Commons ChamberIt is a pleasure to follow the lecture—sorry, the contribution—of the hon. Member for North Dorset (Simon Hoare), whom I congratulate on his election to Chair of the Northern Ireland Affairs Committee. I found myself agreeing with much of his contribution, which is unusual, but it was good to see him trying to win friends and influence people on the Democratic Unionist party Benches so early in his reign.
There have been developments in the situation in Northern Ireland, both positive and tragic, since the last time we debated this extension, meaning that I have not simply dusted down my last contribution on the subject, although elements will remain familiar. The positive developments have of course, sadly, been driven by the shocking terrorist murder of Lyra McKee, whose loss is still felt deeply across Northern Ireland, but it would be remiss of me not to welcome the talks that have been ongoing since May. In wishing all parties involved well, I urge all of them to be open-minded and open to concession in order to bring about the restoration of not only the Assembly and devolved government, but democracy itself to the people of Northern Ireland, and to do that as quickly as humanly possible.
Nevertheless, I have to reiterate once again that we are extremely disappointed that it has come to this. We, of course, accept that in the circumstances, amid the ongoing legislative vacuum in Northern Ireland, this Bill is again necessary. On the subject of developments, we welcome the Government response, published on Friday, to the submissions to the legacy consultation. Dealing with the legacy of the conflict and meeting the needs of victims and survivors has remained one of the pieces missing from the peace process. It is vital that this issue be dealt with in a comprehensive and inclusive fashion; all sides and all victims must feel that their specific hurt has been addressed and that their needs have been met. There have been a number of consultations over the past decade, but what has been missing is the political will to implement the recommendations that have come from these various reports. The SNP has certainly supported the implementation of the legacy institutions that were agreed by the Governments and the Northern Irish parties in the Stormont House agreement in December 2014.
The SNP believes it is essential that devolved government finally returns to Northern Ireland. In the face of the threat of a no-deal Brexit, the political vacuum cannot be allowed to continue. The murder of Lyra McKee was a terrible reminder of the dangers that a political vacuum can cause in Northern Ireland. Politics must be seen to be working again.
The SNP also welcomes the continued attempts by the two Governments and the political parties to secure a return to local government in Northern Ireland, but it is important that the passing of this Bill is not seen as a sign that the ongoing talks can be delayed until the autumn. To be fair, the Secretary of State said that in her opening remarks. Put simply, the people of Northern Ireland have been waiting too long without a Government. Public services, already facing severe financial strain, have been doubly impacted by the absence of vital political decision making and direction. The Northern Ireland civil service must be commended for its efforts over the past two and a half years, but the limited powers afforded to departmental leads is no substitute for a functioning Government.
Particularly amid ongoing austerity, the absence of decision making is straining Northern Irish public services. Decisions are urgently required to provide direction and funding to those services. As we have heard time and again in this place, current conditions are placing particular pressures on health and education. Let me give one example. Figures released in June showed that some 87,500 patients were waiting to be admitted to hospitals in Northern Ireland, which is an increase of 8.5% on the figure for the same period last year. The Prime Minister can make any amount of desperate speeches about reforms to devolution, but it is intolerable to have budgets for Northern Ireland being passed in this place.
A no-deal Brexit would fundamentally undermine the political settlement achieved in Northern Ireland and across the island of Ireland in 1998. The outgoing Chief Constable, George Hamilton, and the Garda commissioner have confirmed that a no-deal Brexit would necessitate additional security along the border. In addition, the UK’s own economic analysis, released in November 2018, showed that GDP in Northern Ireland would take a hit of 9%. Sadly but unsurprisingly, both Tory leadership candidates have refused to rule out no deal, despite the stark warnings of what it would mean politically and economically in Northern Ireland.
It is a fundamental problem that Northern Ireland has been without a Government throughout the entire article 50 process. It is unacceptable that the region that will be most affected by Brexit has had no official input. The UK Government have consistently ignored the fact that the people of Northern Ireland voted to remain in the European Union, just as those in Scotland did. The confidence and supply agreement between the Tories and the DUP has not just denied Scotland billions, but undermined the delicate balance of political relationships in Northern Ireland. Both the British and Irish Governments have been tasked with being co-guarantors of the Good Friday agreement. The criticism has been repeatedly made that the UK Government, constrained by the deal with the DUP in Westminster, have failed to apply political pressure in the talks when necessary for fear of the consequences to their slim majority in this House.
