It is a pleasure to serve under your chairmanship this afternoon, Sir David. I thank the hon. Member for Blaydon (Liz Twist) for securing this very important debate.
Any retail strategy for the future must focus on re-energising our town centres. I accept that the retail footprint will inevitably reduce with changing shopping trends and a changing retail landscape, but the challenge is to manage that change. Empty premises sadly prevail in towns throughout the UK. Online competition—in 2018, almost a fifth of all retail sales were online—crushing business rates and taxes, traffic management systems and parking charges, or a combination of the above, have influenced or played a part in the decline of high street retail.
Many accept, as I do, that there is a place for online shopping, and that is evidenced by the steady increase in internet transactions year on year. Online shopping can assist those with disabilities or who are housebound; others may simply be seeking to exercise their freedom of choice. In the not-too-distant future, our communities might be buzzing not with retail activity, but with drone deliveries of internet shopping. However, online shopping must co-exist with high street retail, and not be a replacement for it. The demise of high street shops could lead to further isolation for the elderly, not all of whom—I might include myself in this—are internet-comfortable when it comes to financial transactions, although I suspect going forward the situation will resolve itself.
On a positive note, eateries in Ayr, Carrick and Cumnock are a great success. It is an element of retail that is really successful. In our area and many areas throughout the UK, that sector uses locally produced goods. It is interesting to note that the towns and villages where shops appear to thrive are those where a variety of small, quality, niche retail businesses are intertwined, as has been mentioned, with the residences and professional offices that are integral to the retail provision, and where traffic management systems are minimal and parking charges are zero or at least reasonable. Sometimes there might be a smaller version of one of the larger well-known food retailers, acting as an anchor store and preventing the drift of custom. However, as residents and as a society, we need to stop and ask ourselves whether we could support high street retail, because we the citizens have a part to play.
Shopping should and can be a pleasurable and social experience; as my wife will remind me, we need a bit of retail therapy from time to time. That applies equally to those providing the service and those receiving it.
I agree on the point about quality. There should be a race to the top. Sometimes quality costs, so quality might mean better pay. Paddy Lillis, the general secretary of the Union of Shop, Distributive and Allied Workers, is my constituent; I recently had a conversation with him, and there is a campaign to raise the living wage to £10 an hour. Does the hon. Gentleman agree with that?
As someone whose mother worked in the pit canteen and made beds at Butlin’s on a Saturday, I fully agree that those who provide such services deserve better pay. We need to recognise those in hospitality and eateries, and the value of those who prepare and serve the food. As a nation, for decades and generations we have undervalued those people, so I totally agree with the hon. Gentleman, and the price has to be passed on to the consumer.
Employees—dare I say the next line? The hon. Gentleman must have been looking over my shoulder—should receive fair pay for work undertaken, and should have security of tenure in their job. Customers should feel involved in the purchase, and should engage with the sales assistant. It should not be a beat-the-clock exercise, in which people have to hurry to return to their vehicle before they receive a fine for overstaying their welcome. Nor should there be an additional cost burden on retailers if their staff wish to park in the vicinity of their place of work; in certain cities, retailers are being asked for £500 or thereabouts per annum per member of staff who wishes to do that.
Recently it has been announced that in Glasgow city centre, parking restrictions and charges will now apply on the Sabbath—on Sundays. Business representatives have already taken to the media to express their concern that the move will lead to shoppers deserting the city centre on a Sunday in favour of large out-of-town shopping centres, which, as we are all aware, generally have free parking. As a business person once said, “When you can’t change the direction of the wind, adjust your sail”. We should manage the change. We need to encourage a steady footfall for the future, and stop what appears to be a stampeding exodus of high street shoppers to out-of-town retail centres or online facilities. In Scotland, that may mean the Scottish Government and councils working together, and reconsidering their planning and roads legislation, and policies that affect town centres.
