My Lords, in the interest of time, I will write to the noble Lord on his second question, but progress is being made there. On the agenda, I thank the noble Lord for his kind remarks on PSVI. As we did previously in London, I am hoping that we will be able to convene a side meeting of leading nations during the Heads of Government meeting when it is rescheduled in Kigali.

My Lords, I agree with the noble Lord. All rights matter: black rights, gay rights, religious rights—all rights matter for the Commonwealth; that is what the Commonwealth is all about.

My Lords, I support the extension of passport rights not least because, in 1997, that was called for in the House of Commons by the late Paddy Ashdown, the then leader of the Liberal Democrats. We must prepare for further abuse, threats and intimidation by the Chinese Government. However, we have not only a moral obligation to the Basic Law and the joint declaration; we have a legal obligation as well.

How many people in Britain still believe that we should continue our association with Huawei?

I do not agree with the noble Lord. We have had a massive effort, and I pay tribute to our network. The noble Lord will recall that the Prime Minister, as Foreign Secretary, embarked on an ambitious programme to increase the number of posts, and our diplomats have served us with great aplomb.

We are acutely aware of the situation of Nazanin Zaghari-Ratcliffe and continue to lobby for her permanent release. We have been encouraged by her release on 17 March and its extension, but we continue to make representations to the Iranian Government to make her release permanent so that she can be returned home to the UK and reunited with her family and loved ones.

My Lords, is the Minister aware that some estimates of the number of British citizens still requiring repatriation are around 300,000? Why do the Government not charter some of the aircraft parked up all over the south of England, put some money into the pockets of the airlines and get all of our citizens still abroad who want to return to the United Kingdom back here once and for all?

As the noble Lord will be aware, we have opened up registration procedures in all our posts. For example, in the places that I cover, including Pakistan, we have returned all British nationals who were registered and who sought to return. We continue to operate charter flights. It has been a successful programme, as I said, across 27 countries, and we continue to monitor the situation. If British nationals are concerned, they should get in touch with the embassy or high commission, register their need to return and we will seek to facilitate it at the earliest opportunity.

To ask Her Majesty’s Government what assessment they have made of the announcement by the government of Israel of its intention to commence discussions from 1 July on applying Israeli sovereignty to Jewish settlements and other territory in the occupied West Bank.

My Lords, we are deeply concerned by reports that the new Israeli Government coalition have reached an agreement which may pave the way for annexation of parts of the West Bank. The United Kingdom’s position is clear: any unilateral moves towards annexation of parts of the West Bank by Israel would be damaging to efforts to restart peace negotiations and contrary to international law.

I thank the Minister for his Answer, but

“no country, however large, can dismember its neighbour and break international law without consequences.”

These are the words of Boris Johnson when Foreign Secretary, in an article published on 22 February 2018 criticising Russia for its annexation of Crimea. The Minister accepts, as I understand it, that the possible annexation by the Israeli Government of land on the West Bank would likewise be illegal, but otherwise the Government’s response is an exercise in hand-wringing, as evidenced by the response today and by the answer given yesterday to the Written Question put down by my noble friend Lady Northover.

The possibility of a just, two-state solution is being dismantled before our eyes in favour of a one-state imposition, all endorsed by President Trump. What is the Government’s position? Do they accept the inevitability of annexation or will they condemn and seek to prevent it? We are entitled to know; the Palestinians are entitled to know as well.

In answer to the noble Baroness’s second question, the short answer is yes. This is demand led. For example, initially we had flights from Delhi, Mumbai and Goa. We commenced the programme in those cities for logistical reasons—to ensure that permissions were received for charter flights. A large proportion of British travellers are still seeking to return from Ahmedabad in Gujarat, India, and from Amritsar in the Punjab, and we will continue to operate flights. The portals were closed to ensure that we could clear the wait-list, which is still operational. I assure the noble Baroness that an email link to the high commission is now being offered to those who still wish to register but who did not meet the original deadline date for registering themselves on the database for returns. We have made a commitment to return those who wish to come back to the UK, and we will continue to meet that demand in India.