Let me put a scenario to the hon. Gentleman. Does he believe that if MSPs did not sit for two and a half years, the people of Scotland would be happy for them still to receive their salary, with just one cut having been made? Will the SNP therefore join me—I have called on the Labour party to do this—in calling on the Secretary of State to use her power to reduce the salaries of the Members of the Legislative Assembly? We have no functioning Assembly and no expectation of having one any day soon, and it is a disgrace that MLAs continue to receive their salaries. Will he endorse that view?
I thank the hon. Lady for her intervention. I have sympathy with what she says about the MLAs’ salary situation, because it is imperative that they get to the table and get the Government back up and running, but this is a devolved matter for Northern Ireland; SNP Members do not generally vote on or intervene in these issues.
I listened carefully to what the hon. Gentleman said in the earlier part of his speech. He mentioned the pressure on finances for hospitals and for our health and education services in Northern Ireland. Will he reflect on what he has just said? I would be more convinced that he was worried about those issues if he were to reflect on the fact that MLAs have received well over £12 million in salary since the Assembly collapsed in January 2017.
I hear what the hon. Lady says, and she is obviously and understandably passionate about the issue, but it is for the parties in Northern Ireland to get back to work and justify their salary. It is not for the SNP and its Members to justify that situation; it is for the MLAs and the parties in Northern Ireland to do that.
The confidence and supply deal has also undermined the devolved settlement by breaching the Barnett formula, and so denying the Scottish people a total of £3.4 billion thus far. If a new confidence and supply deal is struck with a new Prime Minister in the coming weeks, there simply must be a guarantee that any financial package will be subject to Barnett, and that Scotland will receive its fair share of central Government spending.
On the importance of restoring Stormont, I turn back to Brexit, which is wreaking havoc on every aspect of politics on these islands. Indeed, it has cost the Prime Minister her job and looks likely to lumber us with the former Foreign Secretary, the right hon. Member for Uxbridge and South Ruislip (Boris Johnson). Despite the Conservatives’ hustings over in Northern Ireland, the complete ignorance shown by the would-be Prime Ministers has been shocking, as the hon. Member for North Dorset illustrated. No doubt that has been frustrating, to say the least, for the Secretary of State, particularly at this sensitive time.
The broader instability caused by Brexit is a central reason why it has proven so difficult to restore the devolved institutions in Northern Ireland. There are many reasons why the Executive and the Assembly collapsed, but Brexit has prolonged the impasse. The fate of Brexit is in many ways tied to the process in Northern Ireland, so it is vital that Northern Ireland’s voice be heard. As Members may have heard said from these Benches on the odd occasion, Scotland voted by 62% to remain in the EU, but it also bears repeating that 56% of voters in Northern Ireland voted to remain in the EU. The Government have continued to ignore those voices, and now we all face a new Prime Minister seemingly hellbent on a hard Brexit and the economic vandalism that that will bring.
As we all know, Northern Ireland will be hit hardest by a disastrous no-deal scenario. All sectors state that that must be avoided at all costs. According to the Government’s own figures, crashing out would shrink the Northern Irish economy by 9%. Business leaders have warned that that would be the equivalent of another financial crisis. All this despite the fact that the people of Northern Ireland voted to remain. Such massive economic damage could easily be avoided if the UK decided to revoke article 50 and keep the best possible deal for all parties, which is full EU membership. It is, of course, also open to the UK to pursue a policy of staying in the European single market and customs union; there would then be no need for new economic land or sea borders, and trade and relationships—business and personal—would continue to flourish between Northern Ireland and the Republic of Ireland and beyond.
To conclude, we will not oppose the Bill for all the reasons I have outlined. On the various amendments tabled by the Labour Front-Bench team and others for Committee tomorrow, it is a long-held principle that we on the SNP Benches do not vote on matters devolved to other parts of the UK that solely affect that country. We are not blind to the circumstances in Northern Ireland, but we intend to stick to that principle.
I have spoken to campaigners on the issues concerned, and have been open and honest with them. Whether or not we as individual Members of Parliament are sympathetic to their cause, we fundamentally believe that legislation must be made with the agreement of the people or their representatives. I recognise that that position may displease some, but these issues and many others highlight the real and urgent necessity for the talks to succeed quickly. We sincerely hope this is the last time that a Secretary of State has to come to the House to seek such an extension, and wish her and all the parties involved the very best as they try to restore the democratic institutions of Northern Ireland.

Commons ChamberI am sorry that my right hon. Friend is disappointed that there are only five points. There are five areas in which discussions are taking place, within which there will be areas of consensus in all the working groups as well as areas that do not yet have consensus. We are working hard to achieve that consensus. I want to see us reach a point at which all the parties in Northern Ireland can confidently go into an Executive that they know is sustainable and will deliver for the people of Northern Ireland, and at which all the institutions of Northern Ireland established under the Belfast agreement are properly constituted.