Certainly, in my constituency the main towns are, for want of a better word, hurting. They have not hurt as much in their whole existence, and in many cases they have lost their dignity, which they richly deserve to have returned to them. However, the centre of Cumnock is an exception, as a small town that has recently been sympathetically revitalised by the introduction of a small new build retail facility that blends into the streetscape. The principal occupier, a prominent food retailer, appears to complement the existing, varied retailers—so well done to East Ayrshire Council. Local chambers of commerce and industry, such as the Ayrshire chamber of commerce, are to be commended for their encouragement of local enterprise and excellence.
Inevitably some businesses in the UK will, regrettably, fail, for one or more of the reasons I have indicated. The Government need to consider taking appropriate measures to ensure that the auditing of retail businesses is robust; that any asset stripping, particularly by big businesses, will be better regulated in the future, for the protection of employees and shareholders; and that a review—and, if it is deemed appropriate, reform—is carried out with respect to company voluntary arrangements. There is also a need to look at business rates and taxes.
Our future is created by what we do while we are living for today, so I hope that as a result of the contributions to the debate, the Minister will be encouraged to reflect on the Government’s planning for tomorrow. We need more practical measures like the future high streets fund, which was introduced in the 2018 Budget. It is an excellent boost to high streets, despite the failures mentioned earlier. Hopefully those who reapply will be successful next time. I ask the Minister to bring forward further measures to secure our local retail trade and help to re-energise high streets throughout the UK, while remembering that high streets are no longer a cash cow to be financially milked by an outdated business rating system that needs grassroots reform.
It is a pleasure to serve under your chairmanship, Sir David. I congratulate the hon. Member for Blaydon (Liz Twist) on securing this important debate on a matter that is not raised often enough in this place. As a former retailer, I have seen many of these issues over the years, and I am delighted that she has been able to bring the debate to Westminster Hall. As we will get into online retail, I bring the attention of hon. Members to my entry in the Register of Members’ Financial Interests.
The hon. Lady talked about the effects on people, communities and indeed companies. She brought up the spectre of the BHS closures, which was deeply hurtful to many people involved. She also talked about the work of local authorities and the possibility of them getting involved, and correctly called for a longer-term strategy and vision from the UK Government.
The hon. Lady talked about the business rate system in England, which is a key issue. I will come on to the Scottish context. She also mentioned the requirement for proper pay for people working in retail. She will be glad to know that in Scotland the real living wage—not the pretendy one—is being promoted by the Scottish Government, which indeed is a real living wage employer. Almost just at this moment, the 1,500th private real living wage employer in Scotland has been unveiled: Johnstons of Elgin, the menswear retailer. It was congratulated by the fair work Minister, Jamie Hepburn MSP. Congratulations to Johnstons; it is a really good example.
The hon. Member for Henley (John Howell) talked about changes to banking and rural communities. I disagree about everyone being able to go on to online banking. Many people with disabilities and people in rural areas need banking facilities in the heart of their communities. In particular, those who are vulnerable need access to cash in a way that cannot be done online. The hon. Gentleman did, however, make an interesting point about town planning, which people should consider carefully.
The right hon. Member for Delyn (David Hanson) discussed retail’s important contribution to the UK economy and employment. Indeed, in Scotland, retail is the largest private sector employer, accounting for 250,300 jobs. Retailers are kind-hearted, having donated £10 million to good causes in Scotland, and retail accounted for 13% of all new businesses formed in Scotland in 2016. It also accounts for a fifth of all business rates in Scotland.
The right hon. Gentleman talked about out-of-town versus city centre. There is much debate about how we marry the two so that everyone can benefit, because they are realities. That is one for greater consideration. He also mentioned the loss of UK Government offices, which I have seen in the highlands, with the tax offices, Department for Work and Pensions offices, local passport offices and Driver and Vehicle Licensing Agency offices all coming out of communities and affecting people and local businesses, particularly retail.
The right hon. Gentleman brought up another subject close to my heart: support for post offices. These people desperately need a better deal so they can secure a living wage. As the Minister will acknowledge, there are people in post offices struggling to make a living. The right hon. Gentleman also made many suggestions to the Minister in a very good speech.
