Lords ChamberMy Lords, I have put my name to Amendments 236, 237 and 238 which were tabled by the noble Baroness, Lady Henig. We are being asked to support nothing less than a revolution in policing governance in the absence of any evidence base on which the benefits of such drastic changes are set and in the absence of any public clamour for costly reform—indeed, the opposite. We are being told that these changes will not be piloted or introduced in stages since reform is urgent and cannot possibly wait. I beg to differ on all those counts.
However, if we are to press ahead with such an untried system, I am absolutely determined that we should do our duty to ensure that all means possible are employed to insert safeguards into the Bill. HMIC inspections seem to me to be a bedrock of any such safeguards against potential pitfalls and I share the high regard in which Sir Denis O’Connor, Her Majesty’s Chief Inspector of Constabulary, is held, together with his extremely able team.
In short, HMIC inspections are at times a difficult and challenging process for those undergoing them and they have repeatedly yielded the improvement across policing, which is at the heart of HMIC’s mission. So I am left, frankly, bemused when the Government propose not to expand but to constrict the use of this valuable tool for improvement. It makes no sense at all effectively to exclude these completely new systems of oversight from an inspection regime when that regime has already helped the current system to improve.
Next, I shall draw out the intention of Amendment 238, which removes the proposed new obligation on the local policing body to reimburse HMIC for the costs of its inspection. We have heard what the noble Baroness, Lady Henig, thinks of that. We have sought to replace this with a statement that the panel may request that HMIC conducts an inspection if its concerns warrant such an intervention. I am unaware of any other inspection regime in which those delivering a public service, or who invite in or are made the subject of an inspection in the interests of public trust and confidence in their work, are expected directly to cover the costs of their inspection. Surely, in some cases an inspection will be called amidst quite serious financial issues or challenges. This idea that those opening themselves up to scrutiny in the public interest must pay for the cost of such transparency seems decidedly odd to me, even bearing in mind the parlous state of Home Office finances at the present time.
It also seems to me to be the most bizarre disincentive to those on the panel or on the commissioner’s staff who are considering whistleblowing on what might be significant issues of public interest or concern. A whistleblower or concerned panel member or local policing body member would have to gain pre-emptive approval for the costs of a possible investigation from someone who might be implicated in the very dubious activity that necessitates the inspection.
This parcelling of costs on to the petitioner for an inspection feels wrong to me on a very instinctive, but also on a very practical, level. Surely the Home Office should be seeing fit that the costs of HMIC’s absolutely essential work should be met by a Home Office grant. It would seem to be neglect approaching a dereliction of the Government’s duty to do otherwise. We have proposed that this apparently ill suited new subsection (2BB) should be replaced by a positive power for the panel that it should be able at any time to request that HMIC carry out an inspection of the PCC.
No one will be more aware of the PCC’s action or inaction in some areas than the police and crime panel since it is designed as her or his safeguard and strict check and balance. However, while the panel will be equipped to oversee the PCC in most areas, it may feel that there are issues on which it lacks a professional operational judgment on a matter of controversy. In such circumstances, it may not be appropriate to pull the chief constable into what could amount to a difference of opinion with the PCC. Who then can the panel turn to for that necessary professional advice and impartial opinion?
Finally, there should be a direct and clear ability, and a responsibility on the panel, to be able to involve HMIC appropriately. HMIC could, of course, take a view that it was being asked to get involved in a petty or irrelevant matter and could decline the invitation. However, we anticipate that this referral mechanism to HMIC will provide a helpful bridge to practical improvement for many forces facing difficulty in the future, as it so often has in the past.
My Lords, all I would like to say on the amendment is that we have discussed in previous debates the inconsistency between different parts of government in relation to inspection. I must declare my interest again as chair of an NHS foundation trust and as a consultant trainer in the NHS. NHS foundation trusts, which the Government support, were meant to be given much more freedom than other NHS bodies but they are still subject to the tender mercies of a regulator called Monitor. For the life of me, I cannot see why the Government have taken such a light-rein approach to the construct in the Bill when we have such an excellent inspectorate in the form of HMIC. These amendments seem wholly constructive. By the grace of the usual channels, we have been given a little extra time—a day—to consider these matters. Is this not a matter which the Government might take back and consider?

Lords ChamberMy Lords, I have a couple of brief points to make about Amendment 102, and particularly Amendment 104 to which I have added my name. First, I welcome the fact that the Government have shown that they are willing to listen to some of the concerns expressed in Committee and I am genuinely pleased that they have moved to two-thirds the majority required to exercise a veto. I am inclined to agree with the noble Baroness, Lady Henig, that a simple majority might be even better. It would certainly strengthen the role of the police and crime panel, which I think we all agree is essential. Hopefully, when taken in conjunction with earlier amendments about a more collaborative approach, this would guard against too capricious an attitude by the panel, having helped develop the proposals in the first place. I support this amendment but I am concerned about the issues raised by the noble Baroness, Lady Henig, about the relationship between this Bill and the Localism Bill in relation to the precept and referendum arrangements. I agree that this needs to be clarified. I hope that my noble friend the Minister will be able to provide reassurance on this point.
My Lords, we have had a series of debates during the passage of this Bill about the role of the police and crime panel in scrutinising the performance of the police and crime commissioner. The Minister herself has emphasised on a number of occasions the importance of the panel in doing that.
For these panels to do their jobs effectively, they surely have to have a certain amount of leverage. This Bill in effect gives them only two levers; they can veto the appointment of a chief constable, and they can veto the precept that the police and crime commissioner wishes to set. Of course, on other matters it can be consulted and there can be dialogue, but it is very clear from the Bill that the elected party political commissioner can ignore completely any input from the panel unless it exercises the veto. In the past few days we have seen one of the products of a weak regulator, the Press Complaints Commission. That surely shows the problem of having of weak regulators with very few levers. My concern with these new arrangements is that we are establishing police and crime panels inevitably to fail because their influence over elected police commissioners is likely to be limited. The veto in the original Bill was set at a very high level indeed, with a 75 per cent requirement of the members to vote in favour of veto. The Government hinted in the other place that they would be prepared to reduce it and we now see the product of that in the amendment that I am sure the noble Baroness will speak to in a moment.
The question is whether a two-thirds veto is sufficient. Like my noble friends, I do not think it is. To be effective, the police and crime commissioner must surely feel or fear that if he or she were to go too far there would be a risk that the panel would veto his or her proposals. I am speaking here about the precept.
To get a two-thirds majority of the members still places the bar at an impossibly high level. That is why I very strongly support my noble friend and I have tabled an amendment along the same lines calling for a simple majority of those present and voting. The phrase “of those present and voting” is well known to all noble Lords who have taken part in public life. Remarkably, it is not to be found in the Bill. The veto requirement refers to the members of the panel. I very much support my noble friend Lady Henig in wishing to ensure not only that a simple majority is required but that it should be of the members present at such a meeting. I have also laid an amendment to Amendment 103 of the noble Baroness, Lady Browning, so even if the House settles on two-thirds as the majority figure, it ought to be of those members present and voting.
Maybe I have confused the wording of the amendment because I see the noble Baroness perhaps assuming that that is what it says. My reading is that it is two-thirds of the membership.
My Lords, I am pleased to support Amendments 106 and 116, and I want to add my voice briefly to that of the noble Baroness, Lady Henig. I am concerned that we really do not have the proposals about the composition of panels right at the moment.
In the first place, I feel very uncomfortable about all the powers of mandation for the Secretary of State in this section, and I am rather inclined to agree with the noble Baroness, Lady Henig, that mandation is perhaps the wrong response to the problems that have arisen in relation to panels. It does not sit well with the direction we have all agreed is necessary about strengthening the role of panels to have this juxtaposed with greater central powers to determine how those panels are to be made up.
