I am grateful to the noble Lord, Lord Storey, for his realistic comments on this complicated but important new provision. As far as availability is concerned, as I said, in the 12 live pilot schemes 80% of existing providers have engaged and another 10% say that they are considering it. Obviously there will be some areas where there may be gaps in provision and we will work with the sector to see that they are filled.

We did a detailed study of the amount of money that should be paid, which the National Audit Office described as thorough and wide-ranging. The recent independent survey from Frontier Economics said that we were more than covering the costs of the extra provision.

So far as support for providers is concerned, the noble Lord makes a very good point that we need to do all we can to help providers develop their businesses. We have a package of support to help providers to ensure that their business remains stable. This includes a document of key insights from successful providers, guidance on marketing, managing finances and business planning, and an online directory of organisations that can provide business and finance support. We have also awarded grants to the National Day Nurseries Association and the Professional Association of Childcare and Early Years to develop new business sustainability resources. We will do whatever else we need to do.

On the percentage, we anticipated on the basis of a 75% take-up that we would get 200,000 applicants at this time. We have had 216,000.

My Lords, I pay tribute to the Minister who has taken this policy through from the beginning—he took the Bill through the Lords and has taken pains to listen to concerns from around the House. I think I speak for us all when I say that we are very grateful to him. On the issue of quality, maintained nursery schools, in particular, where the staff are qualified teachers, find that they have higher expenses and overheads than much other provision, because of their highly qualified staff. Will he pay particular attention to concerns raised from that sector as this is rolled out, and be sensitive to its particular needs?

The Minister was good enough to listen to concerns about homeless families and their access to this provision. Will he also keep an eye on how effective we are at reaching out to them and how the pilots have worked in that area? If he could say some more reassuring words about high-quality provision and assure us that the rollout will not lead to a dilution in quality, it would be very welcome.

I know that the noble Lord is very experienced in this area, but he has picked one particular statistic. The fact is that returners to education employment have increased by 8% since 2011 and, as noble Lords will know, this year our recruitment programme has run substantially ahead of last year. We have again recruited 100% of primary teachers and 89%, as opposed to 82%, of secondary teachers.

My Lords, will the Minister consider reviewing the system of continuing professional development for teachers with a view to streamlining and strengthening it? Only last week I heard from the leader of a multi-academy trust that he thought that there are too many providers in this area and it is not working efficiently. Does the Minister agree that consistently excellent levels of continuing professional development could have a significant impact on the retention of teachers?

The noble Earl makes an extremely good point. I think that we are all aware that continuous professional development for teachers is vital. Their initial training may be brief, for nine months, and I think that it is accepted by all in the profession —I have had discussions with the unions as well— that professional development should take place throughout a teacher’s career, particularly in their first three or five years. We know that overseas—for instance, in Shanghai—the programme takes five years. We are seeing many multi-academy trusts developing much more sophisticated continuous professional development for their teachers.

As I said, the early implementers, which have already been tested with 4,000 parents, seem to be going extremely well. I take the noble Baroness’s point about particular examples and would be very happy for her to share those details with me further so that I can penetrate this to see if there is anything systemic here and if we can help these particular parents.

My Lords, are there any particular obstacles to accessing the free childcare hours for families living in temporary accommodation? Do they have difficulty getting information about what is on offer? As the Minister knows, 100,000 children are currently in temporary accommodation, 40% of whose families are in employment so many of them will be eligible. Will the Minister write to me on this point if he cannot elucidate now?

I cannot see any reason why the fact that they are in temporary accommodation should be a barrier. We have tried very hard to advertise the service and of course they can go to any local provider to talk to them about it, but I will write to the noble Earl about this.

I am delighted that my noble friend visited Reach Academy in Feltham. It is an outstanding example of the success of the free schools programme, and I am pleased that it has also been approved to open a second free school. I know that my noble friend has done a great deal of excellent work with the Centre for Social Justice on the concept of family hubs. Obviously, the earlier we can help children the better, and this is why we are encouraging so many primary schools to open nursery schools, through the free schools programme and otherwise. A number of local authorities have introduced family hub-type models, and I hope we will see more of them. However, ultimately it is up to local authorities to decide the best local solution.

Does the Minister agree that school exclusion can exacerbate the difficult situation of children in need and may put them into care? Will he look at whether the system of continuing professional development for teachers can be strengthened and streamlined so that teachers are better able to manage such children and do not need to exclude them?

I entirely agree with the noble Earl that school exclusions are to be avoided at all costs, if possible. Certainly, permanent exclusions are counterproductive and even temporary exclusions are often so, because they amount effectively to the child bunking off for a day. They would be much better off segregated in the school, doing something which encouraged them to behave better in future. Most teachers are very keen to avoid school exclusions. I have just taken over responsibility for attendance and exclusions and will certainly look at this in more detail.

In 2014, we introduced a new duty on schools to make arrangements to support pupils with medical conditions with such detailed guidance, which was developed in association with stakeholders, including the Health Conditions in Schools Alliance.

My Lords, this is yet another argument for strengthening personal, social, health and economic education. If children understand their own bodies and are taught well about them, they can respond more appropriately to the issues raised in this question, and more generally, when such health problems arise for them or others.

The purpose of these proposals is to ensure that the public benefits widely from that charitable status. It is clear that many independent schools are possibly putting back into the system more than they are getting in charitable status, but it is also clear that some are not. As I said, we want to see a bigger effort on a wider front.

Can the Minister say what progress has been made in developing boarding school places for young people in care and on the edge of care? He may wish to write to me. Does he think that this offer from the independent schools sector is a possible opportunity to develop that approach?

The noble Earl makes an extremely good point—one that is very close to my heart. I have initiated a campaign to try to encourage more local authorities to send young children who are on the edge of care to state boarding schools and independent boarding schools. It is an area where there is quite a shortage of information. We have a new project that is providing a website essentially to market to local authorities the opportunities of sending some of their children on the edge of care to state boarding schools and independent schools very cheaply because they may qualify for full bursarships.

I thank the Minister for what he said about examining the case of looked-after children in early years provision. I have a couple of supplementary questions, on which he might write to me. The report, Starting Out Right: Early Education and Looked After Children, has four recommendations, and I mention two. One was improving national data on the attendance in pre-school of looked-after children. It would be helpful to have those data kept in future. Another recommendation was for a pupil premium plus for looked-after children in pre-school care just as there is in primary and secondary education. Perhaps the Minister will write to me about those two things.

They are not going to be named publicly but the schools will be able to work out from their results whether they are coasting.

As for the resources available to the regional schools commissioners, they started with very small offices of around six or eight people, but they have all now been substantially strengthened to an average of more than 40 people. We are satisfied that they have the resources in place. One thing that they are working on closely, as the noble Lord mentioned, is ensuring that we have enough capacity in the system and enough MATs to sponsor any failing schools where required.

I will write to the noble Lord in some detail on the other matters to which he referred. I am sure that all noble Lords support our ambition to ensure that all pupils, whatever their background and wherever they live, have the opportunity to go to a good school. I therefore hope that noble Lords will support our proposals and these regulations.

On the issue of the context of the schools, will the level of English spoken in families also be looked at? I imagine that that may have an impact on a child’s learning and it might be helpful when it comes to the read-across with Louise Casey’s work on integration.

The noble Earl makes a very good point. That is something we are looking at, and certainly increasingly seeing in some schools. The definition of EAL is sometimes a little loose, because there are plenty of people who speak fluent English but would be defined as EAL because it is their second or third language. However, in parts of the country an increasing number of schools are having to cater for a sudden influx in different year groups of pupils who do not speak any English at all. Certainly, the regional schools commissioners will take this into account.

My Lords, there are no plans to conduct a formal annual review. The Government are committed to providing high-quality early education for all children. We are investing an additional £1 billion a year in the early years free entitlements and last week we published the early years national funding formula, which ensures that this funding is allocated fairly and transparently. We will monitor the implementation of the 30 hours of childcare, and are clear that getting the funding right is critical to its successful delivery.

I thank the Minister for his reply, for the extension of 30 hours’ free childcare to working parents and for the funding thereof. Given the huge benefits to education and cognitive skills that high-quality early years childcare and education bring—they are so important to business and industry, to physical and mental health in adulthood, to remediating poverty and disadvantage for children, including looked-after children, and to productivity—will the Minister listen very carefully to the concerns of the sector that after this year the funding may not be sufficient? His Answer was reassuring to some extent. We should consider that investing in the highest-quality early-years care and education is essential to an infrastructure for successful economic development.

My Lords, I could not agree more, and that is why we are spending more than £6 billion a year by 2019-20 on early years education and childcare—more than any other Government in this country ever. We know that we need to get the funding right. Our announcement last week of a £4.30 minimum funding rate for local authorities, paid for with additional investment, shows that we are listening to the sector. The cost of childcare review was very thorough—indeed, the National Audit Office said that it was “thorough and wide-ranging”.

I thank the noble Baroness, Lady Armstrong of Hill Top, for her amendment, under which local authorities would be required to provide counselling and therapeutic support to parents who have had children taken into care to prevent any further children being taken into care. This is an important issue and, contrary to the noble Baroness’s introductory remarks, I am pleased that she has raised it and I am grateful to her, the noble Earl, Lord Listowel, and the noble Lords, Lord Warner, Lord Hunt and Lord Ponsonby, for their contributions to today’s debate.

As their Lordships will know, the Government believe that children are best looked after within their families, with their parents playing a full part in their lives, unless intervention in that family’s life is necessary. One of the fundamental principles of the Children Act 1989 is that children should be brought up and cared for within their families. Indeed, Section 17 of that Act embodies that principle, with local authorities under a statutory duty to provide services for children in need and their families to safeguard and promote the welfare of such children and promote their upbringing by their families. Local authorities also have a duty to return a looked-after child to their family unless this is against their best interests.

The noble Baroness is right to emphasise how important it is to support parents who have had children taken into care. They need the right type of intervention to allow them to be effective parents for that child if they are returned to them, any other children in their care and any children they may have in the future. We share this commitment, and the legislation and our statutory guidance, Working Together to Safeguard Children, reflect this. Working Together is clear that any assessment of a child’s needs should draw together relevant information from the child, their parents and any other professionals in contact with them. Every assessment of need must be child-centred and must acknowledge that many of the services provided as part of a child in need or a child protection plan will be to support the parents to make sustained change so they can look after their children well.

Alongside the child’s needs and wider family and environmental factors, parenting capacity is a crucial element of a good assessment, as Working Together makes clear. If support is needed to improve parenting capacity, a good assessment will identify this and enable the specific support needs identified—which will vary depending on the circumstances of each case—to be provided. If a child is removed, their parents should continue to receive help and support. If they go on to have further children, Working Together is clear that the level and nature of any risk to the child needs to be identified at a pre-birth assessment and the appropriate help and support given to these parents to support them with making a sustained change.

The noble Baroness might be interested to read, if she has not already done so, the research Assessing Parental Capacity to Change when Children are on the Edge of Care: An Overview of Current Research Evidence, published by the Department for Education in 2014. Among other things, the research sets out the parental factors that are known to be associated with a risk of significant harm to a child, the factors that can reduce the risk of harm and the likely nature of that harm. The report highlights the extensive body of research that shows that a range of problems can impair parents’ ability to meet the needs of their children. These include, but are not restricted to, poor mental health, problem drug and alcohol use, learning disability and domestic abuse. This underscores the need to make sure that parents receive the right type of support to meet their particular needs and circumstances.

Of course, there may be circumstances where counselling will always be appropriate. Because adoption, unlike any other permanent option, involves the ending of a child’s legal relationship with their parents and family, and the creation of a lifelong relationship with new parents, adoption agencies have a legal duty to provide a counselling service for the parent or guardian of the child. Local authorities and voluntary sector agencies that provide these services often, where appropriate, also use the service to support birth parents whose children have been taken into care. In the London Borough of Hammersmith and Fulham, for example, Ofsted inspectors found:

“In all cases seen by inspectors where placement orders had been granted, there was evidence of birth parents being offered referral to support services and mothers were offered referrals to commissioned services to avoid repeat pregnancies where proceedings were likely to result”.

We know that the cycle of care too often continues and that parents who have a child taken into care may well be more likely to have another taken into care later. The noble Baroness referred to some depressing statistics in this regard. The Department for Education’s innovation programme has supported the Pause project, to which the noble Baroness referred, to the tune of £3 million to support women who have experienced, or are at risk of, repeat removals of children from their care. The project aims to break this cycle and give women the opportunity to develop new skills and responses that can help them create a more positive future. Early indications are showing positive results for all 150 women Pause is currently working with, and in some instances the project is enabling them to engage in positive and consistent contact with their children.

Noble Lords will be pleased to hear that, given its success since Committee, the Secretary of State announced last week that further support is to be offered for programmes such as Pause to build on early successes of the programme, and that the programmes’ reach would be extended from six to 47 areas, with up to a further £7 million. This will provide much-needed further evidence on which we can assess our proposals. I hope the noble Lord, Lord Hunt, is pleased to hear that.

Through the innovation programme, we are also continuing to fund the family drug and alcohol court service, which provides therapeutic support to parents whose children are at risk of being taken away from them. Again, often these are parents who have had other children taken into care in the past.

Changing practice like this provides a more effective means of ensuring that we break the cycle. Mandating that local authorities provide counselling or therapy may help some, but it will not be the answer to all the complex problems in this context and will not provide the right support to all parents.

Given that the existing statutory framework is clear that local authorities must provide services to support children in need and their families to stay together, and the innovative ways that we aim to change practice, including further support for Pause and other projects, so that we can build up further evidence, I hope the noble Baroness will feel reassured enough to withdraw her amendment.

Will the Minister clarify that the future funding of the family drug and alcohol court is secure? Perhaps he would like to write to me on that point.

The noble Baroness makes a very good point. It is of course appropriate that children are placed with families and friends where possible. We have done a great deal of work in this area: the adoption support fund can help in this area and help the special guardians. The Family Rights Group and Grandparents Plus have also been funded in this area and we will continue to push in this regard.

My Lords, while I recognise the important steps that the Government have taken to improve the welfare of young people in care, will the Minister look at whether more could be done to stop children coming into care, as they increasingly do year on year? This makes it so hard to place them locally. For instance, will he look at the lowering today of the caps on benefits to families to see whether that has any impact on the numbers of children coming into care? To look globally, how do we help local authorities by strengthening families so that children do not come into care?

My Lords, I have a question about the data on outcomes. In the recent care leavers strategy, it was published that 90% of care leavers up to the age of 21 are in satisfactory accommodation. But the data that that was based on suggested that 81% were in satisfactory accommodation. Will the Minister take that away and get back to me to explain why those outcome measures seem not to agree with each other? I hope that that is clear enough.

My Lords, I would like to thank noble Lords for these amendments. I will speak about each one in turn, commencing with Amendment 33, which would prohibit profit-making in children’s social services functions, and then Amendment 35, which would put a duty on local government to report on several outcomes for vulnerable children and for the Secretary of State to publish an annual report on these outcomes.

