My hon. Friend will have heard my earlier answer. We are clear that future negotiations over trade must be separate from negotiations over access to waters. There would be no precedent to link the two, and we will continue to take this position in our negotiations on the economic partnership with the EU. The joint statement from the SFF and NFFO that was mentioned earlier made the normal position clear—that total allowable catches, quota shares and access arrangements should ordinarily be agreed through annual bilateral agreements.

When I was reading the Sunday newspapers over the weekend, I was not entirely sure that we would see the Secretary of State in his place today. This morning he says that his resignation is not imminent—I am not sure what message he is sending to his colleagues—but can I assume that his presence signals that he thinks that he won the argument with the Prime Minister yesterday and that a customs partnership with the EU has now been taken off the table?

My first advice to the right hon. and learned Gentleman is not to believe everything he reads in the papers—even about himself, let alone about me. Secondly, I made it clear earlier that the Government are spending some time, rightly, on ensuring that we get absolutely the best outcome that will preserve the United Kingdom without creating internal borders, and that will deliver the best outcome in retaining the trade that we have with the European Union and opening up opportunities with the rest of the world. That is why we are taking time to get this right.

Let me take that discussion to Northern Ireland. In December the Prime Minister made a solemn promise that there would be no hard border in Northern Ireland. That was spelled out as no infrastructure, no checks and no controls, and I know that the Secretary of State and his team take that seriously. If, on serious and sober analysis, the only conclusion is that delivering on that solemn promise requires the UK to be in a customs union with the EU, does the Secretary of State agree that that would therefore be the only position for any responsible Government to take?

The Under-Secretary of State for Exiting the European Union, my hon. Friend the Member for Worcester (Mr Walker), gave Labour Members some guidance on that earlier when he cited their former leader, who has taken a lot of interest in this issue, bearing in mind that he oversaw the last part of the peace process and takes it very seriously. In March this year, he said of the customs union:

“the truth is that doesn’t really resolve your problems. By the way, it doesn’t really resolve your problems in Northern Ireland, either.”

David Trimble, who was made Nobel laureate for his part in the peace process, also said that in pretty stark terms.

On the implementation period, we have made significant progress in a number of areas, and although negotiations are still ongoing, we are confident that we can reach an agreement on that at next week’s EU Council. As my hon. Friend will be aware, article 50 is clear that the withdrawal agreement shall be agreed in line with the framework for the future relationship. We expect new European Union guidelines covering the negotiation of the terms of our future relationship to be agreed at the March Council, as set out by the EU in December. The Prime Minister has set out a vision of the breadth and depth of the future relationship in a number of speeches, and we hope that the EU guidelines will be sufficiently flexible to allow the EU to think creatively and imaginatively about our future partnership. Indeed, I say to him that at least half the effort in the past three months has been aimed at ensuring that we get those flexible, open and broad guidelines by addressing that very issue with the 27 that make up the Council, as well as the Commission.

In January last year, the Secretary of State stood at the Dispatch Box and assured the House:

“What we have come up with…is the idea of a comprehensive free trade agreement and a comprehensive customs agreement that will deliver the exact same benefits as we have”.——[Official Report, 24 January 2017; Vol. 620, c. 169.]

The Government stood by that assurance for 14 months, but then the Prime Minister’s Mansion House speech downgraded the Government’s ambitions to reduced access to European markets. What does the Secretary of State have to say for himself now?

I would say two things to the right hon. and learned Gentleman. Of course, in a negotiation, we go in with the highest possible aspirations, and that is what we intended. Incidentally, he should read his own policy, which I recall has the same aspirations—not very effectively. What we are about is getting the best possible outcome for this country and that is what we will do.

We have had a lot of non-answers this morning, if I may say so, Mr Speaker. In addition to downgrading the ambition for the final deal, the Government are also delaying vital legislation in this House. We were expecting to consider the trade and customs Bill this week on Report and Third Reading but, apparently, they have been parked until May because the Government fear losing key votes. There is no sign of other vital legislation coming down the track. This should have been a busy period in Parliament. General debates on the EU are always interesting, but meaningful votes are better. What is going on?

The duration of the implementation period should be around two years. Only when the UK is no longer a member state can we take advantage of our status as an independent trading nation. As such, the UK will negotiate our own free trade agreements but not bring them into effect until after the implementation period has concluded. For this period, we will agree a process for discussing laws that might be brought in, on which we have not had our say. This will give us the means to remedy any issues through dialogue as soon as possible.

There have been lots of questions this week about the leaked EU exit analysis Whitehall briefings, but this is the first chance I have had to ask the Secretary of State about it directly, so I will choose my words carefully. Can the Secretary of State confirm when he first knew that economic modelling work on Brexit scenarios was being undertaken across Whitehall?

Actually, the right hon. and learned Gentleman does not have to ask me; he should read the book. In addressing the Select Committee on 6 December last year, I said in terms:

“We will at some stage—and some of this has been initiated—do the best we can to quantify the effect of different negotiating outcomes as we come up to them. Bear in mind that we have not started phase 2 yet. In particular, we will try to assess, in bigger categories, the effect of various outcomes in financial services and in terms of the overarching manufacturing industry, agriculture and so on. We will do that a little closer to the negotiating timetable.”

I say that because I read with great interest in Hansard and elsewhere this morning various reports about my being traduced, so I thought that I should tell the House that actually I told the Select Committee that this work was under way last December.

I think it follows that in December the Secretary of State knew that this modelling was going on. Can he confirm when he was first talked through the economic modelling of the Brexit scenarios by his Department—not when he told others, but when he was talked through it?

I beg to move,

That an humble Address be presented to Her Majesty, That she will be graciously pleased to give directions that the EU exit analysis which was referred to in his response to an Urgent Question in the House on 30 January by the Parliamentary Under-Secretary of State for Exiting the European Union be provided to the Exiting the European Union Committee and made available to all Members on a confidential basis as a matter of urgency.

