The hon. Gentleman is not the first person to raise the question of the ICJ, but as hon. Members may know, unless it is under the compulsory jurisdiction of the Court, we cannot submit a case to the Court without the consent of the other side, and it is very clear that China would not accept that. I did raise the question of third-party adjudication with my Chinese opposite number, but it is clear that the Chinese will not accept that. There is no easy adjudicative route, but I hope that I have reassured the hon. Gentleman that we have already looked at that very carefully.

I commend my right hon. Friend for his statement and clear leadership here and in the UN and for the Magnitsky arrangements he intends to bring forward. I remind him and others that China thinks that Hong Kong is collateral damage, which it can happily sweep to one side. The truth is that China sees itself as engaged in an ideological battle about how Governments should be formed, and it dismisses the rules-based order of the west. The Chinese have made that very clear, and they have a strategic view on it. So does my right hon. Friend agree that it is time for us to bring the free world together, not just to complain or to get rapporteurs, but to hit China in the one place it worries about—its economy? We have run to China to buy goods and to invest; it is time we reviewed every single programme here in the UK and around the free world. We learned a lesson 80 years ago about the appeasement of dictators. Maybe it should be applied today.

I am grateful to my right hon. Friend for his generous remarks. He is absolutely right to point to the importance of shoring up the values that we hold dear—the values reflected in the United Nations and the multilateral system. It is right to say that at threat are not just individual obligations in relation to the people of Hong Kong; there is a wider question of China trying to recraft the rules of the international system. It will take concerted effort with our international allies, in Europe and North America but much more broadly than that—that is why the G7 statement in support on Hong Kong was so important—to make sure that we can shore up the multilateral system and the international rule of law.

(Urgent Question): To ask the Prime Minister whether his Government will make a statement on the mistreatment by the Chinese Government of Uyghurs in Xinjiang province.

We are aware of reports issued today by the Associated Press and the Jamestown Foundation alleging that the Chinese Government are using pregnancy checks and forced intra-uterine devices, sterilisation and abortion to minimise Uyghur birth rates. These reports add to our concern about the human rights situation in Xinjiang and of course we will be considering the report carefully.

The broader human rights situation in Xinjiang is of ongoing and serious concern to the Government. This includes the extrajudicial detention of over a million Uyghur Muslims and other minorities in political re-education camps, systematic restrictions on Uyghur culture and the practice of Islam, and extensive and invasive surveillance targeting minorities. Further reports indicating that forced labour is being used and that children are being forcibly separated from their parents add to the growing body of evidence about the disturbing situation that Uyghurs and other minorities are facing in Xinjiang.

We have expressed our serious concerns about these issues on many occasions. The Foreign Secretary raised them directly with his Chinese counterpart, Foreign Minister and State Councillor Wang Yi in March. I also raised the situation in Xinjiang with the Chinese ambassador to London in March. Since 2018, we have played a leading role in raising these concerns at the UN. For example, at the UN Third Committee in October, the UK read out a statement on behalf of 22 other countries drawing attention to the human rights violations and abuses in Xinjiang and calling on China to uphold its obligations to respect human rights. We have consistently raised the issue at the UN Human Rights Council, including at the most recent session in March, when Lord Ahmad, the Minister for human rights, raised the issue in the UK’s opening address. In addition, we advise all businesses involved in investing in Xinjiang or with parts of their supply chains in Xinjiang to consider conducting appropriate due diligence to satisfy themselves that their activities do not support, or risk being seen to support, any human rights violations or abuses. The UK will continue to exercise leadership on this important issue, raising it directly with the Chinese Government and working with partners to do so at the UN.

The Inter-parliamentary Alliance on China—IPAC—which is made up of 30 other lawmakers from 16 global legislatures, has today published research by Professor Adrian Zenz, the world’s leading expert on the treatment of minorities in Xinjiang province. The report shows that birth rates in the two mostly Uyghur regions plummeted by more than 60% from 2015 to 2018. Across the Xinjiang region, birth rates fell nearly 24% in a single year, compared with just 4.2% nationwide. Worse, it is now clear that this is a direct result of Government actions. Unearthed Government documents mandate that birth control violations that come about

“due to the influence of extreme religious thinking”

should be “dealt with severely”, and that those unable to pay fines should be

“dealt with through coercive measures”,

including internment. Mr Zenz’s paper concludes that these measures are part of a state-wide crackdown that includes the mass sterilisation of women. This report corroborates the many horrific personal testimonies that many of us have heard. The genocide convention maintains that birth prevention targeted at minority groups is indicative of genocide, and the convention binds individual states to act, not just to rely on the international judicial system. Does my hon. Friend therefore agree that the Uyghur people have been, and are, the victims of mass atrocity crimes?

