The hon. Gentleman makes an important point. When I was the Minister, I was struck by how regionally diverse the creative industries were, particularly the video games industry. There are companies engaged in that pursuit in Leamington Spa, Manchester, Liverpool and Newcastle. It is a challenge. Sometimes it is straightforward economics: people want to base themselves in London to have access to the widest possible range of services, but it is incumbent on us—I am sure the Minister will respond to this—to recognise the diversity and talent in our regions. The recent merger of Tech North with Tech City UK has created a UK-wide tech quango, which is focused on highlighting tech success stories across the country. Different parts of the country have different specialisms in tech—I am moving slightly away from the creative industries.

The hon. Member for Blackley and Broughton (Graham Stringer) makes a valuable point, and the same criticism is often levelled at cultural funding. I am chairman of Creative Fuse North East, a project led by Newcastle University, which analyses the symbiosis between tech and culture. It is important to remember that culture is often a generator for success in the creative industries, so we must maintain a strong focus on investing in culture outside London. I am glad that the Arts Council has made great strides in doing that in recent years. We are very successful, and the creatives industries are now high on the policy agenda. I should give credit to the Creative Industries Federation, which was created two or three years ago to lobby on their behalf.

Tourism is a hugely important industry—the fourth or fifth most important in our country—that depends to a great extent on culture and heritage. By investing in and supporting culture and heritage, the Government support our tourism industry. We launched the tourism strategy in 2010, when the then Prime Minister gave a speech supporting tourism. One of my great bugbears is that far too few Prime Ministers—that is, none—ever make speeches about the arts. I hope that the Minister will continue to press the case to our Prime Minister that she should give a speech about the importance of culture and the arts in this country.

Despite the hon. Member for Blackley and Broughton trying to cheer me up, I am thoroughly depressed about Brexit. The small silver lining, which is worth recalling, is that our biggest export partner outside the EU is the USA, with whom we do not have a trade deal. A lot of that export investment depends on the creative industries, such as the film industry and the video games industry. Many of those creative industries are global service industries that will not necessarily be hugely affected by Brexit, such as advertising, architecture and publishing, where we lead the world. It is incumbent on us—including depressed remainers—to continue to beat the drum for the global success of the UK’s creative industries.

The right hon. Gentleman is very much missed from his former role, but during that time we had many discussions about the difficulties that artists, and musicians in particular, have in getting visas for the US. Does he share my concern that after Brexit they will have similar problems across Europe? What can we do to ensure that does not happen?

Yes, I do share the hon. Lady’s concern, but I must correct her: I do not think I am missed, because the new Minister is doing such an incredible job that he has wholly erased the memory of me. That is slightly irritating, but I am pleased that somebody as talented as him has taken on the role.

That concern goes both ways. The hon. Lady is incredibly perceptive, and I have worked with her very happily on many different issues. Talent is at the core of the success of our creative industries. If someone walks into the office of any successful business in any part of the country, they will hear a smorgasbord of different voices and meet people of a range of nationalities who have all been attracted by the success of the UK’s creative industries.

We simply cannot have a situation in which we make it as difficult as possible for talented people with the right skills to come to this country, and we must not find ourselves in a situation in which it is difficult for our successful companies to send their people abroad, whether that is a band of musicians or a team of people from an advertising or architecture firm. That must be at the front and centre of the Government’s thinking.

I was struck by an email I received today from a constituent, which is slightly tangential to the core subject of the debate. He runs a Brazilian management consultancy, which has an office in London because it believes in the openness of the UK economy. He cannot get a particular person with a speciality that would enhance the London business over from Brazil, and he has been trying for 12 months. It is a pathetic situation when the Home Office makes it so difficult for skilled people to come to this country and boost our economy.

The Minister should also keep an eye on the audiovisual media services directive. One of the UK’s success stories is that we have hundreds, if not thousands, of broadcasters based here, which can be regulated by Ofcom, the best communications regulator in Europe, and, as a result, transmit their services across Europe. As I was watching my BT Sport app in Europe last week, I was struck that, sadly, we cannot continue to take advantage of the digital single market, which allows portability for paid content. We will have to see what happens with that, but it is absolutely crucial.