The saga of the Brexit impact assessment rolls on. This all started back in December 2016, when the Secretary of State for Exiting the European Union first told the Brexit Committee that the Government were working on “sectoral impact analysis” in 57 areas—later, one was added to make it 58. In October last year, he got rather carried away with the idea and elaborated, saying that the analyses were “excruciating detail”, throwing in for good measure that the Prime Minister and the Cabinet had read the summaries. When various right hon. and hon. Members sought disclosure of the impact assessments, they were met with a flat refusal.

Things moved on. In November last year, we presented and won a Humble Address requiring the Government to disclose the impact assessments arising from the Government’s analysis—an important statement of principle. So far, so good. Some documents were made available, and I was one of those who went to the Treasury to see them. I was escorted to a room, where I had to pass over my phone and sign a document on confidentiality. I sat down, and two files were solemnly brought to me; I was allowed to read them and take some notes. We now know that those documents contained a description of the sector that could have been found in any House of Lords or Select Committee report, a summary of the EU law and policy—surprising that I had to give up my phone to read that—and then a very generalised view from the sector. I went through the footnotes to that third section and struggled to find one that did not relate to open-source material. Press releases and evidence given to Select Committees were there, all of which I solemnly noted before I handed the files back, got my phone back and left the premises. Those documents are now available online, minus the sector analysis and therefore the open-source material.

In September, when questioned by the Exiting the European Union Committee about the rest of the documents, the Secretary of State said that the Department had not done any impact assessments on any sector of the British economy. He made the point that the use of the word “impact” did not mean that an impact assessment had been done within the formal definition used by the civil service. As a former defence lawyer, I was struck by that defence. It was technically right that someone cannot be censured for contempt for failing to hand over impact assessments because they have not done any, but I was never sure which was worse: relying on that technical defence, or not doing the impact assessments in the first place.

Roll on one month, and in the past two days it was leaked that an assessment called the “EU Exit Analysis – Cross Whitehall Briefing” does in fact exist. It is reported that that document looks at three of the most plausible Brexit scenarios based on current EU arrangements with the range of predictions. Consistent with the principle established back in November 2017, the Opposition yesterday called on the Government to release that analysis. In true groundhog fashion, the Government said no, as they did last year.

The right hon. and learned Gentleman had a distinguished career in law before he came to this place. Does he condemn the leak of a Government document? To what extent are any Government documents to be regarded as confidential? Will he condemn the leak?

Before I was in this place, I held the post of Director of Public Prosecutions. We took leaks from our department or any other civil service department very seriously. I can only assume that an inquiry is in place in relation to this leak, and in the circumstances we should say nothing more about it.

I have repeatedly raised concerns that the north-east and other regions will be hard hit by the very obvious risks of Brexit. It seems from the leak that the Government share that view. Does my right hon. and learned Friend share my view that it is completely unacceptable that the Government think it is okay to keep businesses and people in regions such as mine in the dark?

My hon. Friend demonstrates that hon. Members have been trying on behalf of their constituencies and regions to get a proper analysis of the impact of Brexit on the individuals, businesses and communities they represent. That is why it is so important to have that information. It will mean that we can have an informed debate and hold the Government properly to account.

The right hon. and learned Gentleman described his experience of dealing with leaks. Does he accept that we have a curious cult of secrecy across Government today and have had for some years? A leak is a serious matter and I deplore leaks when documents are revealed whose contents compromise the national interest or are loaded with party political or other significance, but it is impossible to see how an objective analysis of the economic consequences of the various options that the Government are considering compromises the national interest. A properly open Government should make such information freely available to all those who have a legitimate interest in the subject, including MPs.

I agree. It is significant that the original documents that were requested last year were initially refused on freedom of information grounds, only then to be made available in the form I described, and then to be put in the public domain in any event, which demonstrates the point that many Governments—this Government are doing the same—put their arms around information that ought to be in the public domain to inform the debate. It is the wrong way of doing business.

If the Government are eventually forced to release the impact assessments, as I suspect they will be—I am sure the right hon. and learned Gentleman suspects the same—and if they confirm that any deal the Government strike will be worse than the one we have with the European Union, will he and the leader of the Labour party change their position and campaign much more vigorously to keep us in the European Union?

I have taken a number of interventions and will make progress. I will allow interventions later, otherwise I will not get very far.

Yesterday, standing at the Dispatch Box, I asked the Government to release the documents referred to in the leak. As I have said, the Government said no. The Under-Secretary of State for Exiting the European Union, the hon. Member for Wycombe (Mr Baker), who is in his place, advanced three defences for that position, none of which withstand scrutiny. His first defence—that the analysis is rubbish—was astonishing. He was asked whether he could name a single civil service forecast that was accurate. He glibly replied: “They are always wrong”. He may have forgotten that he is now part of the Government, and yesterday transposed himself back to being spokesperson for Vote Leave. Ministers and the Government commissioned those papers, and it is frankly ridiculous to attempt to rubbish them as an excuse for not publishing them.

There is a serious point. Is it seriously Government policy that impact assessments are so inherently unreliable that it is better to proceed without them? That is the logic of the position described yesterday. Is it not better to adopt the approach tweeted last night by the Under-Secretary of State for Justice, the hon. Member for Bracknell (Dr Lee), who said:

“The next phase of Brexit has to be all about the evidence. We can’t just dismiss this and move on. If there is evidence to the contrary, we need to see and consider that too”?

Before I give way, I will make one further point about the line of defence of rubbishing the analysis. It is deeply discourteous and disrespectful to the civil servants who have worked on those papers and are presumably continuing to work on them, often in difficult circumstances. In my experience, having been a civil servant, and having had civil servants as staff, they do a very good job whether or not they agree with the instructions given to them. To glibly answer that they are always wrong was deeply disrespectful to them. I hope the Under-Secretary of State for Exiting the European Union, the hon. Member for Worcester (Mr Walker), who will speak for the Government today, will take the opportunity formally to apologise to the civil servants who prepared those papers in good faith, and assure them of the support we all have for the work they are trying to do.

