I am grateful for that intervention. The point is this: the Prime Minister said that no British Conservative Government could or should sign up to any such arrangement, but now it is said that he could sign up to it. That is exactly why we should not trust that. It is why we should support amendment (a). [Interruption.] It is an important intervention, and I take it seriously. That is why amendment (a) is so important, because it gives the House an opportunity to know precisely what the commitment is and what words will go into the legislation.

I am not prepared, I am afraid—nor are the vast majority on the Opposition Benches—to take the Prime Minister’s word. There is more than enough evidence that his word does not mean anything and cannot be trusted.

I was one of those who worked in industry in Coventry during the period of the Thatcher Government when, as my right hon. and learned Friend, like his father, will know, every week we saw thousands of jobs lost in the motor car industry. Big companies such as Jaguar Land Rover are very worried about the industry’s future, bearing in mind that they will have certain things to prove and that if they cannot, they will have to pay tariffs, which could affect jobs and so on. If anyone wants to know why the Opposition are suspicious of any Government in relation to trade union rights, they have only to look at the Government’s Trade Union Act 2016, under a previous Prime Minister. They will see exactly what the Government have in mind.

I am grateful for that intervention, which reinforces the point. Manufacturing, which had been on its knees, has now revived, at least in part. Why would anybody, whichever way they voted, want to take an axe to it? I will never understand that.

My hon. Friend makes a very valid point. Unfortunately, on that occasion, as on too many occasions, the soon-to-be former Prime Minister was listening to nobody apart from her own reflection in the mirror. It is not even as though the Brexit party can claim that 11.5 million people wanted a no-deal Brexit but did not vote for it because they disagreed with some other aspect of the Brexit party’s policies, because it does not have any other policies for people to disagree with.

I am sure that the hon. Gentleman, like me and the rest of the House, recalls the Prime Minister saying before the general election that she was being obstructed by Parliament in getting her deal. That was put to the public, and as we all know, she got her result from the public: she lost her majority. On another point that he made, like him, we have consulted employers, company owners and so forth and they want a deal, as I am sure he would agree.

If we asked a lot of business leaders just now what their ideal option would be if they had a completely free choice, I think most would say, “Don’t leave.” Those who were pushing for us to accept the Prime Minister’s deal previously made it perfectly clear that that was because they thought it was either the Prime Minister’s deal or no deal. If they were presented with a choice of the Prime Minister’s Brexit or no Brexit, they might give a very different decision.

The people had the chance to vote for no deal and chose not to. We can no longer say that pursuing or being willing to allow a no-deal Brexit is the will of the people. The people spoke on 23 May just as firmly and decisively as they did in June 2016. Those who, for the last three years, have been telling us that we have to listen to what people said in June 2016 better start listening to what people said in May 2019, because it was not just about the failure of the no-deal Brexit parties to get anything like a majority of support. The parties who were unambiguous in saying that they were standing on a manifesto of “Stop Brexit”, without exception, had record-breaking successes. The SNP had our best ever European election result, as a result of which, I am proud to say, my good friend Alyn Smith is president of the European Free Alliance and is likely to become the vice-president of a group that has almost 50% more MEPs than the one that Mr Farage wants to lead. Plaid Cymru had its best ever European elections, as did the Liberal Democrats and the Alliance party in Northern Ireland. The Greens managed only their second best ever, but it is 30 years since they were anywhere near the vote that they got this time. Meanwhile in Scotland, the Tories went into these elections telling people in Scotland to send a message to Nicola Sturgeon; I can confidently say that Nicola Sturgeon has got the message.

The purpose of today’s motion is to force the Government to do what any rational, sane and democracy-respecting Government would already have done. We are trying to force the Government to give Parliament a choice and give direction to a Government who are leaderless, rudderless, drifting and utterly lost. The motion is designed to give Parliament a chance to stop a no-deal Brexit, and to stop what would in effect be the non-military coup against Parliament that some would-be Prime Ministers are already openly advocating.

In January, in March and in April 2019, this Parliament voted to take no deal off the table. On 23 May, the people made it clear that they want no deal taken off the table. This morning, some of our most important industries pleaded with us to take no deal off the table. Our duty could not be clearer: whatever our individual views on the European Union might be, it is time to get no deal off the table, and we can start that process by supporting the motion today.