I ask the Foreign Secretary to go to the UN and call for an independent inquiry, but, sadly, I also recognise that the ways to deal with this through the UN will almost certainly be blocked by China. Given that likelihood, will my hon. Friend at least get the UK to make its own legal determination after weighing up this new evidence? Of course the world wants to deal with China, but we cannot continue with business as usual while this sort of blatant activity continues. Furthermore, given the Chinese Government’s appalling record on human rights, their attack on freedoms in Hong Kong, their bullying behaviour in border disputes from the South China seas to India, their blatant breaching of the rules-based order governing the free market and their delayed declaration on covid-19, will the Government now initiate an internal review of the UK’s dependence on China, with a view to significantly reducing that dependence, and call on the free world to come together to ensure that this growing threat from China is dealt with together before, as history teaches us, it is too late?

My right hon. Friend speaks with great passion and knowledge on these subjects. He refers to legal determination. As I said in my opening statement, these reports add to our concern about the situation in Xinjiang, and we will of course consider them extremely carefully. Any legal determination would be a matter for a competent court. I reiterate that we have raised concerns about the situation in Xinjiang at the UN General Assembly Third Committee and UN Human Rights Council, alongside our international partners. We will continue to make our concerns known directly to China and bilaterally, as well as through the relevant bodies.

On a full Government review, our approach to China remains clear-eyed and is rooted in our values and interests. It has always been the case that when we have concerns we raise them, and that where we need to intervene we will. We have consistently led international efforts to highlight concern about the worsening human rights situation in Xinjiang, and I assure my right hon. Friend that the United Kingdom will continue to do so.

I thank the hon. Gentleman for the substance and the tone of his position. We fully welcome his support, as indeed we welcome the support from all sides in the Chamber. This is a powerful opportunity for us to show a united position on this. It is something that successive Governments have agreed on. He asked whether, if we offered to change BNOs’ status, that would be a gift to Beijing. I do not think that that is true. I do not think, from the response of the Chinese Government, that that is correct. They are very sensitive about this, and in any event it is a point of principle. We have fought to live up to our international responsibilities and commitments, and, as I explained in my statement, we regard this as part of the package that went with the joint declaration. If that is upended because of action on the national security legislation, it is only right that we should rethink the position of BNO passport holders. That also explains, in relation to the question from the hon. Member for Wigan (Lisa Nandy), why we have been quite careful about timing. We have been prepared for this, and we have hoped it would not come, but as has often been said in this House, we hope for the best and prepare for the worst. The hon. Gentleman asked about how we build up international support. In my view, we do so based on principle and the rules of international law. The obvious riposte will be that we are intervening in internal affairs, but we are not. We are seeking to uphold China’s own freely assumed international obligations. And no, I am not expecting advance sight of the legislation from Beijing.

I congratulate my right hon. Friend on his statement, but does he not now think that the position of China is altogether too obvious, and that since President Xi arrived, its ambitions globally, both militarily and economically, are now fully on track and Hong Kong is but one manifestation of its global reach through the South China sea, through its abuse of human rights and through its ambitions over Taiwan? Is this not a case, as a previous Prime Minister once said, that this is

“only the first sip…of a bitter cup”,

and that it is going to be offered to us again and again? Appeasement, which has been the case for the free world, is now no longer an option, so will my right hon. Friend now explain how he intends to organise the free world so that we stand up against this? Also, will he now work with all our allies around the world to get them to give all Hong Kong passport holders right of abode, if necessary?

I thank my right hon. Friend for his excellent questions. I do think Hong Kong is part of a pattern, although it is not a uniform one. He referred to the violation of the UN convention on the law of the sea—I think that is what he was referring to in relation to the South China sea—and we could add cyber-attacks and the treatment of the Uighur Muslims. At every step, the right approach for the United Kingdom, as a matter of principle and also of effectiveness, is to call out behaviour that is contrary to international law on its own terms. In answer to the Chairman of the Select Committee and others, that is how we will build a coalition of like-minded countries to stand firm in the face of such behaviour.