My right hon. and learned Friend makes the good point that, yesterday, we saw a pretty grim approach to economic forecasting, which was full of jokes and did not address the seriousness of the situation. Does he agree that an opportunity presents itself? The Conservative Government created the Office for Budget Responsibility—independent forecasters who could do the job of providing the public with the facts if only the Government would tell them what their policy is.

I do agree, and that is a very important point. Essentially, the OBR is saying that it cannot do its job because it does not have the information to do it. That is why it is far better to proceed on the basis of assessments of risk and impact, and to allow the OBR to do its job.

Having been a civil servant for five years and having engaged in risk assessments, I can say that the purpose of the exercise is to identify the risk, the size of the risk, and the likelihood of the risk. The fourth column, which is always the really important one, is what the Government will do to mitigate the risk. That is why these risk assessments are so important.

I thank the shadow Secretary of State for giving way. I agree with him on the important work of the civil service. Many real stakeholders, including the digital industry, the banking industry and the legal services industry, have come to me this week to say what a good job our civil service is doing in preparing for the Brexit negotiations. My understanding of this paper is that it suggests that the no-deal scenario is not very attractive and that cutting and pasting the Canada or the Norway deal is also not very attractive, but that is not what the Government are proposing. Does he not agree that it would be better if our Ministers got out of this House and on with their work to deliver a better deal?

I am grateful for that intervention. The hon. Lady will remember that one question I asked of the Minister yesterday was whether the model that the Government are pursuing has also been subjected to an impact assessment. I did not actually get any of the questions that I asked—about six—answered or even addressed by the Minister yesterday. I hope that some of them might be addressed later on today.

I thank the right hon. and learned Gentleman for giving way. Can he help us with this: has he established the status of these documents? From what I gather, these were not some loosely put together drafts of a document. Has he been able to establish whether these are the documents that were to be made available to members of the Cabinet—next week, I think, if not this week—under lock and key and subject to them not making notes? This is really important. Are these documents the ones that were deemed to be of such importance that the Cabinet should see them?

I am grateful for that intervention. I will answer it, and make a second point as I do so. This is a really important point. The second line of defence that was deployed yesterday for not releasing these documents was that they are not complete, they are at an early stage, and they are just evolving. As I recall it, that was exactly what was said about the first set of documents that we were trying to have released last year. We have heard that one before. I have not yet ascertained the status of the documents, but, as I understand it, they were being shown to key Ministers ahead of an important Cabinet Brexit Sub-Committee meeting next week. No doubt, the Minister will be able to confirm that. If those documents are in such a form that they can be shown to Ministers to brief them for an important meeting next week, they are certainly way past the stage of an early script that has not been approved.

I am grateful to the right hon. and learned Gentleman. Is he aware that, this morning at Welsh questions, the Wales Office Minister, in response to a question from my hon. Friend the Member for Dwyfor Meirionnydd (Liz Saville Roberts), said “We have many assessments as we go through this process”, so it is not just the one, but many? Will it not be essential that the Government release those assessments when they become available as we go through the process?

The hon. Member for Arfon (Hywel Williams) makes an important point on where the devolved Administrations have already done their work on the assessments. Therefore, is it what the Minister said yesterday at the Dispatch Box that the Government will not assist them with that work, because many of these areas are partly devolved and partly retained?

I am grateful for that intervention, because it is consistent with the point that was made earlier about the regions. Each of the regions and nations needs to understand the risk that it faces, so that it can then, if necessary, put the various mitigations in place. We need to press on these issues, so that is vital.

Does my right hon. and learned Friend agree that if the Government had at their disposal any economic evidence or forecast that backed up their chosen approach, it would already be in the public domain; it would not be called a leak?

I am grateful for that intervention, and I agree that it would be highly likely that such material would be put into the public domain.

I come back to this serious point: the choice now to be made is how we leave the EU and what the future relationship might be. That is a profoundly important question. There are many different choices, and we absolutely need—and there should be—a robust impact assessment that we can all see and all discuss.

Mr Speaker, I rather thought that the point of interventions was to engage in the debate that was going on, rather than to make a completely different point. Our position on the customs union has been made clear very, very many times, and I do not see that that is an intervention on the point that I am making, so I will press on.

The third line of defence that was advanced by the Minister, who now seeks instructions from the civil servants he disparaged yesterday, was that any disclosure might harm or undermine the negotiations. Again, we have heard that one before. We have always accepted that anything that genuinely undermines the negotiations should not be put into the public domain, but there is a difference between that and something that is simply embarrassing to the Government, a point made by the right hon. and learned Member for Rushcliffe (Mr Clarke) yesterday afternoon. This motion provides for confidentiality. That defence was immediately undermined by the Minister himself yesterday. When there is a leak, Governments usually say that they will not comment on the leak, and that they do not rely on the information in the leak, because if it is not to be in the public domain, nobody should rely on it. But the Minister not only commented on it, but sought to rely on the leak to advance his own case. When challenged by my right hon. Friend the Member for Normanton, Pontefract and Castleford (Yvette Cooper) about the customs union, he prayed in aid the figures, saying that

“there is economic growth under all the scenarios in the economic assessment.”—[Official Report, 30 January 2018; Vol. 635, c. 683.]

One cannot simply say, “I will rely on the figures to advance my own case, but I won’t publish the full figures so that anyone can question me properly on what I am saying.” We now need to go back to first principles.

As I have said, only question was asked on 23 June 2016, which was whether we should leave the EU—not how and not what the future relationship should be. These are incredibly important questions. We need an informed debate, including on the likely economic impact of different approaches. Publication is needed in the name of transparency; publication is needed in the name of scrutiny. There has been an indication that the Government will accept this motion, and I look forward to hearing from the Minister. When he does so, may I caution him, because his fellow Minister, the hon. Member for Wycombe, yesterday found himself saying, at the beginning of his answer that

“this economic analysis is not what is formally known as an impact assessment.”—[Official Report, 30 January 2018; Vol. 635, c. 680.]

