If hon. Members will give me a moment, the shadow Secretary of State and I have always conducted our debates in the House with great courtesy, so in that spirit, of course I withdraw that. That is a good illustration of what today’s debate is really about. We could get into the detail of whether we are presenting something aligned to what he has previously said and whether the sense is the same, but today is about this House and the country coming together and moving on from these debates and the talks, although the real issue in the talks was some people’s desire for a second referendum, rather than a desire to get into the detail of how we could resolve the issues.

This is at least the seventh opportunity the House has had to avoid a harmful no deal. There were three occasions relating to the former Prime Minister’s deal; there was the European Free Trade Association; there was Norway; and there was the customs union. Does my right hon. Friend agree that it would be folly to let this final opportunity to avoid a damaging crash-out slip through our fingers?

My amendment suggests that there are three options for this House to vote for on Monday 21 October. The first is the withdrawal agreement as it was presented to the House previously. The second is the withdrawal agreement plus the cross-party agreement that was reached, but was never voted on in this House. The third is any new deal arrived at by the Government. In that situation, Members would have the chance to vote for a deal and prevent no deal, which many of us feel could have dire consequences.

My hon. Friend is coming up with such sensible provisions. Does he agree that this would smoke out those who claim to want to avoid no deal but, truth be told, vote against every route to avoid it? This would smoke them out. If they vote for this, they will truly be avoiding no deal.

My constituency neighbour is absolutely right, but my aim is not so much to smoke out—to use his phrase—the motives and underlying thoughts of colleagues across this House, but to give all of us the opportunity to say, ultimately, what we really prefer: is it a deal or is it no deal? In that sense, he is absolutely right.

I thank the hon. Lady for her concern about my answers. They were actually produced after Mr Speaker spoke—[Interruption.] Things move very fast in this place, as she knows. It is not currently our intention to have indicative votes, and I cannot be clearer about that. However, we are going to lay an SI to extend the article 50 period, and I have said that many times.

The Minister indicated that the basis for the extension will be determined following a debate in this House next week. That is the week beginning 25 March, and we are leaving on Friday 29 March. How can we be satisfied that there is sufficient time for the debate to take place, the application to be made and for it to be approved or otherwise in that time?

If my hon. Friend is asking me whether the timeframe is short, of course it is short. However, as I have said many times, the House voted last week to extend the article 50 process, and the Government will have to table an SI in order to do that. However, that has to be done after the March EU Council meeting, which takes place on 21 and 22 March. That is the logic behind the timetable.

I agree and I am grateful for that intervention. That is really the point. If it is not credible that we can leave on 29 March without a deal, and it is not, it is actually not a negotiating stance at all. It has never been seen in that way and it does not work. It is just farcical to suggest that we have to keep up the pretence that we are ready because then the EU will back down. It is ridiculous.

Let us put some detail on this. We have heard the warnings from Airbus and Nissan about future jobs and investment in the UK. Yesterday, Ford, another huge UK employer, said that no deal would be

“catastrophic for the UK auto industry and Ford’s manufacturing operations in the country”,

and that it will

“take whatever action is necessary to preserve the competitiveness of our European business.”

The right hon. and learned Gentleman is right to say that business wants certainty—he has made big play of that—but it was the CBI, the Federation of Small Businesses and GE Aviation in my constituency that said, “For goodness’ sake, back the Prime Minister’s deal.” He did not do that. He must understand that in failing to do so he and the Labour party become complicit in a crash-out.

Well, I am not going to take that lying down for this reason: on the Government Benches, did they vote for the deal on 29 January? [Interruption.] Hang on, hear me out. The answer to that is no. Anybody who voted for the Brady amendment was saying that it is conditional on change, so do not lecture anybody else about voting for the deal. Even the Prime Minister says, “On reflection, I’m not voting for my deal unless there are changes.” The hon. Gentleman really cannot throw the challenge across the House and say that the Opposition have to support the unchanged deal but the Prime Minister wants it changed.

Some on the Government Benches will casually dismiss the threat of job losses as “Project Fear.” It is not “Project Fear”—it is “Project Reality.” It is the jobs and livelihoods of those we represent that are at stake.