Last week we touched on the difficulty of the EU elections and discussed the legal position and what the political position may be, and we need to bear that in mind. Of greater importance is that, given that we are discussing the future of the United Kingdom and its relationship with the EU, we take time to find the purpose of the extension and a majority that the House can get behind, so that we know why we are seeking the extension. That will begin to answer the question of how long an extension should be for.

I fully agree with my right hon. and learned Friend’s last point. The problem really is that the EU negotiators have said that there would have to be significant changes before they would look at an extension. The problem we have, certainly on the Back Benches and I am sure shared by my right hon. and learned Friend, is that nobody knows what the Prime Minister is going to ask the EU for in relation to that extension. Does he agree that it is disgraceful for the House to be kept in the dark in this way?

The problem with the Prime Minister’s approach is that last week we voted on a motion that said she would seek a short extension if the deal was passed by today—that was in paragraph (2) of the Prime Minister’s motion—and it has not been put before the House today, and that she would seek a longer extension if that was not the case. So, there was an expectation that the Prime Minister would do the opposite of what she has done today. Equally important is that there is a growing expectation that the House needs to have time to decide what happens next. A different Prime Minister might have reflected on what happened last week and come to the House this week to say, “I recognise that my deal is not going to get through as it is and I, the Prime Minister, will provide a process of some sort, or ask the House to help me with a process of some sort, to decide where there is a majority, so that we can move forward.” That is what is being missed in the letter.

I do not treat the referendum result with contempt. It has not been able to escape our attention and has dominated our lives for the past three years. The Petitions Committee should be treated with respect, and 135,000 signatures on a petition is not to be disregarded.

The petition text states:

“On the 25th of November both the UK Government and the European Union came to an agreement on the proposed departure from the EU. After an historic defeat in the House of Commons on the 15th of January, 2019 by a majority of 230 votes the PM has now decided to go back to the EU over the backstop.”

That is a statement of fact. On 25 November, the EU 27 leaders met for a special meeting of the European Council and endorsed the withdrawal agreement as presented by the negotiators of the EU and the UK. They also approved the political declaration on future EU-UK relations that accompanies the withdrawal agreement. The scale of the defeat in January was, I think, unexpected for most of us, and it is useful to consider why.

The petition mentions the backstop, which certainly accounts for part of the group of Government Members who voted against the deal, but there were many significant and substantial further concerns. For many of us, it was the imprecise nature of the political declaration that caused concerns; it looked like a wishlist of aspirations, rather than anything settled. Other concerns included the danger of a further cliff edge in two years’ time; the likelihood that at best we would pay to be part of programmes in which we no longer had any influence in terms of a vote; and the near certainty that we would still be subject to European Court of Justice jurisdiction. In other words, far from taking back control, we would, in the words of some, become “vassals”. Frankly, that had been obvious from the outset, and it was a pretty silly vassal that did not see that coming.

The second paragraph of the petition text states:

“Under section 5 (ii) of the Belfast agreement, 1998, there is agreement to ‘to use best endeavours to reach agreement on the adoption of common policies, in areas where there is a mutual cross-border and all island benefit’”.

Essentially, the Irish backstop is an unresolvable issue: it is a position of last resort that prevents a hard border on the island of Ireland by providing an EU-UK customs relationship if a suitable trade relationship has not been reached by the end of the transition period. Some are concerned that we cannot withdraw from it unilaterally, which of course is the whole point. It is a protection mechanism for both the Republic of Ireland and the UK as well as the rest of the EU, and thus it must apply to all of us.

Reams and reams have been written about the issue and months have been spent arguing about it and discussing it. The contents of the Attorney General’s codpiece continue to attract both speculation and consternation. Frankly, I suspect there is little that I can add to all the learned verbiage, other than the conclusion that it does not appear to be getting anyone very far. The technological solutions that some who fear being trapped inside a de facto customs union advocate to manage customs do not currently exist. Realistically, the backstop cannot change, or the protections that it offers will not be cast iron. Whatever codicils, clever words, Star Chamber tests or anything else are offered, a fundamental problem remains and is unlikely to be resolved.

Skilful negotiators are able to build confidence and create constructive ambivalence, allowing everyone to believe what they need to believe. It is a matter of politics, not law, and the Government’s failure to appreciate that is yet another in a long list of failures of basic competence. Brexiteers need to be honest: if they want to allow a position where a hard border becomes possible, they are accepting the potential break-up of the United Kingdom. By neglecting Northern Ireland in that way, it is possible that Brexit could result in the fracturing of our United Kingdom. For the Conservative and Unionist party, that is quite a price to pay. The border of the European Union will be the Irish border, as the Republic of Ireland is our only land border with Europe. The basic facts of geography are undeniable. Ireland is an island, and there is no way around that fact.