Let us not go there again—where a motion is accepted only for later there to be a quibble as to whether the precise wording was sufficient to release the documents. If the motion is being accepted, it needs to be accepted in spirit, in form and in full. Secondly, let there be no confusion about editing or redacting. That is not provided for in this motion, just as it was not provided for last time.

Finally I ask the Minister, if the motion is to be accepted, when do the Government intend to release the documents? I remind the Minister that when this question arose at the end of our first Humble Address, Mr Speaker was asked what he considered to be a reasonable timeframe for the Government to respond. On that occasion, Mr Speaker said:

“One can take a view about this, one can consult “Erskine May” and one should reflect in a sober and considered fashion, but if the hon. Lady is asking me whether I envisage this being something that needs to be deliberated on over a period of several days, the answer is no.”—[Official Report, 1 November 2017; Vol. 630, c. 932.]

The Opposition anticipate and expect the same sort of timeframe to be kept to in this case.

Returning to the hard work of our officials, if every time any element of their work leaked we were forced to present unfinished work for the scrutiny of Parliament, the public and the press, there would be a very real chance that the quality of that work would suffer. It is simply not conducive to an open, honest and iterative process of policy making in government. That is as true for all the Government’s work as it is for EU exit. I do not believe that a single Member of this House believes that that would be in the national interest, so I urge the Select Committee, whose Chairman is here, to provide some assurances, in good faith, that, for those reasons and reflecting on the words of the motion, which recognise the confidential nature of the document, this preliminary analysis will not be made public.

On a point of order, Mr Speaker. The Government not having voted against the motion, it is—as I understand it—carried, which is a victory for transparency and accountability. Can I seek your guidance that this motion is, as the previous motion was, considered to be binding on the Government? Further, may I ask your guidance on what you might consider to be a reasonable period of time within which the Government should comply with the motion?

I am grateful to the right hon. and learned Gentleman for his point of order. The answer is twofold. First, yes, the motion is binding. I think that the Government are clear about that, and the Minister has indicated the intention of the Government to comply with it. Secondly, if memory serves me correctly, the motion refers to “a matter of urgency.” Therefore, the expectation must be that the report that is the subject of the debate will be released, published or made available to those persons mentioned in the motion as a matter of urgency.

I have now to announce the result of a Division deferred from a previous day. In respect of the Question relating to capital gains tax, the Ayes were 306 and the Noes were 240, so the Ayes have it.

I will begin by setting out our approach to publishing economic analysis, I hope once and for all.

I can confirm that—I think the right hon. and learned Member for Holborn and St Pancras (Keir Starmer) will want to listen to this. I can confirm that when we bring forward the vote on the final deal that we agree with the European Union, we will ensure that the House is presented with the appropriate analysis that the Government have carried out, so that the House can make an informed decision. All Members must surely agree, however, that the Government cannot be expected to put such an analysis into the public domain before it has been completed. That would misrepresent our views. Furthermore, the Government cannot be expected to publish the analysis while the negotiations continue, which would surely harm the national interest. Parliament has rightfully agreed that Ministers have a duty not to publish anything that could risk exposing our negotiating position.

Let me now turn to the article that prompted the urgent question. It is a selective interpretation of a preliminary analysis. It is an attempt to undermine our exit from the European Union. As I have told the House before, the Government are undertaking a wide range of analysis on our exit from the EU. The next stage of that analysis, summarised in a draft paper presented to Ministers this month, has been a cross-Whitehall effort to support our negotiating priorities. It has not been led by my Department, and it is not yet anywhere near being approved by Ministers. Even the ministerial team in my Department has only just been consulted on the paper, in recent days, and we have made it clear that it requires significant further work. In fact, I saw this report myself only this morning. The analysis to which I believe this article refers is a preliminary attempt to improve on the flawed analysis around the EU referendum. It is there to test ideas and to design a viable framework for the analysis of our exit from the EU. At this early stage, it only considers off-the-shelf trade arrangements that currently exist; we have been clear that these are not what we are seeking in the negotiations. It does not yet consider our desired outcome: the most ambitious relationship possible with the EU, as set out by the Prime Minister in her Florence speech.

Such an agreement is in the interests of both the UK and the EU. Therefore, the scenarios in this analysis continue to suffer from the flaws we have seen in previous analyses of this type. Such analyses have been proved to be wrong in the wake of the referendum, not least because there is huge uncertainty around any forecast, especially in the long run and especially in the context of a major strategic choice.

It is the Government’s job to improve on this analysis, but to do so we first have to understand where it went wrong previously. That is what the analysis to which this article refers is: it is not a forecast for our preferred outcome of the negotiations; it does not yet properly take account of the opportunities of leaving the EU.

Finally, on 23 June 2016 the people of this country took a decision to leave the EU in the context of a wide range of economic information. The purpose of this analysis is not to question that decision, which this House voted overwhelmingly to uphold. I hope all Members of this House will agree that we should continue to respect the result of the referendum.

Not good enough.

Here we go again: Brexit impact assessments, take two. For the past year, we have called on the Government to publish Brexit impact assessments. It is a simple argument: on decisions of this significance, Parliament is entitled to know the likely impact of the Government’s approach to Brexit and thus to hold the Government to account. The Government have repeatedly refused our requests.

Last year the Secretary of State initially insisted that these reports existed in “excruciating detail”, but were so sensitive that nobody else could see them. After this House passed a binding Humble Address, the Secretary of State changed tack, telling the Brexit Select Committee just last month that no “economic forecast of outcome” had ever existed. Yet last night we learn that an analysis has been produced after all.

This is now piling absurdity upon absurdity, and there are some pretty obvious questions. When was this new analysis commissioned? In particular, was it before or after the Secretary of State gave evidence to the Brexit Select Committee last month on this issue? Is this the only report that has been prepared on the Brexit scenarios? If not, what other analysis has been done? Does this new analysis model the Government’s Brexit approach? If not, why not? If so, will it lead to changes in Government policy? Finally, and most importantly, will the Secretary of State publish this now—not in nine months, but now, so that we can hold the Government properly to account?

