclusion on the legacy issue. However, we did make progress on, for example, the role of the implementation and reconciliation group and its relationship with the other legacy bodies, and on a number of aspects relating to how the Historical Investigations Unit will work and the devolution of responsibility between the HIU and its director. I think that we made significant improvements to how proposed draft clauses might work by clarifying the role of the Department of Justice. We had many discussions on national security. We did not manage to find a solution to that to which everyone could sign up, but I am sure that the shadow Secretary of State will agree it is crucial that we ensure that we do nothing to jeopardise national security.
I agree that an important way forward from now on is to meet victims groups, and I will be doing that soon. I also hope that I will be able to meet the victims commissioner soon to discuss the best way forward because we need to find a way to get these bodies set up.
I welcome the shadow Secretary of State’s indication that he will not be opposing welfare reform. He is right to state that it is crucial that we do all we can to promote jobs and prosperity in Northern Ireland. A crucial way to do that is to ensure that the Executive have sound public finances. There have been many illustrations in recent years of the hugely negative effects Governments face if they cannot make their budgets add up, so getting the Executive’s budget on a sustainable basis and ensuring that it is delivering effective government for Northern Ireland is a crucial way to deliver the prosperity agenda, which is so important for Northern Ireland’s successful future.
I congratulate the Secretary of State on her achievement in bringing the parties to an agreement. I know that she has put an enormous amount of time, effort and indeed patience into the negotiations. In her statement, she referred to the importance of ensuring that young people do not get drawn into paramilitary activity. Does she agree that one way in which we can try to help with that is through improving and increasing integrated education? I understand that some funds were made available in the Stormont House agreement for those purposes and that there are projects waiting to start. Does she think that, with this agreement, that funding will now be available for those projects?
I thank my hon. Friend for his kind words. He is right that integrated education is a crucial means to address sectarian division in Northern Ireland, as is shared education. There are funds available in the £2 billion Stormont House agreement package, which will now be released. We are contributing to a £60 million programme to promote confidence-building measures to see the interface barriers, or so-called peace walls, taken down. That is another way to bring communities together, which is a key part of ensuring that paramilitary groups disband once and for all and are no longer part of Northern Ireland’s present day.

I thank the hon. Gentleman for his questions. On the important issue of testimony, it was established during the Saville inquiry that the testimony of anyone giving evidence to that inquiry could not be used either as a basis for conviction or indeed to incriminate themselves. That was done so that we could find out as much as possible about what happened on that fateful day. That principle still stands, and the protection of a person’s evidence is still an issue. However, it does not preclude other evidence that is gathered later. I cannot comment on the current police investigation. It would be wrong for me to interfere with the PSNI, or indeed inquire too deeply, as it must be left to follow the course of its investigation.
On the issue of legacy, I wish to place on the record my admiration for my right hon. Friend the Secretary of State, the Northern Ireland parties and the Irish Government who, over 150 meetings in the past nine-and-a-half weeks—75 bilateral meetings and more than 35 round table meetings—resolved the current impasse in Northern Ireland. They have decided that the best future is to move forward and not back. It is regrettable that that legacy has been left out of the final agreement in so far as legislation is concerned. However, the agreement signed yesterday continues to commit the parties to produce solutions to deal with the legacy; the victims of the Northern Ireland troubles will demand that. We, as the United Kingdom Government, have committed to provide the funding for that legacy inquiry to take place, and I hope that sooner rather than later, we get to a point where the policy we are examining in the Northern Ireland (Stormont House Agreement) Bill can be enacted so that, in the end, we can achieve not only justice for victims, but closure from the troubles.
The Minister—and indeed the Prime Minister a few minutes ago—was right to draw the House’s attention to the separation of powers. In order for people in Northern Ireland, and throughout the United Kingdom, to keep their faith in the peace process, is it not important that whoever is suspected of committing any crimes is fully investigated regardless of what roles they may be playing in Government now?
I totally agree with my hon. Friend, and it is why, not so long ago when a prominent member of Sinn Féin and former members of the provisional IRA were arrested, I said quite clearly at the Dispatch Box that we support the PSNI in pursuing the evidence that is presented to it to bring them to justice whether they are senior members of a political party or members of a terrorist organisation, but that is not to equate them with individuals who were in the British armed forces and who were doing their job to defend people who could not defend themselves.

