I congratulate my right hon. Friend on bringing the Bill forward. I fully support it and will be voting for it today. He outlined an impressive list of organisations. I do not think anybody has mentioned that apparently nine out of 10 of the British public support the ban, and that is something the House of Lords needs to take note of. I have just been looking through the list of emails I have had on the subject from right across my constituency from Chorlton, Didsbury, Burnage and Withington. From all kinds of different demographic groups and areas around the country, the British public are absolutely united in wanting this trade banned.

I thank my hon. Friend for that point and for highlighting the level of support. Of course, that was reinforced by the Government themselves in January in their response to the petition instigated by Mr Peter Egan, which said:

“We will continue working to deliver our manifesto commitment to ban the import of hunting trophies from endangered animals, which has overwhelming support from MPs and the public…We recognise that this is an issue that the public feel very strongly about, and over 85% of responses to our consultation supported further action. In the previous Parliamentary session, the Government fully supported the Hunting Trophies Bill during its passage through Parliament. The Bill passed the House of Commons in March 2023, with strong support from MPs, but did not progress through Committee stage in the House of Lords. We will continue working to deliver this important manifesto commitment.”

I hope the Minister will be able to back that up further in her contribution later on. That was reinforced in a reply at the end of January to a letter from a number of Members across the House that the hon. Member for Crawley organised, in which the Minister once again said that there is considerable debate, and that the Government support the Bill and shared the hon. Member’s disappointment that it did not pass through the Commons. It is absolutely clear that whatever our other divisions, we are united in support of a ban.

There is one particular aspect that I want to highlight. We have talked a lot about hunting in the wild, but there is the even more deplorable business of so-called canned hunting, where animals, especially lions, are bred in an enclosure to be shot by depraved individuals who want a trophy. I pay tribute to Lord Ashcroft—again, someone with whom I might disagree on other issues—who has spent a considerable amount of time campaigning on and instigating research into that appalling trade. I hope the Bill will help reduce the attraction to such trade. One firm involved in that dreadful trade advertised that

“Your hunt is never complete, until you receive your animals at home for you to reminisce and re-call your experiences for the rest of your life.”

Do we really want to be associated with people who take that sort of attitude?

I have taken a fair amount of time and a number of interventions. We could go on a lot longer and in a lot more detail, but I recognise that the House will want to make progress, and that colleagues will want to make what I hope will be brief contributions.

I visited Israel and the Occupied Palestinian Territories between 14 and 16 February. In Israel, I met Israel’s Attorney General, lawyers for the Israel Defence Forces, and the president of the Supreme Court. In the west bank, I met the Palestinian Attorney General and the Prime Minister.

We do not feel that that case was particularly helpful at this moment in the negotiations. We absolutely respect the ICJ—I have appeared there myself—and we of course understand that the interim measures order is binding on the parties. As I said to the hon. Member for Hammersmith (Andy Slaughter), elements of that order are extremely sensible, and we wholeheartedly respect them. We call, as the ICJ has done, for aid to go in and the hostages to come out immediately. That is the right way to proceed if we are ever to achieve a permanent ceasefire and, ultimately, a resolution of this dreadful conflict. However, we do not think terms such as “genocide”, without a formal final ruling of the Court, are particularly helpful to use.

I welcome the Attorney General’s strong condemnation of settler violence against Bedouin communities in the Occupied Palestinian Territories, and I also welcome the sanctions recently imposed on some of those involved in the violence. Based on her recent visit, does she think that there is a need to go further and sanction those extremist Israeli politicians who are encouraging the violent and illegal expansion of settlements?

When I visited the region with the hon. Member for York Central (Rachael Maskell) many years ago, we saw some of the actions of settlers in the occupied territories. So far as I was able to, I reprised that visit when I went to the region most recently, and I was surprised at the difference in the level of violence used. I was able to visit a Bedouin village and talk to those who feel that at a very difficult time for the farming community, during lambing, they were being pushed off their land. I listened very carefully to what the hon. Gentleman said, and I reassure him that the Government continue to keep this issue under review.