I recognise that profit-making in children’s social care is a sensitive issue, and I entirely understand noble Lords’ desire to ensure that legislation is clear on this point. We believe that it is. There is already a clear legislative restriction on the outsourcing of children’s social care functions in the 2014 relevant care functions regulations. There are also restrictions on profit-making by adoption agencies through the fact that the Adoption and Children Act 2002 allows an adoption service to be operated only by a local authority or an organisation that is not carried on for profit. These restrictions as they stand in secondary legislation have exactly the same force as they would in primary legislation. Any attempt to remove them would need to be debated in both Houses. Therefore, although I entirely understand the intention, I do not think it is necessary to move this to primary legislation.

The noble Lord, Lord Warner, referred to the LaingBuisson event—an ideas-generating event exploring new approaches to service delivery. As he said, concerns were raised about profit-making in child protection, and these are reflected in the 2014 regulations to which I have already referred.

I understand, however, that there is some concern about whether Clause 29, the power to test new ways of working, could be used to reopen this matter. I have therefore tabled a government amendment that will explicitly rule out using Clause 29 for profit-making. This was never the intention behind the clause, but by including this amendment I hope to put the point beyond doubt.

On Amendment 35, the Government are committed to understanding what drives successful outcomes for vulnerable children. It is critically important that we collect data from local authorities and others to steer evidence-based and effective policy-making. The Government have already placed a duty on local authorities under Section 83 of the Children Act 1989 to provide information to the Secretary of State on their performance on a wide range of children’s social care functions, including on vulnerable children and care leavers. The Department for Education already publishes annual reports on the outcomes for vulnerable children, including their educational attainment and levels of absence and exclusion from schooling. For looked-after children, we also collect information from local authorities on offending, substance misuse, healthcare, and emotional and behavioural health. For care leavers, we publish information on their accommodation—

My Lords, perhaps I may speak briefly in support of the amendment. Earlier we debated my Amendment 2, and I indicated this morning to the Minister that I would not be seeking to move it. I must say that, listening to the debate in the Chamber, I was almost tempted to change my mind. The amendment was brought to my attention fairly late, which is why I was reluctant to push it as hard as I might. This is an excellent amendment, if I may say so. I understand that the Minister is going to give a very sympathetic response. I hope he can go as far as possible towards enshrining this in statute. I look forward to his response.

My Lords, I am grateful to my noble friend Lord Farmer and the noble Baroness, Lady Tyler, for the amendment. It seeks to add services relating to relationships to the services that local authorities may offer as part of their local offer. I understand the intention behind the amendment, and I agree that high-quality and consistently supportive relationships are critical to supporting care leavers into successful independent lives. I believe that the key to getting these relationships right is down to how the services are delivered, with individual professionals, volunteers and personal advisers building a strong and positive rapport with young people. I was very interested to hear what my noble friend Lord Farmer had to say about Orange County. It is an area I know well because in a past life I used to travel there regularly on business. I know that it is a very forward-thinking part of the world.

This is an important issue and I am certainly very sympathetic to the points that have been made. I am therefore very happy to take them away and consider further in detail whether an amendment to the Bill along these lines is the best way of securing further progress in this area. I hope that, in view of this, the noble Lord and the noble Baroness will feel reassured enough to withdraw the amendment.

My Lords, I am grateful to all noble Lords for this amendment and their contributions to this debate. The amendment would introduce a new clause setting out a national offer for care leavers. The national offer would first comprise an exemption from council tax until care leavers reach the age of 25. Secondly, it would extend care leavers’ exemption from the shared accommodation rate in housing benefit to the age of 25. Thirdly, it would amend the eligibility rules so that care leavers aged under 25 are able to claim working tax credits. Fourthly, it would limit the application of benefit sanctions to care leavers under universal credit. I understand the intention behind this amendment and I agree that it is important that care leavers have the financial support they need to lead independent, successful lives. However, I am not convinced that this amendment is the best way to provide that financial support. I will deal with these issues in turn.

We believe that local authorities are best placed to make decisions about council tax support schemes. Instead of mandating exemptions from the centre, we have provided local authorities with the flexibility to design their own support schemes to meet local need. This is about giving local freedom so that resources can be spent in the best way. We do not want to give blanket exemptions or discounts because of the impact this will have on local authority revenues and other council tax payers who may equally struggle to pay the tax. The latest briefing from the Children’s Society shows that more local authorities are deciding to exempt care leavers from paying council tax. North Somerset, Birmingham, Wolverhampton, Cheshire East and Milton Keynes have all introduced council tax exemptions in the last few months. We expect that the local offer will drive more local authorities to follow suit.

Equally, however, local authorities may decide that it is more appropriate to provide care leavers with other forms of financial support. Some local authorities, for example, provide care leavers with free travel passes or with help to buy clothes for interviews. These are all clear examples of local authorities taking their role as corporate parents seriously.

I recognise the intention behind extending care leavers’ exemption from the shared accommodation rate until the age of 25. As the noble Earl will be aware, discretionary housing payments continue to be available by local authorities which provide support for those individuals who need additional financial help with housing costs. The Government have already committed £870 million in discretionary housing payment funding over the next five years. Your Lordships will appreciate that that is a significant amount of money to help those who are vulnerable and who require additional help with housing costs. However, we have made a commitment in the care leaver strategy to work with the Department for Work and Pensions to explore the costs and benefits of an extension to age 25, as proposed in the amendment. We do not currently have data that tell us how many care leavers would be affected by this change and therefore I do not believe that it would be appropriate to make a change to the law until this issue has been reviewed further. As part of that, we have asked the Children’s Society to provide some real-life case studies to illustrate the impact of moving to the shared accommodation rate.

With regard to amending eligibility rules so that care leavers aged under 25 are able to claim working tax credit, noble Lords may be aware that universal credit will replace the current system of means-tested working-age benefits with a new, simple, streamlined payment. Under the new arrangements, the requirement for workers to be aged 25 or over to be entitled to claim the working tax credit element of universal credit will not apply.

The noble Earl said that care leavers under 25 will still be disadvantaged when universal credit is introduced. That is not consistent with the information provided by the DWP, which has been clear that age-related conditions will not be applied to universal credit. I would be happy to meet the noble Earl to discuss this point further.

Additionally, as part of the national rollout for universal credit, the Department for Work and Pensions will ensure that care leavers are able to make a claim to universal credit in advance of leaving care. They will also have access to universal credit advances where they need help to manage until they receive their first payment.

We recognise the impact that benefit sanctions can have on care leavers’ lives and we share noble Lords’ wish for sanctions on care leavers to be reduced. Jobcentre Plus has introduced a marker that allows care leavers to be identified on the system and receive additional help. We want to ensure that as many care leavers as possible benefit from the support that is available. We do not think it is in care leavers’ interests to remove them entirely from the requirements expected of other jobseekers. However, we already have the flexibility to tailor requirements based on the circumstances of each individual.

The purpose of sanctions is to encourage claimants to comply with reasonable requirements, developed in agreement with their job coach, so as to help them move into and prepare for work. Reducing sanctions on care leavers is therefore best achieved through closer working between local authority leaving care teams and work coaches at Jobcentre Plus. There are many examples of effective local protocols that can help care leavers to understand the conditions around the receipt of benefits. These include the Barnet hub model, which we promoted in our care leaver strategy published in July. I believe, however, that such protocols are best designed locally.

I understand what noble Lords are trying to achieve through Amendment 13. I agree that it is vital that care leavers have the financial resources and support that they need. However, I think that we need to balance this with making sure that we do not unintentionally lower our aspirations for care leavers. Although noble Lords are right to say that care leavers are vulnerable groups, I believe that we would do them a disservice if we did not encourage them into work, as we do with other young people. The real key to helping care leavers is to promote their life chances by supporting them in accessing and staying in education, employment or training in the way that Jobcentre Plus already does, or through the 2nd Chance learning scheme or priority access to the Work Programme. More help and support will be available to care leavers through the new youth obligation scheme and expanded universal support.

I met the noble Earl, Lord Listowel, earlier today, which helped greatly in clarifying and understanding his issues of concern regarding benefit sanctions. I would like to meet him again to discuss his concerns about this further but, before doing so, I will speak to Ministers to see whether there is scope to apply a less stringent sanctions regime for care leavers.

I would also like to draw attention to the care leaver covenant, which will provide a way for government at the national level to make a commitment to support care leavers. Central government departments will be able to set out and update their distinct offer to care leavers. I believe that this will be the most appropriate way to clarify the role of central government departments in supporting care leavers, rather than setting out a “national offer” in legislation. We will announce more details about how departments can sign up to the covenant in the new year.

The noble Lord, Lord Warner, asked about the new Government’s intentions. Noble Lords will be aware that, as part of the Keep on Caring strategy, we are considering our care leavers strategy and how to ensure that care leavers have the financial support they need. I remind noble Lords that this is a programme for the whole Parliament and we will continue to consider these issues. In addition, as the noble Lord will be aware, our new Secretary of State is prioritising social mobility, and she has recognised that improving the outcomes of care leavers is an important part of that agenda.

Finally, many noble Lords have talked about Jack’s experiences while in care. My officials have also heard from Jack and have organised some work experience for him in the department. We continue to talk to him and to listen to his experiences.

In the light of the points I have made, I hope that the noble Earl will feel reassured enough to withdraw his amendment.

My Lords, I thank the Minister for his reply and I thank all noble Lords who have taken part in the debate: the noble Lord, Lord Watson, the noble Baroness, Lady Bakewell, the right reverend Prelate the Bishop of Chester and other noble Lords. I appreciate their contributions.

I am grateful to the Minister for his interest, his sympathy and his offer of a meeting, particularly to discuss sanctions. However, I am most concerned that this amendment may be lost if not agreed today.

Listening to the debate, I particularly thought of the recent report from CoramBAAF which looked at the rates of teenage pregnancy among young women in care and leaving care. It pointed out that they are three times more likely to become pregnant and that, when they do, they are more likely to keep the child because they are looking for someone to love them. They want to give birth to and hold on to the child and have the love of the child. In this case we may often be talking about young families coming out of care as well.

We have to do more to break the cycle of young people leaving care and so often falling into debt and financial hardship, not being able to make the most of the opportunities that the worlds of training and work have to offer. This is fundamentally about fairness and pulling out all the stops to help care leavers achieve their full potential.

Before I conclude, I want to say how glad I am to hear that the Minister has found a work placement for Jack. I look forward to hearing how that develops. However, I am afraid that I must beg leave to ask the opinion of the House.

My Lords, I thank noble Lords for their interventions on Amendments 22, 23, 25 and 26, which concern Clauses 4 to 6 about promoting the educational achievement of previously looked-after children. I am grateful to the noble Baronesses, Lady King and Lady Walmsley, and the noble Lord, Lord Alton of Liverpool, for these amendments, which would require local authorities and schools to also promote the educational achievement of children adopted from care outside England.

Government policy has been clearly focused on continuing to support very vulnerable children who were looked after by our care system before starting new lives through, for example, adoption. Making a commitment to continue to help them, and the wonderful parents and guardians who give them a secure and loving home, remains a top priority. Support to succeed in education is an important element of this because we know that there is an attainment gap to address.

I understand that some children adopted from outside England will have been in an equivalent form of care prior to adoption and that they, too, are vulnerable. This is in addition to moving to a new country and a new culture. The Government have acknowledged this by extending access to the adoption support fund to these children and their families so that they, too, can get access to much-needed therapeutic services. The Government would like to do more for these children and agree with noble Lords that extending the remit of Clauses 4 to 6 to require local authorities and schools to also promote their educational achievement would be a positive step.

There are, however, a number of important practicalities to consider: for example, how we define eligibility and how a parent proves eligibility. This is because there is much variation between the care systems of other countries. I hope that noble Lords will agree that it is important that we ensure that the eligibility criteria closely match the criteria for children in this country in order to come within the scope of Clauses 4 to 6. As I said, the Government will table a government amendment to this Bill in the other place to bring children adopted from care outside England within the scope of Clauses 4 to 6.

I am also grateful to noble Lords for their Amendment 28, which proposes a new clause to extend existing educational entitlements given to previously looked-after children in England to children adopted from care outside England. These entitlements include priority school admission in the early years and the pupil premium plus. None of these entitlements is provided for in primary legislation so it would not be appropriate to consider this amendment for inclusion in the Bill. The Government will, however, give full consideration to the position of these children when reviewing these policies.

I am grateful to the noble Earl, Lord Listowel, and the noble Lord, Lord Ramsbotham, for this amendment and for raising the very important issue of children being placed at a distance from their home authority.

I recognise that the amendment seeks to improve safeguards and access to services for children placed outside their home authority. I reassure your Lordships that there are already significant safeguards in place that ensure children are placed out of area only when it is in their best interests and, importantly, that appropriate agencies are notified. Most crucially in relation to this amendment, local authorities are already required to notify the host local authority and health services when making out-of-area placements under Regulation 13 of the Care Planning, Placement and Case Review (England) Regulations 2010. This also requires the host local authority to be given a copy of their assessment of needs and care plan. Much of the information this amendment seeks to have included in out-of-area placement notifications is already legislated for, because the care plan already contains it or it is in statutory guidance. We have issued guidance that contains a model notification for out-of-area placements to help guide authorities, which includes the key information about the child. Personal education plans should identify any statement of educational needs or any education, health and care plan. Placement plans must include details of how welfare will be promoted and safeguarded.

I note noble Lords’ desire to ensure the police are made aware of children placed in their area and given their care plans so that they can help support these vulnerable children. We have already amended the regulations so the police can access the addresses of children’s homes in their area, enabling them to form positive relationships with children’s homes and to be more aware of children placed from other areas. I again sympathise with the intent behind providing the police with children’s care plans, but these plans contain deeply personal information, and children in care have, as part of previous government consultations, expressed concern about police access to less sensitive information. Children absolutely need to be protected, but this must be balanced with protecting their privacy.

We shall consider the Wales protocol and how it could be helpful to local authorities in England. The noble Lord, Lord Ramsbotham, raised the point of unaccompanied asylum-seeking children being placed out of area. They will be looked-after children under the Children Act, and so will be subject to the existing duties placed on local authorities in that Act and under the care planning regulations. The local authority must therefore give notification when a child is placed out of area. In view of the strong safeguards and notification requirements already in place regarding out-of-area placements, I hope that the noble Earl will feel reassured enough to withdraw the amendment.

My Lords, I am grateful to my noble friend Lord Ramsbotham for adding his name to this amendment and to the noble Lord, Lord Hunt of Kings Heath, for his support. I am also grateful to the Minister for his careful reply, which I will examine with care but to a large extent find reassuring. It is good to be reminded of the important steps the Government have taken in recent years to protect children placed out of their local authority area better. He refers to the fact that there is now a duty for police forces to be told of the whereabouts of children’s homes in their area, which is an important step forward.

However, as I think the Minister appreciates, there is still considerable concern about the numbers of children being placed outside their own local authority’s care. In March 2015, 37% were placed outside their local authority. Clearly, these are more vulnerable children, and it might be helpful to look at some examples of good practice to reinforce the improvements the Government have made so far. For instance, the Children’s Society has an example from the Greater Manchester Combined Authority which the Government might wish to look at, and I will send the Minister information on that. I am grateful to him for agreeing to look at the Wales protocol and beg leave to withdraw the amendment.

