Lords ChamberThe noble Baroness is absolutely right that we need a curriculum in schools that will encourage all children to flourish and to be engaged. That is why, in setting up the curriculum and assessment review led by Professor Becky Francis, we have specifically asked it to consider how we can ensure that the curriculum meets the needs of disadvantaged pupils and those with special educational needs, and that it does that through creating space for exactly the sort of creativity for which the noble Baroness is a strong advocate.
Has any work been done on working from home? I gather that this is a factor which is leading to some absenteeism. As we are likely to see a growth in the number of people working from home, could we see that, at least in the public service, part of the contract is that those working from home will give an undertaking that their children will go to school?
My noble friend makes an interesting point. In my response earlier to the noble Baroness, Lady Barran, I was very clear that, to be honest, it does not matter whether you are working from home as a parent, or where you are working—your responsibility is to ensure that your children are in school every day. If you do not do that, you are disadvantaging their futures. I do not think my noble friend meant this, but I would not want there to be some idea that there is some sort of excuse because of the way in which there are—quite rightly—more flexibilities about the way in which we work. However we as adults work, we have a responsibility to ensure that our children are in school, because that is where they will learn and have the best chance of a successful future.

Lords ChamberOne of the very last contributions that I made in the House of Commons before I came face to face with the electorate in Redditch was to suggest that I feared that a future Conservative Government might dismantle our Sure Start programme. I was jeered at the time, yet sadly I was right. In recent years we have seen, through some of the longitudinal analysis that was done on Sure Start, the impact that it had on children’s lives. I am afraid I cannot at this time undertake to reinstate the scale and significance of the last Labour Government’s Sure Start scheme, but I can say that recognising the way in which all those elements work in a child’s life—childcare, early years, health and family support—will be a very important way that, across this Government, we think about our future plans to support children to have the very best start in life.
My Lords, the Minister mentioned the creation of a children’s register —yet another register that we are creating when we have already set up so many over the years. If she casts her mind back to the previous Labour Government, one of the major initiatives we had was to create an identity system for each person and child in the country. We increasingly see that that need still has to be addressed, particularly for problems with immigration, yet we now have a different approach by the new Labour Government. Although I recognise that this is rather wide of her brief, I wonder whether she would care to bear in mind that there is a case to be made for a simple approach to this. We ought to be trying to create coalitions where we work together to create a system that will give us greater data about everyone, including children, and which would be far more efficient than the present system, where we create separate systems all the time.
My noble friend tempts me to relive my days developing the national identity scheme and, in fact, having one of the very first identity cards issued by the last Labour Government. However, I will not go down that route. I have some sympathy with his point about around the range of different ways in which we now ask people to prove their identity. The intention behind the register for those children who are out of school is very much about safeguarding and ensuring that children do not get lost to our system, as has sadly become increasingly the case over recent years and which was exacerbated by Covid. This has a very special and important child safeguarding intention, which is why it is a legitimate scheme in its own right.