The hon. Gentleman has not been able to convince his own Front Benchers. Senior Opposition Front Benchers, such as the shadow Business Secretary, have spoken of the huge damage there would be to our democracy if we did what he advocates, which is to end the uncertainty by calling a second referendum. [Hon. Members: “Hear, hear.”] We hear the cheers from the Labour Benches. The policy in the manifesto on which Labour Members were elected was to honour the referendum, yet they cheer. It is on page 24 of the Labour manifesto on which the hon. Gentleman stood.

Does my right hon. Friend agree that there is a fundamental fallacy at the heart of the Opposition’s position? On the one hand they say that there is zero appetite on behalf of the European Union to renegotiate the Government’s deal, yet they claim there is somehow a huge appetite to negotiate another deal as yet unspecified. The reality is that unless they vote for this deal they will become the handmaiden of hard Brexit.

I absolutely agree with my hon. Friend. He alludes to the 78-day plan being put forward by the Opposition, which the EU has made clear is not credible, their sister parties have made clear is not desirable, and which I suspect many on their own Back Benches recognise is not doable. Yet they persist with it.

As the right hon. Gentleman knows, the Prime Minister will respond to the debate in the final speech next Tuesday. She has been talking to a number of European leaders in the weeks since this debate was postponed. She will obviously want to respond to the questions that the right hon. Gentleman fairly puts, either during her speech in that debate, or possibly earlier. That is the most I can commit to on behalf of my right hon. Friend this evening. I also say to the right hon. Member for Belfast North and his colleagues that there is certainly a recognition—indeed, an understanding—on the part of the Government of the concerns that they have expressed. We continue to discuss with him and his colleagues how we can seek to provide the necessary assurances about the Union that he is asking us to provide. I will make sure that my right hon. Friend the Prime Minister is aware of his wish to have a more detailed response to the points he has raised this evening.

I think it is worth the House reminding itself that the EU has an interest, just as we do, in bringing the backstop to an end quickly, should it ever be needed at all. Of course, the fear is often expressed, here and outside, that despite the legal obligation in the withdrawal agreement for the backstop to be temporary; despite the explicit provision in the withdrawal agreement for technology or other measures to be deployed to make the backstop superfluous; despite the duty to replace it as rapidly as possible; and despite, for that matter, frequent public statements by the Taoiseach, the European Commission and other leaders that they have no wish or interest in having the backstop as anything more than an insurance policy, we will still be trapped in it for many years, or even indefinitely. Ultimately, this boils down to a lack of trust within the United Kingdom in the good intentions of the European Commission and some member state Governments.

The irony is that there is a lack of trust of the United Kingdom on the other side of the table, too. One of the most striking developments since the withdrawal agreement was finalised and published has been the fierce criticism levelled at Michel Barnier by Governments in some EU member states. For them, the backstop, should it ever be used, would allow goods from the entire United Kingdom, including agricultural produce, to access the whole of the EU single market, without tariffs, quotas or rules of origin requirements, and that would be granted without the UK paying a penny into the EU budget, without the UK accepting the free movement of people, and with the UK accepting a much less onerous set of level playing field requirements than those demanded of EU member states.

Is it not a fact that what from our point of view might be considered a backstop is, from the European Union’s point of view, a back door? Does that not express the EU’s concern that we would be paying not a penny piece for something that would provide a material advantage—an unfair advantage, as some would see it—in terms of access to the single market?

My hon. Friend is right. Indeed, that fear reinforces the concern that the EU has about the important legal principle that a free trade agreement or association agreement with a third country cannot be based on an article 50 withdrawal agreement, which was intended by the treaty to cover the necessary legal arrangements for a member state’s departure from the Union. The Commission knows that for exactly the reason my hon. Friend gives, the longer any backstop were to last, the greater legal risk it would face of challenge in the European courts from aggrieved businesses, whether in the Republic of Ireland, France, Belgium or elsewhere, complaining that that principle was being breached to their commercial disadvantage.

We should not underestimate the importance of the guarantee of no hard border on the island of Ireland and no customs border in the Irish sea. It is no coincidence that the Northern Ireland business community is overwhelmingly and vocally supportive of this deal. However, there are aspects of the backstop that are and will remain uncomfortable. If it were needed, it would mean that a portion of EU law would apply in Northern Ireland for the duration of the backstop—about 40 pages of the 1,100 pages of single market acquis legislation.

