Commons ChamberIt is not for me to choose who comes to the Dispatch Box. It is up to the Government to decide who they provide, and the Minister was very thorough in his long answers to questions. You have also been in government, and you were the ones who chose who stood at the Dispatch Box. I do not think the points you raise will have gone amiss. You did say that the Secretary of State was meant to be on a phone call, and it was with the Prime Minister as well. I am sure people will check to see if that is the case, as I am sure it is. If the Minister says it is the case, it must be the case.
Further to that point of order, Mr Speaker. I agree with my right hon. Friend the Member for Doncaster North (Edward Miliband) that it is disappointing the Secretary of State is not here to answer questions.
The Minister said he and the Secretary of State have visited affected areas. It is very strange that they visited only those with Conservative Members of Parliament. He got off the train in the constituency of my hon. Friend the Member for City of Durham (Mary Kelly Foy), and no doubt to get to Weardale you have to travel through my constituency, but they made no effort to go anywhere but where they have a Conservative MP. I am sorry, but politicising the crisis is not right.

Commons ChamberI will be quite honest. This is a time when people in the United Kingdom expect the parties to come together to work on behalf of this country, and I do not disagree. This is about ensuring that there is dialogue across the political parties to ensure that we do the right thing by the people in this country.
Further to that point of order, Mr Speaker. I echo the sentiments you just outlined—this is a time for coming together and putting political differences aside—but we have been played here. This issue was highlighted by hon. Members last week and into this week. The Government have had time to look at it. I accept that there are complexities in the process, but to have it announced that the statement is going to be made tomorrow in a press conference is totally unacceptable. May I ask your advice? If we were to vote down the motion on the Adjournment for the Easter recess, would that make it possible for us to sit tomorrow to accept this statement?
Further to that point of order, Mr Speaker. The Leader of the House is an honourable man. There is a sense of anguish out there among our constituents who are self-employed. He will have had the same emails and phone calls as I have had. The way this is being handled is terrible. Reassurance is being given and I accept that it is not easy to bring these schemes into being, but as my right hon. Friend the Member for Warley (John Spellar) has suggested, the announcement could be made tonight instead of tomorrow. A Treasury Minister—the Economic Secretary—is present, or somebody else could be made available in the next few minutes. If the Leader of the House knew that the announcement was going to be made tomorrow, it would have been in order for him to amend the business motion so that we could sit tomorrow to look at it. He is supposed to be our voice in Government, and I suggest that he should have done that. It would have been a good way forward. The alternative is that we vote against the Adjournment tonight.
I will come back to the Leader of the House. I think it is quite clear that those channels should be opened by the leaders of the parties. Some good offers have been made and I hope that the Leader of the House can respond.
The only thing I would say in their defence is that I do not think there was much detail in Peston’s tweet. I call Kevan Jones.
Further to that point of order, Mr Speaker. My right hon. Friend the Leader of the Opposition has made a very good suggestion. Could the Leader of the House indicate whether he would be able to take that forward? I think it would be a helpful way of moving this on.

Commons ChamberWait a minute. It was built in the 1960s, it is full of asbestos and it is very energy-inefficient. If he wants to put capital—public money—into it, fine, but it will not happen, because the money is not there, and what he suggests would cost a lot more than what has been proposed. In addition to that, the council is going to save somewhere in the region of £300,000 a year in running costs. In terms of trying to grow our council tax base in County Durham, that is what the Government want us to do. That is a good, prudent way in which the council is operating. As I say, if the hon. Gentleman is against jobs going to his constituency, please redirect them to mine, because I will have them. [Interruption.] Well, I just ask him to learn his facts. If he wants dog-whistle politics, which he obviously does, then fine, but let us see what is to the benefit—[Interruption.]
Order. If the hon. Member wants to intervene, he should intervene. I am not having continuous noise across the Chamber.
I am sorry, Mr Speaker—I never had this problem with the hon. Gentleman’s predecessor.
The Secretary of State referred to the grants on public health. Again, this issue needs to be addressed, because it is a driver of inequalities. In the police precept debate earlier, we talked about mental health and support for the most vulnerable in our community. The Advisory Committee on Resource Allocation came forward with a formula that meant that from April 2020 County Durham would have lost £19 million whereas Surrey would have gained £14 million. I say in a spirit of genuine co-operation with the hon. Member for North West Durham (Mr Holden) that I hope he is going to argue, and lobby his Government, to ensure that this inequality, which has been there for the past 10 years, will not continue.
Let me turn to the new homes bonus, which, again, disadvantages not only Durham but other councils. The top-slicing of the new homes bonus leads to a situation where, again, southern councils are gaining from this allocation and Durham and others are losing. That cannot be fair in any type of system. I therefore look forward to the new, radical approach that has been announced by the Secretary of State in arguing that we will level up these grants and the new formula will recognise need, because if it does genuinely recognise need, then the likes of County Durham will gain through this process. It is not acceptable to say that we can wash away the past 10 years as though they did not happen; they did happen. Without the fundamental question about what we want local government to do and how we want to fund it—