The third paragraph of the petition text considers the economic impact, noting that:

“The Government’s own economic analysis published in November 2018, shows that a no deal scenario will have roughly a 10% decrease in GDP.”

Again, volumes and reams have been written about the potential economic impact, particularly of no deal. Members will be delighted that I do not intend to re-rehearse those reams this afternoon. Like all economic predictions, it is of course contested, but we are in a curious place when the Government’s own economic predictions are treated with derision by their own supporters.

I will simply add to the already well-known data some information from last week, when the OECD published its regular economic outlook on the global economy. It predicts that a disorderly no-deal exit would probably spark a UK recession. The OECD shows that the UK economy has been weakening since the 2016 referendum.

I am sure that my hon. Friend is aware that MPs for constituencies in the west midlands are very concerned. We have consulted universities and with Jaguar Land Rover, and they are all concerned about the situation that the Government find themselves in, because it means they cannot plan for the future. There are 800,000 jobs at stake in the motorcar industry alone, so we have to get it right.

Likewise, universities may have problems recruiting staff from abroad unless that issue is sorted out. More importantly, the Government will not guarantee funding for universities beyond 2020. People in the west midlands are concerned. The universities rely on the motorcar trade and vice versa, so it is a very serious situation that should not be treated lightly by anybody.

I am grateful to my hon. Friend, who speaks with great knowledge about the west midlands and the motor industry. As a member of the Transport Committee, I have met with many motor manufacturing organisations, and I have watched aghast as the situation has unfolded over the last few months. It is very serious. Of course, the university sector is very important to my city. I have just come from a meeting with the University of Cambridge. My hon. Friend’s point about the uncertainty of future funding is very serious indeed.

To reinforce my hon. Friend’s point, Jaguar Land Rover has already made about 1,000 people redundant; it hopes to secure its future. Ford has made about 300 people redundant. Then there is Nissan and other such companies. The concern is very real. It is no good the Brexiteers treating lightly things that have serious implications for the country.

I agree entirely. Just the other day, I was calling on people when canvassing in Cambridge, and was struck by the number of people I was coming across who were raising personal experiences. Very senior engineers were telling me that they were applying for jobs in Switzerland because the research funding upon which they rely through the Europe Research Council will be going there. They have no desire to go and previously had no expectation that they would ever seek to leave such a wonderful place as Cambridge, but if that is where the research money is going, that is where scientists will go. It is a global set-up, and we risk doing huge harm to our industries and our universities.

We do not want to see article 50 extended. Our focus is on getting a deal that Parliament can support and on leaving on 29 March. Extending article 50 simply defers the moment of decision and extends that uncertainty.

I respect the way in which the hon. Gentleman has framed his question, because I know, as he does, that his constituency voted leave and that many of his constituents will be keen, as mine are, to ensure that we get this deal over the line. Clearly, the withdrawal agreement Bill is a significant piece of legislation and we will need to get it through the House, but the key issue is getting the deal through, because once we have done that, we will have the basis for the necessary consensus in the House to approach that legislation.

I thank the hon. Gentleman for his question. He will know that the multi-annual financial framework, from which that fund comes, finishes in a couple of years, so more certainty can probably be delivered to businesses such as those in his constituency from the shared prosperity fund.

T9. Following on from the question asked by my hon. Friend the Member for Cambridge (Daniel Zeichner) about European research funding, can the Minister clarify whether the Government intend to maintain that level of funding, whichever pot it comes out of, after we leave the EU? The University of Warwick is very concerned about that.

I have been sounding the alarm for the car industry for some time. Of course, its challenges are not just about Brexit, but Brexit has made things worse. Many of my constituents have lost their jobs. The claimant count has shot up on my council estate, and, given the lag in statistics, I fear that things will only get worse. Unemployment is now at 7.4% compared with the national average of 2.3%.