The Government, as I said earlier, are mindful of the fact that we already have some regulatory differences between Northern Ireland and the rest of the country. We have sought, both in previous statements and in the package we put forward today, to identify ways in which the practical impact of any such requirements can be minimised, so that ordinary businesses and customers in Northern Ireland or Great Britain see as little change as possible.

I do agree. I will be corrected if I am wrong, but I am given to understand that, tragically, one of those sleeping just outside the entrance and exit to this place died in the past 24 hours, and that underscores the point that has just been made.

The words of the right hon. and learned Gentleman are that it is highly unlikely that there will be meaningful changes to this deal. If that is right, does he agree that it is vanishingly unlikely that a completely new deal along the lines that Labour, or indeed anyone else, might propose would also be agreed by the 29 March timetable? If that is right, and if it is also right that the EU would not extend article 50 to renegotiate a new deal, it effectively means that, by not supporting this deal, the Labour party risks becoming the handmaiden to no deal, and that is a real concern, does he not agree?

No, I do not accept that. I have had more conversations with people in Brussels than probably most people in this House about the question—the very important question—of what the position would be if the red lines that the Prime Minister laid down were different. The EU’s position in private is confidential. Its position in public has been repeated over and again. It has said that if the red lines had been different, a different negotiation could have happened. If the logical conclusion to the hon. Gentleman’s point is that we on these Benches must simply support whatever the Prime Minister brings back because no deal is worse, then that is an extraordinary position. It means that there is no critical analysis and no challenge even if it is a bad deal, or the wrong deal for the country, and that, somehow, we must support it because of this binary choice, and we will not do so.

I congratulate my right hon. and learned Friend the Member for Holborn and St Pancras (Keir Starmer) on securing this important debate.

We find ourselves in an historic situation as a country and as a democracy. Our country faces the real possibility of leaving the European Union in March 2019 without a deal having been reached in the negotiations. The consequences of such a scenario for trade, jobs, living standards, workers’ rights and the integrity of our country would be both profound and devastating, and we have a Government who are riding roughshod over our democracy by the way they are treating this Parliament. This Government were the first to be found in contempt of Parliament in modern times, and they continue to refuse to put their Brexit deal to a vote of this House. Taxpayers’ money is being wasted by this House and this Prime Minister by her touring Europe.

The Prime Minister insists that her deal is the best on the table for Britain, yet she continues to refuse to bring it to this House for a vote. That does not suggest to me that the Prime Minister has strong confidence in the contents of the deal. If she really believed that this is the best deal, she would be prepared to make the case for it in a meaningful debate and vote in this House.

I can remember the times when the Prime Minister repeatedly told the country that no deal was better than a bad deal. Now she tells the country that a bad deal is better than no deal—and this is indeed a bad deal. It fails to protect jobs and living standards. It offers no guarantees that workers’ rights, environmental standards and consumer protections will not be put at risk. It threatens the integrity of the United Kingdom, due to the backstop that is meant to prevent a hard border between Northern Ireland and the Republic of Ireland. The nature of that backstop, and the inability of the UK to leave it unilaterally, would turn our country into Hotel California. We could check out any time we liked, but we could never leave.

The Prime Minister has brought about some rare unity in the House. She has united Members from across the party divide against her deal. When it finally comes to the House for a vote, I am confident that it will be rejected. What worries me is that the Government continue to rule out the prospect of a no-deal Brexit that the Government’s own analysis has shown would be devastating for the economy. They should provide certainty for businesses, workers and communities by taking the option of no deal firmly off the table.

My constituents want an end to the political games that are being played in this House. They do not want the Prime Minister’s botched deal, which fails to protect jobs, living standards and workers’ rights. They do not want the European Research Group’s hard Brexit, which would devastate our economy, and they do not want the political opportunism of the Scottish National party, which seeks to use Brexit as its latest grievance to push for a second independence referendum. They want a Government who can negotiate a Brexit deal that unites the country and delivers a fairer Britain.

The hon. Gentleman’s Front-Bench spokesman has said that it is highly unlikely that the Government will get meaningful changes to their deal. Does the hon. Gentleman seriously think that the European Union, which has quite a lot of other things to think about, is going to contemplate any sort of radical, root-and-branch completely different deal that his party might come up with before the end of March?