Commons ChamberOn a point of order, Mr Speaker. I might be wrong but I thought this debate was entitled “Local Government Finance”. My hon. Friend the Member for Denton and Reddish (Andrew Gwynne) on the Front Bench made a very good speech about finance, but we have heard very little about it from the Minister, who has talked instead about devolution and other things to do with local government. Could I have some advice, please?
I think if we look in detail at both speeches, we will see that they are around the finance package and the delivery of different projects. I think there is an interconnection there, but I am sure that if we did drift too far the Minister would come straight back into line. For the moment, I am more than happy.

Commons ChamberOn a point of order, Mr Deputy Speaker. We have had a very good debate this afternoon, and there have been some great contributions from all parts of this House. Members can call me old-fashioned, but I thought that the role of the Minister replying to the debate was to address the issues that have been raised in this debate. He has now been on his feet for nearly six minutes, and apart from some reference to two Conservative Members, he is making just a general speech, which he could have done in an opening speech.
The Minister has got time to address the issues, and I am sure that that is where he will take us now.
That was unfair, because I am addressing the points that have been raised by Members from all parts of the House. [Interruption.] The right hon. Member for North Durham (Mr Jones) may not like the answers, but I am providing them. With respect to the digital services tax—it is a tax that has been mentioned by numerous Members across the House—we are the first major country to do this, and it will raise in excess of £1.5 billion, ensuring that, in our thriving economy, our tech-friendly economy, those who generate value from UK users will pay a fair contribution to tax. We look forward to publishing more information and to the consultation on that, which, clearly, hon. Members may wish to take part in.
We chose in this Budget to invest in the long-term economic infrastructure of the country—a subject that has been raised by a number of my colleagues—raising investment levels in this country to the highest sustained level in my lifetime. That is the mark of a mature economy, which is not just spending everything on immediate consumption, but spending money for long-term investment. Public capital investment in this country will be £460 million a week higher under this Government than it was under the previous Labour Government. We have heard some of the ways that we will spend that. We will spend it by increasing investment in our roads—in every type of road. A number of colleagues from across the House—

Commons ChamberLook at the National Audit Office report of 2010. What it said on the equipment budget, not the overall budget, was that on its current basis the figure would be £6 billion. If there was no increase in line with inflation over a 10-year period, the figure would be £36 billion, not £38 billion—
Order. First, if the Minister takes the intervention both Members cannot be on their feet and he cannot suddenly say, “I don’t want to hear any more of it.” In fairness, if he gives way he needs to let the intervention get to the end. If I think the intervention is too long, let me take that decision. Let us not have both Members on their feet.

Commons ChamberOn a point of order, Mr Deputy Speaker. We are seeing an historic event tonight: a Government actually filibustering their own Finance Bill! I think that should have a plaque somewhere in this Chamber. I am told through the usual channels that the Conservative Whips told their Members to book hotel accommodation tonight because the Labour party was apparently going to talk the Bill long, even though Labour Members were assured by our own Whips that we would not. They have got to keep it going until 10 o’clock, so their Members can be reimbursed by the Independent Parliamentary Standards Authority. With 25 more speakers to go, and the Whips doing their best to cut down contributions, I wonder, Mr Deputy Speaker, whether you could institute a time limit to save Government Members from the incompetence of their own Whips Office. [Interruption.]
Hang on a minute. I thank the Government Whips, who have turned out in force, for their advice. I do not know what fear you have put among them, Mr Jones. However, if they were really interested in filibustering, they would have asked you speak. The fact that they did not has probably saved the House. As you well know, that is not a point of order but you have put your point on the record.