The hon. Member for Ayr, Carrick and Cumnock (Bill Grant) talked about regenerating town centres, accepting the online issue. I still get a bit of a shiver when thinking about this future of deliveries by drones, with all these drones whizzing about. The temptation to bat them out of the way might be too strong, but we should be aware that that may come in the future. He talked, quite rightly, about the danger of isolation for the elderly and those who are not internet-savvy—I think he included himself—with different ways to shop. He said that people deserved better, and he talked about the real living wage, so I am sure he will join me in congratulating Johnstons of Elgin.
The hon. Gentleman quite rightly said that local authorities and the Scottish Government should work together. He will be glad to welcome the work that the Scottish Government are doing with the Convention of Scottish Local Authorities on town centres. As well as providing the best business rates in the UK, the SNP Scottish Government have put together a business rates relief package worth more than £75 million. Ninety per cent. of businesses in Scotland will pay a lower poundage than they would anywhere else in the UK. The Scottish Government have launched a £50 million town centres fund in partnership with COSLA, with local authorities allocating the funds. That goes a long way in promoting the work between Government and the local authorities.
To put that in context, when I look at my inbox I see a number of businesses have experienced a significant rates hike. Rural businesses in particular are hurting terribly, so a system had to be introduced to compensate for that. There are anomalies.
Unfortunately, the hon. Gentleman is trying to punt a line that is not the fact. Through the small business bonus, 100,000 businesses in Scotland pay no rates at all, and those are mainly businesses in rural areas that do not come up to the level for being taxed.
The hon. Member for Batley and Spen (Tracy Brabin) correctly talked about public transport and its impact on retail. She gave the example of the fall in revenue for one of her constituents due to a change in bus routes. That brings us back to town planning. People must plan for the unintended outcomes as well as those they want in the future. She also mentioned banks and building societies, the importance of business rates and the need to tax big online retailers.
The hon. Member for Strangford (Jim Shannon), as ever, did a great job of promoting his own constituency. He talked about the chamber of trade and, importantly, the need for a shopping experience. Green areas, coffee culture and all those things need to be thought out in planning for the future. He talked about the mix of online and physical, which is what we used to call—

As I outlined earlier, the review of Whirlpool was a review of the modification programme. It looked at the effectiveness of the technical modifications and the adequacy of the outreach programme. The review concluded that there was a low risk from unmodified machines, and an even lower risk from modified ones. The wider review was concerned with the actions that Whirlpool took to resolve any risk of lint fires in its machines. I believe that its findings were robust and proportionate. The info that was provided to us via Which? and “Watchdog” and the testing carried out by Which? were also featured and taken into account in the review. However, the review very much focused on the technical effectiveness of the modifications.
The reason that this has taken so long, as the hon. Lady suggests, is that we followed due process in carrying out a substantial review, making our assumptions and providing Whirlpool with laid-down notice to come back to us with what it would do to rectify the situation. I would just highlight that part of enforcing consumer and product safety involves ensuring that we carry out a review when we believe that manufacturers are not fulfilling their obligations under the regulations, and that we follow due process in doing so. We will continue to do that where there are concerns about any product that is placed on the market. We will ensure that organisations and large manufacturers comply with the law.
All too often in my previous life I saw the damage, despair and devastation—not to mention the risk to life—that fire can bring to a family home. Will my hon. Friend confirm that product safety and standards remain a priority for this Government, and that manufacturers of white goods such as Whirlpool must act promptly and responsibly when faced with the evidence of goods not being fit for purpose? This journey of risk has been unacceptably long, but I thank her for the robust action that she has recently taken.

Commons ChamberWell, Mr Speaker, if you want a strong demonstration that this country is better together, you need look no further than the highlands and islands growth deal, a partnership between the UK Government and the Scottish Government that is changing lives for people across the highlands and islands. That is a demonstration in one Government policy of why this Union should stay together.
As the House is aware, high streets are under pressure as a result of the changing retail landscape. Sadly, in Ayr, we lost our independent department store, Hourstons, earlier this year. It had been trading for 123 years. Will my hon. Friend outline what support is available to local businesses to ensure that they can remain at the heart of their communities?