As 29 March approaches, it is paramount that we leave the EU with a deal—I have voted for the Prime Minister’s deal. Leaving without a deal would be catastrophic. This is not project fear; this is reality. These are real people’s lives that I am talking about. On Tuesday evening, I co-chaired a meeting with my friend the hon. Member for Birmingham, Erdington (Jack Dromey) of a wide range of organisations: Jaguar Land Rover, Ford, Airbus, Siemens, the CBI, the EEF, the NFU, the British Ceramic Confederation, the Association of British Insurers and so on. The damage of continued uncertainty and the lingering prospect of no deal was made perfectly clear. A total of 80% of CBI members have stopped investing in their businesses. The political uncertainty has damaged the UK’s credibility as a safe place for investment. One of the large US investors now describes the UK as the “problem child” of Europe. Against that backdrop, companies of all sizes are finding it increasingly difficult to justify doing business here.

When I was growing up, this country was often described as the “sick man of Europe”, and I really do not want us to become that again. Manufacturers are now spending tens of millions on no-deal preparations, as we heard earlier. It is extraordinary to think that they hope that that money will be wasted.

The manufacturing industry is not in decline. It accounts for 10% of the UK’s economic output. The UK is the ninth biggest manufacturer in the world, and manufacturing is not an industry that this country can afford to lose; it employs thousands of people and it pays well. However, for this success to continue, companies need to be certain that the UK is a reliable place to invest in and commit to. Unfortunately, as indicated by Ford’s recent announcements, this is now in doubt.

The right hon. Lady and my hon. Friend the Member for Birmingham, Erdington (Jack Dromey) have done quite a remarkable job in getting all the various organisations together. Like her, I am concerned because, as she knows, Jaguar Land Rover and a number of other companies are based in Coventry, and the local CBI has contacted me voicing concerns about the direction we are heading in with these negotiations. I hope that the right hon. Lady agrees with me.

West midlands MPs from across the political divide have sounded the alarm together for the jobs that are being put at risk.

Let me turn to a fresh example of what is at stake. We often speak about the economic cost, but there is a huge human cost. As Second Church Estates Commissioner, I was approached by the Bishop of Europe—yes, the Church of England has a diocese of Europe—on this subject. There are approximately 1 million European citizens living in the UK, many of whom are pensioners, and 250,000 are estimated to be receiving ongoing healthcare treatment. In addition, there are 50 million visitors from the UK annually to the continent, and they are covered by the European health insurance card. Indeed, 27 million UK citizens are registered as having one—maybe some of us do—but that provision is at stake in a no-deal Brexit. Permanent employees and residents are covered by an S1 certificate, which enables healthcare treatments to be reimbursed in the European economic area and Switzerland, but that too is at stake under a no-deal Brexit.

I am surprised to hear that the hon. Gentleman has not had an answer, because I have certainly signed one off. I am sorry if it has not reached him. I shall investigate that matter and check.

In the unsought-for event of no deal, there would be 21 months after we leave the EU for people to register for the scheme. Obviously, the same implementation period would not be in place, so that actually offers a longer period after the change in circumstances than the six-month grace period on offer in a deal scenario.

The Department has engaged extensively with the automotive sector to understand its priorities as we leave the EU. We met leading manufacturers in summits at Chevening House last year. Those were held with the Society of Motor Manufacturers and Traders. It is a dialogue that we are keen to pursue.

Absolutely. It is a very simple question to answer: people in the automotive sector, the businessmen we talked to—as across many other industries—have all said that they want to see a deal. They want certainty, and they want to be able to plan for the future, which is why, as I have said many times, we want to land the deal—we need a deal.

I will make some progress, because I have given way many times.

The point is this, and it has come out through all the interventions: there is no such thing as a managed no deal. That is why I have repeatedly said that no deal is not credible and not viable. It is a political hoax intended only to put pressure on Members of this House to back the Prime Minister’s deal.

Yesterday, instead of trying to find a viable way of getting a deal through the House, the Cabinet agreed to ramp up no-deal preparations, notwithstanding all the valid points that have been made. An additional £2 billion of taxpayers’ money has been allocated to that, which includes half a billion pounds to the Home Office, £400 million to the Department for Environment, Food and Rural Affairs and to Her Majesty’s Revenue and Customs, and £200 million for the Department for Business, Energy and Industrial Strategy. That funding will be welcomed by some in the European Research Group.

However, let us look at the reaction of businesses. The biggest customs firm inside Dover told “Channel 4 News” yesterday that crashing out of the EU without a deal would create “Armageddon” for the UK. That is business speaking. That is what it said to “Channel 4 News”. It is not me or anybody in this House; it is businesses that are running Dover telling us what they think the outcome would be. Five British business groups, including the Confederation of British Industry, said this morning:

“it is clear there is simply not enough time to prevent severe dislocation and disruption in just 100 days.”