I am also very concerned about getting the political balance right, and I agree that in being unclear which objective is most important in reaching the balanced appointment objective in relation to panel membership these issues will be fudged, and we will end up with little balance at all. In my time as chair of a police authority and a member of the Association of Police Authorities, we spent many hours working precisely on getting this particular problem sorted out, and indeed we now have a much better system within police authorities than is proposed in this Bill.
I have other questions on this point. How will we know what considerations have been included locally—I stress locally—in reaching the balanced appointment objective? Who is going to check this? What powers exist to do anything about it if it is not balanced? I am very concerned about diversity among panel members. It is important that panels should try to reflect the populations they serve, otherwise the public, and particularly those sections of the public that are usually excluded, will question whether their representatives understand the issues that matter to them. This is especially important in the policing context if we take into account all the experiences, from Brixton onwards, that have taught us that it is vital to give people a voice in how they are policed.
In this regard, the Government’s proposal that there should be more co-opted members is helpful, but I agree with the noble Baroness, Lady Henig, that it is unlikely to improve diversity if these additional co-optees are local authority members, as seems to be proposed. We certainly found that in our own police authorities. There is a danger that this will simply be perceived as jobs for the boys—or, for that matter, for the girls—so the government amendment, although welcome, should go further and provide for more independent co-opted members.
My Lords, I am slightly puzzled by the Government’s stance on the question of political balance as far as these panels are concerned. When I was first elected to a local council in the 1970s, it was the customary practice that authorities with a majority for one party or another made sure that they packed the committees. That was the norm whether the authority was Conservative controlled or Labour controlled and, for all I know, it was the same in Liberal-controlled authorities. The Conservative Administration under Margaret Thatcher took the view—on this instance, they were right—that it was better that committees of local authorities, and subsidiary and external bodies to which local authorities appointed, should reflect the appropriate political balance, to reflect the wishes of the electorate.
In constructing these panels, the Government seem to be setting that aside. Why, in the Bill, are they repudiating the legacy of the noble Baroness, Lady Thatcher? Why are they so opposed to having proper political balance to reflect the different strengths of the political parties in particular areas as far as policing and crime panels are concerned? This is precisely an area in which the Government should want to ensure that there is political balance rather than perhaps leading to one-party domination of the way the panels operate.

Lords ChamberMy Lords, I support some of the amendments in this group, to which I have added my name: namely, Amendments 117, 144, 154, 156, 232 and 232A. As we have heard from the noble Baroness, Lady Henig, all these amendments deal with the conduct of PCCs, panel members and audit matters. As we have heard, details on these are virtually absent from the Bill except for very limited PCC complaints matters set out in Schedule 7, which is largely predicated on a criminal standard. In my opinion, this is utterly inadequate for a public position where many other types of inappropriate but not criminal behaviour could arise, so our proposal is to delete Schedule 7 and rebalance the way complaints are dealt with.
The proposals in relation to audit committees are consistent with established good governance principles and provide an additional reassurance about probity, particularly in light of the concerns about corporations sole, about which we have heard so much in your Lordships’ House. The amendments require police and crime panels to set up independent sub-committees to deal with both complaints and audit issues on behalf of the panel. The noble Baroness went into detail about those, so I will not try to emulate her. They also enable panels to require information from PCCs and chief officers in relation to complaints and audit matters.
Amendments 156, 232 and 232A propose that a code of conduct for police and crime commissioners and panel members, collectively referred to as police commission members, is drawn up independently. It also provides for both PCCs and panel members to be disqualified from office if they fail to sign the code of conduct. Amendment 144, in my submission, should have been dealt with in the fifth group, but it appears here. It provides that panels should be able to require information from both forces and PCCs about complaints and audit matters. Amendments 232 and 232A also provide that panel members and PCCs should be disqualified for failing to sign the code of conduct within a month. These are sensible and practical amendments, which I support wholeheartedly.
My Lords, it has already been pointed out that under the current terms of the Bill, the powers of the police and crime panels are limited to a veto over the appointment of the chief constable and a veto over the precept. The purpose of this group of amendments, moved by my noble friend Lady Henig, is to provide police and crime panels with the powers to act as a much more effective check on the way the proposed police and crime commissioners exercise the considerable powers given to them under the terms of the Bill. As my noble friend Lady Henig has said, the main amendments refer specifically to conduct and complaints, and to the issues of accounts and audit.
The amendments provide for an independent sub-committee or sub-committees to deal with the issues of conduct, complaints and audit, with an independent person chairing the sub-committee, at least three other independent members and up to another three who are police and crime panel members, at least one of whom must be a co-opted member. These independent sub-committees must be established by the police and crime panels.
The amendments provide also for a police and crime panel to require information it needs from the police and crime commissioner and they would change the criteria relating to the powers to suspend the police and crime commissioner to include where the commissioner has breached any required standards of conduct pending investigation of the allegations brought against them. The amendments provide also for a code of conduct for police commission members to be formulated by the Committee on Standards in Public Life, covering standards of behaviour, commitment to equalities and conflicts of interest.
The amendments proposed by the Government, to which the Minister will presumably refer, appear to lack the strength and robustness in relation to police and crime panels of those proposed by my noble friend Lady Henig and the noble Baroness, Lady Harris of Richmond. As has been said, those amendments come back to the issue that has been raised on a number of occasions during our discussions on the Bill: namely, where are the checks and balances to address the abuse or misuse of the considerable personal powers given to the police and crime commissioners? What is the effective role and purpose of a police and crime panel if it is not to be able to provide part of those checks and balances and thus help ensure that a police and crime commissioner pays regard to the views and concerns of such panels, providing them with the information they need to carry out a meaningful role and thereby helping enhance confidence in the system and structure on the part of the public?
If the Government have really been listening to concerns expressed in your Lordships' House, including over appropriate financial and ethical governance arrangements, they will support the thrust of these amendments.

Lords ChamberI speak briefly in support of Amendments 108 and 111 tabled by the noble Baroness, Lady Henig. I must say that it is without much hope of any movement, as we have seen most of the evening from the Government. Much of the debate and many of the negotiations between the Government and Peers who have expressed concern in Committee have been focused on checks and balances and getting the role of the panels right. I am grateful that the Government have accepted that a more co-operative approach is needed through the amendment that the Minister is about to put forward, which I welcome.
However, I agree that some greater description needs to be included in the Bill about what a co-operative relationship looks like in practice. I therefore support the more detailed amendments tabled by the noble Baroness, Lady Henig. The proposal that the panel should be involved in some of the really key functions brings some important clarity to what this might involve, particularly around shaping the police and crime plan, the budget that will help to deliver it and the precept that will need to be raised locally to support it.
I also welcome the role envisaged for panel members at a more local level in helping to engage with communities and monitor force performance. This, of course, goes back to concerns that the PCC is too big a job to be able to engage in detail at very local level on a consistent basis; and I think it is helpful to suggest that the panel should do so. This would enable it to bring concerns and issues to the attention of the governing body, as well as adding to the sources of information available to the panel to assist in its scrutiny of the PCC. I believe that these are helpful suggestions to assist in drawing out how the role of the panel can be strengthened, and I support them.
My Lords, this has been an interesting debate with slightly curious groupings. I think I should take out my Amendment 109A, which relates to a review by the panel of the police and crime commissioner’s human resources policy. I do not think it belongs here. It might be better taken when we reach Schedule 15.