As I said, the UK supports the ICC and its chief prosecutor Karim Khan. We do have surveillance flights operating in the region. The primary purpose of those is to help with the hostage situation. We will say once again that we very much hope that the hostages will be released immediately. It is absolutely the case that we will continue to urge all parties to continue to abide by international humanitarian law.

As I emphasised to the House of Lords Constitution Committee in June, the rule of law is fundamental to our constitution, and it is the duty of the Law Officers to uphold it.

I will not ask the Attorney General to comment on specific legal advice that she has given to colleagues—I know she cannot do that—but, as a general point of principle, does she agree that the inclusion of a notwithstanding clause in legislation cannot magic away the international laws to which it refers, especially if an individual claimant can still assert their rights under those international laws?

The UK has a strong track record of supporting international law, and we ask that our friends and partners do the same. It is clear to us that all parties should abide by international law. It was very much brought home to me in that room in The Hague that Russia and Ukraine have not been in many rooms together during the past 18 months, but a courtroom brought them to the same place, and that shows the power of international law.

The Government are committed to ensuring that victims are treated fairly and compassionately. We know that joined-up working across the criminal justice system works, and we know that supporting victims makes a real difference. That is why we are spending four times as much on victim support as was the case in 2010.

There are victims of crime in our country who have had to wait years for their cases to come to court, who have bravely given testimony to ensure that the criminals who robbed or attacked them are convicted, and who, this week, will have to watch those criminals be bailed rather than jailed, because the prisons are too full to pass sentence against them. What message would the Attorney General like to send to those victims?

The message that I want to send to victims today is that they are very important to this Government. We want them to come forward and we want to investigate and prosecute the crimes of which they are the victims as well and as expeditiously as we can. I listened to what the Lord Chancellor had to say on Monday and I was impressed that he is putting those prison places in the right part of the system, focusing on those serving time for longer, more violent and more worrying offences, with those at the other end of the prison system—those on that revolving wheel of going in and out of prison—being treated in a different way. We want and he wants—it was clear to me that he feels this very strongly—to reduce crime, and he is making sure that the whole of the criminal justice system and the prison system works to achieve that aim.

As Attorney General, I am honoured to play an important role in upholding the rule of law, which is fundamental to our constitution. I thank the House of Lords Constitution Committee for its report. The Government published their response in March, and I am looking forward to appearing before the Committee next month.

The Constitution Committee said:

“The Government has now twice knowingly introduced legislation…which would breach the UK’s international obligations and in doing so, undermined the rule of law.”

The Committee was referring to the United Kingdom Internal Market Bill and the Northern Ireland Protocol Bill. Does this Attorney General accept that the Illegal Migration Bill is the third such example, and the first on her watch?

No, I do not accept that. I am bound by the Law Officers’ convention mentioned earlier, so I cannot comment on advice, even that provided by previous Law Officers. With regard to the two earlier Bills that the hon. Gentleman mentioned, the Government published summaries of their legal position during the introduction of both Bills, and we did so more recently in February this year on the Windsor framework.

I regularly meet the chair of the Environment Agency to discuss flood risk management, and indeed I spoke to its board yesterday. We have doubled our investment in flood and coastal erosion defence to £5.2 billion, to better protect 336,000 properties across the country by 2027. I am sure that the hon. Gentleman will welcome investment, for instance, in the new flood storage areas on the River Mersey, which were vital to reducing the risk to vulnerable communities during Storm Christoph earlier this year.

That is welcome, because in my constituency we found out that this is a growing problem this time last year, when we narrowly—by 2 cm—averted a disastrous flooding incident in Chorlton and Didsbury when the Mersey flooded. What is the Department’s assessment of the state of readiness in general of flood defences and flood response services as we go into the peak winter storm season?

I discussed this issue with the Environment Agency board yesterday. It is that time of year when being alert to flood risk is absolutely at the top of our priorities, and I visited the flood response centre at Horizon House in Bristol earlier in the autumn. So we stand ready; sadly, we have got quite used to flood response, but we have a good team responding to this now and they are ready for anything the winter might throw at them.

