My Lords, I will speak to the Motion in my name, as a follow-up to a very interesting debate we had in your Lordships’ House on 2 May, led by the noble Baroness, Lady McIntosh of Pickering, on the subject of imports and exports of food and agricultural products. It was a lengthy debate, with some excellent comments from a number of noble Lords.
The Minister gave some good answers to many of the questions, but one that I did not feel that he responded to in enough detail was about where all the different checks on trucks would take place—most of the vehicles coming in are trucks, both big and little. I came away with the impression that, if the checks could not be done in Dover because there was not enough space, the drivers would be told to go up the A20, which becomes the M20, and turn left at the fourth junction, which is called Sevington near Ashford.
Now I know that area very well and I thought that there would be a temptation for the drivers to forget to turn left and trundle up either to London or to a small shed, where the cargo could be transferred to another truck and possibly avoid some of the checks. I felt that that was an omission that the Minister might like to put right—and I am sure that he will do so tonight. I am very grateful that we had a quick chat about it recently.
In addition to the comments made by noble Lords in that debate, there has also been a lot of media coverage, particularly about the import of EU food, and comments about basic questions such as: what is a “consignment”? Noble Lords may not want to know what a consignment is, but can the Minister say whether it is a truckload, several parcels in a truck, or something in between? Several years after Brexit, this should have been sorted out. We are told that there is a shortage of staff and places to have the checks, which is adding cost and delay, particularly to the import of foodstuffs, which have a shelf life, and this is something the Government should have sorted out before now.
However, coincidentally, yesterday the Government published a new document—I am sure that it has nothing to do with the fact that we are having this debate today—called What To Do When Attending an Inland Border Facility. It might be complicated but is only about 10 pages long, so I am sure that all the truckers in the world will be studying it over their tea. It gives good information about what they should and should not do, but it also demonstrates how incredibly complicated the system is. The first thing it says is:
“Get ‘border ready’ … Get ready before you reach Kent”—
I suppose that depends which direction you are going in. But, under the heading “Common Transit Convention movements”—I am not going to read out the whole document because we would be here all night—the document indicates that a good debate that your Lordships held two or three weeks ago seems to have delivered something that may actually be of help to the importers and exporters. Maybe this is a lesson that the Government, who may change after the election, want to be remembered by this wonderful document, which has taken them two or three years to produce. However, there it is, and I look forward to the press comments saying how wonderful it is. I beg to move.
My Lords, I thank the noble Lord, Lord Berkeley, for securing this debate, and I return to issues that I have previously raised with the Minister, particularly about biosecurity and the impacts on small and medium-sized enterprises through the operation of these inland sites. I have three points to make.
First—perhaps the Minister can provide information on this—I have been speaking to the environmental horticulture industry and I declare that, along with the Industry and Parliament Trust, I have a fellowship with the Horticultural Trades Association. What seems to have settled into the pattern for the environmental horticulture sector is that it is seeing large numbers of lorry loads being simply waved through and not being subjected to any checks. I am well aware of the desire to make sure there is not too much obstruction at the border, but there is a general feeling, which I will come back to later, that Sevington does not have enough space or staff capacity at the right times and it is impossible to carry out the biosecurity checks that were previously done on-site when goods arrived at nurseries and other places. That presents a serious biosecurity risk, when we know the pests and diseases that potentially can be imported from the continent. There are also concerns about goods coming from other places.
Secondly, I refer to the comments made in the past few days by the director-general of the Institute of Export and International Trade, which particularly looks at the food aspects. He referred to
“businesses left in the dark with vital information provided much too late, the systems being introduced aren’t working properly. Businesses are frustrated, hauliers are angry and fresh produce has gone off due to repeated delays”.
Like the noble Lord, Lord Berkeley, I am not going to read out an enormous amount of detail here, but it is worth people in general knowing that, on 17 May, Defra issued a series of updates. These indicated that medium-risk plant products will now be split into two categories: “Medium Risk A”, which need phytosanitary certificate and pre-notification, and “Medium Risk B”, which need a phytosanitary certificate but no pre-notification. So far, only certain fruit, such as quince and stone fruit, are in the latter category; spinach leaves have just moved from the “Low Risk” to the “Medium Risk A” category. We have to look at the usage and what is happening to the facilities created by the instrument that we are discussing and think of how difficult it is for people to manage this system when those kinds of things are happening.