I just want to help inform the debate. I put the point about cluster munitions directly to the Saudi Foreign Minister when he came here. He said that, yes, they had bought them, but that was 30 years ago; that they are not usable, because they are 30 years old; and that it would not be possible to use them anyway, because they cannot be integrated with modern jets.

Commons ChamberI know that the Scottish nationalist party wants to play up its victim mentality, which it has turned into an art form that I admire, but the idea to which the hon. Gentleman’s White Paper refers, which is that Scotland could provide the manpower needed for its proposals from the Scottish population, which is getting older, was absolute nonsense—[Interruption.] May I give him some evidence? He needs only to look at the recruitment to Scottish regiments when they were reorganised. Why was one regiment in Scotland—
Order. We have moved way off the subject of the Bill. I understand that there is a desire to keep proceedings going, so I am not trying to pin it down to a tight debate, but I like to try to keep the debate on the subject of the Bill at least a little, so I am sure that the hon. Gentleman could mention it now and again. Given his experience, I know that that will never be a difficulty.
I would refer, for example, to the recruitment of overseas nationals from the Commonwealth. The regiments that had to backfill with Fijians were the Scottish regiments because they could not get the numbers within Scotland. If the hon. Member for Argyll and Bute has some magic pool of people in Scotland who will suddenly join the armed forces or if there is some huge boom that will happen in the next few years that means that 18-year-olds and fit individuals will join the armed forces, I would like to see them.
The hon. Gentleman is not exactly doing the idea of the United Kingdom a great service. Indeed, he is pointing out everything that is wrong with the current system.
Order. I think we are now going to get back to the Bill. We have had enough playing around. Kevan Jones, have you finished?
That is all right then. What I will say is that you have finished on this point.
I shall try to resist the urge to go off the point, Mr Deputy Speaker. The shadow Minister is a very experienced Member of Parliament and when he started his political career the world was a different place from what it is today. Does he recognise the necessity of having a much more flexible military system to deal with the threats that are evolving and changing in the world today?
Order. I think I might be able to help here. The hon. Gentleman might have been referring to the civil war as regards Kevan Jones, as he has been around for a long time, but we are not going to open up a debate about when he first got here and how the armed forces have changed.
The hon. Gentleman makes a good point, however. It is not just the equipment and how we deploy things that has changed. The armed forces do not sit in a vacuum away from the rest of society, and that is one of the main issues for consideration. Things that were acceptable 20, 30 or 40 years ago for young people who joined the armed forces no longer are. When I was a Minister talking to senior military personnel, I heard that young people were far more questioning, although not in a disrespectful way, and more knowledgeable about their rights. They wanted to engage rather than take instructions. That is a challenge for the armed forces. We need to ensure that there are mechanisms in place for when things go wrong and, as I said in an intervention during the speech from the hon. Member for Portsmouth South, a safety valve to deal with complaints.

Commons ChamberMy figures are on page 23 of the Minister’s file, if he would like to look. He quotes figures, but does he realise that the jobs being created in coalfield communities—in County Durham, for example—are low paid, part time and insecure? The scandalous thing that I came across in my constituency last week is that some young people are not in any figures at all. They have opted out of the system. They are working in the black economy, which is clearly having an effect on the EU rebate. That is what is happening on the ground. The Minister can quote as many figures as he likes, but—
Order. In fairness, we have a lot of speakers, including, in fact, the hon. Gentleman, and I hope to get everyone in. We will not have long interventions.

People are allowed to come and speak. I think everything is in order. If it was not, we would have stopped it.