I thank my hon. Friend for highlighting the loss of a department store in his constituency. Let me assure him that the Minister with responsibility for high streets—the Under-Secretary of State for Business, Energy and Industrial Strategy, my hon. Friend the Member for Rossendale and Darwen (Jake Berry)—and I are committed to working together to support the businesses at the heart of our communities across the country and to deliver the £1.6 billion plan for our high streets, including via the Retail Sector Council. The Ayrshire growth deal, with £103 million of UK Government funding, in my hon. Friend’s constituency—of which he has been a keen supporter—will also help the wider business community.

Commons ChamberIt is a pleasure to follow the right hon. Member for Doncaster North (Edward Miliband). My constituency covers what was formerly known as National Coal Board Scotland west area—a thriving mining community in its day—and this is one of a series of debates brought over the years in a bid to seek a fairer distribution of the surplus from the mineworkers’ pension scheme. The scheme was, in effect, divided into four sub-funds—the guarantee fund, bonus augmentation, guarantors, and investment reserve—with it being possible to vire moneys between some sub-funds, as appropriate, but the bonus augmentation fund is an exception, because there is no provision by which to make up any shortfall. The mineworkers’ total pension payable is protected, rises in line with inflation, and does not fall in cash terms.
There has been a long history of reasonable and fair requests for changes from former mineworkers, their widows, the Coalfield Communities Campaign and many others, including myself, whose relatives were miners. In my case, my father, my father in law and many other family members were miners. We empathise with those who served in the pits and who are seeking a pension commensurate with the daily dangers that they encountered at the coalface.
My hon. Friend makes a good point about some of the dangers that coalminers faced at the coalface. In Clackmannanshire, which I represent, we still see not only the dangers that they faced back at the time, but the legacy and the long-term health impacts. Does he agree that it is time to review the fund and its distribution and that we should set regular reviews with actuarial advice to ensure that the distribution is fair and equitable in both good times and bad?
My hon. Friend makes a valid point. Those who were colliers or miners can become victims of silicosis and pneumoconiosis—common names in my household and my father’s—which affect the respiratory system. This group of people deserve a review that favours them. Many miners unfortunately go on to develop ill health later in life, which can often be attributed to the conditions in which they worked underground.
The men who wroughed hard, as we say in Scotland, in the bowels of the earth to put the “Great” in Great Britain fuelled the industrial revolution and kept the home fires burning through two world wars. It is worthy of note that the Labour party agreed to consider their concerns, but it found itself unable to do so as far back as 2003, due to a fall in world stock markets, so the original 50-50 share of the surplus prevailed. Even with the passage of time, it is clear that that unpredictability remains, given the immense dependency on the behaviour of money markets and the return from stock exchanges. It is essential to take a risk-based approach to ensuring that any Government, as the guarantor, are robust in securing and maintaining funding for the future.
The contingent pension liability for British Coal’s two pension schemes was valued at the modest sum of approximately £16 million. Some argue that recent surpluses need to be balanced against previous deficits, but I am unsure whether I would support such an approach. It was reported that there was a large surplus in the guarantee fund in 2017, with half being destined to provide bonuses to pensioners. The trustees announced new bonuses representing an increase equivalent to 4.2% of guaranteed pensions in the six years to 2023. In addition, there were to be improved benefits, and quite rightly so, for members under 60 who were not yet retired but who were experiencing serious ill health from spending decades underground. Such modest moves are to be welcomed, as is the coalfield communities fund that assists some of those communities.
In 2018, the Minister for Energy and Clean Growth instructed her officials to liaise with the pension fund’s trustees with a view to considering revising the scheme for the benefit of all parties. Earlier this year, she advised that that was ongoing, so this evening I ask the Minister to endeavour to expedite the review, given the increasing age and ill health of many mineworkers, to achieve any necessary adjustments to meet the earlier stated principle of a fair and equitable sharing of risk and, more importantly, reward in the interests of both scheme members and the Government. Finally, I hope that the review will look kindly on the remaining miners and their widows and afford them the financial dignity that they so richly deserve.