I was about to say something about data which I hope will satisfy the noble Lord. If it does not, I shall be very happy to discuss it with him further. Local authorities are required to provide data on care leavers aged 19, 20 and 21. From October this year, we will also publish data on care leavers aged 17 and 18. We are also now able to link with datasets held by the MoJ and HMRC, which will allow us to track care leavers’ longer-term outcomes. However, I shall be happy to discuss this further with the noble Lord.

The noble Baroness, Lady Pinnock, asked about funding. We do not believe that Clauses 1 and 2 represent new burdens on local authorities. However, as I have already said, we recognise that extending personal advisers to all care leavers up to the age of 25 will have financial consequences, and we have made a commitment to provide new burden funding to meet these extra costs. Our initial estimates are based on our experience in Trafford, which is a very high-performing local authority, and we will publish the figures shortly.

My understanding is that Amendment 98A, in the name of the noble Baroness, Lady Massey of Darwen, would extend the higher rate of universal credit to single-parent care leavers. The benefits system recognises the special needs of care leavers. However, in the current system there is considerable complexity around the rates for young people, with some differences between benefits. The structure of age-related rates in universal credit is much simpler than the benefits it replaces, with just four rates of the standard allowance compared with, for example, 15 in employment and support allowance. These age-related standard allowance rates are now established in universal credit.

Making changes such as those set out in this amendment would replicate some of the complexity that we are seeking to remove. Rather than handing out money to young people and expecting them to fend for themselves, universal credit seeks to support vulnerable young people and parents to stabilise their lives and find work. For this reason, the DWP extended second-chance learning from age 19 to 21. This allows care leavers to claim income support and housing benefit if returning to full-time, non-advanced education to make up for missed qualifications. In addition, single-parent care leavers who are working will be able to access help with 85% of their childcare costs up to the cap.

With that information, I hope I have reassured noble Lords that care leavers will receive and be able to access the support they need, and I hope that the noble Baroness will feel able to withdraw her amendment.

My Lords, I am grateful for the Minister’s response and particularly for what he said about keeping an open mind and thinking further about the degree of the burden on local authorities from keeping in touch with and being proactive towards young people up to the age of 25. What he said about guidance on being proactive was very welcome. Are there currently issues regarding those up to the age of 21? Under the current duty, do local authorities express concern that the duty sometimes causes them to expend resources unnecessarily? Do young people feel a bit harassed by the current system? Otherwise, I am not clear why one should treat those over the age of 21 any differently from those under 21. If there are no current issues, I am not sure why it should be an issue to transfer the provision to under-25s. However, I am sure that that can be answered in subsequent discussions and, as I said, I am grateful to the Minister for his response.

I am grateful to the noble Baronesses, Lady Walmsley, Lady Bakewell and Lady Pinnock, the noble Lord, Lord Ramsbotham, and the noble Earl, Lord Listowel, for these amendments and their comments, and for the comments of the noble Baroness, Lady Wheeler. I am grateful for their brevity. In that regard and without wishing to be rude, I know we are debating important matters but if we are to get through this Bill in four days in Committee I would be grateful if noble Lords could come back on Wednesday in that vein.

First, I will respond to Amendment 135, on the UN Convention on the Rights of the Child. I offer my reassurance that the Government remain fully committed to this important convention. The recent report by the UN Committee on the Rights of the Child on the UK recognised the progress made by the Government in protecting and enhancing children’s rights over recent years. The Government are unconvinced that putting a statutory duty to pay due regard to the convention on Secretaries of State or other bodies would have a real impact on children’s lives. In 2010, the coalition Government made a Statement to Parliament stating that the Government would give due consideration to the UNCRC when making new policies and legislation. This Government maintain that commitment.

Legislation is already assessed to ensure compatibility with the UNCRC. A rigorous child rights impact assessment was conducted on this Bill, for example, and shared with the Children’s Commissioner and the Joint Committee on Human Rights. Similarly, at a local level we believe that putting additional duties on public bodies is not the right approach to either raise awareness of the UNCRC or to change the way decisions are made. More targeted approaches through guidance and support to specific professionals or related to specific aspects of children’s rights are more effective. In 2013, for example, we issued statutory guidance to DCSs to have regard to the general principles of the UNCRC and to ensure that children are involved in development and delivery of local services. The Children’s Commissioner’s primary function is to promote and protect children’s rights and ensure that they are properly understood, including by children themselves. She raises awareness and ensures that their views are brought to the attention of decision-makers at both local and national levels.

Turning to reporting mechanisms, under the UNCRC process we are required to provide a full UK report on a five-yearly cycle. The reports are publicly available on the UN website. Any additional requirement would risk duplicating our existing obligation. I recognise the value of impact assessments carried out on legislative proposals where they affect children, as referred to by the noble Baroness, Lady Bakewell, and the noble Earl, Lord Listowel. We carried out a very full analysis of the Bill’s impacts on children’s rights, interests and families. The Government are committed to giving due consideration to children’s rights on matters such as this, as I said. Of course, there are aspects of children’s rights where we can and should do more. I assure noble Lords that we are considering the recommendations of the UN Committee, published earlier this month. We will respond to the concluding observations this year.

Amendment 75 proposes that a similar duty is put on the Secretary of State to promote the rights and well-being of children and young people who are looked after or care leavers. We believe that introducing such a duty is unnecessary. This is due to the duties which the Secretary of State already owes and the commitments that the Government have already made. The Children Act 1989 sets out the legal principle that the child’s welfare shall be the paramount consideration in decisions regarding children in the social care system. The guiding principle of any decision taken in relation to looked-after children will be to have their well-being as the primary consideration.

Section 7 of the Children and Young Persons Act 2008 obliges the Secretary of State to promote the well-being of all children in England and empowers her to take action to promote the well-being of care leavers. Clause 1 introduces the corporate parenting principles. The first principle sets out that a local authority must, in carrying out functions in relation to looked-after children and young people, act in their best interests and promote their health and well-being. We hope that this will reassure the noble Baronesses.

Turning to the social justice premium grant, the Government fully support the principle behind Amendment 76. As a Government, we are committed to improving the life chances of care leavers. Our forthcoming care leaver strategy will set out our ambition that care leavers should have the same opportunities, experiences and life chances as other young people. The best local authorities, such as Trafford, already provide additional support to care leavers to improve their life chances and to narrow the gap between them and their peers. Trafford ring-fences apprenticeship opportunities for care leavers and gives them free access to leisure centres.

Our goal is to see more local authorities providing excellent services that improve the life chances of all care leavers. This Government are committed to an all-out assault on poverty and improving chances for all children, regardless of their background and past experiences. Our forthcoming life chances strategy will set out our plan for transforming the life chances of disadvantaged children and their families and for tackling deep-rooted social problems so that no one is held back or prevented from making the most of their lives. In view of the measures that we have already taken to promote and protect children’s rights, particularly for children in care and care leavers, I hope that noble Lords will feel sufficiently reassured not to press their amendments.

My Lords, I thank the Minister for his reply and for what he said about child impact assessments on child-related Bills. But is it not even more important in Bills about housing and welfare that there are such child impact assessments? Those Bills have a huge impact on children and their families and one does not get the sense that the impact on children is really thought through. American academics who come to this country talk about how important housing is to children and bewail the fact that there does not seem to be awareness at senior levels of government of that necessary connection.

With respect to the lawyers present—including myself from many years ago—I will not comment on the last point. We are trying to set out principles and not put local authorities under any more duties than necessary or into any kind of straitjacket. But the noble Baroness makes a point about a number of duties and we will go back and look at this in more detail.

I thank the noble Lord for answering my point about siblings. I look forward to the debate on the amendments. I also thank him for his clear reply to the important point made by the noble Baroness, Lady Armstrong of Hill Top. He said that the care plan process must involve parents. However, the experience so often is that parents do not get the help they need with their addictions or mental health support. So I hope that the noble Baroness will consider bringing back an amendment on this on Report. In the interim, I look forward to having discussions with colleagues to get their advice on whether anything more can be done to ensure parents get the support they need.

Before the noble Baroness withdraws her amendment, I want to say how very pleased I was to hear that Dr Peter Fonagy, director of the Anna Freud Centre, an institution with such an illustrious history in the treatment of abused children, is being appointed to run a working group looking at how mental health professionals can better work with children in care. The Minister might consider taking to Dr Fonagy, at the beginning of his research, the concern about children’s homes. In his report in the 1990s, Choosing with Care, the noble Lord, Lord Warner, highlighted the fact that best and widespread practice on the continent had psychiatrists or relevant mental health professionals working in partnership with staff in children’s homes, as much to support staff as in meeting the mental health needs of these children. Only about half of our children’s homes have a connection with mental health professionals in that way.

This issue is so important. Although there has been progress in terms of the qualifications of staff in children’s homes, still we have a long way to go. They need the best mental health professionals supporting them. I would be most grateful if the Minister could flag that up to Dr Fonagy.

My Lords, I am grateful to the noble Baronesses, Lady Bakewell and Lady Howarth, the noble Earl, Lord Listowel, and the noble Lords, Lord Watson and Lord Hunt, for their amendments in this group, which focus on improving the life chances of children in care and care leavers and helping them to avoid poverty and debt. I share the concerns raised by noble Lords and can confirm that reducing poverty and debt will be one of the key themes in our forthcoming Care Leavers Strategy, which we plan to publish shortly.

Amendment 26, tabled by the noble Lords, Lord Watson and Lord Hunt, seeks to add a new corporate parenting principle to Clause 1 requiring local authorities to promote early intervention. I agree with the noble Lords that we should support measures that enable professionals to identify and intervene in cases where children are at risk of poor outcomes. We have launched a number of initiatives to encourage early intervention and have backed this up with increased funding, with government spending on early years and child care rising from £5 billion in 2015-16 to over £6 billion by 2019-20. Early intervention and support should benefit all children, not only looked-after children or those on the edge of care. Our plans for the early years demonstrate our clear commitment to universal services such as free childcare, alongside targeted support for the most vulnerable.

Amendment 27, tabled by the noble Baroness, also seeks to add an additional corporate parenting principle to Clause 1 which would require local authorities to have regard to the need to protect children in care and care leavers from poverty and destitution. We know that care leavers often face challenges with debt. We have heard from them that they worry about how they will be able to pay their rent and that they often feel they lack the relevant budgeting skills to be able to manage their money effectively. We have heard several examples of that today.

I recognise the importance of the issues raised by the noble Baroness. Care leavers already receive support to help them to manage their finances but all young people should receive financial education. I am pleased to confirm that we will include further information in the guidance that we plan to publish under Clause 1 on how, by working within the spirit of the corporate parenting principles, local authorities can help care leavers to avoid poverty and debt. We should cover in the local offers the importance of financial education and we will cover this in our guidance.

During the last Parliament we introduced junior ISAs and encouraged all local authorities to increase the leaving care grant, which care leavers can use to furnish their first home, to £2,000 or more, but we need to back that up with educating them on how to manage those monies. We also provide financial support to enable care leavers to access and participate in education, to which I referred earlier.

Turning to the amendment of the noble Earl, Lord Listowel, I understand that its effect would be to extend the category of persons eligible for income support to all care leavers up to the age of 25 and to extend the exemption to the local housing allowance shared accommodation rate from 22 to 25, when their entitlement to housing benefit is assessed. I have consulted with honourable and noble Members elsewhere in government about the noble Earl’s amendment to relax entitlement conditions for receipt of working tax credit for care leavers working at least 30 hours per week. It has been a condition of entitlement to the working tax credit since its introduction in April 2003 but, other than for individuals, including care leavers, who are responsible for a child or who are disabled, a person claiming working tax credit must be aged 25 or over and work at least 30 hours per week. There are already a number of existing provisions within the benefits system aimed at helping care leavers, and I would be happy to write to the noble Earl setting these out in more detail.

On the noble Earl’s suggested change to housing benefit, it is right to say that the rate of housing benefit to which care leavers are entitled changes when they reach the age of 22 and they move to the shared accommodation rate. However, as he will be aware, discretionary housing payments continue to be available via local authorities if additional financial help with housing costs is needed. The Government have already committed £870 million in discretionary housing payment funding over the next five years. Noble Lords will appreciate that this is a significant sum of money to help those who are vulnerable and require additional help with their housing costs.

The amendment tabled by the noble Baroness, Lady Howarth, supported by the noble Baroness, Lady Pinnock, would amend the Local Government Finance Act 1992 so as to disregard care leavers from liability for council tax up to the age of 25, ensuring that dwellings occupied solely by care leavers are exempt from council tax. This amendment would provide a blanket exemption for all care leavers under the age of 25 irrespective of their personal circumstances or their ability to pay. If we did so without taking their ability to pay into account, we could find that a lower income tax payer could be supporting a care leaver with a higher income. I am sure that is not the intention behind the amendment.

The Government have been clear that such decisions are much better taken at local level instead of mandating exemptions or discounts from the centre. We have given local councils wide powers to design council tax support schemes, including scope for discounts for particular groups of people. It is therefore a matter for local authorities, which must consult with local communities on their proposals. Concerning the corporate parenting principles, they would impact on all local authority functions, including those relating to council tax or housing, and the guidance will set out how local authorities must ensure that they take holistic decisions in relation to looked-after children and care leavers.

I turn now to Amendment 50, tabled by the noble Lords, Lord Watson and Lord Hunt, which would place a new duty on local authorities to provide suitable accommodation for all care leavers in their local authority area until the age of 21. There are already a range of measures in place that help young people secure suitable accommodation when they leave care. The government’s statutory guidance states that when a young person leaves their care placement the local authority must ensure that their new home is suitable for their needs and linked to their wider plans and aspirations.

I would expect a local authority’s leaving care team to work closely with housing services to help care leavers access supported lodgings or semi-independent accommodation—or, if they are ready, secure and maintain an independent tenancy. Where care leavers struggle to find and maintain accommodation, they have a priority need within the homelessness legislation until age 22, and they are also a priority group within statutory guidance on the allocation of social housing.

We have also introduced, as the noble Earl will be aware, Staying Put to enable young people to remain living with their foster carers where that is what they both want. This provides both suitable accommodation and the sort of gradual transition to adulthood that is enjoyed by the majority of young people. We want to maximise the number of young people who can stay put with their former foster carers and I am delighted—and I am sure that the noble Earl, Lord Listowel, will be pleased to hear—that for the year ending March 2015, almost half of those who were eligible to stay put did so.

The noble Lord, Lord Watson, raised the issue of Staying Put for those care leavers who have been placed in residential care. We are committed to helping all young people successfully move to adulthood but we would need strong evidence before introducing Staying Put on any alternative residential care. Sir Martin Narey’s independent review into children’s homes will set a direction for how we improve children’s experience of residential care, including transition to adulthood. We will publish this report shortly. We have also been trialling innovative approaches to providing care leavers with suitable accommodation. We are also keen to test new ways of supporting those who leave residential care and will set out our plans on this in the forthcoming Care Leaver Strategy.