Commons ChamberOrder. We need short interventions, because they are taking up a lot of time and many more Members wish to speak.
I would be intrigued to know which piece of health legislation would not be covered by the proposal. Again, I think that it is simply one of the issues that have been trumpeted by certain Members on the deregulatory wing of the Conservative party, who have clearly been prevented from pursuing the worst excesses of Beecroft by the Liberal Democrats. I just think it is complete nonsense.
On immigration, I consider the announcements in the Queen’s Speech to be a knee-jerk reaction from the Prime Minister to the threat he sees from his Back Benchers and from the UK Independence party. We have heard a lot of strong language about a crackdown on migrants, and in relation not only to migration but to access to health care and benefits. I understand that a ministerial group on immigration has been meeting, but it has not yet come up with a great deal because most of the plans that have been put forward have been blocked. The Health Secretary has been saying that we have a problem with health tourism, but he cannot tell us how much it costs.
The only real legislation put forward on immigration is secondary legislation that will enshrine the rules on deporting foreign prisoners and on getting private landlords somehow to check whether their tenants are entitled to be in the country. The first one is already law and so will affect nothing, and I do not see how the second can work without some type of registration scheme. Also, it will not apply to the bulk of immigration in this country, which it is threatened will come from Romania and Bulgaria, because that will be perfectly legal.
It is interesting that Nigel Farage says that he is now the heir to Thatcher. I remind Members that it was Margaret Thatcher who signed the Single European Act in 1986, which allowed the free transfer of labour across Europe. These proposals will have no effect. The Prime Minister is trying to act tough, but in practice he can do very little about the transfer of EU migrants. In many ways that transfer of labour has been good for British people, because many people in the north-east who were made redundant when the shipyards closed now work all over Europe, making a contribution not only to the economy of those countries but here.
My hon. Friend the Member for Poplar and Limehouse referred to the fact that we are at the fag-end of this Parliament. I have to say that the Business Secretary looked very unhappy this morning. He reminds me a little of the father of the bride at a shotgun wedding who is now going round saying, “I told you it wouldn’t last very long.” The Prime Minister obviously has a problem with his children on the Back Benches who are now in open revolt. It will be very interesting to see how it all ends. The lack in this Queen’s Speech of a positive economic stimulus over the next two years will add to the misery that is being faced day in, day out by many thousands of people in this country, many in my constituency.
On a point of order, Mr Deputy Speaker. At Defence questions, the Secretary of State announced that he was going to lay a written ministerial statement tomorrow on the future of Defence Equipment and Support—the equipment arm of the Ministry of Defence. He said that a decision had been taken to run the organisation by a Government-owned, contractor-operated model. This decision has been the subject of debate, delay, review and speculation over the last two years. In the light of how important this matter is—not only to those working in the defence sector but to many Members—is it right for it to be announced through a written ministerial statement rather than an oral statement and on the last day before the House rises for the summer recess, as it denies us the opportunity to scrutinise this very important decision?
The hon. Member has put his point on the record, and I am sure that the Secretary of State for Defence will be made aware of his comments.

Commons ChamberI am worried. It is no use telling me not to worry because Members—I ought to warn them now—may be down to a five-minute limit or less if we are to get them all in. I wanted to let people know so they could alter their speeches.
I will take your guidance, Mr Deputy Speaker, and not take any more interventions. On the comments of the hon. Member for Newark (Patrick Mercer), he knows that the recommendations put forward at that time regarding structure and names were put forward by the Army.
Any uncertainty needs to be clarified. It is almost a month since the Secretary of State told the Royal United Services Institute that some units will inevitably be lost or merged. Given that he has gone outside Parliament to light bonfires of rumours, it is not acceptable for him to throw more petrol on them by delaying. We are told that the Ministry of Defence has signed off on this issue now but that matters are being held up by Downing street for political reasons. That uncertainty is leading to a lot more rumours, which are causing more uncertainty.
In conclusion, when they were in opposition the Conservatives called for a larger Army, a larger Navy and increased investment in the armed forces. In government, their actions have been to do exactly the opposite. It is not surprising that they are losing the trust of the armed forces community and the public so quickly. We in opposition want to support strong reform on procurement and the principles of the military covenant and we want the equipment programme to be improved. Too often the Government have put austerity before security. I hope that in his response the Minister will not just answer the questions I have put forward but will also agree with the terms of the motion and the recommendations regarding the assumptions of the defence review to give those whom we ask to serve on our behalf the confidence and certainty they deserve.