We have been here before. It took a great deal of time last year and the use of a Humble Address to force the Government to release documents relating to Brexit. The Secretary of State has the chance today to avoid a repeat of that exercise if he commits to publishing this new analysis in full; will he do so?

The right hon. and learned Gentleman raises the question of impact assessments, and what I can say to the House is that we have always been absolutely clear that we have a wide-ranging programme of analysis, which is evolving continually, but this economic analysis is not what is formally known as an impact assessment. This Bill has never been fit for purpose. It was not fit for purpose when it started its life last year, and after 64 hours in Committee and 10 hours on Report it is still not fit for purpose. We have repeatedly pointed to six serious defects in the Bill. We pointed them out when the White Paper was published 10 months ago, in March last year. We pointed them out again when the Bill was first published in July last year, and I wrote to the Secretary of State setting out those six serious defects and inviting him to address them before the debate on Second Reading. He declined to do so. We pointed them out on Second Reading in September and we pointed them out again in Committee, but we have been talking to a brick wall. The Government have not accepted any of the points that the Opposition have made. They have conceded some ground on their own side, but they have not taken seriously the propositions and arguments that we on this side have put forward. In my experience of dealing with Bills, that is unusual. They have simply robotically voted down all Opposition amendments.

Let me start with the shenanigans surrounding exit day. For purely political reasons, the Government introduced a gimmick amendment to fix exit day in the Bill at 11 o’clock on 29 March 2019 for all purposes. I have no doubt that if a vote on that amendment had been taken on day one in Committee, the Government would have suffered another loss on this Bill because it was so obviously a defective amendment. It was absurd in so many respects that it is hard to know where to start. Let me deal with clause 6(1), which states:

“A court or tribunal…is not bound by any principles laid down, or any decisions made, on or after exit day by the European Court, and…cannot refer any matter to the European Court on or after exit day.”

So clause 6(1), as amended, means that there cannot be any reference to the European Court of Justice after 29 March 2019. However, in December, the Government committed in phase 1 to allowing EU citizens to refer to that Court for another eight years after article 50. Their amendment disables that. It is inconsistent with phase 1. Moreover, we have consistently said that there will have to be transitional measures in relation to article 50, and they will have to be on the same basic terms as we have now, which means staying in the single market and the customs union and under the jurisdiction of the European Court of Justice. So putting an amendment into the Bill that disables the European Court of Justice is inconsistent with the transitional measures.

I acknowledge that the Government have accepted—as they had to—an amendment to their own amendment, but that does not remedy the defect. All it does is tidy up the problem if there is an extension of article 50. It does not enable transitional arrangements on the same basic terms as now, which is what will be needed, and it does not enable EU citizens to exercise the rights that the Government guaranteed to them in the phase 1 agreement. So we are now in a ridiculous position.

I have pretty well given up on predictions, but it seems to me that the Government will now be bound to introduce subsequent legislation to amend this Bill before it comes into force. They will have to do that. It is one thing to pass a Bill and say that there might come a time when it has to be amended. It is another thing to pass a Bill knowing that between now and its coming into force, they will have to intercept it again to disable a provision that they are putting into the Bill. That is how absurd this has got—[Interruption.] Well, let us see whether there is an amendment to repeal this provision next time we are here. If there is not, we will lose the jurisdiction of the Court just at the time when the Government have promised EU citizens they will continue to have it.

As I made clear on Second Reading, thousands of provisions are being converted into our law, and the charter of fundamental rights is apparently the only one that cannot be converted. That is nonsense. The Government are being driven by ideology, not law.

The Government’s defence of their position is in tatters. The Secretary of State says it does not matter because the charter never added any rights, overlooking, of course, the case he brought against the then Home Secretary. His junior Minister, the hon. Member for Fareham (Suella Fernandes), whom I welcome to her place, says the complete opposite. She wrote an article in The Daily Telegraph expressing her concern and objecting to the charter precisely because it does add rights. I do not think that is the only issue on which she agrees to disagree with the Secretary of State. I do not know what team meetings are like in these early days, but I would like to be a fly on the wall as they try to reconcile their irreconcilable views on how we deal with Brexit.

Of course, the truth is that some of the rights are covered elsewhere, but others are not. The exercise the Government carried out proves the point—the Government’s position is deeply unpersuasive. The whole point of the charter was to gather all the rights and protections that existed discretely in other places and put them into one document. The Government have now decided that the best strategy is to scatter them back to where they started.

When pressed forcefully by the right hon. and learned Member for Rushcliffe (Mr Clarke) on the simple question why on earth the Government are doing this, the Solicitor General was driven yesterday to the answer that the sole intention is to avoid chaos. Well, that is what the charter looks like—a slim document that sets out the rights clearly—and this is the Government’s alternative: 73 pages of material telling people where to look for other sources on their rights. One is clear and the other is chaos.

The delegated powers in this Bill are far too widely drawn, and they are still subject to far too little parliamentary scrutiny. In Committee and on Report, the Government have ignored concerns that the delegated powers should be used only where necessary, that enforcement mechanisms should not be abolished by delegated powers and that rights and protections should not be taken away by delegated powers. The proposed shifting Committee—sifting Committee simply is not sufficient to scrutinise—[Interruption.] I had “shifty” on my mind when I looked up momentarily and saw the Secretary of State.

That is not the only cause for concern. Until exit, many EU-derived rights and protections are protected because of our membership of the EU. The protection falls away as we leave the EU, and that is not an idle point. The Bill leaves areas of employment law, such as the transfer of undertakings, annual leave regulations and the working time directive, vulnerable to Ministers with wide delegated powers. Those areas will no longer be protected. Our simple proposal that primary legislation should be used to alter those rights has been rebuffed at every turn.