Finally, again referring to Sevington, I want to mention issues that were raised by the Dover port authority at the end of March but that still very much apply. Now that we have had some time for the facility at Sevington to be in operation, perhaps the Minister can comment on the way in which it is going. There was great concern about whether Sevington had sufficient capacity to be able to handle products of animal origin. The reports I am hearing suggest that many lorry loads are either being waved through or ending up having to wait for long periods, which for animal products is a serious issue.
We are going into an election period. I guess that these issues are probably not going to get much of an airing for six weeks or so, but they are continuing issues that will need to be grappled with by whoever is in government and by an industry sector that is giving strong indications that the Government’s systems are causing it to struggle enormously with getting in the goods it needs.
It is absolutely a delight to be here this evening and to get such a warm and thoroughly lovely reception from everybody. I start by thanking the noble Lord, Lord Berkeley, for the privilege of standing at the Dispatch Box in this important debate, and all of those who have spoken for their thoughtful and constructive comments.
The legislation that is the subject of this debate has been instrumental in implementing the second phase of the border target operating model. New controls under the model began on 30 April, and I am pleased to report that, contrary to some of the press speculation and some of the comments made this evening quoting the press, checks have been introduced successfully at border control posts throughout the country. Defra will continue to monitor the controls and the impacts, and their effectiveness.
The noble Lord, Lord Berkeley, and the noble Baroness, Lady Hayman, asked how the Government intend to ensure that drivers of vehicles subject to controls attend the inland border control posts. Drivers will be instructed, if their goods have been called for an inspection at a border control post, by a port official at the point of entry or at the short straits through a digital system. That system comes up on their telephone, and their telephone number has to be inserted into the system for the electronic IPAFFS to actually pass; they cannot get in without that information being on the system. It cannot fail and so far has not failed.
Where a physical check is required, goods cannot be legally placed on the UK market until the load has been taken to a border control post, inspected and cleared. An instruction to attend a border control post for an inspection constitutes a legal requirement. Should a vehicle fail to attend a border control post, officials can require the return or destruction of the goods for the relevant local authority to carry out controls, such as identity or physical check. There is no evidence so far of traders taking advantage of Sevington’s inland location to circumvent checks.
The noble Lord, Lord Berkeley, also asked what a consignment is. It is a range of goods covered by the same certificate, which is pre-filled to enter the country through any of the border control posts.
The noble Baroness, Lady Bennett, took some delight in telling me that that we were failing on pretty much every single front in the system that we have implemented. She gave me a few examples, which I did not recognise. I am sure she would understand that this is a very significant change to what has gone on before. We have not ever done checks at our borders, or at least not for a very long time. The imposition on businesses importing into this country is significant, and the Government are well aware of the cost and the time and trouble this will cause. At the same time, I think that she would agree with me that it is extremely important that we do this for our own biosecurity. There are multiple reasons, which I think we would collectively agree on, for why we are doing this.
For many years, we have done nothing. We are now starting to build up our new border controls and biosecurity controls. To go from nothing to everything in one go would undoubtedly have created the scenarios the noble Baronesses, Lady Randerson, Lady Bennett, and others keep telling are happening at the moment. They simply are not, and I gave a clear instruction at the beginning of the process that we want a pragmatic approach. We are not in the business of closing down UK business, but we have an imperative to check and to build up those checks over a period of time, taking a risk-based approach. It is not helpful to be told that we are not doing everything we should be doing. Of course we are not: we are in week two. We may be doing everything in a few months’ time, and perhaps somebody else will be standing here at the Dispatch Box answering questions on that. I think and hope that they will see the benefit of taking a pragmatic approach, because we do not want to stop trade in this country.
The noble Baroness, Lady Bennett, said that she felt that there were not adequate staff at Sevington—it is not “Severington”, just for information. I am not sure whether the noble Baroness has been there, but I have. I have spoken to the staff and seen them operating there, and I can tell her that it is working very well and is fully staffed, so I do not recognise the comments that were made.