My right hon. Friend asked about BNO passport holders. We have made a commitment, which he has heard today. It is important that we did that as a matter of principle, rather than waiting for others to agree in concept. However, we are already discussing with our partners—I raised it on the Five Eyes call yesterday—the possibility of burden sharing if we see a mass exodus from Hong Kong. I do not think that that is likely in the last analysis, but he is right to raise it, and we are on the case diplomatically.

Of course, people from a range of Departments were siphoned into DExEU when it was created. We have taken back a significant number of DExEU officials into the Foreign Office, and the Minister for Europe and the Americas, my right hon. Friend the Member for Tamworth (Christopher Pincher), talked to them earlier today. They will be integrated into the wider functions of Government in the usual way.

I congratulate my right hon. Friend on his statement and the Prime Minister on his.

Looking at the service sector, given that the EU has made next to no effort in most of the trade deal arrangements that they have negotiated to put any special pressure for a regulatory position for the UK in financial services, does my right hon. Friend now think that the EU will reference enhanced equivalence, as in the paper written by the lawyer Barnabas Reynolds, which the Treasury accepted? Will my right hon. Friend be proposing that to the EU as the way forward when it comes to regulation?

I thank the hon. Lady for those good, focused questions. The core of the network is the nerve centre for our national telecommunications network. It is for the most sensitive functions, relating to things like protecting sensitive data, and that is how we can identify very clearly the specific requirements needed to protect them. The access network—the periphery or the edge, as it is called—is the infrastructure connecting customer devices and equipment to mobile phone masts, transport and transmission networks. There is a clear distinction. She is right to say that technology is fluid and this may change over time, but we are very clear on the functions that we have identified and the way that we are going to protect them.

I say to my right hon. Friend that I am deeply disappointed by this decision. I have spoken at length to security officials, who will always say that defending in cyber-security is a game of catch-up—always catching up with the next algorithm change, and we can never guarantee that we spot it sometimes until too late. The reality of the 5G network is that it is fundamentally different. There will be less and less centralised function with more and more going to the periphery, which is exactly where Huawei will be. Given that he did not mention China as a threat to us in cyber-security—he mentioned only Russia—does he now believe that China is a threat to us in cyber-security; as he takes on those threats to us, does he think that he will now drive Huawei out of our future systems progressively, as quickly as he can?

The Government and the various statements that have been made in relation to the security risks have consistently called out China for cyber-attacks and other nefarious ways in which they risk—[Interruption.] I am doing it now, so hopefully my right hon. Friend will be reassured. We are squarely focused on that, but in relation to 5G it is important to assess very specifically, in a targeted way, the nature of the risk and make sure that we have the right tools to deal with that risk. As I said in an earlier answer, the risk of an outright ban is that it is a very blunt tool to deal with a very specific problem, but he is right to say that we have to be very mindful as technology develops in the future.

Sorry, I did not hear you, Mr Speaker. I will not give up that opportunity.

First, may I congratulate my right hon. Friend the Member for Bournemouth East (Mr Ellwood) on securing this urgent question, and my right hon. Friend at the Dispatch Box on his calm and reassuring manner throughout this period? Notwithstanding that, I would like to ask a question. From the moment that we negotiated that deal and the west offered an olive branch to Iran, our expectations have never really been met. Iran shows the face that it wishes to show to the west, but underneath it, it has gone on not de-escalating, but escalating the violence. Whether it is in Syria, all the way down to the Houthis, it has done nothing else but use its money to provoke violence and escalate trouble and war. My question to my right hon. Friend is this: at which point do we really get the idea that this regime is not displaying a peaceful nature and is not going to give up on any of its opportunities and that Nazanin Zaghari-Ratcliffe, like many others, is being held as a hostage? When do we decide that, actually, the people of Iran do not want this organisation any more and that we want to support them?