There is a theme in relation to most of the other amendments in this grouping around the role of the panel in relation both to the public and to the precept. My noble friend Lord Beecham is absolutely right. The precept is a significant proportion—between about 11 and 13 per cent—of the total council tax. We debated this in Committee and I know that when we get our council tax information, we have different leaflets in relation to different bodies. However, my noble friend is right: because of the significance and the fact that this is made by one person, it should be completely separate and completely separately identified. That would discharge more effective public accountability.
In previous amendments, we have debated the role of the PCC, and noble Lords on the government Front Bench have rejected many amendments because, for instance, when it comes to requiring chief constables to appear before the police and crime panel or the equivalent in London, it is argued that that blurs the line of accountability. I think that unless you have completely separate precepts, that also blurs the line of accountability when it comes to raising resources from council tax payers.
My Amendment 96A reinforces the requirement for openness in relation to the precept. I think it quite extraordinary that local authorities are not going to be consulted formally on the precept that the police and crime commissioner proposes to make. The Minister will no doubt say that that can be done through the panel. Of course the panel exists to provide scrutiny, but given the importance of the precept, I think there is a strong argument that each individual authority ought to be consulted as well. I hope the Minister will be sympathetic to that.
My noble friend Lady Henig made some very important points in relation to the panels and the question of public meetings. Her amendments link the panel to local areas. West Midlands Police force, which covers the area from Coventry to Wolverhampton, will have one person to be elected the PCC. There is a risk that some of the great work that has recently been undertaken by the police force to develop links at the local level will be dissipated, and the role of the panel to reinforce those links would be very valuable indeed.
The government amendment essentially states that the responsibilities of the panels must be exercised with a view to supporting the effective exercise of the functions of PCCs. It is a tribute to the draftsmanship of parliamentary counsel that such an anodyne amendment could be put forward. It is, of course, completely meaningless because who is to say whether what a PCP does is exercised with a view to supporting the effective exercise of the functions of PCCs? Unless we find ourselves in judicial review territory, I presume that this will never be tested. If I were a panel chair, I would, of course, always argue that everything I did was about ensuring the effective exercise of the functions of the PCC. I think we should congratulate the Government on their ingenuity, but I hope the Minister will confirm that it is meaningless.

Lords ChamberMy Lords, I will speak to Amendment 47 in this group. I apologise that I was premature in attempting to speak to this amendment an hour or so ago, having failed to notice that, in between the draft groupings and the final groupings, there had been some slight changes.
I particularly note the Minister’s Amendment 43 on behalf of the Government, which specifies that the local policing body must have regard to the priorities of the other statutory partners in developing policing plans. That is very welcome, and it begins to improve linkages with community safety partners. However, like the noble Baroness, Lady Hamwee, I still think that there are gaps in the landscape and that the Bill proposals could be further strengthened.
Amendment 47 suggests an active role for police and crime panel members in community safety partnerships, and it specifies that a panel member must sit on each such partnership within their area. The idea of this is to enable the panel to influence the strategic priorities of those partnerships before they are set, and to provide information to the panel and the commissioner to ensure that the policing family plays its part too.
It is all very well to say that the local policing body must have regard to the priorities of other partners; but what if these were at cross-purposes? Having a panel member in the partnership would enable an intelligent dialogue to take place and would enable that panel member to pick up on concerns before they became major problems.
The Minister is right in what he said earlier about this crucial set of relationships between CDRPs on the one hand and the commission, as we have it, on the other hand. However, I do not want this to be a discussion just about generalities, and it would be nice if this happened or that happened. Ultimately, all this is about better engagement. It is about trying to get an improved response on behalf of local communities. We are looking to try to get a system that works well for local people.
I recall that in Committee this House expressed real concern that one person, in the form of a commissioner, could not undertake the kind of in-depth engagement that 17 members formerly did, and that there was a real risk that they would be perceived as remote, not just by electors but by the many other bodies—public, private and voluntary—that work with the police. If the commissioner is going to find it very difficult to get round all the CDRPs, who can do it instead?
I think that the Government broadly agreed in their recently tabled amendments that the role of the panel must be as much about supporting the commissioner as about scrutiny. My amendment is a way of letting the panel develop a supportive role in practice. We keep hearing about the panel being supportive and about stricter checks and balances, but I am trying to get the panel to play a stronger role in practice. We know that membership of community safety partnerships would be one way for panel members to help to make this ambition effective and to get panels to be more supportive and play a more practical role.
We know that the police alone cannot solve all local problems that could arise. That is why community safety partnerships were set up in the first place. If we allow local policing bodies to become disconnected from the wider community safety partners, we will go back 15 years to the kind of silo thinking that saw record levels of crime at the end of the 1990s. I cannot believe that that is what the Government want.
It might be salutary if I remind the Minister that police authorities were not originally among the bodies required to be on CDRPs when they were established. Over time, it was found to be an error and was changed so that police authorities became statutory partners. Indeed, police authority members became among the most dedicated and active members of the partnerships. The reason was that it was a good source of two-way information. It was not just that police authorities, and now police panels, would get information back. Their presence was very much valued at district level both by local councils and divisional police officers. That system is working as we speak and I would be very reluctant to see it disappear.
I understand that the concept was not invented here. The charge has often been levelled at police forces up and down the country that they are very reluctant to introduce things that they have not pioneered or invented. I feel that the Government face the same danger here. They are trying to set up a new policing arrangement. I understand that, but there are lessons to be learnt about what has happened in the past 15 to 20 years, and we need to be prepared to learn them. My amendment attempts to restore a link that will otherwise be lost. I am trying to enable panel members to keep their pulse on the local landscape and ensure that both the panel and the commissioner are aware of developments, are equipped to understand problems and are able to co-ordinate effective joint action. Once again, I am trying to be constructive and to assist. I am absolutely certain that in the years to come, sooner or later the links will be restored. They have to be, because it is common sense. That is the way in which things will work at local level; it is just a question of making the change now rather than later.
My Lords, I do not know why I did not put my name to the amendment of the noble Baroness, Lady Henig—I ought to have done—but I will say a few words in support of it. First, I welcome some of the government amendments in the group. I will single out Amendments 35 and 43. Amendment 35 deals with ensuring that every responsible authority in the context of community safety gets a copy of the police and crime plan. Amendment 43 ensures—going back the other way, as it were—that local policing bodies must have regard to the priorities of local partners. I agree with the noble Baroness, Lady Henig, that the Bill could go further. Therefore, I will say a few words in support of her amendment.
The Crime and Disorder Act 1998 is widely regarded as one of the best and most effective pieces of legislation passed by the previous Administration in their early years. It has made a huge difference to the way that local crime and anti-social behaviour is tackled. It is no accident that the general reduction in crime that we have witnessed in the past 15 years began at about the same time as the partnerships were put in place. Therefore, it seems strange that the Government appear less than enthusiastic about maintaining the link between the partnerships and the new police governance mechanisms.
It is particularly strange when one considers that the PCC’s role will include a vastly increased remit in relation to partnership bodies in other areas, such as criminal justice. Community safety partnerships seem to me to be the key fulcrum around which local engagement and local solutions are brought together. Why on earth we are disconnecting local policing bodies from these partnerships when they should be an asset to improving the effectiveness of local policing and partners, I really do not know. The noble Baroness, Lady Henig, is right to suggest that panels should be represented on community safety partnerships to preserve this relationship and I certainly support her amendment.
My Lords, I speak in support of the amendments, to some of which my name is added, which deal with delegation.
The amendments are all about ensuring that all senior police force appointments at and above the rank of assistant chief constable will remain with the governing body, as is currently the case. I envisage that as being the PCC but with a strong role for the police and crime panel from the interview stage onwards. In the case of senior officer appointments other than the chief officer, they specify that the chief officer of the force must be included on the interview panel, and therefore have a role in appointing his or her senior team. I certainly agree that the chief officer alone should not be able to appoint senior members of the team.
