I do not set out to be a discordant voice, and I have at least some agreement with my right hon. Friend the Member for South West Surrey (Jeremy Hunt), but we are always told that the Government’s policy is a consequence of the best scientific advice. Well, the one thing the Government are certainly not short of—the one commodity not in short supply—is scientific advice. The question is: which are the siren voices? Which is the duff advice, and which is the best advice? I am not qualified to judge. I want an answer to a specific question: to what extent is the lockdown and this cautious plan for the lifting of it a consequence of advice from Professor Neil Ferguson and his modelling at Imperial College London? He has recently released the code for his modelling to very significant peer criticism. Again, I am not qualified to judge its robustness. What I can say as a layman, however, is that he has form. In the past, he has predicted the most blood-curdling of death tolls, which never materialised.

There is no question but that the lockdown has inflicted significant additional damage to that which the pandemic has done to our economy. It will be costly and lasting. Whether it was done on the best advice, there is no question but that it was done for the best of motives—the motive of saving life—but the diminution of economic activity and employment itself takes a very heavy toll on life.

I beg to move, That the Bill be now read a Second time.

As the House knows, we are living in unprecedented times. The Government have made it clear that they will do whatever it takes to mitigate and limit the effects of the covid-19 pandemic on the United Kingdom. To that end, we have a coherent, co-ordinated and comprehensive plan to support public services, equipping our doctors, nurses and other essential staff with the tools they require on the frontline in support of their work. It is a plan to protect businesses, jobs, wages and incomes through this difficult and uncertain period for the economy. At the heart of the Bill is a recognition that the Government must act swiftly and boldly to provide the resources necessary to limit, and ultimately defeat, the virus.

As the House knows, Parliament provides the Government with the authority to expend resources, capital and cash via the supply process. The process is begun with the publication of the main supply estimates, which we debate in this Chamber, and then the introduction of a supply and appropriation Bill. It is only once that Bill receives Royal Assent, usually in July, that Governments get the bulk of their resources, capital and, most importantly, cash to carry out their approved functions. Until the supply Bill passes, typically in July, Departments live on what is described as “vote on account” money. This money usually represents about 45% of the departmental spending on services from the previous year. It allows Departments to start spending from 1 April, and it normally provides sufficient funds to tide them over until the balance is delivered via the supply Act in July, as described. However, as events have been unfolding, it has become clear that additional departmental spending will be needed compared to last year, and for good reason. The scale and spread of the virus mean that we must act now to safeguard lives. The Government cannot afford to wait. No one in this House would want us to wait until July to deliver the resources that Departments need for the next financial year.

The Bill is necessary because the economy has come to a halt; we have effectively halted it in order to put an end to this virus. There is a narrative that actually we could have toughed it out, and that we have sacrificed the economy for healthcare. That never really was a realistic alternative, was it?

The Government have not had any time for that narrative, nor has there been any decision in our mind other than to act as decisively, effectively and comprehensively as we can to defeat this virus and to protect livelihoods, businesses, jobs and wellbeing. That is what we are seeking to do. I do not agree—if I may say so to my right hon. Friend—that the requirements that this Bill seeks to address would or could have been accommodated in any other economic circumstances. To move at the speed at which we are moving to offer the support we are offering demands the cash movement that this Bill is designed to achieve.

T6. The Chancellor has been more creative and accommodating than his equivalents in any other jurisdiction. Setting aside the question of fairness, how practical is it to use historical tax data to try to impute a wage equivalent for the self-employed?

I thank my right hon. Friend for his comments. It is certainly possible to use those historical returns. They are a year and a half out of date, so they will be necessarily imperfect. They also do not provide an easy way to distinguish between those who are deserving of support and whose incomes are being affected by what is happening, and those who are much wealthier and whose incomes are potentially increasing currently, but they do provide a basis and a universe to look at.

On a point of order, Mr Deputy Speaker. I am sorry to have delayed my point of order, but it is pertinent particularly to this business. May I ask why the Financial Secretary’s excellent biography of Adam Smith has not been laid on the Table as one of the papers pertinent to this debate?

You will appreciate that Adam Smith was absolutely categoric in his view of taxation—that it should be fair, proportionate, not retrospective and not arbitrary, which is clearly the subject matter of this afternoon’s debate.

I am talking about how we got to that position. I will come on to talk about the financial status of these people, but my hon. Friend is right: these are not rich people.