The final hurdle—hon. Members will be pleased to know that I am coming to an end—is the French. They have carved culture out of every third-party free trade agreement between the EU and other countries. That was their No. 1 priority when the Transatlantic Trade and Investment Partnership was negotiated. As sure as oeufs is oeufs, the French will try to carve out culture in any free trade agreement between the UK and the European Union, and Ministers will have to be vigilant about the impact of any French agenda on the future of our creative industries.

Is the Minister aware of the campaign by the Writers’ Guild, “Free is NOT an Option”, which is based on a survey that found that TV writers are increasingly being asked or pressurised to write scripts for free, even when they are established writers who have previously written for the same show? What can we do to ensure that creative work is valued in the same way as other work?

I am aware of that very important campaign. I find it absolutely astonishing that many independent production companies, which make millions and millions of pounds, cannot be bothered to pay a decent wage to people who contribute to their work. I will certainly work with the hon. Lady to encourage them to do so.

On Tuesday night I spoke to the Hounslow chamber of commerce at the headquarters of iBurbia in Chiswick. The managing director there rushed up to me to say that he had just got superfast broadband by using one of our super-connected voucher schemes. He also said to me, utterly unprompted, that he thought my hon. Friend was one of the hardest-working people he had ever met. He told the entire room, full of hundreds of business people, that fact.

Obviously London is an important creative hub in terms of its contribution to the UK economy, but other cities such as Bristol can make a real contribution too. What assessment has the Minister made of programmes like Plus Tate, in which the Tate is working with other galleries such as the Arnolfini in Bristol, that enable the London institutions to help places in other cities?

Plus Tate is a fantastic programme that belies the statistics saying that London has more money spent on the arts than the rest of the country. The money that goes to the Tate helps to support 24 contemporary art museums around the country, and the scheme is very successful. It is worth bearing that in mind.

The changes relate to the announcement in the 2013 Budget and came into effect on 1 January 2015. Her Majesty’s Revenue and Customs established an external working group to consider their effect on small and medium-sized businesses. The Treasury and HMRC are actively engaging with it.

I thank the Minister for that response and for agreeing to reinstate the question after his officials tried to transfer it to the Treasury. That was very kind of him. As he will know, musicians are very concerned that they will end up having to fill out quarterly VAT returns for very small sources of income. If they sell their music through iTunes or Bandcamp, they will perhaps do the administration for them, but it is a real issue if musicians have to handle it themselves. I urge the Minister to take part in those discussions with the Treasury and ensure that the voices of musicians and other people in the creative sector are heard.

I would never dodge a question from the hon. Lady, particularly as she represents the constituency of Bristol East, where I stood famously in the 1997 election and turned a 5,000 Labour majority into a 17,000 Labour majority. The changes will protect and increase revenue. The hon. Lady is a great champion for the music industry. I take on board her point and I will certainly engage with HMRC.

The Government have recently reviewed their legislation and believe that the law as currently constituted strikes the appropriate balance between considering the needs of venues and managing the adverse effects that can come from noise.

I thank the Minister for that response. He will know that many people are arguing for an agent of change law in this country, as there is in Australia. They do not believe that existing legislation protects venues from developers who are building around the venue then submitting noise complaints. The owner of The Fleece in Bristol says that

“the reality of the current situation could not be further from the picture painted in the planning practice guidance”,

and the venue’s representatives are back before the planning committee next Wednesday.

The Minister will very soon be getting an invitation to Venues day on 9 December, which will be held just across the river on the south bank. May I urge him to attend that, where he will meet many venue owners who will explain to him just how difficult the situation is on the ground?

The hon. Lady is a great champion of live music, so it does not surprise me that she is raising this issue, and I will certainly consider the invitation to Venues day. As for The Fleece, I understand that Bristol city council has imposed some acoustic restrictions on planned developments around it. The agent of change principle has only recently been implemented in Australia. Some elements of it exist in our own planning policies, but I will certainly raise that with planning Ministers.

Yes, we have regular meetings with colleagues in the Department for Education, who work tirelessly on the issues of cyber-bullying and bullying in general. It is important to stress that Ofsted now holds schools to account for how well they behave in relation to bullying. It is also important to note, in the spirit of the hon. Lady’s question, that we help teachers to help their pupils, particularly when they are subject to abuse online.