Lords ChamberMy Lords, like others, I extend a warm welcome to my noble friend Lady Smith and congratulate her on a great maiden speech. I also congratulate my noble friend Lady Merron on her appointment, and wish the noble Baroness, Lady Jolly, a long and happy retirement and thank her for her services and companionship.
On the Opposition Front Bench, I thank the noble Lord, Lord Evans, for his kindness in dealing with the topics I raised with him. In particular, I thank the noble Baroness, Lady Barran, for her help. We tried to get the quality of children’s school meals changed. We had private conversations, but we did not quite make it. And wow, now we have change—we hope. We have a different Government, and I am hoping that some of the issues raised today will see change actually taking place.
I have come up as 50th in the speaking order, so I have torn up my speech. The noble Earl, Lord Effingham, covered much of my ground. I declare an interest as a member of the Food, Diet and Obesity Committee, chaired by the noble Baroness, Lady Walmsley. She said much of what I was intending to say. There is one topic, which is a bit different, that I wish to draw to the House’s attention and in particular to the attention of my colleague the Minister, to see if I can persuade her fairly quickly to take action.
As the Minister knows, I have been concerned for a long time about sugar, obesity and children. I have been doing quite a lot of work privately on sugar and how we might seek to engage those in the industry that produces our food and drinks. Many of them are demonised for what they do; they are making profits and producing, in effect, rubbish and poison, and they are harming us. But they will continue to produce that food and those drinks. We need to engage—like it or not—with people who do things we do not like. Within those groups, there are people who might have a good heart, and who see that change is needed, that we now have a new government, and are perhaps willing to start exploring whether we can have a different approach.
I tried to persuade the previous Government that we should look at alternatives to sugar and the reformulation of food, and that we should look at more fibre going into food. Their view was that it should be left to the private sector—to industry—to initiate change. Well, the changes have not come. I have been talking to a number of people. I have been in correspondence with companies such as Marks & Spencer. I met Tate and Lyle yesterday, which I met previously to talk about these issues. If we are prepared to invite them in, we might start to get discussions around the table that might lead to a different approach to the previous one.
This country has been falling behind. If you look at what Europe has been doing and the conversations that have taken place with food and drink manufacturers, there has been much more co-operation than we have been experiencing here. They are looking to change legislation and to effect moves that will lead to better quality food. Similar changes are taking place in the United States, which has a great problem with obesity.
I am hoping I might be able to persuade the new Minister for public health and our new Minister here to have a conversation with me about the opportunities for change, which I sense is around. A group of manufacturers is happy to come in and start a conversation. This might lead, with good will on both sides, to getting industry itself to reformulate. Perhaps the companies will need incentives, such as subsidies, rather than simply talking about taxing them. This may be a way they can get involved, so we can truly start to deliver on the big change we need to reduce the growth of obesity in our society.

Lords ChamberI think the noble Baroness has heard from other noble Lords who are much more expert than I am of the value of Ofsted. In relation to one-word judgments, it is extremely important that parents have a simple and clear understanding—the noble Baroness rolls her eyes, but it is true. Parents value it. I commend to her the research on parent opinions about the value of Ofsted reports; they value those judgments, and it is important that parents are recognised in this.
My Lords, does the Minister agree that there are certain areas in which we need more regulation within schools? I particularly draw to her attention the fact that we now have more obese children than when the Labour Government were in power, with very little review taking place of the regulations that govern school meals. When will we see any possible change in that area?
Sadly, in most of the developed world there are more obese children. I am not sure there is a direct correlation with who is in power. As he knows—I thank the noble Lord for taking the time to meet the other day—this is work in progress.

Lords ChamberTo ask His Majesty’s Government what assessment they have made of recent remarks by a head teacher in Southampton criticising the quality of school meals for children.
My Lords, I am aware of the recent remarks from a Southampton head teacher. We cannot comment on individual catering arrangements, as arrangements with particular suppliers are made at a local level. Governors and trustees are responsible for ensuring compliance with the school food standards. We encourage local authorities and schools to work with their caterers to address any quality issues when they arise, to ensure that children receive nutritious meals in school.
I am grateful to the Minister for her Answer. I am grateful too to Mr Ashley for raising this issue, and to the Times and the BBC for picking up on it last week. This is a topic of great concern to all of us. One in three children now leaving primary school is overweight or obese. This, in part, links back not only to what they are eating at home but to an area where the Government have some influence and control, which is school meals. It was 2014 when the regulations were last reviewed; it is time they were looked at again. Much has changed since then. Children are eating far too much sugar these days. We need to reduce it; we need to look after their health and stop abusing them in this way. Will the Government act on that?
The Government believe that the school food standards are very clear. Schools must ensure that they provide children with healthy food and drink options, that they get sufficient energy and nutrition across the school day, and they clearly restrict foods that are high in fat, salt and sugar.