There were comments too about getting from Dover to Sevington, which is 21.7 miles away, and the risk that might constitute. Of the goods coming in to Sevington, 99.9% are from organisations we trust and know; it is a formality to check that there has not been a mistake, and that we are not inadvertently bringing in some pest or disease. The people coming to Sevington are not looking to import things illegally into the UK; they are following our rules. They have export health certificates, have followed the whole system all the way through and have loaded everything up on to the system; we are simply checking that all those formalities have been done correctly.
We should not conflate that with the illegal importation of meat that comes in primarily, but not exclusively, through Dover, which is brought in by a van and a driver from Poland, Romania or somewhere else. Those people will never go to Sevington: they are not on our system and we do not even know they are coming. It is really important to avoid conflating those two things. If you do, you get very confused about what Sevington and every other border control post in the UK is trying to do. Stopping illegal imports is the job of Border Force at the border. Checking goods that are coming in through our prearranged system is the job of our border control posts. They are fully manned and fully operational across the entire country.
The noble Baroness, Lady Hayman, asked me about an error rate of 33%. That number is not familiar to me—I have never heard of it—so I will go away and check. If the rate is anywhere near that, I will certainly write to the noble Baroness.

My Lords, I am very grateful to all noble Lords who have spoken in this short debate. It has been very interesting; so many examples from different parts of the importing world and cargoes have been cited. I am grateful to the Minister for his response, because he clearly disagrees with many of the issues that have been raised. He may be right that it is short-term.
I will make a couple of points. First, I think he said it in the previous debate, but the Minister mentioned again drivers in white vans from Romania. I used to live in Romania, about 50 years ago; I was working there. It is a member of the European Union, like so many other member states, and has just as much right to being treated with dignity and respect, and speed, as people from other member states. A lot of people criticise meat from Poland—
I wonder if I might comment. I absolutely agree that anybody from Romania or Poland, or indeed any other country in the world, has the right to be treated in a dignified way. But the fact of the matter is that, in Romania, African swine fever is running riot. It might be in Europe, but it could be any other part of the world. The point is that we do not want African swine fever. If you import illegal pork into this country, you will bring African swine fever with you at some point.
I am grateful to the Minister. We will have to see. Where I live in Cornwall, there is a boatyard next to me that builds fishing boats, and it has about 15 Romanian welders—legally, I should say —and they are bloody good welders. The fact remains that we are importing most of these goods from the European Union, and I am sure the Minister agrees that everybody will be treated equally.
My main concern, which several noble Lords have raised, is when things go wrong. Whether or not there are enough staff we can go on debating until the cows come home, but government IT systems have a habit of not always being 100% successful. This is probably something for the next Government, but the Minister can keep on thinking about this for the next few days: what is the fallback situation when it goes wrong? In other words, is there a manual system that will keep the goods moving while somebody sorts out the computers?
We will have several months when there will be a lot of press about this, and there will be no Ministers to answer questions, so we will all watch it with interest. Somebody or other in this Chamber will be on the other side of the fence at that stage, and will be able to answer criticism. If it is the present Minister, then in Opposition, I am sure he will enjoy that.

Lords ChamberNo, I do not recognise that at all. Defra grants have helped over 30 councils across the country to tackle fly-tipping at hotspots, such as by installing CCTV and putting up fencing. Further grants to support even more councils are due this summer. Furthermore, councils retain all income from fixed-penalty notices, the upper limit for which has recently been increased to £1,000, and this is ring- fenced for local enforcement and clean-up.
My Lords, will the Government encourage those who have building waste to tip to put it into filling the potholes in the road? That would kill two birds with one stone.
That is a novel idea. I am certainly happy to take it away and consider it extremely carefully.

Grand CommitteeMy Lords, these regulations were laid in draft before this House on 14 March 2024. This is a good news story: Atlantic bluefin tuna are present again in UK waters and are increasing in abundance after an absence of many years. In 2021, the International Union for Conservation of Nature changed its assessment of bluefin tuna from “endangered” to “least concern”, which reflects the improving state of the stock. There is significant demand for recreational fishing access to bluefin tuna, which will boost tourism in coastal communities and deliver social and economic benefits.