I hope that the Minister will be aware of the report from End Violence Against Women, “New Technology: Same Old Problems”. One issue that the report highlighted was the sharing of intimate pictures online, suggesting that even if the person in the photograph had originally consented to it being taken, they ought to have the right to object to it being posted online, and that the internet service provider or the website should co-operate with them in getting it removed.

I am aware of that report, and that is another important issue that is worth raising with social media companies. There is a debate in Europe at the moment on the future of data protection regulations, and it is important to put on the table the issue of people being able to retrieve their data from websites to which they have freely given them.

My colleague the Secretary of State for Business, Innovation and Skills and I are keen to ensure that artists are appropriately rewarded for their creative content, including in the online world. Where music-streaming sites are legitimate, the payment of royalties is a commercial arrangement between the rights-holder and the online service provider.

I thank the Minister for that response. A number of musicians have recently pulled their music from Spotify because the amounts that such online services pay is so minuscule that the emergence of new artists and the financial sustainability of new music are being threatened. Does he think that the larger labels should follow the example of some indie labels and give a 50:50 split to their artists?

As we are talking about new or emerging artists, may I use this opportunity to congratulate James Blake on winning the Mercury award last night? He is a classically trained pianist who won for his album of ambient music. I would hesitate to interfere in the commercial arrangements of either the big labels or the indie labels, but I am sure that each can learn from the other.

I am delighted to update the House on the significant progress we are making. We are connecting more than 10,000 homes a week. Half the projects that are under way are already ahead of schedule and we are bringing in 4G two years ahead of schedule. This is a triumphant programme.

T3. On Monday I asked the Minister for Universities and Science why the UK is the only country in the EU that will introduce a private copying exception without a levy on copying devices to compensate UK artists, and he said that other countries had introduced far wider exceptions, which is not the case: only two of them have. Will the Minister talk to his counterpart in the Department for Business, Innovation and Skills to ensure that our artists are not left worse off than those in the rest of the EU?

The national minimum wage underpins wage levels for those at work and applies equally in the creative sector as elsewhere. The Government support industry in its efforts to provide employment opportunities for young people in the entertainment industry through initiatives such as the creative employment programme, the charity Creative Access, and the forthcoming launch of UK Music’s skills academy.

I thank the Minister for that response, and I particularly welcome what he said yesterday about paid internships in the creative industries. It is still the case, however, that many professional freelancers are expected to work for nothing or for very low pay. Sometimes, everyone involved in a production is being paid except for the musicians and actors who are fronting it up. What will the Minister do about that?

The exploitation of interns is unacceptable, and as I said, the music industry is working hard. In particular, UK Music takes a strong lead on the issue and is setting up the UK music skills academy. The charity Creative Access, with the BPI, will give work experience to 300 individuals who will be paid. I pay tribute to the hon. Lady who continues to campaign on this matter and many other issues in the music industry.

I have had no such meetings but the arts sector, my officials and the UK Border Agency meet every quarter as part of the arts and entertainment taskforce to have such discussions.

The Minister might be aware that on 6 December some Congolese musicians who had been working with Damon Albarn and Oxfam on a project were refused entry to the UK to perform at Rough Trade Records. I appreciate that there was some confusion about the type of visas they needed to apply for and about the process, but can anything be done to make it easier? It is a valuable, worthwhile project, and it is a shame that they were not able to perform.

T7. It is some time since John Robb of Louder than War approached me about the problems musicians have when trying to get visas to tour the United States, and we brought a delegation to see the Under-Secretary of State for Culture, Olympics, Media and Sport, the hon. Member for Wantage (Mr Vaizey), who has responsibility for culture. Will he update the House on the progress being made in talking to the Americans about this and, in particular, whether we can persuade them to look at reciprocal arrangements and adopt measures similar to those that we have here whereby organisers of big events can help to facilitate the visa process?

Officials from my Department have had constructive discussions with the United States embassy, which has taken on board our points, and those discussions continue. Obviously the US will continue to want to implement its regulations, but it has heard the hon. Lady’s concerns via my officials and we are continuing a constructive dialogue with the US.

Certainly, trading standards officers throughout the country work hard to counter the sale of physical counterfeit goods, but the real challenge, which the debate highlights, is the creation of the internet. It has obviously done much good for our economy and economies throughout the world, but it has also made it so much easier to pirate content digitally as well as sell counterfeit goods online.