There is a pretty united view on both sides of the House that clause 11 is defective, and Scottish Conservative Members have argued that the clause is not fit for purpose. The Government said they would table an amendment on Report, which has come and gone with no amendment. Unless the Lords puts this right, a Bill with a serious defect will be passed by Parliament. The Government might have a defence if this issue had arisen at a late stage, but this is one of the issues we raised in March 2017, and it has been raised by everyone who has read the Bill since. In 10 months, there has been no progress. The hon. Member for Stirling (Stephen Kerr), a Conservative, said yesterday that he is deeply “disappointed, dissatisfied and frustrated”. As he rightly said, it is not appropriate for the Government to blame outside influences for the lack of amendment on this issue. Members on both sides of the House will have to ask themselves whether they are willing to wave through a Bill that they know will weaken the devolution settlement of the devolved Administrations. On this side of the House, we are not willing to take that risk.

Let me turn to the sixth issue, which is the meaningful vote on article 50. This is the one area where change has been forced by a vote in this House. The Government of course fought that tooth and nail. To those Conservative Members who voted on that issue and pushed it, and were as a result described as “traitors” and “mutineers”, may I just say thank you? I thank them for standing up for what was right when others told them to stay sitting down. That vote was an important step forward. As we have long maintained, it is crucial to ensure this House has a say on the article 50 deal. How it will operate is still not clear, so let me put the Government on notice: we on this side of the House, and I am sure some on the other side, will be watching like hawks for any backsliding. This has been described as “a meaningful vote” and it must be meaningful. So let me be clear: if the Prime Minister thinks she can come to this House, put forward her proposed article 50 deal, lose that vote and carry on regardless or walk the UK off a cliff with no deal, she has got another think coming.

In conclusion, I thank all those who have spoken in these debates. I thank both Front-Bench teams, particularly my own, who have done so much hard work. I also thank the Clerks of the House and the Public Bill Office for the extraordinary support they have given to my team and Members from across the House. From this side of the House, may I also thank the Department for Exiting the European Union staff, who have worked so hard? They may or may not have liked the instructions they were working to—I do not know that—but they have worked very hard on all the tasks that have been given to them, and we sometimes forget the amount of work they put in. At times, this House has been at its best during the passage of this Bill, while the Government have been at their worst. They have been unwilling to listen to reason, unwilling to reflect on the obvious defects in this legislation and unwilling to ensure this Bill is fit for the incredibly important purpose it seeks to achieve. The Government have simply ploughed on. They have sidelined Parliament and made a mockery of the phrase “Take back control”. For those reasons, Labour will vote against this Bill tonight.

I am surprised that the hon. Gentleman thinks that I am less bright-eyed and bushy-tailed, but that is due to the extension of the single European cold, which is having a transition period of its own in my head. The simple point I made earlier was that if we try to go beyond two years, a number of European national Parliaments have said to their Governments that that would require a mixed procedure, which would involve the Walloon Parliament and 36 other Parliaments around Europe. That is the first reason. The second reason is that we have been given an instruction by 17.5 million British citizens to get on with leaving the European Union, and we have to do that as promptly and expeditiously as we can. Extending the transition period indefinitely would be seen as a breach of that promise.

Whatever comes out of the negotiations, this House voted last night that Parliament should have a meaningful vote, enshrined in law, at the end of the process. That was a humiliating and entirely avoidable defeat for the Government. This House now having spoken, will the Secretary of State give an assurance that the Government will not seek to undermine or overturn last night’s result on Report?

Let me first make an observation about last night’s result. The effect is to defer the powers available under clause 9 of the European Union (Withdrawal) Bill until after the withdrawal agreement and implementation Bill receives Royal Assent, which means that the timetable will be very compressed. Those who want a smooth and orderly exit from the European Union will hopefully want to see a working statute book, so we will have think about how we respond to last night’s result. We have always taken the House of Commons’ view seriously and will continue to do so.

The next accident waiting to happen is Government amendment 381, which seeks to put a fixed exit date on the face of the Bill. Rather than repeat last night’s debacle, will the Government commit to dropping that ill-conceived gimmick?

I start by apologising for my voice. Once again, I have acquired the single European cough, but I hope that it will pass.

Negotiations regarding our exit from the European Union are ongoing as we speak. Indeed, we are in the middle of an ongoing round. As such, I have to be a bit more circumspect than usual. We held further talks in Brussels over the past few days and progress has been made, but we have not yet reached a final conclusion. However, I believe that we are now close to concluding the first phase of the negotiations and moving on to talk about our future trade relations. There is much common understanding, and both sides agree that we must move forward together.

Our aims in this negotiation remain as they have always been. In particular, on the issue of Northern Ireland and Ireland, we have been clear that we want to protect all elements of the Good Friday/Belfast agreement to maintain the common travel area and to protect associated rights. We want to ensure that there is no hard border between Ireland and Northern Ireland. We recognise that, as we exit, we must respect the integrity of the EU single market and the customs union, but we are equally clear that we must respect the integrity of the United Kingdom.

There remain some final issues to resolve that require further negotiation and consultation over the coming days. Our officials are in continuous contact, and we expect to reconvene in Brussels later this week for further negotiations. I or the Prime Minister will formally update Parliament once this round of negotiations concludes, as I have done for every round so far. As was made clear by the comments from President Juncker and President Tusk yesterday, all parties remain confident of reaching a positive conclusion in the course of the week.

What an embarrassment. The last 24 hours have given a new meaning to the phrase “coalition of chaos”. Yesterday morning, No. 10 was briefing that a deal would be signed. There was high expectation that the Prime Minister would make a triumphant statement to the House. By teatime, we had a 49-second press conference saying that the deal was off. It is one thing to go to Brussels and fall out with those on the other side of the negotiating table; it is quite another to go to Brussels and fall out with those who are supposedly on our own side of the negotiating table. If ever there was a day for the Prime Minister to come to this House to answer questions, it is today.