Commons ChamberOn a point of order, Mr Hoyle. You have many attributes, but you do not have eyes in the back of your head. Would it be possible for you to ask those Members behind the Chair to leave the Chamber in order to reduce the noise level, so that others can follow the debate?
I must admit that, if there was noise interference, I did not know where it was coming from and could not hear it in front of the Chair. I am sure that Members will be quieter in future.
I thank my hon. Friend the Member for North Durham (Mr Jones) for that, because it certainly seemed quite noisy from where I was standing.
As I was saying, as real incomes fall, spending on basic items such as food, energy and fuel makes up an increasing proportion of the average family’s weekly spend, as the Office for National Statistics acknowledged in March when it changed the make-up of its retail prices index basket. That means that families are increasingly vulnerable when prices rise quickly.
The Opposition accept that no Government can control the price of oil, which the global markets set, and that the situation in the middle east is affecting people in countries throughout the world, to which the UK is of course no exception, but the Government have control over fuel taxation, and that has a significant effect on pump prices. When so many people are out of work and real wages are falling, the Chancellor has a responsibility to do all he can to help business and to promote economic growth and jobs; and when ordinary working people are struggling to make ends meet, he has a responsibility to do everything possible to help them get on.
That is why we tabled amendment 7. It is important that Parliament has the opportunity to scrutinise the Government’s policies on fuel taxation and their total effect on fuel prices at the pump, because the Chancellor’s cut in fuel duty, as set out in clause 19, is not all that it seems. In January the Government decided to increase VAT on fuel from 17.5% to 20%, even though the Prime Minister told voters just before the election that he had “no plans” to increase VAT. Without that VAT rise, petrol would be almost 3p cheaper now, swamping the 1p cut that the Bill brings in.
The Federation of Small Businesses said that the UK’s small and medium-sized enterprises would be “severely affected” by that hike in fuel tax. A survey of its members in January pointed to the increase as the single biggest threat to their business—something that will resonate with Government Members, who I am sure have been lobbied by the FSB on that point. Some 89% of businesses that responded thought that the Government’s measures would add £2,000 to their costs over six months. A spokesperson for the FSB said in response to the January rise in fuel tax:
“The Government have said it is putting its faith in the private sector to put the economy on a firm footing, yet 36% said they will have to reduce investment in new products and services and 78% said their profitability will be reduced—hardly conducive to growth.”
Many small business people in my constituency are struggling to stay afloat, particularly in the face of cash-flow difficulties. The VAT increase at the beginning of this year was expected to put severe strain on their cash flow, so the Chancellor’s 1p reduction in fuel duty has to be seen in that context.
Some people will be able to cut down on their use of fuel or even stop using petrol all together. Some people are switching to cycling or to public transport, and for those who are able to do so that is a good thing. As an MP for Bristol, which saw investment from the previous Labour Government so that it could become the UK’s first cycling city, I welcome people taking up cycling.

My mind has been set off with thoughts of my right hon. Friend the Member for Rotherham (Mr MacShane) doing various things with dead parrots, but I shall try to resist any temptation to go down that route.
The European Scrutiny Committee was clear about clause 18:
“Clause 18 is not a sovereignty clause in the manner claimed by the Government, and the whole premise on which it has been included in the Bill is, in our view, exaggerated. We are gravely concerned that for political reasons it has been portrayed by the Government as a sovereignty clause in correspondence and also in the Explanatory Notes”.
I would be concerned if, because of what has been said tonight, the explanatory notes are amended during the Bill’s passage, because that might mean we do not have proper explanatory notes, and it might have an impact on our being able to scrutinise the Bill thoroughly.
The Committee also states that the Foreign Secretary was so confident of this clause that he would not appear before the Committee. I think that is wrong. To ensure that the Executive are properly scrutinised, Cabinet Ministers should appear before any Select Committee or inquiry that invites them to do so, and I cannot understand why he chose not to do so on this occasion.
On a point of order, Mr Deputy Speaker. In the Financial Secretary’s address to the House today, he made the accusation that Labour Ministers, possibly including myself, made spending commitments that were not funded. My hon. Friend the Member for Halton (Derek Twigg) made the point that, if that was the case, I and other Ministers would have had to send a letter to the accounting officer—that is to say, the permanent secretary in the Department. Could you use your offices to request that those letters be produced, to go against the accusation that has been made today?
That is not a matter for the Chair, as the hon. Member well knows, but he has certainly got his point on the record and I am sure that everybody has taken on board his comments.