Commons ChamberThe hon. Lady will know that, through the industrial strategy and our work with particular sectors, we have a strong record of investing in the future potential of industries. Steel is part of that, but as she will know, we have increasingly deep working relationships—whether with the automotive, life sciences or the creative industries, or other sectors such as construction—to make sure that we capitalise on our strengths in this country, which are innovation and discovery, putting ourselves at the cutting edge. That is available and is being well exploited across the economy. I hope and expect that the steel industry will be part of that investment in the capability and capacity to prosper in the future.
I thank the Secretary of State for his statement and his support for British Steel. The steel industry, by its very nature, has very high energy costs. What action is my right hon. Friend or his Department taking to reduce those costs and, in parallel, to reduce pollution from the steel industry, which is very important for the future of the United Kingdom?
I mentioned—it was announced in the spring financial statement—a new industrial energy efficiency fund worth a third of a billion pounds to partner with energy-intensive businesses in changing and upgrading their technology, so that they both consume less energy, and therefore have lower costs, and also produce lower emissions. As I said to the shadow Secretary of State, since 2013 we have provided nearly £300 million to energy-intensive industries in compensation for some of the effects of high costs. However, the way forward is energy efficiency, and that is the commitment that we made and backed in the financial statement.

Commons ChamberI totally agree. The post office network, with the Crown issue and this issue, is being dismantled before our eyes unless the Government get to grips with this.
I am conscious of the time, and the Minister may be a little bit shorter of response time than she would perhaps like to be, but I will give way.
Does the hon. Gentleman share my concern that the income of the small businesses run by many sub-postmasters and postmasters has been driven down by the Post Office and has reduced dramatically, and they are therefore unable to sell on what is maybe a long-established business that nobody will take on? This is leading to the closure of important post offices in communities. The Post Office itself is reducing their number and causing this crisis.

Thank you for calling me to speak in this debate, Mr Walker. I thank all my colleagues on the Scottish Affairs Committee for their work in producing this report.
It would be an understatement to say that the oil and gas industry is a vital part of the Scottish economy. It contributed £9.2 billion in 2017 and, as we have heard, it supports about 135,000 jobs. It is essential to the UK’s energy security, and forecasts suggest that oil and gas will account for two thirds of the UK’s primary energy needs until at least 2035.
The industry has suffered in recent years, but is starting to come through a challenging downturn, although there are still worrying signs, such as the low levels of new well exploration. There are also future challenges for the industry, such as declining production, climate change targets and the decommissioning of oil and gas rigs. I agree with the report’s central finding that the Government must provide serious and credible support to the industry through the sector deal. A sector deal supported by the Government and industry has the potential to deliver £110 billion for the UK economy by 2035. It must help with the development of new technology to maximise the recovery of the 10 billion to 20 billion barrels of oil that remain in the UK. It must find ways of encouraging greater decommissioning of oil and gas rigs, while reducing the cost of doing so. It must ensure that the industry’s skills, expertise and technology are protected for the future, including by transferring them for use in renewable energy, subsea engineering and carbon capture. The oil and gas industry has many opportunities for Scotland and the whole UK, which we should not waste. That is why I endorse the report’s findings, including its key recommendations about a sector deal.
I want to touch on some of the issues raised with the Scottish Affairs Committee, particularly by Unite and the National Union of Rail, Maritime and Transport Workers. Those unions play a crucial role in organising and representing the interests of workers in the oil and gas industry. They were both keen to emphasise the need to maximise the industry’s economic recovery to its full potential. They share the sentiment of the industry and the Government.
It is welcome that the Oil and Gas Authority will lead exploration by commissioning surveys of unexplored areas of the sea bed. The creation of the Oil & Gas Technology Centre through the Aberdeen city deal was welcome. The “maximising economic recovery” strategy cannot be implemented through significant reductions in costs, given the impact that they could have on the workforce. There is a clear case for the Oil and Gas Authority working with the UK and Scottish Governments to create strategic public stakes in the implementation of the strategy. Those stakes should include infrastructure, such as pipelines, and public investment through borrowing and national investment banks. Only through co-investment by public and private stakeholders can we ensure the strategy’s success.