Moving on, the amendments state that the responsibility for senior officer conduct and complaints should rest with the governing body, the PCC, with the PCP taking a strong role. It is absolutely unacceptable that police officers decide whether to investigate their close colleagues. That is neither transparent nor proper.
During my time as chair of my police authority, I had to deal with some serious matters touching on the conduct of a chief constable. I could not possibly have dealt with the matter on my own. Even with legal help and support, we needed to work together as a body to come to a reasoned conclusion. As it happened, the legal advice that we were given was wrong, so imagine how I would have felt if I had had to take sole responsibility for making such a decision. Having the panel being supportive—indeed, helping to come to difficult decisions—will be by far the best way to deal with often tricky circumstances. I support the noble Baroness’s amendments.
My Lords, I am conscious of the hour and the fact that our Benches are filled to hear this debate, but this is a very important group of amendments. My noble friend Lady Henig and the noble Baroness, Lady Harris, have raised some important points about that come back, really, to the consequences of having a corporation sole, in which one person has enormous power and responsibility.
My amendments relate to the powers exercised by the police and crime commissioner. Under Clause 39, “Appointment, suspension and removal of chief constables”, huge authority is given to the police and crime commissioner to appoint a chief constable and to require their suspension, resignation or retirement. When it comes to the appointment, there are some safeguards, because the police and crime panel has a veto power on the appointment. We may disagree about the number of the panel voting in favour, but it has a veto power. When it comes to suspension, retirement or requirement to retire, the safeguard is much less. Although the police and crime panel can undertake a scrutiny process, as set out in Schedule 8, in the end, the police and crime commissioner can ignore the panel's recommendation.
My worry is that the police and crime commissioner who is seeking re-election when year two or year three is coming up and who is in some trouble may well consider sacking the chief constable as a visible sign to the public that he or she is doing something. There are circumstances—my noble friends have hinted at them—where that would be a jolly good thing to do, but at other times it will not; it will be a political action by a police and crime commissioner. Where are the safeguards? In the end, there are none because, whatever the panel says, the police and crime commissioner can ignore it.
I have a series of amendments which relate not only to the chief constable but to the circumstances where the same may be required of other chief officers and also to the situation in London. Essentially, this provision should apply only where it can be shown: that there is good reason—in other words, that it is in the interests of the force, for reasons of efficiency or effectiveness; that there has been appropriate consultation with the chair of the police and crime panel; that there has been proper investigation of the circumstances leading up to such an action; and that the approval of the Secretary of State is given. If Ministers consider that that gives the Secretary of State overweening powers, I must say that I have not been persuaded that the essential nature of the tripartite arrangement—the role of the Home Secretary, the police authority and the chief constable—should be so torn up that there are no safeguards to be undertaken by the Home Secretary if the police and crime commissioner decides to take such an action where, as I said, there is virtually no effective scrutiny other than the PCP recommendations.
This is a very important group of amendments. There is unease about the power to be exercised both by the police and crime commissioner in relation to the chief constable and other senior officers and then by the chief constable in relation to those employed by him as a corporation sole. We would look to the Government to recognise those concerns and to give some reassurance.

Lords ChamberAs my noble friend Lady Hamwee said, I have an amendment in this group—Amendment 225ZA—which seeks to add to the list of threats to public safety specified in Clause 79 against which the police must devise a coherent strategy a threat to the welfare of children.
The important role that the police carry out in child protection processes was emphasised in the 2009 Laming review. On the second day in Committee on this Bill, the noble Lord, Lord Laming, who is not in his place, spoke about the role of the police in relation to child protection. His comments highlight why my amendment is important. He said that,
“it is important that the standard of the child protection service is maintained. To achieve this will require determined leadership, and police constables should be left in no doubt that they have a continuing and prime responsibility to tackle the abuse, neglect and exploitation of vulnerable children”.—[Official Report, 18/5/11; col. 1421.]
A democratic process for electing police commissioners will not guarantee that the protection needs of the most vulnerable are considered. Many of the people, including all children, who rely on the police for protection will not be afforded the right to vote for the police commissioner. Including this short paragraph in the Bill would give those children a voice. Domestic abuse, rape, child abuse investigation, honour-based violence, the monitoring of travelling sex offenders, female genital mutilation and forced marriages are all areas of policing that are unlikely to be identified as local policing priorities by the general population who will be voting for the commissioner. However, they are vital. Unfortunately, they are unlikely to appear in the manifesto of anyone seeking election to the post of police commissioner. That is the reason why I would like to see this issue specified in the Bill.
My Lords, in supporting my noble friend’s amendment—my name is added to Amendment 225ZA—I remind the House that the Home Affairs Select Committee in its December 2010 report, Policing: Police and Crime Commissioners, stated that it saw,
“merit in the suggestion that there be a set of national priorities to which Police and Crime Commissioners should have regard when setting local goals”.
This amendment would help to ensure that child protection is prioritised by police and crime commissioners and would grant the Home Secretary powers through the strategic policing requirement to ensure that that was the case.
The NSPCC strongly supports this amendment and maintains that there should be a provision within the strategic policing requirement to promote the welfare of children as defined in the Children Act. While we are talking about the wider responsibilities that the police and crime commissioners will have and will need to take cognisance of, I should tell the House that I intend to bring forward an amendment on Report that will address the equally important matter of ensuring that victims of crime are properly considered. My noble friend Lady Hamwee has already spoken about victims and I want to reinforce her concerns. Yesterday, I met the Victims’ Commissioner, Louise Casey, and was deeply concerned to hear that victims of crime have absolutely nowhere to go if they wish to make a complaint or, indeed, ask for advice about what they should do. The police can, of course, ignore low-level crime. It is important that the PCC is properly apprised of the responsibility to look after victims of crime as well as the desperately vulnerable children whom this amendment addresses.
My Lords, I must apologise to the Committee for not being here when Clause 5, on the requirement on the police and crime commissioners to issue police and crime plans, was discussed. Had I been here, I would have referred to Clause 79, on the strategic policing requirement. The police and crime plans, whoever draws them up, must always be an amalgam of national, international and local policing requirements. It is always going to be a difficult balance to decide which of those has priority and how the resources are to be allocated to them. That is one of the reasons why I have always been a supporter of the dissenting comments of Dr Goodhart in the 1962 police commission on the need for a national police force to cover the fact that crime does not observe local boundaries.
The time has come to look nationally at these issues and then to make certain that they are covered properly. The question is who will cover them. You could be forgiven for thinking that the proposal for elected police commissioners in areas around the country is putting the local policing issue at the top of the pack. Is that actually so? The Home Secretary, quite rightly, will insist that international terrorism or international drug dealing, for example, are given due recognition. What worries me is that I do not see this issue being resolved by the Bill as drafted or the guidance. I had hoped that I might have found it in the draft protocol. It states that local police commissioners have the,
“legal power and duty to … set the strategic direction and objectives of the force through the Police and Crime Plan … which must have regard to the Strategic Policing Requirement set by the Home Secretary”.
That does not resolve the issue, either.
My concern is that the person who will lose out, if we are not careful, is the person who will have to carry the can through the heat of the day—the chief officer of police or the chief constable. To my mind, there is only one person in an area who should draw up these plans—the chief constable. It should be done necessarily in draft and then it should be cleared with those who have to provide the resources. However, it should also be cleared with those with responsibility for influencing the balance between the international, national and local requirements of policing in that area. We will be doing a great disservice to the chief constables and chief officers of police if we do not make that clear and if we set them the problem of having to resolve something that is not resolvable, with a whole lot of competing people around them who may not necessarily come together in a way that will resolve the matter. This issue is too important for the public to be left not properly resolved.