The noble Baroness, rightly, referenced Pakistan and Pakistan International Airlines. We have talked regularly to the chairman of PIA. She will know that I was directly involved in the case that she referred to. I have also been involved in discussions with the Pakistani, Indian and Bangladeshi authorities and at a local level— I have been ringing Chief Ministers to ensure that we get local permissions. Perhaps I may just put this in context. For every passenger who is returned from India, for example, the level of detail that we have to go into, because of the curfews that have been imposed, is such that we have to provide every local authority with details of every vehicle that is used to ensure that we can get British travellers to the airport on time to catch their flight. Our diplomats are not expert travel agents, but I can tell noble Lords that they have learned a great deal from the repatriation efforts. I am sure that all noble Lords will join me in commending them for their excellence—notwithstanding the challenges, which we are seeking to address—in what they have done and continue to deliver.

I join in the appreciation of the efforts of our diplomats and other civil servants in the Government’s service. However, for the life of me, I cannot understand the Government’s reticence in acknowledging that they derived financial support from the Brussels scheme for repatriation. It makes one wonder whether there is some edict that nothing good should be said about the European Union. Since, as has already been pointed out, the first responsibility of any Government is to ensure the safety and protection of their citizens, why not redeploy some of the civil servants who are currently engaged in the increasingly fruitless pursuit of a deal with the European Union by 31 December to make sure that we bring all our citizens home as soon as possible?

On the noble Lord’s more substantial point, we are of course redeploying diplomats in all our posts, whether they work on the security side or from a Home Office or military perspective, wherever they are needed, and they are key to the repatriation effort in each country—I know that south Asia has been a key area of focus—and that has been the right thing to do. The noble Lord says that nothing positive is said about Europe. I ask him to reflect on the comments I made a few moments ago on how we will be co-hosting a conference with our European Union partners on the important issue of the global response to Covid. That underlines the commitment of the UK to work with international partners in different multilateral fora—and, yes, including with our European Union friends.

My Lords, I thank the Minister for repeating the Statement by the Foreign Secretary. Perhaps I may first express my appreciation for the extraordinarily hard work of all the FCO staff who, I know from comments made in the other place, have been working tirelessly over the weekend and throughout the night to support their fellow citizens.

I will turn first to international freight services, such as shipping and haulage. As the Statement said, they are

“vital for ensuring the continuity of supply of essential food, goods and materials to the United Kingdom.”

The Government, rightly, view this kind of travel as essential and say that they will work with the industry to issue detailed advice to maintain the flow of goods, while protecting the well-being of staff working on those routes. Can the Minister assure the House that the Department for Transport, which will be leading on this work with the freight sector, will consult those most directly affected—the workers in the sector—and ensure that trade unions are also properly consulted? It is vital that we get the co-operation of all sides of society in the battle against this virus.

What assessment have the Government made of the impact, particularly in the food and agriculture industry, of people naturally wishing to leave and return to their home country? What sort of cross-government co-ordination is there on that?

As we heard from MPs in the other place, this is clearly a time of immense concern for tens of thousands of people. We have heard about individual examples of young people stranded without the resources to make decisions about how to come back. The Foreign Secretary constantly referred to clear and practical advice. I strongly believe that this is one of the rare occasions when people want to be told what to do. It is not just advice; people need to be absolutely clear about the consequences if they have to make difficult decisions—for instance, if a parent is ill in a foreign country. This applies to my own husband; we were due to fly next week. People need a clear statement of what to do.

The other place heard the example of Morocco, which unexpectedly closed its air and sea borders, causing particular problems. I was hoping to hear from the Foreign Secretary that his department had been in touch with the French and Spanish authorities, which have many nationals there as well, to try to create a more co-operative and international response, especially in assisting people to get back home. Morocco will surely be joined by other countries making similar announcements. Can the Minister confirm that we are making representations to Governments—in co-operation with our EU partners, because many of our citizens are travelling to similar places—to ensure that those Governments who are contemplating similar action give us information in advance so that we can be prepared to give appropriate advice to our citizens?