The fall in the oil price in recent years led to an 18% reduction in the core offshore workforce between 2014 and 2016. It also led to a reduction in the workforce’s terms and conditions. RMT highlights the growing use of short-term and zero-hours contracts. The industry and trade unions have observed practices including the application of retrospective charges for training, the exclusion of trade unions from heliports, the denial of holiday entitlements and the ignoring of TUPE requirements. I believe that Unite is right to call for the full devolution of employment law to Scotland so that we can begin to address those issues, alongside investing in skills, apprenticeships and training in the industry.
Although decommissioning must be a crucial part of the sector deal, it must be done in a way that preserves skills, expertise and technology. It is clear to me that there should be a national decommissioning strategy to ensure that decommissioning delivers for workers and our economy. The strategy must be devised through discussions between the UK and Scottish Governments, local authorities, industries and trade unions.
I would like to talk about safety in the industry. As a trade unionist, I want to ensure that all workers are safe in their workplace. It alarms me to see the findings of a recent report by Robert Gordon University, which received responses from 40% of offshore workers from the major companies in the industry. It found that 52% of workers are dissatisfied with their work-life balance; 45% said that it takes them longer to recover from their shifts, and 57% believe that the conditions of their offshore sleeping environment have worsened. Let us not ignore workers’ concerns about offshore helicopter safety. Some 62% said that they would be unlikely to fly in a Super Puma helicopter if given a choice.
I share the hon. Gentleman’s concerns about the safety of workers and the avoidance of accidents. What does he think the Government can do to bring the oil companies to the table for discussions with trade unions about the important matter of the safety of personnel on their rigs and in helicopters?
I will come to that point; I take an interest in it. I recently met Oil & Gas UK, with which the unions are getting together to bring the workforce on board. Without the workers on board, no company can go anywhere. Unless companies involve their workers in the process, there is no point trying to organise the company.
I declare an interest: 27 years ago today, I took an interest in North sea oil safety helicopters when a Super Puma helicopter went down, killing 11 men, of whom my brother-in-law was one. Today is the 27th anniversary of the crash, so I welcome the report. I hope that the industry will take serious steps to address those safety concerns, particularly as employers have a duty to ensure that workers are safe in their workplace and can get home safely.
To conclude, I reiterate my support for the findings of the report, including its recommendation of a sector deal. It is clear, however, that there are challenges that we will have to address: “maximising economic recovery”, decommissioning, terms and conditions and, most importantly, the safety of the workforce.

I am coming to that point. We have not said that the feed-in tariff is no more, and that there is essentially no value out there; there is huge value in having decentralised energy generation. My hon. Friend the Member for Eddisbury and others made some powerful points about the role of community energy, which I am passionate about. As she mentioned, it is often a way in which people drink the green Kool-Aid and realise that they can be part of this transformation; zero-carbon faith groups, for instance, are amazing movements. That is why we have continued to support communities.
I was pleased to extract from the Department for Environment, Food and Rural Affairs a commitment to the rural community energy fund, which will be reopening for bids later this year; it is an important part of delivering community schemes in many of our constituencies. We have invested £8 million in local energy hubs, which are helping some of the local authority-led schemes that the hon. Member for Hornsey and Wood Green mentioned, both in London and across the country. We have a local energy contact group, and we are working closely with communities through investments in energy efficiency, local energy schemes, and combined heat and power plants through the £350 million heat network scheme. There is a lot of support for communities that want to move forward.
The smart export guarantee is not just to provide a route to market for those who have installed, or will be installing, decentralised installations; it is intended to do a couple of things. My hon. Friend the Member for Eddisbury is quite right to say that this energy should not be provided for free, or indeed at negative prices, as is sometimes the case in other countries. The plan is essentially for this scheme—which, as my hon. Friend the Member for Thirsk and Malton (Kevin Hollinrake) pointed out, is a market-based approach—to help move us towards the smart energy system of the future that we all talk about, in which we have decentralised energy and people are able to do the energy balancing for their home or their community, plugging in their electric vehicles and doing peer-to-peer energy trading. The scheme is designed to support all those exciting things that are out there. I had a very effective meeting with suppliers of products and services who really support this, and who want to get to that decentralised energy future. They accept the points about tariffs needing to be fair and reasonable, and needing to provide an incentive, but they support creating those prosumers, as my hon. Friend the Member for Eddisbury has said. They support creating that aggregated demand side, meaning that all of us who install solar panels will have some power and some value in the system.