Lords ChamberI intervene briefly on this issue of voting systems to register a counter-case with the Government, in case they are minded to carry out the work suggested by the noble Lord. Under the AV system that the noble Lord proposes, outsider and fringe candidates can win. That is why the supplementary vote has been selected. It concentrates the mind of the elector on voting for mainstream front-running candidates. The danger under AV is that outsider and fringe candidates will end up winning, which means the BNP. The AV system for the election of these commissioners would be extremely dangerous. I counsel very strongly against it.
My Lords, I speak to Amendment 234ZZF in this group, which relates to the provisions about transfer schemes in Schedule 15. The Bill currently enables the Secretary of State to direct only a police authority to make a transfer scheme. My amendment would change this so that the Secretary of State could also direct a PCC or MOPC to make a transfer scheme. Effectively, therefore, this amendment would allow the creation of secondary transfer schemes after PCCs and MOPC are put in place. Let me explain why this is necessary.
This schedule currently expects a police authority to make a transfer scheme before it ceases to exist. In making that scheme, the police authority has to decide whether to transfer the assets and staff concerned to the PCC or the chief constable, or—in the case of London—to MOPC or the Commissioner of the Metropolitan Police. There is no second bite at this cherry in the Bill. If the authority does not get it right, the arrangements cannot be changed at a later date. The transfer of land should not be a problem. The Bill envisages that only the PCC may own land. The transfer of contracts may be slightly more complex, but generally the Bill envisages that these will be transferred to the PCC. Following the Minister’s assurances in the previous Committee session, it is likely that chief officers will be able to enter into contracts in their own right only in relation to employment.
The real nub of the problem is people. Given that the police authority currently employs all staff, whether they work for the authority or the force, to whom will the authority transfer these staff? The Bill clearly intends that the chief officer should be able to employ staff within the force. Whatever concerns we may have about the police reform proposals, or the proposals to give chief officers a status as corporations sole, it is in everyone’s interests that we get the transition arrangements right. This is especially important in our current climate of great upheaval and the various pressures on the whole of the police service. Which staff should chief officers be given? Perhaps they should be given those currently employed in the force, but, of course, it is not that simple; it never is. The reason for this is that many staff within the force are from time to time asked to prepare work to assist the police authority. This might be in relation to preparing reports on police performance or assisting the authority with an engagement exercise or a communications campaign. It might relate to providing information about force professional standards or risk assessment that sits behind the development of police plans.
Technically, under Section 15 of the Police Act, only police staff employed to support solely the force and not the police authority are under the direction and control of the chief officer. Perhaps we should transfer only those people under the direction and control of the chief officer, but again it is not that simple. Those employed to support the police authority, even if it is only a small part of their job, are technically under the control of the authority. Many of these people might be more appropriately transferred to the force, but in any event I suspect that few authorities have undertaken the complex exercise involved in working out which police staff are under their control and not the control of the chief officer. There has been little need to do so in the past and it is not likely to seem like a good use of time and resources to do so. Most authorities, therefore, will not have a readily available list of people to include in a transfer order to the PCC.
To demand that authorities undertake this exercise now and become involved in potentially long, intricate and fraught negotiations between the existing authorities and their forces over who gets what will place an unnecessary bureaucratic burden on authorities and forces. This is particularly so at a time when they must deal with other challenges brought about by reform, the financial situation and additional calls on police resources such as preparing for the Olympics. Nevertheless, a PCC will expect to have access to the sort of expertise among his own staff that until now authorities have borrowed from their forces. This puts police authorities in the invidious position of having to second-guess what staff a PCC would want to support him. Will he want to put a particular stress on media and communications, say? We have heard a lot about what high-profile and powerful people these PCCs will be, so that is quite likely. If so, how many staff in the force communications department should be transferred to the PCC’s office? Might he want to keep an eye on police performance in case this affects communities’ perception of how effective he is?
A pragmatic solution would be to enable secondary transfer orders to be put in place. This is what my amendment seeks to achieve. This would allow the police authority to transfer either all staff or those staff who have dual roles to the PCC or MOPC initially and then to let the commissioner make the decision about which of those staff they want to continue to employ directly and which should be transferred to the chief officer’s employment. It would also allow any mistakes in the initial transfer schemes to be corrected at a later date. I realise that this is a technical area but it is very important. I look forward to hearing the Minister’s response.
My Lords, I fear that in the course of this Committee I have not always been entirely helpful to the Government, so on this group of amendments I will do my very best to be as supportive as possible. I echo the words of the noble Lord, Lord Campbell-Savours, about the choice between the supplementary vote and the alternative vote. I will not get into the merits of different voting systems as this House has already spent many happy hours doing that and the country has spent rather fewer happy hours doing the same. However, I should say that if the amendment of the noble Lord, Lord Shipley, were to be passed, a further anomaly would be created for London, because the Mayor of London is elected on the supplementary vote system, while the person fulfilling police accountability in London would be elected on a different system, the alternative vote, from that in the rest of the country. I offer that in the spirit of trying to assist government Ministers in refuting arguments about amendments.
My main reason for speaking on this group is to support the noble Baroness, Lady Harris of Richmond, in her Amendment 234ZZF. I suspect that this relates to something about which not a great deal of thought has been given in the drafting of the Bill, which ties the hands of an incoming MOPC in London, or an incoming policing and crime commissioner, commission or anything else outside the country. That is because the Government are saying that there is only one bite of the cherry and that the transfer of staff must take place before police authorities are abolished. That would be fine if we were talking about an extraordinarily long lead-in. It would perhaps allow time for much discussion and consultation. However, we are not talking about that.
If the Government get their way, the elections of policing and crime commissioners in the 41 areas outside London will take place next May. That presupposes that in all those areas the detailed work that the noble Baroness, Lady Harris, has described will have been concluded on time and that the Minister’s officials within the Home Office will have done it in sufficient time to provide the guidance that is spelt out in the Bill. I have, of course, enormous faith in civil servants in the Home Office, but I am conscious of the workload involved in saying exactly how this is to be done. If, as is the intention or aspiration, the arrangements change in London earlier than May 2012, it would mean doing all this work on an even shorter timescale in the largest police force in England and Wales. I am sure that everyone would do their very best to achieve it, but I am not convinced that the work would necessarily be completed in time for an order to be passed by the outgoing Metropolitan Police Authority by 30 September or any later date, if it is to go earlier than May 2012.
Even if it were possible to do this in practice, I have to ask the Government whether this is really their intention in the legislation. My understanding is that these new individuals are being created—the MOPC in London and the police and crime commissioners, or whatever we end up with, outside London in the rest of England and Wales—and you are then going to say to them, “Actually, it’s tough because all the staff you might want have been transferred already to the control of the chief officer of police”. I suspect that there will be some robust discussions about all this. There is the question of what sort of offices will be put around the MOPC and the PCCs outside London. There will be discussions as to which functions are properly the responsibilities of the MOPC or the PCC, and which functions are the responsibilities of the chief officer of police. Here is an arrangement whereby all those decisions will have been made by the time the MOPC comes into force or the elections for policing and crime commissioners—if there are any elections—have taken place in the rest of the country. I suspect that that is not what the Government want, and that any person elected as a police and crime commissioner outside London would want to make an assessment of the most appropriate balance to be struck and how that is to be done. At the moment, there is no provision to allow that to happen.
This simple amendment of the noble Baroness, Lady Harris, allows there to be, if necessary, a two-stage process. If in fact it is all terribly easy—if the difficulties I have identified do not exist, which I doubt, and it is obvious that all the differing candidates for police and crime commissioners in any locality are of the same mind as to exactly what office they want around them and it goes without saying that the Conservative Party candidate, the Labour Party candidate, and the Liberal Democrat candidate will have exactly the same vision of the shape of the office that they want to have around them in the PCC—it will be fine. In reality, I suspect that the Government are tying the hands of those in the new structures that they want to be so effective before they are even created.