I thank the Secretary of State not only for giving me advance sight of her statement but for meeting me earlier to provide a briefing on the situation in person. That was definitely appreciated. I agree with what she said about the appalling killing of Lyra McKee. That has been a stark reminder of the importance of ensuring that the hard-won peace in Northern Ireland is not jeopardised. We have only to look at the attempt on the life of a PSNI officer at the weekend to be reminded of the fragility of that peace. She is right to say that there is a responsibility on us all—the Government, the parties in this place and the Northern Ireland parties themselves —to ensure that the peace is not jeopardised, and the tone and manner in which we debate these issues is of the utmost importance. The SNP and I wish her well in delivering the hopes of all in Northern Ireland in the coming weeks.
Given the narrow window of which the Secretary of State speaks and the criticism of the level of intensification of the talks yesterday, with previous talks in Northern Ireland involving round-the-clock discussions, when will the Government seek to ramp up the intensity? Have the Governments outlined to the parties what actions they will take if the current talks are unsuccessful? What progress has been made on the reform of the petition of concern, which has the potential to unlock various other areas of disagreement?
Reports in the Belfast Telegraph this morning suggest that the backstop will form a key part of the negotiations between the DUP and the UK Government over a new confidence and supply agreement. Given what I will call the “divergent” views of the Northern Ireland parties on the backstop and Brexit itself, is the Secretary of State concerned that the anticipated confidence and supply negotiations may undermine and overshadow any progress made during the current talks?
I am grateful to the hon. Gentleman for his support. I was pleased to be able to sit down with him to discuss the role that he can play. He is quite right to talk about the tone and manner in which we discuss such matters. Speculation about what may or may not be matters of consensus or disagreement—this is not directed at the hon. Gentleman—does not help in this situation. If what we all want is the restoration of devolution, it is important that we do not speculate or try to second-guess, and that we allow the parties the space they need.
As for the intensity of the talks, we have already changed our approach following the statement from the Prime Minister and the Taoiseach over the weekend. The working groups have done great work, but we are now elevating the issues to leadership level, and this week is about airing those matters and intensifying the talks. I do not want to consider what might happen if the talks fail, because we cannot give anyone an excuse for failure. This is about how to succeed and get government restored.
Finally, the hon. Gentleman referred to the Government’s confidence and supply arrangements and Brexit, and I want to be clear that Brexit is not a part of the discussions. The talks are about how we re-establish government to deliver for the people of Northern Ireland on the issues that are Stormont’s responsibility. The confidence and supply arrangement is something for the usual channels.

Commons ChamberI thank the Chair of the Select Committee. I know that he, as a former Minister in the Northern Ireland Office, is very familiar with the situation in Londonderry and the security threat the PSNI and security forces face every day. It is quite something to think that when actions like this happen in Londonderry it is almost normal—it is just what happens. The PSNI face petrol bombs and shots being fired at them. They sit in Land Rovers and take the fire and the onslaught. Clearly, we will need to wait to see, in the days to come, what effect the camera crew being on the ground had, but this also shows that a crowd had gathered. People came out to watch what was seen as being a spectacle. That just goes to show that these spectacles can have the most deadly outcomes.
I thank the Secretary of State for advance sight of her statement, and I echo the comments that she and the hon. Member for Rochdale (Tony Lloyd) made. On behalf of the Scottish National party, I fully condemn this careless, cruel and cowardly murder. We send our deepest condolences to Lyra’s partner, friends and family.
Lyra McKee was simply doing her job at the time she was murdered, and it was a job she carried out with great skill. The New IRA has admitted its responsibility, saying that it was simply an “accident” and apologising to her friends and family. But sorry is nowhere near good enough. Sorry does not bring Lyra back. Sorry does not ease the suffering of her partner Sara and of her friends and family. Sorry does not alleviate the concerns of communities across Northern Ireland about a step backwards to a past they had hoped to forget. Reading the statement, we would be forgiven for thinking that the past two post-Good-Friday-agreement decades simply had not happened.
This tragedy underlines what people in Northern Ireland have been saying for years now, and there is no possible alternative conclusion: the current stalemate has been going on for too long. So I am grateful for what the Secretary of State said in her statement about talks with the parties this week. Can she confirm what form they will take? Does she have a realistic goal as to when she thinks the Executive can be back up and running by?