Is the Minister minded to ensure a fair minimum market rate for small-scale generators of exported electricity, to give them some incentive and some degree of confidence?
That is an important question that will come out in the consultation. Frankly, I would ensure that the market rate was always greater than zero, but that it varied at different times of day, because many of us may have excess energy that we wanted to sell into the grid at a particular time. I want to see what proposals come forward for setting that market rate. There are ideas out there, including that the rate should be wholesale price minus, or that it should be entirely market led.
I take the point made by my hon. Friend the Member for Eddisbury about speed being of the essence when coming forward with a response, but I really want to get this right. I do not want this to be a scheme that we are debating in three years’ time because it has suddenly become unaffordable and has not delivered. My hon. Friend will be aware that installers are already scrutinising with care what we are saying and doing. We do not want to create a hiatus, but we want to produce a set of incentives that works for the future.

Commons ChamberI might ask the hon. Lady what she is doing to address that. The Scotch Whisky Association has been very clear; it has said that the withdrawal agreement is a compromise but a positive step towards much needed business certainty. If she cares about the industry, she should vote for the deal.
Sadly, my constituency has an unemployment rate of 6%, which is twice the UK average. What progress has been made or can be made on the Ayrshire growth deal, which is essential to Ayrshire’s future prosperity?

We nurture and protect our children as they grow up, testing the temperature of the bath water, ensuring fireguards are in situ, and teaching them not to play with matches and lighters, so why do we permit them fireworks, despite the law? In my youth, the content of a box of fireworks was usually a rocket to be launched from an empty milk bottle, a Catherine wheel to be pinned to a tree trunk or the shed door, a banger, a sparkler or even a jumping jack—I understand that they have wisely been banned. They were fun; I should not really say that, but that was when I was a kid. It was quite some time ago that I had access to fireworks as a child. Nowadays, the pyrotechnics are powerful. The colourful and dynamic packaging and posters are clearly aimed at enticing people to purchase fireworks. I appreciate that there is an age limit on purchases, but regrettably, in many instances, they still fall into younger, inexperienced hands.
All emergency services, including accident and emergency, view 5 November with trepidation, not so much because it is one of the busiest days of the year, but because of the casualties—in the main young people, who are injured or maimed for life. Jack Kirkland, in his book “Blue lights and bandages”, in which he recounts his experiences as a member of the Scottish Ambulance Service, speaks graphically of many bonfire night injuries, including that of a boy who had been carrying fireworks in his pockets when they went off, causing serious burns and injuries, which he carries to this day.
I was a fire officer for 31 years, and I have seen for myself horrific injuries from stray or thrown fireworks. The problem relates not just to the visible, physical injuries, but to the hidden acoustic stress to humans, pets and other animals, and there is the potential to cause further mental trauma for those with post-traumatic stress disorder. As was said earlier, fire crews can be set up: a 999 call is made, but when the crew arrive they receive an onslaught of fireworks, which have been lawfully and legally bought—often from reputable retailers, but more often from pop-up shops that appear over towns for that occasion. Just as worrying is the fact that Police Scotland recently identified the misuse of fireworks and smoke bombs in sports stadiums as a growing issue.
If hon. Members need evidence to convince them, the website of the Royal Society for the Prevention of Accidents states:
“Injury figures support the advice that the safest place to enjoy fireworks is at a large public display—far fewer people are injured here than at smaller family or private parties”
where there is no control over the fireworks that are ignited or detonated. The British Association of Plastic, Reconstructive and Aesthetic Surgeons said that
“in 2017-18, 4,435 people”
—a phenomenal figure—
“were admitted to A&E due to firework injuries; the majorities of these patients were boys under the age of 18”,
who had clearly accessed and possibly misused fireworks.