Following our exit from the EU, the UK joined the International Convention for the Conservation of Atlantic Tunas, henceforth referred to as ICCAT, which is the international organisation that manages Atlantic bluefin tuna. This enabled the UK to secure bluefin tuna quota for the first time. In line with ICCAT rules, this instrument will enable UK fisheries administrations to open their own catch-and-release recreational bluefin tuna fisheries. It will permit authorised recreational fishing vessels to target bluefin tuna by rod and line only and on a catch-and-release basis, meaning that fish should be returned to the water unharmed. Without this legislation the UK would be able to run only commercial and scientific bluefin tuna fisheries, preventing us unlocking the social and economic benefits associated with the recreational fishing of this valuable species.
So far, UK fisheries administrations have taken a cautious and measured approach to managing bluefin tuna quota by running scientific catch-and-release tagging programmes, known as CHART, over the past three years. Under the English CHART programme, bluefin tuna were caught and released with an exceptionally low mortality rate of 0.7%. The programme provided valuable data on the social and economic benefits associated with recreational access to bluefin tuna. A trial commercial fishery for bluefin tuna ran in 2023 in UK waters.
This year, the UK has been allocated around 66 tonnes of bluefin tuna quota by ICCAT, which represents 0.16% of the total allowable catch shared between all ICCAT contracting parties. Comparatively, the European Union has been allocated 53%. In future years, the UK hopes to increase its quota allocation; decisions on how we intend to use it will ensure that bluefin tuna fisheries meet our international commitments, contribute to delivering the Fisheries Act 2020 objectives, and reflect stakeholder interests. This year, 16 tonnes will be used for recreational fisheries and 39 tonnes will be used for the trial commercial fishery, which is running for a second year. The remainder will be used for commercial by-catch and scientific tagging programmes. Although the tuna will be caught and released in the recreational fishery, quota is needed to cover any incidental mortalities.
The Marine Management Organisation is expecting to open a recreational fishery in English waters this summer. The Welsh Government are also considering opening a recreational fishery in Welsh waters this year. These fisheries will run alongside further CHART programmes elsewhere in the UK. ICCAT requires any recreational targeting of bluefin tuna to be authorised. The UK fisheries administrations currently do not have the appropriate powers to authorise recreational fishing for bluefin tuna. Therefore, the Government wish to proceed with the legislation being debated today to bring recreational bluefin tuna fishing in line with ICCAT requirements.
This statutory instrument has been created using powers under Section 36 of the Fisheries Act 2020 to add provisions as amendments to existing assimilated law, namely Regulation (EU) 2016/1627. This UK legislation enables each of the four UK fishery administrations to issue non-transferable, time-limited permits to UK recreational vessels to fish for bluefin tuna in their waters should they wish to do so, regardless of where in the UK the vessel is based. It gives fishery administrations the power to set permit eligibility requirements that support the delivery of Fisheries Act objectives; to set appropriate criteria for ranking applications in the event of oversubscription; and to refuse permits on the grounds of safety, conservation or appropriateness.
The SI also gives fishery administrations the power to amend or revoke permits. It explicitly prohibits both the unauthorised targeting of tuna on a recreational basis and the removal of bluefin tuna from the water anywhere in UK waters, whether on a vessel or from the shore. It amends the Sea Fishing (Enforcement) Regulations 2018 to confer enforcement powers on the Marine Management Organisation and the Inshore Fisheries and Conservation Authorities. Finally, the SI creates new offences for the unpermitted recreational targeting of bluefin tuna and for breaching permit conditions, ensuring that we protect this unique species and its encouraging return to UK waters.
These amendments are distinct from the licensing requirements and powers under Section 14 of the Fisheries Act 2020, which apply only to commercial vessels. This legislation will support delivery of the sustainability and scientific evidence objectives of the Fisheries Act 2020.
With an annual allocation this year of 16 tonnes of quota, bluefin tuna recreational fisheries are expected to generate £25 million in charter fees and significant additional spend over the next 10 years in deprived rural and coastal communities. These benefits will increase if quota allocations increase. We are keen to improve our knowledge of bluefin tuna in UK waters, which is why this instrument stipulates that recreational fishers must report their catch within 24 hours of each trip.
The devolved Administrations are supportive of the amendments made by this UK instrument. If the instrument is not passed, there will not be enough time to open the bluefin tuna fishery for the full 2024 season, with the consequence of lost revenue for charter businesses and an increased risk of illegal fishing.
I hope I have reassured noble Lords on the purpose and aims of this instrument, which will deliver socioeconomic opportunities to coastal communities across the UK. For the reasons I have set out, I commend these regulations to the Committee. I thank noble Lords for their support and remain at their disposal for any questions that they may wish to ask.