I want to finish with Lyra’s own words, powerful words that highlight just what her murder has robbed us of. She wrote a letter to her younger self about growing up gay in Northern Ireland, in which she said:
“You will do ‘normal’ things. You will spend time with your mum. You will go to work and pay your bills. You will go to the cinema with your best friend every week because that’s your ritual—dinner then an action movie where things explode. You will fall in love again. You will smile every day, knowing that someone loves you as much as you love them. Keep hanging on, kid. It’s worth it. I love you.”
Poignantly, she also said:
“We were the Good Friday Agreement generation, destined to never witness the horrors of war but to reap the spoils of peace. The spoils just never seemed to reach us.”
Let us ensure that she is the last to suffer.
Lyra’s words need no comment from me; they are powerful enough in their own right. The hon. Gentleman asked questions about devolution. I would be very happy to talk to him and others about next steps, but I feel that today is a day when we should think about that family who are going to bury a much-loved partner, daughter, friend. They are the ones we should be thinking about today, and perhaps we can talk about the other things after that.

Commons ChamberIt is very much like groundhog day when it comes to Northern Ireland legislation, albeit secondary legislation in this case. I could set out the many reasons why it is imperative that the Executive be re-formed. The Minister would largely agree with that aim but disagree as to the UK Government’s role and leadership in achieving that thus far. I hope that the real depth of feeling exhibited in Northern Ireland in recent days, following Lyra McKee’s sad death, and the Secretary of State’s conversations in the coming days with party leaders will mark a real shift in the political situation, because we are in danger of slipping into a reality where functioning devolution in Northern Ireland is no longer the norm. Although much of the fault ultimately falls on its own representatives, it is far beyond time that the UK Government began a new round of inclusive talks in earnest, in order that they be the arbiter that is required to end this impasse. I reiterate that, if the Government cannot do this, they should consider bringing in independent arbitration.
The murder of Lyra McKee last week has demonstrated to all of us across these islands just how fragile and precious the peace process in Northern Ireland is and always has been. Following her murder, the public and political reaction has been united in sending two very clear messages. The first is a condemnation of those who carried out the killing. The second is a determination that politics, and nothing else, must fill the dangerous political vacuum that has been allowed to develop. So we will not be opposing this SI tonight, but I have a few questions for the Minister to address in his summing up.
I understand that the hon. Gentleman does not wish to oppose the motion, but will he stand in our shoes and think about something? If Parliament were talking about his part of the kingdom—his part of Scotland—he would oppose the motion tonight, would he not?
I thank the hon. Gentleman for that question and understand where it comes from. It is of great regret that we have to consider this SI at all. It is not comfortable for me to address situations in another part of the United Kingdom that should be devolved. There should be elected representatives in Northern Ireland, but—I hate this phrase—we are where we are. We have to ensure that the regulations are passed this evening, so we will not oppose them.
On Monday, the leaders of the Social Democratic and Labour party, the Ulster Unionist party and the Alliance party called on the Secretary of State to reconvene inclusive talks on power sharing this week. We in the SNP have been calling for such urgent talks at every turn. The Secretary of State has said that the restoration of devolution is her top priority, so will the Minister respond to the public and political calls to convene talks urgently? They should be proper talks, not just brief conversations between the Secretary of State and the party leaders. Why must there be such delay? I see no reason why talks should be dragged out beyond the local and European elections. The people of Northern Ireland deserved a functioning Assembly three years ago, and they deserve one now, not at some arbitrary future date. Can the Minister explain the justification for this—is the extension a deliberate attempt to stall the reconvening of talks until September?
In previous debates, Members from all parties have outlined concerns that the Northern Irish civil service has been stretched to its limit. Will the Minister update the House on the administrative pressures that the Northern Irish civil service is experiencing because of the absence of political direction? Given the vacuum in Northern Ireland, why has the British-Irish Inter- governmental Conference not met more regularly? What meetings are planned for the immediate future?
In conclusion, the SNP wants Northern Ireland to benefit from a fully functioning Executive and Assembly. That is in the interests of Northern Ireland, Scotland, the UK and, indeed, Europe. The continued absence of power sharing can no longer be tolerated. The people of Northern Ireland deserve better from all its elected representatives and its Government.

Commons ChamberI would like to see talks resume as soon as possible, but I am acutely aware that there are issues, including the fact that local government elections are now being fought in Northern Ireland and that we are in purdah, that create difficulties for what can be achieved, but I do want to see as soon as possible a short, focused set of five-party talks.
The Secretary of State has previously said that formal talks could not take place until after the local elections on 2 May, which she has just referred to, but given the Brexit developments, or a lack thereof, is she now proposing that all-party talks will now not happen until after the European elections at the end of May, which would bring us into the heart of the marching season? How can she possibly justify yet another delay in attempting to restore the Assembly that nearly 80% of the Northern Irish public are crying out for?