I vividly remember being at school and having to dodge my way along the path to the front gates in the run-up to 5 November and afterwards to avoid the fireworks flying overhead. Fireworks are clearly getting into the wrong hands. Does the hon. Gentleman agree that, if they were invented tomorrow, we would never allow them to be on sale so freely?
I wholeheartedly agree. Despite the law and the regulations, fireworks are so easy to purchase. Pop-up shops that come to our towns sell them to whoever has the money. Perhaps the reputable retailers do that less so, but we have to ask ourselves, as parliamentarians and parents, why should fireworks be on sale on our high streets?
I support a ban on the sale of fireworks to the public. I would prefer organised events by certified, competent persons, who would carry out risk assessments and put in place control zones to ensure public safety. That would be a sensible thing to do, and it would allow people still to enjoy organised events. I do not want to ban fireworks entirely, but they should be used at proper organised events.
If the Government will not ban fireworks, and I think that is their position, we should at least consider applying standards similar to those used for other items that have the potential adversely to affect public health. For example, in recent years, the packaging, display and advertising of cigarettes have been muted. Should it not be the same for fireworks?
It has been suggested that graphics depicting horrendous injuries would deter some from purchasing fireworks, but if we think of the many graphic games that young people play on their computer consoles, which show scenes of terror and horror, might we not just be whetting their appetite with such packaging? I would prefer plain, unattractive packaging. I am also fearful that graphic packaging could cause distress to those suffering from PTSD.
I spoke in a fireworks debate earlier in the year, and I recently hosted a drop-in session in Westminster for MPs that was co-organised by the Dogs Trust, Blue Cross, Battersea Dogs and Cats Home and the Kennel Club. About 40 MPs signed up and undertook to consider introducing further restrictions around the sale of fireworks, such as limiting them to licensed public occasions and organised events. One recommendation was that local authorities should pay attention to the location for which a licence was sought, and that if one was granted, pet owners within a given radius should receive adequate notification so that they could make the necessary preparations—almost like neighbour notification.
I would thought have that, although individual fireworks in categories F1 to F3 may contain only small quantities of explosive, we should, in the interest of security, be eliminating the potential for someone to amass fireworks for illicit purposes by placing a ban on their sale to the general public.
If the UK Government do not back legislation introducing an outright ban on the sale of fireworks to the public, I ask the Minister to consider amendments to plug potential loopholes in the existing legislation. I appreciate that responsibility for fireworks is split between the UK and Scottish Governments: the former regulate their sale as a consumer safety issue, while responsibility for the use of fireworks has been devolved to the latter under the Fireworks (Scotland) Regulations 2004. The Scottish Government will carry out a consultation on the use and regulation of fireworks in Scotland, including on ways to reduce antisocial impact of fireworks, and I, for one, welcome that consultation.
I would, however, ask both Governments to consider the following scenario, which my constituents have drawn to my attention fairly recently. In my constituency of Ayr, Carrick and Cumnock, there are many stunning venues for special events such as weddings, and a growing tendency—strangely—for fireworks to feature as part of those celebrations. Such events are more frequent than the annual Guy Fawkes night and, as some venues are situated in residential areas or near livestock facilities, neighbour nuisance is a very real issue.
Constituents advise me that some venues devolve responsibility for the fireworks display to the customer, who engages a private company that sets up the system and lets off the fireworks from nearby private land, which makes it extremely difficult for local authority officers to police events and take any follow-up action. If the existing legislation does not catch such creative arrangements, surely Governments need to be equally creative to protect the wider public, taking account of proportionality and balance of convenience.
I say to the Minister that it strikes me as strange that, given the innovation and the availability of silent fireworks and light shows, we have not moved on as a nation and, as has been mentioned, are still repeatedly debating the contentious matter of fireworks and the distress and the injury they cause not only to humans, but to pets, livestock and wild animals. Years later, we are still dealing with the issue of fireworks—do we really need them? Let us give due consideration to introducing regulation to reflect a modern approach to fireworks, reduce injuries and prevent unnecessary trauma to humans, pets and domestic animals.