Finally in this group I will respond to Amendment 80 tabled by the noble Baroness, Lady Howarth. The amendment would place a new duty on local authorities to appoint a person to make advice and information available to previously looked-after children with a view to improving their life chances. This Government share the noble Baroness’s belief that society should do all it can to ensure that a difficult start to a child’s life does not set them on an inevitable path to poor educational outcomes, homelessness or imprisonment. However, we do not consider that it is necessary or desirable to place a new burden on local authorities to appoint officers to support these children and young people.

There is a clear difference between this group of children and looked-after children or care leavers for whom the local authority is their corporate parent. These previously looked-after children will have parents or persons with parental responsibility who can provide a stable and loving family, support them to do well at school and provide extra help through the transition into adulthood and living independently. Most local authorities also already provide specific ongoing support for those who leave care under an adoption, special guardianship or child arrangement order. To help them in this role, we have already extended the adoption support fund to children who leave care under a special guardianship order. This is helping to ensure that their parents and local authorities are able to provide them with the therapeutic services they need to overcome their early disadvantage.

The noble Baroness, Lady Lister, asked me to take back these points and discuss them with my colleagues across government, which I will do, and, in view of the points that I have made, I hope that the noble Lords will feel sufficiently reassured to enable them to withdraw their amendment.

My Lords, I thank the Minister for his helpful replies. They give us plenty of food for thought. I am clear that he has given very careful thought to these issues and I am grateful to him for that. It was very encouraging to hear that half of those young people eligible for Staying Put have taken up the offer. Of course, we both want it to go further, but it is encouraging. Staying Put is a very important step forward. I am glad that the Minister is listening to young people in care. We talked about that earlier. Listening to young people with experience of Staying Put is a very salutary, encouraging experience.

There is a concern about ISAs. The Minister may correct me, but I think that they represent a large sum of money being given to very young people. There is a risk that they may not use it well and that they will not be supported in using it. There is also a concern about the sums given by local authorities to care leavers. Some social workers will insist on receipts and manage the money carefully while others will just give them the money. At best the young people may waste that money, but some may use it to their own detriment. Perhaps the Minister could write to me to clarify what support there is for young people leaving care to manage those sums well. I would much appreciate that. I also thank him for his response.

I thank the noble Lord for saying that. That is a very important point which, with his health background, he would raise. I am simply trying to give an example of a possible candidate and how he might be processed by the system. But from what I heard from the Minister just now I am very much reassured that most of these academy sponsors will be experienced and will have a track record, and we can have confidence in them because of that.

If the noble Earl is contemplating making an academy sponsor application, I am sure we would be happy to guide him through the process, but as the noble Lord, Lord Hunt, says, if he is serious about restricting play space, we can save him the bother. I believe a visit is being organised shortly to King Solomon Academy, which is a remarkable school. From memory, I think the statistics are that about 60% of children get free school meals, 90%-plus get five A*s in English and maths, and more than 75% get an EBacc. The noble Earl will have formulated his views on academies and we can discuss his pending sponsor application in more detail.

My Lords, I am grateful to the noble Lord for allowing us this opportunity to have a clause stand part debate.

Of course, it would be much better if children were not taken into care in the first place. We need to think about what we might do to support families better so that these circumstances do not arise—for instance, what we can do to ensure that more fathers stick with their families.

Many boys grow up without a father in the family. Obviously, there are circumstances where parents have to separate, but I am sure that we could do more to enable parents to stick together and to help young men who grow up without a father in the family experience what it is like to have a father through providing mentors and positive male role models. This is a huge challenge for us. Currently, 22% of our children grow up without a father in the home. However, that figure will rise to more than 30% in the next 10 or 15 years, according to the OECD, so we will overtake the United States. Many boys will grow up without a father in the family. How will they know how to be a father if they have not had one themselves? As a society, we need to think what role models and mentors we can provide for these young men.

It is also important to think about the impact of the huge cuts on local authority funding over the last five years or so. I declare an interest as a vice-chair of the Local Government Association, which has expressed concern that we have reached the point where any further cuts will inevitably cut into services for adults and children. I sponsored a meeting recently with a charity that provides excellent support to families—for instance, providing an Arabic-speaking woman to support Arabic-speaking mothers in London who would otherwise be very isolated. That body was on its last legs and said, “You cut us any further and this service will disappear”. It costs a lot to regenerate that service, so it will be lost to those families.

Cuts have also been made to children’s centres. One understands the pressures the Government have been under, their achievement on the economy and on many other levels, and the huge importance of the increase in employment in terms of benefits to families. However, we have to keep in mind the removal of family support services as a result of the cuts to local authorities.

I think that a fairly recent ruling has led more courts to choose to go down the special guardianship line rather than the adoption line. Perhaps the Minister will write to me on the direction of travel in that area. That may be the reason why new regulations on special guardianship are being introduced. I know there are concerns that special guardianship may on occasion be granted too easily.

I agree with what the noble Lord said about the pathways to permanence being many, and adoption being just one of them. I pay tribute to the noble Lord, Lord Nash, and his ministerial colleagues for introducing the “staying put” amendment on the last education Bill, thereby allowing all young people leaving care stability in circumstances where they wish to remain with their foster carer, and their foster carer wishes them to remain, to the age of 21.

Another issue relates to adolescence. Many children are adopted at a young age and from when they enter primary school until the age of about 10 or 11 they may be quite manageable and easy to deal with. The emotional tantrums and outbursts of the under-fives tend to dissipate. However, when they become teenagers and enter adolescence, all that stuff can re-emerge, so services need to cater for that. I would be interested to hear from the Minister about outcomes for adopted children.

I was speaking to a researcher recently and she said that the issues around teenage pregnancy for adopted children are not that far removed from the issues experienced by young people leaving care. That suggests that some issues are important still even with the benefits of a more permanent experience through the adoption process. It occurred to me that one might think of allowing young people who are aware that they have been adopted to have entry to the care-leaving system. This would give some kind of support for young people growing up in adopted homes through the care-leaving system. I am not sure that that would work but it did occur to me. I will be interested to hear from the Minister what information he has on the outcomes for adopted children, particularly during adolescence and up to the age of 21 or 22.

As I say, I am grateful to the noble Lord for this opportunity to have a more wide-ranging debate on the adoption procedures. I look forward to the Minister’s reply.

My Lords, Amendment 33A seeks to ensure that adoption agencies match children with the right parents for them, regardless of which agency recruited and approved those parents. The noble Lords, Lord Watson and Lord Hunt, also oppose the inclusion of this adoption clause within the Bill.

Clause 13 introduces powers to direct one or more local authorities in England to have certain adoption functions carried out on their behalf by another adoption agency in order to create regional adoption agencies. Regionalising adoption is necessary if we are to remove delay from the adoption system and ensure all adopted families have access to the support services they need wherever they may live.

We have already made significant improvements to the adoption system, with record numbers of children finding permanent loving homes, but there is still more to do. The system remains highly fragmented, with around 180 different adoption agencies currently recruiting and matching adopters. We do not think such a localised system can deliver the best service to some of our most vulnerable children. This is starkly illustrated by the almost 2,500 children who are still waiting for their forever families despite there being enough approved adopters across the country. Forty-five per cent of these children have been waiting longer than 18 months.

That is why we are proposing the measure in this Bill to increase the scale at which adoption services are delivered. Actively encouraging local authorities to join forces and work together will give regional agencies a greater pool of adopters, enabling them to match children more swiftly and successfully with their new families. It will also ensure vital support services are more widely available as these will be planned and commissioned at a more effective scale.

The noble Lords raised important issues about how decisions on matches between children and prospective adopters are made. The amendment seeks to remove the practice of sequential decision-making, where agencies seek first to place children with adopters they have recruited and approved before looking more widely. I appreciate the intention behind the amendment and can reassure the Committee that one of the primary motivations in introducing regional adoption agencies is to prevent this sequential practice and to encourage agencies, both local authorities and voluntary adoption agencies, to work much more closely together, always putting the interests of the children first.

The Government will also continue to invest in national infrastructure to enable matches to be made between children and adopters from different regions. We will also continue to use data to bear down hard on any delay so that regional adoption agencies are incentivised to find the right family for a child as quickly as possible, regardless of which agency recruited and approved the family in question. The proposals in the amendment would be difficult to make work in practice and could have unintended consequences.

Effective agencies will plan their pipeline of adopters so that they match well with the children coming through the system. This means links can be made early in the process to avoid any delay. This good practice would be difficult to maintain if the agency was discouraged from shaping its own recruitment to match the needs of the children it knows are coming through the system. If we break the link between the children waiting and the adults being recruited, the opportunity for strategic targeting of recruitment will be weakened.

Furthermore, if agencies have to consider all adopters available nationally in every single case, it is likely to increase delays as they try to filter and sort a large number of potential adopters. It could also impact negatively on adopters who are considered and rejected for a large number of potential matches.

I do not think that I can add anything at the moment, but I will think about what the noble Lord said.

The noble Lord asked about the £30 million figure. This is for children in one of the following groups: children who have been waiting for 18 months or more at the time of placement; children who are aged five or over at the time of placement; children who are in a sibling group of two or more and placed as siblings at the time of placement; children who are from a BME background; or children who are disabled.

The noble Lord asked why the clause covers only adoption. If local authorities are interested in bringing together other permanent services voluntarily, they have the freedom to do so. Furthermore, they can apply to our regional adoption agencies support programme for support to create a “permanence hub” that goes wider than just adoption. More than half of the bids for which we announced funding recently are interested in going wider than adoption. However, given the specific nature of the adoption system, this legislation is in relation to adoption only. Adoption is the system where consolidation and scaling-up of services is a pressing concern.

The noble Lord was not around when we passed the Children and Families Act, a substantial piece of legislation with 177 amendments which comprehensively covered wide aspects of SEN and children in care. Had he been, I think that he would have realised that we have substantially reformed the system for children in care and SEN. His comments about the Prime Minister’s recent concerns about adoptions are ill-informed and unfortunate. The Bill does not go any wider because we have covered fostering in the Children and Families Act and taken considerable steps to improve the situation for children in care homes. The children’s homes regulatory framework underwent significant consultation and review in 2014 to enable the development of new quality standards that must be achieved for looked-after children living in children’s homes.

The Prime Minister announced on 28 October that Sir Martin Narey will lead a review into residential care for looked-after children. Sir Martin will report his findings and recommendations in spring next year. The overall purpose of the review is to set out the role of residential care within the wider care system and to make recommendations about how outcomes for children who are currently placed in residential care can be improved. Given the proportion of looked-after children who have poor mental health, it is likely that the review will explore mental health and well-being of looked-after children in residential settings.

This year, we are providing up to £4.5 million of start-up funding to support the development of regional adoption agencies. As my noble friend Lady Evans mentioned, we have already announced the first 14 projects, which involve more than 100 local authorities and more than 20 voluntary adoption agencies. However, for that small number of local authorities which prove unwilling to rise to the challenge and to get involved voluntarily, we need the power in the Bill as a backstop measure. Without it, children in those local authorities would miss out. They would continue to face unnecessary delay, which we know causes lasting harm, and miss out on the vital support that they need. I therefore recommend that this clause stand part of the Bill and I hope that noble Lords will feel reassured enough not to press their amendments.

My Lords, I was particularly interested to hear what the Minister said about Martin Narey and his work around children’s homes, which is very welcome. I endorse what he said about the quality standards for children’s homes, which are a step forward. If there is one thing that I might ask him to bring up with his colleague, Edward Timpson MP, it would be with regard to residential childcare. It is a matter of great regret that mental health and social care in children’s homes have not been embedded together from the word go. I was talking to a psychiatrist about the history of residential care in this country. We have some excellent residential care, but I am afraid that in general the quality is pretty variable in my experience.

The continentals were interested in our approach. The noble Lord, Lord Warner, published his report on staff in children’s homes, Choosing with Care, which I think came out in 1993. In the witness evidence to that inquiry the psychiatrist said that on the continent staff in children’s homes have an ongoing relationship with mental health professionals. I discovered later that they learned that from us. If we only had that ongoing partnership in all our children’s homes, we would see better outcomes and better protection for children in those homes. I am asking for a model where a clinical psychologist, who is appropriately trained, a child psychotherapist or some other mental health professional goes into children’s homes regularly—maybe once a fortnight—and speaks with the manager and staff, providing an opportunity for them to talk about their relationships with young people and how they are managing them.

In my experience that has such an effective input. This kind of work is emotionally exhausting. People talk about the turnover of staff and how they just burn out after a few years. However, if there was that kind of support, staff would be far more likely to stay. There would be a continuity of relationship, which is so important, and experience would be built over time. Staff members would have years of experience of children with complex needs and they would know the right things to do. We should make sure that all children’s homes have that close support from CAMHS which would make all the difference in this area. I am glad to hear from the Minister of Martin Narey’s review.

Before the Minister responds, perhaps I may say how pleased I am to be reminded of the weight that the Government are placing on professional judgment. I was pleased to read in the Grand Committee proceedings and in the media that they are introducing this new college for school teachers, which will recruit, train and retain the very best teachers to send out to the schools that need them most. That sort of initiative is very welcome. I also welcome the Government’s drive to build trust in head teachers, recognise their expertise and give them as much authority as possible. My concern is that, because of the way in which the Government have set this up, they are putting huge pressures on head teachers to perform in a certain kind of way—which is to have good academic performance so that one will do well as a head teacher if one jumps through certain hoops, which is what head teachers will try to do. That distorts what they might do.

For instance, yesterday the noble Baroness, Lady Massey of Darwen, organised a meeting with children from pupil referral units and hospital schools. We learned that a key issue for those young people is reintegration into mainstream education after their healthcare is completed, or whatever else it might be. A disincentive on the part of head teachers to accept them is that they are not likely to do so well academically. A young boy or girl coming out of hospital who has been away from school for quite some time is not likely to perform as well academically and there might be some hesitation on the part of the head teacher to take them back. I warn the Minister that I may well table an amendment at the next stage of the Bill to help us deal with the particular issue of children who have been out of school for some time and suggest that their data should be excluded from the performance statistics. A head teacher should not have to worry that she will be seen as failing because of a child who has been out of school and is not achieving academically as well as the others. As I say, I may well bring forward an amendment on that.

My Lords, I will speak to Amendments 16, 17, 21 and 26 to 29, tabled by the noble Lords, Lord Addington, Lord Watson, Lord Hunt and the noble Baronesses, Lady Massey and Lady Bakewell. I will try to keep my remarks to the point but, before doing so, I will respond to a couple of accusations made by the noble Lord, Lord Hunt. The first, that we are being dishonest, is quite an accusation and I would take great objection to it if I thought he really meant it. He said that it is dishonest that we should just pass a law turning every school into an academy. Maybe if he feels that is something we should do, he would like to bring an amendment to that effect. I made it clear last week in response to the noble Lord, Lord Knight, and again in a letter this morning which I hope he has now received, that the default position for a coasting school is not to become an academy. I suspect that in many cases they may well be able to improve sufficiently on their own or with limited support. I hope I have made that absolutely clear.