Commons ChamberI agree with the shadow Secretary of State that trust between political parties is crucial in making progress in Northern Ireland and crucial to the effective functioning of devolved government. I wholeheartedly agree that belief in the rule of law and support for that concept is crucial in Northern Ireland, just as it is everywhere else in our country. Like the hon. Gentleman, I believe that the PSNI does a hugely important job in tackling not just the terrorism of the dissident republicans, but the criminality from the groupings about which I have been speaking today.
In relation to the case of Kevin McGuigan, the assessment confirms that the view of the two organisations, the PSNI and MI5, which compiled the report, is that the Chief Constable’s statement in August remains valid, so the situation in relation to the Kevin McGuigan case continues to be as set out by the PSNI in August.
On the question of access by the panel to classified and sensitive intelligence, yes, members of the panel were shown classified material and they had access to individuals from MI5 and the PSNI to challenge them on the process by which the assessment and the report had been compiled.
The shadow Secretary of State asked whether I believe the assessment can provide a basis to move forward. Yes, I do. As I said in my statement, I do not for a moment say that it answers all the questions in relation to paramilitary organisations. There is now a pressing need in the talks for the parties together to establish what is the best way to grapple with the continuing problems associated with the existence of paramilitary organisations, but I hope the publication of the assessment will inform the decisions that will need to be made in the coming days by the leaders of Northern Ireland.
In response to the question about my discussions on these matters, I have had extensive discussions with the five main parties in Northern Ireland and with the Irish Government as part of the talks process and beyond that. On the hon. Gentleman’s question about the establishment of the Loyalist Community Council, I welcome initiatives designed to move groups away from criminality, but this initiative must be judged on its results.
I echo the shadow Secretary of State. It is correct to highlight the conclusion in the assessment that none of the groups under consideration is planning terrorist attacks. He referred to the role these groups might have played in the transition of their members from a violent past to a peaceful future. I acknowledge that the picture is mixed, but there are some aspects of the assessment that are not completely negative.
That covers most of the hon. Gentleman’s questions. I close by saying that I agree with him that it is unacceptable for individuals, whether they are in paramilitary organisations or not, to be involved in disgraceful activity such as the fuel laundering and smuggling that I outlined today.
The report makes for depressing reading in some ways. Has the Secretary of State had the chance to assess whether any of the money from the fuel smuggling, extortion and so forth finds its way into the political process? Does she agree that the work of these criminals is no reason to bring the institutions down, provided that the police and the other agencies have sufficient resources to track these people down and stamp out their poisonous activities? Are sufficient resources going to these agencies so that they can do exactly that?
Yes, in some ways the assessment makes for depressing reading but, as I said to the hon. Member for Gedling (Vernon Coaker), the assessment is that the statement of the Chief Constable remains valid. He emphasised in that statement that the criminality appears to be by members for personal gain and to pursue personal agendas, so there is no evidence of funds being diverted for political purposes. On police resources, it is important that the police have the resources they need to tackle criminality and terrorism. That is one of the reasons why the UK Government have provided additional security funding, and it is why we need to resolve the budget questions around the Northern Ireland Executive and implement welfare reform so that it has resources for its priorities, such as policing.

Commons ChamberThat case has been made. That is why in the Stormont House agreement we allow flexibilities within Stormont to take measures appropriate to ensure that the troubles are recognised and their impact on the people of Northern Ireland mitigated. However, that is a matter for the Stormont House Government. The powers are there; it is time they got on with it.
Does the Minister agree that any Government that cannot set a budget cannot really govern properly? Are not the parties that are preventing the setting of the budget risking the collapse of the whole institutions?
I agree with my hon. Friend that unless this impasse is solved, public services will start to be hit as the money runs out. Let us not forget that the people of Northern Ireland deserve that this solution be put in place. We are already seeing the impact on the health service in Northern Ireland—and no doubt on other services, too. There is very little time left before the people of Northern Ireland realise that a non-functioning Stormont will take Northern Ireland backwards, not forwards.

Commons ChamberAs a co-sponsor of this debate, I acknowledge the hon. Member for South Antrim (Danny Kinahan) as the force behind persuading the Backbench Business Committee to allow us to have it, and he made a thoughtful speech tonight. He is a new but valuable member of the Northern Ireland Select Committee, and I know that he will contribute to its work for some years.
When beginning a speech in this place, it is normal to say what a pleasure it is to take part in the debate, and while it is always a privilege to speak in this Chamber, it is rather regrettable that yet again we have to hold a debate on Northern Ireland because of problems in the Province, especially when, as the hon. Gentleman said, so much is right and working there.
Looking across at the Opposition Benches, I see representatives of three parties and an independent. Although I see some disagreement, I also see a determination in all of them to make things in Northern Ireland work. Sadly, however, problems seem to get in the way of the institutions functioning as well as they might.
As I see it—I have only five minutes—there are two problems to address tonight and in the next few weeks. The first is the crisis—it is a crisis—of government in Northern Ireland, where there are no longer properly functioning institutions. We could say that that resulted from the very bad murders that took place—indeed, as the hon. Member for North Antrim (Ian Paisley) pointed out, we cannot skate over them—followed by the Chief Constable’s assertion that one of the murders was carried out by the IRA, which was supposed to have disbanded a long time ago. We cannot ignore the fact that that is what brought about the immediate crisis.
It is also right to recognise—the hon. Member for South Antrim devoted much of his speech to this point—that the institutions were not functioning before that. The real and deeper reason for this problem, as far as I can see, is the design of those institutions. We know why they were put together all those years ago—to bring people together and to get them talking to each other instead of firing at each other—and there could be no better reason than that for designing those institutions. No one’s heart could have failed to leap at the sight of Dr Ian Paisley sitting with Martin McGuinness. That really gave us hope. Thinking back, we have to accept that the way in which the institutions were designed—with those who wanted to be elected to the Assembly having to designate themselves Unionists or nationalists or neither—could be said to have institutionalised the very sectarianism we were trying to get away from.
It is important to address the longer-term problems. I do not think we shall get solutions this side of next year’s elections in Northern Ireland, but from that point on we have to look at ways of ensuring an effective decision-making body. The institutions have brought people together, and we should not underestimate that magnificent achievement, which is a tribute to all those who worked so hard to bring it about and to the people of Northern Ireland and the great resilience they have shown.
It would be unfortunate, however, for anyone to suggest that revisiting the Belfast agreement in order to improve it is somehow an attempt to unravel it. That cannot be the case. An attempt to make sure that the institutions work better in the future would enhance the principles of the Belfast agreement, and we have to show courage in doing that. I would rather see proposals for improvement come from Northern Ireland—from the Assembly, but also from ordinary men and women in Northern Ireland rather than from this place. It is up to the people in Northern Ireland in those institutions to agree them and make them work.
We must address the immediate crisis. I would say to anyone on the Assembly in Northern Ireland who is listening to the debate that I led for the Conservative party many times when we were in opposition. Direct rule from a Committee Upstairs gave no one in Northern Ireland an opportunity to have their say on major parts of legislation. It is surely better to make the institutions work.