That is the voice of business.

No wonder it is reported that there was considerable conflict of views around the Cabinet table. The Justice Secretary is reported to have told the Cabinet that a managed no deal is not a viable option. He apparently added that

“the responsibility of Cabinet ministers is not to propagate unicorns but to slay them.”

The Work and Pensions Secretary is reported to have told the Cabinet:

“Just because you’ve put a seatbelt on, it doesn’t mean you should crash the car.”

I agree with them. The first duty of the Government is to protect the public, and a no-deal Brexit would put the public at risk. That is not scaremongering; it is reality.

Even if the Government did choose to push ahead with a no deal, I am convinced that Parliament would stand in their way. The overwhelming majority of Members in this House would not countenance a no deal Brexit. I pay tribute to the, I think, now three hon. Members opposite who have already said that they would quit the Conservative party if the Government pressed ahead with no deal. I suspect that they are not alone. No Government have the right to plunge the country into chaos because of their own failure, and this Parliament will not let them.

I am not so sure that the Government grasp the seriousness of this situation. There are 800,000 jobs in the automobile industry alone at stake and about 300,000 in the west midlands, so we have to get some sort of deal, but not the deal that these are proposing. Does my right hon. and learned Friend agree about that?

I do agree, and at this stage of the negotiations, what I think should happen is that the deal should be put to a vote and the vote taken, and then we should have a grown-up conversation about what the real options are and stop pretending that some sort of managed no deal is the default position. It is not, and this House will never accept that it is the default position.

The Government are actually working to roll over all those deals, and the hon. Lady will see announcements in the coming days to deal with some of those points.

Have the Government looked at the costs that will result from our leaving the EU, whether in terms of commodities, pharmaceuticals or farming? Specifically, food prices are a big issue for the National Farmers Union, which I met a couple of weeks ago.

I thank the hon. Gentleman for his question. I know that he has long-standing concerns about what would happen in the case of a no deal, but I can honestly say to him that the best way to mitigate, to stop that problem happening, is to vote for the deal that is on the table.

I will give way in a little while.

The recent European Court of Justice judgment provides clarity at an essential point in the UK’s decision making over its future relationship with the EU. It exposes as false the idea that the only choice is between a bad deal negotiated by the Government or the disaster of no deal; remaining in the EU is still on the table, and the Prime Minister cannot insinuate otherwise. We, as Opposition parties, cannot allow the Government to kick the can down the road and we cannot allow them to run down the clock. I repeat: this is not a binary choice of this deal or no deal—there are other ways forward. The Prime Minister is simply scaremongering, trying to prevent a second EU referendum. This Government claim to want to fulfil the will of the people, yet they deny the people of the United Kingdom a say. This is a democracy, not a dictatorship. After two years of chaos, people have the right to change their minds. Why would this Government deny them a say? We cannot go on like this. We need clarity, certainty and conclusion; this continued turbulence is sending our economy into further insecurity. At a time when this place should be doing more to end homelessness, to decrease worklessness, to stop universal credit hardship, to safeguard our NHS—I could go on—this Prime Minister and this Government are distracted and divided. It is time they got on with the day job.

I picked up a point the right hon. Gentleman made earlier in response to Government Members. Scotland faces the same as the rest of the country. Under this deal there is a lot of uncertainty and unknowns. The EU can almost tell us what to do. So far, the Government have come forward with no plan B. We do not even know at the end of this deal what is going to happen. Expenditure has been guaranteed only up to 2020. That affects universities, research and development, and the major manufacturers in this country. Does he agree that this is a disgrace?

We continue to put the legislative building blocks in place to deliver our exit, and we have made good progress in passing the required primary legislation, including on nuclear safeguards and sanctions. As I said earlier, we are laying exit-related statutory instruments before Parliament.

Given that in politics one is sometimes asked for short answers, I feel that I should stop my answer with the word “yes”. Yes, we will be ready. This is an opportunity to pay tribute to the work that the Under-Secretary of State for Exiting the European Union, my hon. Friend the Member for Daventry (Chris Heaton-Harris), is doing on no-deal planning; a significant amount of work has been done. Let us not lose sight of the fact that the situation will also be very challenging: there is a huge amount to do as part of that no-deal planning. So yes, we will be ready, but significant work will be required.