Lords ChamberMy Lords, I am grateful to the noble Baroness, Lady Bennett of Manor Castle, for her stimulating and challenging speech introducing this interesting debate. I also thank the House Library and the several organisations that have provided most helpful briefings, all pointing, regrettably, to the increasing mental problems among children and young people. I will not repeat the catalogue of problems that many others have covered.
I was going to say that one issue that had not been covered—although the noble Earl, Lord Effingham, now has—relates to diet and its impact on children’s and young people’s mental well-being. I am sure the Minister is not surprised that I am raising this again. The significant issue, on which action still needs to be taken, is the quality of school meals. My concern, and that of many others, is that one of the factors that greatly influences the conduct of children is sugar and the high incidence of it now. In particular, in the view of many people, there is an overly high incidence of sugar in school meals, which is why some of us have been pressing, for quite some time, for the long-overdue review of the regulations relating to school meals to be undertaken. The last time I raised this, the Minister said she would take it back to her department, and I am sure she has done that. As she returns today from her department, I wonder whether she is bringing some good news for us: that we will get a review—the last one took place in 2014—under way in 2024.
If the Minister is not in a position to do that, I can tell her that the new special Select Committee that has been established in the House to look at diet and obesity met this morning for the fourth time, to hear Henry Dimbleby give evidence. He of course was the former UK government tsar at Defra, brought in by the Government to help them with their problems with diet, farming-related issues, food generally and obesity. He resigned, somewhat disgusted with the Government’s unwillingness to implement a number of the recommendations that he has been pressing. Some of those related to children, school meals and the growth of obesity among children.
It is not only child obesity that is worrying us now. As the noble Earl, Lord Russell, mentioned—the noble Baroness, Lady Bull, has spoken frequently on this—we now see an increasing number of children with mental health problems relating to eating disorders. There is considerable growth in that area, which is of big concern and needs addressing. What is causing the growth in mental health problems? Do we have more nowadays than previously? That is debatable.
The causes—there are a variety—are debatable too but, without a doubt, many of us would agree that social media had quite a significant impact. This relates back to food, body image, appearance, bullying and how younger people relate to each other on social media, which is leading to mental health problems. I believe that, behind an awful lot of the mental health problems that we encounter with children, there is a fear of what they are encountering in life—and a fear of climate change, which is growing and worrying children. We have to do all we can to try to address that.
There is a poverty of food in many areas in the country, but I believe too that we have a poverty of spirit. This goes back to resilience and self-reliance, but it is an important factor that we have to see whether we are doing enough in schools to develop that self-reliance. I was very heartened to hear of the work that the noble Baroness, Lady Bull, described that she is undertaking, and we look forward to the results of the experimentation that is taking place in the north-east. I hope that it is successful.
To move away from that issue, I quickly recall that the noble Lord, Lord Layard, helped Tony Blair and helped significantly with regard to mental health by persuading the Government to introduce talking therapies. Some 22,000 people are now employed on that for adults. The noble Lord, Lord Layard, has done some recent work on addiction, and maybe he should do some work with children, too. We should look to see whether we can have a greater expansion at school levels. I leave it now to my good friend and colleague to speak with more authority about mental health than I can.