Secondly, there was a suggestion that I never mention maintained schools. That is partly because the Bill is about academies and I am trying to keep to the point. Of course there are many successful maintained schools and I pay tribute to them. The noble Baroness, Lady Jones, took me on a most enjoyable trip to Morpeth School in Tower Hamlets, which I was particularly impressed with. I was struck by its approach to CPD.

I accept the importance of the matter, and I was delighted to see the ECCE survey, which showed that 98% of parents were “happy” or “very happy” with the services provided by their children’s centre. I know that the Labour Party likes to hark back to a golden age of Sure Start, but in 2009 the National Audit Office reported that children’s centres then were failing to reduce inequality and many were unviable, and Ofsted reported at the same time that half were not reaching out to vulnerable families. It is essential that we reach out to vulnerable families and that the facilities are tailored in the most flexible way to reach the families who need them.

Of course I empathise with the practical challenges that such families face. Housing authorities and children’s services work together locally to ensure that the needs of children in homeless families are met. This should include the role that local children’s centres can play in supporting such families. The Housing Act places a duty on authorities to co-operate with social services in situations where children may be made homeless intentionally or may be threatened with being made homeless intentionally.

My Lords, the noble Baroness referred to the national living wage. I believe that two former advisers to the Prime Minister recently endorsed a move towards the living wage. Clearly, this Bill would be that much more effective and there would be much more incentive for people to take what is offered in it if we moved to a national living wage. What current position do the Government take towards the gradual introduction of a national living wage?

In Amendment 39, the noble Baroness, Lady Pinnock, seeks assurance that the Government will monitor and report on the impact of the entitlement. She spoke with passion about the importance of supporting low-income working families with the cost of childcare, which is the subject of today’s debate, and I will confine my remarks to the subject of today’s discussion. I agree that it is extremely important and must be kept in mind at all stages of policy development in the early years.

The Government have ably and amply demonstrated their commitment to supporting low-income working families with the cost of childcare and to improving the educational outcomes of all children, particularly those from disadvantaged backgrounds. As my noble friend and I have set out in this debate and in previous discussions, the Government have committed to increasing childcare support within universal credit by around £350 million to provide 85% of childcare costs from 2016 where the lone parent or both parents in a couple are in work. The Government have introduced an entitlement to free early education for the most disadvantaged two year-olds, while the early years pupil premium will provide more support to improve outcomes for disadvantaged three and four year-olds.

The Government have demonstrated their commitment to understanding the impact of the provision of free childcare through previous projects such as the Effective Pre-School, Primary and Secondary Education project and the new longitudinal study of early education and development, as my noble friend and I mentioned previously. The Government also collect a range of data on the take-up of the existing entitlements, including the number of children taking up a place. The most recent data were published on 25 June. They reflect the position in January of this year and are extremely encouraging. As detail of the new entitlement is developed further, we will consider what further data should be collected to enable effective monitoring of the new entitlement.

The Government recognise the benefits and importance of evaluating the impact of significant policies such as this but do not believe that it is necessary or appropriate to legislate for the production of a report or to define the timeline and content of such a report. I therefore urge the noble Baroness, Lady Pinnock, to withdraw her amendment.

I am not entirely sure that the noble Earl is right about declining numbers; I will clarify that for him. I think that provision has in fact been increasing, and we have been making every effort to expand that high-quality provision. We know that it is of the highest quality and tends to have higher-quality staff. We have reduced the bureaucracy to enable primary schools to open nurseries, and we have now allowed free school applicants to apply to open nurseries attached to their primary places. We have been working with a number of schools that are already doing this to learn from the practice so that we can share that practice with other primary schools that want to open nursery provision.

The noble Baroness feels very strongly about it, but the Labour Party had 13 years to make it statutory and did not do so. We are currently considering the findings of the Education Select Committee report. We have launched a communications campaign to promote the selection of high-quality resources via our social media sites. They include PSHE Association programmes of study, “Sex and Relationships Education for the 21st Century” and various other products.

Will the Minister praise the previous Government’s success in reducing teenage pregnancy to its current low, while recognising that compared to the continent we are still well behind? Will he keep a very open mind about this issue of a statutory requirement for PSHE? After all, the Education Select Committee in the other House recently recommended in its report that there should indeed be statutory provision in this area.

I do not recognise the example to which the noble Lord refers. I would be grateful if he would write to me as regards his specific example. The pressure on pupil places has been considerably relieved by the amount of money that this Government have spent on them, but I would be particularly interested to hear about this case.

My Lords, is the Minister concerned to hear that a head teacher said at a recent seminar that she was having to pay rent arrears and pay for food in her impoverished community to enable children to get to school, to be able to concentrate and to do well? She was embarrassed to do this but she felt that she had to.

Of course I am concerned about the point that the noble Earl makes. We have introduced universal free school meals particularly to enable pupils who come from the most disadvantaged backgrounds to be ready to learn when they arrive at school.

It has always been the case in the recent past that we have appeared to have a shortage of head teachers. We are increasingly seeing younger heads coming forward and academy chains growing their own senior leadership teams. Teaching schools are now, of course, also playing an increasing part.

I think I have just said that I believe that the department has a very tight grip on the central management of academy chains, which, as I said, are performing extremely well by and large. That is not the case with local authorities, among which there are many unfortunate failures. Nearly 400 local authority schools are in special measures and 30 have been in special measures for 18 months. As my noble friend knows, a number of local authorities have, according to Ofsted, been performing particularly poorly.

My Lords, does the Minister agree that it is a benefit that schools can work in partnership, whether through chains or other means? Can we look back at the London Challenge and the Greater Manchester Challenge to see what more can be done to help schools to work together in partnership, particularly with outstanding heads mentoring other heads?

I entirely agree with the noble Earl. The school-to-school support model, which you could say was pioneered by the London Challenge, started by the previous Government, is one that we favour over other models. That is why we focus all academy groupings on a local and regional cluster basis, whether or not they are part of chains. We think that school-to-school support is the way forward.

The noble Lord is quite right that we unfortunately see an increasing number of pupils entering primary school with very challenging social skills. Primary teachers and assistants have to spend several terms socialising them. Meals are very important, which is why we have introduced compulsory meals. On early years training, in fact we have invested substantially in early years and continue to support childminding.

Does the Question not highlight the additional challenges that certain teachers and schools have? Will the Minister assure the House that in the inspection and evaluation of schools, full appreciation of the job that teachers do and the distance that each child travels, as well as their achievement in academic league tables, are taken into account to stop demoralising teachers who work in particularly challenging areas and do a wonderful job taking children forward through their education?

The noble Earl is quite right; teaching is the most noble profession and we should at all times recognise that and constantly try to raise the status of teaching in all our lives. Teachers do a wonderful job. Our new Best 8 progress measures will track the progress of all pupils of whatever ability throughout their school careers. We think that that is very important.

My Lords, I thank the noble Earl, Lord Listowel, and the noble and learned Baroness, Lady Butler-Sloss, for the way in which they have brought this matter to the attention of the House. I also pay tribute to the late Paul Goggins, the MP for Wythenshawe and Sale East, who sadly passed away on 30 December. He was a champion for children in care and I know worked closely with the noble Earl, Lord Listowel, on a range of issues including promoting staying-put arrangements.

The noble Earl and the noble and learned Baroness made a compelling case for enabling young people to remain with their former foster carers once they turn 18 where this is what they and their foster carers agree they want.

With this year’s figures showing only a slight improvement in the numbers who have been able to stay in such arrangements, we have agreed that more action is now required. So I am delighted to be putting forward a government amendment that addresses this extremely important matter. We have consulted on our new clause with a range of voluntary organisations, including the Fostering Network, Barnardo’s and the Who Cares? Trust. I am pleased to say that they have all fully supported its wording.

Proposed new Sections 1 to 6 deal with what constitutes a staying-put arrangement, the duties placed on local authorities for the duration of the arrangement and the conditions that underpin the support of the local authority. The new clause says that a staying-put arrangement is one where the young person is someone who was in care immediately prior to their 18th birthday as an eligible child, and continues to reside with their former foster carer once they turn 18. So long as the arrangement is consistent with the welfare of the young person, the local authority will be required to provide advice, assistance and support to them and their former foster parent to support the maintenance of the arrangement. It would also be required to monitor the arrangement.

Proposed new Section 23CZA(4) explicitly says that the support provided to the former foster carer must include financial support. This is a crucial element of the new duty. These duties will continue until the former relevant child reaches the age of 21 unless either they or their former foster parent decides to end the arrangement sooner.

Local authorities are already under a duty to assess the needs of eligible looked-after children and devise a pathway plan for their transition into adulthood. The assessment process usually starts around the time of the child’s 16th birthday. The second part of the clause places a duty on local authorities to determine, at this early assessment stage, the appropriateness of working towards facilitating a future staying-put arrangement.

We will also issue statutory guidance which underpins the new duty. We have published a draft of this guidance on our website and sent it to noble Lords. We have been consulting voluntary sector organisations about the wording of the guidance and will continue to do so over the coming weeks.

The guidance sets out more detail about the types of support local authorities will be expected to provide. It also sets out how providing staying-put arrangements fits within the wider statutory duties to support young people make the transition to adulthood.

I would welcome comments from Peers in the next couple of weeks on the wording of the guidance. I hope that your Lordships agree that the amendment is a hugely positive step for children in foster care, I urge noble Lords to support it and I beg to move.

My Lords, I am grateful to the Minister for bringing forward this amendment and welcome it most wholeheartedly. I am grateful for his kind words. As he says, the amendment will make a huge difference to the lives of hundreds of young people leaving care each year. It has been described as the most important change for young people in care for a generation.

If our children or grandchildren were pushed out of their home at the age of 18, we would be very troubled and do everything in our power to change that. Your Lordships have done just that with this amendment. Just consider the difference that this will make for young women. We know that many women leaving care are prey to sexual exploitation. They are more likely to have pregnancies as teenagers and more likely to have their own children taken into care. It is highly arguable that a contributing factor is their poor relationship with their father. I was speaking earlier today to a woman who lost her father at the age of 14, and the traumatic effect that had on her life impressed that on me once more.

It has been encouraging, during the Bill’s process, to meet young women lobbying me with their male foster carers, looking to continue that healthy relationship with an interested male carer. I am convinced that for many of these young women, the opportunity to have a continuing relationship with a man interested in their success and welfare will have a very beneficial impact on their self-esteem and their future choice of men. I was very pleased to hear my noble and learned friend Lady Butler-Sloss talk about the charity, Families Need Fathers, and I certainly support what she said.

I thank the Minister. He has bent over backwards to listen to my concerns, as I know that he has to many of your Lordships, and he has acted on them. I remember him warning me at our first discussion that there was no money left to fund changes to the law. It is to the Government’s great credit that they have gathered together the £40 million necessary to fund staying put. If I may say so, I hope that the Minister will enjoy reflecting with his family on the difference that he has made to the lives of young people leaving care. I know that his wife already does much important work for young people.

I am also most grateful to the children’s Minister, Edward Timpson MP, for his concern to see this change and to the Secretary of State, the right honourable Michael Gove, for agreeing it and for finding the money to fund it.

I hope that I may extend a few further notes of appreciation to those who have been involved. I am grateful to the Opposition for their support for the amendment, and particularly to the noble Baroness, Lady Hughes, for her enthusiastic support and for setting up the staying-put pilots which provided the essential evidence in making the case for that change. I am grateful to the officials, who worked so hard to make this possible, crunched the numbers on the costs and produced the helpful draft guidance, which I welcome, in time for Third Reading. I am grateful to my colleagues, the noble Baronesses, Lady Perry and Lady Massey, my noble friend Lady Howarth, my noble and learned friend Lady Butler-Sloss, and the noble Lord, Lord Storey, for their advice and support. I am grateful to all those who spoke with such unanimity and strength in Committee—albeit, understandably, occasionally flagging up the caveat of cost. That was extremely helpful.

I am also most grateful to the late and much lamented Paul Goggins MP—I was pleased to hear the Minister’s words of tribute to him and his work. He tabled the staying-put amendment in the Commons and lobbied the Speaker there hard and successfully to have it debated. He gave such strong encouragement to me on the two occasions we met to discuss the amendment. He was a remarkable and lovely man, and it was a privilege to have the opportunity to work with him.

I am grateful to Ann Coffey MP, who spoke to the amendment in the Commons and gave much appreciated later support. I am also grateful to David Simmonds, lead councillor for the Local Government Association on child welfare, for meeting me to discuss the matter and clearly doing such a successful job in lobbying the Government for proper funding of staying put, and to Craig Whittaker MP, chair of the All-Party Parliamentary Group for Looked after Children and Care Leavers, for his advice and support.

I am grateful to the coalition of charities which made this possible, including Barnardo’s, the NSPCC and the Who Cares? Trust, and most especially to Robert Tapsfield, chief executive of the Fostering Network, who led the charge. The help offered by his officer, Vicki Swain, was faultless.

I hope that one day soon we will be looking at extending staying put until age 25—the noble Baroness, Lady Morgan of Drefelin, made a powerful case for this in Committee—and to young people in children’s homes. However, today is the time to celebrate the immensely welcome initiative from the Government. Staying put is a revolution and a landmark. The Government are doing so much good work for children in care, if I may be permitted to say so, and I salute them for it.

My Lords, I am prompted by the amendment of the noble Lady, Baroness Walmsley, to draw your Lordships’ attention again to the widespread concerns about the adequacy of funding for the two year-old and three year-old entitlement. This is a long-standing concern. If it is so important that we have high-quality early years care, certainly the Government and the taxpayer should fund it properly. I apologise that I did not take the opportunity to raise this with the Childcare Minister, Liz Truss, when I last saw her. If it is possible during the passage of the Bill to discuss children’s centres with her, I will certainly take the opportunity to raise the question.

My Lords, I thank the noble Baronesses, Lady Hughes and Lady Jones, and my noble friends Lady Walmsley, Lady Tyler, Lady Sharp and Lord Storey for raising these important issues and bringing their experience to this matter.

The purpose of the Ofsted inspection of a childminder agency is to hold it to account for the quality of care its childminders provide, in order to deliver the best outcomes for children. Last week, Ofsted published its consultation on childminder agency inspections. This set out its proposals to ensure that Ofsted regulation of agencies will support quality improvement and will be centred on the needs of young children and their parents.

A key feature of the childminder agency model is that it is the agency rather than Ofsted that is responsible for the monitoring and quality assurance of the childminders who are registered with it. As part of the inspection of an agency, the Bill already gives Ofsted the power to inspect the individual childminders who are registered with an agency. Ofsted plans to use this to undertake sample inspections of childminders registered with agencies, which is comparable to the arrangements that already exist for Ofsted inspection of voluntary adoption agencies and independent fostering agencies.

We want to empower agencies to improve childminder quality. Requiring direct Ofsted inspection of agency-registered childminders could weaken the incentive for agencies to be responsible for improving the quality of childminders registered with them. We intend that agencies will help remove some of the burdens that childminders currently face. We do not want to complicate the quality assurance regime for agency childminders by making them subject to two separate inspections by both the agency and Ofsted.