The hon. Gentleman refers to a number of issues that may be making it more difficult for parties to find an accommodation to enable them to restore devolution. I know that he is a supporter of devolution, and therefore I suggest to him that the best way that we can all help on that is to vote for the deal.

Commons ChamberYesterday’s letter from David Sterling, the head of the Northern Ireland civil service, gave the honest assessment that it was apparent that businesses in Northern Ireland were not adequately prepared for a no-deal Brexit. Who could possibly blame Northern Irish businesses for that, if the UK Government are not prepared either? Just ask the Transport Secretary. Given this stark advice, why will the Secretary of State not support the calls to take no deal off the negotiating table now?
I disagree with the hon. Gentleman, for whom I have enormous respect, when he says that the Government are not prepared for no deal. We are working towards preparing for all eventual outcomes, but we want to leave the European Union with a deal. We want to ensure that we respect the result of the referendum and leave with a deal, and the best way to do that is to vote for the deal.

Commons ChamberI rise to speak briefly in this Bill on devolved Northern Ireland business. The hon. Member for Strangford (Jim Shannon) can rest assured that there will be no green cheese in today’s remarks; and these will be remarks, as they will hardly be a speech.
As the Chair of the Northern Ireland Affairs Committee said, it has been over two years since the renewable heat incentive brought down the Northern Ireland Executive and Assembly, grinding all decision making to a halt. Since that occurred, the Secretary of State for Northern Ireland and the UK Government have simply not done enough to restore Northern Ireland’s political institutions and restore confidence in power sharing while championing Northern Ireland’s devolution settlement.
We have just passed yet another fast-tracked budget Bill that, by rights, should have been debated and decided on in Belfast. Today we will fast-track yet another Bill—this one on rates and the renewable heating scheme, albeit a scheme with huge and unintended political consequences, but the criteria of which were designed in Northern Ireland, for Northern Ireland.
I reiterate one of the central points that I made yesterday as we debated the Northern Ireland Budget (Anticipation and Adjustments) (No. 2) Bill: these debates should not be ours to have and these decisions should not be ours to make. Decisions on devolved issues must only be taken in devolved legislatures or by Ministers of devolved Executives and Governments—not in this place and certainly not in Whitehall. Of course, Stormont’s politicians need to start serving the people they were elected to represent, but this Government must up their game to get the two sides round the table—and if they cannot, as I said yesterday, they should bring in a third party who can. I accept that this Bill must be passed, but we cannot continue passing such legislation in this place—that is not how devolution should ever work.
I promised to be brief, and brief I will be. I very much hope that this is the last time that I, or anybody else in this place, makes a contribution on a matter like this that is for other devolved legislatures.

Commons ChamberFor another year, I rise with a degree of reluctance as we agree a budget that should be debated about 300 miles from here. I am sure that hon. Members across the House will agree that this situation is deeply regrettable. Devolution should be cherished, and its success is vital to the growth and prosperity of Northern Ireland. I believe unequivocally that this budget should not be voted on by politicians in this place representing constituencies in Scotland, Wales and England. Also, as others have said, this emergency legislation process affords ineffective scrutiny. I once again urge the Government to redouble their efforts to begin talks in earnest as soon as possible, so that they can be the effective arbiter required to bring an end to this impasse. If they cannot do that, they should bring in someone who can.
The collapse of the Executive and the subsequent failure to deal with the situation have placed huge, unsustainable stress on the civil service in Northern Ireland. I join the hon. Member for South West Wiltshire (Dr Murrison) in praising the Northern Irish civil service for all the work it has done in these tough times without an Executive. In our opinion, direct rule can never be countenanced, but as the shambolic Brexit process is now a central reason for the ongoing crisis, the UK Government have a responsibility to ensure that talks progress swiftly.
Amid ongoing austerity, the absence of decision making is straining Northern Irish public services. Decisions are urgently required to provide direction and funding to vital services. The current conditions are placing particular pressures on health and education, which are the most important services that a Government can deliver. It is for this reason that I want to make it clear that I do not begrudge the additional money that is going to be made available for public services in Northern Ireland—far from it. We have been calling for additional public spending from Westminster for years. However, it must be said that, under our agreed devolved settlement in this precious Union of equals, both Scotland and Wales should also receive additional funding. Successive UK Governments have inflicted brutal austerity measures on Scotland and Wales, as well as on Northern Ireland. That extra funding could be a small step towards repairing this recklessly inflicted damage. Indeed, if the Barnett formula were applied as it should be, Scotland would receive an extra £400 million for its budget.