My Lords, I am grateful to the Minister for that introduction. I have one or two questions to ask him, because I have been involved in some fishing discussions in the south-west, where I live.
I start by asking the Minister about this SI. We are talking about recreational fishing boats. Can the Minister explain in a bit more detail the difference between a recreational fishing boat and a commercial one, if there is a difference? Is the difference that you are required to throw the fish back on a recreational boat but, on a commercial boat, you can eat the product? It is unclear to me. I know that they all have to be caught by rod and line, but does it matter who catches them?
At the end of his useful introduction, the Minister mentioned an income of £25 million for the fishing industry, but, only a couple of months ago, a similar decision was made to ban pollock fishing completely. That will probably put a large number of small fishing boats whose owners live in small villages in Cornwall, where I live, out of business, and they will probably have to sell their boats.
The reason I raise this issue is that, in the debate on pollock fishing in the other place, on 11 March, there was a lot of criticism from all parts of the House about the lack of data. There was a quota of several thousand tonnes a year of pollock that could be caught, but suddenly, just like that, the whole thing was banned —no fishing at all—with maybe a small amount of compensation if the fisherman’s main income was from collecting pollock. There has been a series of bad rows in the south-west and other places because it is not easy for these small fishing boats to diversify.
In a media statement, the then Minister for fishing and fishermen—I do not know who it was but he has been quoted among the fishing sector in the south-west—said, “If you’re suddenly not allowed to fish for pollock, you can always fish for tuna”. As the Minister here will know, tuna are rather heavier than pollock and you need different equipment. Today, we have a draft regulation telling people that if they if they want to fish for tuna then they have to chuck it back—which I think is a good idea—but a couple of months ago a Minister was telling people that if they were not allowed to fish for pollock then they could go fishing for tuna.
People who are about to lose their livelihood—quite a few of them are having to sell their little fishing boats in places such as Mevagissey—being told that they can go and fish for something else, and that by the way they will get a small grant for one-quarter of the difference, is bad enough, but when people dug into that a bit more they found that there was no data about why the ban was suddenly introduced, without any warning to the fishermen concerned—it just suddenly came. If the stocks were gradually reducing then I could understand that fishermen might be told they could not fish for so many and their quota had to go down for the next year, but to be suddenly told that you cannot fish for them at all, even though that is your livelihood—and we might give you a bit of money for a cup of tea but nothing else—is ridiculous. It shows complete ignorance of the industry. I was talking to a fisherman in the Isles of Scilly at the weekend. I asked what he thought of it and he said, “Well, there’s more pollock around my coast than there are human beings in Cornwall. These people don’t know what they’re doing”.
I would be interested to know the basis on which people can continue to fish for tuna and either chuck it back or eat it, depending on which of these different commercial arrangements are in place. Will the Minister comment before the Government introduce any more sudden changes in regulation? This has a dramatic effect on small boat fishing around the coast, not just in Cornwall and Scilly but in many other places. How are they going to improve things in future? I look forward to his comments.
I am grateful for that answer. We are where we are, but can the Minister provide any assurance that, in future, the monitoring of not just pollock and tuna but other fish that need to be monitored is done consistently and comprehensively? At the moment, I am told that anybody who is allowed to fish for pollock can get extra money from somebody in the Government if they put a tag on it or if it gets monitored. It seems to me that the monitoring should have been going on continuously for many years and the results published, so that people can form their own view as to what is likely to happen in future—and challenge the MMO and anybody else if they do not like it. It would be very helpful if the Minister could give me some comfort that it is going to get better.
That is exactly it and precisely the place that we all want to be. Specifically on the bluefin tuna fishery, we have gone into this carefully. We have done three years of scientific study without even starting up a commercial or recreational fishery, so the lessons are being learned. I take the noble Lord’s point about having a consistent approach and will certainly take a closer look at that when I get back to the department.
We had some comments from the noble Baroness, Lady Bakewell, on how the fishery is to be enforced. I know that she is a keen fisherman herself and an expert in catch and release. In England, the inshore fisheries and conservation authorities—IFCAs—and the Marine Management Organisation will be enforcing the new legislation. IFCAs enforce waters up to six nautical miles from the shore and the Marine Management Organisation enforces from six miles to the 200 nautical-mile limit. Fishing for bluefin tuna without a permit or in contravention of the legislative requirements and permit conditions will be a criminal offence. The MMO will have the power to vary, suspend and revoke permits, under the conditions set out in this new legislation.