I said in my maiden speech that the climate crisis was the most important issue we faced, and in the six years that have passed since then, it has got even more urgent each year. COP26 is the best chance we have of mitigating the damage and keeping the target of 1.5° alive, but as the hon. Member for Brighton, Pavilion (Caroline Lucas) said in her excellent opening speech, time is running out, for the people and the planet, but also for COP26 to be set up to succeed. In a week and a half, we will have to lead by example, to consolidate partnerships, and to crack down on the biggest polluters. We need ambitious updated nationally determined contributions. We need to honour and build on our commitments to climate finance for poorer countries, and we need strong action on biodiversity, fossil fuels and loss and damage. This is a big, big challenge.

On the positive side, in terms of our setting an example, we have some ambitious national plans and there are encouraging words in the net zero strategy. The Government are good at setting targets, and their own climate advisers rated them nine out of 10, but they gave them “somewhere below” four out of 10 for their efforts to meet them. We need to lead by our actions. We need real green investment in the upcoming spending review. We know that it makes sense and we know that it saves money in the longer term as well as saving the planet. If we can find money for the covid emergency, we need to find money for the climate emergency. We have to reduce investment in fossil fuels, whether it is oil in the Cambo field and at Horse Hill, coal in Cumbria or gas in Mozambique. We also need stronger action on ending UK taxpayer support for overseas fossil fuel projects, without the exemptions.

We also need funding for local government. We cannot deliver on the actions we need without local government action. The Climate Change Committee says that local authorities need proper funding to pursue successful plans such as retrofitting housing—where is the big retrofit programme that we need to decarbonise our homes?—building green homes, decarbonising local transport systems and improving waste and recycling infrastructure. On waste and recycling, I strongly agree with the hon. Lady’s comments on the cuts to the aid budget. One in three people globally do not have access to a waste management service and 90% of waste in lower-income countries ends up dumped or burned. The common practice of burning waste causes more emissions than aviation, so waste management systems need to be on the agenda at COP26. I asked about this in COP26 questions yesterday, but I did not really get an answer.

Like the planet, I am running out of time, so I will leave the last words to Kevin Anderson, Manchester University’s professor of energy and climate change. He puts it very clearly:

“Climate change is essentially a cumulative problem (C02 builds up). So each day we don’t deliver the level of C02 cuts for 1.5-2°C we go backwards—just not as big a retrograde step as it would otherwise have been, but backwards nonetheless.”

Every day this problem is getting worse. We need to be honest about the challenge, and we need to step up and deliver on it.

That this House has considered local clean air targets.

It is a pleasure to see you in the Chair, Mr Walker. I am grateful to have the opportunity to talk about air quality. The issue involves a lot of different aspects, as I think we will hear from a number of contributors, but I want to focus my remarks mostly on traffic emissions. I wanted the debate to coincide with the recently launched consultation on Greater Manchester’s plans for a clean air zone. I am pleased that it has generated interest, and I look forward to hearing about developments in places such as Leeds, York, Cardiff, Stoke and, of course, Strangford. Accordingly, I will try to keep my opening remarks relatively short.

As we continue to live through a pandemic caused by a respiratory virus, there is clearly an urgent need to clear up the air we breathe, especially for those who live in the most polluted areas, such as the cities represented here today. I want to focus mainly on what is happening in Greater Manchester and on the local authorities’ planned actions. Also—stop me if you have heard this one before—I want to speak about the additional support needed from the Government to enable Greater Manchester to meet targets that will make a difference to the health of local people. That seems to be this week’s theme.

Before the pandemic, we already knew that air pollution posed a serious threat to the UK’s health and wellbeing. Every year, 11,000 people die from heart and circulatory diseases caused by air pollution. A report by the Royal College of Physicians found that nearly 40,000 early deaths can be attributed to air pollution in the UK every year. Increasingly, we are learning about the many other issues that air pollution can cause or make worse. This is a cradle-to-grave issue, with new research this month from the University of Manchester suggesting that air pollution can have an adverse effect on children’s ability to learn and that cutting air pollution by 20% could improve their working memory by 6%--the equivalent of four extra weeks’ learning time per year. That is to say nothing of the wider effect on growing lungs, brains and other organs. Scientists have also found links between growing up in an area with high pollution and the increased risk of developing a serious mental health issue.