The Foreign Secretary also referred to liaising with the civil aviation authorities and airlines. This is an example of action being taken before the Government’s advice has been issued. Can the Minister assure the House that airlines which halted flights had reassured the Government that they had made provision to enable customers to return immediately or early?

Finally, this is a difficult situation and we are focused on the immediate need for a response. However, whatever we do today, we need to ensure that we learn lessons. We do not know what is around the corner: in the 1980s it was AIDS, and we saw the response of the Lord Speaker at the time. Whatever immediate action we take in responding now, we need to learn the lessons that ensure we are better prepared next time something like this happens.

My Lords, I also thank the Minister for repeating the Statement and associate myself and my noble friends with the expressions of appreciation of the efforts of those in the Foreign and Commonwealth Office and other government departments. What is contained in the Statement is generally acceptable. It may seem draconian to advise against travel globally, but in the febrile atmosphere of many countries, restrictions will often be placed without warning. I have no doubt that the repatriations to which the Minister referred were most welcome. It shows the benefit of co-operation that this was able to be done by the relevant authorities in Tenerife and Cuba.

One matter that sticks out in the Statement is the observation that the ultimate responsibility for these matters rests with foreign Governments. What if such Governments have neither the inclination, capacity nor resources to assist British citizens? Would that be regarded as exceptional and therefore justifying government repatriation? Similarly, what if the considerable efforts of Foreign Office officials are unsuccessful? Would that count as exceptional circumstances, or would we leave our citizens—forgive the slang—“twisting in the wind”?

My Lords, I thank the noble Lords, Lord Collins and Lord Campbell, for their words of support. I will take those, and the level of unity in your Lordships’ House, back to the Foreign Office and to all departments in Her Majesty’s Government—particularly the Department for International Development, which is playing a leading role in such unprecedented circumstances. I am sure that the sentiments which both noble Lords aired are reflected across your Lordships’ House.

One of the final points made by the noble Lord, Lord Campbell, was about my mention, in the Statement, of responsibility. That reflected the responsibility of the Government in question for the measures in place for controlling the spread of Covid-19 in sovereign states. We are working with international partners and providing international support. We have already allocated over £241 million in support of other countries that need assistance and we are providing financial assistance to the World Health Organization. That is also intended to provide support where the measures being put in place may not yet be of the standard one would hope for. This is about sharing expertise and insights. What we have seen from the spread of coronavirus, from where it started in China to where it is today, and what we have seen not too far from here in Italy, shows the global challenge that we are facing and the importance of sharing research and insight. On the point made by the noble Lord, Lord Collins, about ensuring lessons are learnt, we have also allocated a further £65 million for research into the spread of the virus.

The noble Lord, Lord Collins, was right to point out that the Department for Transport is leading on the issue of freight services. He made important points; I support them and will share them. We should be talking to all representative bodies, whether of employers or employees, who may be on the front line and performing difficult tasks in supply chains, and ensure that they are given the support they require.

The Government are also stressing the importance of airlines continuing their services. We are talking to airline operators and ensuring that commercial routes are kept open. While airlines are, understandably, rationalising certain routes, we are imploring them, and working constructively with them, to ensure that the commercial routes continue to be operational, so that British nationals who seek to return to the UK can do so as early as possible.

I also pay tribute to those working in our ports and airports. They are often on the front line and not always given the acknowledgment they deserve. I declare a personal interest, as my elder brother works on the operations side for British Airways at T5. I know only too well from the stories that he is sharing about the challenges that staff are facing, often with passengers who are returning ill and clearly needing support, while ensuring that they fulfil their duties as well. I am sure the whole House will join me in paying tribute to those who are playing important roles on the front line.

The noble Lord, Lord Collins, also raised the important point about how we ensure the repatriation of British citizens, as did the noble Lord, Lord Campbell. To show you what we are up against, over the weekend, just in my patch, which is south Asia, we made 220 changes to travel advice just on Saturday and Sunday. The noble Lord, Lord Campbell, was right to point out that, as far as possible, this should be done with advance notice, but, as we have seen with near neighbours in Europe, countries are taking action.