Enforcement of the fishery will be a risk-based and intelligence-led process, with the primary objective of enforcing the prohibition of non-permitted activities. Clearly, we are dealing with small boats in a big sea with limited resources. It is not going to be 100%, but no system ever is. However, there is quite a lot of local intelligence in this space and I believe that the MMO and the IFCAs have the resources in place to manage the entire process.
I think that covers everything. If I have answered all the questions, I hope that the Committee shares my conviction that this instrument is required to enable the UK fisheries administrations to establish recreational bluefin tuna fisheries in their waters. These regulations will bring social and economic benefits to the fishing industry and coastal communities, and support the sustainable management—I stress “sustainable”—of bluefin tuna. I will be sure to check Hansard and endeavour to respond in writing if I have missed any of the specific details. With that, I commend the instrument to the Committee.

Lords ChamberI thank the noble Baroness for her question. As I say, the Government are completely committed to domestic food production. I do not see that the introduction of the BTOM system has any bearing on what we import or export into or out of the UK.
My Lords, the Minister recently announced that meat imported through Dover will be checked at Ashford, which is about 15 miles upcountry. How is anybody going to stop the trucks from going straight up the motorway rather than turning left at Ashford? Will there be any enforcement, or are they just trusting people?
I thank the noble Lord for his question. It is important to differentiate between what is happening at the port of Dover and what is happening at Sevington. If you go to Sevington, you follow a system by completing the new electronic IPAFFS, which is designed for commercial imports. What is checked at Dover by Border Force is illegal imports. Now, you are not going to be sent to Sevington if you are illegally importing something; you go to Sevington only if you are following the Government’s designated procedures.

Lords ChamberNoble work is being done, and I thank my noble friend for pointing that out. There is a very clear line of process for compensation, which is that the polluter should pay. We will assist anyone who feels they have a legitimate case to make in following that process through. However, at this stage it is unclear whether there are significant losses. As I say, we are working with organisations such as the Food Standards Agency to make sure that the food is safe and that people can continue to produce high-quality shellfish from that area.
My Lords, this oil spill is serious, and it is good that the Government are doing all they can to mitigate the effect. However, this oil field has been there for a very long time, and I recall a lot of opposition to any development such as this in such a sensitive site. Is there an argument now for looking at new developments on similarly sensitive sites and saying, “No, we’re not going to do it there under any circumstance”?
We apply very strict environmental conditions to any new applications. I think this site is the largest onshore oil-producing business in Europe and it has been there for quite a long time. We want to make sure that all the supporting infrastructure is in the best possible condition and that this kind of spill does not happen again. For future licensing of this or any other site, huge measures will need to be taken to reassure local people that all measures are in place to protect them and the environment.

Lords ChamberThe Dasgupta review was extraordinary in so many ways: first, because it was the first piece of work on the economics of biodiversity commissioned by a finance department in any country. The Treasury having commissioned it makes it a very powerful tool. It shows that we are talking about not just species that the noble Lord and I have grown up appreciating but the economic future of this country. It is fundamental to what we are talking about; that is why we want evidence-based targets. On the other matter, I refer the noble Lord to the answer I gave to the noble Viscount opposite.
My Lords, the Government seem worried that too many people have responded to this consultation. This deadline was put in at the insistence of Parliament so that Ministers would be held to account. There is another deadline today in the Department for Transport—nothing to do with the Minister—so that is two deadlines missed. All that Ministers can say is, “We’ll ask them to extend the deadline.” That is not good enough. Surely, we have to get a grip on these things; if a Government commit to a deadline, they should keep to it.
I entirely accept that point. I would be treating your Lordships with disrespect if I did not mention the elephant in the room: a bit of mid-air turbulence in recent weeks, which may have somewhat contributed to some of the wheels of government not being correctly oiled. However, I assure the noble Lord that we are determined to deliver proper, meaningful targets as soon as we can.