But let us not be fooled that yesterday was just about choreography. There are two underlying causes of this latest and most serious failure. The first can be traced back to the Prime Minister’s conference speech in October last year, when she recklessly swept options such as the customs union and the single market off the table, and ruled out any role for the European Court of Justice, yet maintained that she could avoid a hard border in Northern Ireland. Well, yesterday the rubber hit the road. Fantasy met brutal reality. Labour is clear that there needs to be a UK-wide response to Brexit, so the question for the Government today is this: will the Prime Minister now rethink her reckless red lines and put options such a customs union and single market as back on the table for negotiations? If the price of the Prime Minister’s approach is the break-up of the Union and the reopening of bitter divides in Northern Ireland, that price is too high.

The second major reason for yesterday’s failure is that we have a Prime Minister who is so weak that the Democratic Unionist party has a veto over any proposal she makes. What precedent does it set when the Prime Minister is called out of negotiations at the 11th hour to be told by the DUP that the deal is off? What signal does that send to the EU about the Prime Minister’s ability to deliver Brexit?

Yesterday confirmed what we already knew: the DUP tail is wagging the Tory dog. This is now deeply serious, so what assurance can the Secretary of State give to the House that a deal will be agreed by the end of the week? Will he now drop the proposal for a fixed deadline in law for exit day of 29 March 2019? If ever there was an example of why that would be absurd, yesterday was it.

This House passed a motion on 1 November asking that impact assessments arising from sectoral analyses be provided to the Select Committee on Exiting the European Union. This Government take very seriously their parliamentary responsibilities, and have been clear that they would be providing information to the Committee.

In the past three weeks, Departments have worked to collate and bring together this information in a way that is accessible and informative. I am glad to be able to confirm that this information has been provided not only to the Select Committee on Exiting the European Union but to the House of Lords EU Select Committee and, indeed, to the devolved Administrations. I can also, Mr Speaker, with your permission, inform the House that we have initiated discussions with the parliamentary authorities to make this information available to all colleagues through a reading room.

We were clear from the start that we would respond to the motion, but also that the documents did not exist in the form requested. Indeed, I made it clear to the House during the debate on the day that

“there has been some misunderstanding about what this sectoral analysis actually is. It is not a series of 58…impact assessments.”—[Official Report, 1 November 2017; Vol. 630, c. 887.]

As I said, the sectoral analysis is a wide mix of qualitative and quantitative analysis contained in a range of documents developed at different times since the referendum. The House of Commons itself has recognised that, although Ministers should be as open as possible with Parliament, the Government also have an obligation to consider where it will be in the public interest for material to be published.

Furthermore, it is important to recognise that, in some cases, there is commercially confidential information in the analysis and that, in many cases, the analysis was developed to underpin advice to Ministers on negotiation options in various scenarios. It is well understood, as has been the case under successive Administrations, that such advice to Ministers must remain private.

In the light of all that, my right hon. Friend the Secretary of State for Exiting the European Union made a statement on 7 November in which he explained that, given the documents did not exist in the form requested, it would take

“some time to collate and bring together this information in a way that is accessible and informative to the Committee.”—[Official Report, 7 November 2017; Vol. 630, c. 1333.]

He committed that the reports would be provided within three weeks. In providing the information to the Committee yesterday, we have met that commitment. Parliament has endorsed the responsibility of Ministers not to release information that would undermine our negotiating position. Contrary to what has been asserted in some places, the Committee did not give any firm assurances that what was passed to it would not subsequently be published in full. Where there are precedents for Government agreeing to pass information to Select Committees in confidence, these have been on the basis of assurances received before material is shared or a clear set of rules, such as those governing intelligence material.

When he met the Secretary of State, the Chairman of the Select Committee did say that he was willing to enter into a dialogue—after the Select Committee had received documents from the Government. But that is not the same as an assurance that, if we provided confidential or sensitive material, it would not be published, and it is not in keeping with the usual practice of Committees on these sensitive issues. As such, the sectoral reports provided do not contain information that would undermine the UK’s hand in negotiations or material that is commercially or market sensitive. But the House should be in no doubt that this has been a very substantial undertaking. We have been as open as possible, subject to the overwhelming national interest of preserving our negotiating position. We have collated more than 800 pages of analysis for the Committees, less than a month from the motion being passed, and this covers all the 58 sectors. We now consider the motion of 1 November 2017 to have been satisfied.

“Transparency” and “accountability” are two words this Government do not understand. On 1 November, after a three-hour debate, this House voted in favour of a Humble Address requiring all 58 sectoral analyses to be passed to the Brexit Select Committee—not some of the reports, not redacted copies, but the full reports. The Government did not seek to amend the Humble Address, nor did they vote against the motion. After your advice to us, Mr. Speaker, the Government accepted that the motion was binding. It is simply not open to the Secretary of State to choose to ignore it and to pass to the Select Committee the documents he chooses. Whether he is in contempt of Parliament is a matter we will come to at some later date, but he is certainly treating Parliament with contempt.

The Secretary of State says, and the Minister has reported, that he did not get assurances from the Select Committee about how the documents would be used. The Minister therefore had better answer some pretty blunt questions this afternoon. What assurances were sought that were not given? He had better tread carefully, because there will be an audit trail here and if he cannot answer that question, if he did not pursue the assurances, if he did not suggest a course that was rejected, his cover for not disclosing these documents will be blown.

This is not a game. This is the most important set of decisions this country has taken for decades and they need to be subjected to proper scrutiny. In my experience, the biggest mistakes are made when decisions are not tested.

May I remind the Minister and the Secretary of State that, until this House passed the motion on 1 November, Ministers routinely claimed that these analyses were extensive and authoritative? They say that they have now put the documents together. In September, they answered a freedom of information request. The first question was, “Do you hold the material?” to which the answer was, “Yes.” That calls into serious question the explanation now being put before this House.

Finally, I am deeply concerned that the sum total of documents generated by the Government’s work on the impact on the economy of their approach to Brexit can be squeezed into two lever arch files. That is the volume of paperwork I would have expected for a pretty routine Crown court trial in my old world. If that is the case, we should all be worried. Is that the extent of the analysis? Either way, this a very sorry state of affairs.