The noble Lord described changing our travel advice to only essential travel as draconian. We need only cast our eye across the channel to see what other measures are being taken. It has not been the Government’s approach to impose, and we are working in a structured way. Nevertheless, as circumstances change, as the announcements made by the Prime Minister yesterday indicated, we are responding to what is a fluid and ever-changing set of circumstances, not just nationally but internationally.

The noble Lord, Lord Collins, made specific reference to Morocco and working in co-ordination with other partners. As he will be aware, my right honourable friend the Prime Minister took part in a G7 meeting with representatives of our European partners participating in the call, as well as other nations and the European Commission. His point is absolutely valid, and I assure him that we are working closely with partners. I and my noble friend Lady Sugg were involved in the repatriation over one weekend of one set of passengers. Every repatriation where we have had to engage directly with charter flights organised by Her Majesty’s Government has involved opening channels to other European countries, if so required, and we have sought to facilitate that.

That underlines the point that international co-operation is taking place—in certain circumstances, between countries that would not normally be talking to each other. Again, in my patch of south Asia, countries which have normally been challenged in their bilateral relations by international circumstances have come together because everyone recognises that this is a global challenge and needs global solutions.

The noble Lord refers to my time in post, and I am delighted to return to the Dispatch Box. My noble friend from the Treasury has just left the Chamber, but I am sure he will be reassured by the fact that longevity in office is perhaps—as I look toward my noble friend Lady Williams—a trademark of Ministers in your Lordships’ House.

On whether progress is being made, in July 2018 the Kingdom of Saudi Arabia passed a codifying law on the age of criminal majority at 18 for some crimes within sharia law and capping the punishment for crimes committed by minors to 10 years’ imprisonment, so we have seen specific progress in this regard. There are exceptions to this on issues of national security. On action taken, particularly against people alleged to have been involved in the Khashoggi murder, I assure the noble Lord that we have taken action. I am delighted that my noble friend the Minister of State from the Home Office is here. The Home Office did act and we took action against a number of individuals in that respect.

My Lords, I have given informal notice to the Minister that I wish to ask a question about arms exports to Saudi Arabia. Does he recall that on 26 September there were Statements in both Houses on behalf of the Government to admit a breach of an undertaking given to the High Court on 20 June that there would be no export licences granted to Saudi Arabia for military equipment that might be used in Yemen, and that there would be a fully independent inquiry? Why have the results of that inquiry not yet been published—if not for the courtesy of the House, for that of the High Court?

My Lords, I do indeed recall that, and I have followed it up with colleagues at the Department for International Trade. I will come back to the noble Lord on the specific issue of the inquiry. I can reassure him that, since the review of that decision and the decision on the three conditions—one in particular that went against the Government—there have been no new arms licences issued to the Kingdom of Saudi Arabia.

My Lords, I have said in response to the noble Lord, Lord Collins, that we continue to support the Kurds and have paid tribute to their efforts. We continue to raise their obvious concerns since the Turkish incursion into northern Syria and the situation with the Kurds. In 2019-20, we intend to provide more than £40 million of aid in north-east Syria, which is focused on reaching those most acutely in need, including life-saving supplies, food, water, shelter and healthcare. As to the support we are providing in north-west Syria, the border is operational and we have allocated over £100 million to projects implemented by organisations delivering aid cross-border from Turkey, primarily into north-west Syria. As to the support we are giving to Kurdish communities, we regard the SDF as a partner, and we have raised the issues and concerns of the Kurdish community directly with the Turkish authorities—most recently during the visit to Turkey of the former Minister for the Middle East.

My Lords, it is common ground regarding what is happening in the indiscriminate bombing of individuals, citizens and hospitals that those doing so are guilty of war crimes. But is it not worth emphasising at this moment that those who direct or authorise such actions are equally complicit in war crimes and, as a result, subject to the jurisdiction of the International Criminal Court?

Again, assessments continue to be made on the issue of international humanitarian law. We continue to press all parties on upholding that law and, as the noble Lord rightly points out, it specifies and prohibits attacks on civilians, irrespective of the weapon used. The UN commission of inquiry is the international body that will look into those aspects. As it makes its assessment, I assure him that we support the UN efforts in that respect.