There is substantial evidence to show that higher exposure to dirty air increases rates of neurodegenerative diseases such as Alzheimer’s, Parkinson’s and motor neurone disease. Last week, more evidence was provided on the link between air pollution and Alzheimer’s. Even if we take covid out of the equation, the combined impact that air pollution is having on our national health service and on people’s life outcomes is extremely worrying. The British Lung Foundation has said that air pollution is the main environmental threat to public health in the UK. Analysis has shown that almost 60% of people in England now live in areas where levels of toxic pollution exceeded legal limits last year. As such, despite the country’s many competing focuses at the moment, this is an issue that has to be prioritised and tackled urgently.

Much like coronavirus, air quality highlights and exacerbates existing inequalities in our society. It disproportionately hits people in some of our most deprived areas—often those living in crowded accommodation in areas near busy roads with high traffic congestion. It is worrying, but not surprising given what we already know, that there is growing evidence showing a link between covid deaths and poor air quality. A recent Harvard study found that an increase in fine particulate matter of just 1 microgram per cubic metre is associated with an 8% rise in covid-19 deaths.

Although there was a time during lockdown when we were breathing air that was cleaner than it had been for many years—if there can be said to be any silver lining to the disaster we are living through, that may be it, as it has given us a view of the world without air pollution—unfortunately that has not lasted. In fact, with the reluctance of people to get back on to public transport, there is a concern that traffic could rise to a higher level than pre-pandemic because of private car use. Major changes to people’s transport usage led to an initial steep drop in air pollution, but the relaxation of restrictions since June has led to increasing vehicle flows, with traffic volumes now less than 15% lower than typical pre-covid levels, and rising. As I say, they are likely to top pre-covid levels.

Having painted a fairly bleak picture of the problem, I want to talk about some of the solutions and some of the action that is happening locally, on the ground, to clean up our air. Following legal challenges by ClientEarth in the High Court, the Government directed 61 local authorities to bring nitrogen dioxide levels on local roads within legal limits as soon as possible. I thank ClientEarth for bringing that action and for its continuing work in pushing for the most ambitious progress possible on air quality improvement. ClientEarth has acted as a kind of conscience for the public and the Government in this field and has done a lot of excellent work that should be commended.

To focus on the local picture in my area, air pollution contributes to the equivalent of around 1,200 early deaths in Greater Manchester every year. Greater Manchester has historically suffered high emission levels and has a high number of non-compliant vehicles. The Government directed the combined authority in Greater Manchester to introduce a category C clean air zone across the region to bring nitrogen dioxide levels on local roads within legal limits as soon as possible and by 2024 at the latest. That is of course a welcome move, and we know that clean air zones are the best way to reduce nitrogen dioxide.

Greater Manchester is now consulting on key elements of the clean air plan proposal, which includes daily clean air zone charges for the most harmful vehicles but also takes into account discounts and exemptions and, importantly, proposes a funding package to support local businesses to upgrade to cleaner vehicles. I encourage stakeholders, businesses and individuals to engage with the consultation, which runs until 3 December, and I ask Greater Manchester residents take part, share their views and help to shape the future plans for our area. In parallel, the 10 Greater Manchester authorities are also running a consultation on Greater Manchester licensing standards, asking for views on proposed vehicle standards for hackney carriages and private hire vehicles, which will have a bearing on improving air quality, as it includes low emissions targets.

Greater Manchester’s clean air zone is expected to launch in 2022 and will be a designated area that certain high-polluting vehicles will pay a charge to drive into and within, aiming to clean up air quality by incentivising drivers to upgrade to a cleaner vehicle. All roads in Greater Manchester will be included in the clean air zone, with the exception of those managed by Highways England. ClientEarth has some criticisms of the Greater Manchester plan, including that it does not move quickly enough and particularly that it does not include private cars. Those are fair criticisms, and I hope that Greater Manchester, in looking at the future, will reflect on them and perhaps take them on board. We obviously need to move to a situation where we drive all high-polluting vehicles off the road, but the plans are an important start and cover the most polluting vehicles, such as vans, heavy goods vehicles and older taxis.