However, Ofsted will retain its existing powers of entry to any registered childcare premises to determine whether providers are complying with requirements imposed by the Childcare Act 2006. Therefore, if there are concerns about an agency-registered childminder, Ofsted will have the power to go in and investigate, as my noble friend Lady Walmsley said. Indeed, we envisage that childminders registered with agencies will have much more contact, including more frequent home visits, than childminders currently have with Ofsted. Under the current Ofsted arrangements, a childcare provider might have to wait up to four years between inspections.

I am sympathetic to the concerns of my noble friend Lady Walmsley about the scope of Ofsted inspection of agencies, and how such inspections relate to the quality of care and education offered to children. Ofsted intends that inspection reports of agencies will consider how a childminder agency can assure itself of the quality of its registered childminders. While this was always our policy intent, I can see, for the avoidance of doubt and to make it absolutely explicit, that it would be helpful to reflect this in the Bill. I have therefore brought forward an amendment to place a requirement for this in the Bill. The amendment will require Ofsted to report on the effectiveness of a childminder agency’s arrangements for assuring itself of the quality of its registered childminders, and of the quality of experience offered to children. I hope that this gives my noble friend the reassurance she sought, and I urge the noble Baroness to withdraw her amendment.

My Lords, the small government amendment I have tabled will move Clause 9 from Part 1 of the Bill to the new Part 5, which is about the welfare of children. This will mean that the provision will be in the same part as other clauses that relate to looked-after children.

Before the noble and learned Baroness speaks to her amendment, it might assist the House if I confirm the Government’s position on enabling young people to remain with their former foster carers, commonly referred to as “staying put” arrangements. Last week, we announced our intention to propose an amendment to the Bill at Third Reading to place a new duty on local authorities to support every care leaver who wants to stay with their former foster parents until their 21st birthday.

I am fully conscious that many noble Lords have dedicated their life to public service, whereas I am a relative newcomer to this. Indeed, up until 10 years ago I spent my life in business focused, frankly, on money. However, about 10 years ago some philanthropic juices started to flow—better late than never you might think—which was initially sparked by two events which happened, as so often serendipitously occurs, in close proximity to each other that made a profound impact on me. First, I visited an organisation which was involved in looking after children in care who were particularly challenged and had fallen out of many other placements or, as the noble Earl, Lord Listowel, described it, had experienced a revolving door of care. This organisation provided intensive care for these children. I remember when visiting them being struck by how intensive this support was.

Shortly thereafter I visited the charity Amber, which looks after young people, many of whom have been in care and many of whom some years after leaving care have become homeless or been in prison. Amber takes these young people for an intensive residential course to rehabilitate them into society, teach them how to apply for a job, be interviewed, how to dress and show manners et cetera. The charity has a very high success rate of getting them into jobs permanently. When visiting this charity and talking to the young people, I was struck by the contrast between the often very good care that they spoke about receiving—not always but often it was very good care—and how, when they became adults, society seemed to drop them like a hot brick. Following this, I spent some considerable time understanding the plight of children leaving care, and I am delighted to say that we have moved a long way since then, thanks to the very good efforts of the previous Government and this Government.

Therefore, when the noble Earl, Lord Listowel, first started to talk about staying-put arrangements he was, as far as I was concerned, pushing against if not an open door at least one that was off the latch on well-oiled hinges. I discussed the matter with my honourable friend the Minister for Children and Families who—as the noble Baroness, Lady Northover, said, I am delighted to see is in the House—particularly following the latest disappointing figures from the staying-put pilots, had absolutely no hesitation in feeling that this was something we should do. We then spoke to my right honourable friend the Secretary of State for Education, who agreed to it in a heartbeat. Therefore I am delighted to bring forward the amendment today.

I know that many from across both Houses share our commitment to doing better for these most vulnerable young people, but I would like to take this opportunity to pay tribute particularly to the noble Earl, Lord Listowel, for his commitment to increasing and improving the support available to care leavers. The way he presented the case for this new duty during our debates and in our meetings shows that he is a powerful advocate for this group of vulnerable young people. Indeed, I would like to thank the many noble Lords who spoke on this issue in Grand Committee.

Over recent years, I think we have all come to realise that young people often are not ready to leave home at 18. We rarely expect our own children to do so, so why on earth should we treat those in care differently? This issue has moved up the agenda, from the work started by the previous Government, including by the noble Baroness, Lady Hughes, to the significant step forward that we will make in the Bill. I pay tribute to the noble Baroness, Lady Hughes, for initiating the pilots, which have so informed our thinking on this matter.

My honourable friend the Minister for Children and Families has made improving support for looked-after children and care leavers one of his main priorities since joining Parliament—initially as chair of the All-Party Parliamentary Group for Looked-After Children and Care Leavers and now as a Minister. From last autumn, he has led a drive to promote staying put and to encourage local authorities to make this more widely available. As he said in the other place, we wanted to wait for this year’s figures to see what progress had been made. At Grand Committee, those figures had just been released and the increase was minimal. I explained our disappointment that they had not increased as much or as quickly as we hoped.

I would like to thank the sector, particularly the Fostering Network, for its work with officials on the evidence base which has so informed our decision. The new duty will come into force from April 2014. We will be giving local authorities £40 million over the next three years to put the support arrangements in place.

When we made the announcement on introducing this new duty, a number of voluntary organisations immediately supported the move. I will quote two of those. Janet Rich of the Care Leavers Foundation said:

“Step by step this Government has demonstrated that it truly understands the difficulties which face care leavers as they set out on the journey towards adulthood. Today’s announcement is another positive step on the journey towards State-as-parent acknowledging the duty they owe to this uniquely vulnerable group of young adults”.

I hope that noble Lords will welcome the significant change that we are proposing for care leavers. This will allow them to leave stable and secure homes when they are ready and able to make the transition to independence. My Lords, I am most grateful to the Minister for informing us of the Government’s proposal to bring forward their own amendment at Third Reading to introduce the staying-put amendment. I was very grateful to him for his preparedness to listen. Our first meeting had to be postponed because of family illness, but he was very prepared for us to meet again to discuss this, he listened carefully to concerns and we met on subsequent occasions. I was most encouraged by his attention and his responsiveness to my concerns and to those raised by other noble Lords.

I was also very moved in Grand Committee by the strong support from all around the House, from so many noble Lords who are parents and grandparents, who recognised that they look after their own children until the age of 25 or 30. The average age of a child who leaves home is 24 or more. However, many young people who leave care move out at age 16, 17 or 18. I am so grateful to all your Lordships that this change has come about.

In the evaluation that was done on this following the pilots in the 10 local authorities that the noble Baroness set up under the previous Government, 24% of young people stayed put. Those who stayed put with their foster carers towards the age of 21 were twice as likely to be in education and more likely to be at university. Those who did not benefit from staying put, who did not stay with their foster carers, were more likely to have multiple changes in habitation immediately after leaving care and to have far poorer outcomes. As Natasha Finlayson, chief executive of the Who Cares? Trust, said, this is a huge change in the lives of many young people leaving care—one of the biggest changes we have seen in many years. It is very much to be welcomed.

I want to raise one issue at some point with the Minister, which Natasha Finlayson raised in her comments, on dealing with children in children’s homes. They would not be touched by the legislation as it stands, and I understand that it would be a considerable extra cost to allow young people to stay in their children’s homes past age 18. However, it has been suggested that there might be a method of connecting young people in residential care with foster carers towards the end of or early on in their stay in residential care so that, if they chose, they could move on to a fostering arrangement as they moved towards the ages of 18, 19 and 20. I hope that the Government might look at that. Perhaps that is something for guidance rather than statute, and therefore perhaps not for the amendment the Government will bring forward at Third Reading. However, I hope that they will consider it.

I am particularly grateful to the Secretary of State who, at a time of serious austerity, was prepared to come forward with £40 million to enable this to happen. I very much wanted that to be achieved, but felt some concern for the directors of children’s services, who would have to make some very difficult choices in the short term to make this possible. As regards this matter I am therefore extremely grateful for the actions of the Minister, to the Minister for Children and Families, and to the Secretary of State.

My Lords, I can confirm that we will lay an amendment at Third Reading and that we will produce it in good time before that. We did not lay it today as we wanted to get the wording right. We want not only to ensure that the wording is legally correct but also that there is a consensus around it, both in Parliament and in local government and the sector. We will take account of all the comments made by noble Lords as we develop the amendment and start to work on statutory guidance. We will be consulting with interested Peers, local government and key voluntary sector organisations over the next few weeks on the wording of the proposed amendment. Officials will be happy to arrange a meeting with noble Lords to discuss the detail of the amendment.

The noble Earl, Lord Listowel, commented on care leavers who leave residential care. In general, as noble Lords will know, children’s homes do not seek to provide a permanent “family-type” placement, and few placements in homes last very long. However, there is nothing to stop local authorities from providing staying-put arrangements. However, our proposed duty will only apply to care leavers who leave foster care placements. As the noble Earl said, it is a great deal more difficult and expensive to provide staying-put arrangements in children’s homes. You would have vulnerable adults in homes with much younger vulnerable children. However, we are supporting Catch22 with a grant of £200,000 over two years to help improve support and outcomes for young people who leave residential care. The project is working with six providers in the north-west of England and learning will be disseminated nationally. I will be very happy to discuss that project with the noble Earl in more detail.

I hope that our decision to table an amendment on staying put at Third Reading will reassure noble Lords that we are committed to introducing legislation in the Bill on this issue. I therefore urge the noble Baronesses to withdraw their amendment and I beg to move the minor government amendment that would transpose Clause 9.

My Lords, I will speak to all the amendments in this group: Amendments 241BA, 241C, 241D, 273B and 273C.

Four of these amendments will make small changes to the Care Standards Act 2000. My intention in proposing the amendments is to pave the way for the introduction of a reformed framework for regulating and inspecting children’s homes. Amendment 241BA amends Section 65 of the Children Act 1989, which concerns the disqualification of persons from carrying on working, or being employed in, a children’s home.

In March 2013 there were 4,930 children living in children’s homes, representing just over 7% of all looked-after children. The majority of children living in homes will have been placed there by local authorities because they cannot be cared for in a family setting. They will usually be older; children in homes have an average age of over 14. A recent research study found that 62% of children in children’s homes had clinically significant mental health difficulties, and 74% were reported to have been violent or aggressive in the preceding six months. Few children stay in one children’s home for more than a year; 30% live outside the local authority responsible for their care, often at some considerable distance.

Given these children’s vulnerability, it is particularly worrying that there are significant concerns about the quality of care in some homes. While by 31 March 2013 the majority of homes were judged by Ofsted to be good or outstanding, a significant minority, 28%, were judged only adequate or poor against current minimum standards.

My department has been pushing forward for some time with a programme for reforming the pattern of care in children’s homes. We have recently consulted on some immediate changes to regulations designed to more effectively safeguard children living in children’s homes, especially those in distant, or out-of-authority, places. We have also published a comprehensive data pack, with details of children’s homes’ locations, quality and costs, and of the needs of the children in their care. We are considering ways to enhance the training and skills of the children’s homes workforce, and how to support improved commissioning of homes by local authorities.

As my department worked with Ofsted and others on plans for improving care in children’s homes, we reached a view that the current regulatory framework, established by the Care Standards Act 2000, is having a limiting effect on our ambitions to drive improvements in the quality of care provided by homes. In our view, it should only be acceptable for any children’s home to offer care that is “good”, with all homes having a clear remit to strive for excellence in respect of the children they care for. These amendments put beyond doubt the fact that the Secretary of State can make regulations that are able to define high standards for all children’s homes. Every home must have the capacity to enable all the children it cares for to achieve their full potential. These amendments pave the way for my right honourable friend the Secretary of State for Education to develop new, more stretching, quality objectives and standards for children’s homes.

We intend to support innovation by creating regulations which specify high objectives and standards. Homes should be free to decide how they achieve these standards. We intend to set high standards for homes in a number of areas, such as requirements for effective leadership and management; for the provision of excellent education; and for access to healthcare that meets recognised clinical standards. We will, of course, have to be confident that homes respond effectively to the risks and vulnerabilities faced by the children they care for. We have worked very closely with Ofsted to develop the proposal that I am outlining. As the inspectorate for children’s homes, Ofsted welcomes our aim of taking a decisive step away from a regulatory system based on minimum standards.

Our work with Ofsted also identified a small but potentially significant problem with the process involved when Ofsted has reason to consider whether a person should be disqualified from carrying on working, or being employed, in a children’s home. This power is set out in Section 65 of the Children Act 1989. I am tabling a small amendment to this section to improve the practical workability of this process. The amendment introduces a time limit of 28 days for a person to inform Ofsted that he or she has become disqualified, perhaps as a result of a past offence, in order to seek Ofsted’s consent to be involved in a children’s home. Without this explicit waiver from Ofsted, the person would be committing an offence.

Officials from my department have had the opportunity to share our thinking on all these amendments with representatives of local authorities, of children’s homes providers and of the voluntary sector campaigning for children. These services are united in their broad support for the direction of travel I am signalling today, which marks a decisive step in driving forward our ambitions for reforming the children’s homes sector. We are determined to improve the quality of all children’s homes, so that the only acceptable standard for children’s homes is good care, with all homes having a clear remit to strive for excellence. I hope I have explained the important objectives that these amendments will enable us to achieve, and that noble Lords will support them.

Perhaps the best way I can thank the Minister is by speaking as briefly as possible. Having worked in residential settings with young people and spent a week in a children’s home, and having been deeply concerned about the quality of the experience for children in children’s homes since I first entered this House, my perception is that the Government have taken a very careful and thoughtful approach to meeting the needs of these very needy young people—albeit that they are few in number. In the past two years or so we have realised that a number of young girls have been sexually exploited, often in children’s homes.

The Government have responded admirably to this challenge. Tim Loughton MP, the former Children’s Minister, has children’s homes in his Hove constituency, so he is aware of the problem. He addressed it carefully by setting up three working groups to look at the issue, which resulted in regulations being laid. The current Children’s Minister, Edward Timpson MP, has pursued that direction of travel with the attention to detail that is familiar to those who have worked with him. I am deeply grateful for that. The Minister is absolutely correct to emphasise the importance of staff training. It is extremely encouraging that the Government are taking this issue so seriously.

What would stop the Government from injecting funds into local authorities to enable them to build more networks? Rather than going down the agency route to bring these childminders together, what obstacles would there be to a push to enable more local authorities to build on the networks they already have? Why would that not meet the Government’s aim of building the capacity of childminders?

I will take that away. My first thought would be that we have not got any money at the moment. Secondly, the assumption that the public sector can run things more efficiently than the private sector is one that I would probably disagree with on principle.

My Lords, I thank the noble Lord, Lord Ramsbotham, and my noble friends Lord Addington, Lord Storey and Lady Walmsley for tabling the amendments in this group and giving the Committee the opportunity to discuss this important issue. I also thank other noble Lords who spoke.

We have given Clause 70 considerable thought since it was discussed in the other place and following the informative debate in this House at Second Reading. I understand the concerns raised today, which were prompted by this clause being included in the Bill. I assure noble Lords that there was never any intention for this clause to suggest that the Government are not concerned with supporting this vulnerable group of children and young people. I am very clear that I want to use this Bill to improve the support we provide to children and young people in custody with special educational needs. This is an issue I have been concerned with ever since, 42 years ago, during my university course on criminology and penology, I spent three weeks in what was then called a borstal. It was probably the most eye-opening three weeks of my entire education.