My Lords, I can share with the noble Baroness that my right honourable friend the Foreign Secretary spoke with President Abbas on these proposals earlier this week. I understand that my right honourable friend the Minister for the Middle East is also meeting the Palestinian representative. I hope that they will engage with the proposals. Like the noble Baroness, I have followed the statements they have made thus far, but as I have said before, we hope that this plan is a first step and will engage all communities towards the final objective of two viable states.

My Lords, is it not difficult for the Government to maintain what is essentially a position of neutrality on this matter given our responsibilities under, for example, the Balfour Declaration? The truth is that this is neither a peace plan nor a two-state solution. It is a fait accompli in favour of Mr Netanyahu, as demonstrated by his public response to it in the White House. It is an annexation not just of land on which illegal settlements have been based, nor of the Jordan Valley, but of the Golan Heights, all of which is contrary to international law. Why do the Government not give a robust response in favour of the principles of international law—the kind of response we gave when Mr Putin annexed the Crimea?

My Lords, on the point about annexation, the noble Lord mentioned the Golan Heights. When the United States made that statement in support of Israel, we made our position clear: we are against annexation, which is against international law. I reiterate that annexation of any territory unilaterally is against international law.

My Lords, I assure the noble Lord that we remain very much committed to the JCPOA. He says that the triggering of this mechanism was perhaps premature. I do not agree. I think we took a very considered position, one which is very much aligned with that of our European partners. The triggering of the provisions within the mechanism is done to bring the respective parties to the JCPOA to the table. In this case, after careful consideration, we believe that this is necessary for the very reasons I listed: the various instances of non-compliance from Iran on Iranian enrichment and so on.

The noble Lord talked about de-escalation and using this as an opportunity to address substantive issues in the region. We remain very much committed to that. When asking his question earlier, my noble friend referred to the detention of the British ambassador. This was totally against any diplomatic convention. It was unacceptable and that point has been relayed to Iran in very clear and unequivocal terms. Notwithstanding this action from Iran, we retain our diplomatic mission there and the strength of our diplomatic engagement. I cannot agree with the noble Lord; we hope and believe that the triggering of this mechanism will result in Iran reconsidering its non-compliance and returning to the table. I stress again that while there may be other deals in the future, the current deal is the JCPOA and we must do our utmost to ensure we sustain it.

My Lords, I am very tempted to say that I agree with everything that has been said in response to the Statement and sit down. However, I want to make one or two points. First, inconsistency at the heart of government on a matter of such enormous significance in foreign policy is simply unacceptable. Somehow, somewhere, there has to be consistency. It may not be for the noble Lord to bring that about, but perhaps he might advise those who have some responsibility for it of the general attitude of those who have responded to the Statement.

Secondly, until the United States unilaterally withdrew, Iran was in full compliance. Thereafter, as the noble Lord, Lord Lamont, pointed out, the United States embarked upon a severe programme of sanctions. In addition, there was common talk in Washington that the real purpose was regime change. Given that, is it any wonder that Iran should not continue with what might seem to it to be the only way of exercising influence: namely, failing to fulfil its responsibilities under the treaty?

Not only was the question of sanctions enhanced, there was the threat of regime change and, of course, it culminated in assassination. We must ask ourselves this, if I may put it this way: what possible incentive does Iran have to return to compliance so long as the United States has the avowed intentions which it has previously displayed in such a dramatic and effective fashion?

My Lords, what I can say in response to the noble Lord is that we consistently make the point to the United States, in all our exchanges, about the importance of retention. We have a different view on the JCPOA. Obviously, the United States left the JCPOA, and that was very much its unilateral decision. We do not agree with that. We still believe that there is a role for the JCPOA. It has been shown to work. The triggering of the mechanism will, we hope, also allow a continued commitment to the JCPOA.

The important issue in all this is that we need to see a decrease in tensions. The noble Lord talked of Qasem Soleimani; we debated that in your Lordships’ House. I speak for Her Majesty’s Government, and at all times the role we have sought to play in the first instance is one of de-escalation and in the second of ensuring that we keep all diplomatic channels fully open, whether we are talking about the current tensions or the situation around the JCPOA.