Last year, the economy of Northern Ireland did not keep pace with the rest of the UK and it lagged far behind that of the Republic of Ireland, which was growing around four times faster. That just shows what a small independent country in the EU is capable of.
I firmly believe that investment in good public services and infrastructure is vital to the success of any economy. There is £140 million of new funding in recognition of the lack of opportunity for more “fundamental service reconfiguration”—a nifty wee phrase with which the Treasury and the Northern Ireland Office are attempting to circumvent the regular budgetary process. We cannot forget that that is in addition to the £333 million of funding that comes from the Government’s confidence and supply agreement with the Democratic Unionist party. Some of the money seems to be allocated effectively, with £100 million to support health transformation, £3 million for broadband and £200 million for capital spending on key infrastructure projects. I particularly welcome the £30 million to tackle poor mental health and severe deprivation. However, despite my jealousy at that extra investment, I would never countenance the SNP selling its soul to prop up a Government who do so much harm to our citizens and are hellbent on ripping us out of the EU, for which neither Scotland nor Northern Ireland voted, and the reasons behind the positive spending are more than a little suspect. In fact, many say that the extra funding is just a Brexit bung to buy off the DUP.
The extra revenue allocation falls outside the normal budgetary processes deliberately to ensure that Scotland and Wales are denied their rightful Barnett consequentials. That raises huge questions of the Secretary of State for Scotland, who said unequivocally that he
“was not going to agree to anything that could be construed as back-door funding to Northern Ireland”.
He has been written to this week, but he had not replied by the time that I stood up to speak, so does the Secretary of State for Northern Ireland know when the Secretary of State for Scotland was informed that the additional moneys would not be subject to the Barnett formula? Did he agree to that? Most importantly, did he even argue that Scotland should be entitled to its fair share of budgetary increases? If he did not, he must simply go.
I know that the hon. Gentleman wants to make an elaborate political point, but he is not a churlish individual and will have heard this afternoon that we do not have devolved Ministers who are able to take account of financial pressures and make decisions accordingly. That is the rationale for the additional funds. Scotland is blessed with a functioning Government, and we wish we had one, but he should not try to extrapolate this proposal into some cheap point.
I do not accept that I am making a cheap point, but I fully accept the hon. Gentleman’s central point. We would not be strong Members of Parliament for Scotland if we were not here to represent Scottish interests, and the Barnett formula is there for a reason.
The Secretary of State for Scotland should have used his position in Cabinet to stand up for Scotland and protect the Barnett formula, but he did not. If he did, the Scottish budget could have increased by £400 million. Moreover, if he had stood firm regarding the confidence and supply agreement in its entirety, Scotland would have had an extra £3 billion to mitigate this Government’s policies, to prepare for Brexit and to invest in infrastructure, but he either failed or did not bother. He has abdicated his responsibility to Scotland and, despite various promises that he would resign with regard to protecting Scotland interests vis-à-vis Brexit, he has bottled it each and every time.
My hon. Friend is making an excellent contribution. Does he agree that the Secretary of State for Scotland has promised to resign so many times that we have lost count? It is clear that the Secretary of State does not have the ability to have any effect in Cabinet and is becoming the boy who cried wolf.
I could not agree more. The Secretary of State for Scotland’s promises to resign in defence of Scotland have become like white noise, which just highlights how Westminster does not work for Scotland. If the Scottish Secretary is actually arguing for us in Cabinet, he is not being listened to. The alternative is that he is not bothering at all, which is even more troubling. If ever there were proof that the Scottish Secretary is the Tory Cabinet’s voice in Scotland rather than Scotland’s voice in Cabinet, it is now.
The SNP believes that new talks should be established immediately to restore the Executive and the Assembly. However, with the UK Government rather distracted by internal Tory party infighting, I say again that an independent mediator could and should be brought in to speed up progress. It has been over two years since Northern Ireland had a functioning Assembly, which is far too long. The people of Northern Ireland deserve reassurances that they will have a responsive and functional devolved Assembly and Executive as they face Brexit—one of the biggest policy challenges that any of us will ever face. Nothing must be done that would undermine the Good Friday agreement. Therefore this, in my opinion, must be the last budget to be delivered in this manner. A paralysing political vacuum in Northern Ireland must not become the new normal state of affairs.