That is why this simple amendment, which allows, if necessary, for a two-stage process or a staged process is extremely sensible.
My Lords, I am in awe of the multitasking skills of your Lordships’ House. I do not know when your Lordships manage to sleep. I must reiterate that the job is full time and not part time. However the role of a Member of your Lordships’ House is perceived by individuals inside or outside the House and whether it is regarded as a part-time or full-time requirement, the role of the police and crime commissioner is definitely full time in every sense of the word. In our debates on the amendments so far, we have discussed what a large role it is. We have had long discussions about whether the commissioners will get around their patch or have enough time for meetings with other bodies with which they will need to build cohesive relationships. Yes, they will, because it is a full-time job.
Perhaps I may explain the situation as far as your Lordships’ House is concerned. As I have said, if a Member of Parliament wishes to serve as a PCC, they would have to stand down as an MP. Given the role and the demands of the PCC, and the demanding job of an MP, there would be no way in which they could carry out both functions. It is right therefore that similar provisions apply to this House.
I think that this is where I was stopped last time—I do hope to get beyond this.
I beg my noble friend’s pardon but will she confirm that, if an MP decides that he or she wants to stand as a police and crime commissioner, they would have to resign before they decide that they want to stand?
Certainly, they would have to stand down at the point at which they put themselves forward for selection or they would have to give notice at that point. Once the period of the election for the police and crime commissioner begins, they could not have an interest in being a Member of Parliament. The point is that there simply is not time to do both demanding jobs. This is not about what other people do, how other people take on public appointments or how they perceive the time factors. The fact is that the role of the PCC is full time.
I should correct something that I have just said. Apparently, an MP would not have to resign and trigger the by-election until elected. If they were an unsuccessful candidate, they would not have to trigger a by-election. I apologise to your Lordships’ House. In a way, that is almost digressing from the point that I hope I will be able to make between now and 3 o’clock in the morning.

Lords ChamberIn moving this amendment, I shall speak also to Amendments 101B and 101C, Amendments 234ZZA to 234ZZE and Amendments 234R and 234S. I find myself at a bit of a disadvantage in that some of the amendments in this group are consequential, arising out of another group of amendments dealing with chief officer appointments, suspensions, professional standards and dismissals. The explanation of their effect will therefore be disconnected from the main body of the debate but I will outline their effect briefly and perhaps refer back to them when we come to the appropriate group.
Amendments 101A to 101C revise the proposals in the Bill in relation to the delegation of functions by police and crime commissioners. They would enable a police and crime commissioner to delegate functions to a police officer and to another local policing body—I will explain shortly why I think that this is necessary. They would also enable the appointment, suspension and removal of chief officers to be delegated to police and crime panels in certain circumstances, which are set out in a separate group of amendments that we shall come to later.
Amendments 234ZZA to 234ZZE deal with redefining the meaning of local policing bodies and elected local policing bodies in the interpretation part of the Bill. They would include police commissions in this definition rather than police and crime commissioners, as currently drafted. That would, of course, affect the use of these phrases throughout the Bill.
Amendments 234R and 234S affect Schedule 16 by reamending the changes set out in the schedule to the Police Reform Act 2002 dealing with chief officer appointments and like matters. As I mentioned, these are the subject of a separate group of amendments that I shall bring forward. The Bill as drafted removes the definition of “senior officer” and replaces it with “chief officer” in relation to the roles of local policing bodies in appointments and removals. My amendments would effectively revert back to the current position whereby the local policing body appoints all ACPO-rank officers, not just the chief officer.
I believe that my amendments in relation to the delegation of functions by the police and crime commissioner are important. Noble Lords will recall that, on the previous day in Committee, I argued that chief officers should not be corporations sole. I am not going to go over those arguments again but, if they are not to be separate corporations, some other mechanism is needed by which they can be given responsibility for the day-to-day management of police finances and other matters by the governing body. This would make it essential to be able to delegate functions to chief officers. At the moment, the police and crime commissioner cannot do this because the Bill specifically prohibits functions from being delegated to a constable. A chief officer may be a very grand constable, but he is none the less a constable and, as the Bill stands, cannot have police and crime commissioner functions delegated to him or her. As a matter of general principle, this prohibition lacks flexibility, as there may be other functions that the police and crime commissioner might want to delegate that can be more effectively carried out by the force than by the local policing body. As a specific matter in relation to the delegation of budgetary management, such delegation would be essential if the chief officer is not to be a corporation sole. I am, if you like, outlining alternative means.
My next amendment would remove the prohibition on delegating functions to another local policing body. This is intended to be used within the context of collaboration where it is currently not possible to formulate a lead authority model of collaboration—that is, where one authority deals with a particular collaboration agreement or a particular aspect of collaboration on behalf of other authorities. The Bill would continue this prohibition into the new model of police governance. That means not only that every collaboration agreement has to be signed by every party to it, but also that every one has to be managed by every party to it. This will greatly increase bureaucracy, so it would streamline the processes if one governing body was able to manage an agreement on behalf of the others. My amendment would enable this to happen. That seems a matter of common sense and good management practice, as well as a way of reducing the burden of administration in difficult financial times.
I suspect that the Minister sympathises with the desire to reduce bureaucracy but will tell me that this would be tantamount to abrogating responsibility for collaborative matters. He may also say that it could be used to abrogate responsibility for other types of functions, which could be disastrous. I do not think so. As I think I have mentioned, a delegation agreement is a tightly drawn document which is very specific about what functions can be delegated, in what circumstances and to what extent. It is not a casual carte blanche. However, if the Committee thinks that there are loopholes, I would be happy to consider putting conditions around this to ensure that it could be used only in the context of collaboration agreements, which is the intention of the amendment.
The third amendment in this group is effectively a consequential amendment to those on chief officer appointments, which fall in a different group to be debated later. It would bring consistency to an amendment that I am going to propose in that group, which is that in certain circumstances, where the police and crime commissioner has a conflict of interest in appointing, disciplining, suspending or dismissing the chief officer, the police and crime panel or police commission may undertake this function.
My next five amendments relate to earlier changes voted on by this House to create police commissions. They would change the definition in the interpretation part of the Bill so that the phrases “local policing body” and “elected local policing body” became synonyms for police commissions rather than police and crime commissioners. This would have a significant effect on the entire Bill and I hope that it more accurately reflects the intentions of this House in relation to the role of police commissions. The commissions having been created, the amendment would give them a significant role in police governance and funding throughout the Bill. Police commissions comprise both the police and crime panels and the police and crime commissioner, so giving effect to the more collaborative approach to police governance that I believe the original amendment intended. I know that time is short today and I shall not elaborate every area of the Bill that the amendment would affect, but I note in passing that, in my view, it would not affect the arrangements set out in the Bill in relation to London.
As previously noted, the final amendments in my name are effectively consequential on the group of amendments dealing with senior officer appointments. They would ensure that the local policing body retained police authorities’ current responsibility for appointing, disciplining, suspending and dismissing all police officers of ACPO rank—that is, assistant and deputy chief constables as well as chief constables. The Bill proposes that chief constables take this role in relation to deputy chief constables and assistant chief constables. I shall not take the time now to set out my arguments about why I believe that this is a mistake, but I shall certainly do so under a later appropriate group of amendments. Meanwhile, I beg to move.