I thank my right hon. Friend for his question. He makes a range of important points. The reality is that we still view the Joint Comprehensive Plan of Action as the best means of restraining those in the regime who wish to pursue a nuclear weapon, and that is a top priority—our overriding priority—for this Government. In relation to the wider nefarious conduct of the Government of Iran, I share all of his concerns and then some. The reality is that that is why we have always supported the Macron and Trump initiatives to try to bring Iran back to the diplomatic table and deal with all of those issues in the round—if there is a choice to be made by the regime. We will continue to hold Iran accountable for its actions, while leaving the diplomatic door ajar. Ultimately, this will have to be resolved through a negotiated diplomatic route. Who knows what will happen given the current constellation of factors and the change of circumstances in Iran, but, at some point, it will have to come to the negotiating table.

I thank the right hon. Lady for her questions. As for the tweet, I have no idea where that came from. It certainly is not based on the conversation that my right hon. Friend the Foreign Secretary had with Secretary Pompeo last night. Let me be quite clear that we would be opposed to any incursion by Turkey into Syria. The right hon. Lady refers to what is technically called refoulement, which is proscribed under international law, and we would most certainly be against any attempt by any state to engage in social engineering, ethnic cleansing or demographic change.

The right hon. Lady referred to the constitutional committee, and she will be aware that Geir Pedersen led on that at the UN General Assembly and that it will be stood up on 30 October in Geneva. It will be three pillared, with the pillars being the opposition, the regime and independence. Our position would be that all citizens in Syria should be fully represented. There is only one way of making progress in Syria, and that is through an inclusive political process.

I rise to support the urgent question of my right hon. Friend the Member for Bournemouth East (Mr Ellwood). This is surely an issue on which we should be, in many senses, bolder and more public about our disagreement. In America, as the Minister will know, General Petraeus has made it absolutely clear that this is the wrong move and the Republicans themselves in Congress are absolutely opposed to it, so this is not an issue about Trump versus just the usual political sources. It is a real problem that we could abandon a key ally in the destruction of the caliphate and then release them to the mercies of Turkey. Can we make it clear, publicly, that we disapprove of this—not just to the Americans but, more importantly, to the Turks? Will we also make it clear that if the Turks do carry out their threat, we would consider it to be an aggressive act against ourselves as much as we would one against the Kurds?

I have said in plain terms that we would resist any incursion into Syria, and the reason for that—well, there are many reasons for it—is that it will divert attention away from the principal threat to this country in relation to this conflict, which is Daesh. It would potentially divert efforts by the SDF from its operations along the Euphrates valley to the north-west of the country. That would not be helpful and would destabilise the situation, and I think that that is probably behind a lot of concern that has been expressed in Washington. We will continue to work with our allies to push that agenda, because it is right, and if we are going to restore any sort of equanimity in Syria, we need to be united in this particular fight.

First, those on the Government Benches wholeheartedly endorse what the shadow Minister said about the shadow Foreign Secretary, whom we wish every success in having a rapid recovery after her unfortunate bicycle accident. I also thank him for his generous comments about my time as Foreign Secretary—without any sting in the tail. I particularly want to thank him for carefully comparing me to my predecessor after 5 o’clock, which was when the leadership contest for the Conservative party closed, because it might not have helped me if people thought that he thought I was a better Foreign Secretary. I also add my thanks for the brilliant service to British diplomacy of my right hon. Friend the Member for Rutland and Melton (Sir Alan Duncan), who was an outstanding Foreign Office Minister. He will be greatly missed inside King Charles Street—but not for long if tomorrow’s result is the upset that I am hoping for!

Let me turn to the substance of what the shadow Minister said. On the detention of Grace 1 by the Gibraltar authorities, I want to be absolutely clear that the United Kingdom did not endorse that detention by the Gibraltarian authorities because of a request by the US. We did it because it was transiting oil through the waters of a British overseas territory in contravention of EU sanctions against Syria. We have been absolutely clear that our issue was with the destination of that oil, which was President Assad’s regime, because a fundamental objective of British foreign policy has been to ensure that we redraw the international red lines against the use of chemical weapons, which Assad has so tragically broken.

That is also why we have sought to de-escalate the situation by making it clear to the Iranians that, whatever our disagreements with that regime, we would support the release of the tanker if we could receive guarantees that that oil was not going to Syria. We made that offer in public as well as in private, so that they would know we were absolutely serious.