Clause 70 is included to play an important technical function by disapplying duties which would be impractical to deliver while a child or young person is in custody. For example, it would not be possible to allow a young offender to choose where they are educated or to give them a personal budget. We have been considering how we can introduce provisions that will ensure continuity of education and health support while a young offender is detained.

In Amendment 214, my noble friend Lord Storey has set out how Clause 70 could be replaced, and I listened to his thoughtful contribution to the debate today. I hope it reassures my noble friend and others that legislation exists in Section 562C of the Education Act 1996 setting out how education and support for those with special educational needs is delivered in custody. That legislation places clear duties on local authorities to use their best endeavours to deliver the special educational provision that is set out in a statement of special educational need. The consequential amendments in Schedule 3 to the Bill will place the same duties on local authorities for young offenders aged 10 to 17 in custody with education, health and care plans. However, we all agree that more needs to be done.

The noble Lord, Lord Ramsbotham, proposed a way forward in his Amendment 213 which seeks to amend existing provisions in the Apprenticeships, Skills, Children and Learning Act 2009. I thank the noble Lord for this amendment, which I know draws on his considerable experience and expertise in this area. The noble Lord has spoken with knowledge and passion throughout this Committee’s debate on Part 3 of this Bill, and I am particularly grateful for his contributions. As I have discussed with the noble Lord, the intention behind this amendment is in many ways similar to the solutions we have been considering.

Ensuring continuity of support already set out in EHC plans for those children and young people moving into, through and out of custody is exactly what I want to achieve. I am also considering whether we can enable children and young people in youth custody to have the right to ask for an assessment for an EHC plan where special educational needs are identified for the first time.

However, as I have discussed with the noble Lord, this new clause does not achieve all that we might want. For example, it is important to ensure that duties are on relevant health bodies rather than local authorities. Concerning the point my noble friend Lord Storey raised on behalf of the noble Lord, Lord Ramsbotham, it is essential that we properly consider what the role of the home local authority should be as well as that of the host local authority. As many in this debate have said, this is a great opportunity to make a difference, and it is important that home local authorities maintain their involvement with children and young people who are in custody so they are aware of progress and can make sure that appropriate provision and support is available when a young offender returns home on release. This is important if we are to reduce further the risk of reoffending.

I thank noble Lords for the debate today. We will carefully read the contributions from noble Lords between now and Report as we reach a decision on how best to amend Clause 70 to achieve the aim of improving provision for children and young people with SEN in custody which we are all agreed on. I recently met the noble Lord, Lord Ramsbotham, to discuss how we might do this, and I would like to continue to work with him and others as we develop amendments to be tabled ahead of Report.

I turn to Amendment 212 and the issue of screening those in custody for dyslexia. I agree with my noble friends Lord Addington and Lady Walmsley that we must support young offenders who have hidden disabilities such as dyslexia. I should like to assure my noble friends that assessments to identify such needs already take place in the youth secure estate. Education providers assess all young offenders’ levels of literacy, language and numeracy on entry to custody. They also use a variety of tests such as the hidden disabilities questionnaire developed by Dyslexia Action to screen all young offenders who show signs of having a learning difficulty or disability. These assessments are extremely important because they allow providers to identify a range of learning difficulties, including dyslexia. Once their needs have been assessed, all young offenders in custody receive an individual learning plan that follows them through the course of their sentence. Of course, if we are able to ensure continuity of EHC-plan support, then young offenders with plans will already have had such needs and relevant support identified. Education providers in young offender institutions are also contractually required to have a workforce trained to identify and support a young person’s individual learning needs.

Of course, despite the current legal and contractual protections, we can always do more. The Transforming Youth Custody Green Paper sets out how we want to put education at the centre of youth custody, thereby ensuring young offenders are equipped with the skills, qualifications and self-discipline they need to stop offending and lead productive lives on release. The consultation included a question on how best to support young offenders with special educational needs. The consultation ended on 30 April this year. Since then, the Ministry of Justice has been reviewing the responses received and carefully considering the next steps to transforming youth custody, and plans to publish the response to the consultation shortly. We want our amendments to complement the MoJ’s reforms and are working with it to achieve this.

With those reassurances, I hope that noble Lords will feel able to withdraw or not move their amendments.

My Lords, I apologise for asking a quick question. How does the virtual school head that this Bill puts on a statutory basis keep track of a looked-after child who enters the secure estate? Many of them will have special educational needs. There is no need for a response now but perhaps it is a matter that the Minister can think about for us to discuss at some point.

My Lords, I will speak to this group of amendments on home education tabled by my noble friend Lord Lucas. I would like to reassure him that, despite any possible minor imperfections in the drafting, we do know exactly what he is about and we are fully aware of the role that my noble friend plays in the All-Party Group on Home Education. I thank him for raising this important issue.

Noble Lords will be aware that parents have the right to educate their children at home and there is nothing in this Bill that infringes that right in any way. Nor does the Bill increase the responsibility of local authorities for home-educated children or increase their powers to interfere in the way that parents home educate.

Parents of children with special educational needs who home educate do so for different reasons and therefore will look for different levels and types of support from the state, if any. Some home educate because it would always be their choice to do so. Others, however, have begun home education out of desperation, as they have not been able to get the support that they feel that their child needs, or have been let down by the very services which should be supporting them. While I continue to support parents’ right to choose home education, I sincerely hope that our reforms will mean that parents no longer feel that they have to turn to home education as a last resort.

In broad terms, the Bill seeks to keep the same legal position for children with SEN who are home educated as now, but it does so within the important wider context of the Bill including a much greater focus on the views, wishes and feelings of parents as set out in Clause 19 and throughout Part 3 and the code of practice. Where a child or young person has an EHC assessment and the outcome of that assessment is that a plan is needed, the local authority is under a duty to prepare such a plan. If the local authority considers that home education is the right provision for the child or young person, that will be specified in the plan. It will then be under a duty to secure the special educational provision specified in the plan, with the home educator providing the core education provision. Likewise health commissioners will be under a duty to provide the health provision specified.

Amendments 152ZA and 157ZA seek to strengthen parents’ right to request that a plan specifies home education. They would mean that local authorities would have to treat such a request in the same way as a request for a particular school or institution. I think that there is a delicate balance to be struck here. Parents can already make representations for home education and will continue to be able to do so under Clause 38(2(b)(i). Moreover, the principles set out in Clause 19 mean that local authorities must give more weight to parents’ wishes, and as a result we may see local authorities naming home education more often. However, the choice to home educate is a choice to opt out of the state-supported system and is therefore not the same as the choice of a particular school or institution. Therefore these amendments would shift the balance too far.

Where a local authority makes a plan that does not specify home education, this does not prevent parents from home educating. In such circumstances the local authority can only absolve itself of its duty to secure SEN provision in the plan and ensure that the child’s SEN needs are met if it is satisfied that the parents’ provision is suitable for the child’s SEN. I know from the debate on Report in the other place that there are differences of view on this legal point, and these amendments aim to shift the balance of responsibilities between local authorities and parents. However, our view is that not only do local authorities have this duty but it is right that they do.

I should emphasise here that local authorities do not have draconian powers available to them to make this check. For instance, they have no right to enter the parental home to check the provision that is being made. They can enter the home only at the parents’ invitation. The check on the suitability of the parents’ provision could be made through the parents providing a description of that provision or by the parents passing on examples of the child’s work. Neither should they define “suitable” as necessarily being the same as the provisions specified in the plan.

Once a local authority has assured itself that the provision being made is suitable, it is no longer under a duty to make any provision. However, it retains the power to make provision in the home where this will help parents make suitable provision for their children and where parents are willing to receive this help. We encourage local authorities to make such provision and we have made this clear in the code. The same applies to the provisions to support home-educated children who have special educational needs but do not have a plan.

As to Amendment 101A, I can assure my noble friend that the local authority will include provision that would be available to home-educated children.

I hope that what I have said will reassure my noble friend that we continue to support parents’ right to home educate. There is nothing in the Bill that will threaten that right and the greater focus on parental wishes in the new system will mean a better deal for home educators. The code of practice includes a specific section on home education. Following a recent meeting with my noble friend, officials have undertaken to work with representatives of home educators to develop it further during the consultation period. On that basis I ask my noble friend to withdraw his amendments.

My Lords, I listened to the Minister’s response with particular interest as my sister home educated her children for some time.

Perhaps I may raise a tenuously related but important question. It arises from previous debates and is relevant to this clause: how will the local offer help parents to help children in their learning? It is good to see in the code the great pains that the Government are taking to ensure that parents and young people are consulted about what is on offer to them, but we know from all the evidence that family learning is tremendously important to children’s outcomes. In my experience of fostering, helping foster parents to gain the confidence to sit with their children on a regular basis over a period of time, and teaching them the techniques of paired reading with their children, is immensely beneficial for the literacy of those children. Anecdotally at least, it strengthens the relationships of the foster carers and the children.

I have been a follower and supporter of the charity Volunteer Reading Help—now Beanstalk—which works in more than 1,000 primary schools using a paired-reading technique. It works with vulnerable children, particularly; volunteers make a commitment of at least one year and turn up regularly to support the children, with the result that the children make great strides in their literacy.

My question to the Minister is whether it is quite clear how local authorities will offer help to parents to help their children in their learning. Might it be helpful to have guidance somewhere that this is a good approach to take? I am talking particularly about paired reading but it could help with numeracy. I confess to ignorance about the specifics of special educational needs but I appeal to those with expertise in the area to consider the models of good practice there already are of paired reading and parents being assisted to help their children with their numeracy.

In her recent report, Family Learning Works, my noble friend Lady Howarth highlighted that family learning can improve children’s educational outcomes by between 10% and 15%. Therefore, I should like to see this approach adopted as widely as possible in supporting families who have children with special educational needs.

I think I can assure the noble Earl, Lord Listowel, that local authorities will be able to include provision such as paired-reading schemes in their local offers. We want to see extensive and helpful local offers that include the full range of provisions to support children and young people with SEN, including support for parents and carers. We are happy to look at the guidance and the code in more detail to ensure that that is absolutely clarified.

My Lords, I shall be brief, as we are keen to clarify this point. I shall speak to Amendments 71, 72 and 73 about the circumstances in which provision that would otherwise be health or social care provision should be treated as special educational provision. In doing so, I would like to comment on a couple of the points that the noble Lord, Lord Ramsbotham, made. If I understood him correctly, he said that we needed a child development strategy for every child. I would say that we have such a strategy in the massive reform programme that this Government have put in place for schools.

I will try to get my facts right because I know that the noble Baroness, Lady Jones, will write to me if I do not. We have just been told by the OECD that we came bottom—joint 21st with Italy and Spain, out of 24 countries—for our school leavers, and we have just been told by Alan Milburn that we are the most socially immobile country in Europe. That is why we have a schools strategy and a massive reform programme in place. However, this Bill is about SEN. I will write to the noble Lord, Lord Ramsbotham, about the four pathways that he mentioned. On training, which he also mentioned, I just signed a letter to him today on this point about initial teacher training and other professional development for teachers, which is founded on the teacher standards that were introduced in September 2012. Child development is an important part of those standards.

I turn to the amendments. During the pre-legislative scrutiny of the SEN provisions of the Bill, the Minister for Children and Families gave an undertaking to maintain the existing protections for parents in the new system. Clause 21(5) was added to the Bill before introduction in the other place as part of that undertaking. It seeks to replicate as far as possible the case law established under the present SEN legislation, which, in our view, makes clear that health provision such as therapies can be educational, non-educational or both, depending on the individual child and the nature of the provision. Case law has established in particular that since communication is so fundamental in education and in addressing speech and language impairment, it should normally be treated as educational provision unless there are exceptional reasons for doing otherwise. We have reflected this in section 7.9 on page 109 of the draft SEN code of practice.

I think we all share the aim of carrying the current established position through into the new system. I understand the concerns that have been expressed in this debate that the current drafting does not get this quite right. This is complicated legal territory and it has not been straightforward to find the right formulation, as evidenced by the different approaches taken by each of these three amendments. I know that various parts of the sector have sought legal advice on this issue; I understand that the amendment of the noble Lord, Lord Ramsbotham, follows the advice that the Royal College of Speech and Language Therapists received, and we are currently looking at that advice. The noble Baroness, Lady Jones, said that she also had received advice, and we would be delighted to look at that as well. I would welcome the opportunity to discuss this further and see what progress can be made with noble Lords outside the Committee. With that reassurance, therefore, I hope that the noble Lord will feel able to withdraw his amendment.

My Lords, before my noble friend does that, as I imagine that he may well do, I very much hesitate to speak in this debate. I have just been chairing a discussion on child development in schools. Attending it were head teachers, the former head of the TDA and a number of other experienced practitioners in the area that we have just been discussing. Unfortunately, I was four or five minutes late to this discussion so I hesitate to make any contribution to it. However, since the Minister referred to what is being done about the standards to ensure a better understanding of child development, which is very welcome, I should like to make two points.

First, in welcoming the effort by both the previous Government and this one in raising the status of teaching, and particularly in welcoming the advent of Teach First, we heard from the man responsible for Teach First in London. He said how successful the scheme is and that 30% of graduates were getting into the schools that needed their help most, so that really tough inner-city schools were getting these excellent graduates, particularly in science and maths. However, although he could speak only anecdotally, he said that he had met many of these teachers and they said they felt hopeless. They did not know how to manage the challenges presented by the young people they were working with. We need to get this right because otherwise we might lose the wonderful new crop of young teachers we are recruiting into the profession, who will make a huge difference to outcomes for young people.

The other point to arise from this meeting is that a generation of teachers has not learnt anything significant about child development. That means that head teachers and lead teachers today will not have learnt much about child development in their training. So, while I welcome what the Minister has said about the changes in the standards, the challenge presented by this issue should not be underestimated. I hope there will be ongoing discussions about what we can do in this area, which is vital for the educational outcomes that we want to see for our young people. We need to retain our new, young, enthusiastic teachers on the front line, help them to understand why children sometimes behave so challengingly and enable them to engage with them effectively. I apologise to the Grand Committee for intervening but I hope that it has been helpful.

My Lords, I shall speak to Amendments 74, 127 and 217 regarding severely bullied children and the education of children unable to attend a mainstream school. I thank my noble friend Lady Brinton for raising the important issue of bullying and the needs of young people who are bullied. As the noble Baroness, Lady Jones, said, my noble friend has been a great advocate for children and young people whose lives have been blighted by bullying. Bullying in any form and for any reason is totally unacceptable and should never be tolerated in schools. Bullying can instil fear, damage self-esteem and reduce academic attainment. We have a considerable campaign in place to combat cyberbullying, which, as my noble friend Lady Walmsley mentioned, can be particularly unpleasant. As our reforms work their way through the school system, and behaviour management strategies improve—as I believe that they are substantially in schools across the country—that should help in this regard.

The amendments broadly cover three areas: a call for bullying to be defined in law; measures to prevent bullying happening in the first place and to tackle it when it does; and provision for those who are the victims of bullying, particularly those who are severely bullied.