My hon. Friend the Member for Morecambe and Lunesdale referred to the Creative Industries Council. The Government are delighted to have established the council to highlight the importance of the creative industries and to work on important issues such as access to finance and skills.

I also hold regular round tables with rights holders, be that in the music, film or television industries, and internet service providers and providers of search engines, to discuss common issues. The last round table that we held was attended by open rights groups as well, so hon. Members who are interested in what happened can find out from very public blogs.

As my hon. Friend pointed out, one of the best ways to combat illegal piracy is to provide legal services that are easy to access for consumers. The creation of Spotify; Deezer, which has recently launched worldwide; WE7, which is based here in the UK; and up to 70 other legal music services has provided consumers with a range of different opportunities to purchase music legally. Some ISPs, particularly BT, are looking very seriously at providing an easy-to-access music service to their customers, which would significantly reduce—I hope—the demand for illegal music.

I agree that the way forward is to encourage sites that allow legal downloading such as Spotify, but the share of the money that the artist gets when a track is downloaded is tiny. It is not enough for struggling artists—the ones that cannot make money out of huge tours or selling lots of merchandise—to make a living. Has the Department looked into how the economics of that stack up?

I absolutely agree with the hon. Lady on that, but even some money is better than none. On the need for education, which was mentioned earlier, it is important for her and others who feel like her, including me, to emphasise when we go to schools that many musicians and artists are not Adele, Coldplay or similarly successful groups and artists, and do not earn a great deal of money. The more prevalent illegal downloading becomes, the less opportunity they have to earn a living.

The Digital Economy Act 2010 was passed by the previous Government and this Government are in the process of implementing its procedures. Hon. Members will be aware that, in effect, this is the “three strikes” Act. We are in the process of putting in place the initial obligations code and the cost-sharing code, which should happen next year. It is important to stress that the letters that go out to people who might have infringed the law will be of an educative nature. They will not be of a penal nature and they will not cut people off; they will simply make the point that it is apparent that illegal downloading has taken place from their computer. The letters will also advise them how they can access legal music sites and protect their computer.

On supporting legal download sites, I am delighted that Richard Hooper has been appointed to take forward the digital copyright exchange. We hope that the exchange will be an industry-led initiative that will make it much easier to license intellectual property, music, film and television so that it can be used for innovative and new services. That is part of the Hargreaves report, which, although we are absolutely intent on protecting copyright, is looking at how we can bring copyright law into the 21st century.

Hon. Members will also be aware of the success that the Motion Picture Association of America had in seeking an injunction against BT to block the Newzbin2 site using section 97A of the Copyright, Designs and Patents Act 1988. That is something that the previous Government and this one urged on the industry, and we are delighted that existing law was used to seek an injunction to block a site that was intent on infringing copyright and on effectively selling illegal products over the web. That injunction has now been in place for two weeks, and I gather that the MPAA is seeking further injunctions against other ISPs.

I should stress that that process, too, is a legal process. Rights holders go to court and seek a legal injunction. It is not a voluntary process or a process outside the legal system, and that is exactly how it should be.

We are also working with internet advertisers to try to reduce the amount of advertising that appears on infringing sites. This can often be inadvertent, given the wide spread of internet advertising, but the Internet Advertising Bureau has made significant progress in reducing the amount of advertising that appears on illegal sites, and it continues to work on the issue. In fact, it is probably a world leader in the work that it is doing alongside the Internet Advertising Sales Houses association. We also work with credit card companies to ensure that their payment systems do not appear on illegal websites. So significant progress is being made on this issue on a range of fronts—credit cards, advertising, the blocking of websites and the implementation of the Digital Economy Act, as well as bringing rights holders together with ISPs and promoting legal sites for music and other content.

My hon. Friend also mentioned the work that Google is doing, and over the last 18 months relations between rights holders and Google have improved significantly. Google has set the bar in dealing with notice and takedown, and it is now possible for infringing pages to be removed from Google’s search engine in four hours, which is a very impressive turnaround time.

There remains a vigorous debate between rights holders and search engines, which in this case means Google for all intents and purposes, about the ranking of different sites. It is certainly a matter of extreme frustration to rights holders that typing in the titles of songs produced as if by a factory by my hon. Friend in the 1980s—such as “Never Gonna Give You Up” by Rick Astley—results in some infringing sites appearing above the legitimate site, thus depriving my hon. Friend of income that he richly deserves. Some voluntary procedures have been put forward, and we understand that Google’s issue is that the algorithm is its DNA, as it were, but we also understand the concerns of rights holders. We are hoping to find a voluntary solution.