Lords ChamberThe Government did not make anything legal. The Environment Agency permits releases of storm overflows. Where they are not permitted, they are illegal. The Environment Agency has had its budget increased and has increased its number of enforcement officers. At the moment, it is carrying out 2,200 investigations into illegal waste being dumped in rivers and is making prosecutions, such as the one that saw Southern Water fined £90 million—a fine that presaged the change of hands of that company, welcome as that was.
On the measures in the Environment Act, one amendment wanted to end the release of any wastewater into rivers. That would have cost up to £600 billion and more than doubled bills, many of them for people on fixed incomes. It is important that we balance a resolute and ambitious plan with affordability for those who have to pay.
My Lords, in the past week or two, South West Water has named 10 Cornish beaches as being unfit to swim off. I live there. It forgot my little beach in the village of Polruan, which is where I judge the sandcastle competitions every year. One day about a month ago, a great big flood of sewage came down on to the beach for several hours. It has just stayed there. People have videoed and reported it, but nothing has happened. Here we are, paying the chairman of South West Water more than £1 million to do absolutely nothing. It is time that some action was taken to clean up these beaches now.
The noble Lord is absolutely right that that is disgraceful. If it was an illegal sewage dump, which I am sure it was, that matter should have been investigated and should be prosecuted. The Environment Agency now has the resources. Its ambitions have been set not just by Ministers but by legislation that requires this practice to finish. Of course, with our current infrastructure, there are occasions when, if there is not a release of sewage in a storm, that water will back up into people’s homes. We cannot have that in a modern economy such as ours. We must make sure that we build the infrastructure. Some £170 billion has been spent since privatisation on water infrastructure. We are spending enormous sums of money in this price review period, which will rise to £56 billion in the years ahead. The sort of things that the noble Lord describes are absolutely terrible in waters that we want to be enjoyed by people and tourists. Our coastal economies need to be blue-flagged to make sure that these are things of the past.

Lords ChamberCan the Minister answer my noble friend’s Question? When will the directors and chairmen of these companies be sent to jail for what they have done rather than the company paying the fines?
I refer the noble Lord to my earlier Answer: the independent Sentencing Council has agreed to review guidelines to ensure that the sanctions we apply to water companies are appropriate.

Lords ChamberRewilding Britain is the campaigning organisation promoting rewilding and I think it has a target of 5% of the United Kingdom by the end of this century, which will not have an impact on food prices. It will, because of the change in the way we are supporting farmers, be bits of land that most farms can make available for ecological use rather than food production, without at all impacting on the food we eat. However, the right reverend Prelate raises a very important point about the way that some of the trillions of dollars of so-called ESG money is being spent in certain areas. The Government are taking this very seriously, because the S in ESG matters; the social dimension of how this money is spent, in what is called green finance, is really important. We need to protect our food security in the future and we are looking at this—not just ourselves in England but working with the devolved Governments to make sure that ESG money is being spent in a way that is honest, is not greenwash and does not curtail our ability to continue to feed ourselves.
My Lords, the Statement said nothing about Ukraine, although other noble Lords have mentioned it. Is the Minister not aware that the production of corn, fertiliser and oil from Ukraine is a very significant part of world production? Is that not going to affect not only prices and availability here, but maybe a greater movement towards famine in other parts of the world? I think many noble Lords agree that it is very unlikely that the material will be got out of Ukraine in the volumes necessary unless the ports get opened—which they probably will not.

Lords ChamberThat is a very valid point. Part of our discussions and the announcement that I hope we will be able to make imminently reflects what is also done in the poultry industry, where those changes were made to encourage more workers to come over and operate in that sector. We hope that this will alleviate the labour problems in this sector.
My Lords, will the Minister consider inviting the Prime Minister and other Ministers who perhaps do not understand the difference between the culling business and the slaughtering business to go and work for a week in a slaughterhouse, with a slaughterhouse worker’s pay, to try to understand the differences between them?
It is really important that we address the worker shortage right across the supply chain. The Agriculture Act allows us to intervene where we feel that retailers or any part in the supply chain are acting unfairly. This is another area we are looking at. It is important that we have the right people working in abattoirs, and indeed the processing industry, and that they are well rewarded for doing so. This is a vibrant marketplace for a type of meat that people want to eat and, as I say, it is suffering from a perfect storm of three or four different issues. We are trying to resolve this, including the very important point the noble Lord raised.