There has been a huge amount of work since the detention happened on 4 July and, on the security side, the Ministry of Defence has been extremely active: officials have been posted at the Department for Transport, HMS Duncan has been dispatched, the threat level has been raised to level 3 and the activity of HMS Montrose has been enhanced. In recent days HMS Montrose has done 17 transits with 30 vessels, including 16 flying the red ensign; the Wildcat helicopters have flown for 26 hours; and the FCO has been doing a huge amount to try to de-escalate the situation, including calls to my Iranian counterpart, my US counterpart Mike Pompeo and the Chief Minister of Gibraltar. I also met the Chief Minister of Gibraltar and the French Foreign Minister, among many others, at the Foreign Affairs Council on 15 July.

A lot of things have been happening but, on the substantive point raised by the hon. Member for Leeds North East (Fabian Hamilton), it is important if we are to de-escalate the situation that we do not conflate what happened in Gibraltar and what happened to the Stena Impero with the joint comprehensive plan of action and our approach to the Iran nuclear deal, which is different from the approach taken by the Trump Administration.

On most foreign policy issues we are absolutely at one with the United States, which we consider to be our closest ally. Indeed, the alliance with the United States has been the foundation of global peace and prosperity since the second world war. We have a difference of opinion on this issue, but we are absolutely clear that, when it comes to freedom of navigation, there can be no compromise, which is why the solution we propose to the House this afternoon is one that brings in a much broader alliance of countries, including countries that, like us, have a different approach to the Iran nuclear deal.

The Iranians must understand that there will be no compromise on freedom of navigation in the strait of Hormuz, which is essential to the global economy and to global freedom of navigation. This country will not blink in that respect.

I welcome what my right hon. Friend has said. There is no question but that it is the Iranians, not the British, who have caused this problem. Any linking of this would therefore be quite wrong, and I commend him for what he said on that.

I want to ask a very simple question, and it may be one that my right hon. Friend is unable to answer at this point. We have known for some time that there is a heightened problem in the Gulf and that our strongest ally is there with some force. Why did we not request or agree with the United States that in the interim, while we get the right resources in place, it acts in concert with us to protect some of our shipping, as it has said it could have done?

I always listen to my right hon. Friend very carefully on all defence matters, and I reassure him that throughout this period we have had close behind-the-scenes discussions with the United States on how we can improve maritime security. HMS Montrose’s 17 transit missions would not have been possible without US logistical support. Indeed, the United States has made a proposal on how we could enhance maritime security more generally. The US asked us to contribute to a maritime force on 24 June, which became a formal request on 30 June, and it formally briefed NATO allies and the Washington diplomatic corps on the proposal last Thursday and last Friday. We will be talking to the US about it later this week.

We think what the United States is saying is helpful and important, and we will seek to co-ordinate any European efforts on freedom of navigation with anything the US does, but we want the UK’s contribution to be to make that coalition as broad as possible.

I thank the shadow Foreign Secretary not just for the tone of her comments but for the very moving way in which she delivered them. I thank her for her support of the work of the British high commission, which is particularly challenging at this time. We are indeed giving help to the Sri Lankan Government in the two areas on which they particularly requested help: counter-terrorism work and countering violent extremism, of which we sadly have a lot of experience in this country.

The right hon. Lady is right to say that at times like this bringing people together with a message of unity and reconciliation is the only approach. I think people on all sides of the House were immensely inspired by the tone taken by the New Zealand Prime Minister, Jacinda Ardern, after the horrific attacks in Christchurch. I know the Sri Lankan Government are making every attempt to take the same approach.

I thank the right hon. Lady for talking about the extraordinarily generous response made by Ben Nicholson after losing his wife and two children. I also agree with her that these kinds of attacks, far from being religious, are condemned by people of all faiths and none for their utter depravity.

The final point I want to make is simply that while it is right that, in this House, we think about the eight British people who lost their lives, the vast majority of people who were murdered were Sri Lankans at church on Easter morning, celebrating the resurrection of Christ and life. They did not deserve to suffer this way and it is absolutely right that we remember them as well.