This has been a good debate, and it is important to highlight the work that we are doing to try to protect our content industries. I also wish to highlight the interest in the House at this late hour from a range of Members, all of whom have an impressive background in the creative industries.

It is a delight to appear under your chairmanship once again, Mrs Brooke. I congratulate my hon. Friend the Member for Selby and Ainsty (Nigel Adams) on securing this important debate. The fact that so many hon. Members have attended, intervened and made speeches shows that there is large-scale recognition throughout the House of the success of the music industry, and support for it.

I wish Ben Adams the best of luck in his music career. I shall look out for Summer City, which has a ring to it. I can just hear the late Saturday night programme announcer saying, “We’ve got Ben Adams from Summer City coming on next,” and people will stay through the advert break to hear what he says.

I congratulate my hon. Friends the Members for Suffolk Coastal (Dr Coffey) and for Wirral West (Esther McVey) on their important contributions. Obviously, I go regularly to the Aldeburgh festival, which is probably one of the world’s leading classical music festivals. When my hon. Friend the Member for Wirral West recalled The Beatles, that made me recall a recent visit to Abbey Road studios, which I think still has the largest recording studio in the world. Hon. Members may have seen the George Harrison documentary recently, with the extraordinary pictures of The Beatles recording in Abbey Road. The studios still have the piano on which “Eleanor Rigby” was composed—a piano built in 1902. If hon. Members can find any excuse to visit Abbey Road studios, I would urge them to do it.

We talked about the huge success of the British music industry—and it is a staggering success, with almost £4 billion of sales. Britain is the only country apart from the United States and Sweden that is a net exporter of music, and although the major record labels may no longer be owned by UK companies, it is heartening that Beggars Banquet, the largest independent label, has had such astonishing success working with that amazing artist Adele. That leads me on to the point that was made about Andy Heath taking the helm at UK Music, following Feargal Sharkey’s resignation. I pay tribute to Mr Sharkey’s astonishing record in leading the UK music industry, and herding cats in putting things together. He was ably assisted by his second in command Jo Dipple, who I know will continue to play an important role.

I, too, pay tribute to Feargal Sharkey. The Minister rightly talks about our success in exporting albums, but I understand that if we were to take away from the equation Adele, Amy Winehouse and Coldplay, and a few other big names, we would be doing a lot worse. Does he share my concern that things are increasingly difficult for struggling artists, some of whom, in the independent sector, have made the greatest contribution because of their influence? They struggle in today’s climate, and we are in a world where only “The X Factor”-type bands and the huge sellers such as Adele and Coldplay can survive.

We have a thriving and vibrant music scene, and no individual singer or band is guaranteed success, but it is reassuring to me—I happen to be a fan of “The X Factor”, but people understandably say it should not be the future of UK music—that Adele and other stars have risen. Adele, I think, is the biggest selling artist in the world at the moment; that is an astonishing achievement. Obviously, the Government cannot dictate who is going to survive and thrive, but that is testament to the fact that we have a vibrant music ecology in this country.

I know that the hon. Member for Bristol East (Kerry McCarthy) has concerns about visa issues. It is important that bands in this country should have the opportunity to tour the world, and I am happy to continue working with her on the question of jurisdictions where it might be difficult for bands to get the appropriate visas—perhaps for understandable reasons.

Bristol is to be home to one of the new local enterprise zones announced in the Budget, with a focus on the creative industries. Will the creative industries council be able to offer practical assistance to make the zone a success, or will it be just a talking shop at the national level? Will it deliver results on the ground?

I was lucky enough to visit Bristol recently, where the astonishing success of the creative industries is a wonder to behold. We certainly do not want the creative industries council to be a talking shop, which is why we set up four or five work streams, which I hope will be relevant to businesses in Bristol.

Britain is rightly renowned for the creativity of its independent music sector, but musicians seeking to go and tour in the US face huge bureaucracy and costs when they try to get visas, whereas it is far easier for musicians from the US to come and tour here. May I urge the Minister to take action on this?