The UK Government, in this Parliament, to a degree are in chaos, but that absolutely cannot be used as an excuse for the lacklustre attempts since last February to re-establish Northern Ireland’s political institutions. The Government are consumed by their own civil war, but that should not distract from all our duties to steadfastly defend and protect the peace process. The SNP understands that decisions are badly needed to direct and fund public services in Northern Ireland, but the absence of political decision making, amidst ongoing austerity, has placed an intolerable burden on the health and education systems and on the Northern Ireland civil service and the people of Northern Ireland.
The broader instability caused by Brexit is a central reason why it is proving to be so difficult to restore the devolved institutions in Northern Ireland. The Executive and Assembly may have collapsed for various reasons, but Brexit and the threat of new borders or regulations have prolonged the dangerous political vacuum. The threat of new borders can, however, be removed. There would be no need for new economic borders in the Irish sea or across the island of Ireland if the whole UK pursues the SNP policy of staying in the European single market and customs union. It is important to remember that Northern Ireland, like Scotland, voted to remain in the EU by 56%.
Since the 2016 referendum, we in the SNP have engaged with businesses and civic leaders across Northern Ireland, all of whom have consistently made the point that the people of Northern Ireland voted to remain, and that their future economic prosperity will be put at risk by Brexit in any form. According to the Government’s own figures, a no-deal Brexit could end up resulting in a 12% GDP decline in the Northern Ireland economy. The UK Government’s analysis states that a no-deal Brexit
“would affect the viability of many businesses across Northern Ireland”,
and would therefore be tantamount to economic vandalism.
We in the SNP want to see Northern Ireland flourish. We want to see political and economic stability, partnered with strong, inclusive economic growth. We want to see that so that our neighbours—only a few miles across the Irish sea—will have effective public services, growing businesses and better livelihoods for their families. A prosperous Northern Ireland is in Scotland’s interests. A prosperous Northern Ireland is in the interests of England, Wales, the Irish Republic and our friends across the European Union.
We in the SNP fully support the Good Friday agreement and the maintenance of an invisible border that people from all over Ireland can freely cross, whether to visit family, to work, to study or to conduct business. Let me be clear: we would never stand in the way of Northern Ireland achieving a special relationship with the European Union, if that was what was required. All that we ask is that correct, and equitable, budget procedures are followed and that any increases in spending across the UK result in the rightful Barnett consequentials for Scotland.
The final point that I want to make about the budget is on the Hart recommendations. I appreciate that those are sensitive topics and have been raised already, and I concede that the Secretary of State’s position has softened somewhat of late, but the Scottish Government have already announced that they are taking action in this area. The Secretary of State and the Minister will be aware of the victims’ group SAVIA—Survivors and Victims of Institutional Abuse. The group was pleased that the Scottish Government confirmed that they would be making advance payments to elderly and infirm victims and survivors prior to the passing of legislation, and is calling for that model to be adopted for Northern Ireland. So many of those who would have been entitled to compensation are now deceased, and SAVIA believes that the initiative shown by the SNP and the Scottish Government shows that where there is a will, there is a way. The group asks that the Secretary of State follows the leadership, courage and compassion shown by the Scottish Government to make compensation payments to elderly and infirm victims before it is too late.
In conclusion, the Government must give Northern Ireland, and restoring its Assembly, the attention that it requires. Delays in establishing effective talks can no longer be accepted. The institutions of the Good Friday agreement must be championed by all across this House, for the sake of the peace process and for the people of Northern Ireland. The people of Northern Ireland deserve better than this. However, if the Prime Minister’s promises about governing in all our interests are to ring true, she must respect the agreed devolved settlement for the Scottish Parliament and the Welsh Assembly. The people of Scotland and Wales deserve better than this and, believe me, Madam Deputy Speaker: they are watching closely.

I rise to speak very briefly at this stage, although perhaps not quite as briefly as the Secretary of State. Despite some disagreement from the Northern Ireland branch of my fan club on the Benches behind me, I stated clearly on Second Reading the SNP’s view, at least, of the commensurate funding that Scotland would be able to receive as a result of the additional Northern Ireland budget allocation.
It should be noted that the Scottish Parliament and the Welsh Assembly have just simultaneously debated, voted on and passed a motion calling on the Prime Minister to rule out no deal and to extend article 50. That is the first time that this has happened in the history of devolution. But I digress—I just wanted to put that on the record.