Lords ChamberMy Lords, it is a great pleasure to follow the noble Baroness. What a fascinating and wide-ranging debate this has proved to be. I am grateful to my noble friend Lady Andrews for securing the debate and for the excellent way in which she introduced it. I note that I am the first male to speak. I spoke to her about whether I should put my name down as I thought I would be rather wide of the mark, but as I listened to the contributions, particularly from my noble friend Lady Goudie on free school meals, I recognised that, rather like the noble Baroness, Lady Kidron, while I am not an expert on education I have spent a bit of time working on health.
When we look at the totality of what influences babies and children in their early years and children early on in school, all these important factors come together—media, the environment, what we eat and do not eat, what we are taught. My contribution will, I am sure, make the Minister groan, as we have been on the subject as recently as two weeks ago: what we feed our children and what we do not feed our children but should. I declare an interest as a founding member of the All-Party Group on Nutrition: Science and Health and as a vice-chair of the All-Party Group on Obesity. In recent years I have increasingly spent more time on children and obesity than on adult obesity.
Labour has an extraordinarily good record. We should keep saying this over the coming months. Back at the turn of the century, the Labour Government then in power started to get concerned about the growth in obesity among schoolchildren and babies. There was a programme on the radio today about babies’ food. One of the big issues is the amount of sugar that we are feeding to babies, unbeknown to many parents as they feed their children. I declare my interest as a patron of a small charity, Sugarwise, which was founded by a woman who happened to look at the ingredients in what she was feeding her baby. She was astounded by the high element of sugar that her child was being fed, which she believed had an influence. It continues and there is a very big case for further work to be done on babies’ food, but today I am looking at schoolchildren.
The Labour Government were concerned about children aged three to four, and upwards, that were starting to put on weight. In 2006, after doing some research, they introduced the national child measurement programme to check the height and weight of most schoolchildren from age four to five and 10 and 11. It has now also gone into school breakfasts. The aim was to track the changes that were taking place with children’s height and weight, to assess whether they were overweight and if they were then to try to take measures in conjunction with local schools and parents to try to reverse the growth in obesity. In 2007, they turned their attention to school meals because they recognised that, if they were to influence the course of events on health, this was the area where they had the greatest scope. They examined the quality of school meals and then in 2008 devised a programme to produce a set of regulations on the quality of school meals being presented to our children. Unfortunately, we went out of power in 2010, but that was a very ambitious and comprehensive programme. What a great pity that we were not able to stay in power and enforce those regulations properly, as we would not be facing the problems we now have with our young children.
In 2013, the coalition Government decided to do a review of those regulations governing the quality of school meals, and they changed them. There was concern about insufficient energy in the definitions, so they eased the rules—believe it or not—so that it was possible to increase the amount of sugar in the meals. The Front Bench of the Lib Dems have some responsibility for this, as they were then part of the coalition. I do not know whether they agreed with what was happening in the coalition Government’s internal debates, but they were certainly part of it. Public Health England started getting worried in 2016 about the continued growth in obesity, and it set up a programme aiming to reduce it by 20% in children by 2020. There was then an intention by the Conservative Government to undertake a review of those regulations in 2018-19, but then—in fairness to them—Covid hit us, and they have not had the opportunity to do so.
We have reached a stage where children are continuing to put on weight. Not only that, but we are now starting to identify children aged 10 to 11 with type 2 diabetes. These are people who will have their lives shortened. If this cannot be reversed, they will have attendant problems with ill health in their 40s and 50s, and possibly even end up with amputations taking place. The Government have responsibility in these areas. People like me have been pressing them to undertake this review of the regulations and reduce the amount of sugar that is now permitted to be served to children, early in school as well as at breakfasts, back to at least the level applied by the regulations introduced by the good Labour Government in 2007-08.
My colleagues here, whom I hope will be going into government, should take note of this. They should congratulate the former Labour Government for what they did on this and we should pick that up and run with it. If the present Government are not prepared to undertake a review of these regulations governing food, the Labour Government in their manifesto should at least be willing to commit to look at the quality of school meals, seek to improve it and reduce the amount of sugar in them.
I pressed the Minister two weeks ago to do that, on the basis of the good messages I heard from her side, her Front Bench and her health spokesperson, and in writing. I thought that there would be a review this autumn, yet I regret that, when the noble Baroness responded two weeks ago, she gave no indication at all that that would happen. I hope the Minister will reflect on that in the light of this House’s decision to set up a special committee to look at ultra-processed food, sugar, fat and salt. That group will be doing that work over the coming year and I hope that I might be a member, as I would press, as your Lordships might expect, that it looks especially at what happens to children. As we have said in so many other areas, what happens in their early years governs their development for the rest of their lives. Without good health, we do not get good education and all that goes with it.
I hope the Minister reflects on whether to do this review, because it is urgently needed. This is not a party-political issue: children are entitled to better food than they are getting at the moment. The Minister may say that it is healthy and nutritious. I think it probably is nutritious, but whether it is healthy is highly questionable, given the amount of sugar that is now going in. I have even been getting complaints from people who produce school meals that they are unhappy about what they have to produce and serve because, with the cost pressures now on them, they feel that they are not able to make the best possible food for children. I hope the Minister reflects on that and maybe redeems the Government by putting in place the review earlier than she had indicated last time we spoke about this.