Let me address some of the misconceptions in the right hon. and learned Gentleman’s statement. We have not edited or redacted reports. At the time the motion was passed, and subsequently, we were clear that the documents did not exist in the form requested. We have collated information in a way that does not include some sensitive material, but the documents, which he freely admits he has not seen, do not contain redactions. It is noticeable that the original suggestion of redactions in the debate on 1 November came from him, speaking from the Front Bench for the Opposition. He also said in the debate that he had

“accepted all along that the Government should not put into the public domain any information that would undermine our negotiating position”—[Official Report, 1 November 2017; Vol. 630, c. 881.]

He accepted that there is a level of detail, and confidential issues and tactics, that should not be discussed. Those were statements he made in the debate itself.

Let me tell the right hon. and learned Gentleman the logical consequences of that position. He has suggested that mechanisms are available that allow for the sharing of material in advance for Select Committees, and he is of course right—I addressed that in my opening statement. My Secretary of State met the Chair of the Select Committee and discussed these terms. It was very clear that, as the Chair has himself said in Parliament, he wanted to receive all the documents first before he would give any assurances as to the way in which they would be treated. On that basis, we had to be clear that we had to protect commercially sensitive information.

In the absence of any restrictions on what the Select Committee might do with the documentation, the Government had to be mindful of their obligations not to allow sensitive information to be public, but let me be clear again: we have been as open as possible within those obligations. The material we have provided to the Select Committee is very substantial. It is bizarre for the right hon. and learned Gentleman to dismiss it without having yet seen it. When Committee members have had an opportunity to consider it fully and to reflect on it, I think they will reasonably conclude that the Government have fully discharged the terms of the motion.

We have shared more than 800 pages of analysis with the Select Committee. The analysis describes the activity in each sector and the current regulatory regime for the sector. The report set out existing frameworks from across the globe for how trade is facilitated between countries in the sectors, as well as sector views, which cover a range of representative cross-sector views from businesses and organisations throughout the UK. We have taken care to incorporate up-to-date views from stakeholders, such as views on the proposed implementation period.

The right hon. and learned Gentleman asked: does this represent the sum of the Government’s analysis? Of course it does not. The motion referred to sectoral analyses and we have responded to that motion by sharing those sectoral analyses. I note the Select Committee’s statement following its meeting this morning and I welcome the fact that arrangements will be made for Committee members to view documents in confidence. When they do, I think they will find that there is a great deal of useful and valuable information here. I assure the House and the Committee that the Secretary of State will also be accepting their request to discuss the content.

I assure the House that my Department takes its responsibilities to Parliament extremely seriously. We have provided a vast amount of factual information to help the Committees and this House in their scrutiny. I am confident that we have met the requirements of the motion, while respecting our overriding duty to the national interest.

I thank the Secretary of State for advance notice of his statement.

This is clearly a statement of two halves. First, the usual “Groundhog Day” report back on the negotiations in Brussels: a round of negotiations; a press conference at the end that leaves us wondering whether the parties were in the same negotiations; then both sides briefing the press in the days immediately afterwards; and then a statement from the Dispatch Box that assures no one, underlining the profound lack of progress.

We want the next statement to be different. We want the Secretary of State to return and inform the House that real progress has been made—a breakthrough, even. Last time we were promised acceleration. What now? And what is the plan if the December deadline is missed?

I recognise some of the difficulties. As the Secretary of State knows, I have some sympathy with the position he has set out on Northern Ireland. As we see from the Northern Ireland Budget Bill, which is before the House today, the political situation in Northern Ireland is fragile. The peace process is too precious to be put at risk by rushing a Brexit deal that does not have the support of all communities. There must be no return to a hard border, and Northern Ireland should not be used by either side in the negotiations for political point scoring—that is an important point.

The second half of the statement is not a report back at all. It is a recognition by the Government that they are about to lose a series of votes on the withdrawal Bill. Labour has repeatedly argued since the Bill was published in July that the article 50 deal requires primary legislation, including a vote of this House—a point that was made forcefully on Second Reading.

Now, on the eve of crucial amendments being debated, we have this statement under the cloak of a report back from Brussels—I do not think it fools anyone. The devil will no doubt be in the detail, but can the Secretary of State now confirm that the Government accept Labour’s argument that clause 9 should be struck from the withdrawal Bill altogether?

Then there is the question of transitional arrangements. It is blindingly obvious to anybody following these negotiations that a final deal with the EU, including a trade agreement, will not be completed by March 2019 and that transitional agreements on the same terms as now are in the public interest. That is what businesses want, it is what communities want and it is what Labour has been calling for, for many, many months. So can the Secretary of State confirm, on the back of the statement he has just made, that the Government will not stand in the way of sensible transitional arrangements on the same basic terms as we have now with the EU? Can he also confirm that the Government will not now be pushing amendments inconsistent with transitional arrangements? And can he confirm to this House that it will get a vote in the event that there is no deal? These questions have been pressing for months. This last-minute attempt to climb down brings them into very sharp focus, and we are entitled to clear answers.

Yet more carping from the right hon. and learned Gentleman. He complains that the negotiations are not making as much progress as he would like, yet he allowed his Labour MEPs to vote against progress this time around. The question he needs to ask himself is, what would he be prepared to sacrifice in order to buy the good will of the European Commission? We are standing up for UK citizens being able to move around Europe, to use their professional qualifications, to vote in municipal elections. Is he seriously proposing that we let them down in the interests of suddenly rushing ahead? We are standing up for British taxpayers and not wasting their money, with a clear position that we will meet our financial commitments but only once we know more about our future relationship. Would he sell them out? We are using Brexit to restore the sovereignty of the British courts—would he let that go, too? Yes, he would, because he would give the European Court of Justice the right to dictate our laws in perpetuity.

Let me come back to the right hon. and learned Gentleman’s description; he says the second half of the statement does not arise from the negotiations. Well, yes it does, because one of the reasons for the Bill I have announced today is to provide European citizens with primary legislation that will put into British law the withdrawal agreement in toto. So this is as near as we can come to direct effect; it comes directly out of the negotiation. I hope that the next time I come to report to this House, we will get a little more support from the Labour party.