I support the amendments put forward by the noble Baroness, Lady Henig. If many of us in the Committee are concerned about the unfamiliar concept of corporations sole and giving this status to chief officers, it makes absolute sense to look at alternative approaches. I would support an amendment that allowed a PCC to delegate certain functions for the management of police budgets and related issues to a chief officer.
I have been concerned in the past about the way in which collaboration agreements and arrangements work. I fondly recall putting forward some amendments about exactly that while the House was considering the then Policing and Crime Bill two or three years ago. They suggested that a police authority should be allowed to delegate certain responsibilities for managing collaboration agreements to another police authority, which is currently prevented. I complained at the time that this made managing better collaboration unnecessarily bureaucratic and burdensome. The same argument applies to PCC functions for managing collaboration agreements. I strongly support the amendments.
I also congratulate the noble Baroness on her amendments to the interpretation part. They are exactly the sort of thing that is required to give force to the more collaborative approach to police governance that I intended by my amendment creating police commissions. Amendments in the name of the noble Baroness, Lady Hamwee, and the noble Lord, Lord Shipley, suggest that a PCC and a panel should share responsibility for handling of force complaints and conduct matters. I support that, but the amendment in the name of the noble Baroness, Lady Henig, goes just that little bit further.
I am also happy to support the other amendments in this group to which the noble Baroness has spoken. However, as many of them relate to ACPO-rank appointments and complaints, and a later grouping deals with these matters, I shall speak in more detail at that stage.
My Lords, I am indebted to my noble friend Lady Henig for her amendments. As she said, some are consequential and some help with interpretation, particularly in relation to the vote on day one in Committee. I also share her concern about the corporation sole concept and delegation to chief officers and I welcome her proposal to streamline collaborative processes.
My amendment in this group, Amendment 211ZB, returns us to a matter that I have raised a couple of times before. It relates to one of the most bizarre provisions in legislation that I have ever seen before your Lordships’ House. Clause 62(2) states:
“The police and crime panel may appoint a person as acting commissioner only if the person is a member of the police and crime commissioner’s staff at the time of the appointment”.
Clause 62(1) states that the police and crime panel must appoint a person as an acting commissioner if,
“no person holds the office of police and crime commissioner … the police and crime commissioner for that area is incapacitated, or … the police and crime commissioner for that area is suspended in accordance with section 30”.
If we track back to Clause 30, we find the circumstances in which a police and crime panel may suspend the relevant police and crime commissioner. They relate mainly to whether a commissioner has been charged with an offence that carries a maximum term of imprisonment exceeding two years. We shall come back to the issue of whether two years should be reduced to six months, which it ought to be.
In essence, in circumstances where the commissioner is either incapacitated in one way or another or has been charged under the provisions of Clause 30, the panel is to appoint an acting commissioner who will be a member of the staff of that commissioner. This is extraordinary. Who will the people appointed be? I do not want to repeat what I said on our last day in Committee, but who will they be? Who will the commissioners appoint? They will be media people, because the commissioners will want to be re-elected and so a great deal of their focus will be on communications. We should look at the staffing. There is no control over the police and crime commissioners. There is no corporate governance and there are no non-executives; it is solely up to the commissioners whom they appoint. Clearly they are going to appoint people who will help them in their political endeavours—and yet it is suggested that, if the police and crime commissioner is no longer able to carry on in the job, a member of their staff will be appointed.
What would happen if a police and crime commissioner was charged with corruption and the sentence carried more than two years? What would happen if the senior members of the commissioner’s staff were also charged with corruption? Who then would the panel turn to? Even if it was only the police and crime commissioner who was charged with corruption—and, as we are giving so much power to one individual, with very few checks and balances, it is not impossible that one of the PCCs may find themselves in that situation—are we saying that the public would have confidence if a member of the staff of the person so charged were then to become the police and crime commissioner?
So far, apart from the issue of the memorandum of understanding and the clear hint that the Government are prepared to reduce the veto requirement on the precepts from 75 per cent to two-thirds, we have had very little give from them about recognising some of the serious concerns being put forward. On this one, surely the Government must think again.
My Lords, I support the proposals of the noble Baroness, Lady Henig, in this group of amendments to strengthen the functions of police and crime panels. These give some helpful detail on how the intent of my amendment to introduce police commissions could be carried forward. I particularly note how her amendments give additional depth to addressing the appointment of a PCC by the panel. I much enjoyed her discourse on how policing in Lancashire proceeded. It brought back some very happy memories of the authorities being non-political. Members were in a strict political balance from all over the area in which I was chair of the police authority. We also appointed the co-opted independent members, who made a significant contribution to the make-up of the police authority. Indeed, they provided the balance of geography, gender and ethnicity that the authority needed. We might not have managed to get that right if police authorities had been constituted by political membership.
I also welcome the obligation placed on the police and crime panel to assist the PCC, particularly in those matters where it has a power of veto. That is in line with the more co-operative arrangement that I had in mind in creating a police commission. I agree with the noble Baroness, Lady Henig, that the panel should have a role in oversight of issues that are very local in nature, ranging from monitoring police performance at divisional level to a more active responsibility for engaging local communities. I also very much approve of strengthening the role of the panel by reducing the voting majority required, as we talked about earlier, to exercise a power of veto, and of tightening up the way in which the panel manages its business and procedures. The Minister should carefully consider this set of amendments and the way in which the noble Baroness, Lady Henig, has proposed them.
My Lords, the noble Baroness, Lady Henig, has tabled a series of important amendments, so she should not apologise to the Committee for taking some time over them. They are extremely important and I hope that noble Lords will read Hansard carefully tomorrow to make sure that they understand exactly what she has said.
I agree completely that the standards of conduct to be established for the PCCs are utterly inadequate in the Bill as presently drafted. Her amendments to address them make absolute sense. I also agree that the current provisions are inadequate for some of the more politically motivated complaints that are likely to be made. Just because they are political, it does not necessarily mean that they are by definition spurious, although of course many of them may be. A proper and robust mechanism for dealing with them is essential, but the Bill does not currently provide for that. More serious in many ways, though, is the lack of clarity about how complaints from ordinary members of the public are going to be dealt with or how generally poor conduct is going to be handled. I congratulate the noble Baroness, Lady Henig, on the solution that she has set out. It manages to balance properly the independent oversight of these matters with an appropriate and stronger role for the panel. I therefore support the proposals wholeheartedly.
Moving on to senior officer appointments and dismissals, I agree that the final decision on these matters must rest with the governing body. It is not enough for only the chief officer to be appointed, disciplined or dismissed by that body; this must apply to the other senior ranks as well. I support particularly the concerns outlined by the noble Baroness about the negative impact that this will otherwise have on diversity in senior police ranks. I am therefore pleased to see that her proposals for appointing senior officers include a role for community representatives. That is to be warmly welcomed.
I wholeheartedly support the much stronger role that the noble Baroness proposes for police and crime panels in appointments, suspensions and dismissals of the top force team. This obviously guards against too much power being in the hands of one person and reinforces a more collaborative approach between the PCC and the panel, which is absolutely desirable.
I agree that it is not appropriate for the chief officer to be responsible for conduct and discipline matters for the other members of the senior force team. I share the concerns of the noble Baroness that this is asking for trouble and could easily lead to corruption. It seems to me that the provisions in the Bill relating to force corruption complaints and discipline must be changed. I agree completely that it cannot be appropriate for a serving police officer to stand as a PCC. How ridiculous that would be. It is much better for police governance that all former police officers must wait some time before they can become PCCs. The noble Baroness has suggested five years; I would make it life.