HMRC, which has claimed that this is clear law, lost the Dextra Accessories Ltd and Sempra Metals Ltd cases in 2002 and 2008 respectively, when the courts specifically rejected the idea that the loans could be subject to income tax. HMRC then lost a case in 2012 and again in 2014, demonstrating that the 2011 legislation had not clarified the law to the satisfaction of the courts. That is a key point—it was not a question of it not being to our satisfaction or our constituents’ satisfaction, but it was not to the satisfaction of the courts. The fact that HMRC lost twice and then won twice tells us that even experienced, highly informed judges spending a great deal of time studying these cases found it a difficult issue to resolve.

Is not the proof of the pudding in the fact that the 2017 legislation was introduced? The loan charge itself is standing proof that previous legislation was not sufficient to tax the people involved, otherwise that would have been done.

As usual, my right hon. Friend trumps my argument in advance, but I will come back to that in a second.

What that demonstrates—and what my right hon. Friend’s point demonstrates—is a failure of the Treasury and HMRC to write clear and comprehensible legislation. If the judges cannot understand it, what chance is there for ordinary laymen—people who cannot afford to employ an accountant? We are not talking about city slickers or international bankers; we are talking about locum nurses, social workers, careworkers and hospital cleaners.

The hon. Gentleman makes an excellent point. Our ambition is for the criteria to be as flexible and generous as possible. The basic point will be to ensure that a business was sensible and well-traded before coming into the crisis that it now faces. As long as that is the case, the loans should be able to be provided through the banks on the ground, with our guarantee standing behind that.

As always, my right hon. Friend makes a pithy point. He is right to highlight the importance of prompt payment, especially during this time. That is why the Government are taking every step we can to be prompt in our payments and urging all other businesses that can do so to do exactly the same.

As my hon. Friend will know, before coming to the House I worked in the field of trying to prevent money laundering in our financial institutions. As a principle, we are always keen to look at that, but he is right to draw attention to the measures that we have taken, including on the professional responsibilities of advisers, whether that relates to the property business—in businesses linked to his previous senior business experience —or accountants, lawyers and others.

Does my right hon. Friend accept that this ambition is not confined to our domestic policy, but that we have led the world in driving forward the agenda internationally on tax evasion, and what is more, that we have provided the Treasury’s services to many poor countries so that they can collect their own taxes?

Not only is my right hon. Friend point absolutely right in the point he makes, but he draws attention to the measures taken in 2014—when he was a key figure in Government—through the UK’s G8 presidency, when we drove the adoption of greater tax transparency through the automatic exchange of information. It is part of the UK’s role at the forefront of a number of international bodies, including the G20 and the OECD, to improve tax transparency at an international level. Across the House, Members recognise that many of the measures that are required to reduce the tax gap, which I think is a common goal across the House, need international action, not just action on a domestic level.

We are conducting a review to ensure that this is as smooth as possible. We recognise that there is difficulty here. Some 18 months have passed since the original reform of status determination was announced and in that process we have had a consultation, draft legislation and further discussions and consultation, and we are having a further review now to make sure it is properly and smoothly rolled out.

Against how many of the pillars of taxation did the Economic Affairs Committee in the other place judge the 2010 legislation on the loan charge to have failed?

We have a question about the loan charge later on, so I look forward to my right hon. Friend’s further question then. He can answer on the number of pillars because I am sure he has scrutinised the Committee’s hearings very carefully. What I can tell him is that the fundamental principle of tax is that it should be properly collected from people who owe it and who may be avoiding it, and that is what this is designed to do.

I was in the Tees valley earlier this week, and what I heard there from manufacturers was incredible support for this Government’s agenda of spreading opportunity, driving investment in regional infrastructure and sensible taxation of manufacturing companies, all of which will lead to higher growth, more jobs and better investment for their community.

The Government introduced a graduated system of vehicle excise duty to encourage the uptake of vehicles with lower carbon dioxide emissions and to help to meet our legally binding climate change targets. I have held productive talks with representatives of the industry and my hon. Friend the Member for Southend West (Sir David Amess) to discuss this matter, and I am sensitive to their concerns. As with all taxes, we keep VED under review, and any announcements are for future fiscal events.

My right hon. Friend stands up with a positively lengthy question. As he knows, I share his enthusiasm for escaping certain EU regulations when we leave the EU on 31 January. We are, however, convinced of the need to incentivise the reductions in our transport emissions that I have referred to, which represent a third of the UK’s total CO2 output.