Lords ChamberTo ask His Majesty’s Government whether they plan to review the regulations relating to standards for food in schools, and in particular whether they plan to reduce the amount of added sugar they allow.
My Lords, the school food standards regulate the food and drink provided at both lunchtime and other times of the school day. They already restrict foods high in fat, salt and sugar. We believe that the current standards provide a robust yet flexible framework to ensure that pupils in England continue to receive high-quality and nutritious food that builds healthy eating habits for life. We continue to keep the standards under review.
My Lords, I am disappointed that the Minister is not indicating that the Government are willing to undertake a review. Is she aware that they undertook a review in 2014, which eased the rules so that more sugar can be used in school meals? This is damaging the health of children, as we see from the evidence of morbid obesity. Will she review the position and please move to at least apply the regulations that applied when Labour was in power, when we had fewer children with obesity?
I hope that the noble Lord recognises at lot of the measures that the Government have taken on sugar content in food generally and the positioning of food products in retail settings, as well as our wider approach to food education in the national curriculum and our investment in the primary PE and sport premium.

Lords ChamberI am happy to congratulate the right reverend Prelate on his and his colleagues’ contribution before, during and after life. In relation to my noble friend’s question, data and digital literacy already feature within compulsory national curriculum subjects. Data literacy is covered within mathematics, science, computing and geography and digital literacy within computing and RSHE. They also feature within the subject content of GCSEs, which are counted in the English baccalaureate.
The noble Baroness will be aware that children are particularly susceptible to advertising, especially online advertising. Could she say when the Government are going to do something about gambling advertising and the effects it has on children?
I think I already, in response to my noble friend’s question, addressed, in part, the noble Lord’s question, namely in that we already teach children about the risks relating to advertising, and in particular the advertising of online gambling.

Lords ChamberTo ask His Majesty’s Government what plans they have to review and revise the children’s school meal regulations to reduce the levels of processed sugar and to provide incentives to encourage the use of alternatives such as stevia.
My Lords, the school food standards regulate for food and drink provided at lunchtime and at other times of the school day. They restrict foods high in fat, salt and sugar. We believe that the current standards provide a robust yet flexible framework to ensure that pupils in England continue to receive high-quality and nutritious food that builds healthy eating habits for life. We are keeping the standards under review, including the use of sugar and sugar alternatives.
I am grateful to the Minister for saying that the Government are keeping it under review. Is she aware that we have the unhealthiest children in Europe? If the regulations are working, why is that the case? If she accepts that fact, will she go back and speak to the her department and the Department of Health and see whether we can get some progress along the lines of what happens in the Netherlands, where the producers and the Government come together to look at food reformulation, giving children healthier food and getting away from the inevitable decline, which we are suffering, into more obesity and type 2 diabetes?
I do recognise the figures to which the noble Lord refers with regard to the level of obesity—particularly shocking, perhaps, in our primary age children. The noble Lord will be aware that in 2019 we brought together a group of stakeholders to look at updating the standards. That was postponed for understandable reasons during Covid but my right honourable friend the Minister for School Standards is now looking at this very actively.