The definition of bullying outlined in Amendment 74 suggests that bullying will involve an “imbalance of power” and is repeated behaviour that causes physical or mental harm. These elements are likely to be involved in many instances of bullying, but not all of them. The definition of severe bullying outlined in the amendment refers to behaviour that affects children so severely that they suffer trauma and psychological damage. There is a risk that that could cause confusion for schools, because the same bullying activity could be treated differently according to the effect that it has on the victims, rather than the act itself. Although we acknowledge that the support should take account of the effect, it is important that there is consistency in how schools manage the behaviour of pupils.

There will always be exceptions to whatever definition is put in place, which is why we consider that these matters are best placed at the discretion of head teachers and teachers. We outline what constitutes bullying in our advice to schools and we consider that that is the best place to do so, rather than through a strict definition in law. A legal definition could, among other things, rule out behaviour that common sense might suggest is bullying but may not be captured by a law.

Turning to my noble friend Lady Brinton’s point about guidance being in one place, it is of course important that guidance is practical and manageable for those using it. We are very happy to look at how the different pieces of guidance fit together and cross-refer, in particular, in the current consultation on the code.

Turning to preventing bullying in the first place and tackling it when it does, as different schools face different issues, we do not want to prescribe specific anti-bullying strategies. Instead, we want to allow schools and local authorities to address bullying in the light of the needs and circumstances of their schools and their pupils. I believe that our current position provides the right balance between requirements in law, flexibility for schools and strict accountability.

All schools must have a behaviour policy with measures to prevent bullying. It is up to them to develop their own strategies, but they are now clearly held to account for their effectiveness in doing so by Ofsted. Since 2012, it has been a requirement for school inspectors to take into account issues relating to bullying, harassment and discrimination. In addition, we provide schools with advice, with links to several anti-bullying organisations for specific advice.

Turning to provision for children who are bullied, the starting point should be the needs and welfare of children and young people and the state of their mental and emotional health. Schools and local authorities should provide support in a proportionate and tailored way to meet their needs. The new draft SEN code of practice considers that developing a graduated response to the varying levels of SEN among children and young people is the best way to offer support, and this can include the needs of bullied children. There is no separate legal status of a temporary statement. However, local authorities and schools are free to use key elements of the statementing process to make local arrangements.

The causes that affect the well-being of children and young people will be relevant to how those needs are best addressed, but are not the best guide to the level of need. A child’s well-being could be severely affected by a variety of things, including bereavement, family upheaval or severe bullying. It could result from a range of factors that taken in isolation a child could cope with, but taken together have a severe impact. It is important, therefore, to avoid creating a hierarchy of causes and prescribe what the response should be.

Schools know their pupils. They are alive to changes in behaviour, character and attendance. They should offer support quickly, based on the need they identify, and there is a wide range of options that they should consider, from asking the pastoral team to keep an eye out to providing formal counselling, engaging with parents, referring to local authority children’s services, completing a common assessment framework and referring to child and adolescent mental health services, including whether to assess for SEN. The circumstances that my noble friend describes will often need swift support. An EHC plan is intended for those with the most challenging, complex and long-term needs. This is reflected in the amount of time that it will take to deliver an EHC plan—a maximum of 20 weeks under the reforms. In many cases, offering a child or young person SEN support in the first instance will be much more appropriate, and faster. Giving a child or young person an EHC plan is a significant step and may not be necessary.

No child should ever be forced out of school because of bullying. In extreme cases, it may be necessary to make other arrangements so that a bullied child can access the good education they deserve.

In response to the concerns raised by Amendment 127, I should reinforce that local authorities already have a duty to arrange suitable education for any child who would not otherwise receive it. Suitable education is defined as,

“efficient … education suitable … to the child’s age, ability and aptitude, and … to any special educational needs the child may have”.

The duty covers all compulsorily school-age children who are not receiving suitable education. This could include pupils who are unable to attend a mainstream school because of bullying, but it is not limited by the reasons for a child being unable to attend school.

The duty is also not limited by the length of time a child will be missing education. For example, statutory guidance on the education of children unable to attend school because of health needs states that alternative arrangements should be put in place for children missing 15 days of school or more, whether consecutive or cumulative.

Separate statutory guidance on alternative provision, issued in January this year, sets out that parents, pupils and other professionals should be involved in decisions about the use of alternative provision. It also states that there should be clear objectives and arrangements for monitoring progress.

My noble friend Lady Brinton made a point about the shortage of alternative provision. I am delighted to tell her that already, under the free schools programme, we have approved 33 new alternative provision providers. So far as Red Balloon is concerned, I have met Carrie Herbert. I have initiated conversations between her, the department and the New Schools Network, and I hope that she has taken on board what they have said about any future applications she may make under the free school proposals. However, I cannot help but wonder whether such a bid, if successful, would be allowed under a Labour Government, as it would be not a parent-led academy but a free school run by professionals, as indeed are most AP schools and special schools.

I should like to consider and investigate further the point about disincentives made by the noble Baroness, Lady Morris, who I know is very experienced in these matters.

I hope that I have been able to reassure the noble Baroness that we are deeply concerned about bullying and bullied children. We have measures in place to prevent and tackle bullying, and the safety net she is seeking for pupils who are unable to attend school is already in place. I therefore urge her to withdraw her amendment.

My Lords, I am most grateful to the Minister for his reply and for making clear the standards regarding alternative educational provision for those outside mainstream schooling, for whatever reason.

On the guidance, perhaps he can look at the issue of children who are bullied being placed in pupil referral units. It may be helpful to have some clarity in that regard. Maybe as a general principle, something along the lines of guidance that states that if a child is severely bullied a pupil referral unit should not be the first choice of placement would help in these considerations.

I am very happy to do that. I am fully aware that it is obviously not appropriate for a bullied child to be placed in a pupil referral unit with other children who themselves are there because they have been guilty of bullying. It is something that we will look at further.

Before the noble Baroness does so, it occurs to me that the matter of staying put might be helpful in this arena. If there are two siblings, one of 16 and one of 17, in the same foster care household and then one turns 18, enabling the foster carer and the young person to stay together past the age of 18 might enable that sibling relationship to endure further. I do not know what the experience is there, so if the Minister can help with any information with regard to whether there is a significant factor in helping young people to stay put—if that helps in the issue of keeping siblings together—I would be grateful to him. Perhaps the voluntary agencies know of examples in that area; again, I would be grateful to hear about that.

My Lords, I welcome the opportunity to debate the important subject of how local authorities support care leavers. I fully understand concerns raised by noble Lords, including the noble Earl, Lord Listowel, the noble and learned Baroness, Lady Butler-Sloss, the noble Baronesses, Lady Young, Lady Massey, Lady Morgan and Lady Howarth, the noble Lord, Lord Ponsonby, and my noble friends Lord Storey, Lady Howe and Lady Walmsley, and many external parties about the ongoing support for care leavers. As the noble Earl has said, we have had the opportunity of discussing this matter privately on a couple of occasions recently. I look forward to further discussions with him on this matter as he knows I also feel strongly on this subject.

We have emphasised the importance of staying put in revised statutory guidance, because we recognise that for many young people the ability to stay on with their former foster carers, particularly when they are in further and higher education, is the right decision. The Minister for Children and Families wrote to all directors of children’s services last October, encouraging them to prioritise their staying put arrangements, so that all young people who wanted to could benefit from this provision. I accept there is more to do. Naturally we are disappointed that the 2013 statistical returns from local authorities show only a marginal increase in young people in staying put provision. However, we should recognise that these figures collected by local authorities are a snapshot at 19 and they run only until March 2013, so there is not much time to see the impact of the actions we have taken since 2012. Moreover, they do not tell us about the number of young people who might be benefiting from this provision from the age of 18, and who will leave this arrangement before they turn 19. From next year the department will be collecting data at age 18, 20 and 21, and will be able to see from 2014 how many young people are benefiting from this provision before and after the age of 19.

Our approach is and has been to improve practice. We are continuing to look for ways to promote and encourage this. We have already worked with Her Majesty’s Revenue and Customs and the Department for Work and Pensions to issue practical guidance on staying put to help carers and local authorities around tax and benefit issues. As I have already said, the revised Ofsted inspection framework that comes into practice in November has a specific focus on the quality of leaving care services. A focus on the care leaver assessment will be on accommodation, and inspectors will consider staying put opportunities. Being able to stay in placements beyond 18 is mentioned within one of the grade descriptors of the care leavers’ judgement. We will monitor closely the reports on these inspections and feedback from care leavers, and expect to see significant improvements in 2014 and 2015 in the number of young people staying put. In addition, through our work with the National Care Advisory Service, my department will encourage local authorities to share effective practice where they are making good progress in this respect. While doing everything that we can to promote staying put, we must recognise that this sort of provision will not be appropriate for all young people. Care leavers, like their peers, have different needs, and attitudes regarding their transition to adulthood. The crucial point is that young people should be offered a range of placements that are safe and suitable, and meet their individual needs. I want to reassure noble Lords that the Government want to encourage all looked-after children to stay in care until they are 18 and beyond, where this is the right choice for them. We want to do everything we can for all care leavers.

I recognise the strength of feeling expressed today, and wish to take the issue away to consider further what more we can do to increase the numbers of young people in staying-put arrangements. I understand that noble Lords feel there is a case that all we are doing is not enough. I have asked my officials to work further with the Fostering Network and others on this issue. The noble Baroness, Lady Hughes, mentioned a figure of £2.5 million, which is no longer our view of the figure, although it is a figure that the Fostering Network has recently come up with. We believe the figure is considerably higher, but we will be working with the Fostering Network to see if we can pin this figure down further. I would be pleased to discuss this issue further with the noble Earl over the coming weeks.

I hope that what I have said reassures noble Lords of our commitment to this issue and I therefore urge the noble Earl, Lord Listowel, the noble Baroness, Lady Young, and my noble friends Lady Sharp and Lady Walmsley not to press their amendment.

I thank the Minister for his reply. Before thanking colleagues, perhaps I may put a few questions on the detail to the Minister. With regard to the timescale, he was good enough in his comments just now to say that he expected a significant increase in the next two years in the number of young people staying put. Perhaps he would like to write to me with a clearer timescale. My concern is that unless we move quickly on this in the next one, two, three or four years, hundreds of young people will miss out on a pathway which we know would do them a lot of good and mean that they would have much better outcomes. If the Minister wishes to take a different approach, the voluntary approach, I should be grateful if he could make it clear when he hopes to achieve the target of 25%, which I think is the government target. It would also be helpful to know what steps the Government will take if that target is not reached or if good progress is not made in that direction. Those are just a couple of questions. He may prefer to write to me rather than answer them now.

I thank the Minister. I thank all colleagues for their support for the amendment. It is heartening for me to hear that depth of support from across the Committee. If I may say so, it was most interesting to hear from the noble Lord, Lord Ponsonby, about his experience today in an adult court. It was not at all surprising.

I should have made clear a couple of things in my opening remarks. First, 11 local authorities took part in the pilots to begin with. Then two of them merged, so it became 10. That is the reason for the disparity between the comments made by my noble friend Lady Young and me about the number of local authorities in the pilot evaluation. I also omitted to say that some of the local authorities taking part in the evaluation were selecting young people who work in education or training, so that does not give us as clear a picture about the successful outcome as one might like. I think that it is still very clear, but I want your Lordships to be aware that there was a difficulty there in terms of the group used in the pilots.

I welcome what the Minister has said. Of course, the measures that he is proposing are untried. We have seen only a marginal improvement in the past year. My concern is that in the years to come—the next one, two, three or four years—if the movement is too slow, hundreds of children will miss out on an education, a training or employment and go down much worse pathways if we do not grab the nettle and act now. I look forward to studying what the Minister said and to further conversations before Report.

I reiterate once more how grateful I am to noble Lords across the Committee for their support and I beg leave to withdraw the amendment.

Our teenage pregnancy rates are now at their lowest level in more than 40 years, and data for 2011, released by the Office for National Statistics in February this year, showed a continuing decline. The Government believe that the best protection is a good education, and we believe that our curriculum reforms will strike the right balance to allow all schools to improve their focus on the issues that are relevant to the circumstances.

My Lords, my honourable friend the Parliamentary Under-Secretary of State for Education and Childcare, and officials at the Department for Education, have consulted a wide range of interested parties on our proposals through a series of meetings and workshops. Officials have also visited a number of early-years providers to discuss the proposals. The Government launched a public consultation on 29 January, seeking views on these proposals from parents, early-years practitioners and others.

My Lords, I thank the Minister for his reply, and for the Government’s consultation on this implementation. However, is the Minister aware of the widespread concern among parents, practitioners and experts, and among organisations such as the Pre-School Learning Alliance, that the Government are even considering reducing the ratio of carers to babies and carers to pre-schoolers? Will the Minister now consult with his colleagues and consider pausing, taking off the table the proposal to reduce ratios, and will he take the advice of those in the sector on how to improve quality and affordability of childcare?

My Lords, our consultation on adult/child ratios will continue until 25 March. We should not pre-empt its outcome. The changes that we have proposed to the ratios are not obligatory. Providers will be under no obligation to change the way in which they operate. Our proposals are about giving freedom to high-quality providers to use their professional judgment to decide for themselves how to deploy their staff to best meet the needs of the children for whom they care.

I thank the noble Earl for his gracious words. This is the first time that I have addressed your Lordships’ House, and it is a great honour to be able to do so. I thank the House and the staff for being so incredibly welcoming and kind and, as this is my first appearance at the Dispatch Box, I am tempted to say, “Long may it continue”.

I thank the noble Earl for raising an important issue for my first Question because, although it is not within my department’s brief, it has troubled me for many years. Lasting and supportive relationships are particularly important for children in care and their long-term outcomes. That is why we are taking action to increase the speed and number of adoptions, to improve the recruitment and training of foster carers and social workers, and to raise the quality of care in children’s homes. We also have a programme of work to improve support for care leavers making the important transition into adulthood.

My Lords, I thank the Minister for his reply and his gracious words. I welcome him to the House of Lords, congratulate him on his appointment to the Front Bench, and apologise to him for not putting those words a little earlier in these discussions.

The children in care who often have the most broken relationships are those in children’s homes, often having had many placements in foster care before arriving there. Is the Minister aware of the very good example of Break children’s homes in Norfolk, where the average stay for a child is two years—often children will stay for four years or more—and active efforts are made by the homes to keep in touch with children once they move on into adulthood? Will the Minister look at this best practice to see whether it can be applied more widely to children’s homes in general where the turnover is high? On average it is seven months.

I shall try to get the words out in the right order now. I agree that many children in children’s homes have had failed foster placements. Our statistics show that 29% of children placed in children’s homes have had five or more previous placements. I have met quite a few children who have had over 20 placements. That is why we set up the expert working group: to look at how to improve the quality of support these children receive, building on good practice. This group has now reported to Ministers, and Ministers will make announcements on this shortly. We recognise Break’s impressive record—four years is an impressive average length of stay—and that is why we invited Hilary Richards of Break to be a member of the department’s expert group on quality.