I commend my right hon. Friend for his statement and for raising the reality, which is clear to us all, that these attacks were planned to have the maximum effect on the single biggest day in a Christian calendar, when children are encouraged to be in the church, celebrating what has been the resurrection for Christians of Christ. Therefore, they would have known that the maximum effect would be devastating. Following what the Opposition spokesman, the right hon. Member for Islington South and Finsbury (Emily Thornberry) said, does my right hon. Friend agree that the reality is that the one thing that Easter teaches us is that it is about sacrifice for others and the forgiveness that follows? I wonder whether he will therefore ensure that no matter what else happens, we give our greatest support to the Sri Lankan Government in pursuing those who conducted this terrible attack but, at the same time, recognising that the Christian faith is about forgiveness.

My right hon. Friend is absolutely right. Not only has the volume of oil produced collapsed, but many of the oil workers who would have produced the oil have fled the regime. Their families are living in absolute penury as a result of years of neglect and economic mismanagement. The hon. Member for Ilford South (Mike Gapes) was quite right to point out the extreme wealth that is being accumulated corruptly by members of the Chávez and Maduro regimes and by the military. Much of that money is offshored, including vast amounts in Spain. This is not a new phenomenon: for many years, the property market in some areas of Madrid was red hot with money that was flowing out of Venezuela and being used to buy office blocks and residential properties galore in order to cleanse the money out of Venezuela.

Any robust sanctions regime should not only ensure that money is prevented from leaving the country now but take into account the money that has been leaving for years, including at massive rates under Chávez. [Interruption.] That is clearly uncomfortable for the hon. Member for Bishop Auckland, but that money was stolen from the people of Venezuela and it needs to be taken back in as part of any sanctions regime. [Interruption.] If we are talking about laughter, we have seen great amount of laughter from the hon. Lady. This is either something she finds funny or something that she fails to understand.

Following the intervention the hon. Member for Ilford South (Mike Gapes), a fact that I find most harrowing is that aid lorries are now being turned away from the Venezuelan border because the Government are worried that they will lose their grip. That and the point he made exactly define an absence of humanity.

The main issue that we are considering this afternoon is what our independent system of sanctions will be like if and when we leave the European Union. That is the key point. I must confess that I am somewhat sceptical about the value of having an independent sanctions regime, because the whole point of sanctions is that when we work in concert with our closest allies, we are far more likely to achieve success than if we simply try to go it alone. This is nowhere writ more large than in relation to Russia.

For many years, individual countries of the European Union resisted adopting a shared sanctions regime in relation to Russia because some countries wanted to continue to take gas and oil from Russia, some wanted a strong political relationship with it, and Mr Berlusconi in Italy wanted to go to parties with President Putin. It was difficult for us to achieve a shared sanctions regime in relation to Russia. Indeed, it was only when Russia started using gas and oil as a means of oppressing Estonia, Lithuania and Latvia that the European Union decided to act in concert. The UK then went to European Council meetings where Prime Minister Cameron and then our present Prime Minister repeatedly said, “It’s been great, we’ve been able to persuade the European Union to adopt the sanctions that we wanted.” As a united body in Europe, we have been able to achieve far more than the United Kingdom will be able to if we go it alone.

I welcome the Minister’s comments that in the future we will, in the main, adopt the same kind of measures that the European Union adopts. My anxiety is that it might be difficult for us outside the European Union, unless there is some manner of working with the EU, to persuade it to adopt the kind of sanctions regime that we are interested in.

I am grateful to the hon. Gentleman for giving way. It is always worth hearing him on these subjects. I would simply point out that it is not all sweetness and light. For example, the Germans’ behaviour over Nord Stream 2 is going to break the whole sanctions regime, yet nothing seems to happen from the Commission.

The right hon. Gentleman has virtually stolen the words out of my mouth. He is absolutely right, but my anxiety is that when we are no longer in that room, it is going to be much more difficult for the UK to secure the outcome that we want in relation to Nord Stream 2. I hope that the Government will manage to find some means of establishing a strong relationship with the European Union in that regard.

I also worry about the Magnitsky process. I hear what the Minister is saying, but I have heard two Ministers speak on this subject since the House unanimously passed measures that the Government did not really want to include in the legislation—[Interruption.] I know that the Minister put them in in the end, but I am not sure that he was the most enthusiastic Member to adopt them. He can puff out his chest as much as he wants, but he is still not going to persuade me that he was quite there with the rest of us. The point is that we still do not have those measures in place. As he has referred to the Magnitsky process, I hope that we will now manage to sort this out very quickly, not least because Bill Browder has today been told that the Russians intend to press a seventh charge with Interpol—