My hon. Friend makes some incredibly strong points. He knows I am a strong supporter of air quality measures and of reducing carbon emissions and the types of nitrogen oxide emissions he refers to. However, does he agree that adequate support needs to be given to private hire drivers and taxi drivers, who are often on low incomes, to help them make that transition? Most drivers I speak to want to make the transition as soon as possible, but they need support to do that, because they are often on very low incomes.

My hon. Friend anticipates some of the comments I am about to make, and I am grateful to him for making that point—it is really important, as the current crisis has shown. Many of those drivers are self-employed, and whenever I talk to a taxi driver in Manchester, they tell me that the trade is on its knees and that they really need support to get through this crisis, but also longer-term support for changing their vehicle.

More broadly, it is Greater Manchester’s ambition to secure more walking and cycling, which could be a positive legacy of lockdown—we have seen a lot more people walking and cycling. That could mitigate the bounce back to more reliance on car travel and encourage people to improve air quality for the long term. The combined authorities’ “Transport Strategy 2040” is focused on changing travel behaviour towards greener travel, aiming to reduce car use from 61% of trips in 2017 to no more than 50% of trips in 2040, although those will of course be largely in zero-emission vehicles.

There is an important point here. I gave up my car about two years ago and I now mostly walk, cycle, use a bus or take the Metrolink in Manchester. I can do that because I live in a part of Manchester that has good transport links. We have the Metrolink and we have a very busy bus route 100 yards from my house. When I am in London, I cycle to Parliament along a well-designed and segregated cycle route. If we want to change behaviour, we have to invest in public transport and infrastructure, from cycle lanes to zero-emission vehicle charging. The money is there. ClientEarth has suggested that the £27 billion that is currently allocated to the road investment strategy could be repurposed. That is something that the Government could usefully look at.

As well as investment in infrastructure and transport, the clean air zone proposals also need to be resourced. Greater Manchester’s proposals include Government assistance to help businesses and individuals upgrade to cleaner, compliant vehicles. Greater Manchester has requested funding from the Government totalling around £150 million to cover clean commercial, taxi and bus funds, and a hardship fund. The hardship fund is particularly important, as we have mentioned. It is designed to support those most vulnerable to the financial impacts of the clean air zone. The Government initially awarded £41 million, for which we are grateful, but there is a lot more to do. The leaders are currently in discussions to, I hope, secure the rest of the money. Can the Minister address that issue later?

The clean air plan was developed before the pandemic. The current consultation will take into account the impact of covid and any changes required as a result of the crisis. Local leaders in Greater Manchester are acutely aware of the fact that businesses, such as the taxi and private hire vehicle sector, have been severely impacted by covid. Government policies to stem the spread of the virus mean that they continue to be impacted. The consultation is considering extra support so that those businesses are not doubly penalised.

It is crucial that the final funding package from the Government recognises the changed economic circumstances we are operating in. It may be that more money is required to offset the financial impacts to individuals and businesses that have already been hard hit by covid. We might need more money even than was initially requested. I ask the Minister to ensure that the Government take that into account and stand ready to provide in full what is needed for the plan.

There is more I could say in terms of urging the Government to intervene to better support these efforts, but I need to wind up. Local authorities are responsible for the local road network and their own fleets, but responsibility for the strategic road network lies with Highways England, which has not been directed to reduce NO2 in the network in the same timescale or using the same processes. I encourage the Government to look at that anomaly. Greater Manchester has consistently called on the Government to issue a clear instruction to Highways England with regard to air pollution from the strategic road networks that it operates, so that our efforts in the region are not undermined. I encourage the Minister and the Government to act on that.

Greater Manchester is proposing the largest clean air zone outside London, but the funding support guaranteed so far by the Government has not matched the scale or ambition of those plans. Measures that could positively impact on carbon targets, such as an increase in electric vehicle infrastructure and facilitating sustainable journeys, are still considered separate from the clean air plan by Government. There is a strong argument for the various policy frameworks and funding settlements aimed at addressing nitrogen dioxide, PM2.5 and carbon to be better integrated and dealt with as one, rather than as separate disparate pots. I urge the Government to look at combining them and creating a generous clean air fund that all local authorities can use to fund their important air quality improvement work.