I also agree that the current provisions seem to discriminate unfairly by barring current police authority members from standing as PCCs. If councillors can stand without having to resign, police authority members should be able to do so, too. Any arguments about their possibly misusing the resources of the authority to aid their campaigns apply equally to councillors. In any event, as with local authorities, rules are in place for police authorities that prevent resources from being used in this way. I am concerned that this could lead to a number of police authority members resigning at a time when authorities need all the members that they have to deliver business as usual in a challenging financial environment and to deliver the successful transition that we all want to see.
My Lords, I apologise to those Members of the House who are keen to move on to the other debate, but I have to say that it is quite strange that we moved on at this point to this group of amendments, given their sheer number, complexity and importance. I am afraid that I have four issues to raise and, although I will abbreviate what I would otherwise have said, I think that they are important.
The first is that there must be a clear and robust framework for the conduct of people who are either elected police and crime commissioners or, in the case of London, the mayor or the deputy mayor responsible for policing and crime. The same applies to whatever other structure we may have, whether it be police and crime commissions or anything else. The reason why we must have a robust and clear set of guidelines for conduct is that potentially very serious problems could arise. Although provision is made in the Bill to deal with the most extreme examples, it does not cover the sort of things that are much more likely to happen. If an elected police and crime commissioner, having been briefed by a chief officer of police about a particular investigation, takes it upon himself or herself to telephone the subject of the investigation and talk to them about it, how will that be dealt with? Where are the guidelines and rules of conduct to say that that is not appropriate behaviour for such a person?
I find it extraordinary that there is no mechanism for dealing with such an event. I also find it extraordinary that there are no mechanisms for dealing with what are perhaps slightly less serious matters, or indeed for providing a framework so that the people who are elected understand what is and is not permissible. Things of this sort could happen, so there is a need for a robust and proper framework to deal with them. I am extremely grateful to my noble friend Lady Henig for tabling this group of amendments and for giving us an opportunity, albeit it at a rather inappropriate moment, to debate these points. There has to be a framework for conduct, whether it is the standard structure as set out in these amendments or something else. However, there must be an explicit code of conduct.

Lords ChamberMy Lords, I have added my name in support of Amendments 41, 42 and 46, which the noble Baroness, Lady Henig, has set out in very clear detail, so I will be brief.
These are important amendments to test the implications of chief officers being corporations sole. Like the noble Baroness, I am uncomfortable with chief officers being given a legal status as corporations sole, and I look forward to an explanation from the Minister outlining answers to some of the questions that have already been asked about what this means for accountability and corporate governance.
The alternative amendments here deal with limiting the status of corporations sole to powers of employment only. As I understand it, that would prevent chief officers from owning assets or entering into contracts not directly related to employment. I have to say that I also have some significant concerns about giving chief officers unfettered responsibilities for employment of police staff without any role for the governing body. At the very least the latter should have an oversight role in grievance and professional standards, or the chief officer will become both judge and jury in these matters. But I am sure we will return to this later in the Bill. However, I agree with the noble Baroness, Lady Henig, that the most objectionable aspect of the current wording is the role that chief officers could play in determining how huge sums of public money should be spent, for instance through entering into multimillion-pound contracts or borrowing money in their own right. I hope that my noble friend the Minister can reassure me on this matter.
My Lords, I shall speak to my Amendment 64B, which differs only in a minor fashion from one or two of the others, and in support of Amendments 66A, 67, 67B and 234A to 234Q, to which I have added my name. I want to say why all this stuff matters. It no doubt seems like a terribly arcane set of arguments, but I rather suspect that some of our discussions on this group of amendments will determine whether what the Government are trying to do on police accountability actually happens. The way that the Government have framed all this is a recipe to undermine police accountability rather than strengthen it. I am sure that that is not the intention, but I suspect we have ended up here almost by accident.
Let me explain what I mean: it relates to the amendments dealing with corporations sole. The Government have decided that it would be appropriate for chief officers of police and the Commissioner of Police of the Metropolis to have responsibility for the employment of police staff—a function currently carried out by police authorities. I think that is the wrong decision because it places too much power in the hands of a single individual. It is the argument that we have about policing and crime commissioners, and everything else. However, it is particularly difficult in a policing context.
There is a tendency among some chief officers of police to have around them a group of blue-eyed boys and girls who they see as their favoured supporters, and who they tend to promote in favour of others. One of the checks and balances that we have at the moment is that appointments at ACPO rank—commanders in the Met and assistant chief constables and above outside—are appointed by a panel from the police authority rather than simply on the decision of the chief officer of police. I am suggesting not that chief officers of police would use this power capriciously but that the temptation or tendency might be there. Having worked closely with a number of chief officers of police, I am well aware that some of them have extremely strong personalities and that they like to get their own way. This is about creating some checks and balances on those very strong personalities from getting their own way on every single occasion. It is going to be particularly important on employment.
It is actually a protection for the chief officers of police not to be doing this or not to be taking sole responsibility. I lose track of the number of instances where there have been complaints following appointment processes in the police service—the police are a particularly litigious lot. The complaints were about whether processes have been followed properly, whether there has been favouritism or whether individuals have been discriminated against. For a chief officer of police to be able to say, “Actually, this was done through a proper equal opportunities process and properly documented by the police authority” is an important protection. However, Ministers in their wisdom have decided that the employment function for police staff, as well as for the appointment of senior officers, should pass to the chief officer of police.
If that is the decision that the Government have taken, it is of course not too late for them to reconsider this matter. I do not believe that it runs to the centre of the main political headline that the Government wish to achieve by all of this, so they have that opportunity but they have made that commitment. To make that commitment work, as police officers have a particular status of being officers of the Crown, if you transfer responsibility for police staff across to chief officers of police you have to create the legal framework around which that can happen.

Lords ChamberMy Lords, in moving Amendment 31, for the avoidance of any doubt let me say that it was agreed by the Government that this amendment is consequential on my first amendment, which was agreed to on the first day of Committee, and I am most grateful for that.
I rise to support the amendment. Given that thus far with the amendments that have been moved there has not been that much sense of give in the Government’s responses, I would like to know what the thinking was on this provision. I find this whole area of the Bill quite extraordinary and quite out of line with anything else that I have experienced in policing or local government. Given that it is seen by many of us as an extraordinary suggestion, would someone explain where the idea has come from? It is so unprecedented, in my experience. If the response follows the same pattern as on previous amendments and the Minister stands up and tells us why the arguments that we are putting forward are not going to work and why what is being proposed is absolutely perfect and that therefore we should not be challenging it, in this particular case I would like to probe why this provision is in the Bill. It seems bizarre to a lot of people.
I support the amendments from the noble Lord, Lord Beecham, and my noble friend Lord Shipley. My first question is whether we need a deputy for the PCC. My contention is that it is absolutely essential and that that person must be chosen from within the police and crime panel, who will in the main have been elected by the local community. How utterly bizarre it would be for an elected PCC to appoint his or her deputy. That could be absolutely anyone from the PCC’s own staff, as the noble Lord, Lord Beecham, has outlined. What a recipe for corruption that might be. How will that person be chosen and what criteria will the PCC use to put so much political power into the hands of an unelected person? We absolutely must ensure that whatever befalls a PCC during its term of office, it must appoint a deputy from a properly elected body—the police and crime panel or, as I would prefer, the police and crime commission.
I support the amendment as well. I fear that the thinking behind this provision was like something that I explored at Second Reading. It is almost as if the police and crime commissioner will be contaminated, or his office will be contaminated, if he is in any sort of collaborative arrangement or anyone else is drawn into the ambit of the police and crime commissioner in any way. I, too, think it would be totally inappropriate for the police and crime commissioner to nominate his deputy. Therefore, I support the notion of a deputy, if there needs to be one, being drawn from a police and crime panel, or some other body with more legitimacy than just the touching of the shoulder—figuratively speaking—by the crime commissioner of someone who happens to be working within his office.