I made my point, notwithstanding the comments by the hon. Member for Belfast East (Gavin Robinson), on the clear and distinct issues present in Northern Ireland, which I wholly accept. But no Scottish MP worth their salt, or Scottish Secretary for that matter, would accept this situation without at least trying to ensure that Scotland received proportionate funding, and it is not cheap to attempt to do so. I outlined my reasoning at length on Second Reading, so I will curtail my remarks at this stage. Suffice it to say that the extra funds announced for this budget, which would amount to £400 million if Barnettised, could amount to 4,100 police officers, 4,500 nurses and 4,400 junior doctors. At this time when the Scottish Government are doubling childcare funding, an extra 5,000-plus nursery teachers could be paid for by Barnett consequentials from all the £140 million, or an entire borders railway with the £106 million change. Or, taken in the round, the extra £3.4 billion flowing from the DUP’s confidence and supply agreement, in addition to the new moneys, could be transformational. It could fund another three Aberdeen bypasses or nearly three additional Queensferry crossings, should we ever need such things.
I am just wondering why so many people would want to bypass Aberdeen that it needs three roads round it.
I pass no comment on Aberdeen, but this road has been a long time coming. The Scottish Government have just ordered it; thankfully there was an opportunity to say that. Sadly, even though the £3.4 billion could cover the cost of almost three Queensferry crossings, it would not even cover the cost of two Chris Graylings.
Clearly, we are unable to pursue this issue any further during the passage of this Bill, but the Scottish Secretary, the Chancellor and the Northern Ireland Secretary can rest assured that pursue it we will.
This has been an interesting debate so far. I will not name the hon. Members, but some unfortunate references have been made to civil servants in the Northern Ireland Office. I deplore those remarks. I deplore remarks about people who have no capacity in this House to answer for themselves. I deplore the remarks for another reason. Whatever people think about the institution of the Northern Ireland Office, ultimately it is politicians—I make no criticism of politicians when I say this—who make the decisions. Civil servants are there to advise and implement. I want to put that on the record, because it is important that the House knows, and in particular that those who work for us know, that those criticisms are not a uniform view of their behaviour.

Commons ChamberMy right hon. Friend has enormous experience of matters in Northern Ireland. He did great work in Northern Ireland as both shadow Secretary of State and Secretary of State, and continues to take a keen interest. I share his exasperation that we have not been able to find a basis on which parties can come together. My priority is finding that basis, because there is no good long-term, sustainable way that decisions can be made for the people of Northern Ireland except locally elected politicians making them.
I do not doubt how difficult the Secretary of State’s job is, but she said that restoring devolution is her top priority, yet the last round of talks was over three months ago. Surely the damaging perception, if not the reality, is that implementing Brexit against the will of the majority of people in Northern Ireland and keeping her government partners, the Democratic Unionist party, is her actual priority. Why has the British-Irish Intergovernmental Conference not met more regularly, given the vacuum in Northern Ireland? Twice is not enough.
Appearing before the Brexit Committee this morning, former Taoiseach Bertie Ahern said that he believed Stormont would now be up and running again if it was not for Brexit. Does the Secretary of State accept his experienced analysis? What role has the strained relations between the British and Irish Governments caused by Brexit had on efforts to restore the Executive? Does she believe that her exclusive relationship with a minority party in Northern Ireland has prevented an inclusive process to restore devolution? Lastly, what progress has been made on reform of the petition of concern in the Northern Ireland Assembly—a reform that has the potential to unlock the contentious issues that arose during previous talks?
The hon. Gentleman made a number of points. Although the last round of formal talks collapsed 12 months ago, I assure him that there are continued discussions with all parties to try to find a basis on which we can get people back in a room. But there is no point in my imposing a solution on the parties in Northern Ireland that they do not want to be part of, and there is no point in my demanding that people come to talks if there are no grounds to believe that they will be successful, because that would do a disservice to the people of Northern Ireland.
The hon. Gentleman talked about the British-Irish Intergovernmental Conference. It is worth making the point that the BIIGC was established under strand 3 of the Belfast/Good Friday agreement, and it deals exclusively with east-west matters, but of course there are regular bilateral discussions between Ministers from the Irish and UK Governments on a number of matters; they are not exclusively held through the BIIGC. We also have the British-Irish Council, which meets twice a year and which representatives of the Scottish Government attend.
The hon. Gentleman mentioned the petition of concern. That needs to be decided by politicians in Northern Ireland. It is a devolved matter. It is not for Westminster to impose solutions on a devolved Administration because Westminster is not happy with the way that matters are being used in the devolved Administration. I am sure that he, as a member of the Scottish National party, would not wish to see this Parliament imposing solutions on Holyrood that we felt were right but with which he disagreed.
Finally, the hon. Gentleman alluded to the Government’s confidence and supply arrangements with the Democratic Unionist party. I gently remind him that the institutions collapsed before the confidence and supply arrangements were in place. We are all working tirelessly to see those institutions restored.