My final point, which my hon. Friend the Member for Newport West (Ruth Jones), who is speaking for the Opposition, might refer to, is that as well as complementing local clean air plans, we need meaningful, legally binding targets and real accountability when the Environment Bill comes back to the House. Can the Minister give us an indication of when that might be? I urge her to incorporate the World Health Organisation’s air quality standards into the Bill when it comes back to the House.

It has been a while since I spoke in a debate with you in the Chair, Sir Charles, and it slipped my mind that since the last time you have been awarded a knighthood, so belated congratulations, and apologies for misaddressing you at the start.

We have had a rhetorical tour of the UK in the past hour and a half. I am pleased that hon. Members have been able to speak up for their area. There have been two or three themes. First, we need to act quickly, because the more we learn about the effects of air pollution, the more worrying it becomes. Secondly, we need better targets. I welcome the new targets the Minister has just referred to, but we really need to do more and I hope that the forthcoming Environment Bill will put some of those targets in legislation.

Finally, we have heard many times about the need for Government support. The Minister referred to the £77 million that Manchester has been given; we need £150 million. It is expensive, but there are big economic and health costs to not acting. I urge the Government to act.

The new UK global tariff that has been announced today does retain tariffs for most key agricultural products, including those sensitive agricultural products that are often discussed in this House. The answer to the hon. Gentleman’s question is that we would seek to grant tariff-free access to EU trading partners in future through a free trade agreement, and we have set out clearly the legal text of an acceptable free trade agreement should our partners wish to enter into such an agreement. Maintaining those agricultural tariffs also ensures that we do not expose our market in the short term to lower-standard products from other countries.

What assessment he has made of the effect on air quality of the reduction in the use of motor vehicles during the covid-19 lockdown.

It is an absolute pleasure to be taking part today, Mr Speaker, although nothing really makes up for being there in person with you.

DEFRA’s roadside air quality monitoring stations continuously monitor air quality. Between 23 March and 5 May, nitrogen dioxide concentrations were, on average, 46% lower than this time last year, with reductions ranging from 9% to 65% at individual locations. That is largely due to the substantial reduction in traffic levels, although other factors such as weather may also have had some impact. Interestingly, concentrations of other air pollutants, such as fine particulate matter, have not shown similar trends.

I thank the Minister for her answer. That is some small good news, I guess, out of lockdown. In Manchester’s sister city of Wuhan in China, private car use nearly doubled when the lockdown ended, with the obvious effects on air quality. Is the Minister concerned that the Prime Minister’s statement of 10 May encouraged the use of cars?

It has been made very clear in all the guidance and by the Prime Minister that, first and foremost, if people can work from home, they should do so. Those who have to go to work were advised to go by car, and also to cycle and walk. I thank the hon. Gentleman very much for his question, because he strikes a good note. He will know that the uptake of cycling has surged during this time, especially where businesses are providing a scheme so that their employees can have bikes. He will also know that the Prime Minister has announced that we are phasing out new petrol and diesel vehicles by 2035—earlier, if possible. Lessons will be learnt. The Air Quality Expert Group has been conducting a big survey, and I know that the hon. Gentleman will be interested in the results when they are revealed.

I look forward to working with the shadow Front Benchers on these issues. We have gone further and faster than the previous Labour Government with radical changes, including the plastic bag tax and our plans to ban plastic stirrers and other plastic products. We are a world-leading country on this issue, and we will continue to be so because we are determined to tackle the problem.

The Government have invested £3.5 billion in improving air quality and £495 million is specifically set aside for councils where they are in breach of nitrogen dioxide limits. We will continue to support councils in a variety of ways to improve air quality.

Residents and businesses want to play their part in Greater Manchester’s plans to reduce air pollution, but unless the Government will properly support plans for vehicle upgrades and for retrofitting, many businesses will not be able to afford to do so. When will the Government give the clarity and the assurances on funding that businesses in Greater Manchester need?