I thank the hon. Gentleman for that question, because I was just about to go on to talk about a Labour Government.

A Labour Government will negotiate a strong single market deal and permanent customs union with the EU to protect our trade, jobs and living standards. A Labour Government will guarantee workers’ rights, environmental protections and consumer standards. A Labour Government will guarantee the rights of EU nationals living in this country, who contribute so much to our public services and society. We will address the underlying causes of Brexit by investing in our communities, tackling low pay, ending precarious employment and ensuring that our public services are run for people, not for profit.

I will finish up now, as it would be unfair to the next speaker to carry on. I reiterate the call that I put to the Prime Minister in the House last week: recognise that you have failed to deliver a Brexit deal that delivers for working people; recognise that you no longer command the confidence of the country; and give the people the opportunity to elect a Labour Government by calling a general election, so that we can get to work for the many people looking on at this Tory pantomime and this shambles of a Government.

As I speak today, we are just over 100 days from Britain leaving the European Union. There is no plan being debated in this House, no vote in this House and no plan B. Instead what we see, depressingly for many people outside this place, is just party politics. Last week, we had the spectacle of a potential Tory leadership campaign, which I voted against. This week, we have the shambolic Opposition attempt to try to decide whether they have the confidence to bring a no confidence vote. I think people have a sense of drift in Parliament at the very moment when they want decisions to be taken that can help to get our country back on track as the clock ticks down towards Brexit.

People also recognise that, as has been the case for the past two and a half years, we are not discussing anything else. The issues they face in their day-to-day lives are going missing in this Chamber. The challenges my constituents face—South West Trains, housing, tax credits, universal credit and so on—are not being discussed in this Chamber with the level of intensity that the British people need if we are to play our role as a Parliament scrutinising the performance of Government. We have to get back on to the domestic agenda. Until we solve Brexit, we will not begin to get on to solving the challenges that people face in their day-to-day lives.

I strongly respect my right hon. Friend, but if there were to be a second referendum and remain were to narrowly win, does she seriously think that that would draw a line under the European issue? Is it not far more likely that it would rumble on—and rumble on for a generation?

We have to accept that this country will always debate its relationship with the European Union and our neighbouring countries on the continent of which we are a part. We are a part of the continent, but we are an island just off the mainland of that continent. It is almost an inevitability that we will continue to debate how close our relationship should be with our European neighbours. We should accept that as normal, instead of obsessing about it as a Parliament and as a country when there are so many other, more pressing issues in the 21st century that we now need to get on with.

It is a great pleasure to follow the right hon. Member for Putney (Justine Greening). On her challenge, on the Order Paper today I have tabled the European Union (Revocation of Notification of Withdrawal) Bill, because I think that there is consensus in the House that we do not want a no-deal Brexit and the chaos that would bring, including the lack of medicines, the lack of food, and economic catastrophe.

What the Bill says, in essence, is that a deal should be voted on here; if it is agreed to, it should subsequently be voted on by the people; if they agree to it, we should go merrily along that Brexit route; but if it is not agreed to, we should remain in the EU, which would mean the revocation of article 50. That is what people expect of this place. They do not expect some sort of chaos. I accept that the Prime Minister has done her best in a difficult situation, going to the EU to negotiate and trying to bring together two irreconcilable models, the pure Brexiteer and the pure remainer, but it is obvious that the Government, and the whole country, are split.

The Secretary of State has said, “We have already had a vote; we cannot have another.” The simple fact is that if the Secretary of State went to a restaurant and ordered a steak and a bit of chewed-up bacon arrived, he would have the right to send it back. The waiter would not have the right to say, “You ordered some food—eat it.” People were promised more money, more trade, more jobs, and “taking back control”, including control of migration. All that sounded great, and I can imagine a lot of sensible people voting for it, but what has been served up is a situation in which there is not more money. There is the £40 billion divorce bill, and there is the reduction in the size of the economy. We do not have more control. The Ministers have taken the control so that they can reduce environmental protections or workers’ rights below EU minimum standards in the future. We will still, in the deal, have to abide by the rules laid down by Europe, so we have not taken back control at all.

As I understand it, the Opposition’s position is that there is no chance of the deal being improved and therefore the Government should have the vote now, but if that is the case, there is even less chance of Labour’s alternative deal being approved. That means that with every passing day, the inexorable logic is that Labour is becoming an accessory to no deal. Does the hon. Gentleman not agree?

My own view is that Brexit is a betrayal of conservatism, because we are withdrawing from the most well-constructed market in the world. It obviously denies the Union, because any Brexit will mean an open border with open migration and products moving freely. Ultimately, that will not work. If we have a hard Brexit, there will be a hard border. I also think that Brexit is a betrayal of socialism, because it will mean a smaller cake that we will want to divide more equally, and it will leave a future Tory Government to undermine EU standards and workers’ rights and the environment in the future.

I make no apology for the fact that I am against Brexit and always was. I want a people’s vote because people’s eyes have now opened to the fact that this is an absolute nightmare. They voted for the steak, they got the bacon, and they do not want it. They want to stay with what they had before.

Furthermore, the European Union (Withdrawal) Act 2018 itself empowers the Prime Minister to trigger article 50 on the basis of an advisory referendum. What we have found, and what the courts have found, is that the illegality in the leave campaign would be sufficient for a general election to be ruled void and for the Government to go back to the drawing board. I think that they need, legally, to think again about article 50, and if a deal cannot be agreed, they should withdraw it.

People talk about what will happen if there is another vote. Incidentally, this will not be another vote; it will be a vote on the deal, which is intrinsically different from a vote in principle on whether people want to stay in the European Union. I accept that people wanted to leave on the basis of what they were told, but now that they have seen what has turned up—the bacon—they do not want to eat it, and they should have the right to send it back. That would not be the same as just having another referendum. As Keynes said, “When the facts change, I change my mind.” People say, “What if we had another vote and lost?” We have already lost. Britain will lose if we Brexit.

People say that there will be a lot of anger. Obviously there will be some anger, but people who have been made poorer and poorer by a Conservative Government since 2010 were told, “If you vote for Brexit, we will get rid of the foreigners, and you will have a better job and better services.” In fact, they will have less. They will be even poorer. Those people will not be angry; they will be massively enraged.

We are walking slowly along the road to fascism. That is what is happening in this country. We face a choice between being impoverished and isolated—going down a darkened tunnel with no apparent ending—and seeing the future and returning to the sunny uplands. That means joining the EU again, giving the people the choice as to what to do, and creating a better, stronger future for all our children.

We are at a moment in history when we have to choose whether we give the people a vote or not. Our children will either condemn us in the future for condemning them or will thank us for giving them the opportunity to choose their future in a much better world we can all share—a world in which we can defend our shared values of human rights, democracy and the rule of law, rather than be cast aside, be much weaker, and find those values, in an uncertain world, under attack.

It is incumbent on us all to remember that it was this House that legislated for the referendum, and that promised people their views would be listened to and followed. It is therefore for us to deliver on the outcome of the referendum, as both our parties promised in their manifestos just last year.

It is vital that the House has its say on this crucial issue, so I am grateful for the Minister’s assurances, but 21 January is nearly six weeks away. Does he agree that that should be a deadline, not a target? If this matter can come back before the House, it should. We need to resolve this at the earliest possible opportunity.

T2. No deal will be damaging for both sides, so does my right hon. Friend agree that, in effect, to rule out supporting any agreement that the Prime Minister agrees with 27 other EU states on the basis of contrived tests puts politics before principle and does not serve the national interest?

It is a deeply irresponsible approach. I have to say that it is one that the Labour leadership have taken, but it is one that all Members on all sides might have to think about very carefully when we bring back a good deal from the EU.

I think that economic forecasts ought to be treated with a measure of caution, given their track record. I note that the hon. Gentleman always reduces any matter relating to Brexit to the Scottish National party’s blinkered, narrow political obsession with a referendum on independence, but I think that every part of the United Kingdom wants to see us strive to get the best possible deal, which will work for all corners of the UK.

It is encouraging that agreement has been reached to ensure that UK and EU nationals will continue to live broadly as before. Will my right hon. Friend encourage our European friends to publicise that progress? It is important to give British nationals the reassurance that they seek.

My hon. Friend is absolutely right. We have talked about that, and we have encouraged it. Of course we want to ensure not just that EU nationals whom we value and whom we want to stay feel secure in their position here, but that British expats are given the same treatment abroad.
